Éviction de locataires - Changement d’affectation des lieux loués CNW Telbec/ - Au Québec, règle générale, le locataire d’un logement bénéficie d’un droit au maintien dans les lieux. Ce droit lui confère la possibilité de renouveler son bail et de demeurer dans son logement, et ce tant qu’il respecte les obligations liées à son bail. Néanmoins, la loi prévoit des exceptions à cette règle. En effet, dans certaines circonstances, un locateur peut résilier un bail et mettre un terme à sa reconduction, autrement dit mettre fin à la possibilité qu’a le locataire de renouveler le bail. Ainsi, la loi permet au locateur d’un logement d’en évincer le locataire pour en changer l’affectation. En ce cas, des règles précises s’appliquent. En effet, que

vous soyez locataire ou propriétaire, vous devez être bien informés des règles applicables et des délais légaux à respecter en matière de changement d’affectation des lieux loués. De ce fait, la Régie du logement désire rappeler aux citoyens les principales dispositions de la loi en matière d’éviction de locataire lors du changement d’affectation d’un logement résidentiel. Par exemple, pour les baux d’un an se terminant le 30 juin 2012, le locateur est tenu d’aviser le locataire au plus tard le 31 décembre 2011. Cet avis doit indiquer la date et le motif de l’éviction. Il doit également être suffisamment précis pour que le locataire soit en mesure d’apprécier pleinement

les intentions du locateur et d’en mesurer les impacts. Attention, contrairement à la reprise de logement, lorsqu’un locataire désire s’opposer à son éviction pour changement d’affectation de son logement, c’est à lui d’en contester le bien-fondé auprès de la Régie du logement. Le locataire doit déposer sa demande au greffe de la Régie du logement dans le mois de la réception de l’avis. À défaut, le locataire est réputé avoir consenti à quitter le logement et devra déménager à la date indiquée dans l’avis. S’il y a contestation à la Régie du logement, le locateur doit démontrer qu’il entend réellement changer l’affectation du logement et que la loi le permet. Sur

demande du locataire, la Régie du logement peut fixer son éviction à une date postérieure à celle mentionnée dans l’avis. Le locataire évincé a droit à une indemnité. En effet, dans le cas d’un changement d’affectation des lieux loués, le locateur doit payer, au locataire évincé, une indemnité de trois mois de loyer et des frais raisonnables de déménagement, que le locataire ait contesté ou non son éviction. Si le locataire considère que le préjudice qu’il subit justifie des dommagesintérêts plus élevés, il peut s’adresser au tribunal pour en faire fixer le montant. L’indemnité est payable à l’expiration du bail et les frais de déménagement le sont, sur présentation de pièces justificatives.

CNW Telbec/ - Generally speaking, in Québec, the lessee of a dwelling has the right to maintain occupancy. That right entitles the lessee to renew the lease and stay in the dwelling as long as he or she complies with the obligations related to the lease. However, the law provides for exceptions to this rule. Under certain circumstances, the lessor may resiliate a lease and put an end to its renewal, in other words terminates the lessee’s possibility of renewing the lease. Accordingly, the law provides that an owner may evict a tenant in order to change the destination of a dwelling. In that case, specific rules apply. Consequently, whether

you are a lessee or an owner, it is important to be well-informed of the rules that apply and of the legal time limits to be complied with. That is why the Régie du logement wishes to remind Quebecers of the main legal provisions governing the eviction of a tenant in order to change the destination (use) of a residential dwelling. For example, for one-year leases ending on June 30, 2012, the landlord must notify the tenant no later than December 31, 2011. The notice must indicate the date and the reason for eviction. It must also be sufficiently clear so that the tenant is able to fully understand the landlord’s intentions and evaluate the impact.

Important: Contrary to the repossession of a dwelling, when a tenant objects to the eviction for a change in destination of the dwelling, he or she must contest the justification for it before the Régie du logement. The tenant must file the application with the office of the Régie du logement in the month following receipt of the notice. Failure to do so mean the tenant is deemed to have consented to vacate the dwelling and must move by the date indicated in the notice. If the tenant files an objection with the Régie du logement, the landlord must demonstrate that he or she really intends to change the destination of the dwelling and that the law allows him or her to do so. At

the tenant’s request, the Régie du logement can set the eviction for a later date than the one given in the notice. An evicted tenant is entitled to an indemnity. In the case of a change in the destination of the rented premises, the landlord must pay the evicted tenant an indemnity of three months’ rent and reasonable moving expenses, whether the tenant has contested the eviction or not. If the tenant believes that the prejudice sustained warrants higher damages, he or she can apply to the court to set the amount. The indemnity is payable at the expiry of the lease and the moving expenses are payable upon presentation of vouchers.

