THE TEMPERATURE IS DROPPING but the NCBIA is Heating Up! We have officially made it to fall! You know what that means right? Sweater weather, pumpkin patches, and football! It also means that we are so close to our annual clambake! This is a fall favorite, and we were super sad that we had to cancel it last year! The flyer can be found later on in this newsletter so I would highly recommend you sign up for it! Bring your significant other, coworkers, or clients for a fun night out where you could even win some money! Now I would be remiss if I did not mention our Battle of the Builders softball game. We all know that this is my most favorite event of the year and this year was definitely the best one we have ever had! And I am not just saying that because my team won! Jon Sherer’s team put up one hell of a fight but in the end, team Majzun was victorious! It only took my team 5 years to take the W so I am 100% going to bask in this glory! All of the fantastic pictures from that day can be found later on in this newsletter! Maria Sabala, our NCBIA photographer, always does such a fantastic job of capturing the pure intensity and adrenaline that happens at this event and we are so lucky to have her!

Associates!

Associate members support the industry in many different capacities as trade professionals, business suppliers, service providers, product manufacturers and more. More than two-thirds of our association members are associates. Associates come from a variety of fields that builders rely on to do business every day. Those relationships are the key to what make our industry thrive and our association a community. The value associates bring is not limited to the products or services they provide; it’s also seen in their interest in contributing to the growth and success of home building. Without them, our industry doesn’t exist. Not only are these members important to the success of his business, but they represent the type of members who bring strength in numbers to local and state associations and NAHB. The more support we have in the industry, the more voices we have and the more we are heard. Building and remodeling homes is not a one-person job. It takes a network of people from all different backgrounds to provide the expertise, skills, and hands-on work to make a project successful. Although builders may be at the forefront of the charge, it’s the associate members who often complete the puzzle. Those working relationships allow all members in our association to provide high-quality, safe homes for people. Partnerships between members also benefit the projects they work on. Doing business with Associate members means you will have industry allies whose services reflect the attention and care they put into their membership. Associate members have a business ethic that exemplifies their high moral character. They will go out of their way to help us in any time of need. The more these relationships happen, the better our businesses become. I believe their level of service, products and pricing make us more competitive and they truly become a big asset to our business operations and success. The association is here to build homes and change lives. It takes more than just builders to accomplish this. BUILDING MATERIALS PRICES: Large Increases Year to Date

A

lthough the recent drop in softwood lumber prices since mid May is helping bring costs down (after having driven them up drastically earlier in the year), the decline has been offset by large increases in the prices of several other building material products. The prices of these 10 have increased the most thus far in 2021, and all are up at least 30%: • • • • • • • • • •

Steel mill products Building paper and building board mill products Asphalt Plastic water pipe Fertilizer materials Laminated veneer lumber Thermoplastic resins and plastics materials Structural metal joists and concrete reinforcing bars Wood window and door frames Copper pipe and tube

Over the first seven months of 2021, the majority of these products’ prices have increased many times more than they did in 2020. The price change of steel mill products is the most glaring example, up 81.3% year to date following a 2020 increase of 11.1%. The prices of a subset of building materials were stable in 2020 but have seen substantial price increases in 2021. Some building materials and inputs to building materials have seen especially acute increases over the last three months. Of the goods analyzed here, nine experienced price increases exceeding 20% between April and July: • Laminated veneer lumber • Building paper & building board mill products • Fertilizer materials • Plastic water pipe • Fabricated structural metal • Other engineered structural wood members • Copper pipe and tube • Steel mill products • Aluminum base scrap

NAHB OPPOSES House Democrats' Plan for $2 Trillion in New Taxes

N

AHB is sounding the alarm to lawmakers as House Democrats within the Ways and Means Committee begin consideration of a massive overhaul of the tax code which would generate over $2 trillion in additional tax revenue over the next 10 years. While the legislation also includes critical and much-needed affordable housing investments, this is far outweighed by trillions of dollars in job-killing tax hikes — which risk broad harm to the still fragile economy — along with direct and indirect cost increases on housing. These changes are being considered to fund part of the Democrats ambitious Build Back Better plan, which focuses on what the White House refers to as “human infrastructure.” The most concerning tax changes in the plan would: • Increase the marginal tax rates on individuals as well as corporations; • Reduce 1202 gains for certain small business investors; • Increase the capital gains rate; • Expand the application of the Net Investment Income Tax to active income; • Limit 199A deductions; • Alter the estate tax that may affect family-owned businesses; and • Otherwise limit business losses. Many of these tax hikes will inevitably be passed along to new home buyers and renters and will result in a reduction of home building activity at a time when greater supply is urgently needed. NAHB is fully engaged with Congress and working to blunt or roll back these proposed tax increases. If the Democrats remain unified, the procedural process being used by the Democrats allows them to move forward without Republican support, avoiding the filibuster in the Senate. This process has been used various times by both parties to enact many policy priorities, including by Republicans to enact tax reform in 2017 and Democrats to overhaul the health care system in 2010.

