I have many, but one I will mention here is the Temecula Valley Cheese Company. Shawna and Miles gave this old ragamuffin his first gig down here (as a solo artist) so I will forever be indebted to them for that. Plus, their Irish Tipperary Cheese is to die for. (When I first bought it I thought it was called “Irish Temporary,” so naturally I bought up as much of it as I could) Who is your favorite local musician/band? Why? Will I get fired and lose this amazing income stream if I don’t say Joe Gillaspie??? Actually there are several, including Joe and his folky ballads. Mickie Arnett Band for a beer drinking good time (I could probably get into a brawl and still have fun if Mickie is playing), Tralain Roslyn for her beautiful voice, genuineness, and enthusiasm, and Shoot4Tuesday for just how COOL Elisha and the whole band is in general. Usually, there’s at least one borderline !!@$!!!hole in every band, but NOT this one. I have made them aware that if my solo career doesn’t pan out, they are required to adopt me (Kinda the way Stevie Nicks feels about Tom Petty). What more do you want the Echo and Buzz readers to know about you?

What is your earliest musical memory? Probably when I tried to write a song at 3:00 am one time...that was pretty early...very brutal. Just kidding. I can remember my Uncle trying to record me singing Billy Joel’s “My Life” onto a Maxell cassette tape when the record first came out in the late 70’s. (Before Bosom Buddies came out). I mumbled most of the words up until the chorus where shouted “my life!!!!!” I still have the tape for when I achieve stardom.

Ok...so here’s my shameless plug since Joe just inadvertently opened the door. I am a Singer/Songwriter, I write original music and play at many of the local venues. I am also a foodie, and spend much of my time driving around aimlessly in search of good hole in the wall places to eat. I could subsist off Chinese take out every day for the rest of my life. That is all.

What music is on your (choose one) phone, mp3 player, cd player, turntable, cassette deck or 8 track player right now? Honestly, my own songs, but that’s only because I need to learn a couple of dozen of them so they are performance ready. I write songs much faster than I can remember them. Otherwise it would probably be Abbey Road or Rubber Soul in my 8 track. If you could have any superhero power what would it be and why? Oh...easy...It would be the ability to make others see what a genius I am. Just kidding. Honestly, I would love to have the ability to make others see the potential they have in themselves and then act upon it! What’s your favorite thing about Echo and Buzz? I’m from L.A. originally, so I love fact that Echo and Buzz gives us a sense of a musical community since I consider where we live to be a small town. I can find out who’s playing locally any given day and each month I get to find out more personal stuff about the artists. All we need now is a gossip column so I can find out all their dirty laundry. What qualifies you to write for Echo and Buzz? Aside from the fact that I need my massive ego constantly fed through recognition, validation, and “attaboys!,” I happen to be a singer/songwriter and I used to write movie and music reviews for my college newspaper. What do you write about or contribute to Echo and Buzz? I just started recently so at this point I have only written only one article about somebody else also who writes for the paper. Maybe he’ll write one about me so it will be like some sort of gigantic reciprocated journalistic hug. Aside from this, I look forward to writing about other local musicians in the near future. How’s the pay at Echo and Buzz? Fantastic. My school debt is now payed off, I eat wherever I want (Alberto’s) and I’m about to purchase my first yacht! Thanks Joe :). Muffy and the girls have

Who is your favorite local musician/band? Why? Too many to list. Many of them are my friends. I cannot single anyone out because their styles are all so different. The quality and originality of their work is was draws me in. What more do you want the Echo and Buzz readers to know about you? Hmmmmm...Not my scene to talk myself up. I love music; it’s a huge part of my life. Photography is my other passion. That I can combine the two is such a gift.

On my iPhone: You name it, it’s on my phone. A lot of independent and local artists that I know. Buddy Guy, John Mayer, TOOL, Bach, Mozart, Chopin…the list isn’t endless, but it’s certainly diverse. If you could have any superhero power what would it be and why? The power to heal. I guess I’d want that because I’m a nurse. That’s what I do. But It would be cool to do it on a bigger level. What’s your favorite thing about Echo and Buzz? The spotlight on local, original artists.

What qualifies you to write for Echo and Buzz? My passion for music, because, really, that’s what it’s all about. I love hearing new sound. It’s just a wonderful gift to have so many supremely talented artists in our own backyard. What do you write about or contribute to Echo and Buzz? I’m primarily a photographer. I cover the events from the visual side of things. How’s the pay at Echo and Buzz? N/A What’s your favorite local music venue? Why? Wow, this a is a tough one. I’d have to say Franklin’s Cove and Baily’s. They are huge supporters of the music scene in The Valley and they have stages and lighting.

