It has a limit of $2,500 per occurrence, with a $100 deductible. Builders Risk and Installation Floater “Floater” coverage is for anything that oats, or moves from place to place — like your supplies and machinery. It also covers damage to the structures you’re working on, including scaffolding, foundations, and more. This has a limit of $5,000, with a $250 deductible. Each year, the Executive Officers Council (EOC) recognizes executive officers (EOs) who will have completed 5, 10, 15, 20, 25, 30 and 35 years of service in the year to come. The length of service is calculated annually as cumulative service as a voting member of the EOC and is based on information provided by you. THE FINAL Thank You

Thank you so much Judie! Let’s give Judie and her staff, Labreeska and Ashlyn a round of applause for all of their hard work over the past year. We appreciate everything you guys do for the association!

When I stepped into this role of president two years ago, I knew I had some big shoes to fill. So many great people have come before me, and I knew that I wanted to emulate many of them, but I also wanted to put my own spin on things. I knew I wanted to live up to the Majzun name and kick butt just like my father and grandfather all while proving I am my own person.

And let me tell you that was no easy feat, have you had a conversation with my father? There is absolutely no denying where I get this big personality from. But in all seriousness, I would not be standing up here without his support. Dad, from the bottom of my heart thank you for always believing in me, supporting me, and kicking me in the pants when I needed it. You and my wonderful mother raised a strong independent woman that will never back down from a challenge, and I owe you both everything.

Over the two years that I was president we as an association accomplished some pretty amazing things! We brought back our member mixers and the turnout at all of those was incredible. We brought in some wonderful new members that have now become some of our best associates. We learned that no matter how much we put into a plan it might not always go the way we want and that trying and failing is better than not trying at all. We made our home show a two-day event which was a huge hit to our consumers as well as our vendors. Our golf outing committee gave us an excellent event despite mother nature trying her hardest to ruin it. And this was the first year in a long time that so many of us hung out after the clambake and just networked as a group! We accomplished this and so much more and I could not be prouder of us as an association.

We were only able to accomplish all of these wonderful things with the help of all of you.

If I stood up here and listed off everyone that helped me this year, we would be here all night and my dad would have walked out hours ago, so I am not going to do that. You all know who you are and please know that I greatly appreciate everything you have done. I do need to say thank you to a few select people. To my 2022 executive committee, Tim King, John Toth, Melanie Stock, Mike Meszes – you guys all rocked! I absolutely loved the chemistry we had and how during all our exec meetings we would get so much accomplished and then some! To my presidential advisors, Jeff Hensley and Jeremy Vorndran – thank you for always taking my call and walking me through questions and helping me every step of the way To my board of directors and committee chairs, thank you for stepping up and guiding the association and keeping the ship on course. And lastly to my husband DJ – thanks for putting up with all of the endless BIA talk and never once complaining when I ask you to come to an event or volunteer to help with something or make you wear a matching ugly Christmas sweater. You’re perfect and I love you for it!

So here is to 2023! Tim I absolutely cannot wait to see what wonderful things you bring to the table this year and I know you are going to kill it!

2021 - 2022 PRESIDENTIAL Diamonds of Distinction

The diamond of distinction award is given to individuals that went above and beyond during a presidential term. My first set of diamonds goes to two men whom without them I would not be where I am today. Literally. Once helped give me life and the other got me a job. I will let you decide which is which. Chris Majzun Jr. and Jeremy Vorndran, thank you so much for everything you have done for me over the years.

Our second set of diamonds goes to three men that do more behind the scenes then most of us realize. From helping to set up and tear down every event to attending and assisting at them we greatly appreciate everything you have done for the association. Brian Bellan, Chuck Docs and Kaleb Caskey please accept these awards as a small token of our appreciation. Thank you so much for all you do!

First, I would like to again thank everyone that attended and sponsored the 2023 Installation/Hall of Fame/Circle of Excellence Banquet. Congratulations to all of the award winners and the Hall of Fame inductees. Judie and staff, Tom’s Country Place, and DJ Easy gave us a fun night. Also, a thanks to Richard Bancroft our 2023 OHBA President for being there with us to swear in our 2023 officers and directors

I am grateful for the opportunity to serve this association as the 2023 president. Some of you have been a part of this organization for a long time and others just a little while. For me, I think I may be somewhere in between. It is hard to believe that I have been in the building industry for 30 years now. It was about 20 years ago that I attended my first NCBIA event. It was a Codes Meeting. A takeaway that I had from that was the collaboration and relationships of those there.

An association that provides opportunity to network, build relationships, and work together can be keys to success for our businesses. Especially in our industry that is ever changing and definitely not boring. About 7 years ago during Mary Felton’s time as president, she caught me at the annual golf outing and encouraged me to get more involved with the association. So, I started attending more events. About a year later, Sarah Majzun caught me after an event and strongly recommended that I run for a board position. I don’t believe telling either of those ladies no thanks was an allowable answer. Then a couple years later Jeff Hensley sent me an email encouraging me to stick around on the board and take a position on the executive board. Now here I am 4 years later as your 2023 NCBIA President.

I encourage all members to take some time and look for ways to help out this association. The highlighted quote at the bottom of Judie Docs email has resonated with me over the years. If you have not seen it be sure to scroll down in her emails to check out the quote from Theodore Roosevelt. Whether you attend an event, sponsor an event, bring in a new member, join a committee, do business with a member, or have lunch with a member there are many ways to get involved. We can grow and overcome obstacles in this industry by working together.

