Unions at loggerheads with Department

The 2020 academic year for these pupils is facing up to uncertainty under the Covid-19 lockdown. (Graphic for illustrative purpose only.) STANDERTON - The Department of Basic Education had to delay the phased reopening of schools which was planned for 6 May for grade 7 and 12 pupils after labour unions in education sectors opposed the move citing possibly unsafe conditions for pupils, teachers and support staff. Parents also vowed not to send their children to school. The Minister of Basic Education, Mrs Angie Motshekga, announced a revised proposal on 30 April to delay reopening until 1 June. The minister assured the unions that by then every aspect of Covid-19 safety compliance will be in place. According to the Department’s plan, on Monday, 11 May, all School

management teams (SMTs) were to report to work and would be followed by all teachers and support staff on 18 May. The South African Democratic Teachers Union (SADTU) however is of the view that the Department is not ready for schools reopening, and has failed to meet minimum safety requirements and consequently it has called all its members not to report for work on Monday, 11 May. Cosmos News spoke to some of the local teachers to get their views. The response was that the Department has not implemented the measures for the sanitation of classes, social distancing in crowded classrooms, personal

protective equipment and Covid-19 screening and testing of teachers and support staff before reopening can take place. An adequate supply of face masks, cloves and sanitizers and the upgrading of schools’ infrastructure for water and sanitation is still needed. As a result of these failures, SADTU has taken the position against irrational and reckless reopening of schools. They said the lives and safety of pupils, teachers and support staff is their priority and they are of the view that education can rather be delayed for some time instead of risking lives. Die Caxton-groep het vandeesweek aangekondig hy onttrek hom aan tydskrifpublikasie en alle verwante bedrywighede. Dit beteken tydskrifte soos Rooi Rose, Vrouekeur, Woman & Home, Your Family, Bona, Country Life, Essentials en Food & Home sal voortaan nie meer verskyn nie. “Die bestendige en voortgesette daling in besteding aan advertensies in die tydskrifsektor, asook die afname in die sirkulasie-inkomste het oor die afgelope paar jaar gestyg en die lewensvatbaarheid van die tydskrifbedryf laat daal,” het Caxton se raad gesê. Die groep sê die landwye staat van afsondering weens die Covid-19-pandemie het beteken die groep se kliënte moes hul bedrywighede afskaal. “Die negatiewe uitwerking van die onlangse Covid-19-afsonderingstydperk op algemene ekonomiese bedrywighede en gevolglik die onderneming se vermoë om normaal sake te doen in wat rééds moeilike

omstandighede vir tydskrifuitgewers was, het dié besluit onvermydelik gemaak.” Die raad sê talle adverteerders het in die aanloop tot en tydens die afsonderingstydperk advertensies onttrek en daar was kommer dat dié inkomste permanent verlore gaan wees en bykomende druk op die tydskrifbedryf en die hele groep sou plaas. “Die beduidende daling in inkomstevlakke wat vererger word deur die moontlike langtermynuitwerking van Covid-19, gekombineer met die daling in sirkulasiesyfers, kan nie die onderneming op kort en lang termyn dra nie. In die lig van dié uitdagings het die groep ʼn beginselbesluit geneem om die tydskrifafdeling te sluit. Dit was ʼn moeilike maar onvermydelike besluit wat in belang van die hele groep geneem is.” Die raad sê hy voer samesprekings met sy werkers oor die pad vorentoe. Die sluiting van die titels kom as nóg ʼn groot skok vir die bedryf nadat Associated Media Publishing (AMP), een van SuidAfrika se grootste onafhanklike mediahuise, verlede week aangekondig het dat hy

óók sy deure sluit. AMP publiseer die tydskrifte Cosmopolitan, House & Leisure, Good Housekeeping en Women on Wheels. AMP het ook gesê die Covid-19-pandemie het sy tol dermate geëis dat die maatskappy met die druk en verspreiding van tydskrifte noodgedwonge halt moes roep. “Die wêreldwye stilstand rakende die besteding aan advertensies asook die onvermoë om geleenthede te bied, het dit dus vir AMP onmoontlik gemaak om voort te gaan ondanks groot bedrae persoonlike geld wat in die maatskappy gestort is.” Die Suid-Afrikaanse Nasionale Redakteursforum (Sanef) het vroeër gesê die mediabedryf speel ʼn geweldig belangrike rol tydens die Covid-19-pandemie, maar is terselfdertyd onder enorme druk. Sanef sê nie net is werksgeleenthede op die spel nie, maar ook die produksie van gehaltenuus. Die forum sê hy is ingelig dat sommige mediahuise beoog om salarisse met tot 40% te besnoei en die gebruik van vryskutwerkers se dienste te staak. (Maroela Media) JD

