LETTER FROM THE PRESIDENT

THE NCBIA IS Ready for Summer! The weather is warming up and things are finally starting to feel like they are back to normal! Our Installation, Hall of Fame, and Circle Of Excellence event at the beginning of May was proof of that! It was so great to have so many of our members, family and friends together again to celebrate such a wonderful evening! I just want to say that night was most definitely one of my most favorite nights of my life! To have my grandfather, my father and my NCBIA family there together again just dancing the night away was one of the greatest feelings! Later on in this newsletter you will get to see pictures from that night as well as of our 2020 Circle Of Excellence winners! It had been 15 years since we gave out these awards and I need to give another big CONGRATULATIONS to all of our winners! There was definitely some tough competition, and all of our winning individuals and companies were so deserving! We will be bringing the Circle of Excellence Awards back every year moving forward so make sure if you have projects you and your company are working on take lots of good before and after pictures! I cannot wait to see all the beautiful entries we get at the end of this year from our builders, remodelers and associate members!

We have lots of exciting stuff planned over the next few months! Be sure to come out to Rush Inn in Avon on Wednesday June 9th at 5pm for our 2nd member mixer of 2021! The last one we had at Captains Club in Amherst we had over 50 people in attendance! This is a GREAT opportunity for some of our newer members to get the opportunity to meet our veteran members and make some good business connections. And then on June 25th we have our Summer General Membership Meeting and Cookout at Pogie’s Clubhouse! This event is always a favorite among the members! We may even have a few tricks up our sleeves for this years event so be sure to get signed up asap! As always watch your weekly eNews to see what other great networking opportunities are coming up! Between our young professionals Night at the Crushers game in July and our Golf Outing and Battle of the Builders softball game in August, there will be plenty of opportunities for us to all get together! We are also working on some new and great educational opportunities exclusively for our members! Is there something that you have an interest in learning about or a topic that you think others might be wondering about? Or maybe you have a class that you might be willing to offer to our members? Gary Alan Butchko, age 80 a lifelong resident of Lorain passed away at home on Thursday, April 22, 2021 after a lengthy illness. He was born on May 2, 1940 in Lorain, Ohio to Paul S. and Sue (nee Muhar) Butchko. Gary was a 1959 graduate of Lorain St. Mary’s High School and attended Finn College.In 1961 Gary established Butchko Electric Company. He also served as a certified State Inspector for many years. Gary was an entrepreneur and possessed an amazingly strong work ethic. He had a great respect of nature and enjoyed spending time in the outdoors and shared that love with his family. Bringing his wife roses, ballroom dancing, traveling the world, enjoying fine wine and food, and listening to opera music, especially Luciano Pavarotti, brought him much joy. He really enjoyed being around people and sincerely loved listening and learning their stories. Gary was dedicated to his work, wife, and family.Gary is survived by his wife of 60 years, Caroline (nee Nicola); children, William (Tracy nee Nishanian) Butchko, Christopher (Judy) Butchko, Robin (Gustavo) Rodriquez; and Dr. Gary Jon (Sarah) Butchko; grandchildren, Marco Rodriquez, Alex Rodriquez, Joseph Butchko, Jon Robin Butchko, Garrett Butchko, Kristen Butchko, Natalie Butchko, Juliana Butchko, Caroline Butchko, and Emelia Butchko; and his sisters, Maryann “Nikki” (Alastair) Leonard, and Carol Sue (Dr. Lawrence) Gans.He was preceded in death by his parents, Paul and Sue Butchko; brother, Sydney Butchko, and sister-in-law, Carol Ann Butchko.The family will receive friends on Sunday, April 25, 2021 from 1:00 – 5:00 p.m. in the Dovin and Reber Jones Funeral & Cremation Center, 11110 Cooper Foster Park Road, Amherst. Mass of Christian Burial will be held on Monday, April 26, 2021 at 11:00 a.m. at St. of Anthony of Padua Catholic Church, 1305 E. Earie Ave., Lorain, Ohio. (EVERYONE PLEASE MEET AT CHURCH). Rev. Programs include courses and seminars, offered by in-person and online. Plus, NAHB professional designations provide opportunities to improve your skills and advance your career.

Online Learning In NAHB’s learning portal, you will find and access on-demand course and live online courses, webinars, replays and more. You can also track your online education via your online learning transcript.

