“I’m a repeat customer of this company’s services, having relied on them to construct both a 3-story, 4000 square foot duplex condo project in San Francisco and then later a large custom single-family home (more than 5000 square feet). “We had a defined vision of what we wanted our home to be and Anthony and his team’s input was instrumental in making our dream a reality. This was an internal remodel that required extensive structural modifications such as addition of extra large view windows, cantilevered staircase, removal of walls, repositioning structural elements, building shear walls and reinforcement of the foundation. Basically MurphyMcKenna rebuilt the house from the inside. A. Concretum Operis, Inc Works:

Bid includes installation of reinforcing steel, placing and finish concrete, and job clean up. Concrete price is based on natural color, light broom/hand trowel finish, and standard plywood/lumber form finish (non-architectural). Note: concrete color can vary naturally without being a defect. Also, shrinkage cracks are normal and not a defect. Architectural concrete finishes are not included.

F. The crew generally take a ½ hour lunch. Whatever the length, the client is not billed for that time. The crew also is entitled to two 10-minutes breaks, generally at 10:00 A.M and 2:00 P.M., which is included in the bill. Crew time is billed portal-to-portal each way. Time will be billed for working on figuring, jobsite, picking up and ordering materials, and planning. Time spent on accounting, billing, payroll preparation, ETC. is considered overhead and will not be billed.

2. Concretum Operis, Inc. warrants that if there are any defects in workmanship or materials from one year of completion of house construction, Concretum Operis, Inc. will, at its own option, either repair or replace such defective work or materials. This warranty is in lieu of all other warranties, implied or express.

3. The General Contractor may, at any time by written work order, direct to make changes, additions, or omissions to the Contract and Scope of Work. The parties here to prior to commencement of change shall agree in writing upon any changes in the contract price resulting from such changes.

4. At no cost to Concretum Operis, Inc. General Contractor is responsible for providing and maintaining during the construction time, temporary toilet, security fencing, tree protection, erosion control, any required traffic control and sufficient parking and staging adjacent to work site, and other normal and usual general conditions.

5. General Contractor is responsible for providing and maintaining during construction, adequate water supply on or adjacent to property and sufficient and reliable electrical power source.

6. General Contractor and Client understands that due to constant rise in cost of labor and materials, including fuel for transport of products and materials, this proposal is only good for (15) days from date of submittal. Project delays beyond Subcontractor’s control are not its responsibility and can result in escalation charges due to labor and material cost increases.

7. In the event of any dispute, before demanding arbitration under paragraph 8 below, the parties shall first mediate their dispute before the American Arbitration Association in San Francisco, on an expedited basis.

8. In the event the mediation called for in paragraph 7 fails to achieve a resolution, then my dispute, claim or controversy arising under this Subcontract, or the work performed hereunder will be submitted to binding arbitration before JAMS of San Francisco. The arbitrator shall have the discretion to determine who is the prevailing party, and award that party, costs, arbitration fees, expenses, expert fees, and reasonable attorney’s fees.

Our Price and Scope excludes responsibility or liability for any delays caused by rain, inclement weather, acts of public agencies, owner, design team, general contractor, other contractors, design defects, force majeure, adverse governmental orders (including PGE shutdowns or pandemic shutdowns or constraints), differing site conditions, encountered hazardous materials, change orders and like unanticipated events, including but not limited to unforeseen conditions not in the control of Concretum Operis, Inc.

PAYMENT SCHEDULE:

Payment shall be made to Concretum Operis, Inc. within 15 days of receiving the invoice Past due amounts bear 1.5% per month finance charge. Concretum Operis inc reserves the right to invoice at increments of every two to three weeks, based on progress.

Owner and Contractor is responsible for obtaining all financing that is or may be necessary to fund the work specified in this agreement. Owner and Contractor represent that Owner and Contractor have sufficient funds or have arranged for sufficient financing to comply with this agreement.

ACCESS TO WORK:

Contractor shall grant free access to work areas for all worker’s vehicles and shall provide areas for storage of materials and debris. Contractor shall keep paths clear and free to not impede on Concretum Operis, Inc.’ works, staging, access and operations.

