STPS APPROVES THE FINAL VERSION OF NOM FOR TELEWORK, THESE ARE THE MAIN CHANGES

The labor authorities have ready the Telework Standard (NOM-037) that will regulate this employment modality in the country. The National Advisory Committee for the Standardization of Occupational Safety and Health approved last Friday the changes to the project published in July last year after the public consultation period to which it was submitted.

Among the adjustments endorsed by the working group that collaborated with the Ministry of Labor and Social Welfare (STPS) in the design of the standard, the following stand out:

• The Safety and Health Commission of the companies acquires a more active role by being in charge of verifying that the applicant or teleworker has the appropriate conditions for this modality.

• It is recognized that employees may propose the places where they will telework and agree on them with the employer, as long as they are fixed spaces and have basic conditions.

• It establishes the obligation to have a second checklist to be applied periodically and ensure the continuity of health and safety conditions in which teleworking is performed.

• The measures to prevent psychosocial risks in the modality are extended by incorporating breaks and rest times during the working day.

• Within the measures of gender perspective, it is annexed in the policy of teleworking as a basic element that women have time for breastfeeding.

• It is incorporated in the employer’s obligations to guarantee the confidentiality of the list of workers who will be under the modality of remote work.

• The obligation of the worker to inform the employer

in advance of any temporary or permanent change of domicile to the agreed workspace is maintained, but now the basic elements of the writing are established: “Date of elaboration; the name of the worker in the modality of Telework that elaborates the writing; the date of occurrence, and the description of the change of domicile”.

• The concept of work accident is expanded to include those that occur during the commute to/ between the agreed spaces or to the work center during or because of work.

NOM-037 will retain the verification mechanism to corroborate the safety and health conditions of the space where remote work will be performed, as well as the obligation of employers to have a telework policy. Although the modifications make the implementation more flexible by changing concepts and the wording of some points.

The NOM of Telework is the instrument that will regulate the safety and health conditions in this type

of employment, its objective is to avoid illnesses and accidents among the people who perform their activities under this figure.

“The elementary conditions and specific preventive measures to be adopted in the workplaces determined by common agreement between employers and teleworkers, in order to prevent events that endanger their physical integrity, life and health through a regulation on safety and health at work in line with technological advances and with a preventive approach to occupational diseases and accidents at work,” said the STPS in the draft submitted for public consultation in July last year.

The final version of NOM-037 maintains the possibility for the Safety and Hygiene Commission to visit the workspace proposed by the worker to verify the conditions, as long as the employee’s consent is obtained. Otherwise, the alternative will be the self-evaluation that the remote worker can do.

TESLA WOULD BE OPERATING IN NUEVO LEON BY THE END OF THE YEAR OR EARLY 2024

The Groundbreaking Ceremony of Tesla’s gigafactory in Nuevo Leon, could be laid in a month and a half and it should be operational by the end of this year or early 2024, said the state’s governor, Samuel Garcia, on Monday.

In an interview with EFE in his offices at the Government Palace in Monterrey, Garcia informed that he is only waiting for federal permits to begin construction of the project.

The gigafactory will be located in the municipality of Santa Catarina, some 17 kilometers from Monterrey, and will represent an initial investment of US$5 billion, in addition to generating some 35,000 direct and indirect jobs.

“For the first stone to be laid, we need all the permits to be ready, the local permits have already been approved, the federal permits are missing, so we are just waiting for Semarnat (Ministry of the Environment and Natural Resources) to give the approval and then we can start”, said Garcia.

He specified that this process, according to the law, could take approximately a month and a half, so in that time Tesla’s CEO, Elon Musk could be in Nuevo Leon for the start-up of the project.

On Wednesday of last week, during the celebration of the “Investor Day 2023” held in Austin (Texas, USA) the magnate confirmed the installation of Tesla in the north of Mexico.

“In order not to speculate on the terms (the time in which it will be already in operations) the Shanghai plant was a replica of Austin: the same process, the same plant, the same model and they did it in nine months. Here it is much more ambitious, they are talking about a plant that with a new assembly system will create a new model that is the most economical in the world”, he explained.

