Heat the Streets draws record turnout HIGHLIGHT of the week

The 18th annual Heat the Streets Run & Walk for Warmth drew a record-breaking 1,100 runners and walkers March 1, raising money to help customers struggling with utility bills. The event brought in $226,000 via registrations, sponsorships and other donations, also a record.

The event, sponsored by OPPD and Metropolitan Utilities District, raised money to support the organizations’ respective utilities assistance programs. Heat the Streets Run & Walk for Warmth is the single largest annual fundraiser for these programs, bringing in $175,000 last year.

M.U.D. distributed $350,194 in bill assistance to 945 households over the past year while OPPD’s Energy Assistance Program distributed $371,012 in funding to 996 households across its 13-county district.

“These funds help us provide financial assistance to our families in crisis due to financial hardship,” said Sharena Marrs, program director at Family Housing Advisory Services Inc. “A job loss, a hospital stay or even an unexpected car or home repair can be a real hardship for those living paycheck to paycheck. Sometimes, just a little financial support can make all the difference.”

This year’s co-chairs were Mark Mendenhall, senior vice president and general counsel of M.U.D., and his wife, Bridget, and Eric Williams, a member of the OPPD board of directors, and his partner, Kristine Hull.

“The funds raised at Heat the Streets really do make a difference for families and people in our community when they experience an unexpected circumstance,” Williams said. “When they need help with their utility bill, their electric or gas bill, the funds raised at this event help them get through these challenging times.”

Both utilities urge customers struggling with bills to call customer service representatives and talk through their options. For OPPD, dial 402-536-4131 in the Omaha area and toll free outside the metro, 877-536-4131. M.U.D. customers should call 402-5546666 for assistance.

TOP 5 THINGS TO KNOW

DOGE activity affects five federal buildings

The Flatwater Free Press reported March 14 that the federal Department of Government Efficiency had terminated leases for five federal buildings and raised questions about a sixth building owned by the feds in downtown Omaha.

As reported by the news outlet, the five canceled leases include:

Department of Agriculture in Lincoln (10,471 square feet), original lease through Dec. 31, 2025. Annual lease is $188,448; DOGE reported savings is $62,816.

National Parks Service visitors center in Valentine (6,234 square feet), original lease through Dec. 20, 2026. Annual lease $151,670; DOGE reported savings $0.

Internal Revenue Service office in Scottsbluff (2,000 square feet), original lease through July 31, 2028. Annual lease $29,549; DOGE reported savings $91,110.

Food & Drug Administration office in Omaha (1,875 square feet), original lease through Aug. 21, 2028. Annual lease $34,357; DOGE reported savings $0.

U.S. Small Business Administration in Omaha (5,756 square feet), original lease through Dec. 31, 2025; DOGE reported savings $33,895.

In addition, the 357,000-square-foot Edward Zorinsky Federal Building, home to employees of several government agencies including the U.S. Army Corps of Engineers, Housing and Urban Development and the IRS, was on a list (since deleted from the DOGE website) of non-core government owned buildings that could potentially be sold.

There are more than 40 other federally leased buildings in the state that are thus far unaffected by DOGE activity, the news site reported.

City of Bellevue breaks ground

Officials and community leaders broke ground March 20 for the forthcoming Bellevue Bay Indoor Water Park, touting its potential as a premier attraction for families, tourists and water park enthusiasts from across the nation.

According to a press release from the city, the $60 million park, to be built in the Bellevue Good Life District, will be the fourth-largest indoor water park in the country. It is designed to provide year-round entertainment and recreation with state-of-the-art water slides, a sprawling lazy river and an interactive splash zone.

The 100,000-square-foot attraction is expected to open in 2027.

All concert tickets include State Fair gate admission. The fair is utilizing all-in pricing where the advertised price is inclusive of taxes and facility fees. Pricing varies based on Etix service fees charged for online orders.

