AGM – NOTICES OF BUSINESS FROM MEMBERS ANNUAL GENERAL MEETING AGENDA ITEMS

As per rule 2.98 members wishing to place an item of business on the agenda for the 2021 AGM shall give notice in writing of that item to the Chief Executive by no later than 31 January 2021. The notice must include the names and VCA membership number of the mover and seconder.

Notes for the benefit of members submitting notices of business:

1. A notice of business that seeks to amend, delete or insert a clause of the constitution or a rule, must be worded as a special resolution. See also regulation 6.2.1.

3. A notice of business that directs or seeks to direct the management committee in any matter that is a power of the management committee [Clause 1.5 of the constitution] would not be a proper matter for an AGM, and therefore would be an invalid notice of business.

ELECTIONS

Members are hereby informed that vacancies for vice president and five ordinary members of management committee will occur in April 2021.

Eligibility of Candidates to Nominate for Election Members are advised to check the Constitution, Rules and Regulations of the Victorian Canine Association Inc to confirm their eligibility. Subject to Rule 2.52.2 only an ordinary, dual or life member as described in Rule 2.6.1 - 2.6.3 shall be eligible to nominate as a candidate, or propose or second a candidate, for election to the management committee, provided that they were financial members of the VCA for the whole of the previous financial year, and their membership renewal subscriptions have been paid not later than the date on which nominations close, and that they are not in default under Rule 2.10.5 or Rule 2.11 between the date on which nominations close, and the date on which the ballot closes, and such ineligibility has not lapsed by the latter date.

Term of Office

The term of office for the vice president will be one year, three ordinary members of the management committee will be four years, one ordinary member of management committee will be two years, and two ordinary members of management committee will be one year. (Total of six ordinary positions of management committee up for election).

Electoral Roll

The electoral roll will close at 4pm on Sunday 31 January 2021. All ordinary, dual and life members as described in Rule 2.6.1 - 2.6.3 shall be on the electoral roll provided their membership is current by the 31 January when the electoral roll closes each year and provided that they are not ineligible at that date under Rule 2.10.5 or Rule 2.11.

RULES FOR THE CONDUCT OF RALLY TRIAL EFFECTIVE 1 JANUARY 2021 – CLARIFICATION AND CORRECTIONS

The National Obedience & Tracking Committee Chairperson, Raelee Hedger has advised the committee has discussed and agreed the following underlined wording is required to be added to the rules to clarify the intent of the rule:

The Bulgarian Republican Federation of Cynology (BRFC) informs the FCI members and contract partners that Mr Lyubomir LYUBOMIROV POPANTONOV has been definitively excluded as BRFC member and breeder since 26/11/2020. In addition, his FCI kennel name “ANGELSSTAFFTEAM” has been cancelled from the international FCI Kennel Name Register.

APPROVAL OF 2023 NATIONAL SHOW APPLICATION – WA CHIHUAHUA CLUB

We are pleased to advise the approval of the 2023 National Show application received from the WA Chihuahua Club via Dogs West to be held on 11 & 12 October 2023 at Dogs West Showgrounds, Southern River, WA.

Dogs West has advised the Perth Royal Show dates are yet to be finalized pending the 2023 WA Public Holiday calendar being approved however it is expected that the WA Queen’s Birthday public holiday will be 25 September 2023 with the Perth Royal Show being held on 23 to 30 September 2023. We have asked Dogs West to update us should there be any change to these dates. Our website will be updated accordingly.

APPROVAL OF 2021 NATIONAL SHOW – TENTERFIELD TERRIER CLUB OF NSW INC – CHANGE OF DATE

We advise a change to the date of this National Show to be conducted by the Tenterfield Terrier Club of NSW Inc.

Dogs Victoria responds to Directions Paper for a New Animal Welfare Act for Victoria

A NEW ANIMAL WELFARE ACT FOR VICTORIA

Directions Paper

DOGS VICTORIA appreciates the opportunity to comment upon the Directions Paper for a new Animal Welfare Act for Victoria.

As the only canine Applicable Organisation, DOGS VICTORIA represents the largest body of regulated and organised breeders of purebred dogs in Victoria and is affiliated with the national body representing purebred dogs throughout Australia, the Australian National Kennel Council Ltd. Accordingly DOGS VICTORIA speaks in the interests of more than 35,000 active dog fanciers and purebred dog breeders, and their families. Moreover, through its Associate Dog register, DOGS VICTORIA represents the interests of many mixed breed dog owners. Once one adds in the number of Victorians with close relationships with our members through puppy purchases and life-long support, and our numerous dog activities (including Obedience, agility, rally, field trials, dancing with dogs, earth dogs and many other activities) offered to the general public, DOGS VICTORIA has an extensive reach within the canine community.

Members of DOGS VICTORIA are committed to breeding for the betterment of their breeds – to breeding strong, healthy, genetically diverse dogs which conform to well-recognised and approved breed standards. In so doing, our breeders minimise the risk of reproducing recognised hereditary and other health problems. Puppies bred to the accepted breed standards are more likely to develop conformation relating to their function (which assists in preventing injury) and stable temperaments characteristic of their breeds.

DOGS VICTORIA notes the rationale of the new legislation is to enhance the welfare outcomes of all animals in the state, and to legislate to safeguard animal welfare rather than prosecuting events of cruelty after their occurrence, but is concerned that the proposal appears to be a “one-sizefits-all” approach and that domesticated animals – family pets – are to be treated in the same regime as farm animals – animals bred for slaughter or other commercial, profitmaking purposes and wild animals.

DOGS VICTORIA is of the view that domesticated animals owned by members of Applicable Organisations should be exempt from the requirements of any further legislation and should instead be regulated under the Domestic Animals Act 1994,

amended as necessary, to ensure optimal welfare for all animals within the Application Organisation framework. DOGS VICTORIA is strongly of the view that legislative policy should be guided by welfare and not activism.

DOGS VICTORIA members are already highly regulated, having to comply with internal Rules, Regulations and Codes of Practice as well as state government legislation and delegated legislative and other instruments and local government requirements.

Each dog owned by a member of DOGS VICTORIA is traceable:

1. The member has a unique identifying membership number;

2. All members’ dogs have a unique identifying number;

3. All members’ dogs have a unique, independently registered microchip number;

4. All members who qualify to breed must obtain a unique Pet Exchange Register Source number (after completing Dogs Victoria breeder training);

5. Each member’s dog must be registered with their local council and has a further unique identifying number.

DOGS VICTORIA’s Codes of Practice and internal disciplinary processes combine to mandate better welfare outcomes for dogs owned by its members than the standards required by state legislation. Few prosecutions of members have taken place over very many years.

