WHITE PINE, TN-The East Tennessee Trainer’s Association held their 10th Annual horse show this past weekend in White Pine, TN November 1-2, 2013. Small Miracles helped with the admission gate and a donation was made to their organization for their help. This show benefits the Trainer’s in East Tennessee with a much needed Medical Fund. This is a benefit as most of the trainer’s do not have any type of medical insurance.
The show started on time even with the USDA in attendance. Classes were a mixture of light and full. The checking of horses seemed to be done fairly and not with the intent to shut down the horse show. Each night the show ended early enough to where those traveling could get home and ready for the next day in a timely manner. There were three exhibitions over the two day show, Emily Kiser-Jackson exhibited Jose’s Almighty Ritz winner of the Specialty Action Juvenile 13-14 Stake WGC class, Diana Bowers exhibited Santana’s Super Natural winner of 15.2 Amateur Barelegged WGC class, and Jason Creech exhibited Pusher’s Dollar the winner of the Barelegged Stake WGC class. These were very exciting and impressive exhibitions as well as such great accomplishments made by these three individuals. Thank you for showing to us your great animals.
Kara Gram and Jose’s Signature Videl win the Model Class. On hand were Mrs. Debbie Givens along with her children Christopher and Kelsey for the presentation.
After the judges tied the Model class Mrs. Debbie Givens along with her daughter Kelsey and son Christopher were in attendance to present the Jeff Givens Memorial trophy to the winner. The family was also presented a platter from the East Tennessee Trainer’s Association in remembrance of Jeff Givens. Truly a gentleman and he will be missed by all. Thank you for the memories. Over 54 classes were judged and tied with the Stake and Scott Beaty bringing home the prize. Siege won the day and showed everyone in White Pine just how it was done. If you weren’t there you missed a great time of fun, fellowship and friends. See you around the corner and down the road at the next horse show.
Christopher, Debbie, and Kelsey Givens were at the show to present the trophy. The show was in memory of Jeff Givens. Page 18 / The Scoop

The Scoop For The Walking Horse Industry WHITFIELD AMENDMENT SEEKS TO OVER-REGULATE HORSE SHOWS Washington, DC - Republican, Ed Whitfield of Kentucky continues to pursue redundant legislation to over-regulate the American Walking Horse Industry. His bill named the Prevent All Soring Tactics Act (H.R. 1518/ S.1406) would allow the USDA to be the sole inspection entity to evaluate horses for soring* at shows and events after the Walking Horse industry has successfully self regulated to eliminate soring. Contrary to the claims of the bill’s supporters, soring is currently illegal, well regulated, and rare. It is the opinion of The Cavalry Group, an advocate for animal owners and animal related businesses, that these regulations would only serve to further inhibit well intentioned horse owners from participating in shows, and its over reaching will negatively impact all breeds and disciplines. Mindy Patterson, president of The Cavalry Group, said the following, “Radical animal rights groups like the Humane Society of the United States have long desired to end horse shows, and other animal based entertainment that they wrongly view as unethical. Soring is but another thinly veiled, baseless attempt to scare people away from showing their horses with the risk of fines and criminal prosecution. Not only is Congressman Whitfield misinformed, it is no coincidence that Ed Whitfield’s wife, Connie Harriman-Whitfield serves as Senior Policy Advisor for the Humane Society Legislative Fund raising the issue that his sponsorship of this bill is a conflict of interest which is driving this effort.” “It is sad that otherwise solid Republicans and rural Democrats who claim to be supportive of agriculture continue to buy into the uninformed, far left wing narratives of these animal rights organizations. The current soring regulation system has been very effective at preventing the practice. In the age of sequester, more big government intervention is the last thing we need.” *Soring is a method used by unscrupulous horse owners to manipulate the gait of the horse through the use of physical or chemical irritants on the front hooves. For more data on the rare occurrence of soring, please view data information attached.
correction In The Scoop’s October 28, 2013 issue we inadvertently omitted the AOT from the classes that Debbie Smothers’ horse Avenger’s Foxxy Farrah won at the SSHBEA World Celebration held October 2 – October 5, 2013. The correct names of the classes should read as follows: Trail Pleasure Amateur Owned and Trained 4 Year Old & Over World Grand Champion Unanimous; and, Trail Pleasure Amateur Owned and Trained 4 Year Old & Over World Champion Unanimous. We apologize for any inconvenience this may have caused.