September 13, 2021 The Honorable Richard Neal Chairman Committee on Ways and Means 1102 Longworth HOB Washington, DC 20515 Dear Chairman Neal: On behalf of the more than 140,000 members of the National Association of Home Builders (NAHB), I am writing in opposition to the Build Back Better Act proposals to be considered by the Ways and Means Committee this week. While the legislation includes critical and much needed affordable housing investments, this is far outweighed by trillions of dollars in job killing tax hikes—which risk broad harm to the still fragile economy—along with direct and indirect cost increases on housing. The vast majority of NAHB’s members are organized as pass-through businesses, and the collective effect of the proposed tax increases on our members is alarming. Among the most concerning are the increases of the marginal tax rates on individuals as well as corporations; eliminating 1202 gains for certain small business investors; increasing the capital gains rate; expanding the application of the Net Investment Income Tax to active income; limiting 199A deductions; making changes to the estate tax that may affect family-owned businesses; and otherwise limiting business losses. Many of these tax hikes will inevitably be passed along to new home buyers and renters and will result in a reduction of home building activity at a time when greater supply is urgently needed. The committee should carefully consider how these tax hikes may exacerbate the ongoing housing affordability crisis facing the United States. NAHB strongly supports many of the Low-Income Housing Tax Credit (LIHTC) provisions included in this package. The LIHTC is the most successful program to produce and preserve affordable rental housing in the country’s history, but it has historically lacked the resources to meet the overwhelming need for affordable rental housing. This bill takes meaningful steps to provide the program with the funding it needs. However, we remain concerned by retroactive tax changes to qualified contracts. We firmly believe that a fundamental principle of the program’s past and future success is the public-private partnership model, which depends on a mutual understanding that Congress will not retroactively alter the rules. NAHB also supports the long-term extensions included for many of the existing energy tax incentives. However, we oppose the structural changes made to the Section 45L new energy efficient home tax credit. Energy efficiency will not be served by relying on Energy Star for New Residential Construction as the sole means to qualify for the 45L tax credit. Every builder is familiar with energy codes, which has been the basis of qualifying for Section 45L since its inception. In contrast, Energy Star is a niche market—less than 10% of single-family and multi-family units were certified in 2020. The program has its merits but will never be adopted widely. Developers have indicated that the paperwork burden is onerous and would create an unnecessary layer of bureaucracy on top of the QC protocols already in place. Energy star adds restrictions on design choices that go beyond energy efficiency metrics.


Section 45L should remain an energy-focused credit. Designers and developers should also retain flexibility on the methods for achieving the expected energy performance levels. To that end, we believe that marketplace competition—including competition amongst various rating programs—is key to advancing energy efficiency. We believe this credit should continue to use the International Energy Conservation Code (IECC) as the reference point. We also encourage adding additional rating systems beyond Energy Star, including specifically the two highest tiers for the ANSI-approved 2020 National Green Building Standard: Gold, which is currently 15% above the 2018 IECC, and Emerald, which is currently 20% above. We believe strongly that the 45L credit should be achievable in the construction of any new home or apartment unit being constructed. Under this proposal, 45L will fail to serve the purpose of incentivizing broadly increased energy efficiency. NAHB regrets the Committees decision to move away from a broad credit based on a metric common to every new home built: the energy codes. Thank you for considering our views. Sincerely,

COMMUNITY PLANNING in a Post-COVID World

W

hat will residential communities look like after the COVID-19 pandemic subsides? Although sweeping changes aren’t likely, architects, planners and developers believe we’ll see: • • • •

A greater emphasis on remote working opportunities. Safer ways to socialize. Appealing amenities; and In general, creating places where people really want to be.

