The Scoop For The Walking Horse Industry letter to Congressman Whitfield May 2, 2013 The Honorable Ed Whitfield United States House of Representatives 2184 Rayburn House Office Building Washington, D.C. 20515-1701 Dear Congressman Whitfield, I have carefully studied H.R.1518. The bill, if passed, will have historic significance. It will be the first time that a recognized horse breed, the Tennessee Walking Horse, will be destroyed by an act of congress.

What was the answer to this dilemma? The department drug out the concept of selfregulation and mounted a campaign to sell this idea to the Walking Horse Industry. Part of this self-regulatory scheme was to convince the yokels in the horse industry to create horse industry organizations from within their ranks, to be certified by the Department of Agriculture. The Department authorized the HIOs to hire people to inspect horses at shows and sales, and incredibly, convinced the industry to agree to pay for checking the horses by imposing a fee for every horse entered in a show or sale.

It is painfully clear that the Walking Horse Industry needs a transparent and effective regulatory system. The purpose of this letter is to hopefully persuade you and others that there is a better way than the approach embodied in your bill. If your bill passes, what will be the fate of thousands of existing performance walking horses which were bred for and trained with pads and action devices?

We in the Department, being superior creatures, know that this system is fundamentally flawed. The industry will have to deal with inevitable appearance of corruption and conflict of interest. Surely there will be friction among the HIOs, over which factions within the industry will control them. In addition we are not requiring any due process rights for those assessed penalties by the HIOs. We will go to some shows in a supervisory capacity and even prosecute some selected cases, although we must be careful, because if we prosecute, we must provide due process.

Thirty years of feckless Federal efforts to stop the soring of these horses has resulted in frustration of all parties concerned.

This system has resulted in industry fighting among ourselves like the “Hatfields and McCoys”.

The passage of an ill-conceived Federal law (The Horse Protection Act), the creation of a fundamentally flawed regulatory scheme for implementation of the law, plus years of erratic administration of this law has resulted in widespread confusion and loss of credibility of all parties. There are alternative models to effectively regulate this industry. I would think that you and your colleagues will be better served as saviors of an important industry for your state and other states rather than destroyers.

Of course the Department knew, or should have known, that they could control this whole system by rule-making. And the best news is we are the “good guys” and are not accountable to anyone. After all, that is what the Bureaucrat’s Manual teaches us, right?

So, before we write the obituary of this great horse, let us examine ways to regulate this industry more effectively. Jurisdiction The Horse Protection Act is not a horse protection act at all. It is a law to protect a buyer of a horse who might pay more for a horse that is more competitive because his feet are sore. The law was passed under the federal government’s power to regulate commerce. The argument was: a sore horse is more valuable in competition than a horse that has not been sored, which distorts the market value of these horses, and thus Federal regulation was proper. Under this legal theory, Federal jurisdiction was limited to shows and sales and transportation of these horses. Therefore, the Horse Protection Act is concerned with the welfare of these horses in shows and sales, where a horse spends about one percent of it’s life. By contrast; Tennessee (1), Kentucky and other southern states ... had soring statutes years before the Federal law was passed. Under state law, these horses were protected from soring or any mistreatment in competition as well as in barns and pastures (where these horses spend ninety nine percent of their lives) - before and after any competitive career a horse might have. TCA 39-14-202 A person commits an offense who intentionally or knowingly… (5) inflicts burns, cuts, lacerations or other injuries or pain by any method, including blistering compounds to the legs or hooves of horses in order to make them sore for any purpose including but not limited to competition in horse shows and similar events. Why would anyone who cares about these horses support government regulation (Federal) that protects these horses one percent of their lives and abandons government regulation (States) that protects them ninety-nine percent of their lives? The motives of those who bought into federal regulation must be critically examined. Self Regulation Once the HPA was passed and sent to the Department of Agriculture for enforcement, a harsh reality set in. The Department of Agriculture quickly figured out that Congress expected a million dollar result on a nickel budget.