Whilst clearly DOGS VICTORIA breeders supply puppies to pet purchasers, the activity of breeding lacks a commercial orientation. Breeders breed to produce their next champion in their chosen activity, whether it be conformation showing or a performance sport. Puppies and dogs retained by DOGS VICTORIA members are loved and indulged pets. DOGS VICTORIA members do not form part of an “animalbased industry” and are not “agricultural producers”.

DOGS VICTORIA is strongly of the view that its members should not be subject to the same legislative and regulatory regime as those engaged in industrial and agricultural exploitation of animals for profit.

DOGS VICTORIA is concerned that the Directions Paper, and the survey questions it contains, are at such an abstracted level, without the important detail allowing meaningful responses to be given.

Theme 1: Safeguarding Animal Welfare

1.1

Animal Sentience

It is inconceivable that a DOGS VICTORIA member would dispute, or fail to recognise, that their dogs are “sentient”. DOGS VICTORIA members participate in a wide variety of canine activities which take place in competitive, social and training environments, and require close cooperation between the dog and handler, built upon relationships of trust. Such activities underpin the importance placed by DOGS VICTORIA members on breeding for health and temperament.

DOGS VICTORIA members are clearly aware that their dogs may experience nervousness and happiness and a range of emotions both at home and when participating in canine activities.

However, DOGS VICTORIA cannot endorse legislating to recognise animal sentience without understanding how this recognition will affect the breeding of purebred dogs by its members. The Directions Paper indicates that causing “unreasonable pain or suffering” will be prohibited. It is known that some jurisdictions have prohibited “unnecessary” pain and suffering which extends to prohibit artificial inseminations and particularly surgical implantation of semen by trained reproduction veterinarians. These procedures are essential to ensure genetic diversity and health of our breeding dogs. Likewise the ACT now has prohibited breeding with a bitch that has previously given birth by caesarean section. There appears to be no proper scientific basis for this prohibition.

DOGS VICTORIA therefore calls upon the Andrews Government to provide clarification of the nature of the regulations which will define “unreasonable pain and suffering” and to consult with DOGS VICTORIA before endorsing the inclusion of recognition of animal sentience in legislation and to provide better justification for the need for this change, especially as it will reduce the ability of the person best placed to make decisions relating to the welfare of their dog – the owner in consultation with their veterinarian.

1.2

Minimum Standards of Care

DOGS VICTORIA argues that minimum standards of care for dogs owned by members of Applicable Organisations are established by the codes of practice already in existence and by the higher level codes of practice which Applicable Organisations are required to implement and discipline, and report upon in their Annual Reports and applications for renewal of status.

DOGS VICTORIA reiterates its contention that its members are already held to a higher level of care of their dogs and should be exempt from being subject to multiple legislative instruments.

There should be one Act which governs the keeping of dogs by members of Applicable Organisations. Members of DOGS VICTORIA should not be at risk of breach arising from numerous sources of animal legislation.

Accordingly DOGS VICTORIA responds to your questions as follows:

(a) No. DOGS VICTORIA does not support a requirement to provide a minimum standard of care for animals in a new Act unless it exempts its members as it is of the view that the obligations placed upon members of Applicable Organisations and internally of its own motion more adequately secure a better welfare outcome for dogs than does state legislation and more adequately enforces those better welfare outcomes;

(b) The examples of purely physical care indicate that the focus of the government is industry and agricultural production and not domesticated pets;

(c) The Directions Paper does not explain the tests that would be used to assess a breach of either an “obligation” or a “duty of care”, the latter being the subject of volumes of legal decisions, and in the absence of a full explanation, DOGS VICTORIA considers this question unanswerable. Potential obligations or duties regarding veterinary treatment for animals is particularly needing clarification – where competing

treatment regimes are proposed, who will arbitrate? What decision-making role will vest in the owner? These are very significant issues which are deserving of proper elaboration.

1.3 Offences for Prohibited Acts

DOGS VICTORIA is of the view that there is an inconsistency under the current POCTA Act between defining cruelty to include acts likely to cause unreasonable pain or suffering and allowing councils to mandate the de- sexing of animals.1

DOGS VICTORIA agrees that acts of cruelty to animals should not be tolerated but considers that the most effective tool to prevent cruelty is education.

DOGS VICTORIA responds to your questions as follows:

(a) DOGS VICTORIA partly supports the shift from prohibiting specific actions and behaviours that constitute cruelty to providing a set of general offence categories provided that prior to the introduction of such legislation the government clearly defines all the terms used to create an offence. The category 1 example given, failure to provide appropriate accommodation, is inherently unclear. Currently the Code for the Private Keeping of Dogs mandates that dogs under 40cm in height must have a minimum of seven square metres. Presumably an owner would be in breach if the dog was housed in a crate, trolley or smaller enclosure during feeding or sleeping. The RSPCA has however recently endorsed crate training for dogs – this again would breach the example given.

Further, DOGS VICTORIA would only support the introduction of new offences if a comprehensive and effective education campaign was undertaken.

(b) The escalation of offence categories is related to the escalation of penalties. DOGS VICTORIA conditionally supports the escalation of offence categories, subject to the comments in (a) above, if there are clear guidelines delimiting the categories and the penalties attached to each category are reasonable.

(c) There is no question (c)

(d) DOGS VICTORIA repeats its principle objection that members of Applicable Organisations should be subject to only one legislative regime and again suggests that the Domestic Animals Act 1994 could be utilised to provide a more sensible and systematised approach to the regulation of domesticated animals, in this case, our members’ dogs.

(e) DOGS VICTORIA believes in the principle that the punishment should match the crime. There is a great deal of subjectivity in the current POCTA Act. DOGS VICTORIA is of the view however that prosecutions under state legislation should be brought by persons employed under the provisions of the Public Service Act.

1.4 Controlled Procedures

Again, there is a bewildering lack of specificity given the enormity of the potential effects of legislating “controlled procedures”.

The Directions Paper indicates that categories of restricted or controlled procedures will be listed in Regulations. Regulations are necessarily brought into existence after the enabling Act, so respondents to the survey questions, and stakeholders and affected persons will not be made aware of the categories of controlled procedures, exceptional circumstances (if any) and restrictions until it is too late to be heard.

1 DOGS VICTORIA opposes mandatory spay/neuter approaches. Published and peer reviewed scientific studies find that de-sexing a dog, particularly before it has fully matured, can lead to significant long-term health impacts, including cancers (such as osteosarcoma, mast cell cancer, hemangiosarcoma, lymphoma, and lymphosarcoma), hip dysplasia, ligament damage, patellar luxation, incontinence, cognitive decline, fear and/or aggression and other behavioural issues, and even a shorter lifespan. Mandatory spay/neuter legislation targets all dog owners, regardless of their level of responsibility or the behaviour of their dogs. By legislatively mandating surgical procedures without consideration of the individual dog and its circumstances, the approach obviates a veterinarian’s professional case-by-case judgment. This is in direct conflict with professional standards of care required of veterinarians. Routine neutering, especially in the case of non-free-ranging companion animals, raises significant ethical questions, and from some ethical perspectives, looks highly problematic. (a) It is inappropriate to raise this question without divulging the nature of the controlled practices and establishing the scientific and ethical basis for arguing that all controlled practices apply equally to all animals.

