ABRAHAMS, KASLOW & CASSMAN BUILDS ON STRONG FOUNDATION

When Omaha legacy law firm AKC (Abrahams, Kaslow & Cassman LLP) launched in 1944, attorneys were not yet as omnipresent as today’s relative glut.

The nation was at war and two bright young Jewish attorneys and fellow Creighton Law School graduates, Milton Abrahams and Ben Kaslow, merged their business law practices into one. They made a formidable team. With the arrival of Frederick “Fritz” Cassman in 1949 the AKC triumvirate of founding partners was complete. Eight decades later AKC has grown and is still going strong. Partner Howard Kaslow carries on what his late father Ben helped start.

2024 marks the son’s 60th year in practice at a firm celebrating 80 years of serving clients.

Kaslow, a Yale Law School graduate and Rhodes Scholar, entered the firm in 1964. Kaslow ascribes his early interest in

being an attorney to seeing the strong relationships his father and his father’s partners enjoyed with their clients.

“It was very obvious their clients had great respect for them and spoke highly of them and that Milt, my father and Fritz were dedicated to their needs. Those relationships certainly made an impression,” Kaslow said. “Many clients were family friends whom I knew personally. It just struck me as a profession I would like to go into.

“That our firm has continued for 80 years is a great pleasure to me. There aren’t a lot of firms that can say the same, so we’re all very proud of that. I think the reason for our continuity is simply the fact we’ve had wonderful, excellent young attorneys join us. Most of our attorneys have been here through their entire career. They started here and have been trained by not just me but other older members of the firm. We’ve just created an environment

where everybody is pleased to be here, enjoys the work, enjoys the people. I think people enjoy what they learn here in becoming good professionals and I hope that will continue for the future.”

Currently, the firm’s managing partners are Randy Hanson, Tom Malicki and Robert Schartz. Malicki, a Creighton Law School graduate, has spent his entire 37-year legal career at AKC. He came on board in 1987 and became a partner a handful of years later. Kaslow mentored him.

“He taught me everything I know,” Malicki said of his mentor. “I learned about law and life and everything you can think of. He is a very good standard to try to attain. Don’t know if I’ll ever get there. He is a brilliant lawyer, a wonderful person, a great colleague, a great friend. He shows you by way of doing as opposed to just telling how to handle certain things. I’ve been very blessed to have him in my career and in my life.”

Schartz, a University of Nebraska Law School grad, joined AKC in 2009 after a stint with the Douglas County public defender’s office and years with a medical malpractice firm. He knew of AKC before ever working there.

“The firm’s and its founders’ reputations preceded them,” Schartz said. “Many of our partners have dealt with generations of business owners and their successors, their children, their grandchildren,” he said, adding that he’s pleased to be a part of a firm “so deeply rooted in the Omaha legal community.”

“We’re a great blend and range of both experience and in-house commitment to our clients. There’s a lot of continuity and breadth of experience. We don’t have a ton of turnover,” said Schartz, who became a partner a year after joining AKC.

Should the firm make the century club and beyond, Kaslow is sure its managing partners won’t have anything like the combined 112 years of service with AKC that he, Malicki and Schartz own. Its office staff also boasts long-tenured employment.

“You just don’t see that so much anymore,” said Kaslow, who appreciates that continuity extending to clients. “I’ve had the privilege of representing several clients for three generations.

“That they would consider wanting to remain clients of the firm is a very rewarding thing both personally and professionally. Sometimes relationships with clients go beyond just the performance of legal services. I certainly find that to be the case in the estate planning and probate aspect of the practice, where a lot of my discussions with clients have to do really with their personal objectives and how they can best attain them. Part of our role in certain areas at least is more as a counselor than as a

lawyer, and that’s important, too. Continuing to work with clients that I like and have represented for many years really is the most important thing at my stage of the practice.”

Right Fit

Malicki enjoys the intimacy and intensity of the work.

“The clientele we’ve been able to attract and to work for is very satisfying,” he said. “It’s complicated, challenging work. Because it’s a smaller firm you get to have a lot more personal interactions with people, so you develop friendships as opposed to just client relationships over time.”

What’s kept AKC a player all these years, Malicki said, “is culture for the most part – and being able to pass that culture down. We’re a very unique law firm in that we don’t argue amongst ourselves. We’re all committed to the same path, same goal. People are treated fairly. People don’t feel taken advantage of. We’ve been lucky to be able to attract bright young lawyers and to train them along, so the quality of lawyer we have here is high. The quality of the legal work we do here is very high.”