Concretum Operis, Inc shall not be liable for damage to streets, driveways, sidewalks, trees or hard and soft landscaping, shrubs, or other vegetation by reasonable movement of equipment and materials. Contractor and Owner are expected to have factored those anticipated impacts in their overall project considerations and are not part of our scope.

Approval of work by inspection of a governmental agency is deemed to be completion of that work.

CONSTRUCTION SCHEDULE:

If we are provided with and agree in writing to Contractor’s Project Schedule, we are entitled to additional time for delay and other events beyond our control, as listed in Section “Commitment and Payment” above.

F. The crew generally take a ½ hour lunch. Whatever the length, the client is not billed for that time. The crew also is entitled to two 10-minutes breaks, generally at 10:00 A.M and 2:00 P.M., which is included in the bill. Crew time is billed portal-to-portal each way. Time will be billed for working on figuring, jobsite, picking up and ordering materials, and planning. Time spent on accounting, billing, payroll preparation, ETC. is considered overhead and will not be billed.

2. Concretum Operis, Inc. warrants that if there are any defects in workmanship or materials from one year of completion of house construction, Concretum Operis, Inc. will, at its own option, either repair or replace such defective work or materials. This warranty is in lieu of all other warranties, implied or express.

3. The General Contractor may, at any time by written work order, direct to make changes, additions, or omissions to the Contract and Scope of Work. The parties here to prior to commencement of change shall agree in writing upon any changes in the contract price resulting from such changes.

4. At no cost to Concretum Operis, Inc. General Contractor is responsible for providing and maintaining during the construction time, temporary toilet, security fencing, tree protection, erosion control, any required traffic control and sufficient parking and staging adjacent to work site, and other normal and usual general conditions.

5. General Contractor is responsible for providing and maintaining during construction, adequate water supply on or adjacent to property and sufficient and reliable electrical power source.

6. General Contractor and Client understands that due to constant rise in cost of labor and materials, including fuel for transport of products and materials, this proposal is only good for (15) days from date of submittal. Project delays beyond Subcontractor’s control are not its responsibility and can result in escalation charges due to labor and material cost increases.

7. In the event of any dispute, before demanding arbitration under paragraph 8 below, the parties shall first mediate their dispute before the American Arbitration Association in San Francisco, on an expedited basis.

8. In the event the mediation called for in paragraph 7 fails to achieve a resolution, then my dispute, claim or controversy arising under this Subcontract, or the work performed hereunder will be submitted to binding arbitration before JAMS of San Francisco. The arbitrator shall have the discretion to determine who is the prevailing party, and award that party, costs, arbitration fees, expenses, expert fees, and reasonable attorney’s fees.

BACKING RECESSED FIXTURES BY OTHERS

PRIOR TO work by SDI, OTHERS to install air impermeable, R-5 min. POLYISO rigid insulation board in contact with roof substrate, so that it extends at least 8 to 12 inches beyond sides of the recessed elements. Caulking to air seal must be applied wherever rigid board contacts framing within the 8 to 12 inches, or where it is difficult to apply SPF to edges of the board.

Appropriate clearances are required from any heat source ( I.C rated recessed lights) and provide enough air impermeable insulation for condensation control at restricted clearance areas. After fixtures are side wrapped with fiber insulation, this allows spray foam to air seal exposed rigid board, and continues air sealing where it can’t, so that a continuous air impermeable surface is created. Fixtures or elements can be recessed lights, fans, shade or shade pockets, duct work, duct boots, or any other items that restrict installation.

NOTE - SPRAY FOAM: OCCUPANCY, COMPATIBILITY, UVAS OCCUPANCY GUIDELINES :

In some cases, time to re-entry (not occupancy) can be can be reduced if ventilation is increased 10ACH. OTHERS are responsible for coordinating with building occupants to control access to areas where SDI work may affect other workers, occupants, etc. This may include OTHERS having to create a sealed off area to allow spray application. Even if the work area is not in the occupied area, SDI strongly suggests that occupants not remain in building during application due to possible airborne material or odor. Largest amount of airborne material or odor can occur at application due to the nature of spray application, and then will significantly lower after application stops, and then will dissipate over time.

