You never get a second chance to make a good First Impression! It is this reason I encourage you to attend the first IAFE Convention in San Antonio, Texas. NICA is sponsoring a Workshop Session on Wednesday 28th, from 3:154:00 PM, entitled, “What is the Right Mix of Food at Your Fair?” The Workshop will feature a panel of Fair Industry leaders who will discuss how to balance the mix of stands between traditional choices, regional favorites, and brand new concepts. They will share the kind of data to use when deciding if a fair is “under-fooded” or “over-fooded.” How many duplicate stands are appropriate, and why? Is there a mix of expensive, average, and cheap pricing? Are you serving children, seniors, and people with special needs

such as “sugar-free” and “gluten-free?” How do you manage menus? Come learn the steps that provide “the right mix of food at your fair!” It will be a very educational session. In addition, we are partnering with IAFE as a presenting partner to host a Happy Hour on Tuesday, November 27th, 2018, starting at 5:45 PM. Your presence will not only contribute to your companies’ future success; it will also strengthen NICA’s Voice in the Industry. Please let the NICA Office know of your intentions to attend, as we want to ensure that the NICA Board of Directors and Staff have an opportunity to meet and greet you. You can send a quick email to nica@nicainc.org and let Linda Frisco, NICA’s Office and Membership Manager, know that you’ll be attending. I look forward to seeing ya’ll there. Voting Deadline is Approaching The end of the NICA election season is coming soon! If you haven’t received your ballot, please contact us at (813) 438-8926 or nica@nicainc.org and we will send you a duplicate copy. The deadline to request a duplicate ballot is September 14, 2018, due to the time it would take the Voting Member to receive and submit it. All votes must be in the NICA Office no later than September 30, 2018. You can read each candidates’ statements online or in the July/August 2018 issue of NICA News. ▲

Do You Use Pepsi? Send NICA Your Receipts! This year we are changing our protocol when it comes to tracking your Pepsi purchases so the NICA Members who utilize the Pepsi pricing and rebate program can make sure they get their full rebate. Whenever you make a purchase, send a picture of your receipt/ticket/invoice to pepsi@nicainc.org—we will assist you in case your receipts have degraded by the November due date. ▲

Refer One Member and Get a $25 Credit! In addition to qualifying for our Coca-Cola Membership Contest (leaderboard on page 33 and rules on the back cover), referring new members after May 1st, 2018 gets you a $25 credit, up to a total of $125 for a limit of five new members—paying for a whole year of regular membership! Don’t Miss Our Two Council Events This Month! Our Councils have been booming this year, hosting many fun events and opportunities available to support NICA and the Councils. This month is no different, with two events on both sides of the country. First off, the Northeast Council is hosting their 3rd Annual Rally in West Springfield, MA on Thursday, September 20, 2018 at 10 PM at the New England Craft Beer Tent, Avenue of States on the Big E Grounds. Come learn about the Northeast Council, meet NICA Members, and join us for hors d’ouerves, entertainment, and prizes. There is no fee to attend. Just like racing is no longer a sport; it has become a science. There are a few ground rules I like to follow: Knowing an employee’s strengths and weaknesses is imperative to proper placement. If an individual is not placed properly, it will result in inefficiency, which costs time and money and could lower the morale of the entire team. As you know, we work an average of twelve hours a day to make our earnings in three hours. Good communiation is also extremely important. Even with great planning, poor communication can cause a problem, which leads to misunderstandings, poor morale, and wasted time. Take time each day to have meetings and have a daily itinerary. Be open minded to your employees’ suggestions. Remember, they are the pit crew. I have found that society as a whole does not have the same work ethics that I am accustomed to. Employees are individuals and have a varying degree of capabilities. Therefore, it helps to take a little time and communicate with employees—not only as individuals, but as team members—to make for a successful day or show. This, in turn, will make them feel respected and appreciated. As an owner or manager, you are the most imporant success factor to your organization’s ability to get results. Remember, your employees are your number one resource.” ▲