Years of institutional knowledge, professional experience and expertise are shared by veteran lawyers with newcomers.

“We have a huge mentoring program where every associate is assigned a partner as a mentor,” Schartz said. “That really helps train them but then also instills the firm’s culture in the next generation of lawyers to be mindful of taking care and making sure you have excellent work product and provide a value-add to our clients.”

Malicki feels the firm’s size is an advantage in other ways.

“The smallness allows for a more collegial atmosphere,” he said. “Larger firms are more corporate. Here it’s more entrepreneurial because you’re not just sitting in your office working, you’re also getting the clientele, keeping the clientele, servicing the clientele, teaching the younger lawyers. All that continuity continues throughout the years, and that’s the best. We have a very good core group of people and they all share the same values and thoughts on how to make a good law practice work.”

Bread and Butter

AKC has largely stayed in its lane focusing on corporate and business law, employment law, franchise law and real estate law. Energy law is a more recent focus.

estate planning, corporate transactions. Litigation of various types,” Kaslow said. “We don’t really do much criminal law representation but more commercial litigation and defense work for other professionals (medical, insurance). Those have always been the areas we’ve been involved in.”

A big change in the course of his career, he said, is “the vast expanse of administrative law dealing with all the federal and state agencies that exist today” that didn’t when he started.

“There was no Environmental Protection Agency. No Employment Retirement Security Act dealing with pensions and profit-sharing plans. No Limited Liability Company Act,” he said. “We practiced common law, if you will – case law, contract law, the law of employee relations. But it’s changed dramatically over the years as more and more administrative law has come into existence.”

Just as the medical profession has become ever more specialized, so too has the law.

“The areas of the law that require or need some expertise today are so numerous that it really is impossible for any one attorney to be an expert in everything,” Kaslow said. “To a certain extent all attorneys have become specialists with work concentrated in only one or two areas. For example, I work primarily in the

area of estate planning, trusts, wills, probate administration and corporate transactions.

“I don’t do any litigation. I wouldn’t probably be able to find my way to the courthouse. But we’ve got a firm that can provide expertise across the whole range of business or personal needs, so if something comes up that I don’t know about the first thing I do is find attorneys in the firm that do and make sure they get involved.”

“We have a very active, open-door policy where a lot of times clients are getting several heads for the price of one because we bounce ideas off of and talk about cases with each other all the time to get really good results,” Schartz said. “We’re more of a full-service law firm and we’re able to handle many aspects of a client’s legal needs as opposed to saying we’re just able to do this and you have to find somebody else do that.

“I always look to the experts on the other side of the hall like Howard and Tom for their intimate knowledge of the probate code and the trust code and utilize them in defending or prosecuting a case when we’re representing a client in that area. We work with each other really nicely and share that knowledge.”

Working together to satisfy client needs is what it’s all about.

“Getting results is what really solidifies those relationships,” Schartz said. “One follows hand in glove with the other.”

Getting and keeping clients, Kaslow confirmed, “is really all reputation based – people that have had a good experience with us or know that we have experience in a particular area is where the word of mouth and referrals come from.”

The legacy of AKC must be continually nurtured.

“You can’t take it for granted at all,” said Schartz.

Forward-thinking

Besides new areas of specialization in the law, Malicki said technology is the other big change AKC has weathered.

“I do think with our size and structure we’re able to adapt to more things and to deal with change without too much disruption,” he said.

Kaslow said what sets AKC apart is its membership to Meritas, an invitation-only international association of law forms. AKC is the only Meritas firm in Nebraska.

“It’s certainly been a benefit to us,” Kaslow said of the association. “When we have a client who has an issue in another state that we think we can’t address we can refer the client to somebody we know is a reputable firm. And it’s reciprocal – we regularly receive referrals from firms outside Nebraska.”

For AKC’s partners, the firm’s fixture spot on the local legal scene is not enough. They set an example of community service they expect and encourage their attorney partners and associates to follow.

“We like people to have a good work-life balance,” Kaslow said. “We’ve always had a history of being involved in the community at large in terms of charitable and nonprofit activities.

“That’s something we try to get our people involved in. Community involvement is very important not just to give back to the community but also just to make relationships in the community. I know that’s something I’ve always valued and so I’ve been involved in a number of nonprofit organizations, serving on their boards of directors. It’s enabled me to meet a panoply of people I would never have met otherwise.”

At 85, Kaslow has no plans to retire. Not yet anyway.

“As long as I enjoy it and my clients want my services I’m happy to continue. I don’t have any target date to phase out. But at some point I’m sure that will occur,” he said.