Before we used to consider it was something that only affected the poorest, those on welfare, the unemployed, immigrants, refugees and homeless people. Les joies de L’oubLi Je suis né en 1940. C’était il y a longtemps. Pas étonnant d’ailleurs que j’ai déjà oublié les événements de décembre dernier alors que nous ne sommes qu’en janvier! Oubliées les peines d’enfant parce que mon parrain ne m’a jamais offert le cheval qu’il m’avait promis pour mon certificat d’études. Il m’a donné plutôt un cheval à bascule. Finis les châtiments corporels d’instituteurs d’un autre âge ; dur, dur, de vivre au 21ème siècle quand on a été formé par des gens du19ème!!! Oubliées aussi les promesses jamais tenues de mon père de me laisser conduire la voiture, oubliés les copains jaloux de mon anticonformisme, les collègues jaloux de mon talent, les premières blessures de l’antisémitisme, les premières peines de coeur, les premières déceptions professionnelles, les premières injustices de la vie, les premières découvertes que la vie n’était pas si juste que ça, après tout! Oubliées les femmes qui m’ont laissé, celles que j’ai quittées... À côté de ces ratages, il y a aussi des moments de bonheur parfait, des réussites inattendues, des bons coups, la joie d’être papa. Ça, on n’oublie jamais! C’est ce qui s’appelle avoir une nature optimiste! O! joie d’avoir un oubli sélectif! Aujourd’hui, je peux ramasser cinq exemplaires du journal de quartier et recommencer, sans m’en rendre comte, le sudoku et les mots croisés... Pas problème, c’est un plaisir renouvelé! Mes billets de Loto-Québec se retrouvent souvent dans mon linge au lavage et je ne consulte jamais la liste des gagnants. Puis les blagues! Les copains qui veulent toujours me raconter la dernière, et je ris toujours de bon coeur... surtout quand c’est eux qui ont oublié comment elle se termine! (après tout, ils ont le même âge que moi!). Il m’est même arrivé de serrer poliment la main à des gens qui m’avaient volé ou à une maîtresse d’un soir qui ne m’avait pas laissé de souvenir impérissable. La plupart des émissions télé repassent trois ou quatre fois par jour et même en bonus les fins de semaine. Pensez-vous que je fais aller ma zappette? Jamais de la vie : Même si j’ai déjà vu ce C.S.I., ce Contact Animal ou ce NCIS plus tôt dans la journée, et comme j’en ai oublié la fin, ça me fait toujours plaisir de les revoir! Le plus pratique, c’est d’oublier les obligations sociales, les voeux de bonne fête ou les réunions de famille. Au pire, je vois chuchoter dans mon dos que l’Alzheimer me guette, puis ils me pardonnent. Il m’est même arrivé d’oublier un souper organisé pour me souhaiter mon anniversaire. Il a fallu un appel de dernière minute pour me rafraîchir la mémoire! En ce moment même, j’ai l’impression catastrophique d’avoir oublié quelque chose. Mais quoi? J’ai oublié!

As the world wrestles with the sovereign debt crisis in Europe and America - we’ll see if 2012 is any easier than 2011 - it’s worth reviewing what caused the last financial meltdown. Of some help is a new book, Reckless Endangerment - How Outsized Ambition, Greed, and Corruption Led to Economic Armageddon. Gretchen Morgenson is a Pulitzer-prize winning business reporter for the New York Times; Joshua Rosner is now a managing director at a New York-based consulting company. In 2001, Rosner authored a report critical of the already too-easy approach to American mortgage financing. Their collective talents help identify the various mischief-makers in the last financial crisis and why it occurred.

