Deveney Nel murder

More charges?

More charges could be added to those laid against the teenager accused of stabbing schoolgirl Deveney Nel to death last year, the National Prosecuting Authority (NPA) has revealed.

In response to questions relating to reports stating that the teenager has now also been charged with rape, Eric Ntabazalila, spokesperson for the NPA in the Western Cape, told Hermanus Times : "The child in conflict with the law is currently facing charges of murder and defeating the administration of justice. No other charge has been added as we speak." He did say, however, that more charges against the 18-year-old could possibly be added before the trial commences in the Western Cape High court.

"The investigation is continuing, and we hope to be able to put all the charges to the accused when the matter is transferred to the High Court.

"On the day we will hand the indictment outlining all the charges we are levelling against the accused over. But presently he is facing these two charges."

The accused was found fit to stand trial after undergoing a month-long psychiatric evaluation at Valkenberg Psychiatric Hospital at the beginning of the year.

The accused was arrested on Friday 16 August 2024, hours after attending

a memorial service for Deveney that was restricted to staff and learners of Overberg High and their parents. The girl's body was discovered in a store room at the Caledon school during an extensive search, after she had been reported missing by her mother when she failed to appear for her lift from school to their home in Grabouw on Wednesday 7 August.

The accused, who was 17 at the time of his arrest, was initially held at a centre for youth in conflict with the law, but was moved to a regular prison after turning 18 in April. He will, however, still be tried as a minor under the Child Justice Act because he was legally a minor at the time of his arrest. It is also the reason he cannot be named.

The case against the young man was postponed last week in the Caledon Magistrates' Court to 23 July "for transfer to the High Court."

The accused's mother was also seen at the Grabouw Magistrates' Court on Friday when the case against two activists of the organisation One Billion Rising, an international

organisation fighting for the rights of all victims of gender-based violence, was heard.

Tanya Bippert, an activist for One Billion Rising, confirmed she and Lucinda Evans appeared in court to oppose a protection order aimed at prohibiting her from commenting about the case or making any posts on social media regarding the matter.

Speaking to Hermanus Times afterwards, Bippert reported that a trial date for the interdict application had been set for 8 August.

Bippert also expressed relief that her Facebook account was no longer blocked as a result of the interim court order granted after an application made by the mother of the young man accused of Deveney Nel's murder. In her application for the protection order the mother reportedly argued that her family, including her murder-accused son, had been threatened as result of Bippert's posts.

Evans told Hermanus Times that on seeing the alleged perpetrator's mother in court she was filled with "so much rage and hartseer" at the same time.

New substation boost for region

Amid grey skies and a light winter drizzle, Overstrand Executive Mayor Archie Klaas officially cut the ribbon at the ceremonial opening of the Birkenhead Substation on 26 June.

Although former Gansbaai Electrical Department Senior Manager Danie Maree was unable to attend the event due to ill health, he too was recognised for his significant role in the early stages of the project.

The Birkenhead 66/11kV substation is the largest electrical project ever undertaken by Overstrand Municipality. Situated just outside Gansbaai on the road to the Danger Point Lighthouse, the new substation will ease the burden on the existing network and ensure sufficient supply to support the region’s rapidly growing future development.

The substation project has been in the pipeline for over a decade. It was first proposed in the 2011 Overstrand Electricity Masterplan, and a 2019 load growth investigation report confirmed the need for a second supply point to meet rising demand in the Greater Gansbaai area. Without this upgrade, the existing network would have been unable to handle the projected

Evans referred to a case that stemmed from an incident in 2020, when the teenager accused of Deveney's murder was charged with the sexual assault of a young girl when he was only 13 years old.

A recommendation was made for the case to be referred to the Children's Court and that he be enrolled in a rehabilitation programme for sex offenders. This reportedly never materialised and the case was withdrawn in June 2023.

"If those recommendations were followed up Deveney would still be alive," Evans stated.

Readers have expressed disbelief, shock and outrage at the news that the mother of the young man who stands accused of stabbing the 16-year old Deveney Nel to death has applied for a protection order against two activists who have been extremely vocal from the start about the case that has gripped the nation.

Messages of support for Tanya Bippert and Lucinda Evans from One Billion Rising, an international organisation fighting to end Gender-Based Violence (GBV) and child abuse, streamed in ahead of and after the duo's appearance in the Grabouw Magistrates' Court on Friday to oppose the application.

Latifah Dirkse, an author and activist, wrote: "... I want you to know that you are not standing alone as you walk into that courtroom in Grabouw. Your courage, your voice and your commitment to justice for Deveney have already echoed louder than any attempt to silence you ever could.

"It is heartbreaking that instead of

centring justice for a life so violently taken the system is being used to try and silence those who fight for truth..."

In response to Evans' post on social media before the court, Dirkse stated: "As parents we have a responsibility to hold our children accountable, and not protect them when they cause harm. Covering up abuse, silencing victims and attacking those who seek justice is not parenting; it’s enabling... Let it be clear: We will not be silenced. We will speak for Deveney. We will fight for every child failed by adults who should’ve protected them. And we will stand... until justice is served."

