The Selling Process

LISTING CONTRACT AND STANDARD FORMS

The first formal step in marketing your property is to enter into a written listing agreement: a legal contract that commits the Whistler Real Estate Company to actively market your property for a specific period of time The contract will contain:

The price of the property

The address and legal description of the property

Your legal name and current address

COMMUNICATION

The commission amount

Expiry date of the contract

Exclusion list (items not included in the sale)

We will document every step in the sales effort and provide regular progress reports by email, as well as regular phone calls Constant communication is important to review the market activity on your home (interest, viewings, feedback) and discuss whether any price adjustments are required With our team approach there is always one of us available to take your calls and answer questions

NEGOTIATIONS

Negotiations are a key aspect of the home selling process This is when my professional skills make all the difference to negotiating the best possible price and terms for you

When someone offers to buy your home, their Realtor will prepare a Contract of Purchase and Sale When you receive an offer, you can accept it, refuse it, or make a counter offer to the Buyers with the changes you want

An offer usually contains subject clauses that the buyer needs to remove by a specific date These might include a home inspection, suitable financing and review of strata documents, to name a few I will be in constant communication with all parties to ensure the Buyers get all the information and documents they require Once all the conditions have been satisfied, the subjects are “removed” in writing, a deposit is received “in trust” at the Whistler Real Estate Company and a firm and binding contract exists Your home is now considered SOLD

Completion

The Contract of Purchase and Sale will specify a completion day for the sale. On this day, legal ownership of the home will transfer from you to the buyer. We will go over the contract with you well in advance to ensure all contractual obligations are clear Examples might include professional cleaning, a checklist of furniture that may have been included in the contract, keys, codes and garage fobs It is also helpful to leave manuals, and make a list of service providers for the new owners

You will need to hire a Lawyer or Notary Public to handle the completion procedure They will:

Ensure that your mortgage has been properly discharged

Arrange for you to sign papers transferring title

Confirm that all payments you are responsible for have been made

Give you a cheque for the balance

Costs associated with the sale of your home may include:

Legal fees

Any penalties for paying off your mortgage early

Your portion of the property taxes

Realtor Estate Commission + GST

Capital Gains – (contact your accountant)