We have great present and past leadership in this organization, and I want to specially thank the 2023 officers, directors, and committee chairs that will be working closely with me on our 2023 goals. Some of which are Brand Awareness, Increasing Membership, Increasing Member Involvement, Workforce Development, and Industry Education. I look forward to seeing what we can accomplish. My ask of all the members of this association is to help us with those goals and to make a difference for our association. Lastly, we are in an industry that is essential and services the American Dream of Home Ownership and that is something to be proud of. Let’s make 2023 a great year for our business, the NCBIA, and our industry.

Our 1/21 “Celebrate” event also included Hall of Fame inductees.

Our Hall of Fame was established to honor individuals who have made lasting contributions to the housing industry through their work in building and development. Currently we have 28 members that have been inducted since the time we started this back in 2001. Tonight, we are very pleased to announce that we will be inducting 2 new members into our Hall of Fame!

Our first member is Liz Schneider. Liz joined the North Coast BIA in 2001. Currently Liz is a life director and has been chair or vice chair for numerous committees, served all officer positions including being a past president.

The second member is Tom Caruso. He has been a member for over thirty years and has served on all North Coast BIA committees and board of directors during his membership and is currently a life director. He has been the recipient of many local and national industry awards.

EXECUTIVE OFFICER’S REPORT

Thank you for coming this evening. This is quite a humbling honor. I wouldn’t be here if it wasn’t for a few very important people. I joined the NCBIA 22 years ago at the urging of a colleague of mine at the time, John Turcanik, who is here this evening. I wanted to work with builders and he said the best way to meet builders is to join a builder’s association and get involved- so I did. The rest is history. I have held every position in the Executive committee, Chaired or co-Chaired Circle of Excellence, the Home Show, Sales and Marketing Council, the Clambake, the golf outing, I was the Outstanding Sales and Marketing council member in 2005 and a Presidential Diamond of Distinction in 2016 for the first woman associate President, Mary Felton- who I also have so much to thank for!! I attended the Education Insider Conference at NAHB Housing Center in October, 2007 to learn about Education options for the NCBIA. I was even President in 2019- a woman banker associate member of a builder’s association - I never thought 22 years ago that would even be possible.

I’ve learned so much being a member- how to build a house, building codes, what’s an impact fee, the building process, how to plan a big event, how to fundraise-I won a trip for fundraising for the NCBIA during the Total Resource Campaign, but we promised not to talk about that. I used some of those skills to be my daughter’s wedding planner in 2019.

I want to thank my rock and Designated driver for most events, my husband of 30 years, Dale. He usually is OK with going to events as long as there’s going to be good food and he doesn’t have to cook- on those evenings I get cooking credit. He’s let me do my thing for the last 20+ years and he’s even met some members that he has stuff in common with. And to our daughter, Hanna, she’s our greatest achievementshe’s turned out so great and I am so thankful for the privilege of being her Mom the last 28 years. And I’m sure some of you are happy that the overachieving kid stories have ended since she’s all grown up now- what can I say- I’m a proud Momma.

I’ve seen members come and go and even come back. I’ve made some really good friends – I have clients who have become our cruise crew and another couple who are our dear friends that I met because her dad is a builder and they have the same anniversary as us on Halloween- what are the odds of that?! Some members have become like family to me and I am so grateful for the true friends that I’ve made and for their generosity all that I’ve learned and will continue to learn from all the members of this “family”. I am blessed to get to do what I do and help the people I get to help.

If you’re a new member- I invite you to get involved and talk to long time members to learn the history of the association and how to make your membership work for you and your business. You truly get back what you give. This industry provides a basic need we all have- shelter- and we should be thankful we get to serve our communities to provide this basic need. Make it a priority to work with members of this association, meet with members and get to know them personally, and professionally- listen, really listen to them. We all have a story to share, and we can all learn from each other And when we all work together- great things happen! Here’s to another 22 years at the NCBIA! I am not done yet.

Thank you everyone for being here tonight, I know most of you came for an award or for Liz but in my eyes you’re here for me.

I think I need to start with my family because family first. One thing that so many us of do not think about is the person at home taking care of the home and the kids while we were all here working hard for our association. I am thankful that I had someone like Chris at home with our girls, making sure their homework was done and in bed on time…. Thank you, Chris, I wouldn’t be accepting this honor without you and I am glad you are here to share this moment with me.

My brother Jerry, Jerry and I have worked together for over 30 years and we have been to hell and back more than once and I hope we do not have to do that again, but if I do, I know if Jerry is by my side, I will make back again…Thank you Jerry for being there with me all those years and here tonight.

And all my daughters Ashley, Victoria, Ali, and Angela, you all know more than anyone of my late evenings at the BIA and all of the events I dragged you to, it makes me very happy that you are here with me tonight while I receive this honor and I hope that one day that I am watching one of get inducted into this Hall of Fame.

My wife, Pam, thank you for being by my side as I continue this journey and as I watch my daughters one day take over the business. It may be a while because I still love what I do, so I am not rushing out the door.

I am not sure if this man knows how much he has done for me and my family over the years, he has trusted me and my company with thousands of his homeowners and when the recession hit this man stood behind me and supported me. For that Bucky Kopf, I am forever in your debt.

The next builder is someone that I sat with on the board of directors for many years, Bob Yost is a man that believed so much in the BIA that he would argue with his friends in the meetings because he believed in was best for the BIA. Bob, I was watching you and I learned so much business from you… Thank you for your business and our friendship.