CPVC SPRINKLER PIPE AND PEX PIPE :

The application of SPF insulation shall be installed by a trained and/or certified applicator, and will abide by the manufacturer’s recommended maximum thickness per pass. OTHERS are responsible for installing pipe in correct location to insure protection from freezing. Most all CPVC sprinkler pipe and PEX pipe materials are compatible with spray foam. SDI Insulation Inc. guarantees that we will install spray foam insulation materials that are compatible with CPVC fire sprinkler systems, and that spray foam insulation materials will be installed per manufacturers' requirements. Guarantee will be effective upon timely receipt of payments when due. Sprinkler heads that do not require air flow through the sprinkler to activate must be used, such as flush mount or non-vented recessed types. Unless otherwise specifically included, OTHERS to wrap or protect any incompatible materials and/or PEX pipe per manufacturer's requirements.

UNVENTED ASSEMBLIES

(UVAS) :

Unvented roof assemblies require air impermeable insulation as well as an air sealed assembly which is intended to prevent interior air from contacting surfaces that are cold enough to allow condensation. Spray foam insulation is air impermeable and provides an air seal where it is applied. But other air leakage bypass locations such as, but not limited to doubled up framing joints, wood to steel transitions, or inaccessible locations, may be present and must be air sealed by OTHERS. Unvented roof assemblies require that no significant air spaces exist above the air impermeable insulation. Air spaces may sometimes exist such as at, but not limited to, inaccessible skip sheathing gaps, parapet walls, tapered sleepers, or other elements above the air impermeable insulation. Unless otherwise specifically included, OTHERS to fully fill these cavities with an air impermeable material, or install sufficient ventilation to prevent any moisture issues. General project notes:

All new plywood sheathing to be performed by others at the new construction. Scaffolding (if required) to be provided for our use by General Contractor. Components not specified are not included into the scope. If BRS is asked to stop work to accommodate for other trades/schedules, there will be a $500.00 charge per occurrence.

The price quote above is exclusive of fees associated with obtaining building permits and will remain current for a period of thirty (30) days from the date of this proposal. Composition shingle roofing materials are supplied with a manufacturer’s limited lifetime warranty.

Berkeley Roof Services is proud to offer a contractor guarantee on all new and complete roofing systems for a period of ten (10) years. The roofing materials are subject to the warrantee specifications supplied by the manufacturer.

Berkeley Roof Services is fully insured and holds all the appropriate state and city contracting and business licenses. Copies of certificates of liability insurance and worker’s compensation insurance will be provided to you at your request.

If you wish to proceed with the work described, please initial your choices and sign and date both copies of this contract. Return one copy to us and keep the one copy for your records. An additional payment of 30% will be due on the first day of work and the balance will be due upon completion of the work or receipt of final invoice. A 2.5% surcharge will be applied to all credit card payments. Past due invoices after 30 days will be charged interest. Invoices that are unpaid or delinquent will be subject to a mechanics lien placed on the property and the fees associated with the lien will be passed on to the property owner/signee addressed above.

Notice of Cancellation

You may cancel this transaction, without any penalty or obligation, within three business days from the date you signed the contract.

If you cancel, any property traded in, any payments made by you under the contract or sale, and any negotiable instrument executed by you will be returned within 10 days following receipt by the seller of your cancellation notice, and any security interest arising out of the transaction will be canceled.

If you cancel, you must make available to the seller at your residence, in as good condition as when received, any goods delivered to you under this contract or sale, or you may, if you wish, comply with the instructions of the seller regarding the return shipment of the goods at the seller’s expense and risk.

If you do make the goods available to the seller and the seller does not pick them up within 20 days of the date of your notice of cancellation, you may retain or dispose of the goods without any further obligation.

