Editor’s Letter Blooming July!

I hope you like our cover this month, it’s in honour of the citrus theme for Marlborough in Bloom, judging for which takes place on 14 July this year. See the Council news on page 13 for details of how you can get involved. July as always is a very busy month in Marlborough - what with the Jazz Festival (and its seemingly controversial road closures), Barbury International Horse Trials, Marlborough Open Studios (which has spread its net even wider this year), not to mention the Summer School with its gala performances and the now traditional open air theatre in Ogbourne Maizey. There’s also a Summer River Walk run by Action for the River Kennet, which will take you through privately owned parts of the river bank not normally accessible to the public. And for fans of Brass Band music there’s Aldbourne Band’s Pond Concert, lovely on a balmy Summer’s Day. With all these outdoor activities, let’s keep our fingers crossed for some good weather! Hope you enjoy the magazine this month!

People

Fiona Kellow Fiona Kellow is a partner with Thrings solicitors. She lives just outside Marlborough with her husband Matthew, two children, Eleanor, 14, and Joseph, 11, Coco the chocolate Labrador and Angel, the three-legged cat. Tell us about your background I am originally from Wokingham. I went to an all-girls school where we were encouraged to work hard and succeed – there was also a particular emphasis on the professions. I became interested in the law from an early age, so was always headed in that direction. I studied law and sociology at university in Hull, and worked as a paralegal while studying subjects I needed for law school. I then completed two years with a firm of solicitors in Wokingham, where I was lucky enough to work with the managing partner on some fascinating cases. How did you end up working for Thrings? I joined Townsends solicitors in 1997, which, after a merger in 2000, became Thring Townsend. We are now simply Thrings, a Top 100 law firm with offices in Swindon, Bristol, Bath, London and, of course, Marlborough. You specialise in family law, what made you choose that? It was accidental. I was

6

keen on personal injury law, but there weren’t many openings in that area, so I started working in family law and really enjoyed it. I also found that my sociology studies came in useful. You’re a partner at Thrings – what does that involve? As a partner, I essentially wear two hats. I still practise as a family lawyer with my own clientele, and am Head of the Private Client department, which includes the Family, Property and Costs teams. I probably split my time equally between managing teams and practising law. Do you prefer one over the other? They are both about helping people and ensuring they succeed. I like to help my clients get the best outcome, and I enjoy helping teams develop and achieve their goals. I would therefore say I enjoy managing teams and practising law equally.

I imagine family law can be quite stressful? It can be, as you are dealing with emotions and very personal areas, especially where children are involved. I think family law has changed for the better over the years, with mediation taking a much bigger role. I particularly like collaborative law where everyone gets round a table to sort out the issues and comes to an agreement. It can be very tense, but you tend to get a more creative solution, and participants more often end up being civil to each other. Court is very much seen as a last resort, and we will do our very best to avoid a case ending up there. Understandably, clients can be very emotional and need help working through issues. We often introduce them to counselling or coaching professionals who can help them in these areas. As a family lawyer I need to be available outside the standard 9-5, as I wouldn’t want a client

People to worry about something that comes up and feel they can’t get hold of me. I also enjoy working in family law as no two cases are the same. It can be enormously satisfying to help someone through a very difficult time, reaching an agreement that works for both parties – the best outcome for all concerned. Your husband Matthew works with you, what is that like? Matthew is the Head of Family Law at Thrings, so I effectively work in his team when I am dealing with my clients, and when I am working in my management role, he works in my team. I can’t say we never take work home with us, but we manage it well. What do you enjoy most about your job? The people. I love guiding both clients and team members, helping them to get the best possible results. It’s very rewarding seeing them succeed. And what do you like least? I spend a lot of time travelling between our different offices – I’d love a space/time machine that could just beam me there and back! What do you do in your spare time? I enjoy working with St John’s. I’ve put many year 10 students through mock interviews which is great fun, and often most pupils’ first experience of being interviewed. I’ve also given several presentations on