Meanwhile AKC is planning 80th anniversary celebrations for current and past staff, clients and friends. That milestone is cause for reflection.

“I’ve been a part of building that up and maintaining it and continuing to make it grow, which gives you a really good feeling – that you actually have made that investment and that investment has paid off. That’s what you do feel the pride in,” Malicki said.

For Schartz that eight-decade legacy “is a real testament to those who have come before us.”

“We take the responsibility as managing partners here very seriously to keep that going and to keep our reputation as stellar as it is. I think everybody here is focused on that singularly,” he said.

Kaslow shares his partners’ confidence AKC’s built a strong enough culture to continue thriving. How much longer, he said, is anyone’s guess. He believes the future remains bright as long as AKC “keeps attracting promising talent” that takes “pleasure,” as he does and the founders did, in gaining people’s trust and serving their needs.

POLICY REFORM NEEDED TO EXCEL

When it comes to the subject of elder care and senior living options, the numbers matter. According to the U.S. Census Bureau, 1 in 6 Americans are 65 or older as of 2020. The rate of growth in the demographic category was unprecedented, up 39% from 2010. The senior population is expected to reach 80 million by 2040, per The Senior List.com, putting strains on industry segments from health care to housing.

Much of this is not news as the baby boomer aging phenomenon — known colloquially as the “Silver Tsunami” — has been in the headlines for some time. What isn’t as well-known, and what is keeping everyone from service providers to elders up at night, especially in-home care and residential communities, is the number 2035. That’s the year when the number of older adults will surpass the number of children under 18 in the United States for the first time in history.

“The 2035 problem is coming,” said Mark Goetz, president of the HomeCare Advocacy Network. “There’s already a national shortage of caregivers.”

Reform Needed

Goetz said while the nation’s nursing shortage tends to get the headlines when talking about elder issues, the dearth of caregivers overall to provide services is an even bigger issue. He said a combination of technology and legislative reform is required to adequately address the situation.

“There’s no doubt that tech will play a greater role in senior care in general over the next 20 years,” he said. “We are going to see better reimbursement for remote patient monitoring.

“We’ll move into what I believe will be remote client monitoring where services that tech companies provide will be the far front end of the care continuum. That’s already happening. However, we also need innovation coupled with government and policy support in every aspect of home health care. What’s needed is immigration reform, targeting those who want to serve our aging population, whether that’s nursing or home caregivers. And, in this state, we need to normalize senior caregiving for our youth, as some states have already done. In the state

of Iowa, for instance, you can become a certified nursing assistant at the age of 16, and they have been doing this very successfully for the last 30 years.”

Within the home care industry, companies are challenged to provide ever-more robust training for their front-line employees, Goetz said. He said one of the most important measurements by which such companies will be judged in the marketplace will be a measurable quality of care delivered in the patient’s place of residence.

“We’re going to see more of the home care and home health companies driving outcomes, benefitting their clients by not having to go back into the hospital after a health event because they are effectively and efficiently being taken care of at home,” he said.

Group Solution

Nate Underwood, president of Heritage Communities, agreed, saying governmental leaders need to join hands with the senior care industry as a matter of public health.

“As the owner of senior living communities, we recognize that not all seniors have access to quality care,” he said. “There may not be suitable

housing options in their community that can provide the level of support they require and affordability can also be a major concern.

“Inadequate housing and care options can have detrimental effects on seniors’ health and impact their overall happiness and sense of fulfillment. All of this can place a significant burden on family caregivers, affecting their own well-being and ability to provide care effectively. We see it every day.”

He said a multi-faceted approach with policymakers, health care providers, caregivers and community organizations is needed.

As for communities themselves, Underwood said the public will continue to demand more and more amenities and on-premises expertise to meet their needs. Some areas of service he mentioned in particular include a shift toward more person-centered care models, more wellness and lifestyle amenities and especially innovations in memory care.

This last point is an increasingly important segment of operations, given the number of seniors needing these services. In its 2024 annual report, the Alzheimer’s Association noted that 7 million Americans live with some form of dementia, yet per the Centers for Disease Control, only 4 in 10 assisted living facilities nationwide offer memory care to residents.

“With the rising prevalence of Alzheimer’s and other forms of dementia, there will be increased focus on specialized memory care programs, therapeutic environments and innovative technologies,” Underwood said. “At Heritage Communities, we are rolling out an in-room technology solution for memory care with dashboards that flag health changes and AI-driven safety alerts that will help us improve resident health and safety.”

Having an Event?