He added that, for now, there is no certain date for the Nuevo Leon assembly plant to start operations, but it could be by the end of 2023 or the beginning of 2024.

The plant will be Tesla’s first automobile production plant in Latin America and the fifth in the world, after those already operating in Fremont and Austin (United States), Shanghai (China), and Berlin (Germany).

• Peso: President Lopez Obrador highlighted the peso’s performance against the dollar, which in recent days has even traded below $18.00.

• Economic indicators: President Lopez Obrador presented various economic indicators for the country. In summary, as of February 2023, Mexico has 21.6 million jobs reported in the IMSS and is expected to reach historic figures in March. The average monthly salary of workers enrolled in social security is $15,913. The Mexican currency has experienced an appreciation of more than 10%, making it the second strongest currency after the dollar. In addition, remittances are up 12% over the previous year, and record foreign direct investment has been seen due to the merger of Televisa and Univision, the restructuring of AeroMexico and other companies. The economy has emerged from the 8.2% decline caused by the pandemic and is expected to grow by 3% this year. Although inflation is on a downward trend, an anti-inflation plan is being implemented with Latin American countries to combat food inflation. The minimum wage has been increased by 90% over 2018, and the Mexican Stock Exchange has experienced a 26% increase. • Tesla Investment: President Lopez Obrador mentioned that his conversation with Elon Musk was very good, and they talked about other topics such as the development of the Isthmus of Tehuantepec, the installation of a battery company in Hidalgo, the Sonora Plan and the Mayan Train. The President extended an invitation to Musk to visit Sonora and see the solar energy plant, in addition to highlighting that the subsidies for battery plants and electric cars in the United States cannot be implemented in Mexico due to the cost. Regarding foreign participation in lithium investment, Lopez Obrador informed that they are working on the research and separation of lithium from clay, and that CONACyT is in charge of this task. He also confirmed that lithium belongs to the nation and that there may be agreements to sell the raw material.

BILATERAL RELATION

• GM corn consultations: The President of Mexico has proposed that an analysis be conducted between a qualified U.S. agency and COFEPRIS to determine whether GM corn is harmful to health. Although GM corn is not allowed to be consumed in Mexico, an agreement is being sought before going to the panel. Mexico is self-sufficient in white corn for human consumption and has many native corn varieties that must be protected. If there is no understanding, it will go to the panel to guarantee the health of Mexicans. Minister Buenrostro will attend the visit of U.S. trade representatives.

• Kidnapping of U.S. citizens: The governor of Tamaulipas reported that U.S. citizens were found, two of them deceased, and the president criticized the lack of media attention to violence against Mexicans in the United States. It was mentioned that President Biden offered to respect Mexico’s sovereignty, which was appreciated. Also mentioned was a case of a U.S. pharmaceutical company that created an addictive drug that was approved by the U.S. health regulatory agency and the lack of control of arms trafficking in the U.S., with senators receiving money from arms factories for their campaigns.

• Relationship with the United States: The President emphasized that he has a good relationship with Ambassador Ken Salazar, who is respectful of Mexico’s sovereignty. He announced that on March 19, legislators from the United States will come and make a joint tour and on March 21, Secretary John Kerry will come. This March 9 will receive the visit of the person in charge of the White House to face the fentanyl issue.

POLITICAL AGENDA

• Autonomous Agencies: The President reiterated that he will leave a list of pending reforms; he stated that due to the lack of time he has to concentrate on concluding works and welfare programs; but other reforms are needed, such as in the judiciary, since it is a bastion of corruption. He added that a reform is needed to eliminate all the agencies that were created in the era of corruption; he added that the monopolies are the ones that manage this autonomous body, or so-called preponderant agents. They are excessive positions of civil servants; they are life scholarships in different sectors. By cutting services such as the savings bank and private medical services for public servants, savings of 15,000 million pesos were achieved.

• Insults to authority: Upon being informed that in Veracruz there are 800 people for this alleged crime, despite the fact that a year ago the Court

invalidated this crime, the Federal President stated that all crimes that have to do with insults to authority must be eliminated. Today or tomorrow an initiative to modify Article 33 of the Constitution will be sent; before, anyone who was considered a foreigner and questioned the government was deported, and this will be eliminated.