a career in law – Thrings offers work experience to students who might be considering a career in law. We always try to make it interesting and varied for students, and one day hope that a student who comes to us for work experience ends up studying law and then working for us. Outside work I love baking and all sorts of crafts (I am a frustrated Kirstie Allsopp). I keep fit and have been doing Debbie Brown’s Kettlercise – an exercise class involving kettlebells – in Burbage for the past year. As a family we also spend a lot of time outdoors, and enjoy walking the dog in Savernake Forest. Joseph loves his sport, and Sundays are often spent watching him play rugby or cricket. Where do you like to eat out? I enjoy Coles Bar & Restaurant and for Indian, The Zaika Inn. The Red Lion at East Chisenbury is also a favourite. What about shopping? We’re so lucky to have the high street in Marlborough with its mix of national and independent shops. I’m glad Seasalt is here, and I like White Stuff. It’s good to see Mistral has been so successful too. For gifts I love Valentiners and the Merchant’s House. I also love a rootle around charity shops – they’re good for crafts, finding lamp shades to re-cover for instance. Marr Green Farm Shop in Burbage is great for meat and vegetables and other foodie bits.

What are you reading at the moment? I’m crying my way through ‘The Last Days of Rabbit Hayes’ by Anna McPartlin, and recently finished ‘The Girl on the Train’ by Paula Hawkins. I probably read most when I’m on holiday – something enjoyable and easy to read by Marian Keyes or Cathy Kelly always goes down well. What’s your type of music? I’m an ‘80s girl – Duran Duran were a big influence – and we’ll quite often have something loud and disco-ish on in the house. The kids are starting to dictate what we listen to, so we often listen to Hozier, Mumford & Sons and Florence and the Machine. What are your pet hates/ candidates for Room 101? I get irritated when I’m in a shop and the assistant takes a phone call in the middle of serving a customer. I work in a service profession, and I believe exemplary customer service is paramount. I also get irritated by the plethora of chargers that end up lying around the house now - wires are everywhere! Brighter Futures the fundraising arm of Great Western Hospital in Swindon has launched a new appeal to bring radiotherapy treatment for cancer patients much closer to home for residents of Wiltshire. Currently patients have to make what can often be a gruelling round trip to Oxford on a daily basis for their treatment. The appeal is aiming to raise £2.9m (a portion of the total cost) over the next two years with the aim of bringing the treatment to Swindon by 2015. How can you help? There’s plenty to do towards us winning a Gold Award. There’ll be 2 Community Clear-Up days in the lead up to the big day. We will be meeting on Monday, 6 July and Monday, 13 July at 10am in Priory Gardens, where we’ll supply the equipment if you can help us with the man (and woman) power. There’s weeding, painting, cleaning and litter picking to keep everyone busy. Hope to see lots of you there.

Aldbourne Band on tour… In their first overseas trip for some years, Aldbourne Band competed in the French Open Brass contest in Amboise, in the Loire region of France. They did rather well, coming second in the March, and fourth overall in the competition, much to the credit of their new Musical Director, Joshua Ruck. Highlights were solos from Paul Bilkey in Flowerdale, Ian Keene with On With The Motley, and the brilliant performance of the whole band for The Torch Bearer – an extremely testing piece.

Temperatures soared to 32° c which kept band supporters in a job supplying copious quantities of water for the players! “This is a great opportunity to showcase our gifted and talented players and gives our new MD the chance to take the Band to a new arena.” Chairman James Sheppard said “We were very pleased with our result at the British Open Qualifiers in Blackpool in May, retaining our place in the Grand Shield. Now it is time to build on that success and play to a wider audience.

Solo by Ian Keene On with the Motley

In a first for the Band, they entertained the French crowds in Amboise, alongside other prestigious bands such as StavangerBand from Norway, Swiss band Ensemble de Cuivres and the French contender from the Nord Pas de Calais. It is several years since the Band played overseas (last time in Holland) and they made new friendships and links with other brass players from around the world.