Chris Mazjun Jr. I think you and I have more committee plaques than anyone ever in the history of the BIA. When Chris and I Co-Chaired the Men’s Night and the Clam Bakes, everyone knew it was going to be a good time and a big money maker for the BIA. I had a great time on those committees with you Chris and thank you for family business, you guys were my builder account, and I am proud today that we are still working together.

Last but far from least, one of my best friends in the BIA, the Queen of the BIA, Mary Felton AKA Google Mary. Mary is another reason I am standing here; Mary has done so much for me and my business. She has introduced me to some great guys in the past few years. Jason Scott with North Star and Keith Martin with MBD, I would not have their business and their friendship without Mary. Calvin Wayne Smith

June 18,1958 - December 18, 2022

Calvin Wayne Smith, 64 years of age, and a resident of LaGrange, went home to be with his Lord and Savior on Sunday, December 18, 2022, at Mercy Regional Medical Center in Lorain.

He was born June 18, 1958, in Elyria, Ohio. Calvin was a lifetime resident of Lagrange, graduating from Keystone High School with the class of 1976 where he was active with the Art Club.

Calvin had a lifelong passion of imagining and creating. This passion gave birth to Calvin Smith Builders which has been Calvin's passion for over forty years. Calvin was also very active in his community. He was a member of Midway Baptist Church in Elyria, a member of the North Coast Building Industries Association, and the Dodge Viper Club of America. Calvin enjoyed the experience of owning and driving his Dodge Viper and loved Mopar muscle cars. Calvin's great passion was for his favorite music, bluegrass, and he was active with the bluegrass community as well as playing his mandolin for personal enjoyment. He also enjoyed science fiction and was a civil war buff.

Survivors include children, Jennifer Hoops (Andy) of Wellington and David Smith of Cleveland; his siblings, Michael Smith of Bedford, TX, Blaine Smith (Starr) of West Salem, Brad Smith (Reta) and Bobby Smith (Joann) both of LaGrange, and Pauline “Sis” Meeks (Lynn) of Marietta; as well as his close friends, Willie New and Leslie Sickels. He was preceded in death by his parents Walker and Maxine Smith (nee: Fisher).

REMODELING MARKET SENTIMENT Weakened in Fourth Quarter but Remains Positive

The NAHB/Westlake Royal Remodeling Market Index (RMI) for the fourth quarter of 2022 posted a reading of 66, falling 17 points from the fourth quarter of 2021.

While there is a sharp decline in RMI year-over-year, it remains in positive territory as remodeling continues to outperform the rest of the residential construction sector, whether one looks at construction spending or the NAHB/Wells Fargo Housing Market Index (HMI). Nevertheless, remodelers are noticing a pullback from consumers due to the elevated costs of materials and labor. NAHB forecasts that the remodeling sector will experience a slowing nominal growth rate in 2023, but activity should pick up towards the latter half of the year since the Fed has signaled that they plan to decelerate the pace of interest rates hikes

The RMI is based on a survey that asks remodelers to rate various aspects of the residential remodeling market “good,” “fair” or “poor.” Responses from each question are converted to an index that lies on a scale from 0 to 100, where an index number above 50 indicates that a higher share view conditions as good than poor.

The RMI is an average of two major component indices: the Current Conditions Index and the Future Indicators Index. The Current Conditions Index is an average of three subcomponents: the current market for large remodeling projects ($50,000 or more), moderately sized projects ($20,000 to $49,999), and small projects (under $20,000).

In the fourth quarter of 2022, the Current Conditions component index was 75, dropping 14 points compared to the fourth quarter of 2021. Year-over-year, the subcomponent measuring large remodeling projects decreased 14 points to 71, moderately sized remodeling projects fell 13 points to 77, and the subcomponent measuring small remodeling projects declined by 14 points to 77.

The Future Indicators Index is an average of two subcomponents: the current rate at which leads, and inquiries are coming in and the current backlog of remodeling projects. In the fourth quarter of 2022, the Future Indicators Index was 58, which is 19 points lower than the fourth quarter of 2021. Year-over-year, the subcomponent measuring the current rate at which leads, and inquiries are coming in tumbled 22 points to 52, which was the largest decline among all subcomponents. The subcomponent measuring the backlog of remodeling jobs decreased 17 points to 63.

The NAHB/Westlake Royal RMI was redesigned in 2020 to ease respondent burden and improve its ability to interpret and track industry trends. As a result, readings cannot be compared quarter to quarter until enough data are collected to seasonally adjust the series. To track quarterly trends, the redesigned RMI survey asks remodelers to compare market conditions to three months earlier, using a “better,” “about the same,” “worse” scale. In the fourth quarter of 2022, 9 percent of respondents said the remodeling market is “better” compared to 29 percent of respondents who indicated “worse”; this is the highest percentage of remodelers indicating “worse” since Q1 2020. Those who stated “about the same” was 62 percent.

BUILDING MATERIALS PRICE Growth Slows 60% in 2022

The producer price index (PPI) for inputs to residential construction less energy (i.e. building materials) rose 8.3% in 2022 (not seasonally adjusted) according to the latest PPI report—less than one-half the increase seen in 2021.

Softwood Lumber

The PPI for softwood lumber (seasonally adjusted) fell 6.9% in December and 26.1% over the course of 2022. Since increasing the first three months of the year, the softwood lumber index has fallen 45.8%.

Steel Mill Products

On a monthly basis, building materials prices declined 0.3% in December—the fourth consecutive monthly decrease. After increasing an average of 1.8% per month the first five months of 2022, the index averaged a monthly 0.1% decline from June through December.

