Who runs NCBIA Build PAC?

NCBIA Members do! An elected Board of Trustees made up of NCBIA members that decide which political candidates to support. Does any part of my contribution pay for other expenses, such as overhead or administrative costs?

No. All funds collected for the PAC will be used in support of candidates and political parties.

Why can’t NCBIA BuildPAC use my dues money?

Under Federal Law, the use of membership dues to help elect candidates to office is prohibited. Those who give, do so voluntarily. They understand pro-business officials are essential to sustaining our industry. Does NCBIA BuildPAC favor a political party?

NCBIA Build PAC supports candidates irrespective of party affiliation. Candidates are judged strictly on their merits.

How will NCBIA BuildPAC work for my business?

The NCBIA Build PAC is a local political action committee. Its goal is to help elect and re-elect local and state governmental offices.

What about the regulatory issues impacting us in Columbus?

• Because of the legislation in Columbus that affects our members’ businesses, it is most important that we give our PAC dollars to keep our interests in the forefront of any legislation.

• None of us have time to time keep up on all the legislation brought before representatives in Columbus.

• At the discretion of the NCBIA BuildPAC Trustees donations are sent on behalf of the NCBIA so that OHBA can continue to protect our industry as an active and aggressive advocate for all facets of the building industry in the myriad of the many legislative and regulatory issues impacting our business before the Ohio General Assembly and government offices.

How does OHBA use our dollars?

• To support pro-home construction advocates in the General Assembly by promotions, member support and involvement in BuildPac.

• Each year OHBA BuildPac Supports pro-housing candidates who champion affordable housing issues.

• To educate the constantly changing General Assembly and Governor on housing issues facing our industry. For example, in a typical election it is not uncommon for the General Assembly to have 30% to 40% new members. New members need to be brought quickly up to speed on housing issues facing our members. Our full-time representation enables us to provide this education efficiently and timely.

• To represent the interest of the industry on building code issues under consideration by the Ohio Residential Code Advisory Committee (RCAC) and Board of Building Standards (BBS). Direct action by OHBA has achieved code savings totaling thousands of dollars per home by insisting on a true and realistic cost/benefit analysis to be completed by providing actual cost savings to prospective homebuyers before passage. OHBA assures builder representation on the RCAC and BBS. Our members have saved millions of dollars by not having to install sprinklers and include burdensome and costly requirements in new home construction. All a direct result of OHBA action and advocacy.

SHARE OF TWO OR MORE STORIES New Homes Maintains Lead in 2022

Data obtained from the US Census Bureau’s Survey of Construction (SOC) and tabulated by NAHB, show that the rising trend of two or more stories homes continued in 2022. Although the overall share remained virtually unchanged, the share of two or more stories homes started construction was greater than one story homes in 2022. Nationwide, the share of new homes with two or more stories stayed at 48% in 2022. However, the share of new homes with two or more stories showed a mixed trend across nine different regions. New England, East South Central and Pacific were the only three regions that saw an increase in the share of one story homes in 2022. Though single-story new homes are more common in the Midwest, shares of single-story homes in the Midwest region declined in 2022.

Looking deeper, five of the nine divisions saw a greater share of newly-built two or more stories homes. Among these five divisions, New England and Middle Atlantic had a significantly higher proportion (75% and 80%) of two or more stories homes. However, it is worth noting that this share decreased notably in New England in 2022. New homes started with two or more stories in Mountain and Pacific were 57% and 59%. The greatest concentrations of two-or-more story homes were in divisions along the coasts of the country.

New homes started in the Midwest and South showed a stronger preference of single-story homes, except for the South Atlantic division in the South. In the Midwest (East North Central and West North Central), 53% and 58% of new homes started were one-story, while the shares in the East South Central and West South Central were 55% and 58%.

EXISTING HOME SALES UP Slightly in May

After two consecutive monthly declines, existing home sales saw a modest increase in May as mortgage rates were relatively steady in April, according to the National Association of Realtors (NAR) . However, elevated mortgage rates and limited inventory continued to weight on homebuyers. Low resale inventory and strong demand have contributed to the recent increases in new home sales. Total existing home sales, including single-family homes, townhomes, condominiums and co-ops, rose 0.2% to a seasonally adjusted annual rate of 4.3 million in May. On a year-over-year basis, sales were 20.4% lower than a year ago.

The first-time buyer share rose to 28% in May, down from 29% in April but up from 27% in May 2022. The May inventory level measure increased to 1.08 million units but was down 1.15 million from a year ago.

At the current sales rate, May unsold inventory sits at a 3.0-months’ supply, up from 2.9-month last month but down from 2.6-months reading a year ago. This inventory level remains very low, compared to balanced market conditions (4.5 to 6 months’ supply), and illustrates the long-run need for more home construction.