Barney (not so) Frank

Exhibit A: Just after Lehman Brothers collapsed in 2008 and as U.S. mortgage giants Fannie Mae and Freddie Mac declined into financial quicksand, Massachusetts congressman Barney Frank was omnipresent on the nightly news. Frank, then chairman of the powerful House Financial Services Committee, knew who to blame for the mess: Wall Street and other politicians. Quoted in a January 2009 New Yorker profile, Frank said he predicted and might have prevented the U.S. housing crisis - if only others had listened: “The ‘I told you so’ here is that homeownership is a nice thing but it is not suitable for everybody,” said Frank to the interviewer. In fact, until the financial crisis, the congressman favoured expanding home ownership beyond reasonable limits, especially to those who, under more prudent lending rules, would never have obtained a mortgage. Frank had also long opposed stripping Fannie Mae and Freddie Mac of their sweetheart deals with the U.S. federal government. The two lenders, created in 1938 and 1970 respectively to help raise levels of U.S. home ownership, were technically private for the last four decades. However, and critically, both were granted de facto government guarantees and other favourable treatment that cut their borrowing costs. For example, capital requirements for Fannie Mae and Freddie Mac were set low, at just 2.5 per cent, compared to a 10 per cent requirement for American banks. Such favours were opposed by the rest of the financial sector and by critics who thought such favouritism risked a future taxpayer bailout. In Reckless Endangerment, blame for the last American financial crash is properly attributed to both government and the financial sector: Wall Street again became “irrationally exuberant” (to use a 1990s phrase from Alan Greenspan). But it did so courtesy of government “carrots”

and “sticks,” i.e., incentives and regulations to lenders that artificially boosted homeownership levels, risk be damned. Such encouragement of high-risk behaviour included the Carter administration’s Community Reinvestment Act, pumped up in the 1990s under Bill Clinton. That Act pushed financial institutions to lend more money to low-income, high-risk borrowers on the theory that racial discrimination (and not lousy credit scores) explained a previous dearth of low-income mortgage-holders. Some of this ground has been explored in previous books. What’s new in Reckless Endangerment is the examination of the role Fannie Mae’s 1990s-era chief executive, James A. Johnson, played in creating the U.S. housing bubble: internal high-risk corporate behaviour that massively expanded Fannie Mae and external attacks on any critic that sought to kill Fannie Mae’s government-granted privileges. “Johnson’s command-and-control management of the mortgage finance giant and his hardball tactics to ensure Fannie Mae’s dominance amid increasing calls for oversight are crucial to understanding the origins of the worst financial debacle since the Great Depression,” write the authors. Johnson and those who followed him at Fannie Mae spent tens of millions of dollars on campaign contributions, grants to potential allies, and on lobbying. For instance, the company strategically supported a wide swath of American politicians, everyone from Barney Frank on the left to Newt Gingrich on the right. The cash helped thwart any attempt to put the company on a level playing field with other financial institutions. Johnson moved on from Fannie Mae in 1999, nine years before the financial sector imploded, but the authors assert he was a major reason for the housing boom and subsequent bust. “Johnson’s tactics were watched closely and subsequently imitated by others in the private sector,” write Morgenson and Rosner.

A cavalier attitude to defaults

Whether relaxed lending standards, the elimination of due diligence, repackaging junk loans, and, importantly, supporting disastrous political attempts to push for more home ownership even for those who by any sensible measure, could not afford one, Johnson and Fannie Mae were there first as “pioneers.” As for the congressman from Massachusetts, when asked in 2005 whether his political opposition to traditional prudence in the financial sector was wise, and whether this might not lead to mass mortgage defaults, he brushed off the question: Said Frank, “We’ll deal with that problem if it happens.” Mark Milke

Rappelons que le 14 décembre dernier, la CSDM a convoqué plusieurs organismes locaux, représentants des parents et de l’école, à un « Comité de travail projet d’agrandissement de l’école Barclay ». Les membres du Comité citoyen ont fait admettre au président d’assemblée que ce «comité de travail» était, malgré son nom, une simple rencontre d’information. À cette occasion, la CSDM a en effet réaffirmé son intention d’aller de l’avant avec le projet tel que présenté. Notons qu’il s’agit de la seconde séance d’information depuis que le Comité citoyen de ParcExtension a, au printemps dernier, alerté les élus et la population locale au sujet de la menace pesant sur le parc Barclay. Si quelques ajustements ont été apportés au projet initial, la CSDM maintient toujours son intention d’occuper 25% du parc attenant à l’école. Avec l’annonce surprenante de la démolition de la maison du concierge, partie intégrante du complexe scolaire construit dans les années