I’m a Mom first, and a Musician second. My world is my Family and I’m very fortunate to have the best very musical partner and Father to my children. Photo property of Malissa Miller.

What is your earliest musical memory? From an early age, I dreamt of singing on a huge platform. I never imagined anything less than a sea of people or maybe the voice on an animated Disney movie. I entertained thoughts of being an actress and being “famous” although I’m not exactly sure I even understood what that meant. Somehow I knew that who ever I was meant to love would be a part of all of that. I always dreamt of playing an instrument and literally marching to the beat of my own drum. I think my first musical love was Elvis.

What’s your favorite thing about Echo and Buzz?

Who is your favorite local musician/ band? Why?

My favorite thing about Echo and Buzz is that it’s exposing the community to the musical talent and passion that is right here in our town. But, in all honesty, I love that I get to write. It’s always been on my “bucket list” and I’ve always thought it would be a fun thing to do

I love me some JD Priest. I’ve always admired his musicianship as a player but very recently have connected with him as a friend and I love what he does. Although he is a paid musician, he doesn’t do it for the money. I’ve jammed with this guy in my living room and I think every person who knows him knows he is the real deal. To me, that’s enviable.

What qualifies you to write for Echo and Buzz?

What music is on your (choose one) I have absolutely NO qualifications to write for a phone, mp3 player, cd player, turntable, magazine. It’s just one of those things I knew I’d cassette deck or 8 track player right now? probably be good at. I’m one of those people that I like to listen to whatever suits my mood. If I’m working out, I indulge in my closeted love for R&B (think Ne-Yo, Chris Brown, Trey Songz, The Weekend). But if I’m looking to get inspired, it’s Allison Krauss, The Wailin’ Jenny’s, or Ani DiFranco. Sometimes, while the kids are at school and I’m temporarily relieved of my duty to listen to TwentyOne Pilots non-stop, I belt out Whitney or Mariah, or Christina at the top of my lungs.

If you could have any superhero power what would it be and why? If I could choose a “superpower” it would be to talk to the dead. I think there are so many people I would love to have a conversation with. Beethoven would blow my mind like Einstein, Edison, Tesla, and then my obvious influences. I’d really love to talk to family members who have passed and I am really curious about the unknown. I have an affinity to mysticism and spirituality and God himself. Often times I think I’m far more concerned with these things than the here and now.

just won’t even try to pursue things I know I have no business pursuing. Writing seems to come quite naturally to me and it always had. So rather than put all my eggs in several baskets, I stick to what I feel confident in my ability to do.

What do you write about or contribute to Echo and Buzz? I write whatever Joe lets or asks me to write. I’m up for a challenge and according to Joe I “work better under pressure.” So naturally, I often get distracted and procrastinate and get it done at the very last minute. I don’t mean to be like that, but I think he may be on to something.

What more do you want the Echo and Buzz readers to know about you? I’m a Mom first, and a Musician second. My world is my Family and I’m very fortunate to have the best very musical partner and Father to my children in this world to attack life with. No matter what, they are my rock and it’s because of them I’m able to roll. So if I seem pre-occupied at times, I am. But, I am honest to a fault, and loving like no other. I tend to go after what I want and I’m a bit intense for most people. So, although you might find me extrovert in public, I’m somewhat of a recluse. My pet peeve is saying you’ll be somewhere or do something and you flake. Once you do that to me, you’re pretty much not in my “in” crowd…but, I think other than that I’m easy to get along with. Very outspoken and headstrong, but I’m harmless.

What’s your favorite local music venue? Why? My favorite local music venue is absolutely hands down FALLBROOK BREWING CO!!!!!!! Not only is Chuck a pleasure to play for, but he’s all about family and our kids can come and make musical memories with us. The community of Fallbrook is an amazing listening crowd and when things are so relaxed, it’s easy for us to play our best. I hat the feeling of “putting on a show” just kills the mood and makes it really hard to transcend the audience and tap into that “thing” that people are inevitably drawn to