International Builders’ Show (IBS) The annual NAHB International Builders’ Show® (IBS) offers attendees more than 150 education sessions during the three-day event. Certified New Home Sales Professional: Master the craft of successful selling and launch your new home sales career with the Certified New Home Sales Professional (CSP) educational designation. Graduate Master Builder: The ultimate symbol of the building professional, the Graduate Master Builder (GMB) designation is for experienced veterans only. Graduate Master Remodeler: The Graduate Master Remodeler (GMR) professional designation is held by a select group of building industry professionals: applicants must have at least 15 years of remodeling experience before they are even eligible to be considered for the designation. Housing Credit Certified Professional: The Housing Credit Certified Professional (HCCP) is a specialized designation for developers, property managers, asset managers and others working in the affordable housing industry through the Low-Income Housing Tax Credit (LIHTC) program. Master Certified Green Professional: As green and high-performance construction turns to the mainstream, experienced green industry professionals seek an educational designation that signifies their long-standing commitment to and experience with sustainable building and remodeling. Master Certified New Home Sales Professional: Professionals who hold the Master CSP designation have been provided knowledge to grow their careers in new home sales. Master in Residential Marketing: The Master in Residential Marketing (MIRM) represents the pinnacle of new home sales education because it represents years of industry experience, serious coursework requirements and a one-of-a-kind requirement for a successful case study to complete the designation.

Biz Tools NAHB members gain a competitive edge with NAHB’s Business Tools: members-only tips and management strategy to build your company, boost your marketing and gain business know-how. Get legal assistance and resources from NAHB’s team of lawyers. Network with other NAHB members and find out what home buyers want. • • • •

LANDS Program The NAHB Legal Action Network for Development Strategies (LANDS) is designed for experienced land use and environmental attorneys who focus at least half their practices on home building and development issues. Members enjoy networking opportunities combined with cutting-edge, advanced-level education seminars. In addition, NAHB sometimes asks LANDS attorneys to serve as outside counsel and connects these attorneys with state and local HBAs and individual builder members. LANDS provides the medium for development-side land use and environmental attorneys to form the strategies necessary to succeed in the courtroom through: • •

An annual Roundtable & Workshop CLE, which offers LANDS members the opportunity to participate in advance-level discussion, interaction, and training on land use and environmental issues. Timely updates and alerts on important land use and environmental updates.

Land-use decisions are better when they reasonably allocate public and private burdens, respect constitutional principles and are consistent within jurisdictions. HOW BUILDERS ARE DEALING with Rising Lumber Prices

A

s NAHB continues to work tirelessly to combat rising lumber prices and supply shortages by aggressively engaging with the Biden administration and members of Congress, builders who are on the frontlines are engaging in several strategies to mitigate this unprecedented price surge that is raising housing costs and impacting their bottom lines. NAHB recently asked builders about their reactions to the rising and volatile lumber prices in its April 2021 survey for the NAHB/Wells Fargo Housing Market Index (HMI). Nearly half (47%) of single-family builders in the HMI panel indicated that they were including price escalation clauses in their sales contracts as their primary mitigation effort. “It’s been a difficult time for us and homeowners,” Jeremy Burke, a remodeler in Pennsylvania, shared through NAHB’s online lumber testimonial form. “We have had to prepare contracts with clauses for material change orders when materials cost rise — which I fear means we will lose contacts and/or projects for those who can’t afford the extra costs.” Other efforts include pre-ordering lumber (29%) and obtaining lumber price guarantees from suppliers (22%). According to responses, prices were typically guaranteed for 15-29 days (42% of respondents reported) or 30-59 days (33% of respondents reported), for a median length of 28 days. “We are pricing each unit on a case-by-case basis, and only after we have a commitment on actual lumber costs for that unit,” noted Thomas Troy, a builder in New Jersey, in a testimonial. “We are at the point where we are withholding new sections in some projects.”