• Electoral Reform “Plan B”: The President of Mexico, Lopez Obrador, defended the electoral reform that seeks to have honest judges and advisors and reduce expenses. He rejected the idea that certain officials, like Edmundo Jacobo Molina, maintained privileges at the expense of the treasury and accused them of being part of the neoliberal regime. The Secretary of Government, Adan Augusto Lopez, explained that the reform consolidates the power to resolve appeals, eliminates privileges for INE staff, reduces the number of board members, and facilitates voting for Mexicans abroad. The President accused the INE of having a “golden bureaucracy” with three types of privileges and questioned the use of opaque trusts by the INE and the judiciary. He denied that the reform weakens citizen participation and suggested that the media, sometimes owned by oligarchs, can be a problem. The President stated that the Supreme Court will determine if any articles of the reform violate political-electoral rights.

• Genaro Garcia Luna Case: When asked if a specific investigation will be opened on former President Felipe Calderon, the President pointed out that the Attorney General’s Office is investigating Garcia Luna and his group, and that there is also a civil complaint in Florida for the assets that are presumed to be the result of corruption. However, he pointed out that the government is not going to file a complaint against former presidents, since

• Electoral Reform: President Lopez Obrador stated that the Electoral Law does not affect INE’s operation and that the lack of approval of the constitutional reform means that 25 billion pesos will continue to be allocated to elections in Mexico. Furthermore, he expressed his satisfaction with the reforms that have been promoted during his administration, such as the elevation to constitutional rank of several public policies and the fight against corruption. Regarding the constitutional reform on water, the president pointed out that it is not necessary and that with the National Water Law and legal decrees the problem of water use in Mexico can be solved.

• Welfare Bank: The head of the agency, Victor Manuel Lamoyi, commented that they have an expansion plan of 2,700 branches, at the moment they have a coverage of 1,502 branches throughout the country in 1,207 localities and 997 municipalities in the 32 entities.

INFRASTRUCTURE

• AIFA: In response to the question about the train that would go from Buenavista to AIFA, he commented that he receives a report every 15 days. Progress is being made and there is no longer a right-of-way problem. It will be a stretch that will take 45 minutes. • Tren Maya: The head of FONATUR, Javier May Rodriguez, assures that the Tren Maya is environmentally friendly, with the use of low sulfur diesel, reforestation and the construction of viaducts to protect the cenotes and subway rivers. In addition, 44% of the road is electrified with clean energy. On the other hand, the Head of SEMARNAT, Ma. Luisa Albores Gonzalez, highlights the final authorizations and public consultations carried out for the environmental impact statements, as well as the creation of new protected areas and the mitigation of climate change with the Sembrando Vida program. Finally, the Head of the Welfare Secretariat, Ariadna Montiel Reyes, mentions the Welfare programs that will benefit more than 3 million people in the area of the Mayan Train, including senior citizens, people with disabilities and scholarships, and the opening of branches of the Welfare Bank and the benefit to 271 municipalities with the contribution fund. The inauguration of the Mayan Train is scheduled for December 2023, 290 days away.

• Internet for Wellbeing: Emiliano Calderon pointed out that it consists of two telecommunications services, the first is to provide free internet in various spaces. This public service has 65,152 sites in 19,529 remote locations and poor populations and the monthly average is 1,680 connections. This year’s goal is to reach 100,000 sites covering 27,672 localities. On the other hand, the cellular telephony program will deploy 3,600 antennas and there are already 7,500 antennas installed covering 91.9% of the population. The goal will be to reach 94% of the population, installing 2,601 antennas.

SECURITY

• Private security: In previous governments, private security services grew with the help of the government and there is suspicion of corruption in the contracts, even SEGOB hired private police. However, work is being done to create the Federal Protection Police so that the government will be in charge of the surveillance of public offices. The hiring and training of personnel to guarantee the security of banks and public offices was authorized. In the case of Banco de Bienestar, which will have 2,750 branches by mid-year, it is important to guarantee their security. Banco Azteca currently has 1,900 branches.