If you fail to make the goods available to the seller, or if you agree to return the goods to the seller and fail to do so, then you remain liable for performance of all obligations under the contract. A) General Mediation and Arbitration Provision Mediation. Any controversy or claim arising out of or related to this Contract shall be subject to mediation as a condition precedent to arbitration or the institution of legal or equitable proceedings by either party. Notwithstanding the foregoing, either party may file an action or proceeding within seven (7) days of the expiration of any deadline or statute of limitations on any claim or cause of action, but such filing does not excuse the obligation to mediate pursuant to this section. The mediation shall be conducted in accordance with the Construction Industry Mediation Procedures of the American Arbitration Association in effect as of the date of this Contract. Request for mediation shall be made in writing and mailed to the other party to the Contract by First Class Mail and filed with the American Arbitration Association. The condition precedent shall be satisfied if the parties have failed to conclude the mediation within sixty (60) days from the date of the request. The parties shall share the mediator's fee and filing fees equally. The mediation shall be held in the place where the Project is located unless another location is mutually agreed upon. Arbitration. Any controversy or claim arising out of or relating to this Contract or its alleged breach ("Construction Dispute") which cannot be resolved by mutual agreement or mediation shall be settled by arbitration in accordance with the Construction Industry Arbitration Rules of the American Arbitration Association in effect as of the date of this Contract, and judgment upon the award rendered by the arbitrator(s) may be entered in any court having jurisdiction. The Construction Industry Arbitration Rules may be found at www.adr.org or by contacting the American Arbitration Association. Waiver of jury trial and right to appeal. It is recognized that the Seller's review of the drawings/plans is made only in the Seller's capacity as a material supplier and not as a licensed design professional . Unless specifically enumerated, Seller has no installation, means and methods, or design responsibility for this Project. This document and the attached product specifications constitute the entire Sales Order. Descriptions and pricing for the products included in this order are summarized below:

Lead Time

Any shipping dates provided by Argonaut Window & Door, Inc are estimates only and are based on information provided by our manufactures at the time of sale. Argonaut Window & Door, Inc shall not be liable for any damages from any delay in performance due to factors beyond Company’s reasonable control, including, but not limited to, acts of God, accidents, delays in transportation, labor disputes or shortages, or delays by suppliers or other third-party vendors.

Cancellation & Changes

Order cancellations and changes are not permitted once this Sales Order has been signed and submitted. All manufacturers begin production as soon as the order is received and will not stop production for any reason. Please be certain of your product specifications before approving this sales order.

Product Warranties

All products sold by Argonaut are supported by our Service and Warranty department and backed by their respective manufacturer’s warranty. Product issues and warranty claims should be directed to our Service and Warranty department to be processed on your behalf.

Delivery, Inspection, & Storage

Customer agrees that delivery will be made within 14 days of product receipt in seller's warehouse and delivery may be in partial shipments at the discretion of seller. Delivery is curb-side only. Customer takes responsibility for the labor and equipment necessary to move Goods to desired location. Customer shall immediately inspect all Goods upon receipt and, if found improper or damaged, shall provide written notice to Argonaut within 48 hours of receipt. Storage Fees will apply for Goods remaining in seller's warehouse after 14 days at a rate of $400 per month.

Additional Services

Post sale services are offered for a fee and include: screen and hardware installation, lock and glide inspection, and adjustment. To have these services performed, make sure "Post Sale Service" appears as one of the line items in the "Item Description" above.

Disputes

The parties hereby consent to personal jurisdiction of the courts of Superior Court of California, Santa Clara County with respect to any legal action to enforce the terms and conditions of this Order. The prevailing party shall be entitled to recover all of its reasonable attorneys’ fees, expenses and costs.

Holding Screens & Hardware at our Warehouse Facility

Throughyearsofexperience,wehaveencounteredcountlessprojectswherescreensandhardwarehavegonemissingordamagedduringthe constructionprocess.Replacementofthesepartscanbecomeverycostly.Wehaveasolution.AspartoftheArgoCarepackage,wewillholdyour screens and hardware in our warehouse facility until you need them. And then, when you are ready we will install them for you!!