Huur en verhuur in Vlak 4 - hoe gemaak? NASIONAAL - Sedert die instel van die landwye afsondering is talle werkgewers genoop om van hul werknemers te laat gaan of salarisse te sny om finansieel te kan oorleef. Dié toedrag het werknemers met hande in die hare gelaat omdat hulle steeds maandeliks ’n bedrag op ʼn verband of huurkontrak moet opdok.

Volgens Megan Harrington Johnson, ʼn prokureur van HJW in Johannesburg, is huurders steeds verplig om die volle bedrag huurgeld te betaal tensy die verhuurder ʼn ooreenkoms met die huurder aangaan waarin die huurgeld aangepas word. “Al het die werknemer se salaris ongelukkig verander, is hy of sy steeds verplig om dit

(die ooreengekome huur) te betaal tensy die verhuurder wat die kontrak voorsien het, uit sy eie die huurgeld aanpas. Die hof gaan nie die huurder uitsit voordat die afsonderingsregulasies gewysig is nie. Om nie huur te betaal nie is kontrakbreuk en nie ’n misdryf teen die afsonderingsregulasies nie,” sê Johnson. Versuim om masker te dra nié ’n misdryf – kenners

NASIONAAL - Die regulasies gedurende vlak 4 van die koronavirus-afsonderingstydperk bepaal dat dit verpligtend is om ’n gesigmasker te dra wanneer jy in ʼn openbare plek is. Regskenners verduidelik dat jy egter nie beboet of in hegtenis geneem kan word indien jy nie ’n masker in die openbaar dra nie. Jy mag wel toegang tot ’n openbare ruimte soos ’n winkel, park of bank geweier word. Die prokureur Oelof de Meyer het aan Maroela Media verduidelik dat artikel 5 van die afsonderingsregulasies bepaal dat maskers ten alle tye in die openbaar gedra moet word. Volgens De Meyer maak artikel 14 en 31 van dié regulasies, waarin strafbepalings uiteengesit word, egter geen melding van artikel 5 nie. Daar is dus geen straf uiteengesit vir ’n individu wat versuim om ’n masker in die openbaar te dra nie. “Die legaliteitsbeginsel vereis dat indien die staat ’n misdryf wil skep, die staat dit duidelik as ’n misdryf moet uiteensit en ’n straf daaraan koppel,” verduidelik die prokureur Carel Taute op sy beurt. Volgens Taute is die dra van ’n masker in die publiek dus ’n regulasie, maar die oortreding daarvan nié ’n misdryf nie. Die oortree van regulasies soos die klokreël, die verbod op die verkoop van alkohol en tabakprodukte, die vervoer van alkohol, onwettige besettings, asook die verbod op reis

