Things are heating up quickly for the fledgling hemp cannabinoid space. Massachusetts’ comprehensive new regulations, targeting hemp processors and businesses, have introduced severe limitations on the sale and distribution of hemp-derived products, promising all but certain death for hemp businesses within the Commonwealth. In Louisiana, two competing bills are making their rounds, with nearly polar opposite goals. HB 952 seeks to establish clear standards for hemp products, while SB 495 proposes stringent restrictions that could isolate and severely impact the local hemp market. Meanwhile, in Chicago, a new ordinance introduced by Alderman Brian Hopkins, aims to regulate potent hemp-derived products by confining their sale to licensed cannabis stores.

It appears that the latest assault on the cannabis industry is coming from Colorado, of all places. The Rocky Mountain State’s SB24158, sponsored by Democrats Hansen, Michaelson Jenet, and Lukens, mandates immediate removal of any online promotion of substances deemed illicit, including legal marijuana. Taking heavy criticism for potential free speech infringement, the bill, part of a larger internet policy reform, will require social media platforms to update and publish policies by 2025, aligning with state content regulations. At press time, the bill is scheduled for discussion in the Senate Business, Labor, and Technology Committee. Whether it will pass is anyone’s guess at this point. However, if it does pass the legislature, it’s hard to imagine Governor Jared Polis, a longtime proponent of legal cannabis, would sign the bill into law.

Blumenaur Spits Truth

U.S. Rep. Earl Blumenauer might be drifting toward retirement, but he’s not going quietly. Just at press time, he criticized the Biden administration for not ending marijuana prohibition, labeling it “political malpractice.” At a House committee hearing, Blumenauer conveyed frustration at the delays in the DEA’s review of cannabis scheduling, supported by remarks from Vice President Harris. Health Secretary Xavier Becerra responded, noting that while HHS has recommended rescheduling cannabis, the final decision rests with the DEA. IOWA’S CHOICE TO PROTECT MEDICAL MARIJUANA INDUSTRY

Iowa’s House recently passed legislation that would place excessively strict controls on hemp product consumption, limiting THC content to 4mg per serving and 10mg container, alongside introducing age restrictions and warning labels. Meanwhile, Iowa’s Senate passed a bill doubling the maximum number of licenses available for medical cannabis dispensaries. There is a clear desire to promote the medical marijuana industry at the expense of the state’s functional hemp marketplace.

FLORIDA braces for the impact of Senate Bill 1698, a new hemp regulation bill poised to unravel the current legal framework for hemp and hemp extract products. The legislation’s stringent THC concentration limits (Delta-9 only, max 5mg per serving/50mg per package) and packaging standards loom ominously as businesses scramble to adapt.

GEORGIA finds itself embroiled in a legal battle over mislabeled hemp products, highlighting the critical need for rigorous testing and accurate labeling. The lawsuit against major cannabis brands for selling marijuana as legal hemp is a grim reminder of the importance of legal compliance and integrity.

SOUTH DAKOTA has passed legislation prohibiting the chemical modification of industrial hemp, aiming to curb the sale of psychoactive substances. This law emphasizes the distinction between naturally derived cannabinoids and those resulting from chemical processes, compelling businesses to adopt natural extraction methods.

As MINNESOTA moves towards legal adult-use cannabis, heightened scrutiny is on the hemp industry, especially regarding compliance with THC limits. Enforcement efforts aim to ensure hemp products do not surpass legal THC concentrations, with significant fines for violations. With this new scrutiny coming into play, it is all the more imperative for businesses to verify product compliance, ensuring the hemp market’s integrity and consumer safety amidst regulatory changes.

TENNESSEE has proposed serious limitations that threaten to impact the local THC-A market and trigger shifts in consumer behavior towards out-of-state or online purchases. While products with delta-9 THC levels below 0.3% are still legal, THC-A products are in danger of facing strict regulations.

THE FEDERAL CALL FOR ACTION: A UNIFYING VOICE NEEDED

Amidst state-level adjustments, a collective push by 21 state attorneys general for stricter federal regulations on hemp products raises concerns over the industry’s future. Especially with the Farm Bill being reauthorized at the end of fiscal year 2024. Business owners are encouraged to advocate for regulations that balance consumer safety with industry growth, with an emphasis on the need for a harmonious federal and state regulatory framework.

FEDS PONDER KRATOM’S

FUTURE

One look at the official US Food and Drug Administration web page devoted to kratom makes clear that the Biden administration is certainly interested in the leaves of the plant known scientifically as Mitragyna Speciosa. The thing is the attention that the federal agency is giving kratom is not really positive. In fact, as pointed out by members of the American Kratom Association, much of the FDA’s language regarding the plant and its use by Americans is skewed towards a viewpoint that sees kratom as a potential threat to consumers.