In response to the Hermanus Times' article about the application against Bippert and Evans, another woman wrote: "Why? So the justice system can fail another victim of her son's (alleged) deeds?"

Another wrote: "Ons wat in Grabouw bly en Suid-Afrika moet weet wie die (beweerde) murderer is. (Residents of Grabouw and South Africa should know who the [alleged] murderer is.)"

One reader's opinion was that the murder accused's mother's attempt to silence the activists would raise the public's ire even further, saying: "Sy (het) nou 'n lat vir haar eie gat gepluk. Nou gaan die publiek eers teen haar draai (She has shot herself in the foot. Now the public will turn against her even more).

One woman, however, expressed sympathy for the accused's mother, stating that the woman herself has been a victim of people judging her for her son's alleged deeds. "As a mother she has been attacked, with horrible things being said about her... ," the reader commented.

Another also defended the accused's mother by saying: "She is not necessarily condoning his (alleged) deeds, but she wants to protect him against people who have already judged him and found him guilty before the trial has even started."

’n Vriend van die oorledenes het bygevoeg: “As ons hier vir ‘petty’ sake soos aanranding verskyn, kry ons nie borgtog nie, maar nou is iemand wat van drie moorde aangekla word, op borgtog vrygelaat. Hoe maak dit sin?”

Nyembezi, Tom en Tsepo Moahloli, wat besluit het om nie om borgtog aansoek te doen nie, is aangekla van Salies, Julies en Plaatjies se moorde. Die saak teen beskuldigde nommer een in die saak is teruggetrek.

Die ondersoekbeampte het getuig dat Tom uitgeken en verbind is deur die klere waarin hy kort ná die skietvoorval by die hotel gesien is. Die klere stem ooreen met die klere wat een skieter gedra het. Tom se prokureur het uitgewys dat daar “geen konkrete bewyse” is wat sy kliënt met die moorde verbind nie.

Die staatsaanklaer het aangevoer dat die ondersoek nog in ’n vroeë stadium is en dat die staat in dié stadium nie die beskuldigdes se skuld hoef te bewys nie.

Die landdros het hiermee saamgestem, maar gesê die kringtelevisiebeeldmateriaal is nie duidelik genoeg om die skieters positief te identifiseer nie.

Borgtog is dus aan Tom en Nyembezi toegestaan.

A reckless post could well cost you your job

In Edcon Limited v Cantamessa and Others (JR30/17) [2019] ZALCJHB 273, the Labour Court was asked to consider whether an employer has the right to discipline an employee for actions committed outside of the work environment. As a general rule employers do not have the authority to discipline employees for conduct that occurs outside the workplace and is unrelated to their work. However, as with any general rule, there may be exceptions.

In this case, Ms Cantamessa was employed as a specialist buyer by Edcon and held a senior position within the company. While on leave she posted a racist and derogatory statement on her Facebook profile, in which she indicated she was an employee of Edcon. The statement caught the attention of one of Edcon’s customers, who then reported it to Ms Cantamessa’s employer, expressing concern about this post, which gained substantial media traction.

It left Edcon with no alternative but to institute formal disciplinary proceedings against her, and she was dismissed.

Aggrieved by her dismissal, Ms Cantamessa referred an unfair dismissal dispute to the CCMA, where the Commissioner found in her favour and awarded her maximum compensation.

Unsurprisingly, Edcon approached the Labour Court to review and set the arbitration award aside. It based the review application on the grounds that the Commissioner had misconstrued the reason for Ms Cantamessa’s dismissal. The company contended that she was dismissed for posting a racist and derogatory statement on Facebook, which ultimately exposed Edcon to undue reputational risk.

Beware of tender scams

Theewaterskloof Municipality has issued an alert, warning the community, contractors and businesses about the circulation of fraudulent contract-award notices being sent by scammers.

“These fake notices are designed to appear authentic, often including our logos, fabricated signatures and falsified details,” said a spokesperson for the municipality.

“Scammers are not only using email to distribute these fake notices but are also making phone calls, including from the number 076 250 8493, among others, to inform individuals or companies falsely that tenders have been awarded to them. These scams are often aimed at obtaining personal or financial information under false pretences.”

The municipality urged the public not to respond to these communications and immediately to report any suspicious emails or phone calls to the municipality.

Residents, businesses and contractors should look out for the following indicating

the documents may be fraudulent:

• Poor resolution of municipal logos or inaccurate use of branding;

• Headings such as “Strategic Supply Chain Management” the municipality doesn’t use;

• Dates written in informal formats (eg. “Jan” instead of “January”);

• Inconsistencies in the use of pens or ink used to sign and date documents;

• Poor grammar, unprofessional language, handwritten elements and minor discrepancies in wording or formatting.