Steel mill products prices decreased 2.7% in December, the sixth consecutive decline. After soaring 128% in 2021, prices dropped 28.7% in 2022—25.0% since May.

Price growth of goods inputs to residential construction, including energy, declined even more sharply over the year due to a historic increase in fuel prices in 2021. Prices increased 8.2% in 2022 after surging 20.8% the prior year.

Gypsum Building Materials

The PPI for gypsum building materials declined 0.2% in December but increased 17.6% over the course of 2022. Although the 2022 price increase was more than three times the 25-year average, it was substantially lower than the 23% increase seen in 2021.

The trend of ready-mix concrete (RMC) prices continued its historic pace as the index increased 1.6% in December. The PPI for RMC increased 13.6% in 2022, twice the 2021 increase and nearly seven times the historical average.

The price index of services inputs to residential construction was unchanged in December after decreases in October and November. Prices rose 5.6% in 2022 after climbing 10.8% in 2021. In contrast to building materials, the index for services inputs increased substantially in 2020 as well (+10.0%). The 2020 increase was almost entirely driven by a large increase in building materials retailers’ gross margins.

Transportation of Freight

The monthly increase in the national data was broad-based geographically. Prices rose in all four regions—up 0.5% in the West, 1.1% in the Northeast, 1.6% in the South, and 2.1% in the Midwest. The price of RMC increased the most in the West region in 2022, up 18.8%, but each region experienced double-digit percentage increases over the year.

The price of truck and rail transportation of freight decreased 1.7% and 0.1%, respectively, in December. The index for deep sea (i.e., ocean) transportation of freight climbed 0.6%. Of the three modes of shipping, trucking prices showed the largest slowdown relative to 2021 as the growth rate fell from 17.9% to 8.2%.

MATERIAL SHORTAGES EASE, with Notable Exceptions

In May of last year, Eye on Housing reported on historically widespread shortages of building materials. Since then, most of the shortages have eased; the major exceptions being shortages of HVAC equipment and certain categories of ceramic materials (ceramic tiles, clay bricks and cement-based building materials), which have gotten slightly worse.

NAHB has been tracking shortages of building materials and products since the 1990s through special questions on the survey for the NAHB/ Wells Fargo Housing Market Index (HMI), most recently in October of 2022. At that time, over 80 percent of single-family builders reported either a serious or some shortage of three categories of building products: appliances (88 percent), transformers (86 percent) and windows and doors (83 percent).

Appliances and transformers are relatively new to the HMI survey, added in response to anecdotal comments fielded by NAHB over the past two years. Shortages of HVAC equipment were also relatively widespread in October, reported by 76 percent of single-family builders. Overall, half or more of all builders reported shortages of 17 of the 25 building products listed in the October 2022 survey.

Between then and October of 2022, the incidence of the shortage fell for 18 of the 24 listed products and materials (transformers were not covered in the 2021 survey). The decline in the share of builders reporting a shortage ranged from 3 percentage points (from 63 to 60 percent) for cabinets, to a massive 59 points (from 92 to 33 percent) for OSB. The HMI survey in general shows the availability of lumber products improving markedly since May of 2021, which is consistent with the concurrent declines in lumber prices. As reported in the December 9

post, as of November the seasonally adjusted Producer Price Index for softwood lumber had declined in seven of the previous eight months. As indicated in the title, shortages of a handful of building products actually became slightly worse between May 2021 and October 2022. The share of builders reporting a shortage of HVAC equipment increased by 8 percentage points (from 68 to 76 percent) over that period, and the shares reporting shortages of cement and ready-mix concrete each increased by 6 percentage points. This is consistent with the rapid increase in the price of read-mix concrete, also reported in the December 9 post

SIGNS INDICATE BETTER TIMES for Housing Lie Ahead

Amodest drop in interest rates helped end 12 straight monthly declines for builder confidence. However, sentiment remains bearish as builders continue to grapple with elevated construction costs, frequent supply-chain disruptions and challenging affordability conditions.

Single-family home builder confidence rose four points to 35 in January, according to the latest NAHB/Wells Fargo Housing Market Index. It is possible that the low point for builder sentiment in this cycle was registered in December, even as many builders continue to use a variety of incentives to bolster sales, including price reductions. The rise in builder sentiment also means that cycle lows for permits and starts are likely near, and a rebound for home building could be underway later in 2023.

Led by a decline in multifamily production, overall housing starts decreased 1.4% to a seasonally adjusted annual rate of 1.38 million units in December. Although single-family starts increased 11.3% from the previous month to a 909,000 seasonally adjusted annual rate, they ended the year down more than 10%, marking the first annual decline since 2011. Meanwhile, multifamily starts decreased 19% to a 473,000 pace in December. On a year-over-year basis, multifamily construction is down 14.9%. There are currently 943,000 apartments under construction, the highest total since 1974.

The declines in home production are evident in broad measures of housing demand, which have weakened because of elevated interest rates. For example, total existing home sales fell 1.5% to a seasonally adjusted annual rate of 4.02 million in December — 34% lower than a year ago and the slowest pace since November 2010, except for April and May 2020. This marks the lowest annual total since 2014 and the largest decline since 2008.

In addition to elevated interest rates, higher construction costs have also harmed housing demand. The producer price index for residential construction building materials rose 8.3% in 2022, although this was less than one-half the annual increase recorded in 2021 (19%). And while some materials remain in short supply (e.g., electrical transformers), supply chains continue to improve. Between October 2021 and October 2022, the incidence of shortages fell for 18 of the 24 major products and materials. The tightest supply was reported for electrical transformers (50% of builders) and appliances (32% of builders).

