Appeals & Referrals Referrals
The Referrals Committee, Mr. Justice Tony Hunt (in the chair), Mr. Laurence McFerran and Mr. Nicholas B. Wachman convened in the Stewards Room, The Curragh Racecourse on Tuesday 11th April 2023, to consider whether Mr. Richard O' Brien (Trainer) was in breach of any rules of racing arising from an Equine Premises Inspection carried out at his Training Establishment on 6th October 2021 by IHRB officials.
On the day, the inspection team noted that the annual trainer/employee agreement which must be displayed as a requirement of the Stable Employment Bonus Scheme in accordance with Rule 298(5) was not displayed.
The Referrals Committee considered a written submission from Mr. O' Brien. In his written submission, Mr. O'Brien accepted that he was in breach of Rule 298(5) as a copy of the agreement was not on display, however he stated that all employees in his yard are verbally advised of their entitlements under the scheme.
Having considered the evidence, the Referrals Committee found Mr. O' Brien in breach of Rule 298(5) and imposed a fine of €250.
The case was presented by Mr. Michael Daly, IHRB Regulatory Legal Advisor.
Referrals
The Referrals Committee, Mr. Justice Tony Hunt (in the chair), Mr. Laurence McFerran and Mr. Nicholas B. Wachman convened in the Stewards Room, The Curragh Racecourse on Tuesday 11th April 2023, to consider whether Mr. Tom Hogan (Trainer) was in breach of any rules of racing arising from a Stable Inspection carried out at his Training Establishment on 21st March 2022 by IHRB officials.
On the day, the inspection team noted that Mr. Hogan's current Veterinary Medicines Register was not available for inspection as required under Rule 148(iii)(b).
In a written submission to the Referrals Committee, Mr. Hogan explained that other than worm doses, medicines were only administered on four occasions in the 12 months since the Stable Inspection on 21st March 2022.
Having considered the evidence, the Referrals Committee found Mr. Hogan in breach of Rule 148(iii)(b) and having considered his record in this regard imposed a fine of €350.
James Joseph Mangan (Trainer) was in breach of any rules of racing arising from a Stable Inspection carried out at his Training Establishment on 20th October 2021 by IHRB officials.
On the day, the inspection team noted that despite signage indicating that skull caps and body protectors must be worn as per Rule 148 (v)(b), two riders were observed riding out without back protectors.
The Referrals Committee considered written submissions from Mr. Mangan and from both riders in question. In his written submission, Mr. Mangan accepted that he was in breach of Rule 148 (v)(b).
Having considered the evidence, the Referrals Committee found Mr. Mangan in breach of Rule 148(v)(b) and imposed a fine of €200 in respect of both riders, totalling €400.
The case was presented by Mr. Michael Daly, IHRB Regulatory Legal Advisor.
Referrals
The Referrals Committee, Mr. Justice Tony Hunt (in the chair), Mr. Laurence McFerran and Mr. Nicholas B. Wachman convened in the Stewards Room, The Curragh Racecourse on Tuesday 11thApril 2023, to consider the referral of Mr. Gordon Elliott (Trainer) in relation to the identification of Optoforce which was due to run on 4th March 2023 at Navan in the Race Displays Maiden Hurdle.
On the day, the Stewards received a report from Ms. Emma Costello, IHRB Veterinary Officer, that she was unable to positively identify Optoforce from the markings and the microchip number contained on the passport for the horse and that the filly presented was in fact an unnamed 2019 filly by Artic Cosmos x Beyond Belief. The Stewards ordered the withdrawal of Optoforce in accordance with Rule 90 (iv) and referred the matter to a Senior Racing Official for further investigation. On further investigation, it was also noted that a second runner in the same race, Media Naranja, could not be positively identified from the markings and the microchip contained in the passport presented, and the horse presented was Mrs Paisley. Media Naranja was subsequently presented in time to race.
At the Referral Hearing, the committee considered evidence from Mr. Elliott.
In his evidence, Mr. Elliott explained that he had been abroad on the day of the fixture and his travelling head girl was also away from the yard supervising cross country schooling. Mr. Elliott apologised for the mix up that took place at Navan and explained that Optoforce, who was due to run for the first time, had not been scanned on first arrival at his yard. Mr. Elliott further explained that Media Naranja and Mrs Paisley are two horses that look similar to each other and on the morning of the race both had come off the horse walker at the same time and were put in the wrong stables by a weekend member of staff. Mr. Elliott accepted that he was in breach of Rule 90 (vi) and assured the Committee that he has taken active measures to prevent a reoccurrence of this incident.
Having considered the evidence, the Referrals Committee were satisfied that Mr. Elliott was in breach of Rule 90(vi) in respect of both Optoforce and Media Naranja. They imposed a fine of €500 in respect of Optoforce, and, having considered the mitigating circumstances, imposed a fine of €200 in respect of Media Naranja.
The case was presented by Mr. Michael Daly, IHRB Regulatory Legal Advisor.
Appeals
The Appeals Body, Mr. Robert Dore (in the chair), Mr. Anthony Byrne and Mr. M.C. Hickey convened at the Offices of the Irish Horseracing Regulatory Board on Wednesday, 5th March 2023 to consider the appeal of Shane Foley (Rider) following the decision of the Raceday Stewards at Naas on Sunday, 26th March 2023.
Following the running of the Irish Racing Writers Madrid Handicap, the Raceday Stewards found Mr. Foley in breach of Rule 214 in that he had ridden carelessly and having considered his record in this regard they suspended him for three racedays.
The grounds of appeal lodged by Mr. Foley was that the Stewards on the day erred in their decision.
At the Appeal Hearing, evidence was heard from Mr. Foley, rider of Panic Alarm. The Appeals Body also watched a recording of the race.
In his evidence, Mr. Foley stated that his mount had given him no indication throughout the race that he would shift left at any point. Mr. Foley said that he had used his whip twice and the horse had continued straight but on the third occasion drifted left, at which point he corrected him immediately. He said that his mount had moved across only slightly but it appeared worse as Semblance Of Order, ridden by Chris Hayes, had been green throughout the race and shied away from Panic Alarm. He also added that Duke Of Leggagh hung right, as reported by his rider Nathan Crosse and that Paddington, ridden by Ryan Moore, had also moved right at this point.
Having considered the evidence, the Referrals Committee confirmed Mr. Foley was in breach of Rule 214 in that he had ridden carelessly. However, due to mitigating circumstances they varied the sanction to two racedays.
The case was presented by Mr. Michael Daly, IHRB Regulatory Legal Advisor.
Suspension Dates: 11th and 12thApril.