The May median sales price of all existing homes was $396,100, down 3.1% from a year ago. The median existing condominium/co-op price of $353,000 in May, almost unchanged compared to a year ago.

Existing home sales in May were mixed across the four major regions. Sales in the South and West increased 1.5% and 2.6% in May, while sales in the Northeast and Midwest fell 2.0% and 2.9%. On a year-over-year basis, all four regions continued to see a double-digit decline in sales, ranging from 16.5% in the South to 25.5% in the West.

Homes stayed on the market for an average of 18 days in May, down from 22 days in April but up from 16 days in May 2022. In May, 74% of homes sold were on the market for less than a month.

The May all-cash sales share was 25% of transactions, down from 28% last month and identical to a year ago. Allcash buyers are less affected by changes in interest rates.

The Pending Home Sales Index (PHSI) is a forward-looking indicator based on signed contracts. The PHSI fell 2.7% from 78.6 to 76.5 in May. On a year-over-year basis, pending sales were 22.2% lower than a year ago per the NAR data.

THE FED: DRIVING WHILE USING Only the Rear-View Mirror

Markets are increasingly expecting the Federal Reserve to increase the short-term federal funds rate by 25 basis points in July and again in September. As a result, the 10-year Treasury rate rose to above 3.9% this week (the highest since March) and looks set to test a 4% rate again. This means upward pressure on mortgage rates, perhaps approaching 7% on a 30-year fixed home loan. Recall the cycle high was near 7.2% in the fall of 2022.

The Fed is still concerned the labor market is too hot (risking wage inflation absent productivity growth) and costs for non-housing services are rising too quickly. However, the central bank is risking a policy mistake — and a hard landing — by focusing on backward-looking data. About 40% of inflation is generated from shelter costs (rent and owners’ equivalent rent) and those prices are rising more than twice as fast as overall inflation gauges. But those measures are inherently backward looking. Real-time measures of rent show generally flat growth, and there are more than 1 million apartments in the construction pipeline, meaning more supply and lower rent growth lie ahead. This is the risk of driving and only using the rear-view mirror.

Moreover, commodity inflation has slowed significantly. For example, according to NAHB analysis of Producer Price Index data, from January to May of 2022, residential construction material prices were up just 0.3%. This is in stark contrast to the equivalent measure for 2022 (10.2%). That said, some supply-chain issues remain, with electrical transformers in short supply and ongoing increases for concrete prices (up 13% over the last year).

These factors all suggest that the rate of inflation will continue to slow. The prudent policy approach for the Fed is now to pause and move into a data-dependent mode, rather than overshoot in an attempt to appear hawkish for Wall Street. State, local and federal governments can help by enacting policies that will support the supply-side of the economy, particularly with respect to shelter costs, by facilitating more affordable, attainable single-family and multifamily construction.

While residential construction data will be pressed by higher interest rates in the near-term, recent data have been positive. The NAHB/Wells Fargo Housing Market Index measure of single-family building sentiment increased five points in June to a positive level of 55. This was the first measure above the breakeven level of 50 in 11 months. In May, single-family starts increased 18.5% to a 997,000 seasonally adjusted annual rate. However, this remains 6.6% lower than a year ago. The multifamily sector increased 27.1% to an annualized 634,000 pace. However, multifamily development will slow during the second half of 2023.

And despite elevated rates, the lack of existing home inventory continues to support demand for new construction. Currently, about one-third of total housing market inventory is made up of newly built homes, compared to about a 12% historical average. As a result, the pace of new home sales is up 20% compared to a year ago, while resale activity is down 20%. In May, sales of newly built, single-family homes increased 12.2% to a 763,000 seasonally adjusted annual rate.

Despite these positive readings for the building market, this rebound momentum is at risk if mortgage rates move north of 7% for a sustained period of time.

HOUSE APPROVES REINS ACT to Limit Executive Overreach

In a important victory for NAHB and commonsense regulatory reform, the House today approved the Regulations from the Executive in Need of Scrutiny (REINS) Act of 2023.

This legislation would restore meaningful congressional oversight to regulatory rulemaking by requiring Congress to approve all federal agency regulations that have an annual economic impact of $100 million or more.

Prior to the House vote, NAHB sent a letter to House lawmakers urging support for this bill and deemed it a “key vote” because of its importance to the housing industry.

Without meaningful congressional oversight, poorly crafted rules often go into place and businesses are forced to divert precious resources to lengthy and uncertain legal challenges.

Under the REINS Act, if a federal agency proposes a major regulation, it would need to be approved by both the House and Senate before going into effect.

The bill would also grant Congress the authority to disapprove a “non-major rule” (defined as a regulation that would result in an annual effect on the economy of less than $100 million) through a joint resolution.

NAHB believes that placing more decision-making in the hands of Congress on major regulatory rules that impact millions of Americans and countless small businesses will reduce regulatory overreach by federal agencies. We will urge the Senate to introduce and advance companion legislation.