The future of rates and construction costs will determine the extent of a rebound for single-family home building this year. Moreover, the economy will have to navigate rising unemployment and weak GDP growth for the first half of 2023. Nonetheless, real-time housing data are coming in better than expected. And the housing market will benefit from the Fed ending its tightening cycle during the first quarter of the year.

U.S. POPULATION GROWTH RATE Rebounds In 2022

According to the U.S. Census Bureau’s latest estimates, the U.S. resident population grew by 1,256,003 to a total population of 333,287,557. After a historically low growth rate of 0.16% between 2020 and 2021, the U.S. population grew at a rate of 0.38% between 2021 and 2022. The increase in the population growth rate reversed a 6-year trend of declining population growth.

The Census Bureau reports that the primary source for the increase in population growth was net international migration. Total net international migration in 2021 was 376,029, and this number increased by 168.8% to 1,010,923 in 2022. This increase indicates that migration patterns are returning to pre-pandemic levels. A secondary driver of the U.S. population growth rate was positive natural births (births minus deaths) which increased the total population by 245,080.

At the state level, Florida was the fastest growing state for the first time since 1957 with a rate of 1.91%. Idaho’s population continued to grow rapidly, growing at a rate of 1.82%. The third quickest growing state was South Carolina which grew at a rate of 1.72%. Texas had the largest numerical increase in population of 470,708 as it joined California as the second state to have a resident population above 30 million. Behind Texas, Florida had the second largest numerical increase in population of 416,754.

For the second straight year, New York’s population declined at the swiftest rate of all 50 states at 0.91%. This was followed by Illinois (-0.82%), and Louisiana (-0.80%). These three states have had the fastest declines in population over the past two years. New York also had the highest numeric decline of 180,341 followed by California which had a decline of 113,649. Per the Census’ estimates, 18 States experienced a population decline in 2022.

BUILDER CONFIDENCE UPTICK Signals Turning Point for Housing Lies Ahead

Amodest drop in interest rates helped to end a string of 12 straight monthly declines in builder confidence levels, although sentiment remains in bearish territory as builders continue to grapple with elevated construction costs, building material supply chain disruptions and challenging affordability conditions.

Builder confidence in the market for newly built singlefamily homes in January rose four points to 35, according to the National Association of Home Builders (NAHB)/ Wells Fargo Housing Market Index (HMI) released today.

“It appears the low point for builder sentiment in this cycle was registered in December, even as many builders continue to use a variety of incentives, including price reductions, to bolster sales,” said NAHB Chairman Jerry Konter, a home builder and developer from Savannah, Ga. “The rise in builder sentiment also means that cycle lows for permits and starts are likely near, and a rebound for home building could be underway later in 2023.”

“While NAHB is forecasting a decline for single-family starts this year compared to 2022, it appears a turning point for housing lies ahead,” said NAHB Chief Economist Robert Dietz. “In the coming quarters, single-family home building will rise off of cycle lows as mortgage rates are expected to trend lower and boost housing affordability. Improved housing affordability will increase housing demand, as the nation grapples with a structural housing deficit of 1.5 million units.”

Derived from a monthly survey that NAHB has been conducting for more than 35 years, the NAHB/Wells Fargo HMI gauges builder perceptions of current single-family home sales and sales expectations for the next six months as “good,” “fair” or “poor.” The survey also asks builders to rate traffic of prospective buyers as “high to very high,” “average” or “low to very low.” Scores for each component are then used to calculate a seasonally adjusted index where any number over 50 indicates that more builders view conditions as good than poor.

All three HMI indices posted gains for the first time since December 2021. The HMI index gauging current sales conditions in January rose four points to 40, the component charting sales expectations in the next six months increased two points to 37 and the gauge measuring traffic of prospective buyers increased three points to 23.

Looking at the three-month moving averages for regional HMI scores, the West registered a one-point gain to 27, the South held steady at 36, the Northeast fell four points to 33 and the Midwest dropped two points to 32.

SEASONS GREETINGS and Other Things

From all of us to all of you our best wishes for a happy holiday season and great new year. As usual, we were busy here at OHBA and look forward to the same in 2023. Hats off to our President Charles Ruma for great leadership in 22. We are also glad he’s sticking around in 23 to support Richard Bancroft.

As we recover from a COVID induced atmosphere and changing working conditions to more normal, we expect normal issues impacting the industry to find their way to our doorstep. You may have read the recent session of the General Assembly adjourned its twoyear session. So, a new General Assembly takes its place the first week of January. This new assembly will find at least 30 new members. That means a bunch of new introductions and explaining what we do. If you know any of the new folks, please let us know

The lack of enough housing continues. So much so that many housing groups are now proclaiming the lack of housing is a drag on economic development. That of course has been a major theme of ours; so, if their support of economic development aids the cause, great. We find that regulatory issues play a major role in increasing availability and cost. As such, reducing those burdens should be the rightful cause for ALL who claim to be a part of the housing industry.

We expect continued issues with restrictive zoning, excessive codes, lack of workforce and supplies such as transformers. We will work closely with our local and national partners. The Ohio government will remain just about the same so we have a good grip on what may come our way; OHBA leadership is set and we hope to meet more of you as we work on your behalf.

OSHA and PERRP recordkeeping logs, summary and online reporting are due soon, if you are required to do so.