Proposed tax to provide housing for abuse victims

Nebraska lawmakers advanced a bill March 19 that would raise an existing fee on home purchases with the money going to assist victims of domestic abuse. LB78, introduced by Sen. Eliot Bostar of Lincoln, creates a fund to assist survivors in covering the cost of rent, utilities, rental deposit and other needs related to housing. The measure passed unanimously, both to the floor by the legislature’s Revenue Committee and through first-round debate. It would create the Domestic Violence and Sex Trafficking Survivor Housing Assistance Fund, paid for by increasing the document stamp tax already levied on home purchases. The bill calls for an increase of seven cents per $1,000 of property value, which proponents say would generate about $1 million annually. Eligible recipients would access the fund through partner organizations, such as a shelter or domestic violence advocacy group.

Unemployment rate inches upward

Nebraska’s preliminary unemployment rate for January 2025 is 2.9 percent, seasonally adjusted, according to a release by the Nebraska Department of Labor. The jobless rate was up 0.3 percent year over year but was unchanged from revised December 2024 figures. The state’s rate of unemployment is ranked fifth lowest in the nation.

“Nebraska’s labor force grew by nearly 13,000 from January 2024 to January 2025,” Commissioner of Labor Katie Thurber said via the release. “The number of employed workers increased by nearly 9,000 over the year.”

Nonfarm employment, a count of filled jobs, was 1,044,095 in January, down 21,615 over the month. Private industries with the most growth month to month were other services (up 133 jobs) and information (up 41 jobs).

New Kids on the Block BANKERS TRUST EXPANDS INTO NEW BUILDING, SERVICES

Samantha Mosser already had a successful career in banking when she was recruited to Iowa-based Bankers Trust. The western Nebraska native had previously served as market president for a regional bank and president of a local bank in Omaha.

So when Bankers Trust approached her about leading — and expanding — the company’s Nebraska operations, she didn’t need another challenge. She took it anyway, sensing something about the company was special.

“I had worked with [Bankers Trust] on deals back and forth with my prior employer,” said Mosser, Nebraska market president. “I knew their ownership, their CEO, and a lot of their senior lenders. I also knew they had an amazing culture that centered around family and work-life balance. I knew I could recruit the right talent in Omaha to work for us, knowing the culture.

“We have such an amazing story to tell. We’ve had the same name for 107 years, being family-owned. We are the largest privately held bank in Iowa and we have a strong commitment to the Midwest. All of those things drove me to

come here.”

Under the radar

The bank’s Nebraska presence dates back to 2008 as a loan production office. The office did well, but lacking retail banking its success largely flew under the radar. When Mosser came aboard, Nebraska operations included four full- and part-time employees and in the three years since, expanded to 22 workers with four more to be added this year. The bank also grew its balance sheet and ranks in the top 15 in Omaha from an assets standpoint.

Even more significantly, Mosser has led the firm from its leased space into a new location at 192nd and Dodge Streets that’s roughly five times what Bankers Trust occupied previously. That, Mosser said, sends a clear message to customers and competitors alike that Bankers Trust is here and open for business in a major way.

“We’d outgrown our previous space, and we knew we wanted to be a

full-service location with a complete retail experience, offering retail, private banking, mortgage and wealth,” she said. “Our new building is 20,000 square feet and about 2,000 of that is devoted to our retail team, giving customers a branch experience.”

The location of the new building was highly strategic, with visibility from Dodge Street being a major priority.

“We knew we wanted to be along Dodge Street; it’s a major thoroughfare in Omaha and this building and its signage would basically be a living billboard for us,” Mosser said. “In all honesty, I started at 72nd and Dodge and called every landowner between 72nd and Dodge and where we’re at to try and buy their space. A lot of people were like, ‘We won’t sell you the ground, but we’ll do a joint venture,’ but bank ownership really wanted to own this facility.”

Connected to community

In addition to all of the expected amenities of a modern bank branch, the new building also devoted square footage in direct service to the community.

“A unique feature about our building is we have a 2,000-square-foot room that we’ve opened up in our facility for the community to use,” Mosser said. “People can hold trainings in there, they can do nonprofit board meetings in there. We’re not charging for the use of that space, we’re happy to be a resource for the community in that way. We’ve had quite a few people already reach out to us to take advantage of that.”

B. F. Kauffman, opening that June with 12 employees. In one day, the bank took in more than $485,000 in deposits and issued loans totaling just under $500,000. Over the next four decades, the bank grew aggressively in part due to consolidating or purchasing the assets of four local competitors.