Mental illness killed some of the best musicians I have known. I am not talking about Kurt Cobain or Michael Hutchence. I am talking about people I know personally. I sat in their living rooms listening to them play. I watched as their symptoms came in like waves crashing the shoreline. Sometimes their mental illness incapacitated them, throwing them into a tunnel of darkness where there was no room for creativity. Other times music and songwriting were the vehicles that led them back to their version of recovery. The ones who died succumbed to their illness, either through suicide or poor health exacerbated by their struggle with the symptoms of their illness (people with mental illness die at much younger ages than people who are not affected). I have come to learn that music and “madness” are bedfellows that at times inspire greatness and at other times lead to destruction. Most often these two circumstances occur within the same person. And they are not alone. It is commonly reported that one in four adults has a mental illness in the United States. Of those with mental illness only forty percent seek or receive treatment. Those who go untreated then end up homeless, in jail or in locked institutions end up costing the country $100 billion per year. People with mental illnesses account for ninety percent of all suicides and there are about seven of those every hour in the U.S. And if all this is not sobering enough, here is what I think is the most sobering statistic: only twenty five percent of people who have a mental illness feel that they are treated with compassion by those around them. Look, I know true compassion (as opposed to pity) for something that is different, strange or crazy is difficult to muster, but it is the one thing each of

us can do to make the life of a person with mental illness a little better. So what does all this have to do with you, the Echo and Buzz reader? Well, what I learned from my friends was that music transcended the mental illness. When I had nothing else to connect with them about I could always talk about music or ask them to play a song for me. Suddenly the differences between us were gone, as were the awkward silences. My experience told me that music was a key to recovery, the key to compassion, and the key to mental health. And now there are professionals who espouse the connection between music and mental health for people experiencing mental illness, for you, and for me. Combining common wisdom and research, Reach Out Australia has published a list of benefits of music on mental health for all of us. 1. It helps you focus. That’s right, try listening to music with no lyrics and a tempo of at least sixty beats per minute (classical music is recommended) while studying for a test, or while preparing a work report. At this tempo, music has proven to increase your brain’s efficiency in processing information. 2. It allows you to express yourself. Many people have a hard time talking about their feelings or other important things but find the words in others’ lyrics or are better able to express themselves through writing their own songs. I remember reading an interview with Chris Cornell (Soundgarden) who said the reason happy songs rarely become hit is because no one has trouble expressing happiness but they connect with the dark lyrics that express the feelings they cannot find a way to express.

3. It leads to social connection. Much like my interactions with the friends mentioned earlier, music was a point of connection, a source of agreement, and a source of debate. In other words, it was a source of a meaningful relationship among friends. 4. It fosters creativity. Creativity creates positive feeling of self and others. For some, like my friends, creativity helped them get through difficult times. 5. It helps you relax. They say music calms the savage beast, and studies prove it. So put on some comfortable clothes and turn on some of the music you love and feel the tension disappear. 6. It motivates you. Avoiding those tedious household chores? Try putting in those ear-buds, playing your favorite song, and grabbing the broom. Getting started on cleaning the house has never been easier. You see? Simple. And you all knew it. Music is great. And now you know how to use it to improve your mental well-being and improve the well-being of those around you. More importantly, you now know how to use music to create compassion for those struggling with mental illness. A friend. A coworker. A relative. You. With the recent deaths of David Bowie and Prince, it has once more become a time for reflection on the generations of musicians and songs that defined entire eras. You’d be hard pressed to find even the youngest Millennials who don’t have some knowledge about the musical giants of the 50’s, 60’s, and so on. However, despite the ubiquitousness of names like The Beatles, Elvis, and Stevie Wonder, for many that’s as far as the knowledge goes; people miss out on just how many talented individuals have inspired what we listen to today, or how interconnected the musical world is as a whole. It’s a bond that transcends time, age groups, and is so intrinsic to anyone who calls themselves a musician that to not share this history with others would be a shocker. The David Paul Band is one band that excels in broadcasting genres and songs from across the entire musical spectrum to their crowd. David Paul — the eponymous leader of the cover band — has a goal of bringing the classics back into the spotlight. “I like to break people out of the mold of maybe what they’re used to hearing. People still hear the Beatles, but there’s