When several different ideas come together that benefit our members, it is a very, very good thing! Tyson Foods was pleased with the results of their participation in the NICA Sysco Marketplace held during the 2018 WFA Convention in January. They were looking for a way to be out in the field at Fairs to showcase some of their products to Concessionaires; so, they suggested sponsoring a lunch with product demonstrations. Michelle Card, NICA’s Executive Director, has wanted to try some pop up product shows at Fairs. It is challenging for our members to leave the grounds for a meal during move-in at a Fair, so finding a free, cooked meal on the grounds is an unexpected surprise! I called San Diego County Fair Concessions Manager Donna Ruhm and asked if Tyson Foods, hosted by NICA, could serve lunch to the Concessionaires during the Fair’s move-in and right before her annual Concessionaires Meeting. She said, “You bet!” Longtime NICA Members Chuck and Irene Dugan, Chuckwagon Concessions, agreed to provide seating, power, refrigeration, a grill, and a dedicated space for the

OABA Guidelines for Mobile Sleeping Accommodations Definition and Scope

The OABA recognizes that due to the mobility of the outdoor amusement industry the following guidelines have been adopted for Mobile Sleeping Accommodations (MSA). Compliance with these guidelines should be the eventual goal of all OABA Members to enhance the living conditions of their workforce.

1.

MSA locations or sites

Ideally, MSA units should be situated on relatively level, adequately drained sites large enough to accommodate the workforce without overcrowding. Sites should be located away from standing water and livestock to minimize exposure to e-coli, and mosquitos or other insects. Sites should be kept clean and in sanitary condition, free from trash or other debris.

1. Construction and flooring MSA should be constructed to provide protection against the elements. Camping tents are not adequate MWH units. Dirt, grass, gravel, and similar surfaces are not adequate flooring. Floors are to be similar to flooring in mobile recreational vehicles and are to be kept in good condition. Floors in living quarters are to be elevated at least 12” above ground level.

2. Occupancy No more than two persons should occupy individual, or dual occupancy rooms used for sleeping purposes. Rooms used for sleeping purposes should be reasonably sized to provide adequate floor space for each occupant. Ceilings should be at least 7’, excluding areas located above 5th wheel pins. Sleeping accommodations and storage facilities such as wall closets or lockers for clothing and personal articles should be provided to all occupants. Sleeping accommodations should be spaced appropriately. Beds should be elevated at least 12” from floor.

3. HVAC All heating, ventilation, and/or air conditioning equipment should be installed in accordance with applicable regulations for mobile recreational vehicles. Mobile housing used during weather conditions below 50 degrees should be equipped with appropriate heating equipment; mobile housing used during weather conditions above 85 degrees should be equipped with appropriate air conditioning equipment.

4. Windows In the absence of appropriate HVAC equipment, rooms used for sleeping purposes should be provided with windows and screens that may be opened for ventilation. Window sizes should be in accordance with applicable regulations for mobile recreational vehicles and should be equipped with appropriate mesh screens maintained in good serviceable repair.

areas, should be provided with 24 hour-per-day lighting and electrical outlets when possible.

5. Potable water

Where bathing or laundry facilities are provided, such facilities are to be supplied with adequate potable water while onsite. Hot water should be provided for bathing purposes. Water heaters should be installed in accordance with applicable regulations for mobile recreational vehicles.

All MSA areas should have an adequate number of appropriate receptacles for refuse in close proximity that should be emptied when full. Garbage, trash, refuse, and other debris should not be allowed to accumulate around MWH units.

6. Sanitation

11. Insect and rodent control Effective measures should be taken to prevent insect or animal infestation, including cockroaches and bed bugs. Should an infestation be reported or discovered, it should be eradicated as soon as possible.

7. Hand washing and bathing facilities MSA units must have facilities available for hand washing and bathing, including adequate hot and cold-water supply and wastewater holding tanks or sewer connections.

Laundry facilities or access thereto Occupants of MSA units should have reasonable access to laundry facilities consisting of clothes washers and dryers, whether provided as part of a MSA unit or off-site laundry facility, not less than one time per week. If laundry facilities are provided as part of a MWH unit, there should be at least one clothes washer and dryer. Transportation and access to laundry facilities to off-site facilities should be provided at no charge to occupants.