But Kratom is everywhere; products containing the plant, whether in the form of leaves, tinctures, or concentrates are sold in shops spanning America from coast to coast – unless you happen to live in Alabama, Arkansas, Indiana, Rhode Island, Vermont, or Wisconsin, where the plant has been totally banned. Additionally, city or county ordinances in San Diego, California; Denver, Colorado; Sarasota County in Florida; and Union County in Mississippi have deemed the plant illegal for human consumption.

Given those parameters, it’s still likely that there’s probably a shelf or an aisle devoted to the product at your shop. Even the feds admit that “Kratom is often

used to self-treat conditions such as pain, coughing, diarrhea, anxiety and depression, opioid use disorder, and opioid withdrawal.” The fact that “an estimated 1.7 million Americans aged 12 and older used kratom in 2021” seems to point to the fact that such use is safe and effective, if mostly unregulated.

And that’s the operative concept here regarding kratom: regulation. Users and retailers all speak of the plant’s effectiveness, but until the feds commit to further testing and a clarification of their policies surrounding kratom, its status as a legal, regulated substance available to consumers remains murky at best.

But there has been some progress. Recent news releases by the FDA indicate an evolution in their stance on kratom. This slow movement forward the FDA is planning on releasing its findings in the fall — has been countered with a growth in lawsuits related to consumer deaths and injuries resulting from kratom’s alleged misuse.

According to some members of the kratom manufacturing and wholesale industry, concrete plans – and ultimately regulation – would not only help guide consumers in their purchases, but would also afford the industry a level of oversight that would guarantee freshness, purity, and safety while also fencing out manufacturers of adulterated and sometimes dangerous kratom-derived products. This sort of regulation would be a starting point toward eliminating the dangers some see in kratom use.

“Speaking for myself, regulation is part of doing business in the United States,” says Drake Fischer of Durity Distribution. No stranger to our readers, Durity, based in Boise, Idaho, is a leading manufacturer and distributor of kratom products, including Mit Therapy Extract Enhanced Kratom and Vital Elements Kratom. “I don’t view regulation as a bad thing,” he continues, “It helps stabilize markets.

it’s healthy and not harmful, leads to consumer satisfaction. Nobody can complain about that because consumers really appreciate the right information.”

The lack of labeling guidelines established by an authority like the FDA has led to problems, Fischer reasons. “Unfortunately, in this space, there are people who get away with lying about their products. Some of them flat out don’t know anything about the product they’re manufacturing or wholesaling. A bit of federal regulation will help that.”

Fischer knows what he’s talking about. As he puts it, he’s involved in the industry “from tip to tail.” His direct presence includes five retail outlets and a massive wholesale operation. “We carry 30 or 40 brands of kratom and seventy or eighty different products, and we manufacture our own brand of kratom, Mit Therapy,” he qualifies, while describing the current

regulatory environment, which he says is mostly self-administered–without the benefit of government support.

“We do in-house production of capsules, powders, liquids … we do everything we can to maintain GMPcertified practices. I really try to keep our processes above the standards, and I’m realistic about that. Also, there are standards that have been set by the American Kratom Association. We follow those guidelines. There are a lot of people trying hard to self-regulate the space. But having federal backup would help out. It would level the playing field.”

But, despite a recent evolution in the federal regulatory environment, like last month’s government admission that their testing was unable to determine dose-based toxicity levels for kratom, there continues to be pushback from the FDA. Kratom concentrates are the focus of current FDA inquiries into product safety, as well as potential legal liabilities in today’s consumer environment. A number of lawsuits, particularly in Florida have recently resulted from human deaths due to alleged misuse of kratom – specifically due to improper labeling and product concentration claims. Fischer has some good ideas about those situations, adding, “I think water can be dangerous if not consumed reasonably. I don’t think we should be telling people what they can and can’t put in their bodies.

That said, I understand that some of these alkaloids can be scary to people, that they could be potentially harmful. Some of them might be beneficial. The key here is that we have to look out for the consumers that might act like idiots with the potentially harmful stuff. That’s why regulation is so important to the entire space. Ideally, manufacturers (who have questions about the safety of their product) should take their case to the AKA, where some regulatory basics can be determined and used. Instead of that, we’ve got all sorts of brands bypassing that framework.”

Enlisting government support to regulate kratom would aid the AKA’s efforts and lead to less controversy, safer dosing, and happier consumers, Fischer concludes.

Until regulators understand the nature of kratom and the consumer demand for its well-recognized benefits, selfregulation and responsible business owners, such as Drake Fischer, are the only defense against the ongoing and often unjustified backlash.

Living PROOF

The film DOSED: The Trip of a Lifetime follows Laurie Brooks as she discovers the transformative power of plant medicine. Offscreen, Laurie shares the deeper discovery: her authentic self.