a lot more beyond that,” he said in a recent interview. “I just want to bring that back into the spotlight a little.” Don’t let this fool you into thinking that the band only covers songs from past generations or more obscure hits! They cover genres ranging from rock to jazz to even re-imagined pop songs. Nothing is off the table for the David Paul Band. David’s path began back in high school when the core trinity of his band started playing together: his brother Michael Rodriguez, his friend Chris Miranda, and himself. “Chris and I went to high school. We were in the high school jazz band together, then we started playing music outside of school,” David said as he recalled how the group started. “My brother [Michael]...he started playing [and] basically ever since he’s been playing he’s been playing with me.” With the trio founded in a link of close bonds and a love of music, the band’s groundwork was already laid for when they officially came together years later. David became a “hired guitar player” that worked with multiple bands all around the area, a free-flow style of teaming up

with others that would lend itself to how the David Paul Band operates. While the central core of the group will always be David and his “lifelong musical partners,” they have a number of fellow artists that fill in any role. “It’s like a community we have going. Where whoever can do it,” he said, when referring to performances. Life seldom adheres to any schedule, so the more fluid nature of David’s band allows them to play very actively around the area without having to handicap themselves due to conflicts in date or time. Someone has to step out for the day and can’t play? Call up a friendly neighborhood musician! It has lead to some interesting team-ups, and also built relations throughout So Cal. While every artist has a fundamental grasp on the names and faces in each area, fostering interpersonal relations among musicians is of paramount importance to David, and it is this camaraderie among both the core group and friends that join them for performances that best exemplifies their commitment to cooperation.

as he enjoys covers, David loves to write his own tunes. His new record is slated to come out roughly in July of this year, featuring original work composed by himself. Considering the long history of music that he draws from, the songs are certain to captivate. As for plans for the future and goals to reach? There are always new heights to climb. “It sort of develops and changes as you continue; like when I started, there was no grand goal. It was just music for music’s sake. I just wanted to keep reaching a higher level for myself,” he said when asked about what music is to him and where he wants to travel with it. Playing roughly 150 performances each year, 2016 is proving to be the busiest yet; as of this writing, David’s band is just completing a continuous set of sessions at the Pala casino. This year they could well go beyond the 150 average. Which, for David, is another chance to captivate others with outstanding covers from the past and present.

Jesse Moreno, owner and operator of Temecula Boxing, was kind enough to allow us to use his gym to take our staff picture for last month’s Echo and Buzz (Remember the super-models gracing the cover of that issue?). I had the opportunity catch up with Jesse and inquire as to the nuts and bolts of what he does there, as well as his motivation for starting a boxing gym. Jesse is originally from East L.A., and he say’s being an inner city native had a huge impact on him. “I grew up in an area where the police had a lot of special programs to help keep kids away from crime. They keep you busy. I learned boxing at a young age. One of the reasons I got my bachelors in Criminal Justice was because of these experiences” conveys Jesse. Oh, and while we’re on the subject of schooling, throw out any preconceived notions you hold about the level of education your typical boxing gym owner is supposed to have. I discovered that Jesse not only has a Bachelor’s degree, but a Master’s degree in Management, and will soon be going for his PHD. In addition, he is a former Probation Officer and a 20 year Veteran of the Navy. (So I feel really dumb now, and it’s obvious I wandered around aimlessly for at least 20 years of my life. How did he have time for all this?) Ironically, it was never Jesse’s intention to start a boxing gym. What started as a hobby helping to train some local neighborhood kids out of his garage quickly turned into something more. When the inevitable questioning came from his significant other at the time about “the amount of kids and cars arriving at their home,” he knew it was time for a different venue. Jesse now uses many people to train at Temecula Boxing, and they all have one thing in common. If you want to be a trainer you have to have professional fighting experience. Sorry. No exceptions (my hopes were dashed,

but I pressed on). Jesse believes that you cannot train properly on ANYTHING unless you’ve already done it. Therefore, everyone who teaches there has been a professional boxer at some point. When he took me around the gym, it was immediately apparent just how in depth their training methods are. Jesse emphasized the importance of tailoring the training to the specific needs and goals of each fighter, taking into account a variety of factors. Everything from who they are, when they are going to fight, their recuperation time, and levels of endurance are carefully considered before these brave souls embark upon their pugilistic journey. Does the training work, you ask? Yes it does, and thanks for asking. Jesse speaks proudly of the fact that his gym currently boasts four amateur fighters who should be turning pro by years end. He’s also big on allowing professional fighters who fly in to fight at Pechanga and other local venues to use his gym to train while they are in town. Temecula Boxing is a nonprofit organization, and is open to anybody that wants to learn. All ages are welcome. Currently, he has about 120 members. Starting at $68 a month it is very affordable if one is serious about learning. Jesse introduced me to a couple of his up and coming protégés, whom you see pictured above. Above, pictured from left to right are future stars Sebastian Gonzalez and Danny Andujo. Jesse is happy with what he’s achieved here. “I’ve taken the concepts of what I learned from my 20 years in the Navy, from growing up in the inner city, what I learned from my degrees and put them into our program,” he says. He likes where he’s at. He’s making a difference. Jesse echoes the sentiment that “If you love what you do, you never work a day in your life.” Let’s hope for our community’s sake, Jesse Moreno’s love for teaching the sport of boxing doesn’t fade for a long, long time.