We all offer checking accounts, we all offer loans, but how you deliver that to the market is what differentiates us. We just have to win on the service side.

In addition to lending, retail banking and commercial banking services, Bankers Trust also offers personal and institutional wealth management. Per its 2024 annual report, the bank has $7.2 billion in assets and reported $61.9 million in net income. In addition to Omaha, the bank operates branches in Iowa and Arizona as well as BTC Trust Company of South Dakota, a wholly owned subsidiary.

First on service

Mosser said with the new building finished, the focus turns to expanding the company’s presence in all banking sectors. She said for as disparate as those customers’ needs may be, one element of Bankers Trust’s corporate ethos is common in meeting them all.

“It’s all about the service component,” she said. “We have high-tech platforms, don’t get me wrong, especially on the treasury management side for businesses. We invest a lot in the technology components of our business as banking has almost become commoditized. We all offer checking accounts, we all offer loans, but how you deliver that to the market is what differentiates us. We have to win on the service side.”

WOMEN IN banking Getting With the Times

EXECUTIVES SHARE ADVICE, PERSPECTIVES FOR WOMEN IN BANKING

For young employees who are just getting started in banking, I would advise to never stop learning and gaining new experiences.

While women have had a role to play in banking for generations, it has only been in the last two or three decades that the industry has given them many of the same opportunities as men. Even today, as women outnumber men overall in banking, the number of females who have advanced to boardroom level positions is severely disproportionate to male peers.

In other words, while substantial progress has been made to crack the glass ceiling it is far from shattered, say local executives.

Progress a mixed bag

“Perhaps a B is the grade I would give the banking industry today,” said Tera Schaecher, senior vice president, corporate operations with Centris Federal Credit Union. “This is an improvement from when I started almost 30 years ago in banking. Back then, having more than one woman in an executive role or as a decision-maker in the room was rare.

“I was lucky to have always had women mentors to help pave the way. The old boys club may still exist in some organizations but I am pleased with the progress made and the continued growth of women in C-suite positions in our community. I do however think there is still room for improvement.”

S&P Global may have summarized the situation best with a recent poll

- DORIS ROBERTSON, EXECUTIVE VICE PRESIDENT, UNION BANK & TRUST

that examined the number of women in banking versus the number in the highest levels of bank leadership. It found that nearly 60% of about 2 million bank employees in the U.S. were female in 2021, yet only 10 public banks had female CEOs at that time.

“When I started in banking out of college there really weren’t many women,” said Kathryn Barker, senior vice president of Core Bank. “The majority of women at that point in time, I’d say, were in operational roles within the bank. Nobody in a C-suite kind of position was female. I would say things have improved somewhat but probably not as much as I would’ve thought over a 35-year period.

“It’s pretty common if you look across financial industries as a whole, you don’t see a lot of women in board positions of banks, or very few. You don’t see very many presidents of banks who are women, certainly among the smaller banks. You do find some, but typically there’s a family history of ownership there. Overall, I would say it’s improved, but not where it needs to be.”

Root causes

While there has undeniably been gender bias issues throughout the decades that have kept women out of executive roles, industry watchers say the root cause of such issues today now starts

I

systemically much lower on the organizational chart. According to “The Broken Rung,” a book published this month by three female senior partners of McKinsey & Company, the problem of women’s career advancement in corporate America starts much earlier in one’s career journey.

The broken rung concept refers to women not being promoted to their first management role at rates on par with men as the most foundational problem in women’s advancement. Only 87 women are promoted for every 100 men into beginning manager roles which, over time, cuts down on the number of women who might otherwise work their way to being in the running for roles of higher responsibility.

Companies that invest in their employees, both male and female, through formal career mapping and/or mentorship programs tend to enjoy better representation and higher retention. Such was the case with Schaecher during the early years of her career.

“I interviewed for a management trainee position at a bank and I threw myself into this role,” she said. “It allowed me to move into different positions in various departments, each lasting anywhere from two weeks to three years. At the end of the program, the expectation was that I would be an officer of the company and have a role overseeing a department.

