ARBITRATION CHAIR SELECTED

The National Association of Letter Carriers and the U.S. Postal Service have selected Arbitrator Dennis R. Nolan to serve as the neutral chair of a three-person interest arbitration panel to set the terms of a new National Agreement between the NALC and the Postal Service. Under the law, each side will also appoint union and management representatives to serve on the panel and represent their respective positions.

Arbitrator Nolan is a member of the American Arbitration Association’s labor panel and has been a full-time labor arbitrator since 1976, serving for many years as a national arbitrator on the NALC/USPS panel. In 1985, he was selected for membership in the National Academy of Arbitrators, and eventually served as its president in 2006. Arbitrator Nolan served as the parties’ neutral arbitrator in the interest arbitration proceedings for the 2019 National Agreement, which were near conclusion when the parties reached a negotiated settlement late in 2020.

As final preparations for interest arbitration are made, NALC and the Postal Service continue to negotiate in an attempt to reach a tentative agreement. Further updates will be provided as the collective bargaining process moves forward.

The Carousel

In my wonder years, I remember my parents taking their rambunctious offspring to amusement parks or the local zoo to get us out of the house for some family fun. Whether it was the Oakland or San Francisco Zoo, the Santa Cruz Beach Boardwalk or Disneyland, we would ride the classic carousels. Some of them were historic and had been around for many years. When we were in New Orleans last November, I visited the historic and iconic Carousel Bar that was built in 1949. The artwork and theme itself were really cool. Now, in my later years, I want off of all carousels.

The Contract Merry-Go-Round

As I write this on March 8, 2024, it has now been 293 days since our Contract ended on May 20, 2023. No joke, I added it up! No holds barred here. It is beyond ridiculous that we have gotten little to no information about our pending contract negotiations. Unless you count generic rhetoric like, “we are seeking possible substantial wage increases” or “we are close on some issues.” Really? What does that mean? To all of us, not much. I get that when you are negotiating you cannot show your hand until the last card is played or you have a signed agreement. Yet, the regurgitated statements that “we are continuing to negotiate while preparing for arbitration” is as tiresome as a merry-go-round that never stops. It is time to get off this circular ride!

We need to tell the USPS to “put up” or “shut up.” In other words, it is time to kick some butt in arbitration. If by some chance there is a last-minute agreement, remember that it must be ratified by the membership.

The New USPS Vehicle Fleet Roundabout

I frequently get asked this question, “Where the hell are the new next generation vehicles?”

Is the USPS waiting for all the wheels to fall off the LLV wagons? Are they locked in storage units? I have heard that the wheels of the Postal Service itself move slowly. Even a sloth moves faster in slow motion than the USPS in real time. So, what is the USPS doing in the interim?

They are purchasing more off-the-shelf vehicles. Of course, they will muff that up as well. It was brought to my attention that the USPS/CA-2 District in some offices are assigning Promasters, or other left hand drive vehicles, to routes with dismount or mounted deliveries. No left-hand drive vehicles were designed for these types of deliveries. It is the union’s position that it is a safety hazard and could lead to possible injuries. Just because the Pro-master has a sliding door on the right-side, this does not make it safer. I have reported this issue to NALC National. They are addressing it. However, I was informed that the USPS is being as stubborn as a mule (or jackass) on this issue. They

believe that if a route has 20 or less dismount deliveries, it is okay. So said the chicken that crossed the road, until he got hit by a car. As always, take the time to work safely, fill out a PS Form 1767 (Report of a Hazard or Unsafe Condition) and file a grievance.

Our Fight is Not with Us

Brothers and sisters of Greater East Bay Branch 1111, we are all union members. We all have a voice in this great union. The world is full of naysayers who complain but do very little to affect change. The union is always looking for individuals from our tribe to step up. We need more Warriors. We as a union must always band together to fight for our common cause, which are better wages, working conditions and welfare of the entire membership. In unity there is strength. So, stay strong and stay committed. Everything worth fighting for takes time, energy, and commitment.

Current Events

During the past few months, we have seen a number of new hires entering the Postal Service as Letter Carriers. In some offices, they hired too many letter carriers which led to not having enough vehicles or enough work for them. Some of the new employees who were hired in offices that were overstaffed have resigned due to lack of work or because they were being sent out to work in other offices.

However, there is still a need to hire more carriers in offices such as Oakland or Richmond. In fact, carriers from all over different areas have volunteered to work in a different installation under the Memorandum of Understanding (MOU), M-1968. Any such details must be first approved at the national level before the carrier(s) start the detail.

Some carriers have been involuntarily sent to work outside of their employing office which violates the National Agreement. Please let your steward(s) know if any letter carrier is being involuntarily sent to work outside of their office.

A new issue has been arising in some offices where management displays route information on a television monitor showing a carrier’s route information and/or discrepancies and/or infractions conducted by the carrier.