I caught up with Jerod & Malissa from Dulaney and Co. recently to see what’s been happening in their world the past few months. They have been super busy! It seems they are having a great time balancing being amazing parents with getting to share their soulful mix of Americana/Folk/Bluegrass music with all of us. Over the past few months, opening for bands like Lukas Nelson and The Blues Travelers has helped them to develop their own sound and steer away from the “jam band” they had originally intended to be. They have also found a little “magic” collaborating with local musicians like JD Priest and Lee Koch and have some exciting shows lined up this summer. They are putting out some fantastic new material and hope to get into the studio soon and start recording songs for their first album. E&B: It’s been awhile since E&B has sat down with you and caught up. What’s been going on in your world? D&C: We have been really busy with raising our kids, but we make time for music whenever we can. We will always be parents first and we aim to teach our children that you can do anything you set your mind to. For us, we still have always felt music was our path individually and now together. E&B: I saw you open for The Blues Travelers at Monte De Oro and Lukas Nelson at Wiens Family Cellars last summer and both shows you were phenomenal. D&C: Thank you!! Thank you very much! We were in a really transitional place so hearing that it worked out is awesome! E&B: How did those shows shape what you are doing this year? Did they change the way you have been performing at all? Did they lead into anything else for you?

basically had to throw something together. We learned a lot and we really had to do something different. We weren’t the “jam band” that the original Dulaney and Co. set out to be. Luckily, we had more time to prepare for the show with Blues Traveler and were blessed to have had some amazing musicians with us that night. Since those shows we realized we had to really hone in on OUR SOUND. We wanted a more Bluegrass/Folk/Americana vibe and set out to accomplish that. E&B: Have you had any changes, additions to the band? I saw you playing with one of my favorite locals, JD Priest a few weeks ago. What’s up with that? D&C: We almost always have Mike Emory on bass, and Chad Dulaney on his handmade suitcase percussion kit. Recently, we began playing with JD Priest just for fun and it became a weekly thing. Now, we rehearse and have started playing shows with him. There’s definitely some magic there. We have plans to continue playing together and start co-writing. I guess it’s a little premature to say EXACTLY what’s going on, but we’d love to keep him as a permanent fixture. We’ve also reached out to some other local talent such as our friend Lee Koch. Hopefully, we are on to something and we can share that with you soon.

E&B: You have such busy lives with music, family, and work. How do you balance it all? D&C: I have no idea. Somehow, it works. E&B: How do you find the time and inspiration to write new material? D&C: Time is always a precious commodity, but it’s how you use it. So, for Malissa, it’s late at night while everyone is sleeping. For me, it’s sporadic moments when I’m able to grab the guitar like while I’m supervising the kids outside. As far as inspiration.. well, it just comes to me. Malissa is really emotional and expressive so if she doesn’t write SOMETHING all the time, she gets moody. E&B: Who’s been your musical inspiration lately? Who do you listen to every day? D&C: We love Chris Stapleton, Allison Krauss, Waylon Jenny’s Pandora Station, Sturgill Simpson... who knows. We listen to different stuff everyday. E&B: If you could see any band/singer dead or alive who would it be and why? D&C: Robert Johnson because we want to know if he really sold his soul to the devil.