tussen provinsies of metro’s, is wel ’n misdryf wat gestraf kan word, verduidelik hy. Die moontlikheid bestaan egter om die geldigheid daarvan in ʼn hof te bevraagteken. Die prokureur André Grobler verduidelik dat sou ’n persoon in hegtenis geneem word vir die versuim om ’n masker in die openbaar te dra, die aanklagte teen die persoon summier teruggetrek moet word. Geen vervolging mag plaasvind nie. Grobler meen dat hoewel jy nie gestraf sal word indien jy nie ’n masker dra nie, die regulasies ingestel is ter wille van die veiligheid van SuidAfrikaners. “Jy het ’n verantwoordelikheid om jouself en ander te beskerm. Dít is waarom mense maskers in die openbaar moet dra.” Bogenoemde kenners verduidelik dat enige ruimte buite jou huis as ’n openbare ruimte geld. Dit sluit winkels, banke, parke en strate in. Die regulasies bepaal dus dat Suid-Afrikaners ook maskers moet dra wanneer hulle in ’n straat gaan draf of stap. “’n Straat is ’n openbare plek waartoe die algemene publiek toegang het,” verduidelik Grobler. Volgens Taute geld jou motor nie as openbare ruimte nie. Jy as eienaar van die voertuig bepaal wie toegang daartoe het. Wees ’n Leier wat die naam werd is “Daarom skryf ek hierdie dinge terwyl ek nog van julle af weg is, want wanneer ek kom, wil ek nie met die gesag wat die Here aan my gegee het, streng teen julle optree nie. Met dié gesag moet ek opbou, nie afbreek nie. (2 Korintiërs 13:10)” Dit is Paulus se tweede brief aan die gemeente in Korinte, en hy is aan die vooraand van sy derde reis na hulle toe (vgl 2 Kor 13:1). In hierdie laaste hoofstuk rig hy enkele laaste vermanings aan hulle “terwyl ek nog van julle af weg is” (v. 10). Hy gun hulle die tyd om intussen die nodige aanpassings te maak, om positief op sy raad te reageer. Een van die dae is hy daar by hulle en dan moet die dinge reg wees … En as dit nie reg is nie? Wel, sê hy, hy wil nie streng met hulle wees nie. Hy beskik oor al die gesag daartoe – hy het dit immers van die Here af gekry – maar hy sal verkies om liefs opbouend op te tree. Leierskap, nie waar nie? ’n Leier wat die naam werd is,

én die verantwoordelikheid én die gesag wat daarmee gepaardgaan. Dit is nie dinge wat jy van alle leiers kan sê nie. Inteendeel. Sommige leiers ken net een manier: Kraai koning! En as dit nodig is: Verguis. Vertrap. Raak van teenstand ontslae. Beloon jou gunsgenote. Bestendig jou posisie. Dien jouself. Paulus was ’n kerkleier. Hy, van almal, het goed geweet dat alle gesag aan God behoort. Dat Jesus die Hoof van die kerk is. Dat die aangewese leiers se gesag oor die kerk en die kerk se mense dus van Bo kom. Dat daar van Bo rekenskap van die leiers geëis word. En hy weet alte goed dat die Leier net een ding van die leiers verwag aan wie Hy sy gesag verleen het: Dien my mense. Bou hulle op. The Failures of Section 139 The original version of section 139 did not include any specific remedies for financial problems in a municipality. These original paragraphs also only made provision for a discretionary intervention to be undertaken by a Province, with no role for the national executive to intervene if they believed that the Province should have acted. This legislation was ‘owned’ by the Department of Provincial and Local Government predecessor of CoGTA. In implementing this legislation, Provinces closely followed the old Provincial Administrator model. Once the new local government structure was in place, however, there was growing concern within National Treasury that the section 139 framework was not sufficiently broad or powerful enough to ensure that municipalities could be prevented from falling into financial collapse. Treasury was concerned that there was no clear basis for intervention on the basis of financial problems which it considered to be very different from the ‘failure to fulfil an executive obligation’ no clear process for how serious financial problems were to be addressed in the intervention; and they wanted to have an additional mechanism to ensure that an intervention would take place, even if a province had decided not to intervene. That is, they wanted a clear mechanism for mandatory interventions in the event of serious financial problems in a municipality. The 2000 Policy Framework for Municipal Borrowing and Financial Emergencies makes clear Treasury’s rationale for wanting to expand the application of section 139: ‘many

municipalities have encountered increasing financial difficulties in recent years. For a number of reasons, it is important that government respond systemically to this situation. First, it is obviously critical that the delivery of essential services which is threatened in some cases - is maintained. However, central government cannot allow itself to get drawn into a succession of ad hoc responses it has neither the capacity nor the fiscal resource to sustain. In other words, central government needs to respond in a manner which provides municipalities with the incentives to perform their functions effectively and manage their fiscal and financial affairs prudently. Third, in the absence of such a response it is unlikely that local government will be able to attract significant investment from the private sector.’ Treasury pushed for an amended version of section 139, which was approved by Parliament in 2003, adding paragraphs (4) to (7). These additional paragraphs in section 139 are regulated by Chapter 13 of the Municipal Finance Management Act (MFMA). It should be noted that there is currently no similar form of detailed regulation of the original paragraphs, since COGTA’s Bill in this respect has never been promulgated. In 2013, COGTA prepared the Intergovernmental Monitoring, Support and Intervention Bill (IMSI) which was intended in part to provide such clarity. The Bill was never passed by Parliament, which in hindsight is probably a good thing: although it clarified some important issues around the process of section 139 interventions, it failed