Nearly one in five builders (19%) have also, unfortunately, had to delay building or sales when costs spike, and 15% indicated they are laying the foundation but pausing before framing. This puts further strain on the much-needed housing supply necessary to help make housing affordable. “We have always prided ourselves on being able to provide affordable housing to our local market, while also being financially prudent to the best practices in the building industry,” stated Michael Welty, a builder in Colorado, in a testimonial. “When you couple these price increases with the limited amount of supply that currently resides in our housing market, the current conditions are creating an escalating market that in our opinion will eventually be unsustainable.” Paul Emrath, vice president of surveys and housing policy research, provides more analysis and details in this Eye on Housing post. THE MOST COMMON REASON Active Buyers Can't Close the Deal

A

recent Eye on Housing blog post revealed that 64% of buyers who were actively engaged in the process of finding home in the first quarter of 2021 have spent upwards of three months searching for a home without success. The most common reason long-time searchers have come up empty-handed is not because they can’t find a home at an affordable price (32%), but because they continue to lose out in bidding wars (45%), according to survey results from NAHB’s most recent Housing Trends Report. The reasons are flipped from a year earlier, when 40% cited unaffordable prices and only 23% because of better offers by other buyers. When asked what they are most likely to do next if still unable to find a home in the next few months, 50% of active buyers searching for three-plus months will continue looking for the ‘right’ home in the same location – about the same percentage as a year earlier. On the other hand, 42% will expand their search area, an increase from the 34% willing to take that step a year earlier. Difficulties finding a home to buy will likely lead 25% of active buyers to give up until next year or later, up from 16% a year earlier. Historical data show a steadily rising trend in the share of longterm searchers likely to quit looking for a home until next year or later, as the latest increase marks the fifth year-over-year rise in this metric. BUILDER CONFIDENCE Edges Up as Strong Demand Offsets Supply-Side Challenges BY: ROBERT DIETZ

trong buyer demand pushed builder confidence up in April even as builders continued to grapple with rising lumber prices and supply chain issues and consumers faced higher home prices due to a lack inventory. The latest National Association of Home Builders (NAHB)/Wells Fargo Housing Market Index (HMI) shows that builder confidence in the market for newly built single-family homes rose one point to 83 in April. Despite strong buyer traffic, builders continue to face challenges to add much needed housing supply to the market. The supply chain for residential construction is tight, particularly regarding the cost and availability of lumber, appliances, and other building materials. While mortgage interest rates have trended higher since February and home prices continue to outstrip inflation, housing demand appears to be solid for now as buyer traffic reached its highest level since November. NAHB’s forecast is for ongoing growth in singlefamily construction in 2021, albeit at a lower growth rate than realized in 2020. Derived from a monthly survey that NAHB has been conducting for 35 years, the NAHB/Wells Fargo HMI gauges builder perceptions of current single-family home sales and sales expectations for the next six months as “good,” “fair” or “poor.” The survey also asks builders to rate traffic of prospective buyers as “high to very high,” “average” or “low to very low.” Scores for each component are then used to calculate a seasonally adjusted index where any number over 50 indicates that more builders view conditions as good than poor. The HMI index gauging current sales conditions increased one point to 88 and the gauge charting traffic of prospective buyers posted a threepoint gain to 75. The component measuring sales expectations in the next six months fell two points to 81. Looking at the three-month moving averages for regional HMI scores, the Northeast rose six points 86 and the South moved up one point to 83. A

number of unsustainable trends have developed in the housing market. The combination of a decade of underbuilding, favorable demographics, historically low interest rates, and a shift in consumer preferences have pushed single-family housing demand to the strongest levels in over a decade. However, there is simply not enough resale inventory to meet demand. Existing single-family inventory in March stood at a very lean 2.1-month supply — less than half of what a healthy market needs. Consequently, median resale pricing increased 17.2% year over year to more than $329,000. This magnitude of price growth — far in excess of underlying income growth — is not sustainable over the long run. The best means of protecting housing affordability is to boost inventory by increasing new home construction. Although home building is moving at its fastest pace since 2006, inventory stands at a thin 3.6-month supply. Moreover, inventory and sales of new homes are increasingly coming from homes that have not yet started construction, with this count up 150% over the last year. With the strong pace of single-family starts, building materials prices continue to rise on short supply. While not limited to lumber, lumber pricing is now up nearly 250% from a year ago, adding close to $36,000 to the average price of a new single-family home. A recent NAHB survey revealed that as a result of higher material costs, almost half of builders are including price escalation clauses in contracts, 29% are pre-ordering lumber prior to need, and 19% are delaying some building activity. Given these price increases for materials and existing housing, some analysts are talking about bubbles. However, the market is not in a bubble because this price growth is predominantly driven by lack of supply and true demographic demand (as opposed to loose mortgage underwriting). Nonetheless, the current pace of housing price growth is pushing affordability down. And clearly, inflation pressures are building in the economy. The question for the Federal Reserve is whether these forces will be long lasting or transitory as the economy restarts after the unusual recession of 2020.