“This program exposed me to the breadth of areas within a financial

institution and pushed me to make an impact in each area I had the opportunity to work within. I also had the opportunity to work with many different personalities and observe the leadership qualities of those around me, allowing me to pick and choose the traits I wanted to emulate in my career.”

WOMEN IN banking Getting With the Times

I was lucky to have always had women mentors to help pave the way.

Successful by design

This type of orientation and formal education is increasingly important as banks attract fewer women with formal business or financial degrees and who may be unfamiliar with various types of banking channels.

Doris Robertson, executive vice president at Union Bank & Trust in Lincoln, is typical of that path, having come to banking after working as a certified

public accountant. She said while she brought relevant skills to her role at UBT, it took mentoring to demonstrate how to apply those most effectively to banking specifically.

“Professional experience as a CPA allowed me to learn the intricacies of business financials, foster networking skills and develop a strong work ethic during those long busy seasons,” she said. “[In banking] my networking and communication skills proved extremely important to build relationships, both

internally within the bank and externally with customers, and my accounting background allowed me to be successful in my position as controller. In that role, I was able to learn about every division of the bank and meet managers throughout the organization.

“I also had an excellent mentor in Angie Muhleisen, who served as president and CEO of Union Bank and Trust until she retired in December 2023. With Angie as my role model, I could learn from her leadership skills and received valuable advice, which were both pivotal in my promotion to a top management position.”

Barker said as banks expand their departments into technological and regulatory roles previously unknown to the industry, it is attracting women with entirely new skill sets that also must be shown how their roles fit into the banking ecosystem.

“One of the fields that has definitely expanded is technology — IT, treasury management and treasury services — it has become very technical,” she said. “When I first came into banking the movement of money was more physical, today it’s more electronic. You don’t have armored cars as much. You don’t carry cash in your bank as much. Having a technology background is certainly more important, but you still have to have a broad brush of skills within the areas of banking.

“Another area is compliance. We’ve always been a regulated industry, but

Lead from the front

Baker also said more women being recruited to banking leadership arrive with experience in other industries. In her case, she left banking for a decade to operate her own business which invested her with skills that enabled her to step back in prepared to lead from Day One.

“I do believe it’s very beneficial to have some experiences outside of banking,” she said. “Being in private business taught me a lot in my engagement and working with banks, to the point where I basically said if I ever came back into banking, I was never going to do certain things that I experienced just by being on the other side of the desk.”

Robertson also said individual employees, male or female, must accept the responsibility for building their own careers by taking advantage of educational opportunities and going above and beyond to make themselves stand out.

“Sometimes during your career, you need to take a calculated risk in order to advance. After 13 years as controller, Angie [Muhleisen] approached me about transitioning over to the lending division as a commercial lender. I was very hesitant at first as my current position was definitely a comfort zone,” she said. “With Angie’s encouragement, I accepted the position and a few years later that experience would prove valuable. I now had financial, lending and credit knowledge that would lead to my promotion to executive vice president.

The Doctor Is In

JANYNE PEEK EMSICK CREATIVELY SHOWS OTHERS HOW TO LEAD MORE EFFECTIVELY

After years of helping Fortune 500 companies forge a better, more collaborative culture and working one-on-one with C-suite executives on how to lead others to their full potential, Janyne Peek Emsick has plenty of people from whom to draw inspiration.

But as the New York-born, Chicagoland-raised leadership coach will tell you, it’s not only the people at the top of the organizational chart who have the capacity to change lives and spark ambition. In fact, she’s living proof that inspiration can come from just about anywhere.

“I believe that we lead out of our stories. We learn our foundational values and understanding about how well the world works, what I’m always going to do and what I’m never going to do, coming out of those informational years,” she said. “I always go back to Mr. Klehm, my fifth-grade Sunday School teacher. I remember

once in seventh grade he introduced me to a crowded fellowship hall and he said, ‘If there’s ever going to be a first female president, it’s going to be this next young lady, Janyne Peek.’

“I didn’t recognize that I was a leader until a couple of decades later, but I never forgot the confidence that he had in me and that he had a high level of expectation for me.”

Confidence is something that appears over and over again in Peek Emsick’s life story. Growing up, she developed a mini-empire mowing lawns, which gave her a first taste of entrepreneurism. She studied theater at Baylor University and worked professionally in the brutally competitive world of drama and musical theater. She’d eventually find her way to the corporate world but the rat race didn’t agree with her, causing her to step into an entirely different role.