Screen & Hardware Installation & Adjustments

Afteryouhaveremovedanyprotectivefilmontheglass,andafteryourglassandtrackshavebeenthoroughlycleanedofalldebris,andallpaint workhasbeencompleted,youwillbereadyforustoinstallyourwindowandpatiodoorscreensandfinishedhardware.Wewillalsomake adjustments to wheel rollers on your doors and adjust door and window hinges that have the adjustable feature.

AtthetimeofthePostSaleappointment,ifanyitemsarerequestednottobeinstalledandtobeleftonsite,Argonautwillnotberesponsibleforany damage or loss to those items.

Product Warranty

Itistheresponsibilityoftheinstallertomakesurethatwindowsanddoorsareinstalledinaccordancewitheachmanufacturersinstallations instructions/guidelinesandlocalbuildingcodestomaintainproductwarranty.Thisincludesmakingallnecessaryadjustmentstowheels,hinges, locks, and levers. All product should be in proper working condition when the installer has completed his work.

All quotations will be subject to change unless an order is placed within 60 days from the quotation date and written approval is sent to the Registered Dealer. Further price holds may be available for Volume Program ("VP") orders, but must be agreed to in writing by a member of the VP management team.

Lead Times & Ship Dates

All products are manufactured to your specifications. The lead time will vary depending upon your requirements and begins when we receive your signed Approval Packet (consisting of a signed Dealer Quotation, any required deposits, and signed shop drawings and color chip, if applicable). Please allow sufficient lead time as advised by your sales representative. All lead times and shipment dates (whether provided in a Quotation, Acknowledgement, or otherwise) are estimates only. Western Window Systems uses commercially reasonable efforts to fill orders in accordance with the estimated lead time and shipment date. However, Western Window Systems will not be responsible for any delays in filling an order nor be liable for any losses or damages resulting from such delays, and no order shall be subject to cancellation for such delays. Please refer to “Lead Times” on the Custom View homepage for current production lead time.

Orders

VP Program lead times vary by product type and are estimated as follows: 7600 Series VP doors = 10 production days, 600 Series VP doors = 10 production days, 3600 Series VP doors = 5 production days; and Semi-Custom doors = 15 production days. (All lead time measurements described herein relate to production days and therefore, do not include time for shipment or delivery). Western Window Systems uses commercially reasonable efforts to fill orders in accordance with the estimated lead time and shipment date. However, Western Window Systems will not be responsible for any delays in filling an order nor be liable for any losses or damages resulting from such delays, and no order shall be subject to cancellation for such delays. Western Window Systems is not responsible for determining whether the incorporation of its products into a building design will achieve a particular third-party certification or standard as windows and doors are only one factor in the building envelope. Determining such product suitability is the responsibility of the architect, contractor, registered dealer, installer, owner, user, and/or other construction professionals. Western Window Systems will also not be responsible for any claims or damage arising from inappropriate selection of products, faulty building design or construction, improper installation, or inaccurate orders.

Western Window Systems also does not control the application or selection of its product configurations, sealant, or glazing materials and assumes no responsibility therefore. It is the responsibility of the architect, contractor, registered dealer, installer, owner, user, and/or other construction professionals to make these selections in strict compliance with applicable laws and codes.

Registered Dealer is solely responsible for ensuring product shipments are safely received. The Registered Dealer shall provide, or require third-party recipients to provide, at least two (2) individuals to offload products from the truck at the time of delivery. Any failure to provide appropriate personnel may result in the inability to make delivery as scheduled. Western Window Systems will not be responsible for any damages or inconvenience caused by any such delayed shipment and the Registered Dealer shall defend, indemnify, and hold Western Window Systems’ harmless from any and all claims, demands, or lawsuits arising from or relating to such delayed shipment.