“I think there will be renewed appreciation for things we already have, particularly outdoor spaces that allow us to interact without making physical contact — specifically the front porch,” says Don Powers, AIA, CNU, LEED AP, founder and president of Union Studio Architecture & Community Design in Providence, R.I. Before automobiles, says Powers, Americans knew how to achieve the correct balance of being part of a community and being in their private realm. The front porch functioned as a social connector to neighbors and visitors passing by. Once automobiles came along, homeowners began entering from the rear where the garage was located, and lifestyles shifted to the backyard. He thinks the pendulum will swing back, and we are going to rediscover the street and the porch as an outdoor room. “When you’re on the front porch, you’re not in the street, but you’re not in the house,” he says. “You’re in a protected, semi-private space.”

Balancing Community and Privacy Some community-planning concepts are better suited to a post-COVID future, Powers says, specifically New Urbanism. “The movement has always been about re-forming the way we make communities to prioritize that kind of public and semi-public world, as opposed to the way that we, in the past 50 years, have de-prioritized it [by sending] everybody to the patio or backyard,” he notes. New Urbanist developments, which are purposely designed to create a sense of community, offer intentional gathering spaces but also plenty of opportunities for accidental interaction. Even multifamily buildings can provide a high-quality outdoor environment, Powers says, by incorporating: • • • • •

Walking paths and trails. Native plant materials. Good size trees. Pocket parks; and Community green space for residents.

Ken Ryan, principal of KTGY Architecture + Planning in Irvine, Calif., and head of the firm’s Community Planning and Urban Design Studio, thinks new community planning will focus on development that moves forward in smaller increments. “A continued push for a variety of housing product and affordability will also be present with smaller homes,” says Ryan. “Some of these will be allowed with traditional single-family detached neighborhoods, where jurisdictions are now adopting bylaws such as horizontal apartments.” Products such as this, he says, maintain a reasonable density but allow residents to live in a single-family detached configuration that is more compatible and acceptable in certain established neighborhoods.

Working Remotely Will Increase Although Powers doesn’t expect significant changes in community planning, he does foresee at least one permanent shift: more people will be working from home. “I don’t think we’re going to be fully remote once we get a chance to come back together, but I do think it’s going to be a bigger component of people’s lives,” he notes. This could mean an evolution in the work-at-home environment as well as community design, which might include more co-working spaces that are not necessarily a central office, he says. Ryan agrees: “Floor plans will need to accommodate flexible space for Zoom Rooms and a better working-at-home environment.”

Community as an Amenity In addition to finding safer ways to socialize and create a variety of spaces for working remotely, other factors, such as demographics, will also impact community planning going forward. But it isn’t just a matter of housing types and the amenity mix. “Understanding emerging and changing population factors — such as race, gender and age — will play an even stronger role in new community development,” says Ryan. “Successful communities that excel will not only provide specific services or uses or housing products that respond to a particular demographic, but those that connect to the human soul.” Over the next decade, Ryan expects community development to focus on urban infill, attainability, and healthy environments. Urban infill will be especially prominent because cities must find ways to provide more affordable housing. Accessory dwelling units (ADUs) will also become more commonplace in single-family detached neighborhoods. Communities such as agrihoods that promote health and wellness will also be development drivers because they embrace outdoor activities, eating right and exercise — all of which have cross-generational appeal. “I believe home buyers are looking for ‘Community as Amenity’ — meaning that no matter how large or small and whether urban or suburban, every project needs to embrace strong fundamentals of great neighborhoods,” says Ryan. “This includes pedestrian orientation, attractive streets, meaningful open space, a variety of housing, a safe public realm, and design elements that connect to the human experience.”

IS INFLATION Pressure Easing?

A

s the economy recovers from the COVID-induced recession, the costs of business inputs and consumer goods and services are rising. However, the Federal Reserve has indicated that it expects these high rates of growth to be transitory, thus allowing the Fed to move less aggressively with respect to increasing interest rates and tightening monetary policy, which will help improve future housing affordability. The building materials market presents some parallels to the Fed’s take on inflation. Despite declining costs for softwood lumber in recent months, overall year-to-date prices for residential construction materials are up 12%. A closer examination reveals a fundamental shift underway: Unlike last year when lumber prices were rising the fastest, in recent weeks it’s a surge in steel prices — up more than 80% so far this year. Although prices for many materials continue to rise, there are signs that production bottlenecks could ease in the coming quarters. This would help alleviate upward pressure on material costs. The impact on these higher prices will ultimately affect consumer inflation. In a sign inflation may be easing, August core CPI increased 4% over the last 12 months, down from July's 4.3% pace. Although unwinding of bottlenecks will help, increasing rents will push up inflation in the months ahead, as existing leases expire, and new leases are offered at higher prices. The labor market is the other economic sector to watch in terms of future inflation. There are almost 11 million open jobs, a clear indication of the ongoing labor shortage. In the construction sector, the jobs openings rate is trending higher: There are currently 321,000 open jobs compared to just under 300,000 a year ago. And although we expect the nation’s unemployment rate to continue to decline to below 5% by the end of 2021, this will make filling these jobs even harder while increasing wage-cost pressures on business owners.