to do so in respect of some critical issues. For example, it failed to provide a clear definition of exactly what constituted an ‘executive obligation’ for the purposes of section 139 interventions, simply stating that ‘executive obligation’ was to be defined as it is defined in section 139, when the problem is that section 139 does not contain such a definition. In addition, the Bill did not make it clear that administrators were only to be appointed if the Council had been dissolved, and was vague on the details of exactly how a province would take over responsibility for an executive obligation. Most importantly, IMSI focused almost entirely on section 139(1) interventions, with only a passing mention of the other options, reinforcing the idea that this section ‘belongs’ to COGTA. I believe that one outcome of this regulatory amendment was that the additional paragraphs 139 (4) to (7) together with the MFMA regulations effectively came to be seen as the ‘Treasury’ intervention framework, compared to the ‘COGTA’ intervention framework of section 139 (1) to (3). This longterm contestations between COGTA and National Treasury over who has ultimate oversight authority over local government – was never addressed in subsequent regulation, and continues today, exacerbated by the rise in inter-departmental rivalries. I further believe that these contestations over oversight of local government have been a key factor supporting the extensive (and incorrect) use of section 139(1) (b) in interventions. Bad behaviour on roads ... The coal trucks that supply coal to Majuba are driving on the Leandra road through Standerton. Also some of them from other sides are driving through town and they don’t follow the correct route. I want to report their bad behaviour on the roads. SG coal is the one that complies so far and behaves. Some of my concerns regarding the trucks are the following: Driving at high speed (supposed to drive 60 km) through town, driving in misty conditions at high speed, they don’t follow a safe driving distance, they damage the roads, they disrespect fellow road users and the lights on some trucks are not working. What to do about your fogging glasses INFORMATIVE - People wearing corrective eyewear or sunglasses struggle with impaired vision while wearing a facemask as breathing fogs up the lenses. Some simple remedies were found and shared with our readers. Firstly, improve the fit of your mask. Many medical masks feature a bendable metal strip that allows the wearer to mold the mask to their nose and cheeks. But you don’t need a surgical mask to achieve a good fit. If you’re making a homemade mask, you can sew a pipe cleaner or twist tie into the top of your mask. That way, you’ll be able to fit the mask to your face more effectively. You’ll also want to adjust your mask’s straps or ear loops. When the mask fits properly, most of your expelled breath should go through it, not out the top or sides. Secondly, you can tape your mask. Most doctors use tape to prevent foggy glasses while they work. To DIY it, tape your mask across the bridge of your nose and across your cheeks. You can use most any type of tape, be it adhesive, medical, or athletic, just make sure you avoid duct tape. Test the tape on a different part of your body to ensure it doesn’t irritate your skin. Another simple way to decrease the

amount of vapour on your specs is to pull your mask higher on your face and use the weight of your glasses on top of the mask to block the flow of air. Whether or not this works will depend on the shape and makeup of the glasses. This method is most effective with large, thick frames. Use a commercial anti-condensation wipe or spray. These can be very effective, but they can also be very expensive. Keep in mind that anticondensation solutions may not work as well on glasses with certain coatings, such as anti-glare, antifingerprint, or anti-smudge, and so it’s important to read the fine print on each product. A simple and cheaper way to prevent fogging up of your glasses is to apply shaving cream to your lenses to create a protective barrier. Blot a small amount of shaving cream to both sides of your lenses and rub in. Let the shaving cream dry before gently removing the residue with a soft dry cloth. A quick and temporary fix is to use spit to clean your lenses, but this poses a health risk and is not recommended. As any form of eyewear is normally expensive, we recommend that you consult with your optometrist before using any of these preventative ways. JD