16

Homeward bound Band and supporters with Trophies

“Amboise is a beautiful town with friendly and welcoming people. We enjoyed good

company, great food and wine and of course, fantastic music. There were many youth bands there too and it was encouraging to see the European commitment to Brass. ”

Chateau Royal Amboise

You can hear some of their repertoire, as the Band will be playing at 7.15pm on Sunday 5 July at the annual series of open air Pond Concerts in Aldbourne. These concerts are free, with donations in the bucket to help fund the costs of running the Band. If the weather is wet it will be held in St Michaels Church. House & Home

Don’t move, improve…. With the cost of moving home these days, many people are deciding that it’s best to sit tight and improve their existing property. Trading up to the next size house can be prohibitively expensive, especially when you add in moving costs and stamp duty. Instead of moving to get more space many people have made the decision to add space to their existing home, or just simply improve the space they’ve got by renovating. Whether you have a hefty budget to make major improvements, or you just want a new look living space - here are a few ideas to get the creative juices flowing… Even if you are not currently intending to move, if you are planning on spending a significant amount on fixtures and fittings, you should consider whether and how the improvements you are making will add value to your home. Always seek professional advice before making major changes. If your home is suitable, it is generally agreed that loft conversions are the most cost effective way to create extra living space. A double bedroom with en-suite is probably the most popular option and in many cases can more then recoup the cost when you come to sell your home. Extensions are also very popular, and it is important

that you think carefully about your current space and how extending will generate more successful living areas. Often a relatively small addition to your home can make a big difference to how you use it – this is why investing in an architect’s design skills can be money very well spent. Conservatories are a good way of adding space – choose a design in sympathy with your house, and if you plan to use it all year round ensure you consider how you will keep it warm in the winter and cool in the summer. New kitchens and bathrooms are always fashionable, but don’t spend out of proportion to the value of your property – a £25,000 luxury kitchen is unlikely to recoup its full value in a 3 bedroom semi. If you don’t have a vast amount of money to spend then there are still plenty of things you can do to improve your home. It’s amazing how many people only make improvements to their homes when they are about to move, and never get to enjoy the changes they have made. If you do it yourself, painting your home can make a radical change to the look of your house, and if you are not moving then you can be as individual with your colours as you like. Don’t spoil the effect by being slap dash though, ensure the emulsion stays on the walls, and the eggshell on the woodwork otherwise your efforts will just end up looking tacky. If you have an oak or pine kitchen a good

Painting a wood kitchen can transform the whole room

paint job will transform it. If you’re no good with a paint brush, try changing your accessories. In a living room for instance, new curtains and cushions, and the addition of the odd table lamp or coffee table can revitalise an existing scheme without having to spend a fortune. If you can’t afford to replace your whole kitchen, consider new doors (or even just handles), tiles or worktops. The same with a bathroom – new tiles, taps and flooring can transform an old white suite. And if you don’t have any money at all to make changes then don’t lose heart – in many homes a good clear out, spring clean and rearrangement of the furniture can leave you feeling like you’ve got a new home! Just start today…

Road Test

Jaguar XE Before we start, I must make a confession. I am and always have been one of Jaguar’s biggest fans, so this road test is likely to be a little biased. In fact, my fondest dream is to be proud owner of an early E Type, although this becomes ever more unlikely as prices head towards the stratosphere. Instead, I shall have to content myself with their new compact sports saloon, the XE. This car matters to Jaguar; it is going up against the likes of the BMW 3 Series and, as such, is entering the premier league of premium carmakers; this class is where the volume sales are. Jaguar tried to play this game before with the X Type, a rebodied Ford Mondeo with a hastily cobbled together 4 wheel drive system. They lost miserably. This time they are fielding a vastly superior team with a body that is 70% aluminium, a proper rear wheel drive setup and styling that is rooted in the 2020s rather than the 1970s. But, will it be good enough to take the fight to the 3 Series, Audi’s ubiquitous A4 or the swoopy new Mercedes C Class? First things first, does it look the part? The answer is a resounding yes; with a sharply raked rear roofline it is long, low and sleek. It looks a little like a scaled down XF but with a tidier back end and the faintly menacing