Installation

Western Window Systems does not install its products and is therefore not responsible for any installation defects, errors, or omissions. The Registered Dealer is solely responsible to take reasonable steps to ensure WWS' products are installed properly and in strict compliance with American Architectural Manufacturers Association ("AAMA") requirements, applicable building codes and regulations, and Western Window Systems' written installation instructions, such as only engaging, hiring, or recommending experienced installation professionals or selling products to building/construction professionals who are responsible for ensuring proper installation.

Warranties: exclusive remedy

Western Window Systems provides express limited warranties with its Products, which are available at www.westernwindowsystems.com/faq/warranty. Western Window Systems makes no other warranties and expressly disclaims all other representations, warranties, conditions, or covenants of any kind, either statutory, express, or implied including without limitation, any implied warranties of merchantability or fitness for a particular purpose, use, climate, condition, or durability. -Dear Client, please note that on all active job sites where wireless coverage is spotty or inaccessible, the G.C. will need to provide the password to the local WiFi, in order to allow our crews to be reached during the work day.

- All client remnants after job completion will be stored at no charge for 3 months, after which a storage fee will be charged at $50/month or the items will be discarded by Constructa

- Small slivers/ pieces of left over material will be discarded by Constructa during the fabrication process

- Constructa markup on purchased materials includes but is not limited to:

• Material take off, purchasing and handling, load and unload, layout at shop, slab breakage due to Constructa fault, sealing, storage and delivery to the job site. Markup varies by material and quantity ordered.

NOTES for Tile jobs:

-Handmade Tile: Variation is an inherent part of any handmade product and will affect tile sizing and color. These properties affect color variation, which is easiest to see after installation. Variation can affect: Hue, Saturation, Sheen, Texture, Size and Grout Line. All costs to “fix” or address any of these Variation issues, should they occur, will be a change order.

- Allowances: $20/sf cost material allowance used for all TBD Tile, priced as regular tile. Change to Mosaic will affect labor cost

- All Floors to be installed over a cement/deck mud mortar float unless otherwise specified

- All tile work comes with (2) grout color samples per tile type, additional grout samples requested will be an additional $150 per sample

- All tile materials are priced with a 20% overage

- Tile layouts must be decided with the GC or client representative, Constructa takes no responsibility for deciding layout of tiles. One tile layout with GC or client representative is included in all tile cost. Additional requested layouts will be charged at $250/hour as needed to complete the layout. Specific Tile selection is not included.

NOTES for Slab jobs:

- Items such as Islands, counters and vanities, which include at least one undermounted sink cutout also include (if needed) the following labor:

• cutting subtop (plywood) for sink placement

• installation and caulking of sink

• drilling of fixture holes

- Allowances: $25/sf cost material allowance used for TBD Slab

- All slabs assumed to be 2cm in thickness. Unless otherwise identified in Base Contract, slabs with differing thicknesses will affect labor costs

- All edges of fabricated items are assumed to be a mitered edge, unless otherwise specified

- Shop Drawings are not in contract. These can be added, for an additional cost upon request at a rough cost of $280 per page. Cost may change upon actual request by client.

- Measurement drawings can be requested by client; these drawings will not be to scale and will be considered rough shop drawings

- 2 free layouts per slab item are included in the cost of slab work. More than 2 layouts per item will be charged an additional $150 /hour.

NOTES for Cleaning jobs:

- Efficient and thorough cleaning of existing installations (by others) is an essential part of Constructa’s policy, but please note cleaning will be done to the best of Constructa’s ability

NOTES for NuHeat jobs:

- NuHeat cost includes wire or matt heating system, (1) Thermostat and two probes per room once added to contract

NOTES for W/P jobs:

- Note to Waterproofing of Shower Pans and Curbless Shower Floors:

• Inspection by Building Dept. must occur after 48 hours, but possibly no later than 5 working days after filling the pan with water by Constructa representative;

• General Contractor is responsible for checking water testing results before submitting it to the inspector, and must be present during inspection.

• To guarantee integrity of work, tile installation should continue no longer than 5 working days after inspection is passed.

• General Contractor is responsible for protection of waterproofing after inspection.

• Availability of pan/floor covering materials at site is a recommended prerequisite to commencing waterproofing work.