Cornelius Takes the Role as TWHBEA President Rob Cornelius was named President of the Tennessee Walking Horse Breeders’ & Exhibitors’ Association at the Executive Committee meeting held on October 26, 2013 at TWHBEA headquarters. Cornelius is finishing out the 2013 term for previous President Loyd Hall Black.

The Scoop For The Walking Horse Industry THE THRILL OF THE RIDE I bought my first Tennessee Walking Horse by accident. I am a goal setter – even in college I wrote out short and long term goals. One that stuck was to purchase a horse when I got in practice. I had a patient and friend who owned the grocery store in a small town in northern Kentucky . He had several horses - two Saddlebred geldings and a Tennessee Walking Horse mare. I was invited on a ride with him and fell in love with the smooth ride provided by this mare. I begged him to sell her to me that day even though I had no place to keep her. He did, and I still think of many enjoyable days riding along those picturesque Ohio River trails in Warsaw , Kentucky. Next, there was a patient who took me to my first horse show to see their horse exhibit. As I walked around the show grounds, met their trainer and looked at all the beautiful stock, I could hardly contain myself. Later sitting in the stands watching the classes it came to me that I could ride in one of those classes. It would be several years before I went to my first Celebration and saw the greatest horse show on the planet, but I was hooked. Yes, it was my first show when I first saw a class of Tennessee Walking Horses strut around a little ring that a place in my heart filled up. I remember reading an article in the Report about the late Mr. Hamilton. He related that when he rode Ebony’s Princess it was like “a little bit of heaven”. It would be much later I could say the same thing about my ride. I was eager to ride a show horse so the next week I went up to Union to see Mose Oppenheimer. During that 30 mile trip I kept saying to myself not to buy another horse. Mose sold me my first show hoss that day! “Stroller Boy” was wind foundered and breathed like a freight train after the first round. Mose did let me trade him in for a better mount. “White Music” was a solid white gelding by Midnight Sun. He had black eyes and I thought he was “real pretty”. I guess everyone wants a white hoss in the beginning. I tell people that “Music” is the reason Mary Ann went out with me. She was in college at Eastern Kentucky University . When I met her and asked if she ever came home on the weekends, she said “no”! Then I told her I had a horse. She did consent to a date if she got to ride the horse. Later I found out she had wanted a pony all her life. On that sunny fall day when she took “Music” around the ring, I think that secret place in her heart also filled up. We are still riding together after 46 years! In those days the trainer just threw you up there and off you went. I rode all slumped over like Mose and the faster I went in the running walk the bigger the thrill. Most of the time I ran my hoss off his feet, and tied down, but I was having lots of fun! I knew from my first lab in Chiropractic College how important correct posture was, but I thought that poor riding posture was part of the industry. It would be three more years before we went to our first Celebration. We rented the upstairs of someone’s home in Shelbyville and when they did not have the baby crib they promised, our infant daughter Amy (she has the hoss gene too), slept in the bottom draw of the dresser next to our bed. I remember sitting in the West grandstand hypnotized watching class after class while the greatest riders and horses in the world passed in front of me. Right away I picked out my favorite rider – Mr. Vic Thompson. He sat up so straight and never moved. His hands and arms were level with his chin slightly tilted up. He looked like the horse was riding him instead of him riding the horse. At the time I thought that was how an amateur could win the big stake. But I still slumped when I rode because that was the way Mose rode. No one ever said “sit up straight
Page 54 / The Scoop
