Like everything else in my life the t-shirt that arrived in the mail that day was probably not ‘hip’ anymore. After all, it had been a couple years since I saw the shirt on some hipster walking out of a bar in the Hawthorne District of Portland. Maybe I should have left it for the hipsters but no other shirt could illustrate my ‘late to the party’ life story than one that simply stated “Whiskey and Yoga.” It was only a few years ago, when I was in my mid forties, that I began to appreciate Whiskey. And even fewer years ago did I have my first foray into yoga. I have to admit, though, I am much more passionate about and likely to indulge in whiskey than I am to do yoga. In fact, while wearing my shirt and contemplating a downward dog or a Maker’s Mark served neat, Pandora started to play “Here Comes a Regular” by The Replacements. The song about drowning your sorrows and your life drinking “a great big whiskey,” made me wonder what other songs about whiskey were in my past. I discovered there were many, and that true to my pattern I was always a bit behind. The first song about whiskey I remember singing along with was when I was about 10 years old. “Scotch and Soda” was a favorite of my parents’ from the Kingston Trio Greatest Hits album. Sung low and slow, the tone of the song belied the song’s assertions: “Scotch and soda, mud in your eye, baby, do I feel high; oh me, oh my, do I feel high.” The Kingston Trio released the song in 1958. Seventeen years later I would hear it for the first time not knowing that the song had been around much longer. The song’s history is a bit of a mystery though the story has a familiar name. Back in 1932 the parents of New York Mets star pitcher Tom Seaver heard the song while on their honeymoon. They had the performer write out the music and lyrics so they could take them home and remember it as their song. Dave Guard, a member of the Kingston

Trio heard the song while dating the Seaver’s daughter, and recorded it. The rest is history and no information about it’s origins has come to light.

used in several musicals in the 1920s and 1930s. In other words I was almost half a century late to this party. Better late than never, I guess.

Next, I remember sitting at the end of Stearn’s Wharf in Santa Barbara in 1986 with bait and hook in the water when a stranger with his own rod and reel came and asked, “Any bites?” I looked into the face of a man who had seen more than any man should at his age. As he left to fish on his own, my friend punched my arm and enthusiastically told me, “That’s George Thorogood, Dude!” I knew he was a musician but I was not sure I liked his music. So I bought a used cassette at a local store and fell in love with the song, “One Bourbon, One Scotch, One Beer.” Of course, this was released ten years earlier and my enthusiasm for the music was not matched by those friends who had been turned on to the music so many years ago. But that was OK with me, because Lonesome George and I could sing the bluesy riff together. Even later on I learned that the song was a cover of the original penned by Rudy Toombs in 1953. It was later made famous by John Lee Hooker in 1966. I still prefer the snarling rambling of George Thorogood when I enjoy a Laphroaig single malt Scotch.

As I was searching my memory for whiskey songs, I kept hearing the fragments of a Metallica song I used to hear and liked. “Whiskey in the Jar” was released in 2004 and I uncharacteristically become a fan of it almost immediately. So I felt pretty good about this one. On time to the party for once. I looked up the song to remember the lyrics and the tune and discovered that the song was actually a bigger hit in 1972 for Thin Lizzy, and it was first made popular in 1960 by The Dubliners. In fact the song is an Irish traditional song dating back to the 17th century! I was actually four centuries behind the times on this one! I am still a fan of the seemingly nonsensical chorus: “Musha ring dumba do dumb a da; whack for my daddy-o, whack for my daddy-o; there’s whiskey in the jar-o.” Who could argue with that?

This next song will probably seem cliche to you because you probably got The Doors the first time you heard them. Not me. Couldn’t stand to listen to them. Then one day, 25 years after it’s 1966 release, I found myself buying their first album, The Doors. I was sucked in by all the wonderful music and soulful vocals, and then there was the polka-like sounds of “Alabama Song (Whiskey Bar)” and its fatalistic lyrics, “For if we don’t find the next whiskey bar, I tell you we must die, I tell you we must die.” Recently, I was told that the song was actually not a Doors original. In fact it was written in 1925 and was

So, you see, though I only started drinking whiskey more recently, it has been in my music for a long time. And now that I think about it, maybe I am not behind in the game too much, after all, good whiskies age many years, perhaps as long as it took me to catch on to these songs. I think I will turn on “The Have Nots” by X (34 years old), pour myself a double Glenlivet (18 years old), and enjoy both on the patio with my dog, Daisy (56 in dog years). I think Daisy prefers downward dog over Jack Daniels.

The Shift is one of those bands that you can’t help smiling the whole time you’re listening. From their upbeat songs, positive vibrations, and enlightening aura, you can literally feel the love and unity they exude. Not only do they enjoy making their own music that is a meld of funk, folk, blues, and jazz, they are genuinely considerate people who have created a seriously grooving band and a movement that encourages members of the community to participate in their message of love and grace. They have taken it even further than their music by choosing to live an active and healthy lifestyle which includes founding and operating The Living Tea in Oceanside that brews Kombucha, a detoxifing fermented tea that offers a variety of health benefits. In addition to all of this, if they’re not busy making kombucha, or playing locally, you can find them hosting various fundraisers that benefit local organizations who uplift the community and its members regardless of trending digital divides. E&B: Give us the run down on how The Shift came to be. Have there been any major incidents that have profoundly made you who you are today? The Shift: Josh Weigel was playing college football in New York when his brother Bill Weigel, who just moved to Carlsbad, convinced him to move to sunny Southern California to start a band. After graduating