H-2B Returning Worker Exemption Update James Judkins, JKJ Workforce On Wednesday, July 25th, the House Appropriations Committee passed an H-2B amendment offered by Representatives Andy Harris (R-MD), Henry Cuellar (D-TX), Dutch Ruppersberger (D-MD), Chellie Pingree (D-ME) and Chris Stewart (R-UT) that would do the following:

• Exempt H-2B workers from the 66,000 annual cap if they received an H-2B visas during one of the previous two fiscal years; • Allocate the 66,000 visas for new H-2B workers on a quarterly basis to assist employers whose seasons do not align well with the current bi annual allocation; • Create a system in which in 66,000 H-2B visas for new workers would allocated on a proportional basis if the cap is reached so that all employers will receive a percentage of H-2B workers. During the markup, the amendment sponsors, Homeland Security Subcommittee Chairman Kevin Yoder (R-KS) and Representative John Moolenaar (R-MI) all spoke very eloquently about the need for additional H-2B workers and how these workers support American jobs. If any of these Members are your Representative, please time a few minutes to say thank you. Typically an Appropriations Bill only covers funding for government agencies and programs. Enabling legislation (a new law or change in existing law) is typically a different type of bill. However, as our political system has become nearly deadlocked, the only tool that we have been able to use in prior years is to have the enabling legislation added to the appropriations bill and then when the appropriations bill is passed, then the tacked-on language (our language) also passed. So what we have been able to do is get our language tacked onto the Appropriations Bill for Department of Homeland Security (DHS) in the US House of Representatives. Unfortunately, the Appropriations Committee in the Senate (both Republicans and Democrats) have agreed, unanimously, that they are not going to “legislate through appropriations” and are not going

to allow any enabling language onto the Senate versions of the Appropriations Bills. The Senate Appropriations Committee passed its version of the Homeland Security measure on June 21. The bill is silent on H-2B cap relief due to the agreement mentioned above, but it does include report language that states: H-2B Visa Distribution. The Committee is concerned that the current semiannual distribution of H-2B visas on April 1 and October 1 of each year unduly disadvantages employers that need H-2B workers to begin work later in a semiannual period than other employers participating in that period. The Committee directs the Department, in consultation with the Department of Labor, to review options to ameliorate this problem consistent with the H-2B provisions of the Immigration and Nationality Act and to report to the Committee on these options not later than 120 days after the date of enactment of this act. On June 29, the Senate Appropriations Committee passed its spending bill for the Departments of Health and Human Services, Labor and Education. The bill continues the provisions from last year’s Omnibus Appropriations Law related to the H-2B wage methodology and wage surveys, corresponding employment, the 3/4 guarantee, a 10-month season and staggered crossing for seafood workers. The House Appropriations Committee approved its version of the legislation on July 11. That bill includes only the provision related to the staggered crossing of seafood workers. Both chambers need to pass their final Appropriations Bills, work to iron out the differences between the bills in conference and then pass final Homeland Security and Health and Human Services, Labor, and Education Appropriations Bills, either as stand-alone bills or in combination with other Appropriations Bills. At any step of the way any of these amendments could be stripped out completely, amended to different language as a compromise or could live as currently drafted in the final bill. with Congress have an uphill battle to complete the next several steps in this process. When there is specific assistance needed for employers to step up to the plate and speak with your Senators and Representatives, it is extremely important that all of you, your Suppliers, and your Committees take action. Keep your powder dry for now in regards to the Senate and any additional work with the House. The President would then need to sign the final bill into law for it to take effect. Congress is working to pass all of its Appropriations Bills prior to the start of Fiscal 2019 on October 1, but this deadline is often missed, requiring Congress to pass one or more short-term temporary funding measures called a continuing resolution (or CR). We have no idea if this specific Returning Worker Amendment will survive exactly as currently drafted, in a different form or be stripped out of the final bill. We must all work even harder to make sure it lives as currently written. We may not know if it will become law until October 1, or if there is a CR, until a later date in the fiscal year. ▲