“These notices may look convincing at first glance, but are not issued by Theewaterskloof Municipality,” the spokesperson warned. Companies and contractors are urged to be vigilant and to verify any notice by contacting Theewaterskloof Municipality’s Operations Call Centre on 080 021 4730 or its finance department.

“Report any suspicious notices, emails or phone calls to us immediately. Protect yourself and your business from scammers,” the spokesperson cautioned.

Residents must take note

The Overstrand Municipality has warned residents to not fall for a disconnection scam from “Kelvin Ndlovu”.

“Overstrand Municipality will never contact you via WhatsApp to inform you your account is overdue or threaten to disconnect your municipal services unless you pay immediately,” Municipal Manager Dean O’Neill said.

The municipality’s official procedure for overdue accounts is as follows:

• If the municipality has your cellphone number on its system it will send an SMS notifying you that your account is in arrears and that the payment must be made within the following two days.

• If payment is not received within two days, a 14-day notice will be delivered to your physical address and, if available, to your email address.

• Only after this 14-day period without payment will municipal services be restricted or disconnected.

Municipal officials will never demand upfront payment to avoid disconnection. Any fees (such as reconnection fees) must be paid directly to the Municipality’s official bank account, either via EFT or in person at your nearest rates hall.

“Residents are advised not to respond to unsolicited job offers. We advertise jobs only in newspapers and on our website.”

In arriving at its decision the Labour Court considered whether there was a causal link between Ms Cantamessa’s conduct and Edcon’s business. It found that the fact that Ms Cantamessa’s Facebook profile indicated she was an Edcon employee did indeed establish that connection. The court accordingly held that her dismissal was fair even though the statement was posted on her private Facebook profile because it exposed Edcon to potential reputational damage.

CapeNature launched the 2025 State of Conservation Report recently at its annual Conservation Review, offering a clear, evidence-based view of the Western Cape’s biodiversity and how conservation efforts are measuring up.

Key themes emerging from the report include sustained efforts to build biodiversity resilience in the face of climate change, the value of strategic partnerships and the growing integration of monitoring data into planning and policy.

“This report is more than a reflection of where we stand environmentally. It is also a useful guide for decision-making in a way that strengthens both ecosystems and communities.

Conservation successes noted

in the report highlights close co-operation between government, private landowners, communities, research institutions and other partners. Stewardship agreements with private landowners continue to secure ecologically important land outside formal reserves, while survey and data partnerships with research networks have enhanced the accuracy and reach of biodiversity monitoring efforts.

Basketball is an increasingly popular sporting code in South Africa. With this in mind Paulitos Basketball Academy wants to promote this sport among the youth of Zwelihle as well as the broader Overberg region.

Paulitos was established earlier this year by Paul Dyantyi and Ndumiso “Ndura” Xorile, the team’s coach who is also a former basketball player.

“We want to show the youth that there are other sports besides rugby, soccer, cricket and netball,” Xorile said. “We want to promote basketball and develop local talent so they can be exposed to the professional leagues. I want to expose the youth to opportunities I never had

so they can one day become professional basketball players.

“Our biggest focus group is the young players from nine years old and up so that we can develop them from a young age in order to build a strong senior team for the future.”

Currently Paulitos Basketball Academy has approximately 30 players of different ages. According to Xorile the team is open to players of all ages, genders and races and from all areas.

Two of the biggest challenges they face, said Xorile, is the fact that they do not have suitable training facilities and that there are very few teams in the Overberg against which they can compete, leading to them having to travel to the Cape Metropole for games.

“We currently train at the old tennis courts close to the Zwelihle Taxi Rank.

“This isn’t ideal because the tar makes it easier to get injured and basketball is an indoor sport,” Xorile explained.

“I have reached out to Qhayiya Secondary School, where I previously coached the team while I was a learner, to ask if we could use their facilities, but have had no luck.”

To promote the sport of basketball further and to ensure its players are in top shape Paulitos Basketball Academy needs equipment such as basketballs, cones, hoops and a proper basketball court.

Xorile added: “We appeal to the community to assist us with donations that will help to cover travelling costs because we have to travel to Cape Town to compete and for our players to get the proper exposure so they may be selected to the provincial or national teams.”

Give basketball a boost

Recently, the team members took part in an event hosted by the Department of Cultural Affairs and Sport at Qhayiya Secondary School.

“We were so excited, but when we arrived we discovered that no other basketball teams had pitched up,” said Xorile. Hyped up for a match, the players quickly got their own mobile hoops to compete in a match against each other.

Despite these pitfalls Xorile and Dyantyi remain dedicated to growing the basketball academy and promoting the sport. Paulitos currently has approximately 30 players ranging in ages from 9 to 16. They train Mondays to Fridays, from 16:00, at the Zwelihle Tennis Court on the corner of Jikileza and Sisulu Streets.

The basketball players are struggling to find a suitable court where they can practise their skills. Paulitos Academy players currently train at the old Zwelihle Tennis Courts close to the taxi rank.