(b) This question lacks context and DOGS VICTORIA contends it is cannot be meaningfully answered.

THEME

2: A Simplified and Flexible Legislative Framework

DOGS VICTORIA supports the simplification of animal welfare legislation in Victoria and reiterates that this could be efficiently achieved by utilising the Domestic Animals Act to regulate all animals owned by members of Applicable Organisations.

DOGS VICTORIA does not agree that a “simplified” Act can encompass pets, animal-based industries, agricultural production, animals used in scientific research and wildlife and pest animals. Such a broad ambit will necessarily involve lengthy and complex drafting making the legislation incomprehensible and inaccessible to ordinary people bound to comply with it. The proposed legislation will apply equally to sophisticated profit-making corporate structures and the “mum and dad” owner of one or two dogs or cats.

2.1 The Need for Broad Exemptions

DOGS VICTORIA considers that the legislation governing the exempted activities should be complete and discrete, such that it would include the animal cruelty safeguards relevant to that activity – all regulation of the exempted activity would be set out in “a single place” and persons engaged in that exempt activity need not look to both the primary Act and the POCTA replacement.

Likewise all regulation of domesticated animals could be located in the Domestic Animals Act 1994 so that those concerned in the hobby of dogs or cats could identify all government requirements in the one source document. The POCTA codes could be transferred to the Domestic Animal Act, and members of Applicable Organisations need only search on the one name to be certain of identifying all legislative requirements.

Accordingly DOGS VICTORIA does not prefer either Option 1 or Option 2 but would prefer to see the animal cruelty provisions relevant to a particular sector reproduced in the legislation governing the activities of that sector. DOGS VICTORIA opposes any proposal to remove exemptions currently available to it as an Applicable Organisation under the Domestic Animals Act 1994.

2.2

Clarity of the Framework

DOGS VICTORIA agrees that the legislation governing animal welfare should be logical and unambiguous, and further agrees that the current framework is confusing and inconsistent. However ad hoc and poor drafting should not result in new legislation that is even more complex because it endeavours to be a “one size fits all”. DOGS VICTORIA considers the relevant agencies should instead consider whether legislative clarity could be better achieved by sector- specific legislation incorporating relevant animal welfare safeguards. There would eliminate the need for exemptions and cross-referencing to other legislation. Simplified Codes of Practice could be introduced for each sector.

DOGS VICTORIA does not support either Option 1 or Option 2 because it does not support one primary Act for the reasons set out throughout its response to the Directions Paper. DOGS VICTORIA’s members are not engaged in caninerelated animal-based industries or agricultural production. They are dog fanciers and pet owners who engage in various canine activities for the love of undertaking those

activities with their dogs, and some of whom breed so that they can continue those activities with younger dogs and who supply remaining puppies to pet families.

2.3 Incorporating National Codes of Practice, Standards and Guidelines into the Framework

Again, the four Australian Animal Welfare Standards indicate that the focus of this legislative review is not domestic animals. Likewise the Guidelines for Exhibited Animals (zoos and wildlife parks) and the codes relating animals used for scientific purposes have no resemblance to the manner of keeping domestic animals.

DOGS VICTORIA does not consider a single Act can clearly and simply cover all animals in the state, whether replicated by agreement in other states and territories or on a standalone basis.

DOGS VICTORIA therefore responds to the questions as follows:

(a) DOGS VICTORIA, as a member of a national body, does not object to harmonisation of legislation among the states and territories but believes it should be sector specific, and in the case of dogs owned by members of Applicable Organisations, the national framework should be specific to those activities and animals. DOGS VICTORIA considers that significant and meaningful consultation with the Victorian Applicable Organisations should occur before any steps are taken to adopt a national framework which would alter the current regulation of domestic dogs.

(b) See above

(c) DOGS VICTORIA considers the use of animals in scientific research should be subject to stringent regulation and oversight.

2.4

Co-regulatory Schemes

Whilst DOGS VICTORIA supports in principle the development and expansion of co-regulatory schemes, these appear inconsistent with much of the preceding discussion – viz. desirability of a single piece of legislation and single location covering all animal welfare safeguards. It also appears that this scheme will allow different standards of animal care.

As DOGS VICTORIA considers its members are required to meet higher than minimal standards, it would seek to have discussions about formally entering into a co-regulatory scheme.

(a) DOGS VICTORIA would like to explore further the idea of co-regulation but maintains that a single Act will be complex and will not assist the non- corporate and nonprofitmaking sectors in understanding and meeting their requirements.

(b) Not applicable.

(c) DOGS VICTORIA would welcome consultation on coregulatory schemes for all Applicable Organisations.

(d) This is a matter for discussion during meaningful consultation.

2.5 Formal Role for Scientific Knowledge and Expert Opinion

DOGS VICTORIA acknowledges the contribution of scientific knowledge and expert opinion from veterinary surgeons and specialists to the wellbeing of our dogs.

DOGS VICTORIA also acknowledges the lay expertise of many of its breeder members in the care (anti and post-natal) of all breeding animals and the nurturing of puppies. Many of our members have more extensive and more practical experience in the care and raising of dogs and many members have more experience in animal behavioural matters than scientists and certificated experts.

DOGS VICTORIA does not oppose the establishment of an expert advisory committee but cannot endorse same

without examining its Charter or its composition. There is no explanation of the role or qualifications of experts in the Directions Paper and DOGS VICTORIA reiterates that within the confines of its activities, many of its members are experts. These comments apply to Options 2 and 3. DOGS VICTORIA is interested in Option 3 but again, considers that this guidance should have been fully explained in the Directions Paper.

Theme 3: A Better Compliance and Enforcement Model

That neglect-based offending is the most prevalent breach of the current POCTA cruelty provisions reinforces DOGS VICTORIA’s concern that any enforcement must be preceded by a comprehensive and effective education campaign.

DOGS VICTORIA considers that Applicable Organisations are best suited to educate their members and that the government should make funding available to assist Applicable Organisations to fulfil government objectives. DOGS VICTORIA agrees that any penalty must be proportional to the breach but suggests that before any legislative change is determined, the relevant agencies should investigate why and how breaches occur.

3.1 Monitoring Compliance

DOGS VICTORIA responds the questions as follows:

(a) DOGS VICTORIA considers that enhanced powers to enable proactive compliance assessments have no place in relation to its members generally but could be an appropriate method where the alternative would be seizure. As stated above, DOGS VICTORIA members are both highly visible and highly regulated. Further given the intrusive nature of this proposal, its potential to infringe upon persons’ civil rights, DOGS VICTORIA considers that officers authorised to inspect its members’ dogs and premises should be properly trained and employed by either the relevant council or the state government.