I think I became an entrepreneur because I’m designed to change things.

MIDLANDS BUSINESS

- JANYNE PEEK EMSICK, PH.D.

“I began working for a corporation and transitioned into organizational development,” she said. “I had an interesting pivot there; in the midst of all of that I felt called to something bigger. I left my corporate job to pursue a seminary education, believing I would become a pastor.

“My Ph.D. research in transformational leadership opened a new door and I realized I could build a consulting practice that served leaders worldwide, while still having the flexibility to consult as a ministry in organizations across the globe. It just was an extraordinary kind of season for me.”

Peek Emsick’s consulting adventures not only took her abroad, but to some of the most difficult environments in the world at that time. Being an American woman traveling and working alone in the Democratic Republic of Congo following that nation’s civil war, without benefit of speaking the native language, attest to the fearlessness and fervor with which she pursued her cause. Peek Emsick’s view, however, she was merely living out what had been hard-wired into her from the beginning.

“I think I became an entrepreneur because I’m designed to change things,” she said. “I wasn’t designed for a corporate environment. I’m a catalyst for change and I’m oriented for risk. I enjoy going to places that are different and what I invariably find is that human beings actually are far more similar than they are different.”

“These events are an extension of my background in theatre, storytelling, and leadership transformation,” she said. “Whether in a boardroom, on a stage or at a leadership retreat, I believe in the power of creating moments that change people.”

Today, Peek Emsick’s schedule is as hectic as ever as she continues to spread the message that effective leadership is the most potent secret ingredient any successful company can have.

Even as she found success in one area, Peek Emsick’s career has continued to unfold in new and exciting directions. She launched Your Executive Coach in 1992 and Emsick Architects in 2012. That same year, she spearheaded the creation of Professional Women Connect Global, a thriving leadership platform for connecting and empowering women across industries.

In addition to her life as an in-demand public speaker and college instructor, she would also co-found the nonprofit Inspire Events to create transformational experiences such as The Gratitude Summit, focusing on gratitude and organizational success, and YP-Executive Dialogues, developing emerging leaders with executive mentorship.

“We just finished research with our clients on leadership competencies,” she said. “We found that with our coaching methods clients reported a 35% increase in strategic decision-making efficiency and a 25% improvement in communication effectiveness and breaking through conflict.

“I help leaders make decisions and help them with accountability and how to stop wasting energy on burdens they have about people not getting along or not being aligned with values and get to the other side of it.”

Of course, such progress doesn’t come without client companies being willing to stretch outside of the norm and display the courage to engage in new practices and new ways of thinking.

Modeling such behavior for her clients is arguably Peek Emsick’s biggest strength and one major reason why she’s been able to compete successfully against much larger competitors.

“My dad grew up on a family farm, which they lost when he was finishing high school. He was the first in his family to go to college, became a CPA and HR executive, and strongly discouraged me from pursuing the arts or teaching. He wanted me to go into business,” she said. “Looking back, I can see that I did take his advice, just in an unconventional way.

“My business acumen didn’t come from a corporate job; it came from leading in artistic spaces, coaching executives and co-leading an architecture firm. My knack, my gift, is going into really hard places and helping people navigate them and coming out on the other side with hope and optimism.”

Silicon Valley isn’t Seeing a “Growth Scare”

The stock market gets a lot right, especially over longer time horizons. However, we simply don’t believe that every notable price move can be rationalized and explained, no matter how confident financial media appears at times. Even Warren Buffett said, “I’d be a bum on the street with a tin cup if the markets were always efficient.” There are many different players in the stock market with various time horizons, styles and processes. We would argue that the market has become quite myopic over the years. According to CBOE Global Markets, “zero-day options,” or ones expiring on the same day that they were created, accounted for 51% of overall S&P 500 Index options volume during the 4Q24. This is triple the amount from the same period in 2021.

In other words, day traders dominate much of today’s price action — not longterm investors.