STABILIZATION for Home Sales?

A

fter a run-up in home prices, sales have gradually slowed over the course of 2021, albeit off an unsustainably strong pace at the end of 2020. Recent data suggest that this cooling of housing demand, amidst insufficient supply, is now yielding a new trend line for housing activity. For example, existing home sales in July rose 2% from the previous month. This was the second consecutive month of increase, despite inventory remaining tight at just a 2.6-months’ supply. New single-family home sales increased 1% in July to a 708,000 annualized rate, after three consecutive months of declines largely because of prospective buyers increasingly getting priced out and some builders limiting sales. However, sales were 27% lower than a year ago, and inventory (including homes not yet started construction) has now risen to a balanced 6.2-month supply. Provided home prices do not increase further (up 18% year over year) beyond incomes, new home sales should return to their pre-COVID modest growth trend in the quarters ahead. New single-family home size is increasing as a result of changes in consumer preferences spurred by the pandemic. Demand improved for inner suburbs and medium-density neighborhoods, as townhouse construction had the best quarter in 14 years. Custom home building posted a 4.5% gain when comparing the last four-quarter total (187,000 starts) to the year prior. And single-family built-for-rent construction increased 8% over the same time period. Finally, multifamily construction continues to expand, recording its strongest quarterly starts total since 1987. –NAHB Chief Economist Robert Dietz

SEPTEMBER Update A recent news report caught my eye and piqued my continuing interest. The interest stems from two main areas: housing affordability, and the New York Times apparently encouraging housing affordability in the regulatory realm. From years of reviewing this topic, I sense a shift of opinions. I have been commenting, via letter, to the editor on various New York Times reports written on the subject of housing. Naturally, I asked they focus a bit more on the effect of regulatory impacts, but I never got a response. California, on the other hand, is the trend setter with regulatory inflated housing pricing. Impact fees in the tens of thousands of dollars, an average existing price of $800,000 and a race to singularly reverse climate change, are hallmark there. Their Governor, fresh from a recall victory, may sign some measures which will tilt the regulatory hand from local governments to the state with the goal of increasing the affordable housing stock by 3.5 million units over the next few years. While not realistic, it’s a refreshing number indicating how much affordable housing is needed due to regulatory neglect. This article also points to needed reforms. Next to the excellent read, The Color of Law, the article signals a realization that the role of government, through regulatory powers, has eliminated a class of Americans from a reasonable opportunity to own a home. Many local government officials claim restrictive zoning protects the interests of existing residents (NIMBYs), or school districts, who are unduly burdened by new residents.

Ohio is a home rule state where overcoming the municipal power of zoning is a major challenge. Planning regulations with counties and townships is a lesser challenge. School districts feel the state continuously underfunds them, and they are always ready to take the state to court. Many in the economic development field do not consider housing development as ‘economic development’. Others, believe the state has no standing in the affordable housing arena. With that, we disagree. As I mentioned in my last column, some legislators are becoming aware of the critical shortage of affordable housing, while others have been with us all along. We are very direct with our response: zoning referenda is a killer of housing development; environmental regulations need a reasoned hand in enforcing them, and school districts need to recognize homes are where children live. They have a right to benefits, as do all school age children, without having to pay an admission fee. Our government leaders must also acknowledge the need to provide affordable housing for all. If that requires limitations on local powers or setting targets for achieving needed housing goals, so be it. This has been the efforts of OHBA for many years. Let’s hope we can fulfill our obligations as a state. Our statewide and legislative leaders will have to do just that, lead.