Page 46 / The Scoop

After the Walking Horse Industry swallowed this scheme “hook, line and sinker”,a congratulatory session was held in the Department of Agriculture. The session probably went something like this ... Policy Analyst I: “We have pulled off the bureaucratic coup of the century and gotten ourselves off the hook.” Policy Analyst II: “You are right of course, but we should admit we have pushed the concept of self regulation to the limit. It is legitimate to permit regulated industries to participate in developing policy with the Regulating Agency. However, to actually permit enforcement of a Federal Law by private industry groups is a bridge too far. Well maybe the boobs won’t figure this out for years. And in the final analysis we must be guided by the Eleventh Commandment of Federal Bureaucrats: Our job is not to solve problems but to manage problems. And at any rate, Scarlet O’Hara was right ... we will worry about that tomorrow”. It took more than thirty years but finally the Inspector General of the USDA studied this self regulatory scheme, which the Department set up and found the obvious problems. After a three year study, his conclusion and recommendation was that the heart of the system, the HIOs, be eliminated. And what was the Department of Agriculture’s response - the Department doubled-down on retaining the HIOs, and threatened decertification of the HIOs if they did not impose the Department’s mandatory penalties. Conclusion to Self Regulation 1) The HIOs should be eliminated in accordance with this provision in HR.1518. 2) The Inspector General did not recommend an alternative model for regulation of the Industry, so this is the task before us. 3) Eliminating pads and action devices is not the proper response. There is no scientific evidence that these devices harm horses, if the devices are properly used. 4) The first thing that anyone who attempts to regulate this industry must understand is that soring horses is a training practice used routinely in training barns. It is not a practice of soring the horse just to make the horse more competitive and more valuable at shows. The HPA was passed, based on a finding by Congress, that a sore horse was more valuable in competition than a horse not sore. Because of improved breeding of these horses, plus inspections at shows and sales, the more plausible argument today is that a sore horse is less valuable and as a show horse, is virtually worthless.

NEWS

The Scoop For The Walking Horse Industry letter to Congressman Whitfield, Continued Recommendations 1) Start with State jurisdiction where horses can be routinely and reasonably checked in training barns. This is far more important than Federal jurisdiction at shows and sales. The Department of Agriculture has, by dubious means, extended the jurisdiction of the HPA to training practices in barns by the adoption of the “Scar Rule”. The rationale is that a callous on a horse’s foot is evidence of previous soring. This is absurd. 2) Withhold action on HR1518 and use the influence of your Committee to convene a meeting of the Commissioners of Agriculture from Kentucky, Tennessee and other interested states. The Governors and/or their representatives should be involved in this meeting as well as representatives from the Walking Horse Industry and policy representatives from the Department of Agriculture. Request this group

of officials to develop a regulatory system for this industry involving both State and Federal jurisdiction and make recommendations to your committee. 3) Abandon the recent Elliot Ness approach of planting informants in barns, torturing the legal process to get federal jurisdiction to inspect barns. Sincerely, William J. Reinhart Cc: Governor Bill Haslam, Governor Steve Beshear, Senator Lamar Alexander, Senator Bob Corker, Senator Robin L. Webb, Congressman Frank Lobiando, Congresswoman Jan Schakowsky, Congressman Steve Cohen, Congressman Joe Pitts, Congressman Jim Moran, Commissioner Julius Thomas Johnson, Commissioner James Comer

THE IRS’S MISGUIDED APPROACH TO “RECOUPMENT” For any business, long-term profit potential may hinge, in some measure, on efforts to reduce costs, getting better prices for goods and services, consolidating operations, layoffs, or efforts to promote efficiency. For many people in the horse or livestock business, the operations have a history of losses, but the expectation is that future operations will be profitable. The IRS will want to see evidence that the taxpayer has taken steps to correct or abandon unprofitable strategies, and to demonstrates steps taken to improve operations. Often, the IRS will argue that a profit motive ultimately depends on whether the taxpayer expects future earnings and appreciation to be sufficient to recoup accumulated losses of prior years. The IRS will want to see a meaningful plan for recouping losses sustained in prior years. This seems inherently unfair. Other businesses are not asked to demonstrate a plan to recoup past losses. In some industries past losses have been so great that the companies might never really end up recouping them. According to Terrence D. Miller, CPA, of Miller and Miller Accountancy Corporation in Fresno, California, “In my experience with audits, quite often an auditor will be obsessed with the cumulative losses and they fixate on it. And the losses might not ever be recoupable. Luckily there is a Tax Court case on the subject and usually when you show auditors this case they move on.” He is referring to Helmick v. Commissioner IRS, T.C. Memo 2009-220, which involved a horse breeding and boarding operation with losses for a period of 17 years. The Tax Court held in favor of the taxpayers, and rejected the IRS “recoupment” argument. The court said that the IRS “seems to assume that the requisite profit motive as of any given year must involve an expectation that even all past losses will be recouped, so that the activity will have generated a net profit over its entire course. This position distorts the notion of profit motive for purposes of section 183.”