LAWMAKERS URGE ACTION on Lumber: U.S. Trade Rep. to "Push for Solutions to the Lumber Pricing Issues"

M

embers of Congress and the Biden administration are heeding the concerns of NAHB and its grassroots on the need to take action to resolve soaring lumber prices, supply shortages and tariffs that are hurting home builders, home buyers, the housing sector and the economy. (View a video montage of policymakers discussing the issue at the end of this blog post.) U.S. Trade Representative Katherine Tai told Senate lawmakers that she would “push for solutions to the lumber pricing issues” and address the issue of tariffs on Canadian softwood lumber imports into the United States during a May 12 Senate Finance Committee hearing on President Biden’s 2021 trade policy agenda. Tai reiterated her willingness to act on this issue 24 hours later during a House hearing in which four bipartisan lawmakers spoke about the need to seek remedies for rising lumber prices by boosting production and ending tariffs on Canadian lumber imports into the United States. During the House hearing, Rep. Kevin Hern (R-Okla.) submitted a statement of record from NAHB where we stated that “resolving the long-running dispute with Canada over the trade in softwood lumber and addressing the steel and aluminum tariffs must be a top priority of Congress and the Administration. Building safe, decent and affordable housing depends in large part upon a stable and affordable supply of building materials.” Separately, Sen. Jerry Moran (R-Kan.) delivered a Senate floor statement on lumber on May 11 where he cited NAHB statistics on how rising lumber prices have added nearly $36,000 to the price of a new home and a $13,000 increase in the market value of a multifamily unit. Moran called for the elimination of lumber tariffs and to “boost the domestic types of the types of lumber used in home construction.” Finally, Sens. Moran and Jeanne Shaheen (D-N.H.) sent a joint letter to Tai this week stating that “the complete elimination of these [lumber] tariffs is necessary to provide relief from rising lumber prices. American home buyers, not Canadian lumber producers, are the ones who end up paying the cost of these trade restrictions.”

Senate Hearing Highlights Sen. Charles Grassley (R-Iowa): Yesterday I met with the Iowa Association of Home Builders. They told me that lumber prices had skyrocketed tremendously. They gave me a figure of 300% since April page 30

2020. Have you had conversations within the administration on what can be done to lower the 9% tariff on Canadian lumber? U.S. Trade Representative Tai: This is not just something we’ve been talking about within the administration but something that I’ve raised directly with my Canadian counterpart and I’ve certainly heard a lot from members of Congress about this as well. I want to assure that I will be raising this again with my Canadian counterpart at the free trade commission meeting of the USMCA and I will continue to push for solutions to the lumber pricing issues that we are experiencing. Sen. Bob Menendez (D-N.J.): I’ll submit a question to you [Tai] about whether you are working on a new softwood lumber agreement with Canada. I keep hearing from housing people that it is incredibly challenging. Sen. John Thune (R-S.D.): The home builders, the realtors, everybody in my state is talking about the cost of lumber and how that’s driving up housing costs in this country and really curtailing new construction because just pricing homes in a way that is outside the reach of a lot of families in this country. One of the issues they consistently raise are the tariffs on lumber coming in from Canada. Can you speak to that issue and what’s being done to address that and the impact that those tariffs have on the cost of lumber in this country and ultimately on the cost of housing? U.S. Trade Representative Tai: The free trade commission that is required to meet within the first year of the USMCA is meeting next week and I will be raising our concerns with the Canadians. But obviously I look forward to continuing this conversation with you and the many other members of Congress who have raised concerns about this on both sides of the issue.

House Hearing Highlights Rep. Mike Thompson (D-Calif.): I appreciate how the pandemic has exacerbated trade issues and disrupted supply chains. This has a real life impact on my district where we just lost thousands of homes because of the deadly fires that we experienced. The surge in lumber prices is making it harder to rebuild. This is hurting real people already reeling from these fires. One way that we can help address this is by doing away with the tariffs on Canadian softwood lumber. Rep. Steven Horsford (D-Nev.): I know earlier Mr. Pascrell [Democratic congressman from New Jersey] raised the issue around the lumber issue. I joined in that letter to you and would just ask that we receive a follow up. I am particularly concerned in Nevada with the rising housing costs and how its impacting people who are able to access affordable or attainable or workforce housing particularly as those costs escalate. Rep. Kevin Hern (R-Okla.): At present, the U.S. and Canada lack an agreement governing the trade of softwood lumber. U.S. home buyers, home builders and everyone who participates in the supply chain is suffering due to these unnecessary cost increases. Last week, you in your response to Sen. Moran inquiring about the rising cost of lumber. You stated quote: “This will always be important to U.S.-Canadian relations. We have raised these issues with my counterpart already. Softwood lumber will always be in my sights. We have a lot of tools and plans to use them robustly and raise the concerns we have and engage our Canadian counterparts on how to manage longstanding differences and think outside the box.” Ambassador, can you clarify what specific tools you plan to use? U.S. Trade Representative Kai: We have a lot of tools. There’s a NAFTA chapter that’s been brought into USMCA. Those are trade remedies that written into our trade agreement. We have our trade remedy provisions here in U.S. law. I’d be willing to sit down with my Canadian counterpart and think, “Hey, is there anything else that hasn’t been tried before that we could try?”