Reportable payroll & true-up

Recordkeeping may seem like a daunting task, but it can be simplified by breaking it down into the following steps:

1) Private employers must determine if they’re exempt from keeping the OSHA Log. All public employers must maintain the PERRP log.

2) Download the Recordkeeping forms and instructions and log all injuries for the calendar year that fall under the criteria of ‘recordable’. Not all injury claims will be recordable.

In defining payroll, the Ohio Bureau of Workers’ Compensation (BWC) generally follows the guidelines of the Ohio Department of Job and Family Services, as well as the Federal Unemployment Tax Authority (FUTA) in the businesses section.

3) Submit your summary information annually unless your organization is exempt. Now, let’s take a look at each step in a little more detail. Exemptions

OSHA - There are two exemptions from keeping the OSHA 300 Log.

Examples of reportable payroll

• Companies with 10 or fewer employees at all times during the calendar year. The only exception to this is if you are specifically requested by OSHA, the Bureau of Labor Statistics (BLS) or another agency to keep a log. If you receive a request, do not ignore it.

Although employers may contact BWC at (800) OHIO-BWC (800.644.6292) and complete their true-up report over the phone, BWC anticipates high call volumes and long wait times. They strongly encourage employers to complete their true-up report online through their BWC e-account at www.bwc.ohio.gov. If you do not have an e-account, simply select the Create E-Account Link to begin. You will need your BWC policy number and/or Federal Tax Identification Number.

• The other exemption is for establishments classified in certain low-hazard industries. You will need your NAICS number and check it against the list of “Partially Exempt Industries” at: https://www.osha.gov/recordkeeping/presentations/exempttable.

The more common types of reportable payroll include gross hourly wages and gross salaries less qualifying deductions for section 125 cafeteria plan benefits, sick pay and vacation pay, bonus payments, including stock given as a bonus, sales commission and tips. Additional rebates

Additional rebates are available should an employer utilize their e-account through the BWC’s website. Eligible employers will qualify for a 1 percent Go Green premium rebate (up to $2,000 maximum) by filing electronically. To be eligible for the Go-Green Rebate, you must complete the true-up online and pay any balance at that time as well as opt in to invoice email notifications.

PERRP - There are no exemptions for public employers for keeping and maintaining the PERRP Log. All public employers are required to keep the Log.

*Remember whether you are a private or public employer you must report to OSHA or PERRP, as applicable, any workplace incident that results in a fatality, in-patient hospitalization, amputation, or loss of an eye.

The final step in the process is to determine if you must file online. OSHA - To determine if your organization is required to do so, review the information on OSHA’s Injury Tracking Application (ITA) by going to: https://www.osha.gov/injuryreporting/ and clicking on the “Who is covered by this reporting requirement?” box towards the bottom of the page. If your establishment is required to submit online, then you must create a secure account at: login.gov. Once you have successfully set up an account, then you can submit your OSHA 300A Summary information. The online submission is a fairly straight forward process, just be sure to have your NAICS number, average number of employees and total work hours entered on your OSHA 300A Summary report.

In one case, Sedgwick was able to secure a 100% write off through subrogation/MVA on a maximum value claim, impacting a group retro program, with reserves set at over $1 million. Not only does this victory result in premium savings for our client but it also means the refund potential for that group retro program just increased by at least $500,000.

The second case involved a death claim with close to $300,000 in costs. Our cost containment team was able to secure a 100% handicap reimbursement, once again resulting in savings for our client and a refund potential for the group retro program of close to $300,000.

2022 OHBA YEAR IN REVIEW

OHBA VOTED INTO LEADERSHIP ON RCACAND BBS

At each of the initial meetings for 2022, both the Residential Construction Advisory Committee (RCAC) and Board of Building Standards (BBS), chose their respective Chair and Vice-Chair. The RCAC elected, OHBA member, Ric Johnson, to serve as the Chairman of the RCAC, and the BBS elected OHBA member, John Pavlis as its Vice-Chair.

NEW MEMBER APPOINTED TO THE RCAC

After a vacancy opened on the RCAC, OHBA member Lindsay Bott, of DaleYost Construction, from Lorain, Ohio, was appointed by the Director of Commerce to serve on the committee.

IMPORTANT OHBA BACKED BILLS SIGNED BY GOVERNOR

HB 126 Property Values (Merrin, D.)

To modify the law governing property tax complaints. Am. 4503.06, 5715.19, and 5717.01 HB 126, introduced by Rep. Derek Merrin (R-Monclova), will rein in predatory property valuation challenges, and protect commercial and residential property owners.

HB 175 Ephemeral Streams (Hillyer, B.)

To deregulate certain ephemeral water features under various water pollution control laws. Along with exempting any non-jurisdictional ephemeral streams from being a ‘water of the state’, HB 175 also set forth reasonable mitigation requirements using storm water management for impacts to such features falling under the current WOTUS definitions. Further, the bill made changes to make the Interagency Review Team process more transparent.

OHBA OFFICER RESPONDED TO ARTICLES ON HB 175 EPHEMERAL STREAMS

Following articles printed after the enactment of HB 175 Ephemeral Streams, questioning the Governor ’s signature, OHBA Vice President, Richard Bancroft, quickly responded. He wrote a fact-based letter fully supporting the passage of HB 175, laying out its real impact on housing affordability in Ohio. Mr. Bancroft went on to point out that there are rational, sensible approaches to the issue, and HB 175 is a piece of the approach in addressing the housing affordability crisis.