BUILDER CONFIDENCE MOVES INTO Positive Territory in June

Solid demand, a lack of existing inventory and improving supply chain efficiency helped shift builder confidence into positive territory for the first time in 11 months. Builder confidence in the market for newly built single-family homes in June rose five points to 55, according to the National Association of Home Builders (NAHB)/Wells Fargo Housing Market Index (HMI). This marks the sixth straight month that builder confidence has increased and is the first time that sentiment levels have surpassed the midpoint of 50 since July 2022.

In another sign of gradual optimism for the state of demand for single-family homes, the June HMI survey shows that overall, builders are gradually pulling back on sales incentives:

• 25% of builders reduced home prices to bolster sales in June. The share was 27% in May and 30% in April. It has declined steadily since peaking at 36% in November 2022.

• The average price reduction was 7% in June, below the 8% rate in December 2022.

• 56% of builders offered incentives to buyers in June, slightly more than in May (54%), but fewer than in December 2022 (62%).

Derived from a monthly survey that NAHB has been conducting for more than 35 years, the NAHB/Wells Fargo HMI gauges builder perceptions of current single-family home sales and sales expectations for the next six months as “good,” “fair” or “poor.” The survey also asks builders to rate traffic of prospective buyers as “high to very high,” “average” or “low to very low.” Scores for each component are then used to calculate a seasonally adjusted index where any number over 50 indicates that more builders view conditions as good than poor.

A bottom is forming for single-family home building as builder sentiment continues to gradually rise from the beginning of the year. This month marks the first time in a year that both the current and future sales components of the HMI have exceeded 60, as some buyers adjust to a new normal in terms of interest rates. The Federal Reserve nearing the end of its tightening cycle is also good news for future market conditions in terms of mortgage rates and the cost of financing for builder and developer loans. Nonetheless, access for these loans has become more difficult to obtain over the last year, which will ultimately result in lower lot supplies as the industry tries to expand off cycle lows.

Housing is critical for the inflation outlook and the future of monetary policy. Shelter cost growth is now the leading source of inflation, and such costs can only be tamed by building more affordable, attainable housing – for-sale, for-rent, multifamily and single-family. By addressing supply chain issues, the skilled labor shortage, and reducing or eliminating inefficient regulatory policies such as exclusionary zoning, policymakers can play an important and much-needed role in the fight against inflation.

All three major HMI indices posted gains in June. The HMI index gauging current sales conditions rose five points to 61, the component charting sales expectations in the next six months increased six points to 62 and the gauge measuring traffic of prospective buyers increased four points to 37.

Looking at the three-month moving averages for regional HMI scores, the Northeast edged up two points to 47, the Midwest increased four points to 43, the South moved three points higher to 55 and the West posted a five-point gain to 46.

OSHA PROVIDES ENFORCEMENT UPDATE, DETAILS NEW SAFETY Helmet Program at NAHB Meeting

At the NAHB Spring Leadership Meeting in Washington last week, Scott Ketcham, Director of OSHA's Office of the Directorate of Construction, provided a robust update on the safety agency’s activities and enforcement agenda in the NAHB Construction Safety and Health Committee meeting.

Ketcham explained key changes in OSHA’s Severe Violators Enforcement Program (SVEP) that went into effect last fall. The SVEP carries elevated penalties and stricter inspection requirements for employers “committing willful, repeated, or failure-to-abate violations.” Significantly, under OSHA’s multiemployer citation policy, “[a]n employer can qualify for SVEP even if none of its own employees were exposed to [SVEPrelated] hazards.”

Late last year, the SVEP was expanded to include all OSHA standards and hazards. In addition, the requirements to be placed in the SVEP were dropped to just two willful or repeated violations or failure-to-abate notices based on serious violations.

Ketcham shared the most-cited OSHA violations for the first seven months of the federal fiscal year 2023:

Ketcham also detailed enforcement emphasis programs within the Directorate of Construction, including the fall protection program announced just last month and one on outdoor and indoor heat-related hazards, which was issued in April 2022.

Beyond enforcement, OSHA’s construction office is working on guidance to improve jobsite safety. One initiative shared at the meeting is a pilot program for safety helmets meant to eventually replace hardhats as the preferred head protection in construction. Ketcham noted that 20% of head injuries in construction are the result of slips, trips, and falls and that hardhats do not protect against such injuries while helmets with chinstraps may stay on the head during a fall and offer protection.

OSHA is also working on revising construction standards to include explicit requirements that PPE must fit workers properly. This would align construction standards with those in general industry and maritime and address concerns heard from women in construction. A notice of proposed rulemaking is expected shortly.

Ketcham noted that OSHA, and especially the Directorate of Construction, is devoting a lot of resources and energy to going beyond enforcement with strategies to make health and safety a core value on jobsites.