Highlights from Sen. Moran’s Senate Floor Speech on Lumber The reality is that record high lumber prices are putting the American dream of a home of homeownership out of reach for hundreds of thousands of potential home buyers and disproportionately harming middle- and low-income families across our nation. At a time when residential home building is booming, it is essential that home builders and consumers have access to the materials they need at competitive prices. In April 2017, the US Department of Commerce announced countervailing duties averaging 20 percent on softwood lumber products from certain Canadian producers. In December of 2020, the average tariff was reduced to 9 percent. While a reduction in tariffs for some Canadian producers is a step in the right direction, the complete elimination of these tariffs is necessary to provide additional relief for rising lumber prices. In addition to working to resolve this trade dispute, we should also work to boost the domestic production of the types of lumber used in home construction. Additional lumber can and should be sustainably harvested from public lands managed by the U.S. Forest Service and the Bureau of Land Management. Adding to the existing lumber supply and ensuring that domestic sawmills are operating at full capacity will help soften lumber prices. APRIL Showers Typically, April showers mark the beginning of the growth season. However, in politics it merely is another month of endless politicking. Might as well get used to it as there is no end in sight. While just ending an exhausting presidential election and shift in the balance of political power in DC, we already have two special congressional elections facing Ohioans. With the ascension of Marcia Fudge to Secretary of HUD and Steve Stivers to the Ohio Chamber of Commerce, vacancies must be filled by special elections this fall. Already a bevy of candidates are sniffing around for the job. I wish them well raising the hundreds of thousands necessary to be a viable candidate. Activity in Ohio is a bit subdued. Billions in federal relief money made passage of the state budget in the House relatively easy. The senate now has a crack at it. One difference this time is school districts and local governments seem satisfied as enough money was directed to them keeping them in check. Otherwise, the usual number of trades licensing bills are being considered. And not to forget a number of House members are already campaigning to be the next Speaker a mere year and a half from now. Without question now is the concern over skyrocketing lumber prices. This is a national issue as well as in Ohio. We are checking all possible resources for information and/or relief. NAHB is working overtime on it as well. It is frustrating in that no one can pinpoint a culprit or circumstance as the root of the problem. Nonetheless we will keep at it until some relief is secured.

Key NAHB Housing Issues

U.S. market.

1. As lumber prices remain stubbornly high, NAHB continues to work with the White House, Congress, and lumber producers to increase production and bring prices lower. 2. NAHB’s recent legal victory in the U.S. District Court for the Northern District of Ohio means that the CDC’s federal eviction moratorium has been set aside for all members. However, the eviction moratorium may still apply to landlords who are not NAHB members. 3. President Biden’s broad COVID-19 relief package contains several provisions to help our members, including $175 billion in low-interest loans for small businesses, $15 billion in grants to small businesses and an additional $25 billion in rental assistance to help renters and landlords. 4. The $2 trillion infrastructure package unveiled by President Biden at the end of March includes more than $200 billion for housing to build, preserve and retrofit more than 2 million homes and commercial buildings. At the same time, the plan includes troubling labor provisions and tax hikes to pay for the plan. 5. Get Involved in NAHB’s premier grassroots lobbying event, Bringing Housing Home®, on May 3-7. 6. NAHB opposes the FAIR Act, legislation introduced in the House and Senate that would effectively eliminate the use and availability of predispute arbitration agreements in residential construction contracts. 7. NAHB has launched the IBSx Education & Showcase, which provides registrants with full access to the on-demand IBSx demos and education sessions, as well as a newly enhanced IBSx exhibitor directory.