SEPTEMBER 20, 2021 REPORT #9 LEGISLATIVE REDISTRICTING LIKELY HEADING TO COURT; CONGRESSIONAL WORK TO BEGIN A few minutes after the midnight deadline, the Ohio Redistricting Commission approved a four-year legislative map passed along party lines which is likely destined for a challenge before the Ohio Supreme Court. The new maps are for districts which will begin in 2023. The constitutional provision adopted by voters in 2015 gives the Supreme Court exclusive jurisdiction and would force the commission to reconvene if any map or district is determined to be invalid. With the legislature also likely to miss the initial September 30th deadline for drawing the Congressional map, the job will fall to the Redistricting Commission, which would have until Oct. 31 to adopt a 10-year map with the support of the commission's two minority members. Failure to meet that deadline, would kick the responsibility back to the General Assembly. Lawmakers would then have until Nov. 30 to adopt a map with the support of three-fifths of both chambers including at least one-third of Democrats. The General Assembly could also adopt a four-year map with a simple majority of both chambers under more stringent rules, which state the plan shall not unduly favor or disfavor a party or incumbents or unduly split or give preference to keeping whole governmental units. Those rules also instruct mapmakers to attempt to draw compact districts. Stay tuned and feel free to contact OHBA with any questions.

HB 107 Elevator Law (Baldridge, B.) To revise the Elevator Law.

LEGISLATIVE UPDATE

After passing the House before summer recess, HB 107 will be starting hearings in the Senate General Government Budget Committee this week. In prior hearings, the House committee heard concerns from elevator contractors from around the state who OHBA has been working with on HB 107. While residential elevators have been exempted already from the contractor licensing, OHBA has suggested changes to address the accessibility equipment also making up the business of the contractors who do the residential work. OHBA will continue to work on changes in the Senate to HB 107. HB 304 Smoke Alarms (Baldridge, B.) To amend the law regarding smoke alarms in residential premises. HB 304 is scheduled for its second hearing for proponent testimony this week in the House Commerce and Labor Committee. Over the summer, OHBA met with the bill’s sponsor to express concern over particular provisions of HB 304 which would mandate changes to the Ohio Building Code and Residential Code of Ohio dealing with installation of sealed battery smoke alarms in certain scenarios. OHBA explained to the sponsor the more appropriate venue for these types of changes would be the established petition process at the BBS and RCAC. OHBA will continue to work with the committee and representatives. The bill can be reviewed here: https://search-prod.lis.state.oh.us/solarapi/v1/general_ assembly_134/bills/hb304/IN/00/hb304_00_IN?format=pdf Interstate Pipeline Notice Legislation A final bill is being drafted for introduction which would require certain notice provisions for any new residential or nonresidential building development located in whole or in part within 660 feet of the center point of any natural gas transmission pipeline constructed or operated prior to the development. The bill’s sponsor and proponents have been in contact with OHBA asking for feedback. OHBA is paying particular attention to the timeframes and practical impacts if timeframes are not adhered to. Further, a similar bill has already passed in TN, and OHBA has been in page 50

RCAC VACANCY FILLED BY CINCINNATI BUILDER With Bill Kaufholz moving to fill a vacancy in the architect spot on the Residential Construction Advisory Committee, Andre Frazier, of Frazier Homes, has been named the newest homebuilder member of the RCAC.

U.S. DISTRICT COURT ORDER VACATES THE NAVIGABLE WATERS RULE In light of this order, the Army Corp of Engineers and U.S. EPA have halted implementation of the Navigable Waters Protection Rule and are interpreting “waters of the United States” consistent with the pre-2015 regulatory regime until further notice. The agencies continue to review the order and consider next steps. This includes working expeditiously to move forward with the rulemakings announced on June 9, 2021. It is important to note Jurisdictional Determinations (JD) issued prior to August 30, 2020 will not be revisited, those issued on or after August 30, 2020, will be revisited by the U.S. Army Corp. Any JD yet to be issued will be made by the U.S. Army Corp under the Pre-2015 WOTUS rules. Discussions on how this will impact the recent actions in Ohio with the ERAC appeal and HB 175 are ongoing.

NAHB’s tireless efforts to work with the White House, Congress and lumber producers to increase production and bring prices lower are showing some positive results but the fight is far from over. 2. The Supreme Court struck down the CDC eviction moratorium in late August. What many of you don’t know is that nearly all NAHB members had been exempt from the eviction ban since March 2021. And we continue efforts to ensure that our members have the tools to access any emergency rental assistance funding and assistance that is available. 3. NAHB calls on Congress to help boost housing production by acting to fix the building materials supply chain, improve the Low-Income Housing Tax Credit and reformulate current homeownership tax incentives. The White House has heard our message and announced steps to create and preserve nearly 100,000 additional homes over the next three years. 4. Recruiting is the lifeblood of the Federation. Please participate in NAHB’s “ONE in 21” campaign to recruit at least one new member this year. 5. NAHB members are invited to sign a Diversity, Equity and Inclusion compact to enhance a diverse and inclusive membership that represents all communities that seek the American dream of homeownership.

