Divorce Proceedings
• Do I need to wait one year? i. No: you can file for divorces as soon as you decide to permanently separate from your spouse. It can be the next day. • Why would I file sooner? i. You may need immediate remedies from the court such as a parenting/custody order and an order for child or spousal support. ii. You may require an order for exclusive possession of the home and for the other party to move out. • How do I start a divorce? i. You must file and SERVE on the other party a Claim for Divorce. (1) The documents must be personally served within one year of filing (2) the documents must be served by someone other than the claimant ii. You can go online to find documents for Alberta but unless there are no children and no property, I recommend that you HIRE A LAWYER to assist you in the divorce. • When can I finalize the divorce? How long does a divorce take? i. Although you can file right away, you cannot finalize the divorce until you have been separated for ONE YEAR (hence the earlier mis-conception), unless you are claiming grounds of cruelty or adultery. ii. Once the court receives the final sworn documents, it may still take 2 months or more for a judge to sign your divorce. iii. There is a one month appeal period after the divorce is granted which must lapse before you can remarry. • Do I need to attend court? i. No - most divorces proceed as a ‘desk divorce’ where the papers cross a judge’s desk and are signed in the absence of the parties or their counsel.