Rising Lumber Prices •

As lumber prices remain stubbornly high, NAHB continues to work relentlessly with the White House, Congress, and lumber producers to increase production and bring prices lower. This is the top priority for the association. Lumber prices have more than tripled over the past 12 months and this has caused the price of an average new single-family home to increase by $35,872, according to new analysis by the NAHB Economics team. This lumber price hike has also added nearly $13,000 to the market value of an average new multifamily home, which translates into households paying $119 a month more to rent a new apartment.

Why Lumber Prices Have Surged •

Since President Biden was sworn into office in January and the new 117th Congress was seated, NAHB has taken the following actions: o NAHB Chairman Chuck Fowke and First Vice Chairman Jerry Konter held in-person and virtual meetings with congressional leaders earlier this month to urge them to address rising lumber prices and to take steps to ensure an adequate supply of lumber and other building materials to stem rising housing costs. o In an effort led by NAHB, more than 35 organizations recently sent a joint letter to Commerce Secretary Gina Raimondo calling on her to “examine the lumber supply chain, identify the causes for high prices and supply constraints, and seek immediate remedies that will increase production.” o NAHB has also sent letters to President Biden, Agriculture Secretary Tom Vilsack, U.S. Forest Service Chief Victoria Christiansen and U.S. Trade Representative Katherine Tai seeking prompt action to address this issue that is a growing threat to housing and the economy. o NAHB remains in close contact with the administration and held a productive virtual meeting on the lumber situation with White House staff from the Domestic Policy Council, National Economic Council and Office of the Vice President on April 29. o At the same time, we continue to reach out to lumber producers, other policymakers and the media calling on lumber mills to increase production to meet growing housing demand. o On the last point, NAHB CEO Jerry Howard delivered this message in several appearances on Fox Business Network and Fortune, Bloomberg, The Washington Post, The Wall Street Journal, Fox Business online and the Associated Press have mentioned or quoted NAHB on the impact of rising lumber prices. Woodworking Network on April 30 published a sharp by rebuttal by NAHB that undercuts arguments from the U.S. Lumber Coalition on lumber prices and import duties. o NAHB is also seeking swift action on the trade front. Tariffs on Canadian lumber shipments into the U.S. are exacerbating price volatility and increasing housing costs. o In the near term, NAHB invites builders to take advantage of this free sample escalation clause to use in contracts which stipulates that if lumber prices increase by a certain percentage, the customer would be required to pay the extra cost. •

These unprecedented lumber price hikes are attributable to the following factors: o Many mills reduced production last spring due to stay-athome orders and social distancing measures enacted by state and local governments at the onset of the coronavirus pandemic. o When it became clear in the ensuing months that housing weathered the storm much better than predicted and demand remained strong, lumber mills did not ramp up production accordingly. o Moreover, producers did not anticipate the massive uptick in demand from do-it-yourselfers and big box retailers during the pandemic. o Finally, the extreme lumber price volatility has been exacerbated by tariffs on Canadian lumber imports into the

CDC Eviction Moratorium Set Aside for all NAHB Members •

In an important example of the value of membership, NAHB has scored a major legal victory that sets aside the federal CDC eviction moratorium for all NAHB members nationwide.

On March 10, the U.S. District Court for the Northern District of Ohio ruled that, by issuing an eviction moratorium, the CDC exceeded the authority granted to it by Congress. NAHB brought the lawsuit as a plaintiff on behalf of its members, and we were the only association to do so. As a result of this ruling, the CDC eviction moratorium is currently set aside with respect to all NAHB members nationwide. However, the eviction moratorium may still apply to landlords who are not NAHB members. Moreover, NAHB members must still comply with state or local eviction restrictions. The reason the decision was set aside for all NAHB members across the nation and not all landlords is because NAHB was a plaintiff in the case, and we had “representational standing.” This means NAHB was acting as a representative of its members who have been impacted by the moratorium. When an association wins a case like this, the decision applies to all its members. This victory for all NAHB members shows how our association is working on behalf of our entire federation and producing concrete results to help your businesses and our industry. And while this is an important win, NAHB continues to urge members to seek access to the $46.5 billion of rental funding through the Emergency Rental Assistance Program via your local government and housing authorities. NAHB has always stated that the best way to help all parties is through emergency funding and not moratorium mandates. Finally, with the CDC eviction moratorium set to expire on March 31, the agency moved to extend the eviction freeze through June 30, 2021. Given the district court’s ruling on March 10, this eviction moratorium extension should not apply to NAHB members. For more information, view NAHB’s FAQ on the CDC eviction moratorium at nahb.org.