1930, et l’intention de masquer une des entrées de l’école, cela démontre que, malgré ses engagements institutionnels envers la protection du patrimoine et le développement durable, tous les efforts n’ont pas été faits par la CSDM pour les respecter. Reconnaissant les besoins d’un gymnase, le Comité citoyen, soutenu par le CSSS de la Montagne, Tandem, VRAC environnement et plusieurs centaines de résidents continue cependant de déplorer que les organismes et les citoyens n’aient jamais été associés à l’élaboration du projet d’agrandissement. Le Comité citoyen questionne toujours le fondement de ce projet et réaffirme que d’autres solutions moins coûteuses et plus en accord avec les besoins du quartier existent. Lors de l’assemblée, le Comité citoyen a en effet réaffirmé que les besoins en nouveaux locaux de classes ne sont toujours pas démontrés, mais la CSDM s’obstine à ne pas vouloir discuter en profondeur de ce sujet pas plus que des alternatives. De plus, il n’a pas été question des préoccu-

pations de santé publique évoquées en juin, dont le Comité citoyen s’est fait l’écho à plusieurs reprises et qui concernent un quartier tout entier, incluant ses enfants. Rappelons que ce parc représente un des très rares ilots de fraicheur du quartier ainsi qu’un facteur essentiel de cohésion sociale. Le Comité citoyen de Parc-Extension estime que le processus décisionnel qui engage 7,5 millions de dollars d’argent public mérite plus de transparence. La CSDM affirme, dans un de ses documents institutionnels, vouloir se placer sous le signe de la transparence, tant sur le plan pédagogique, administratif que démocratique. Elle doit donc donner l’exemple en procédant à une véritable consultation publique, conformément à ses engagements démocratiques, et former un vrai comité de travail. Le Comité citoyen affirme que ce processus, garant de la démocratie, est le seul capable de donner une réponse contemporaine et durable aux besoins scolaires et à ceux de tous les citoyens de Parc-Extension.

Ainsi, une demande relative à cette disposition peut provenir de la zone visée 0233 et de ses zones contiguës 0105, 0184, 0241, 0250, 0253, 0282, 0301 et 0590. Une telle demande vise à ce que cette disposition de la résolution soit soumise à l’approbation des personnes habiles à voter de la zone à laquelle elle s’applique et de celle de toute zone contiguë d’où provient une demande valide à l’égard de la disposition. 2. Description du territoire La zone ainsi touchée par ces amendements est la zone 0233 et ses zones contiguës. Le territoire visé par le présent avis est montré ci-dessous :

Cette procuration doit être produite avant ou en même temps que la demande. Dans le cas d’une personne physique, il faut qu’elle soit majeure, de citoyenneté canadienne et ne pas être en curatelle. Dans le cas d’une personne morale, il faut : • avoir désigné parmi ses membres, administrateurs ou employés, par résolution, une personne qui, le 6 décembre 2011 est majeure, de citoyenneté canadienne, qui n’est pas en curatelle et n’est frappée d’aucune incapacité de voter prévue à la loi; • avoir produit avant ou en même temps que la demande, une résolution désignant la personne autorisée à signer la demande et être inscrite sur la liste référendaire, le cas échéant. “This is going to be a fantastic housing project that will provide a very nicelooking gateway into Park Ex,” Borough Mayor Anie Samson said in an interview. According to Samson the units will be suitable for students as well as small families, and first-time condo buyers will be eligible for a subsidy from the City of Montreal. Samson said the developer appears to have understood that up until now the trend among members of Park Extension’s younger generation has been to leave the district because of a lack of suitable housing for their needs. “We’d like our young people to stay, and this project appears to have been designed with that in mind,” she said.

DEA officer stops at a ranch in Texas, and talks with an old rancher.. He tells the rancher, “I need to inspect your ranch for illegally grown drugs.” The rancher says, “Okay , but do not go in that field over there,” as he points out the location. The DEA officer verbally explodes saying, “Mister, I have the authority of the Federal Government with me.” Reaching into his rear pants pocket, he removes his badge and proudly displays it to the rancher. “See this badge? This badge means I am allowed to go wherever I wish…. On any land.. No questions asked or answers given. Have I made myself clear? Do you understand? ”