3.2 Permissions and Restrictions

(a) – (c) As the only examples of restricted activities provided are rodeos and scientific research, DOGS VICTORIA would require more information to meaningfully respond to these questions, but in principle agrees that an escalating risk-based framework to safeguard animal welfare and ensure the proportionality of penalty outcomes is appropriate.

3.3 Managing Seized Animals

DOGS VICTORIA is of the view that the seizure of animals should be reserved for the most severe cases of animal cruelty. DOGS VICTORIA has limited experience of its members having had animals seized but believes better outcomes for animals could be achieved if there were dialogue between the agency and the animal owner. DOGS VICTORIA acknowledges that some of its members may, either through ignorance, personal issues (e.g. mental health) or purposeful negligence, not comply with our codes and regulations, or the law and in these relatively few cases, the welfare of the animals is our primary concern. As documented in DOGS VICTORIA’s submission to the 2017 EI&C Inquiry into the RSPCA, DOGS VICTORIA has been frustrated by poor communication with the RSPCA and lack of transparency regarding process, particularly in relation to seizure of animals. We have continued concerns about the physical and psychological well-being of seized animals and, most concerning, the refusal of the RSPCA to communicate with DOGS VICTORIA or the owner/member on matters of animal welfare. DOGS VICTORIA also has concerns as to the transparency of processes around

seized animals. It is in the interest of the animal, the RSPCA and DOGS VICTORIA to collaborate where members are involved. We note that the Comrie Review was critical of the impact of the RSPCA keeping animals for prolonged periods in shelter conditions. DOGS VICTORIA’s full submission dated 10 November 2016 was submitted to the Inquiry into the Domestic Animals Amendment (Puppy Farm and Pet Shops) Bill 2016

(a) DOGS VICTORIA would favour introducing a category prior to Alternative A which would be to assist the owner unable to rectify the situation to identify

and re-home the animal. Only if the owner is unable or unwilling to identify a suitable home for the animal should the other Alternatives proceed.

(b) DOGS VICTORIA believes that the person or agency responsible for making the decision on managing the seized animal should be an independent government official and certainly not the agency who seized the animal and/or prosecutes the owner.

(c) DOGS VICTORIA believes that if the owner will not relinquish ownership of the seized animal, the enforcement agency should investigate placing the animal in a foster home. With regard to any dog owned by a member, DOGS VICTORIA wishes to see consultation with its breed clubs and breed rescue which could provide a more humane temporary or permanent outcome for the dog, and the owner.

DOGS VICTORIA would welcome an opportunity to discuss with the Minister the Topics for further development.

HERDING RULES REVIEW

A meeting will be held by the herding committee at KCC Park 1pm Sunday 14 February 2021 to consider Victoria’s submission to the upcoming Rules Review.

The Rules for the Conduct of Herding Trials are scheduled for review over the next couple of years in order for the new rules to take effect from 1 January 2023.

Submissions are to be received in accordance with the ANKC Ltd Procedure for Reviewing Existing Rules and Documents.

February National committee meeting

October Minutes of the February 2022 national committee meeting receive ratification at the October ANKC Ltd board meeting.

Whilst the minutes are awaiting approval a volunteer from the national committee will finalise the amended rules in accordance with the minutes and forward a copy to the ANKC Ltd Administrator.

Once the minutes receive ANKC Ltd ratification, a copy of the new amended rules will be made available (in addition to the existing rules) on the ANKC Ltd website. They will be clearly identified as effective from 1 January 2023.

COVIDSafe

The COVID Recovery Working Party (CRPW) is providing the following key information that will help support our members in resuming training, shows and trials.

Some important notes:

• Please carry a mask with you at all times.

• Whilst outside activities do not require participants to wear a mask, should there be an inability to social distance, masks will be required.

• When visiting KCC Park or Bulla Exhibition Centre you must scan in through the QR code or sign in via the clubs sign in registry sheet.

• Clubs are required to setup their own QR Codes and tracking records. There will be information available on the website as to how clubs can do this.

• Training can resume without the requirement of zoning and bubbles.

• For gatherings under 100 people a COVIDSafe Event Plan is not required.

• For gatherings over 100 people a COVIDSafe Event Plan is required and the event Tier 3 protocol is required to be followed.

• Trials and shows with contact can commence providing face masks are worn and social distancing is practiced.

• A COVIDSafe Event Plan for all events is required to be submitted to Dogs Victoria.

• General specials, junior handlers and sweepstakes at all breed conformation shows are now allowed, (with conditions).

• Currently “Public Events Tier 3” is capped at 1000 people per event.

• COVID Marshals are still a requirement at events, and you must advise Dogs Victoria if you are a nominated marshal for an event.

Step by step guide for clubs

Dogs Victoria events and activities have been classified by the Victorian Government as public event tier 3. Tier 3 currently has an attendance limit of 1000 people, (07/12/2020).

Organisers should keep up to date with any Victorian Government COVIDSafe regulations and advice along with Dogs Victoria advice as their event approaches.

Restrictions are changing as the risks of COVID-19 infection are reduced. Up to date information can be found on the Government’s website and the Dogs Victoria website.

Steps

1. Judges contracts and schedules must include “Event conducted under COVID-19 conditions”.

2. Submit your schedules that are required to be lodged and to be approved by the Dogs Victoria office, as

occurred pre COVID-19.

3. Complete the COVIDSafe Event Plan template “Section 2 - Event Details”.

4. Email the COVIDSafe Event Plan to covidsafe@ dogsvictoria.org.au for approval at least 5 business days prior to the event.

5. Use only online entry methods.

6. Publish the Dogs Victoria approved COVIDSafe Event Plan on a website or Facebook page.

7. Download and complete Victorian government COVIDSafe Events Checklist, (See Essential Resources listed below).

8. Register the event online with the Victorian Government, attaching the completed COVIDSafe Events Checklist at least 7 days prior to event.

9. Retain copies of plans and registration at the event.

10. Follow your plan during the event including recording all attendees, keeping to attendee limits and managing physical distancing.

11. Follow the latest government and Dogs Victoria requirements for events.

12. Appoint COVIDSafe Marshals.

Show Regulations

All affiliates advertising schedules are affiliated with Dogs Victoria and their shows are held under the Rules and Regulations of Dogs Victoria. A copy may be inspected at the office of the secretary of the fixture on the day of the show.

The following Rules/Regulations apply to all schedules. No person over the age of 18 years who is a resident of Victoria can exhibit, handle, officiate in the judging ring, or register an animal with Dogs Victoria unless he or she is a financial member of Dogs Victoria.

EXHIBITORS PLEASE NOTE: The committee of the club holding the fixture reserves the right to substitute judges if the entry is excessive. Judging for all shows will be in alphabetical order unless otherwise stated in the schedule.