Lakelyn Eichenberger, gerontologist and caregiving advocate with Home Instead, said part of the solution for growing workforce and providing quality elder care in part lies with the industry’s ability to think outside of traditional labor demographic pools to find workers.

“We see people from 18 years old up into their 80s that can be really great providers of care in the home,” she said. “It really depends on if they have the heart for service and will they be willing to learn the skills needed. We see college students who are wanting to get some experience; maybe they’re going into a health care field or social work. Experience in home care is a really great thing to have on their resume. We also see teachers working in the summer or on the weekends and they make great home care professionals.

“And then there are retirees themselves. A lot of times people retire from their profession and they want to do something, maybe not full-time. The role in home care is quite flexible, so you can set your schedule. We’re trying to appeal to those individuals that have a heart to serve and draw them into our field.”

Beyond expanded recruitment, Eichenberger said home care is following the lead of other industries in doing more with less thanks to technology.

“Looking into the future, we’re trying to better utilize technology to create more efficiencies in the way that we staff and schedule to hopefully make the most of the workforce that we currently have,” she said. “I think we’re going to see more and more of those types of innovations and utilization of technology for the operational efficiencies of these types of service lines so that we can continue to meet the growing need and demand.”

As experts also note, home care and residential options aren’t mutually exclusive; senior community ownership groups have diversified into the in-home space and home care companies routinely deliver their services to clients living in a community. For that reason, both industries have a vested interest in working collaboratively to meet clients where they are as they age.

“As we see the baby boomers continue to age, they have a focus on holistic care,” Eichenberger said. “We are seeing them be a little more active and even proactive in their care. As we explore this, there are opportunities for active aging, healthy aging and getting people to stay active both physically and mentally.”

This hiring mentality helps her delegate responsibilities with confidence. “The best piece of advice could give is when you begin, you wear all the hats. was head of marketing, was head of finance, was head of HR, sales, design,” she said. “It’s determining which hat to give away first and giving away the ones you’re the worst at or just find yourself getting frustrated with because they take too much time or they’re not the best use of your time. O’BRIEN BUILDS ORAL SURGERY TEAM IN HEARTLAND Throughout Dr. James O’Brien’s career, maximizing opportunities has been key to his success, to say the least. In dental school, he never considered entering the military, yet wound up serving in the U.S. Navy for 12 years. During that span, he gave little thought to life after the service, yet by the time he retired in 2020, he’d already spent two years moonlighting with Omaha & Council Bluffs Oral Surgery where he is now managing partner and co-owner with Drs. Caleb Schadel and Blair Racker. “I commuted from Honolulu to Omaha,” he said. “It was a really unique opportunity to be able to feel out private practice was what wanted to do with the rest of my life and see if this particular practice was a good fit. As that continued to go, discovered really wanted the challenge and the opportunities within private practice. was sort of energized by that challenge.” O’Brien said his military experience was mixed bag insofar as how prepared him for life as an people navigate fairly uncomfortable situations and just hard work. When you’re at sea, you work seven days a week. There are no vacations, there’s no break. “The part that did not learn in the Navy was basically how to create relationships and partnerships,” he said. “In the Navy, the patients just showed up whereas our practice is purely referral-based. There’s no direct-toconsumer marketing, it’s all basically B2B. Creating trust between the general dentists that send us patients and their patients and our practice was one of the original challenges but also one of the things that was energized by, and find lot of fulfillment in.” Part of O’Brien’s evolution as an entrepreneur has come through membership in Entrepreneurs’ Organization Nebraska, to which he was introduced by colleagues. He said the organization has given him a community of people of like mind and in similar situations that he can relate to. “[EO] sounded very intriguing to me and it’s helped with my responsibilities of managing the business challenges and whatnot. UTILIZING DATA TO BUILD POSITIVE ENVIRONMENTS

At Category 1 Consulting, it all starts and ends with the desired impact. Specifically, for co-founders and principal consultants Amy McFeely and Sara Roberts, it’s about helping organizations use data and analyses to build positive environments.

“Is this an organization that wants us to come in and help them create a great work environment for their people, or is it somebody that wants us to come in and run analyses to figure out where they can cut costs,” Roberts said.

Data for Good

Before opening Category 1 Consulting (C1C), both Roberts and McFeely received their doctorates in industrial organizational psychology from the University of Nebraska Omaha. They were working at Conagra on its people insights team. As McFeely puts it, their task was to provide the human resources department with evidence-based data to inform policies.

When Conagra hired a new CEO and moved to Chicago their team was laid off as it “didn’t directly produce revenue.”