When this happens, you must immediately let the Branch know and ask the steward to file a grievance. It is our position that management’s use of TV slides results in a public shaming of carriers – that publicly posting carriers’ performance information is disrespectful and in violation of M-39 Section 115.4 amongst other provisions

Recently, the Branch has received numerous favorable decisions (pre-arbitration) for grievances that were filed from the past year or so. Some include additional payments to affected carriers who were not immediately paid Continuation of Pay (COP), management not complying with settlements or decisions in a timely manner. In other words, not providing proof of GATS and/or not complying with prior cease and desist orders by continuing its violations of, but not limited to, Article 8 violations or Article 7 for crossing crafts.

I want to recognize all the stewards for their hard work and dedication in making these grievances successful. So please if you see a grievance adjustment on your paychecks, don’t forget to thank your stewards!

Lastly, I would like to encourage you to always carry your scanner during the performance of your duties as a letter carrier. If you are delivering a parcel to your customer’s door, it will show that you are moving, unlike when you leave it in your truck where it will show a stationary time. It is important especially if your office is scheduled for evaluation. It will show that you are working and will less likely be asked what happened during a certain period of time when your scanner does not show any movement. If you have any anomalies during your delivery, you will have the opportunity to explain them during your

consultations with the team conducting your evaluation. If you don’t provide an explanation, it is likely that time may be disallowed from your assignment. I urge you to answer their questions with valid explanations.

Hello Brothers and Sisters, my name is April Patrick, and I am thrilled and honored to be serving as the Fourth Vice President of Branch 1111.

I am a Bay Area native and have been a USPS carrier for 17 years. I bring a tremendous amount of knowledge, skills, and abilities to this position as I previously served as the shop steward for the Richmond Hilltop office for over three years. I am so excited to contribute to the team's success and look forward to supporting my fellow full-time officers, as well as the local Shop Stewards as we continue to ensure that we have equal and fair rights for our brothers and sisters of Branch 1111.

ANY GOOD CHANGES AT YOUR POST OFFICE?

As the new year has begun, perhaps your Post Office has made some good changes. Maybe you can’t see them, but they may be there. Has any of your offices received new vehicles? Unfortunately, some offices may be experiencing the fact that the replacement vehicle are mostly Pro-masters. The Pro-masters are definitely not convenient for every type of delivery. For those of you who have a dismount or a mounted route, this vehicle becomes a big problem. There’s no tray to the left of the driver’s side to put your mail on, and the door swings open versus sliding back and forth. These are not doable for those types of routes.

All these problems have not been worked out yet with the Postal Service. However, for those of you who have dismount and mounted routes, you should ask your supervisor to demonstrate how to drive a Pro-master on these types of routes. Nevertheless, this alone is going to create lots of overtime, so be prepared to fill out your PS 3996.

A solution to these problems may be around the corner. Hopefully, we will receive the new vehicles that are similar to the LLV’s that most likely will be best for the dismount and mounted routes. So far Berkeley vehicles have not been fully replaced.

BERKELEY BLUES NEW!

Berkeley has been experiencing lots of PTFs coming through. Which is a positive thing, especially if we are able to retain some of these newcomers, because this would help in reducing the carriers being mandated to work on their SDO and unwanted overtime. This happens to be a big challenge simply because a lot of PTFs either quit or are fired. Retaining them is one of the keys to some of the solutions of unwanted overtime. Hopefully, some day we will have enough carriers.

There hasn’t been any improvement to share, just the same old chaos, of not being organized. If you’re organized you would be running a smooth office, but not in Berkeley. We keep getting horrible leadership who don’t know what they are doing. I am also finding that carriers are starting to have disagreements among each other, instead of being unified. I would like to remind all my brothers and sisters of this great union that it is very important to do our best to get along with each other, as the union protects all of us.

Management is usually our enemy and supports not having unity among us. So, if management is asking for a statement to go against another brother or sister, please think about it. I personally wouldn’t do it. If management wants to interview you, then you would cooperate with the interview, with your shop steward present of course.

Sure, not everyone gets along with each other, but for the most part, do your job to the best of your ability and avoid anything that would only create hostility among us.

Berkeley management has decided that all grievances are to be denied. Their stupid explanation shows their inability to try to resolve any problems. Berkeley management is very disrespectful to the DRT, the Dispute Resolution Team. For example, on many, many occasions Berkeley management has been given “cease and desist” from the most famous violations of Article 7, crossing crafts, and yet they never stop the practice It’s unbelievable that they don’t even try to do what is right.

This is just one indication of how this place is total chaos, and will be this way until our leadership changes.

Knowledge is Power!

VOLUNTARILY CHANGING MY SCHEDULE…

Full-time regular letter carriers have fixed schedules and starting times. What happens, for example, when my child has a game and I must work or it’s my mom’s 90th birthday or any other event that is planned during my fixed workday schedule, what can I do?

It is possible to temporarily change your scheduled start time and/or scheduled day off so you can attend those functions that you may normally miss due to your schedule.

This is done by completing a Form PS 3189. This form can be obtained from management. If you need help completing it, request to see your Shop Steward.