The court cited a hypothetical example: “If a natural disaster caused the death of 90 percent of a rancher’s herd and resulted in a catastrophic loss that could never be recouped, but the rancher thereafter expected to generate an overall prospective profit by breeding and selling the remaining 10 percent of his herd on a foregoing basis, then he could not be said to lack a profit objective after the disaster merely because he would never recoup the prior loss.” The court pointed out – and this is very important – that the “recoupment” concept is forward looking. That is, the profit objective is shown where the taxpayer expects that the activity will generate an overall profit between the year being audited and the time at which future profits are expected. To some extent, taxpayers often can explain a poor history of profits due to circumstances beyond their control, including personal issues, casualties, stillborn foals, and the negative effect of the recession on horse sales. The implication is that the activity, in a given year, would have been profitable if these events had not occurred. Whether an activity producing losses is a business or a hobby is a question that has generated substantial litigation in U.S. Tax Court. If faced with an audit of horse or livestock activities, it can be frustrating when confronted with an IRS auditor who wheels out the “recoupment” argument. Thankfully, there are Tax Court cases, such as that mentioned above, that provide a rational approach in determining whether the taxpayer has a bona fide profit motivation. The 76th Annual West Tennessee Strawberry Festival Horse Show Humbolt, TN- The 76th Annual West Tennessee Strawberry Festival Horse Show was held on Friday, May 11th at 6:30 pm. The location of the show was the Chalmus Davenport Arena in Humboldt, TN. The evening was filled with great horses, friendly faces and delicious strawberry shortcakes! The show originally was scheduled for Friday night, but due to the weather forecast show management postponed the show until Saturday. The judge for the show was the honorable Frankie Jo Bradley. He had the job of marking the cards for classes that included model, performance and flat shod divisions. There were 10 Riders Cup classes as well. The Strawberry Festival was affiliated with MSHSA and SHOW HIO. Taylor Walters had an exciting night by claiming four blue ribbons at the West Tennessee Strawberry Festival. Three of those blue ribbon rides were back to back! That is a Saturday night that should go down in history! Show Manager Vicki Benjamin put on a great event along with the help of many others. The final class of the night was won by Bee Bee King and trainer Jimmy McConnell riding for owner Rachael Costaldi. Reserve in the stake went to Jail Time with Michael Wright in the irons for Sammy and Gayle Cagle. The Scoop was proud to be a part of this fun event and support a show that has been a hit for 76 years! The strawberry shortcake made the trip worthwhile and seeing our customers blue ribbons smiles!

PUSHER’S DOLLAR PUSHED HIS WAY TO CHAMPIONSHIP VICTORY IN DECATUR Decatur, AL – The 42nd Annual Racking Horse Breeders’ Association of America Spring Celebration was held in the Racking Horse Arena on April 24-27, 2013. The Honorable Tonya Parsons-Beaver, Jamie Lawrence, and Ricky Parker had the difficult job of judging the seventy-seven class event. The alternate judge was Kelly France. John Cordell did an outstanding job as ringmaster. Gene Frye served as master of ceremonies and Jane Frye was the organist. Jack Greene served as the official photographer for the show. Don King, farrier, handled any shoeing needs. Show Management is pleased to report that there were 477 entries to make this a very successful show. Papa’s Final Choice, the 2012 World Grand Champion, under the direction of Larris Missildine made an outstanding exhibition with the crowd showing lots of enthusiasm. The Grand Championship class saw seven outstanding horses answer the gate call. Pusher’s Dollar thrilled the crowd winning the championship for owner/rider Jason Creech. The twosome made an outstanding show and victory pass. Reserve in this good class was E.K.G. and Pete Slemp for owner Ronnie Slemp. The yellow ribbon went to Ritz’s Cosmo and Danny Odum for Lewis Fred McRoy. The SCOOP congratulates all of the participants and the show management for a successful Spring Celebration. Please visit our FREE website at www.thescooponline.com.

Pusher’s Dollar and Jason Creech made a great ride to claim the blue in the Racking Stake class. They were met in the winners circle by friends and family. Page 72 / The Scoop
