STPS APPROVES THE FINAL VERSION OF NOM FOR TELEWORK, THESE ARE THE MAIN CHANGES

The labor authorities have ready the Telework Standard (NOM-037) that will regulate this employment modality in the country. The National Advisory Committee for the Standardization of Occupational Safety and Health approved last Friday the changes to the project published in July last year after the public consultation period to which it was submitted.

Among the adjustments endorsed by the working group that collaborated with the Ministry of Labor and Social Welfare (STPS) in the design of the standard, the following stand out:

• The Safety and Health Commission of the companies acquires a more active role by being in charge of verifying that the applicant or teleworker has the appropriate conditions for this modality.

• It is recognized that employees may propose the places where they will telework and agree on them with the employer, as long as they are fixed spaces and have basic conditions.

• It establishes the obligation to have a second checklist to be applied periodically and ensure the continuity of health and safety conditions in which teleworking is performed.

• The measures to prevent psychosocial risks in the modality are extended by incorporating breaks and rest times during the working day.

• Within the measures of gender perspective, it is annexed in the policy of teleworking as a basic element that women have time for breastfeeding.

• It is incorporated in the employer’s obligations to guarantee the confidentiality of the list of workers who will be under the modality of remote work.

• The obligation of the worker to inform the employer