Carberry stated that as the runners were moving forward, his mount got lit up and got a run on him despite his best efforts to restrain the horse by sitting against him. Having viewed the recording of the incident and considered the evidence, the Raceday Stewards gave P.J. Carberry the benefit of the doubt and took no further action.

Evidence was heard from the rider concerned. In his evidence, Mr Codd accepted that he had breached the whip guidelines and apologised for his actions. Having viewed a recording of the race and considered the evidence, the Raceday Stewards were of the opinion that Mr J.J. Codd was in breach of R10(3)(g) by using his whip with excessive frequency and R10(3)(i) by using his whip without allowing his mount at least three strides to respond. They were, however, of the opinion that R.L. Moore was in breach of Rule 214 in that he had ridden carelessly and, having considered his record in this regard, the Raceday Stewards suspended him for two racedays. Mr. P.N. Moore stated that his mount was green throughout and was pulling up in front when she dived right for the gate. D.P. McDonogh stated that he suffered interference and felt it may have cost him second place. Having viewed the recording of the race and considered the evidence, the Raceday Stewards were of the opinion that while Red Riding Hood had caused interference to Shamwari, she did not improve her finishing position as a result of this interference so they made no alteration to the Judge's placings.
Furthermore, the Raceday Stewards were of the opinion that R.L. Moore had taken all reasonable steps to prevent the interference from occurring and they therefore took no further action. Mr. P.N. Reynolds recused himself from this enquiry. Mr. N. Chance attended this enquiry in an observatory capacity.

Cleary, unplaced, where it appeared that Rumbled Again and Inthepoorhouse both ran short of room. Evidence was heard from the riders concerned. J.M. Sheridan stated that he could not fill the gap and took a precautionary check. R.P. Cleary stated that his mount became a little intimidated and rolled right. S.D. Bowen stated that his mount leaned right for company. B.M. Coen stated that he kept straight and caused no interference. Having viewed the recording of the race and considered the evidence, the Raceday Stewards found S.D. Bowen was in breach of Rule 214 in that he had ridden carelessly and, having considered his record in this regard, they suspended him for six racedays.