“At the time, it felt like the worst thing that could have ever happened because we loved our jobs and we loved the team we had built,” Roberts said. “Now I look back, and I think that layoff was the best thing that ever happened.”

After interviewing with multiple companies, they decided to fast-track their 10-year plan and open their consulting practice.

“It’s not that there weren’t organizations that would have hired us … when we were at Conagra we were partnering with Google, Starbucks, and FedEx,” Roberts said.

“But we would have conversations about what they wanted to use the data for and it would be to maximize profits and cut costs. That’s not why we got the degree that we did. We wanted to do something good, to have a positive impact.”

Answering Questions

Nowadays the team of six works with a variety of organizations, but primarily foundations, nonprofits, and government entities. About 50% of their work falls within the research and evaluation scope.

For example, McFeely said a nonprofit might receive a grant and need an external source to evaluate the implementation and impact.

The second area of practice is planning and facilitation.

“Say an organization has a huge decision to make and they need the data, the buy-in, to do that,” McFeely said. “We’ll facilitate the process of making that decision and creating a plan to implement the decision.”

The last practice area is organizational effectiveness, essentially making sure that processes that are in place internally are effective.

“Although we focus on research and evaluation, planning, facilitation, and organizational effectiveness always get woven in,” McFeely said. “It almost always spans across all three practice areas.”

Leading by Example

While there is merit to building a more balanced practice, the duo said it’s a conscious decision to keep the bulk of the work in research and evaluation.

“We’ve had conversations with our team members, and that is the area that people like to do the most,” McFeely said. “I feel like that’s the best use of our skills.”

This kind of input is not unusual for the team; team members are often invited to take part in major decisions and meet monthly to go over metrics such as customer satisfaction, billable breakdowns, and revenue targets.

“We do democratic decision-making,” Roberts said. “The decision to stay entirely remote, even after COVID-19, was a group decision.”

The team also recently voted to include parental leave and extended leave policies.

“We’re small, but we can figure out how to make it work,” Roberts said. “We not only want people to stay with C1C, but we want to make sure they’re able to have a high quality of life outside of work.”

For their part, both Roberts and McFeely said they are content where they are.

“I think in the past I was focused on growth, and how do we build this and make it bigger,” Roberts said. “I think maybe that’s not as important to me now.”

McFeely echoed the same sentiment, adding “We just enjoy doing the work so much, and the bigger you get the more administrative your role gets.”

Spring is almost here, and college seniors are getting closer to graduation. Besides ordering your cap and gown, one of the most important aspects of preparing for graduation is finding a job.

Jody Wilson, Stacia Hoffman and Allison Plummer, talent acquisition specialists at Blue Cross and Blue Shield of Nebraska (BCBSNE), are offering their top tips for the recruiting process, from interviewing to your first day at a new job, to help you succeed.

Understand the basics of the recruitment process

Every company has a different recruitment process, but knowing the basics of how it works can help you manage expectations as you start applying and interviewing. In most cases, including at BCBSNE, companies will post open positions on their website, LinkedIn or college job boards.

Once you’ve applied for your dream job, a recruiter will reach out and fill you in on the next steps. Hoffman explained that at BCBSNE, this usually means a phone screen with a recruiter, a video interview with the hiring manager and a video interview with additional members of the team.

During your initial conversations, be sure to ask questions about next steps, so there are no surprises.

Learn what the company is looking for in a candidate

Understanding the company’s values and culture will help you learn more about what your potential employer is looking for in a candidate and enable you to demonstrate how you’re the right fit.

“At BCBSNE, we’re looking for someone who embodies our mission and values,” Wilson said. “When a candidate applies, we’ll see how they fit with our mission and culture and if their technical skills are a good match for the role.”

Said plans and specifications have been prepared and reviewed by E & A Consulting Group, Inc., engineers for the District and said engineers have filed with the Clerk of the District, prior to the first publication of this Resolution, an estimate of the total costs of said improvements, including engineering fees, legal fees, fiscal fees, interest and other miscellaneous costs, which estimate is in the sum of $800,000.00.

To pay the cost of said improvement the Board of Trustees shall have the power to issue negotiable bonds of the District after such improvements have been completed and accepted; said bonds to be called “Sanitary and Improvement District Bonds” and shall be payable and bear interest as

provided by the Statutes of the State of Nebraska.

The Board of Trustees shall assess to the extent of special benefits, the cost of such improvements upon properties specially benefited thereby. All special assessments which may be levied upon the properties specially benefited by such improvements shall, when collected, be set aside and constitute a sinking fund for the payment of interest and principal of said bonds.