OHBA REPRESENTED INDUSTRY IN ONGOING STREAM MITIGATION RULES PROCESS

With the passage of HB 175 removing ephemeral streams from waters of the state, the legislation also instructed the OEPA to adopt rules for stream mitigation. OHBA was involved in the beginning stakeholder process and provided feedback for the drafting of new rules sometime in 2023.

ENGAGEMENT WITH UTILITY PARTNERS

Throughout the year, OHBA met with numerous utilities, both gas and electric, to engage the groups on potential development standards or ways to provide more consistent expectations. Additionally, OHBA worked with the Public Utility Commission (PUCO) to explore what comes under its authority

OHBA MEMBERS TESTIFIED IN OPPOSITION TO THE ELEVATOR LAW LEGISLATION; LAST MINUTE FLOOR AMENDMENT PASSED

Throughout the year, OHBA worked with legislators to exempt residential elevators from new licensing requirements. Further, residential elevator contractors and OHBA members from Akron and Cincinnati worked closely with OHBA to testify and explain continued opposition largely from language in the bill which still included vertical platform lifts. While OHBA had worked out a residential exemption for HB 107 Elevator licensing earlier in the process, OHBA was able to get an amendment exempting a final piece of accessibility equipment into the bill with a rare floor amendment before its passage on the final day of session.

BOARD OF BUILDING STANDARDS ASKED OHBA FOR FEEDBACK ON BUILDING DEPARMENT RULES

The Chairman and members of the Ohio Board of Building Standards (BBS) took a fresh look at the rules and procedures governing Ohio’s building officials and building codes. The BBS reached out to OHBA to hear comments/ suggestions on addressing building department staffing shortages and the ability of departments to provide code enforcement services.

The BBS reached out to OHBA to help the Board obtain valuable feedback/suggestions from entities such as private developers, and contractors as they are impacted by the same issues facing building departments.

OHBA AIDS IN PRESERVING AMENDMENTS TO NATIONAL ELECTRIC CODE

OHBA and its members on the RCAC, insisted on the proper review and analysis of the petition to update to the 2020 NEC. The committee, after review and analysis based on statutory considerations, sent its recommendations to the Board of Building Standards with amendments. Even after being challenged by proponents of the NEC, the members of the RCAC all agreed proper review and analysis had been done based on cost, technical feasibility, and safety considerations. After a heated discussion with the electrical industry, the RCAC remained firm in its decision and sent the 2020 NEC with amendments back to the BBS.

OHBA SERVED ON DAYTON HOUSING PANEL

OHBA Executive Vice President, Vince Squillace, and Dayton homebuilder and OHBA Past President, Charlie Simms, participated in a panel on housing. Organized by the Dayton Daily News, a panel of experts discussed the boom in local housing developments, how affordable housing options created today will shape our region in the years to come, and the concerns some community members have about these plans.

OHIO SUPREME COURT RULED IN FAVOR OF WILLOW GROVE WITH HELP FROM OHBA AMICUS

The Ohio Supreme Court ruled in favor of Willow Grove, the party OHBA submitted an amicus for in support jurisdiction last year. In its opinion, the Supreme court ruled the column heading in a township zoning-resolution schedule serves as more than a guidepost and must be read substantively because the heading uses specific terminology that is defined within the resolution.

MEETINGS WITH MAJOR INDUSTRY GROUPS ON IMPORTANCE OF HOUSING AND LAND DEVELOPMENT

Throughout 2022, OHBA reached out and spoke with the Ohio Chamber of Commerce, Columbus Partnership, Ohio Realtors, Ohio Business Roundtable, real estate attorneys, and the Ohio Housing Council on issues impacting the homebuilding and residential development industry. As many began to finally realize there is a shortage of housing in Ohio, OHBA was contacted by various groups on what could be done about housing.

SKILLSUSA OHIO TEAMWORKS SPONSORSHIP AND PARTICIPATION

OHBA continued to be the main sponsor for the SkillsUSA Teamworks competition which brought an impressive turnout of young men and women competing in the various construction trades. Several OHBA past presidents served as judges and volunteered throughout the competition.

REVIEW AND ADOPTION OF MINIMUM QUANTIFIABLE STANDARDS UPDATES

As the adopting body of the workmanlike standards for the industry, OHBA reviewed and adopted the Fifth Edition of the Minimum Quantifiable Standards.

OHBA INVOLVEMENT IN THE LAME DUCK SESSION

After a flurry of activity, the House and Senate adjourned after a busy lame duck session. A new General Assembly (135th) will begin after the new year. In the final week, OHBA engaged in several items, including elevator licensing, mechanics lien law, and changes to LIHTC projects.

CONTINUING AGENCY AND LEGISLATIVE FOLLOW UP

While agency issues are always ongoing, many of the legislative issues from 2022 will likely continue into the new year. Throughout the year, OHBA received questions from around the state on enforcement of multiple regulations, including, but not limited to utility, environmental and plumbing issues. OHBA provided valuable insight and contacts to help mitigate issues brought to OHBA’s attention.

MONITORED LEGISLATION

Throughout the year, OHBA tracked and monitored numerous other items receiving attention by the legislature. Some of these included SB 61 Planned Communities, HB 68 Contractor Payments, HB 88 Roofing Contractors, HB 186 Home Purchases, HB 304 Smoke Alarms, HB 560 Affordable Rental Housing, and SB 329 Property Tax.