NOTE for cutting down material or when reducing tile or slab thickness, the following should be noted:

- Constructa will attempt to reduce stone thickness as required, but this will be done "to the best of our abilities"

- Solid surface materials (stone, ceramic, quartz, etc.) are manufactured at a certain thickness for structural integrity, by asking Constructa to reduce the thickness you are asking us to modify a

manufacturer’s spec. Constructa cannot guarantee or be liable for consequences, including refabrication or material repurchase.

- This bid includes engineering drawings, hydraulic calculations, labor, material, installation, and testing of system.

Provisions:

A. The provisions of the Conditions of Proposal attached hereto are incorporated in full by reference and shall govern any contract entered by Todd Morris Fire Protection, Inc.

B. Builder to provide Todd Morris Fire Protection with adequate water supply as required by hydraulic calculations. on plans and a full set of plans for design use.

C. Builder to provide Todd Morris Fire Protection with "tee-off" domestic water line within three feet of sprinkler riser as shown

D. Builder to notify Todd Morris Fire Protection 8-12 weeks prior to installation date.

E. Builder to provide Todd Morris Fire Protection with deposit before any work begins (includes engineering & surveying)

Exclusions:

- Permits and fees are extras, No spray foam on pipes unless wrapped or insulator take responsibility or void of warranty

- Electrical work to be done by others, no freeze protection, no insulating (all CPVC must be insulated)

Engineering Dept. Notice:

- With few exceptions, you will need to upgrade your water meter to one inch.

- Our engineers require a full set of approved plans in order to design the Fire Protection system.

- Point of entry of water line to building should be noted and size of water line from the meter if available.

- A full set of plans should include the following:

- Site plans, Architectural, Sections, Floor, Framing, Mechanical, Electrical and if included, Landscaping plans.

- With this data we can produce your plans faster and With more accuracy. Without a full set of plans, we must resort to procedures which may result in slower submittal and completion times.

Scheduling Notice:

Notification is required prior to rough-in of fire sprinkler systems. Allow from 4-6 weeks from the date of notice to the date you would like us to start the installation.

Estimator Notice:

As we strive to keep our prices down, material costs seem to be increasing almost weekly. Brass products (adapters, gauges, flow switches, etc…) CPVC, copper our bid prices for 30 days. For larger projects, we will attempt to lock in prices for the duration of the construction.pipe and fittings are among the most noticeable. For this reason, we will only be able to guarantee our bid prices for 30 days. For larger projects, we will attempt but cannot guaranty to lock in prices for the duration of the construction.

Furnish labor for the completion of HVAC system, to include:

EXCLUSIONS:

HERS rater, certificates, test and balance, structural calculations, line voltage electrical, scaffolding, plumbing flashings, electrical flashings, permits, bonds, fees, trenching, traffic control, engineering, design, .

Contractors are required by law to be licensed and regulated by the Contractors' State License Board, which has jurisdiction to investigate complaints against contractors if a complaint regarding a patent act, or omission is filed within four years of the date of the alleged violation. A complaint regarding a latent act or omission pertaining to structural defects must be filed within 10 years of the date of the alleged violation Any questions concerning a contractor may be referred to the Registrar, Contractors' State License Board, and P.O. Box 26000, Sacramento, CA 95826.

In the event that any legal action is instituted for either the interpretation or enforcement of this agreement, or arising out of this agreement, the prevailing party shall be entitled to an award of reasonable attorney's fees, costs, and filing fees in addition to any other remedy allowed by law. All sums are due and payable when billed by Contractor, sums not paid when due shall, after 30 days, bear interest at the rate of one and one half percent (1.5%) per month, calculated and compounded daily until paid. The agreement and subsequent contracts/change orders shall be construed in accordance with the laws of the State of California Venue for litigation to enforce any terms of this agreement shall be Sonoma County. A facsimile copy of this agreement shall have the same cause & effect as an original document All returned checks shall be assessed a $20 00 returned check fee Waivers of subrogation will incur an additional $250.00 charge.