DEFINITION OF CLASSES: (Age of exhibits is now not published in each schedule).

See Prize Schedule for classes offered. It does not follow that, because a class is defined here, there necessarily is one offered for any particular breed.

Please read the schedule carefully and complete the entry form in block letters.

8. LIMIT, for dogs over 12 months of age which are not champions, or have gained sufficient points to qualify as a champion.

NOTE - The qualifications for the NOVICE, GRADUATE and LIMIT classes, shall only include wins up to and including the day before the date of the entry close.

9. STATE BRED, for dogs six months of age or over, whelped in the state or territory in which it is exhibited.

10. AUSTRALIAN BRED, for dogs six months of age or over, whelped in Australia. (A state and/or territory may reserve the right to exclude all, or any, of the recognised Australian breeds.)

11. OPEN, for all dogs six months of age or over, and of a breed or variety

recognised by the ANKC.

NOTE: ANKC Regulations Part 5, Clause 1.5 Only entire dogs and bitches can compete in the veteran classes at specialist and semispecialist show where the winners are eligible to compete for challenge certificates.

14. BRED BY EXHIBITOR, for dogs aged six months and over. The exhibit must be owned and handled by the breeder of record.

15. PUPPY NEUTER, for neuter dogs aged six and under twelve months.

16. JUNIOR NEUTER, For neuter dogs aged nine and under eighteen months.

17. INTERMEDIATE NEUTER, For neuter dogs aged eighteen and under thirty-six months.

18. OPEN NEUTER, for neuter dogs aged six months or over.

ANKC clause 3.2 “Classes 15, 16, 17 & 18 shall be ineligible to compete against entire exhibits for challenge or best of breed awards.”

To compete in neuter classes a dog must beregistered as a neuter on the main register.

Refer to ANKC Regulation Part 5 Section 7.7 for neuter championship points system.

21. CHAMPION CLASS, for exhibits which have qualified as champions. This class is for both dogs and bitches for each breed at open shows. The winners of these classes are not eligible to compete for best dog, best bitch, or best of breed therefore they cannot compete for any group award other than best champion in group or any in show award other than best champion in show. The above class shall be judged as the first class of each breed at open shows. Where class 21 or 21A are not offered champions shall compete in ordinary classes.

LOCAL CLASSES AT CHAMPIONSHIP SHOWS - are classes for exhibits of at least six months of age owned by exhibitors residing within a specified radius of the exhibition. The body holding the exhibition shall have the power to specify any radius up to 50 km. If the radius is not specified in the schedule it shall be taken to be 50 km.

Local classes may not be offered within 160 km radius of the GPO Melbourne. Wins in local classes shall count against the eligibility of a dog only for restricted local classes.

7.2.17 Baby puppies are not eligible to compete outside of baby puppy class except only for baby puppy special prizes. ANKC Regulations Part 5 - Show, Section 1, Clause 1.6 Where a member body regulations allow for property and special classes at specialty shows, neuter dogs and bitches shall be eligible to enter.

Challenge Certificates

7.7.19 When a specialist breed club or semispecialist (variety breed) club is conducting its annual championship show, challenge and best of breed certificates shall be restricted (not be offered) for that breed at any other championship show conducted on that day in Victoria. At that other championship show: 7.7.19.1 the scheduled classes for the breed to which the restriction refers may be conducted, 7.7.19.2 the “restricted” winners of these classes may compete for special prizes such as “best of class in group” and “best of class in show”. 7.7.19.3 the “restricted” winner may not compete for “best of breed”, “best in group” or best in show” or any other competition which is available to challenge or best of breed winners

only. Where permission has been granted for a breed club or variety breed club championship show to be conducted in conjunction with, and on the same grounds as, the championship show of its group club or an all breeds championship show, this Regulation shall not apply.

National Shows

Where a national show is held, no challenge certificates shall be awarded for the breed/s involved in the national show, within a radius of 1000 km from the show on that day/s.

Junior Handler Classes at all Breeds Championship Shows

ANKC Ltd Regulations Part 15B, Section 7

An affiliated club, other than a breed or group specialist club, must conduct a junior handler competition at one of its shows in each calendar year. 7.1 Where an affiliated club conducts more than one show over a weekend the junior handler competition must not be conducted on a regular school day and must be conducted on the weekend or days proclaimed a school holiday unless out of school hours. 7.2 Where a junior handler competition is to be held by an affiliated club, the competition must be advertised in the official schedule lodged with the controlling body in respect of the show. 7.3 Entry fees may not be charged in respect of junior handler competitions.

Correctness of details on the entry forms

Every person who enters a dog in any fixture conducted under these Regulations shall be responsible for the correctness of details on the entry form. The dog entered is to be owned or leased by the person who is named as the exhibitor on the entry form and registered as such with the State Controlling Body in which the exhibitor resides. The dog entered must hold a current vaccination certificate issued by a veterinarian. Exhibitors and dogs participating at an exhibition do so at their own risk.

Online Entries

When entering events using an online entry provider entries will close at midnight on the day online entries close unless stated otherwise in the schedule.

REGISTRATION AND EXHIBITION OF DOGS Dogs Victoria MEMBERSHIP ESSENTIAL Regulation 3.3.1

A person cannot exhibit, handle or officiate at a VCA approved exhibition, or participate in VCA breeding activities, unless that person is a financial member of an ANKC Ltd recognised state member canine controlling body.

Children under the age of seven years are not permitted to exhibit, handle or officiate in the judging ring at approved Dogs Victoria fixtures.

ANKC Ltd Regulations Part 5 Section 8

8.2 Excepting as provided for in Regulation 8.3, handlers at all competitions must be financial members of the controlling body in the state or territory in which they reside.

8.3 A person, who is not a resident of Australia, and is able to provide written advice to the secretary of the affiliate conducting the event from the recognised controlling body of their country of residence that they are permitted to handle dogs at championship exhibitions held in that country, may handle at all competitions conducted by member bodies for a period of up to three months on each visit.

Procedures at Exhibitions

7.5 PROCEDURES AT EXHIBITIONS

7.5.1 No member of a Judge’s family or household, including a person who resides at the same address, or a Judge’s partner, shall exhibit or handle any dog at any fixture at which the Judge officiates as a judge. This regulation does not apply to a Trainee Judge judging a sweepstakes class where the class is judged before breed classes.

7.5.2 At an exhibition a Ring Steward will not exhibit or handle any exhibit under a Judge for whom they have stewarded at that exhibition.

7.5.3 No person shall enter any exhibit or handle in any Show or other exhibition under any Judge who has, or has had, a proprietary interest in a dog or dogs whether solely or in partnership with such person, within a period of twelve months prior to such Show or exhibition.