Your request for a temporary schedule change must be for your personal convenience, not because management asked you to change your schedule for their convenience.

Joint Contract Administration Manual (JCAM) Pages 8-6 Voluntary Schedule Changes. There may be situations in which full-time employees wish to have their regular schedules temporarily changed for their own convenience. Out-of-schedule premium is not paid when a change in a fulltime employes schedule meets all three of the following criteria:

1. The requested change in schedule is for the personal convenience of the employee- not for convenience of management…

2. The employee has signed a Form 3189 Request for Temporary Schedule Change for Personal Convenience.

3. Management and the union’s representative (normally the certified steward in the employee’s work location) agree to the change and both sign the Form 3189.

Management and the Steward (Union’s Representative) must agree to the change, and both must sign PS 3189. The PS 3189 must be completed prior to the date of the temporary change of schedule.

Management may deny the temporary change of schedule request only after considering operational needs specific to the request and weighing them against the needs of the carrier making the request.

Management is to write a “reason” on the PS Form 3189 after it is submitted and if checked “Disapproved” an explanation beyond the catch-all phrase ‘needs of the service’ should be given to the carrier. The reason must be specific and explained to the carrier.

There is nothing in the temporary schedule change request which limits the number or frequency of requests for a temporary change of schedule. If you have questions request to see your steward.

WHY IS MANAGEMENT PICKING ON OUR CARRIERS?

Hello everyone, hope you are all having a good year so far. I know what you all are thinking, “when will we have our contract?” Well, there’s no real good answer to that other than National is still working on it. Every contract season we have I am always optimistic about what new provisions we will receive, and this contract season I believe will be no different. The cost of living in the Bay Area is absolutely ridiculous and this next contract needs to help offset that. As of April 1st, 2024, the minimum wage for fast food restaurants is $20 an hour now, so it would pretty sad if we can’t get the Postal Service starting wage up at least $5 an hour more than that. But we will see, stay tuned on that and please check www.branch1111.org for more information later on our contract or www.nalc.org

What I wanted to talk about was why management keeps screwing with our carriers, and a lot more now lately? Well, the answer is simply this, they are trying to meet a quota. I spoke with three of the Supervisors that are in my offices, and they told me that the Manager of Post Office Operation’s (MPOO’s) is pressuring their local management teams to issue disciplinary action to the carriers. It has actually gotten more blatant these last couple of months where carriers are getting letters of warning for going over 1 click. For example: 8.01 is considered unauthorized overtime! Are you serious?!?!

Letter Carriers are getting this bogus disciplinary action placed upon them punitively which is a blatant violation of due process and Article 16 of the National Agreement. When will management learn that this causes a hostile work environment. This company does NOT run without our carriers, customers don’t get their mail without our carriers, and the Postal Service will NOT survive without our carriers, and until they realize that local or upper management will never gain the respect of our carriers. Especially if they’re trying to discipline carriers for ridiculous reasons such as what I mentioned above.

Despite all of this there is absolutely no reason to fear them, we will always be there for you all and continue to get these punitive disciplinary actions thrown out. I want to give a shout out to some Stewards that have been instrumental in doing just that. Che’ Perez, my Chief Steward in Fairfield not only gets discipline thrown out, but she makes management pay an additional $200 for management attempting to discipline carriers without having Just Cause. That’s unheard of but when it comes to Che’ nothing is unheard of.

Also want to give a shot out to San Ramon Steward

Anton Thompson who had literally turned the office around for the better. He is remarkably intelligent, direct, and does not take crap from anyone. He’s been putting management in their place by getting discipline thrown out with no problem, in fact he has been able to get management to stop the Just Cause Interviews midway through. He lets them know how ridiculous the Just Cause Interview is and makes them not want to finish it. My Vallejo Stewards Steve Teding, Krista Beals, and Vanetra Green I appreciate all of you and all of the grievance you sent to the Step B Team, you won them all! That is an amazing accomplishment, please keep up the excellent work.

My Steward Eileen Brown of Suisun is as tough as they come, I definitely appreciate the heart and soul of the Suisun installation. Her carriers love her, and she is one of the greatest humanitarians I’ve ever come across. She really cares about her community and wants to change it for the better, and you can’t teach that kind of dedication, it’s already built in her.

Last but definitely not least, Sharon Jones and Dwayne Hunt in Walnut Creek. They are both going to be excellent Stewards and they already have the passion within them to be just that. They follow instructions very well and they get things done and I appreciate both of you. Sad to say, but I will be turning over my Livermore Office to newly elected Eddie Murphy as of February 1st, 2024, as I have picked up the San Ramon and the Vallejo Installations.

Again, do not be afraid. Management has no power over you as long as you are doing your best and taking care of your responsibilities as a professional Letter Carrier. Let us be the ones that hold THEM accountable, and file grievances against THEM. All I will say is that we need your help as well through statements that you provide to get Supervisors who do not deserve to be in their position out of your office. We’re not saying ALL are like that, but we must get them out. Please help us in this task and be safe out there.