While large technology stocks have been in the crosshairs of this recent correction, we remain steadfast that artificial intelligence is a generational investment opportunity that remains in the early innings. In fact, despite the selloff, we’ve become even more confident in our thesis. While the “doomers” on financial media obsess over falling share prices, we continue to be laser focused on the fundamentals and progress of the AI revolution. The following headlines are some notable highlights that we’ve learned over recent weeks which we believe show that we’re closer to the beginning — not the end.

Nvidia’s CEO said that the amount of computation needed for AI is easily 100x more than the world thought we needed this time last year. The biggest driver of this is the discovery of “reasoning,” or giving the AI model time to think by breaking down problems step by step to find the most accurate answer. He also noted that the company’s new AI chip, Blackwell, is the fastestramping product in the company’s history with unit volumes being nearly 3x its predecessor, Hopper, at this time last year.

For the month of February, TSMC announced that its sales rose 43.1% compared to last year. This company is the dominant manufacturer of AI chips. While this is just one data point during a short time period, it shows that AI demand isn’t slowing down.

Reportedly, OpenAI is planning to charge $20,000 per month for PhD-level agents. There continues to be a lot of concerns about how companies can justify spending billions on AI data centers. Furthermore, consensus seems to think that all AI models are becoming (or are already) commoditized. Currently, OpenAI is charging $200 per month for ChatGPT Pro with strong adoption, according to The Information. Rolling out a product that costs 100x that amount indicates to us that AI functionality is meaningfully improving and that firms are on the cusp of generating handsome returns from their investment.

The CEO of AI startup Anthropic said that he believes AI will write 90% of the code for software engineers within the next three to six months and every line of code within the next year. We knew that AI was getting good at coding as Alphabet said last year that AI was writing over 25% of its software code. However, tackling 90% of it within three to six months would be incredibly impressive. Considering that software engineers are in short supply and very expensive, this helps corroborate OpenAI’s news above.

Recent earnings reports from Oracle, Broadcom and Marvell showed that AI growth remains robust. Oracle said that growth in its AI business was “extraordinary.” Broadcom noted that its AI opportunity is “very, very high”. Marvell said that expects its AI revenue to exceed its target this year “very significantly” and continue growing next year and beyond.

Amidst all the uncertainty within the traditional economy, we have arguably the biggest secular trend that the modern world has ever seen. Not only is it continuing unabated but seems to be accelerating. The only thing that has changed is that share prices for most of these firms have become cheaper.

Bio:

Andrew Lerner is a seasoned professional in the commercial real estate industry, specializing in land development, leasing and investment strategy. He graduated with a degree in Commercial Real Estate and Land Development from the W.P. Carey School of Business at Arizona State University. In his role at The Lerner Company, he focuses on retail development and brokerage throughout the Midwest, bringing both institutional experience and entrepreneurial drive to the firm.

Outside of work, Lerner enjoys spending time with his wife, Katie, and their two daughters, Kinsley and Meadow. His hobbies include horse racing, golf and long-distance running.

What led you to the CRE field in general and to the family firm in particular? Commercial real estate was a natural fit for me — I’ve always had a strong interest in how communities grow and how strategic retail development can shape that growth. I was introduced to the business early on by my uncle, Jay Lerner, who founded The Lerner Company. He was a major mentor throughout my career and helped facilitate my growth in the industry.

I started my professional journey with institutional retail developers to gain a national perspective and build experience at scale. After nearly a decade working on projects across the western U.S., I joined the family firm to bring that knowledge back home and help drive our next chapter of growth in the Midwest.

What professional projects are you most proud of? I’m proud of my work leading leasing strategy for several regional malls that underwent repositioning

during a time of rapid retail evolution. More recently, I’ve been deeply involved in the development of a 50-acre retail project in Lincoln. It’s incredibly rewarding to shape a project from land acquisition to execution, and to build something that will serve a community for decades.

What are the most important qualities needed to excel in your field? You need to balance vision with patience. Real estate is about anticipating where the market is going and aligning projects accordingly but it’s also a long game. Strong relationships, a deep understanding of market data, and the ability to creatively structure deals are also critical. Above all, consistency; success in CRE comes from showing up every day and executing the fundamentals well.