7.5.4 No person shall exhibit or handle under a Judge, if that Judge has handled any dog owned or part owned, leased or part leased by such person within a period of 12 months prior to such event or exhibition. This Regulation applies to approved and sanctioned events, with the exception of members competitions and dog matches, and does not apply where an exhibitor assists another exhibitor who, due to a judging decision on the day, is required to compete with two or more exhibits at the same time in the same ring. 7.5.5 No person shall exhibit or handle under a Judge, if that person has handled any dog owned or part owned, leased or part leased by such Judge within a period of 12 months prior to such event or exhibition. This regulation applies to all approved and sanctioned events, with the exception of members competitions and dog matches, and does not apply where an exhibitor assists another exhibitor who, due to a judging decision on the day, is required to compete with two or more exhibits at the same time in the same ring. A Judge will excuse from the ring, any dog exhibited or handled by any person who has handled, or assisted as a ‘runner’, any dog owned or part owned, leased or part leased by that judge within a period of 12 months. This regulation applied to all

Herding Judges Training Scheme 2021

Expressions of Interest

The herding subcommittee invites expressions of interest from any members who are considering becoming a herding judge. Please email rozate@gmail.com for copy of the Herding Judges Training Scheme and the application form for the 2021 scheme. All members in the scheme in 2020 will be included into the 2021 scheme.

1. Application Procedure

All applications for entry into the Judges Training Program must be on the nominated form and be received before the nominated date.

To be eligible to enter the Program the applicant must:

[a] have been a member of the ANKC Member Body for a total period of not less than five years, but dispensation may be given for persons with sufficient experience in this discipline

[b] be over 18 years of age;

[c] be approved by the member body

approved and sanctioned events, with the exception of member’s competitions and dog matches, and does not apply where an exhibitor assists another exhibitor who, due to a judging decision on the day, is required to compete with two or more exhibits at the same time in the same ring. (15/04/16)

7.5.6 No person shall exhibit or handle under a Judge if that person has accommodated that Judge or been accommodated by that Judge in the period of 12 months prior to a show at which that Judge is officiating or intends to accommodate the Judge within 24 hours after the Show. (15/04/16)

7.5.7 A Judge who has trained or groomed for reward, gift or favour a dog, must not adjudicate upon or judge that dog at an exhibition within a period of 12 months. No person shall enter, handle or exhibit any dog at an exhibition where a judge who may be involved in the judging of that dog during the exhibition has trained or groomed for reward, gift or favour that dog within a period of 12 months. Training included physically handling the dog or giving instruction for reward, gift or favour but excludes professional veterinary care and attention. (15/04/16) This regulation does not apply to:

7.5.7.1 Elimination awards where due to a Judge’s decision on the day an exhibitor assists another exhibitor by handling a dog for an award such as the challenge award or a best of breed or class in breed award where the owner has two or more dogs to be judged for that award. (15/04/16)

7.5.7.2 The exhibitor assisting another person by holding dogs in an assembly area for that person who is showing two or more dogs at the same time. (15/04/16)

7.5.8 No judge including licenced, trainee and aspiring judges shall handle any dog at any exhibition for financial gain or reward. (15/04/16)

7.5.9 At all conformation amenities shows including Classic Dog Show, KCC Park Show, Bulla Extravaganza, Summer Spectacular and New Year’s Shows no official including secretary, chairperson, committee member or show manager shall exhibit or handle any dog nor enter any co-owned by them. 2. Eligibility to judge all Test Levels

The only persons eligible to judge instinct test shall be those who have been accepted into the Herding Judges Training Scheme.

Applicants must have:

[a] trained and trialled a dog to a pre-trial test title

[b] acted as scribe and stock handler for at least three herding tests and at least three pre-trial tests within 12 months prior to application

[c] attended relevant lecture/workshops before to undertaking theory assessment

[d] passed theory and practical assessment for test levels

3. Eligibility for first Trial Course licence

To be eligible to apply for a herding judges licence in a given course the applicant must have:

[a] eligibility to judge pre-trial test;

[b] judged a minimum of three pre-trial tests;

[c] acted as scribe for at least three herding judges at trial events on chosen course within 12 months [24 months for C course];

[d] trained and trialled a dog at intermediate level on chosen course;

[e] attended relevant lecture/workshops before to undertaking theory assessment

[f] passed theory and practical assessment for trial licence

4. Eligibility for subsequent Trial Course licence(s)

To be eligible to apply for a herding judges licence in a given course the applicant must have:

[a] judged a minimum total of six dog runs over at least two trials

[b] attended relevant lecture/workshops before to undertaking theory assessment

The attention of breeders and intending puppy purchases is drawn to the following VCA Regulations and ANKC Regulations. Full copies of the Regulations are available from dogsvictoria.org.au and ankc.org.au

VCA REGULATIONS

4.4.4 Except as provided for in these Regulations any member selling, supplying or disposing of a dog to another person must supply to that person the signed registration certificate duly completed with the name and address of the person and the transfer date, within one calendar month of disposal unless

Management Committee otherwise directs. A member shall not include any contractual provisions contrary to this regulation. (15/11/11)

4.4.5 Any member who sells a registered dog without transfer of registration to the purchaser must obtain the agreement of the purchaser in writing that the dog will either not be transferred into the name of the purchaser or deregistered with the VCA.

4.4.6 A member shall not sell any dog in such a manner as to cause the purchaser to believe the dog being sold is registered with the VCA if it is not. (15/09/19)

4.4.6.1 A member may indicate during the sale that a dog which is not as yet registered with the VCA is intended to be registered in accordance with Regulation 4.1.3.

ANKC LTD REGULATIONS Part 6 Section 8 Breeding

8.3 All bitches eight years of age and

over at the time of a mating must have a current veterinary certificate stating that the bitch is in good health at the time of breeding. This certificate must be presented at the time of registration of the litter resulting from this mating. 8.5 First Degree Mating protocols: (Added 10/12, 6.6.1)

8.5.1 Applications shall be made prior to the mating to the relevant ANKC Ltd Member Body and the following information is the minimum required for the Member Body to make deliberation:

a. Grounds for the mating should include details of the dogs to be mated and relevant health test results;

b. Desired outcomes for the mating;

c. When the intended mating is likely to occur.

PART 20 CODES

20.1 CODE OF PRACTICE (amended 15/09/19, 15/08/18)

Each member, upon being admitted or re-admitted to membership of the Victorian Canine Association Inc. shall be bound by the Victorian Canine Association Inc. (hereinafter ‘Dogs Victoria’) Code of Practice.

Ethics

20.1.1 A member shall not knowingly or recklessly misrepresent the ANKC or Dogs Victoria.

20.1.2 A member shall not engage in any behaviour that is contrary to the standards accepted by the community.

20.1.3 A member shall display good sportsmanship and conduct at all times so as to reflect credit upon themselves, the ANKC and Dogs Victoria.