Biden’s stimulus plan will help housing • •

• •

While the end of the year relief package was a positive development, more needs to be done to help small business owners and keep the economy moving forward. Millions of Americans remain underemployed or unemployed, millions of small businesses still require economic relief and millions of mom-and-pop landlords have not been receiving rent payments for months, threatening their economic livelihoods. The Biden COVID-19 relief bill signed into law on March 11 includes additional funds for small businesses, rental assistance, school reopenings, nationwide coronavirus vaccine delivery, and state and local governments -- which are critical to help many of our members and get the economy back on track. The new law will leverage $35 billion in government funds into $175 billion in low-interest loans for small businesses. It also includes $15 billion in grants for small businesses. An additional $25 billion is targeted to rental assistance to help renters and landlords. This is why NAHB supports the Biden relief package, though we recognize the COVID relief package is far from perfect. Regarding aid to state and local governments, this provision is a net plus for members. Without federal aid, critical government services such as planning approvals, building permits and timely inspections are at risk of being curtailed or eliminated, which would result in construction delays and increased costs to home buyers.

NAHB Opposes the FAIR Act •

The Forced Arbitration Injustice Repeal (FAIR) Act (H.R. 963/S. 505) prohibits parties from agreeing in advance to resolve future employment, consumer, antitrust and civil rights disputes by arbitration. NAHB opposes the FAIR Act because it denies builders and their customers the right to negotiate the terms of their contract, including whether to agree to predispute arbitration Under current law, parties are allowed to agree in their contract to resolve future disputes with arbitration as an alternative to litigation. If the FAIR Act becomes law, parties would only be able to enter into an agreement to arbitrate after a dispute arises. NAHB supports the use of alternative dispute resolution (ADR) -including binding arbitration -- in consumer contracts. NAHB has found that ADR is often the most rapid, fair, and costeffective means to resolving trade disputes – for the both the builder and buyer – arising out of the construction and/or sale of the home. For the home buyer, the use of arbitration resolves disputes in a quick, fair, and less costly manner than litigation. Due to the higher costs of litigation, homeowners may be left with insufficient funds to perform repairs once legal fees and costs are deducted from their recoveries. Additionally, precluding the use of predispute arbitration could have the unintended effect of harming housing affordability if the builder must account for the uncertainty of litigation to resolve potential disputes. NAHB remains firmly opposed to the FAIR Act and has sent a letter to lawmakers detailing our concerns with the bill. State and local HBAs and their builder members are encouraged to contact their representatives and ask them to oppose the FAIR Act (House bill H.R. 963 and Senate bill S. 505).

NAHB Launches IBSx Education & Exhibitor Showcase

Biden’s $2 Trillion Infrastructure Plan Includes $200 Billion for Housing The $2 trillion transportation and infrastructure package unveiled by President Biden includes more than $200 billion to build, preserve and retrofit more than 2 million homes and commercial

buildings. At the same time, the plan includes troubling labor provisions and tax hikes to pay for the package. For example, as part of the package, Biden is urging Congress to pass the PRO Act, an anti-business bill strongly opposed by NAHB. The PRO Act would expand employers’ liability for the labor practices of subcontractors and third-party vendors and narrow the circumstances under which an individual can work as an independent contractor — effectively gutting the contracting business model that serves as the foundation of the residential construction sector. NAHB is studying all the provisions in this huge infrastructure proposal as several could be positive for housing while others would not. As the White House engages with bipartisan leaders in Congress to turn the proposal into legislation, NAHB looks forward to working with policymakers to advance an infrastructure package that addresses the nation’s housing affordability challenges and pays for it in a way that will not jeopardize future economic growth.

MAY 7, 2021 REPORT #5 RCAC BUILDER SEAT OPENING There is currently a builder vacancy on the residential construction advisory committee (RCAC). HB 68 PROMPT PAY LEGISLATION CLEARS COMMITTEE UNANIMOUSLY HB 68 Contractor Payments (Cross, J., Sweeney, B.) To require owners of private construction projects to timely pay a contractor. Text/Analysis Despite concerns raised by OHBA, The Manufacturers Association, Ohio Council of Retail Merchants, and others, the House committee voted HB 68 out of committee unanimously this week. The bill adds provisions to Ohio’s Prompt Pay Act (R.C. 4113.61), which concerns payment timelines for construction projects aside from those involving one-, two-, or three family dwellings. The new provisions require the private owners of construction projects to pay contractors within 30 days of a request for payment or within 30 days of certain specified work being certified as being in compliance with requirements. The Prompt Pay Act, in its current form, does not contain provisions requiring prompt payment to contractors from project owners. It only addresses payments amongst contractors, subcontractors, material suppliers, and laborers. The bill does not change these provisions.