The White House has heard our concerns and recognizes the importance of finding solutions that will end production bottlenecks that have resulted in soaring material prices. At NAHB’s urging, a White House summit on building materials was held on July 16 with a diverse group of stakeholders. Representing the administration were Commerce Secretary Gina Raimondo, HUD Secretary Marcia Fudge and Director of the National Economic Council Brian Deese. NAHB stressed at this meeting that it is imperative that lumber mill producers boost production in order to meet rising demand. Home inventories are lean and the U.S. housing market is more than 1 million single-family homes short of what is needed to meet the country’s demand. The summit was an important step forward. All the participants recognized the need to resolve supply chain bottlenecks and the issue of rising material prices and supply shortages has been brought front and center to the Biden administration.

I want to stress that this White House summit on building materials was the culmination of a year-long effort where NAHB has been in the forefront in educating the public and policymakers about how rising lumber and building material prices are harming home builders, home buyers and the economic recovery. NAHB leaders have appeared on CBS This Morning and numerous times on Fox Business News. We have also been featured in Bloomberg, CNN Business, Fortune, CNBC and scores of local media outlets across the nation calling for action to address rising prices and supply shortages. Overall on the media front, we have earned more than $50 million in media coverage, with over 11,000 stories featured in national and local news. Effectively, we got $50 million in national publicity for free rather than having to pay for it. In the policy arena, we have reached out to virtually every member of Congress on this issue and held talks with top White House officials and Commerce Secretary Raimondo. Thanks to the outreach of NAHB and our grassroots membership, several House and Senate leaders have openly raised the issue of soaring lumber prices, housing affordability and tariffs with Secretary Raimondo and U.S. Trade Representative Katherine Tai. In fact, Secretary Raimondo addressed the NAHB Leadership Council on June 18 and said that “supply chain disruptions are at the top of my mind.” And we are also seeking swift action on the trade front. Tariffs on Canadian lumber shipments into the U.S. are exacerbating price volatility and increasing housing costs.

The U.S. Supreme Court on Aug. 26 ruled that it was unlawful for the Centers for Disease Control and Prevention (CDC) to unilaterally extend its eviction moratorium through Oct. 3, 2021. What you may not know is that thanks to the clout of NAHB, the CDC eviction moratorium has not applied to nearly all NAHB members since March 2021. In October 2020, NAHB filed a lawsuit contesting the federal eviction moratorium that began Sept. 4, 2020. In our case filed on behalf of all members of the association, a federal judge in the Northern District of Ohio ruled in March 2021 that Congress did not provide the CDC with the authority to issue such a moratorium. The court’s ruling prevented the CDC from enforcing its eviction moratorium order against NAHB members who were members at the time of the complaint -- but all other landlords nationwide had to comply with the CDC’s eviction ban. In other words, NAHB members who were members of the association as of October 2020 have not been subject to the CDC’s eviction moratorium since the federal court in Ohio issued its ruling in March. This court case clearly illustrates the value of NAHB membership. Separately, the recent Supreme Court decision means that NAHB members who joined the association after October 2020 and other landlords across the nation no longer must comply with the CDC’s federal eviction ban. However, all NAHB members and non-members must comply with state and local eviction moratoria.

Evictions Should be a Last Resort • •

On the lumber price front, many of you may have seen media reports about the recent sharp drop in prices. • While this is good news, the lumber crisis is far from over. Though framing lumber prices are down significantly from their peak in May 2021 and the current price trend is positive, lumber price volatility is at an all-time high over the past 12 months. Meanwhile, the price of oriented strand board, which has also declined in recent weeks, is still more than 100 percent higher since April 2020. Moreover, many builders have not been able to take full advantage of the recent drop in framing lumber prices because producers are still selling off lumber that they purchased from mills when prices were at or near their peak. So, when buyers read that lumber prices are coming down, builders need to educate them about this price lag.