STANDERTON - Since liquor taps in bars, shebeens and taverns have run dry due to the ban on the sale of liquor during the Covid-19 lockdown, homemade beer in the form of a pineapple brew is flourishing in the villages and townships across the country, with Sakhile being no exception. The beer is gaining momentum and has become popular, cheap and affordable to the consumers yet the

degree of intoxication is very high. Currently a jug costs R10, which is cheaper than 750 ml of beer and two jugs are enough to cause a near stupor. Department compelled to release detailed Covid-19 statistics “What are they hiding?” PROVINCIAL The Democratic Alliance (DA) has submitted a Promotion of Access to Information (PAIA) application to the Mpumalanga Department of Health to compel the MEC to release detailed and daily provincial Covid-19 statistics. The people of this province are in the dark about the true rate of testing, tracing and tracking. To make matters worse, Mpumalanga Health MEC Sasekani Manzini and her department have consistently been publishing false, inaccurate or incomplete data of Covid-19 cases on their Facebook page. The MEC has more than once published misleading information on the number of positive cases in the province. Her information often does not match data released by the national Health Department. The DA has tried on several occasions to engage MEC Manzini on this issue, but to no avail. Mpumalanga is the only province where Covid-19 stats are seemingly fluctuating. The people of Mpumalanga are concerned about these inconsistencies and they’re looking for answers. The DA has also written to Premier Refilwe MtsheniTsipane early last month complaining about the inaccuracies but she has not yet

responded. The DA is also concerned that Mpumalanga is the only province where the Covid-19 Provincial Central Command does not include opposition parties represented in the legislature. They have failed to learn from the national Health Minister, Dr Zweli Mkhize, who has gone out of his way to work with all stakeholders and opposition parties in the fight against this pandemic. Mpumalanga has also not convened a virtual health portfolio committee meeting to report to members about Covid-19. We are also the only province that doesn’t publish the number of people that have been tested on a regular basis. What are they hiding? In the DA-run Western Cape, Premier Alan Winde releases daily statistics that are broken down into regions, fatalities and most importantly tests conducted. With our application we hope to compel the Mpumalanga Department of Health to do the same. The DA will always put the people of Mpumalanga first and will not stop holding irresponsible executives to account. We will continue to do this without any fear or favour. Biltongburgers vir smulpape Word Search with Cosmos News

Hierdie maklike burger resep lewer vier porsies en kan in 20 minute voorberei en in 15 min gaargemaak wees. Die bestanddele wat jy gaan benodig is 550 g maer beesmaalvleis, 500 g vars varkworsies (vleis uit derm gedruk), 15 – 25 ml biltongspeserye, 15 ml bruinasyn, 15 ml worcestersous, 125 ml biltongpoeier, 30 – 45 ml olyfolie, vier groot broodrolletjies (oopgesny en gerooster) en jou gunstelingbolaagbestanddele soos mayonnaise, blaarslaai, avo, tamatie en jalapeňorissies. Ek noem die krummeltjies biltong en fyn speserye wat in ’n biltongpakkie agterbly, ‘biltongpoeier’. Sommige biltong-winkels verkoop dié fyn mengsel op sy eie in pakkies. Gaan nou as volg te werk. Meng die maalvleis, worsvleis, biltongspeserye, asyn en worcestersous goed saam in ’n groot mengbak. (Die worsies bevat bindmiddel, dus het jy nie eier of brood nodig nie). Verdeel die mengsel in

vier en vorm patties. Verf dit oraloor met olyfolie en rol die rante van die patties in die biltongpoeier. Sit dit vir 20 minute in die yskas tot ferm. Braai die burgers vir ongeveer 5 minute aan ’n kant in ’n warm gietysterpan oor die kole (of op die stoof). Gebruik jou eie oordeel: Sodra die onderkant mooi goudbruin is, maar nog nie begin brand het nie, kan jy die patties omdraai. En gebruik liewer te veel olie as te min – anders gaan die patties vassit en begin verkrummel. Sodra die vleis mooi bruin en so te sê gaar is, verwyder van die hitte, bedek die pan en laat die vleis toe om vir nog sowat 10 minute te rus en deurgaar te word. Omdat die burgers vark bevat, wil jy hê dit moet goed gaar maar steeds sappig wees. Bou die burgers nou met ál jou gunstelingbestanddele en bedien met jou eie gunstelingbykos. (Weg!