20.1.4 Members shall constantly strive to improve their knowledge of their chosen breed or breeds, and their knowledge of the requirements for the care, welfare and betterment of dogs.

20.1.5 Members shall ensure proper care for all dogs under their control, whereby

20.1.5.1 Food shall be provided in sufficient quantity and nutritional quality; it must be canine appropriate and nutritionally balanced to meet the daily requirements for the condition, activities, age and size of the each dog. All dogs shall have access, in their housing area, at all times, to a sufficient supply of fresh, clean, water daily. Food and water utensils shall be kept clean;

20.1.5.2 Dogs shall be housed in a safe and secure manner that is suitable for the size and containment requirements of the dog and provides protection from adverse environmental conditions and climatic extremes. Adequate ventilation and sufficient space must be provided for

dogs to stand. The flooring area of pens/ cages shall not be made from uncovered suspended wire. Each dog older than 16 weeks of age shall have access to a separate bed or sufficient bedding material that all animals can sleep comfortably at the same time;

20.1.5.3 Dog sleeping, housing and exercise areas shall be kept clean and at a good standard of hygiene by cleaning any faeces, wasted food, and soiled bedding daily. Where pens and kennels are cleaning by hosing, material on floors (toys, bedding, food, faeces etc) shall be removed prior. Hard surfaces in pens and kennels should be disinfected weekly or more often if required. Veterinary advice shall be sought for managing the cleaning of premises and management of isolation if a contagious illness occurs in dogs;

20.1.5.4 All dogs of all age and breeding status shall be provided with an appropriate amount of daily exercise, social contact and enrichment suitable to the individual needs of the dog;

20.1.5.5 Where dogs are tethered, they shall be tethered in accordance with the Prevention of Cruelty to Animals Act 1986 and Regulations. Pregnant bitches of more than 7 weeks gestation, whelping bitches and lactating bitches with puppies shall not be tethered. Puppies under 16 weeks of age shall not be tethered.

20.1.5.7 Dogs shall be transported in a safe and secure manner. Dogs shall not be transported in the boot of a sedan type car. When on the back of a ute or trailer, dogs must be appropriately tethered or caged. Sealed transport containers shall have multiple ventilation holes.

20.1.5.8 Veterinary care is provided as required in accordance with the Code of Practice for the Private Keeping of Dogs. Additional veterinary requirements for breeding dogs is described in Section 20.8 Code of Practice for Breeding Animal Health Management.

20.1.6 A member who leaves a dog owned by them in the care of another person shall remain responsible for that dog.

20.1.7 A member shall take all appropriate lawful measures to assist a dog in distress.

20.1.8 A member shall positively enhance the reputation of dog breeders and owners by ensuring that dogs owned by the member are not a danger or nuisance to the community.

20.1.9 A member shall not participate in nor support any activity in that involves cruelty or damage to animals, excluding legal hunting activities.

20.1.9.1 Dogs shall not be trained or worked beyond their willingness and capabilities. All training methods used shall be humane and not cause undue fear, distress or pain.

20.1.9.2 Dog Collars

The use of dog collars incorporating protrusions designed to puncture or bruise the dog’s skin, or electronic collars designed to deliver an electric shock to the dog is prohibited at any VCA sanctioned event, training activities, or any activity which may reasonably be seen to be in connection with the VCA. 20.1.10 A member shall make every effort to rehome any dog no longer required by that member to a suitable home. A member shall not dispose of dogs owned or bred by the member to a pound or animal refuge except in exceptional circumstances and following notification in writing to Dogs Victoria. In this instance, depending on circumstances Dogs Victoria may request that any breeder prefix also be suspended or surrendered.

Breeding

20.1.11 A member shall breed primarily for the purpose of improving the quality and / or working ability of the breed in accordance with the breed standard, and not specifically or predominantly for the pet or commercial market.

20.1.11.1 If breeding animals are determined to be no longer suitable for breeding, or are retired and are to be rehomed, they must be prevented from further breeding by transfer to limited register, neutering, contraception, contract of agreement or other means.

20.1.12 A member shall not breed with a bitch unless they have reached adequate maturity for that breed as determined by Dogs Victoria, without the prior approval of Dogs Victoria. Where the Rules, Regulations and Codes of Practice are otherwise silent, the minimum age for breeding a bitch shall be 12 months [see attached Minimum Breeding Age for Bitches]. (15/11/18)

20.1.13 A member shall not breed a bitch causing it to whelp more than twice in eighteen months without the prior approval of Dogs Victoria.

20.1.14 A member shall not breed with a bitch causing it to whelp more than five times in its lifetime (amended 15.03.17)

20.1.14.1 First generation breeding (eg father / daughter; brother / sister; mother / son) matings are not permitted.

20.1.14.2 The progeny of any matings under 20.1.14.1 will be registered on the Limited Register and endorsed “never to be upgraded”. It will be a breach of Code 20.1.14 by the member/s who are the owners of the sire and dam of the litter constituting an offence against Dogs Victoria Rules, Regulations and Codes.

20.1.14.3 All bitches eight years of age and over at the time of a mating must have a current veterinary certificate stating that the bitch is in good health at the time of breeding. This certificate must be presented at the time of registration of the litter resulting from this mating. A current veterinarian certificate is defined as being within three months prior to the mating. (15/08/15)

20.1.15 A member shall not permit any of that member’s pure bred dogs to be mated to a dog of a different breed, to a cross bred dog, to an unregistered dog of the same breed, or to a dog not on the Main Register without the prior approval of Dogs Victoria.

20.1.15.1 A member shall not permit any of that member’s unregistered dogs to be mated to any other unregistered dog, with the exception of dogs registered with a Registry Body recognised by ANKC Ltd (unless an exemption is granted by Dogs Victoria). (amended 15.03.17, 15.04.18)

20.1.16 A member shall take responsible action to reduce the incidence of hereditary diseases in accordance with the ANKC Code of Practice for Hereditary Diseases and shall comply with Dogs Victoria’s Code of Practice for Hereditary Diseases (Code 20.3), and the Prevention of Cruelty to Animals Act 1986, particularly with respect to the Code of Practice for the Responsible Breeding of Animals with Heritable Defects that Cause Disease.

20.1.17 A member shall not, within Australia, sell or otherwise transfer from that member’s care any puppy under eight [8] weeks of age. (amended 15.05.17)

20.1.18 A member shall not export a puppy under

the age of eleven [11] weeks, or such greater age permitted under the livestock import requirements of the country to which the puppy is being exported.

20.1.19 Deleted (15.11.19)

20.1.20 A member shall ensure that persons acquiring dogs from that member understand the requirements for the care, welfare and responsible ownership of the dog, and that they have the time and facilities, e.g. adequate fences, sufficient room and proper shelter, to fulfil their responsibilities.

20.1.21 A breeder shall be expected to maintain reasonable contact with the purchasers of dogs from that breeder and to offer continued advice and reasonable assistance.