Looking ahead, the NAHB advocacy team – Government Affairs, Communications, Economics and Legal – will continue to work doggedly to keep pressure on policymakers and industry stakeholders to ease production bottlenecks and protect housing affordability. And while NAHB members are not bound by the eviction moratorium, it doesn’t mean they should or will be engaging in mass evictions. And even when a landlord initiates eviction proceedings, this does not always result in an eviction. For non-responsive tenants, filing an eviction is commonly only the start of the conversation for alternative options. Keep in mind that as of mid-March, members of NAHB were not required to follow the CDC order thanks to the win in our court case. NAHB’s multifamily members did not engage in mass eviction proceedings back then and today they understand that the eviction process is clearly the last option. Landlords are working diligently with tenants to help them apply for rental assistance and to offer payment plans. NAHB has actively advocated for emergency rental assistance to help renters and landlords impacted by the COVID-19 pandemic and to protect the viability and stability of the rental housing industry. Federal funds are available to assist renters. NAHB continues to urge members to seek access to the Emergency Rental Assistance Program through their local government and state housing finance agencies. While a large portion of the $46 billion that congress appropriated

for emergency rental aid has not been disbursed, Treasury has announced new steps to help state and local governments to expedite aid to renters and landlords in need.

Tools to Work with Tenants •

Landlords don’t want to lose a good tenant who is falling on hard times. They want to work with them. But oftentimes, many tenants who are in arrears on their rent payments become fearful and actively avoid any contact with their landlords. Landlords are then unable to provide their tenants options to assist them if they are nonresponsive. Which is why many of NAHB’s multifamily members are working to help connect their tenants with necessary funding to help ensure that their payments are current. To assist in this outreach, NAHB has provided our multifamily members a sample script that landlords can use to contact tenants and walk them through the steps to apply for assistance and/or request permission to apply on their behalf. The script, and other multifamily COVID resources, can be found on the Multifamily and Affordable Housing Resources for COVID-19 page on nahb.org. The bottom line is that property owners understand that evictions should only be made as a matter of last recourse and will continue to do everything in their power to help their tenants to access rental assistance and/or to enter into a reasonable payment agreement.

NAHB CEO Jerry Howard is calling on lawmakers to enact policies that will help home builders expand the housing supply, reduce the housing deficit and improve housing affordability and opportunity for all Americans. • In a July 14 hearing before the House Ways and Means Subcommittee on Oversight, Howard encouraged lawmakers to act on three key issues: 1. Fix the building materials supply chain. This is key to constructing more housing and reducing the housing deficit. Regarding the current lumber crisis, the U.S. must immediately engage with Canada to adopt a new softwood lumber agreement and stop the imposition of harmful tariffs on Canadian lumber. 2. Improve the Low-Income Housing Tax Credit (LIHTC). Congress needs to enact H.R. 2573, the Affordable Housing Credit Improvement Act. The bill would finance more than 2 million additional multifamily units over the next decade by increasing the amount of credits allocated to each state and expanding the number of affordable housing projects that can be built using private activity bonds. 3. Reformulate current homeownership tax incentives. Recent tax changes have undermined the effectiveness of the mortgage interest deduction, resulting in fewer middle-class taxpayers itemizing and incentives flowing more to high-income households. A shift away from the mortgage interest deduction to a permanent homeownership tax credit that is targeted to lower- and middleincome Americans would make homeownership more accessible to hardworking American families. • The Biden administration has heard our message. On Sept. 1, the White House announced several steps to create and preserve nearly 100,000 additional homes over the next three years. • In an official statement, NAHB Chairman Chuck Fowke commended the administration for its newly announced plan to increase the affordable housing supply and said it is important that the plan includes tangible policies to incentivize new residential construction. • “We look forward to working with the administration in the effort

Why Enter? ◊ Circle of Excellence celebrates the top projects completed by the finest builders, remodelers, and associates of the North Coast Building Industry Association (NCBIA). ◊ Winning a Circle of Excellence award allows your company to advertise to consumers as an “award- winning” company.

Eligibility ◊ The candidate must be a NCBIA member in good standing. ◊ Entry must have been created, produced, or marketed between November 1, 2020 and October 31, 2021.

Entry Preparation ◊ Complete entry must be received by the NCBIA no later than November 16, 2021. There will be no exceptions to entry deadline. ◊ Entry may be submitted via email with one attachment of required items, or in a binder delivered to the NCBIA office. ◊ Payment of the entry fee must accompany entry. ◊ Each entry must be sent separately, clearly marked with what category it is for and who is submitting it.