32

headlights of the XJ. The wheels fill the arches nicely too, always the acid test for a purposeful looking car. Inside it’s all a bit modern for a Jag, influenced more by the F Type sports car than the old world luxury of the XF saloon. There isn’t a bit of walnut veneer in sight, although there are lashings of leather. I like the sporty bucket seats front and rear. Headroom in the back is a bit restricted because of the sloping roofline, but it isn’t a major problem and at least there’s a decent size boot. The choice of engines at launch is an all-Ford line up. There’s a turbocharged 2.0 litre petrol with either 197 or 236bhp and a supercharged 3.0 litre V6 with 325bhp, which I’m told is turbine smooth and seriously brawny. The big seller is inevitably going to be the diesel, initially a 2.0 litre unit with either 161 or 177bhp. The more powerful version only adds £500 to the price tag and doesn’t charge a penalty in either fuel consumption or CO2 emissions; that was the one I tried. It’s a nice smooth engine but you have to rev it to access the power – there’s enough to get up to 60 in under 8 seconds and top 130mph. The manual 6 speed is a bit notchy but the ratios are well chosen. Better still, you can easily better 60mpg

and the tiny CO2 emissions bring your car tax down to £20 per year. Jaguars have always been about driving and the XE is certainly no exception. The steering is light, precise and provides just enough feedback to let you know what the car is doing as it flits from corner to corner with beautiful poise and balance. On a twisty B road it will bring a huge smile to your face. The ride isn’t perfect but it’s good enough for this class of car; on the vast majority of roads you wouldn’t even notice. Jaguar were originally predicting an entry level price of just under £27,000 but in the event it’s knocking on the door of £30k, still competitive against the German opposition. But have they done it, have they built a BMW beater? Well, maybe not a BMW beater but in almost every respect the XE is on a par with the 3 Series. For my money, the Jaguar is a better proposition on two counts – it’s a Jag and every other sales rep in the country hasn’t got one. Kit Johnson Car as tested Jaguar XE 2.0D (180) Prestige £30,775 RRP

Gardening

July in the Garden As the weather heats up borders and containers should be looking their best with plenty of variety and colour. To keep perennials and annuals looking their best and flowering for as long as possible it is important to deadhead faded blooms. During long dry spells only water borders if they really need it and it is better to give plants a good soaking once a week than to water a little each day. Applying a thick mulch around plants will help to reduce moisture loss. Once perennials have finished flowering cut back faded stems, some like hardy geraniums can be cut back to around two inches from the ground and they will reward you with a second flush of flowers later in the season. Whilst the border is in full bloom note any changes you would like to make, for instance, if a plant has become too large and will need dividing in autumn or if a plant is simply in the wrong place and will need to be moved and replaced with something more suitable. Plan ahead for late summer colour and plant perennials like Asters, Rudbeckia, Dahlia’s and Sedums and shrubs such as Caryopteris, Hibiscus and Hydrangea. For a more informal feel add some grasses especially Miscanthus varieties with their wonderful plumes which can be left over winter for birds to feed on. Deadhead roses to prolong flowering by cutting faded flowers to a leaf bud further down the stem, this will encourage new shoots to