• Organized crime: The alleged bill in the U.S. Congress to classify Mexican cartels as terrorist groups and the Republican Party’s strategy to interfere in Mexico is considered propaganda by the Mexican government. The U.S. State Department presented its 2021 terrorism report to Congress and assured that there are no Mexican links with terrorist groups and that cooperation between both governments is good. Mexico is an independent and sovereign country and rejects the idea that other countries want to use military force to intervene in its public life. Fentanyl is an issue of concern for both countries, but drug abuse prevention counseling must also be addressed. The government will continue to insist on an outreach campaign in all media about the harm caused by drugs. BAJA CALIFORNIA

Last week a meeting was held attended by business chambers and delegates from the German Embassy in Mexico, with the aim of learning about industrial capacities and exploring investment opportunities for German companies.

The labor market in Baja California generated 5,730 new formal jobs during February 2023, according to the Mexican Institute of Social Security (IMSS). The behavior of employment in the State by sector was as follows: Transformation Industry created 3 thousand 272, commerce created 657, social services created 631, construction industry created 530.

SONORA

Last week the presentation of the Sonora Plan was held in Puerto Peñasco, which will integrate the largest solar power plant in Latin America and the seventh in the world. GUANAJUATO

Guanajuato’s Governor delivers his 5th government report “I will deliver a state with better security, it is not a completed task, it is a continuous work, we have made our maximum effort in terms of security,” he said to those attending the report at the Bicentennial Park. The Governor said that the population can be sure that Guanajuato is brave and does not bow down to crime. In Guanajuato the incidence of crime has decreased, intentional homicide by 6.70 percent, femicide by 30 percent, bank robbery by 75 percent, home robbery by 4.94 percent, and kidnapping by 27.27 percent, he said in the report. He highlighted that Guanajuato has the bestpaid State Police in Mexico, each element has a net salary of 20,717 pesos per month. Diego Sinhue highlighted in the report that they surpassed the goal of granting 600 million pesos to the State Fund for the Strengthening of Municipal Public Security, reaching 800 million pesos. QUERETARO

Microsoft promotes the digitalization of SMEs in the state due to its developments in artificial intelligence, augmented reality, and its basic software, said the state’s Secretary of Sustainable Development, Marco del Prete Tercero. In the fourth quarter of 2022, Mexico City ranked among the most dynamic states in terms of attracting tourism capital, which could ensure a more dynamic 2023, according to local authorities. According to the federal Ministry of Tourism (SECTUR), from October to December of last year, a Foreign Direct Tourism Investment (FDIT) of 18.4 million dollars was reported in the city, that is, 9.9% of the total in the country. Taiwanese company Wire and Cable celebrated its Groundbreaking Ceremony, for a new manufacturing facility in Villa de Reyes, San Luis Potosi, with a $10 million dollar investment. This project is expected to create 1000 job opportunities in the region.

We Build, an Italian Real Estate company, has invested $30 million dollars to inaugurate a new project in Queretaro, generating 500 job opportunities in the region.

Ideal Contact Center will invest $3.5 million dollars to establish a telemarketing center in Torreon, Coahuila, creating 700 new job opportunities in the region.

GRUPO INDUSTRIAL MONCLOVA

Grupo Industrial Monclova, a Mexican company, has invested $15 million dollars to inaugurate a new fertilizer plant in Monclova, Coahuila, generating 200 new job opportunities.

MKDC

South Korean company, MKDC, has invested $70 million dollars to inaugurate an automotive manufacturing facility in Ramos Arizpe, Coahuila, creating 600 new job opportunities.

TESLA

Tesla announced their plan to invest in a new Gigafactory, the biggest facility in the world, in Santa Catarina, Nuevo Leon. With a $4.5 billion dollars investment, it is planned to produce 1 million electric cars per year.

NATIONAL

HOME DEPOT

Home Depot, the U.S. home goods retailer, has announced an investment of $185 million dollars in Mexico. This is a national plan to open their 150th store in the country. The number of jobs that will be created hadn’t been disclosed yet.