20.1.22 Record keeping requirements: (15/09/19) (15/11/11)

20.1.22.1 A breeder shall create a record file for each individual puppy born, and maintain until ownership changes or the animal is deceased. A breeder shall make available all records for inspection by an authorised officer or as directed by an officer of Dogs Victoria. Copies of these records must be retained by the breeder for a minimum of 3 years from date of last entry.

20.1.22.1.1 Records to be kept for puppies under 12 weeks of age shall include the following (copies of original documents are acceptable where originals accompany the puppy to its new owner):

• a copy of the litter registration form, or alternatively: -name, -microchip number (when implanted); -sex; -breed; -date of birth; -colour and markings (if applicable); and -dam and sire registered names and numbers

• health care history including vaccination records, internal and external parasite control,

• purchase/disposal record including name and address of new owner (where applicable),

• copy of health declaration, and

• record of return (if applicable) with supporting documentation.

20.1.22.1.2 Records to be kept for dogs over the age of 12 weeks acquired or retained by breeders for the purpose of breeding shall include:

• either ANKC registration certificate, or alternatively: -registered name and number when registration details become available; (amended 15/09/19)

- microchip number;

- sex; - breed;

- date of birth;

- colour and marking (if applicable); and

- dam and sire registered name and numbers

• council registration certificate;

• health care history including vaccination records or titre tests, internal and external parasite control,

• breeding status and breeding history,

• purchase/disposal records including name and address of new owner (where applicable), and

• record of return (if applicable) with supporting documentation.

20.1.22.2 Records of breeding history for dams must include dates of mating or artificial insemination, dates of whelping, number of puppies born alive, number of puppies stillborn, record of any whelping complications and resultant treatment, microchip numbers for live pups at 8 weeks, and post-partum veterinary treatment.

20.1.23 A member shall provide to all recipients of dogs sold or otherwise disposed of by that member, written details of:

20.1.23.1 The breed characteristics;

20.1.23.2 Vaccination record and / or requirements including the due date of the next vaccination or recommended timing for next titre;

20.1.23.3 Responsible dog ownership information;

20.1.23.4 All documentation required by Dogs Victoria

20.1.23.5 Records on internal and external parasite control;

20.1.23.6 Records of microchip number with a signed transfer of owner form;

20.1.23.7 A desexing certificate (if applicable); and

20.1.23.8 A written health declaration in accordance with 20.1.25.

20.1.24 A member shall not incorrectly describe nor knowingly misrepresent the characteristics of a breed.

20.1.25 A member shall ensure that all dogs sold or disposed of by that member are in the best possible state of health. Where any known physical abnormalities exist, a breeder health declaration shall be supplied which includes details of the known physical abnormality at the time of sale and how that abnormality may affect future health and welfare of the dog. This shall be signed in acknowledgement by the recipient. With the exception of matters disclosed in the health declaration, a member shall abide by the following as a minimum practice when selling dogs;

20.1.25.1 Where a dog is returned to the member within 3 days of sale, for any reason not supported by a statement from a veterinary practitioner, the member must take back the animal and refund 75% of the purchase price.

20.1.25.2 Where a dog is returned to the member within 21 days of sale accompanied by a statement from a veterinary practitioner that the animal is unacceptable for health reasons, the member must take back the animal and refund 100% of the purchase price.

20.1.25.3 If an animal is diagnosed with, suffering from, dies of, or is euthanased from a physical defect or disease that is directly traceable to the point of sale within 3 years of purchase, the member must, subject to a second veterinary opinion, refund 100% of the purchase price where the owner of the animal provides supporting statements from a veterinary practitioner, including test results where

a suitable test is available. Owners of the animal must make veterinary reports and test results available to the breeder for the breeder to obtain their own veterinary advice (second opinion), and for the purpose of informing future breeding management.

20.1.26 A member shall not:

20.1.26.1 Sell or dispose of a dog to a commercial pet wholesaler or retail pet shop.

20.1.26.2 Allow a dog owned by that member to be given as a prize or donation or to be auctioned.

20.1.26.3 Advertise in any media or other display, the sale or disposal of a dog without the inclusion of the member’s DOGS Victoria membership number and, unless subject to written veterinary advice that the health

of the dog is liable to be significantly prejudiced if it is implanted, each dog’s full microchip number. It is mandatory that the following wording is included in any advertisements: “Please contact Dogs Victoria on email: office@ dogsvictoria.org.au to verify my membership”.

General

20.1.27 A member who provides or makes available a dog for use in a film, advertisement, promotion, or any media or public display must ensure that:

20.1.27.1 The dog is portrayed in a manner consistent with its breed characteristics and temperament as described in the Standard for that breed; and

20.1.27.2 The dog is presented in a manner that is unlikely to create a negative reaction to dogs generally or that breed in particular

20.1.28 A member shall not indulge in false or misleading advertising relating to the conformation, characteristics or performance of that member’s dog.

20.1.29 A member shall not misrepresent nor malign the conformation, characteristics or performance of another member’s dog.

20.1.30 A member shall not misrepresent, malign, impugn or denigrate another member or person in such a way as to bring discredit upon themselves or Dogs Victoria. (14/02/13)

7.6.8 Extreme Weather Conformation

This regulation takes effect from and including Saturday 1 October 2016.

Hot Weather

If the forecast temperature for the district where the show is to be held is 36 degrees or higher then:

(a) The show is to be cancelled or:

(b) The show is to be rescheduled to start at 7 pm where the exhibition area has lighting and is available for use.

Fire Danger

If the CFA fire danger rating for the district where the show is to be held is Extreme or Code Red then: The show must be cancelled

Gale Force Winds / Thunderstorms / Flood

If gale force winds, thunderstorms or floods are predicted for the district where the show is to be held then:

(a) The show MAY be cancelled or (b) A wait and see approach may be adopted and

1. If the show proceeds, judging must stop during thunder storms or periods of heavy rain.

2. Judging may continue without a lunch break.

4. It is the responsibility of the secretary of the affiliate or its delegate, and the exhibitor to check the forecast weather, the fire danger rating, or the gale force winds, thunderstorms and flood prediction, for the district where the show is to be held as in procedures 1 and 2 above.

5. The secretary of the affiliate or its delegate must notify the Chief Executive of Dogs Victoria by telephone when the decision has been made to cancel or reschedule a show.

6. The Chief Executive will place a notice on the Dogs Victoria Facebook page and website advising members of the status of any show affected by this regulation.

7. Exhibitors are to refer to the Dogs Victoria Facebook page and/or website to check the status of the show.

8. Where a show is cancelled, no entry fees will be refunded.

Where the affiliate has cancelled a show the secretary or their delegate must submit a copy of the catalogue and pay all levies to Dogs Victoria within 14 days of the date of the cancelled show.