OHBA OFFERS SUPPORT FOR EPHEMERAL STREAM CHANGES HB 175 Water Pollution (Hillyer, B.) To deregulate certain ephemeral water features under various water pollution control laws. Text/Analysis Committee Hearing in House Agriculture & Conservation (3/23/2021; CONTINUED) OHBA offered support of HB 175 during its proponent hearing in the House Agriculture Committee on the 27th, by submitting both written testimony and in person testimony given by Kristin Watt of Vorys, Sater, Seymore, and Pease. OHBA has been following this issue since the WOTUS definition was changed to exclude certain ephemeral and erosional features. Additionally, in July, OHBA filed an ERAC appeal challenging the OEPA General Permit to regulate ephemeral streams, and is continuing to navigate the negotiations through the formal ERAC process. Currently, the Ohio EPA regulates ephemeral streams that only flow in the event of rain or snowfall through its General Permit issued last spring. Committee Hearing in House Energy & Natural Resources Passed in House (5/6/2021; 64-32) After testifying in support of HB 201, OHBA signed on to an industry letter reiterating its support for HB 201 send to the House Energy Committee last week. After being voted out of committee, the House passed HB 201 during Wednesday’s session. HB 201 would prohibit local ordinances limiting natural gas use and has drawn support from some industry and business groups, while opponents continue to blast the measure as a Home Rule violation. OHBA will continue to be supportive as the bill moves along in the Senate process. Please feel free to contact OHBA with any questions or concerns.

LICENSING FOR RESIDENTIAL SPECIALTY CONTRACTORS SB 142 Occupational Regulation (Schaffer, T.) To license residential only construction contractors and to make changes to the law regulating specialty construction contractors. Text/Analysis Committee Hearing in Senate Small Business & Economic Opportunity (5/12/2021) SB 142 received sponsor testimony this week and is scheduled for a proponent hearing on 5/12. OHBA continues to be in contact with the sponsor and Committee Chairman to provide feedback, and suggest potential changes.

GIBBS SEEKS ANSWERS on Softwood Lumber Policy

WASHINGTON, DC - Congressman Gibbs led a group of colleagues on a letter admonishing the Biden administration and pushing for a plan of action to help reduce the price of softwood lumber, currently seeing skyrocketing costs and hampering the building of new homes. Partly as a result of the coronavirus pandemic the supply of softwood lumber has been dramatically disrupted and the price of lumber has increased 300% since the spring of 2020. The additional costs to homebuilding have added $36,000 to a new home construction price. The letter, sent to President Biden and U.S. Trade Representative Katherine Tai, asks the administration to answer four key questions surrounding supply, labor, tariffs, and a timeline on its resolution: 1. Understanding that COVID-19 pandemic has caused supply disruptions and prices have soared, does the administration have a plan to mitigate these disruptions and restore a reasonable supply and demand balance for the nation’s softwood lumber producers, builders, and consumers? 2. Does the administration have plans to include initiatives to address worker shortages? 3. What steps has the administration taken to address the Canadian trade issue? If not, what steps if any will the administration be willing to undertake to move forward on a new agreement? 4. Considering the urgency of this issue, can the administration provide a planned timeline of action regarding softwood lumber? After sending the letter, Congressman Gibbs said: “Multiple factors have contributed to the spike in softwood lumber costs. However, the main driver is an unstable labor market caused by the coronavirus pandemic and the unintended consequences of extended unemployment benefits. As the United States works through our trade issues with Canada, our domestic efforts should be focused on fully reopening our economy and getting Americans back to work. We are on the verge of what should be an economic boom. The last thing we need is distortions in the labor market driving up costs. I and my colleagues urge the Biden administration to find commonsense solutions in addressing the labor and supply disruptions in the softwood lumber market.” Joe Race, Executive Director of the Stark Building Industries Association, also provided the following statement: “The average price for a new home built in East Central Ohio has risen by over $36,000. over the course of a year. Our industry creates 17% of the United States GDP and we need help getting this issue solved immediately.