E&B: I saw you posted some exciting news recently E&B: Anything else you want to share with us? about opening for The Bacon Brothers this summer. What are your upcoming projects/gigs? How did that happen? What are you looking forward to most about the concert? WOW! It’s hard to believe it is already time again! Seems like yesterday I first learned about the Temecula Valley Music Award’s. We were at Franklin’s Cove for an open mic when Tim Moyer suggested Caden enter his original song “Never.” And that was the start of an amazing journey, new friends, and new connections. A first for many things. The making of a music video, learning how to write a bio, creating business cards, entering the world of social media on a way different scale and for a different purpose…promoting my then 11 year old. It all seemed overwhelming. But not until Tim asked Caden to do a Showcase did it get to really be an adventure. With just one original song under his belt Caden was asked to write at least 2 more in order to qualify for the Showcase. And so it began. Songwriting cram sessions at Riffs Music with one of the best–Salvatore Spinelli. In the end we had 3 solid originals and added 2 cover songs for the showcase complete with our drummer Anthony Necerato and backup singer and guitarist Frankie Clark. It was a night to remember! We are so thankful for Tim Moyer for the opportunity he gives the Temecula Valley Musicians. Without this experience Caden would never have been pushed out of his comfort zone, it really allowed him to fast forward his music career and surround himself with some of the best in our area. At the same time giving something back to the local schools. April 1 was the Launch Party for the2016 TVMA’s. We found ourselves back at Franklin’s Cove for the celebration! The event started right on time complete with sponsors like KTM Motorcycles lining the sidewalks. Tim’s wife at the door readily handing out fliers and last year’s program.

He along with Makayla Phillips sang a few originals off Cadens new EP “Memories” Matt Stone winner of “Best Folk” was up next and Matt’s personally shone through as well as his brilliant writing style, Matt is actually a funny guy! Shae Givens winner of “Best Pop Artist” is a talent to watch for sure, beautiful vocals she played keyboard and sang her originals. Midnight Satellites a town and crowd favorite winner of last years “Best Rock” category of course brought the house down singing a few song off their new album “Past-PresenceFuture” my personal favorite of the evening Old School “The Band” was up next winner of last years “Best Cover” category…these guys are a blast to watch! Really fun they entertained the crowd with recognizable hits we all grew up with. And, closing out a great evening was local favorite “Faultline.”

Ask the guitar player...He’s a lawyer! Chris Whelton is the frontman and guitar player for The Barstow Prophets (who’s second CD will be released soon). He’s also an established local criminal defense attorney who has practiced law for 24 years. Chris represents adult and juvenile clients in all criminal courts in Riverside, San Diego and San Bernardino counties. After quizzing Chris on some lighter issues like medical marijuana and the DMV, we thought we’d ask the tough question: E&B: What is Megan’s Law and who is a “Sex Offender”? Chris: OK, this gets really heated really fast, because the statute covers terrible cases of true sexual violence, but it can also be triggered by sexual conduct which as a society we have historically accepted, although now made “illegal” by statute. The label lumps all the behavior together. Let me try to break it down. The Internet Web Site - Effective September 24, 2004, Penal Code section 290.46 required the Department of Justice to create this Web site on or before July 1, 2005. There are four categories of registered sex offenders for purposes of disclosure on the Megan’s Law Internet web site. HOME ADDRESS CATEGORY The conviction of certain sex offenses requires that the home address of the offender be posted, along with other information about the registrant. 290.46, subd. (b). CONDITIONAL HOME ADDRESS CATEGORY The conviction of other designated sex offenses, along with the conviction of any other registrable sex offense, requires that the home address be posted, along with other information about the registrant. 290.46, subd. (c). ZIP CODE CATEGORY Commission of certain other sex offenses requires that information about the offender, including his or her ZIP Code and other information, but not including the home address, be posted on the web site. 290.46, subd. (d). UNDISCLOSED CATEGORY Finally, there is a category of registered sex offenders that may not be displayed on the Internet web site. These are registrants who have been convicted of sex offenses not listed in the above three categories. Offenders in the undisclosed category must still register as sex offenders with local law enforcement agencies, and are known to law enforcement. E&B: Do the police know what the conviction was for and what do they do with the information? Chris: Local law enforcement agencies, under statutes defining the type and extent of notice allowed, may also notify their communities about the presence of designated registered sex offenders in their area. This is usually done