She sits upright on a non-descript couch, in a nondescript suburban living room. She could be anywhere— and in a sense, she’s been everywhere. The look in her eyes is unmistakably familiar to anyone who’s shared in the experience. It’s the aftermath of a spiritual purging, a tsunami of catharsis wrapped up in revelation. It’s a sensation of such complete and total surrender that you could mistake it for a sort of cheerful nihilism if everything wasn’t pulsating with so much meaning. You could call it a look of resignation, but not of defeat.

“Death is as easy as crossing the street,” she’ll later tell me, describing what she’s learned in this moment. Her therapist and his assistant sit in armchairs across from her. Glenn, her husband of more than 30 years, is on the couch beside her, his eyes adoringly locked on hers as he hangs on her every word.

“I don’t even know where to start,” she begins, her voice choked with relief. “I’m done. I’m done with the crying. There’s nothing to be sad about anymore.” As if on cue, a tear leaks

out of her left eye and slides down her cheek, still flushed crimson by the force of the emotional release. Somehow, that single tear is more proof of her words than a contradiction.

If there’s a climax to be had in the film, DOSED: The Trip of a Lifetime, this is it, though there’s no spoiler within the recounting. If anything, the spoiler is this: Five and a half years after she was

diagnosed with colon cancer and told she had less than a year to live, Laurie Brooks is still here—and she’s more alive than ever.

The film, which premiered in 2022 and features an all-star cast of plant medicine luminaries that includes Paul Stamets, Gabor Mate and Dennis McKenna, documents Laurie’s journey as she grapples with her own mortality in the face of a harrowing diagnosis and improbable recovery. A native resident of British Columbia, our protagonist was able to take advantage of Canada’s Special Access Program, which allows terminal patients access to psilocybin therapy on a case-by-case basis. As if to strike the perfect chord, the film also documents her adoption of a cannabis oil regimen to supplement her treatment. The results speak for themselves and have made Laurie, a mother of four and wife of a former evangelical pastor, an unexpected hero of the plant medicine movement.

“Cannabis has helped me in so many ways and not just the anti-cancer properties, but also laughing . . . I learned to laugh at cancer and my tumor because of when I was high.”

know about cancer,” she tells me. “And for me . . . I don’t want to think about that anymore. I still have cancer—I still have a tumor, actually. His name is Frank. Frank is a bad boyfriend who just won’t leave. I’ve told him to sit down and shut up and he has. So, I don’t know; I’m just kind of past that now. But we go to screenings for the movie and that’s all people want to know about is the cannabis regimen, or . . . my cancer, and it’s like, you guys are missing the point. The way I got through cancer was by finding myself again—and mushrooms definitely helped me do that.”

But for Laurie, as much as the movie has opened doors and created opportunities by which she can make a lasting difference on her terms, it represents what is already behind her. It’s the prologue; the real journey begins now.

“Everybody wants to

The first thing I notice about her as we open the conversation is the electricity of her presence that’s tangible even over a Zoom call. There’s an unforced joy in her voice, an effervescence that seems to punctuate her thoughts, which never seem to lack, nor fail to illuminate a deeper truth. She speaks with clarity and authority, but also with casual ease—and surprising candor.

“Cannabis has helped me in so many ways,” she continues, “and not just the anti-cancer properties, but also

laughing . . . I learned to laugh at cancer and my tumor because of when I was high—when I was stoned at night,” she lets out an unforced giggle before continuing. “I entertained myself by thinking of other ways to die that were more entertaining than cancer. My favorite right now is getting hit by a piece of space junk falling from the sky . . . Cancer is so blasé.”

Her laughter is contagious, and I find myself joining her, despite the bleakness of the subject matter. But that’s the thing: For her, there is nothing bleak about it. She’s already faced death; she’s made her peace with it, and she’s still here to tell the tale. I point this out to her and ask her if it makes her feel immortal.

She smiles and gives me an affirming nod. “I feel like I might have superpowers.”

Her cancer now in remission, Laurie is moving forward—heart in the moment, eyes on the future. With the knowledge and acceptance of the fact that her prognosis could change at any time, she’s purposed to live deliberately, embracing her most authentic self without apology.

“I feel so much more myself now,” she confirms, her effusive smile beaming through the monitor, “I’m confident in who I am and not afraid to show it; I’m just being more authentic and letting

people see who I am. The feeling of being seen and heard is amazing.”

That authenticity means making the choices that are best for her, despite the expectations of some of the members of her newfound audience. There is a general assumption that the choice between conventional and plant medicine is a binary one, but Laurie doesn’t see the world in ones and zeroes. It was psilocybin therapy— not DMT.

“I haven’t gone off my chemo meds,” she posits with a shrug, “and that’s what people don’t get. I’m not into all this green juice in Mexico or whatever . . . I still work with the doctors—I still have an oncologist that I talk to all the time. I go in for scans and do my chemo regimen, and I’m not going to let that go. These,” she adds, referring to mushrooms and cannabis, “are addins. I still believe in science.”