What are some keys to client satisfaction in the CRE field? Clear communication, responsiveness and aligning incentives. Whether it’s a tenant, landlord or development partner, everyone wants to feel like their goals are understood and that you’re as invested in their success as they are. We always aim to be transparent, proactive and collaborative as those principles build trust over time.

What is your favorite local golf course and what course is on your bucket list? My favorite local course is Omaha Country Club; it’s a classic layout with a ton of character and a great test of golf. On my bucket list, I’d love to play Augusta National. That’s the gold standard for so many golfers and a truly iconic place in the sport.

This appointment reinforces the Murphy family’s ongoing leadership, ensuring stability and a clear vision for the future. Daniel joins a Senior Leadership Team that includes his father, Executive Chairman Chris Murphy; President and CEO Mark Ellerbeck; and Chief Financial Officer Margie Heller.

First Westroads Bank has been a part of Daniel Murphy’s life since childhood. Growing up in a family deeply committed to banking, he learned firsthand the importance of integrity, transparency and community engagement. Inspired by his father’s leadership and the bank’s dedication to its customers, Murphy chose to join the family business and help carry its legacy forward.

Murphy has played a key role in fostering strong connections with the business community, local residents and area nonprofits. Through branding, marketing and implementing modern banking technology, he’s enhanced the customer experience to help ensure First Westroads Bank remains at the forefront of the industry. His vision moving forward is clear: banking should never be just a transaction — it should be about building relationships and doing what’s right for every customer who walks through the doors.

“I’m honored to take on this new role at First Westroads Bank and continue my family’s commitment to our customers and community,” Murphy said. “Our leadership ensures that the bank remains a trusted institution for generations to come, and I look forward to carrying on that legacy.”

Ellerbeck also expressed his confidence in Murphy’s leadership. “Daniel has been a vital part of our team, and his promotion to Senior Vice President reflects his dedication and vision for the future of First Westroads Bank,” Ellerbeck said. “His ability to build strong relationships and embrace innovation will continue to strengthen our commitment to exceptional customer service and long-term stability.”

Murphy’s promotion comes on the heels of a highly successful 2024 for the bank, a year marked by modernization and continued financial strength. What are the current U.S., international, and other notable laws regulating artificial intelligence technologies, and what best practices should organizations follow when making AI available to employees?

In the wake of the explosion of availability, use and abuse of artificial intelligence technologies, organizations may be wondering what legal frameworks may be applicable to their adoption and use of such technologies. Organizations should review their compliance obligations and take note of how different technology offerings may fall under the scope of such obligations.

Q: Are there any current U.S. laws directly regulating the use of artificial intelligence technologies?

A: Currently, there are very few U.S. laws that directly regulate the use of artificial intelligence. One notable exception is the Colorado Artificial Intelligence Act (CAIA). The CAIA’s primary focus is regulating the use of “high-risk” artificial intelligence systems. These high-risk systems are those systems that make “consequential decisions.” These “consequential decisions” include decisions relating to employment, financial services and education, especially in the context of reviewing pools of applicants.

Q: Are there any current international laws regulating the use of artificial intelligence technologies?

A: The European Union’s AI Act recently became law, though its scope is limited. The Act provides obligations on entities involved in the creation and deployment of artificial intelligence systems. Thus, developers of AI technologies that are subject to the Act must comply with its obligations.

Q: Are any other notable laws applicable to the use of artificial intelligence technologies?

A: Although they generally do not mention artificial intelligence by name, many states have adopted comprehensive consumer privacy laws. These laws regulate the “processing” of “personal information” by entities subject to the scope of such laws. These laws regulate

the processing of any consumer personal information through any means. Consequently, processing personal information through an AI framework is subject to the scope of these laws.

Q: What are some best practices for an organization looking to make artificial intelligence technologies available for use by its employees?

A: In spite of the lack of laws and regulations explicitly regulating the use of AI technologies, organizations should nonetheless take proactive steps to curb organizational risk from these technologies. One of the best ways to limit risk is to adopt an organizational AI use policy. These policies set forth clear guidelines on how AI technologies may be used in the workplace, what uses are explicitly barred, what technologies are pre-approved for use, and consequences for noncompliance. Adopting an AI policy allows organizations to clearly communicate expectations to their workforce on the proper use of these emerging technologies.