only when an offender is suspected of posing a risk to the public. Penal Code section 290.45. E&B: Who has to “register” and how do they do that? Chris: Initial Registration. Penal Code section 290 requires mandatory registration as a sex offender for persons convicted of the sex offenses listed in that section. §290(a) (2)(A)-(E). Even if the offense is not listed in section 290, the person may be ordered by a court to register as a sex offender if the criminal offense committed was sexually motivated. Section 290 applies automatically to the enumerated offenses, and imposes on each person convicted a lifelong obligation to register. The registrant must appear in person to register with the police department of the city in which he or she resides, or with the sheriff ’s department if he or she resides in an unincorporated area or city which has no police department. The person has five working days to register after release from custody or on probation, or after coming into, or changing his or her residence within, any city or county. Transient Registration. If the person has no residence address (is homeless), he or she must register within five working days after release from custody or on probation and, beginning January 1, 2005, no less than every 30 days thereafter, as a transient. Registration is with the law enforcement agency in whose jurisdiction the transient is physically present. Penal Code section 290, subd. (a)(1)(C). Campus Registration. A person who resides, or is living as a transient upon, or is enrolled at or employed by, a campus of the University of California, California State University, community college or other institution of higher learning must register with the campus police department, in addition to registering with the police or sheriff ’s department having jurisdiction over his or her residence. Penal Code section 290.01. Registration of Sex Offenders Who Come to School or Work in California. Students and employees who reside out of state but go to school or work in California must register as sex offenders here if they are required to register in their state of residence. Penal Code 290, subd. (a)(1)(G). An employee is defined as a person who is employed in California on a full or part-time basis, with or without compensation, for more than 14 days, or for an aggregate period exceeding 30 days in a calendar year. A student is defined as a person who is registered in an educational institution, as defined in Education Code section 22129, on a full or part-time basis. The student/ employee must register in the jurisdiction where he or she attends school or is employed. Moves. Registrants with residence addresses must notify the last registering agency in writing within five working days of moving,

and must re-register in person if the move is to a new jurisdiction. (Penal Code section 290, subds.(a), (f).) If a move makes a person homeless, he or she must register as a transient within 5 working days of leaving the residence address. Transients, who re-register no less than every 30 days, need not re-register upon changing their location unless to a destination outside the state, in which case the transient must give written notification of his move to the law enforcement agency in whose jurisdiction he or she was physically present before leaving the state, within five working days of leaving. Transients who move into a residence must register at that address within 5 working days of moving there. If the registrant does not know his or her new address out-of-state, the person must still give notice of the move within 5 working days of leaving, and must mail written notice later of the new address or location (if transient) within 5 working days of moving into the new residence. Penal Code section 290, subds. (a)(1)(C), (f). Updates. All registrants must update their registration annually, within five working days of their birthday. Penal Code section 290, subd. (a)(1)(D). Transient registrants must also update their registration no less than every 30 days, and sexually violent predator registrants must update no less than every 90 days. Penal Code section 290 subds. (a)(1)(C), (E). Out of State Sex Offenses. If a sex offender was convicted in another state, he or she is very likely to be required to register in California, and should register in accordance with the sex offender registration law. If the offender is not required to register in California, the Department of Justice will notify him or her of that assessment and terminate the registration. Registration At More Than One Residence. Registrants who regularly reside at more than one residence address must register at each address, regardless of the number of days or nights spent there. If the addresses are in different jurisdictions, the registrant must go to the law enforcement agency having jurisdiction over each address. Penal Code § 290, subd. (a)(1)(B). Juvenile Sex Offender Registration. Juveniles convicted of certain offenses are required to register as sex offenders upon release from the California Youth Authority. Penal Code §290, subd. (d)(1)-(3). However, registrants whose offenses were adjudicated in juvenile court cannot be publicly disclosed, either on the Internet web site or by public notification by a law enforcement agency. Name Changes. A registrant must inform the law enforcement agency with which he or she is currently registered of a name change within 5 working days. Penal Code § 290, subd. (f)(3). E&B: What if a person fails to register and walks away? Chris: Failure to register can either be charged as a misdemeanor or as a felony. E&B: Can registration ever end or be terminated? Chris: Sex offenders who successfully complete probation may apply to have the offense dismissed under Penal Code section 1203.4, but dismissal does not relieve the person from the duty to register as a sex offender. Penal Code § 290.1.Persons whose registrable sex offenses are nondisclosable to the public may obtain relief from the duty to register upon obtaining a certificate of rehabilitation. Penal Code §§ 290.5 and 290.4, subd. (a)(1). All others must obtain a governor’s pardon to obtain relief from the duty to register as a sex offender. A person is eligible to apply for a certificate of rehabilitation seven to ten years (depending on the registrable sex offense) after release from custody or on parole or probation, whichever is sooner. Certain registrable sex offenders are not eligible to obtain a certificate of rehabilitation. Penal Code §§ 4852.01 & 4852.03. E&B: Thanks Chris, I know that it is not a pleasant subject, but we appreciate the accurate information. Chris: These types of charges and law are life changing.