11TH DISTRICT APPEALS COURT DECISION SUBJECTS ALL REMODELING TO CSPA

In a recent decision coming out of the 11th District Court of Appeals, the Court concluded that “home construction service,” i.e., the “construction of a residential building,” encompasses the building of (1) one-, two-, or three-family dwellings, (2) accessory structures incidental to those dwellings, and (3) individual dwelling units within structures that contain four or more dwelling units. Accordingly, “home construction service” does not encompass remodeling. Therefore, remodeling contracts are subject to the laws of the Consumer Sales Practices Act (CSPA), including treble damages, and not the laws of the Home Construction Service Supplier Act (HCSSA).

While the original case was filed in the Geauga County Court of Common Pleas, the Plaintiffs (the customer) appealed the decision of the court of common pleas granting summary judgment in favor of the defendant (builder/remodeler). When the plaintiffs appealed, the case went before the 11th District Court of Appeals which covers multiple counties. Any decision coming out of the 11th District would be binding on those counties: Ashtabula, Geauga, Lake, Portage and Trumbull.

The deadline to ask the Ohio Supreme Court to take up the case is later this week, and it is expected the builder/ remodeler will ask the Supreme Court to take the case.

Both the Appeals Court and Common Pleas decision have been attached.

Coming off the 2022 midterm election results, BUILD-PAC — NAHB’s bipartisan fundraising arm for electing federal pro-housing candidates — is already in full swing, supporting industry champions for 2024.

Last month, the Ohio Home Builders Association (OHBA) held a BUILD-PAC fundraiser in Columbus during the HBA’s fall awards and installation banquet. The event, Bourbon Bash Auction, offered various bourbons, wines and Amish cheeses for bidding.

Judie Docs, executive officer of the North Coast Building Industry Association (NCBIA), donated a bourbon basket including W.L. Steller bourbon, a smoker, and other related items, and Andy Profanchik, owner of APCO Construction, donated an E.H. Taylor bourbon bottle. In total, the event raised $7,740.

“Events like these are always a great draw to bring our people together and raise awareness for a common cause,” said Fred Tobin, owner of Tobin Construction Company. “I am proud to be a part of our Federation’s efforts to elect federal pro-housing candidates with peers across the home building industry.”

Scott Meyer, NAHB assistant vice president of government affairs, attended OHBA’s fundraiser and offered remarks for the upcoming congressional term.

“I appreciate any opportunity to join NAHB members and share the advocacy agenda for the upcoming Congress,” Meyer said. “BUILD-PAC is a critical component of our efforts to support the membership, and the more members get involved, the better policy outcomes we achieve on Capitol Hill.”

The North Dakota Association of Builders (NDAB) also recently held a fundraiser for BUILDPAC, a tasting involving various bourbons. A guest presenter joined the HBA, sharing the political history of bourbon and the stories behind some of the labels.

“Bourbon history and auctioning is the first time we’ve done this type of event for BUILDPAC, and we were overwhelmed by the positive feedback our members gave,” said North Dakota HBA Chief Executive Officer Kayla Pulvermacher. “We’re excited to build upon this event and do more in the future. And I encourage other HBAs to consider hosting similar BUILD-PAC events of their own.”

NAHB FILES COMMENTS, JOINS Coalition Opposing Changes to Independent Contractor Test

The U.S. Department of Labor recently published a proposed rule updating the test for determining whether a worker is an employee under the Fair Labor Standards Act (FLSA) or an independent contractor. NAHB last week submitted formal comments opposing the proposed rule, which is intended to combat employee misclassification, and would alter the test for independent contractor status under the FLSA as last articulated by the prior Administration.

The executive summary of the proposed rule notes: "[Workers who] are in business for themselves ... play an important role in the economy and are commonly referred to by different names, including independent contractor, self-employed and freelancer. This proposed Rulemaking is not intended to disrupt the businesses of independent contractors who are, as a matter of economic reality, in business for themselves."

However, NAHB, and many other groups, argue that the language of the new test introduces new, undefined, vague terminology, and would reclassify legitimate independent contractors – including those with their own businesses –into employees, and threatens to impact many industries that rely on the subcontractor business model, including residential construction.

The proposed rule attempts restore a "totality-of-the circumstances" analysis, setting forth six non-weighted factors to consider when determining whether a worker is an employee or an independent contractor. The test's ultimate inquiry is whether, as a matter of economic reality, the worker is economically dependent on the employer (and thus an employee), or in business for themself (and thus an independent contractor). The six factors include:

• Is the work performed an integral part of the employer's business?

• Does the worker's managerial skill affect the worker's opportunity for profit or less?

• Is the relationship between the worker and employer permanent or indefinite?

• What is the nature and degree of the employer's control?

• Does the worker use specialized skills to perform the work, and do those skills contribute to business-like initiative?

• Are investments by a worker capital or entrepreneurial in nature?

The independent contractor rule that went into effect in early 2021, which NAHB supported, provided much needed clarity, uniformity, and simplicity to the independent contractor analysis and accounts for the realities of the modern workplace.

NAHB and more than 200 business groups, including the Associated Builders and Contractors and Associated General Contractors of America and many state and local Chambers of Commerce, call on the Labor Department to withdraw the proposal.

"Not only does the Proposed Rule ignore the realities of how businesses and independent contractors work together in 21st century America, but in so doing, it ignores the preference many workers have to remain independent contractors," the groups state in the comment letter. NAHB has been engaged in the rulemaking process from the beginning and will continue to monitor and provide updates as the rule moves forward. Importantly, this proposed test will not impact tests by the IRS or other federal agencies