Morgan” until I met Jimmy Carnathan in Tupelo , MS . Later I would go on to build a barn where he trained. Jimmy taught all of us (and our three kids) to ride and show. He tried to teach me to “feel” the square gait with my rear end. I never quite knew what he was saying. In fact, it took me twenty years of riding to really know what he was talking about. Jimmy was always fussing at me for going too fast. I wanted to be like Joe Webb and Carbon Copy and go around the ring 90 miles an hour like the barn was burning down! Two things Jimmy never let up on – sit up straight and never come out of the show ring unless you are excused. I had no trouble with the second thing, as I always thought my class went by too fast. But, I had all night after the show to re ride my class in my head and dreams. I still do that pretty much. I kept trying to improve my riding all along. Yes, I enjoyed watching our horses show and raising colts, but riding and showing has always been my thing. It was not until I came to Georgia that it finally came to me that I could sit still and feel the gaits - my saddle seat had finally arrived. I still kept studying and picking out my favorite riders all along and settled on Ed Breedlove – my hero. Ed never rushed (still my big mistake) his mount and he never moved in the saddle. He always seemed to know where he was in the ring and saved the best of his horse for the judge’s viewing until last. Jimmy used to say I showed my best behind the judge! Even today I study good riders and what it takes to be a good showman. For twenty years I had to hear all our friends tell me I needed to get Amy to teach me how to ride. She had perfect balance, but mine came from years of practice and determination. One thing I know God worked out for me was giving our family a world champion trainer and a World Champion mount for me to ride. We were one of the founding families of Life Chiropractic College in Marietta , and soon found ourselves hauling our stock to Georgia to work and live. I tell everyone who will listen how God gave us a world champion. This horse was born right outside our kitchen window on Morgan Hill Farm. We got to watch him grow and develop every step of his career. It would be awhile before Gary Edwards would let me climb up on his back because of his “454 motor”. But I was getting better with my “seat” and anxious to ride the next good show horse in their stable. I know these Edwards have had a lot of riders come through their program but I bet they never had one that got as excited to ride as I do. So young riders – sit up straight, it not only helps develop healthy “disc” between each spinal vertebra. It looks so much better to the fans. Find you a good riding coach – we have some good ones now – and don’t get discouraged. Remember rule number one: don’t let the judges determine your happiness. In the show ring, try to derive your fun and pleasure by grading your own ride. Most of all make as many horse friends and competitor friends as possible to better enjoy the great fellowship horse people offer us. Lastly, remember to exercise and stay in shape to ride, study other riders, set your goals and try and have as much fun riding as possible. See ya at the hoss show! Dr. Tom Morgan

WALKING HORSE ENTHUSIASTS SUPPORT KIDS HUNTING FOR A CURE Fayetteville, TN - On October 24-25, 2013, the Matt Malone Memorial Chapter of Kids Hunting For A Cure hosted an auction and deer hunts on land in Lincoln County. One of the hunts was held on the property of longtime Tennessee Walking Horse owner and exhibitor, Charles Gleghorn. These dates correspond with the Tennessee Youth Deer Hunt. Kids register and are provided a place to hunt and a guide to assist them. The guides may be parents or volunteers. In the picture above are two of the hunters with their trophy bucks. Volunteers, Brett Boyd, walking horse trainer at Brookhaven Farms, and Bart Lovvorn, another walking horse enthusiast, guided these two successful hunters. Hunts also happened in Franklin, Moore, Giles, Bedford, as well as, Lincoln Counties. The events averaged between 75 and 100 kids. A fund raising auction was held on Friday night. Also, community businesses and individuals make donations. There is a sponsor T-shirt that lists those who have donated $100 or more. Every kid and guide who hunts is given a T-shirt. After the morning hunt, everyone came back to the Lincoln County Fairgrounds where they receive door prizes and enjoy a catered meal. On average, Kids Hunting For A Cure raises between $20,000 and $30,000 for St. Jude Childrens’ Hospital. Other horse industry volunteers included Ty Boyd, Mac and Jana Rogers.