34

form. Lavenders need to be cut back to around two inches above where the plant is green after flowering to prevent the plant becoming woody. Irises that have become too large for their space can be lifted and divided before replanting. Wisteria should be pruned by cutting back new growths made during the summer to within five or six buds of the main stem to encourage buds to form for next year. All buxus (box) whether topiary or hedging should be pruned to shape in July but remember it is better to trim off too little that too much so trim lightly, stand back and trim a little more as needed to keep the shape of the plant you require. Continue to mow and trim the edges of lawn, however during long dry spells of weather raise the blades and reduce frequency of mowing to help the lawn to cope with less water. Try to resist watering the lawn as it will soon recover once it starts to rain. Use weed killer to treat any weeds growing in paving as pulling weeds out can dislodge the mortar allowing more weeds to seed themselves in gaps. Containers will need to be fed every couple of weeks and watered daily unless it rains heavily, also remove any weeds that may compete for water and cut off any straggly bits of plants to keep containers tidy.

Continue harvesting vegetables and harvest some herbs for drying. Pinch out the head of the leading shoot on runner beans once it reaches the top of the canes, this encourages side shoots lower down and results in a heavier crop. Plant out winter brassicas and sow spring cabbages. Continue to remove side shoots from leaf axils on tomatoes and pinch out the growing tip at the top of the plant once it has reached the height you require. Ponds and water features should be topped up with water in dry weather and remove duckweed and blanket weed. Also regularly fill bird baths to ensure birds have a fresh water supply available. Traditionally July and August are holiday time. Plan ahead if you are off on holiday to avoid returning to either a dried up garden or a jungle. If you can, book a friend or relative to water containers while you’re away. Leave any new planting until your return and group pots and containers together in the shade if possible to reduce moisture loss. Before you leave deadhead flowering perennials and annuals to help ensure a blooming garden on your return and mow the lawn as close as possible to your departure date. By Jill Blackwood

Legal

A Common Misconception about Divorce All too often our family clients here at DGR Law are told by their estranged partners: “You can see the children when you agree the finances”! This is however very wrong on several levels including the legal one. The legal process of obtaining a divorce begins with the first step into a solicitor’s office. I mention that because it can be a very emotional time to make the decision to start divorce proceedings and takes great courage to pick up the telephone and make an appointment and then take yourself to that appointment. So, having made the step, it is now over to our Family Team to guide you through the next few months and the forms and the divulging of information, some of which is incredibly private. The Divorce Petition has a section which asks for details of the children in the family, however it is purely for statistical reasons and arrangements for children are dealt with separately. Since March 2015 all divorce petitions are dealt with through the Southampton Central Divorce Centre which unfortunately for those of us in Wiltshire is causing delays and in some cases lost petitions, but that is a topic for a different article.

36

We, at DGR Law, try to be ahead of the process and reduce timescales by asking our Clients to start thinking about finances and the future while we process the Application for Decree Nisi and subsequently the Application for Decree Absolute. It helps to focus on the future and what each party needs to carry on with living and providing for children. We give them a copy of the “dreaded Form E” which details all property, assets and income while at the same time addressing future needs for property, schooling, and day to day expenses. Often we agree with the opposing solicitor to make a voluntary exchange of Form E to start the negotiations without the need for the intervention of the Court. It is the delay in this exchange that seems to bring out the worst in couples with accusations of delaying tactics and hiding something. And it often causes couples to use the phrase “Sign the Form E and you can see the children”. We then have to gently remind them that the two issues are certainly not connected. Arrangements for children are to be dealt with between parents either through mediation or through solicitors. DGR Law is pleased to be working with local Counselling Team Geoff Miles and Helen Payne-Kumar of See For Miles Ltd who offer Couples Counselling to deal with the problems of separate parenting. At no point would solicitors advise their clients to withhold

contact because of finances. If arrangements cannot be agreed then either party can make an Application for a Child Arrangements Programme under S8 Children Act 1989. These applications are made to the Family Court in Swindon. These are processed separately and as such couples working towards a divorce should treat the two separately. Apart from the fact that children are not bargaining tools, it is a stressful enough time for all concerned especially children. If you are having difficulties working through divorce finances or child contact arrangements please make an appointment for our free 30 minute consultation to see if we can help clear up any misconceptions.