SHOW Issues DQP Report SHOW released inspection numbers for September and year-to-date. For the first time, SHOW issued separate numbers for Horse Protection Act violations and well as violations of the SHOW rules. The September monthly numbers are as follows: Total horses inspected – 1,310 Total HPA violations – 6 or 0.4% Total all violations – 11 or 0.8% The 2013 year-to-date numbers are as follows: Total horses inspected – 11,179 Total HPA violations – 310 or 2.7% Total all violations – 345 or 3% SHOW officials continue to be pleased with the efforts of the Designated Qualified Persons under the direction of Mitchell Butler, Head DQP with administrative support from Rachel Reed. The quality and consistency of the inspections is better than ever and the working relationship in the field with the Veterinary Medical Offices from the USDA has been mutually beneficial in keeping horses not incompliance out of the show ring. Last month SHOW announced that it will become inactive after the Tunica, Mississippi Horse Show but has extended that time to Dec. 31, 2013 in light of additional events. The Tennessee Walking Horse National Celebration, owner of SHOW, will keep SHOW alive but inactive as was the case prior to being asked to take over enforcement responsibilities April 1, 2009 by the Walking Horse Trainers’ Association and the Walking Horse Owners’ Association, partners in the National Horse Show Commission HIO SHOW was formed over 10 years ago as a backup HIO for Celebration sponsored shows in the case of an emergency but was never activated until 2009. The announcement is being made at this time to enable another group to step up and take over these responsibilities. “While the Celebration was willing to activate SHOW to help the industry during a difficult time, it has been demanding and expensive and its time we concentrated on our horse shows, particularly The Celebration,” said SHOW Board Chairman Buddy Nelson. “We will support any other responsible group that implements an effective HIO program to enforce the Horse Protection Act in the future.” The Celebration loaned SHOW money to get it started in hopes it would be self-sustaining, but that was not the case. The Celebration has loaned SHOW over $500,000 as others HIOs came into existence and started affiliating shows in competition with SHOW. SHOW has affiliated 147 events this year, up 35 over 2012 or 31%.

Tax Court Case Discusses “Market Study” By John Alan Cohan, Attorney at Law In the Tax Court case, Richard H. Daley, T.C. Memo l996-259, an Arizona surgeon was denied deductions with respect to his cutting horse activity. The Tax Court, which in recent years has become more and more hard-nosed, concluded that the activity was not conducted for profit within the relevant IRS Regulations. A number of facts worked against Dr. Daley: (l) He entered the activity without the aid of a written market study; (2) the evidence suggested that his motive for entering the activity was recreational; (3) he never relied on a formal profit or business plan; (4) in managing the activity he used a ledger to record various transactions and events, and had a separate “drop” file for each horse--but failed to maintain them in a completely accurate manner; (5) while he claimed to have devoted l0-l2 hours per week to the horse activity, he was unable to substantiate this to the Court’s satisfaction. The Court suggested there should have been “a formal market study prior to undertaking his horse activity.” Under this Court’s criteria, very few horse owners would pass muster. The opinion suggests that taxpayers in the horse industry are going to have to engage in a lot more of formalities insofar as documenting how they started the activity. If you have a significant amount of losses you have a good chance of eventually being audited; it is therefore very important to document your compliance with IRS Regulations pertaining to the hobby loss rule. Dr. Daley was unable to show that the he consulted with industry experts prior to entering the activity. He testified that he had such consultations, but the judge found his testimony lacking in credibility. There was no documentation to back him up. This case therefore amplifies the importance of establishing groundwork documentary evidence and preserving it. It is important to maintain inventory records on each animal, including parentage, birth date, birth weight, and registration information. There should be a chart of horses owned and sold, with details. It is important to keep separate files on each horse. If you are audited, it is important to immediately obtain legal assistance. Evidence of your businesslike purpose should be presented to the auditor in the most favorable light. Your business plan should be set forth in a clear and concise manner. How you eventually expect to make a profit should be made clear. If losses are due to unforeseen circumstances or setbacks, including disease or fluctuating market prices, you should maintain documentary evidence to prove these facts. The IRS also wants to see evidence that you keep abreast of industry practices and that you investigate the possibility of changing or abandoning current methods of operation in an effort to mitigate losses. In many cases, taxpayers have convinced the Tax Court that their horse activity is a business rather than a hobby despite over two decades of losses. In those cases the taxpayers had good evidence showing the businesslike manner in which they operated their venture. The horse owners who come through well in audits usually have a working knowledge about genetic principles and other elements of animal husbandry. They usually strive to raise high quality animals, and have a plan on how to market them or otherwise make a profit.