from Hofstra University Josh set out from “Coast to Coast” on a three month vacation that has yet to end to this very day. The Weigel Bros got right to collaborating on songs and jamming together in Bill’s beach-side house with like minded friends and family, honing their musical skills. The two of them eventually transformed their living room into a fully equipped jam room with all kinds of different instruments, a full drum kit, and all the big amplifiers one could want. After solidifying a few songs and gaining a little confidence, they set out most weekday nights to the North County San Diego open mic scene. The Weigel Bros played a dozen or so open mics between Carlsbad, Leucadia, Encinitas, and Oceanside playing songs they wrote together and incorporating melodies they each wrote independently before coming together as a band. Then in 2011, everything shifted when Josh Weigel and David Sias paths crossed while managing a team of salesmen for a corporate company. They became friends quickly while working this under paid, un-motivating, and unsatisfying sales job. One day Josh invited Dave to come to one of The Weigel Bros. open mic jams. Neither Josh nor Dave took the other too seriously when they agreed to jam on stage, but the combination of Dave’s quick hand percussion, Bill’s bluesy harmonica & guitar and Josh’s old dorm room ballads were both pleasing for the crowd and musically awakening for The Weigel

Bros. They barely knew each others songs, but there was this non-verbal communication between all three of them that was out of this world. The songs began to shift and form into these seemingly perfect arrangements highlighting all that they were as musicians at that point and it was magical for them. They would jam a new song, end the song together at the exact same time with no rehearsal, and just bust out in laughter on stage. All three had little to no idea what was being created in that instance. It was a release of all the nervous energy, of accepting the unknown, and momentarily forgetting that the next morning everyone had to go back to their own unfulfilling daily shift. It was in those moments, The Shift was conceived. With that energy, The Shift continues. Through love and community we all will endure! E&B: How do you describe your sound? What musical influences have helped to shape the band today? The Shift: We have always been a multigenre, original band with creative multiinstrumental musicians and a vision to progress our lives through our message and vibration. Our influences shift as each song highlights who is playing what instrument in that moment, but we strive for a soulful groovy vibe with folk, funk, blues Continued page 10

Talkin’ Country with Joe Lawing The first thing Joe Lawing did when I approached him in Old Town’s 1909 gastro pub was shake my hand, give me a grin, and offer me a drink. What better way to start an interview? Indeed, Joe’s amicable attitude was contagious and filled with energy despite just getting off work. By day, he lays cement and concrete work for a company that works with Edison Electric, traveling the area and repairing the ground when electrical teams tear it apart for maintenance. But by night, Joe trades his tools in for a guitar and sings that good ol’ honky tonk. Joe’s tale is an interesting one. Many times a musician is entrenched in music from a young age, and in that Joe is no different, coming from a musical family. Joe’s father is both a musician and a salesman. “He’s one of the first Paul Reed Smith dealers, one of the first Fender custom shops,” said Joe. “So when I was a kid, I would go visit his shops. So I was always around guitars.” However, it wasn’t until he was in his thirties that

he decided to pick up the guitar and give it a twang. “Interesting things happened in life. People die around you, things like that, you get inspired by different things. There were a few things that happened with me, and... it just kind of made me look over at the guitar that I had and go ‘why...why have I had this all my life and not done anything with it?’” And so he began to learn in perhaps the most natural way possible: just playing and being around other musicians. “I learned from going to open mics -- that’s the biggest thing, I think -- just going to open mics, chatting with other people.” That being said, there are still some select individuals who have helped him start. One of his dad’s old roommates, Jeff Moore, started giving Joe lessons and helped him to understand chords. “That one lesson was huge to me. When I went to him, he said ‘what do you want to learn?’ and I said ‘Well Jeff, I want to learn to just...be like, get on stage, and be able to listen to what people are playing, and just play

with them without knowing the song,” said Joe, looking back. “It really is the secret to jamming.” While he experimented with punk rock in the past, Joe has found his passion in country music. Not country-pop or country, but the classic honky tonk that comes straight from the soul. “It’s just so honest and sincere,” he said when asked about what makes country so special. For Joe, playing country is as much about fun as it is a ‘healing process.’ “When I write...it’s all influenced by things that happened. I’ve written about people I’ve lost, things I’ve wanted, written about things I’ve wished are a certain way.” Sometimes inspiration hits out of nowhere. One one occasion, he was working on a job when a new song shot to the forefront of his mind, and he animatedly had to tell his coworkers to continue on without him as he quickly jotted down the lyrics. Along with his love of music, Joe also holds great love for his family. He has a fiance and daughter, the latter of

whom he hopes to one day share his passion for music with. In some ways, she already has it, learning piano at a young age. The idea of going on a big cross-country tour, becoming famous, is always an idea in the back of every musician’s mind, but for Joe, he’s quite content with where he is now. He’s got stability and a family, and there’s not much more you can ask for after that. Joe has had a band for six years now called Live Remedy. Primarily a honky tonk band that originated as a cover band, they perform all old country going back as far as the 40’s. They play at the Winchester Inn at the end of each month, PK’s Roadhouse in Lake Elsinore, and a number of places around the So Cal area. As of this writing, a brand new music video will be out on Youtube highlighting one of the songs. Anyone interested in booking Joe solo or Live Remedy can find them on Facebook. And really, when there’s the promise of some classic country with such an energetic front man, why wouldn’t you?

& jazz influences. Our desire as a band is to play positive music that speaks to the audience in a language they can understand. We can’t be easily defined as it is a constant, steady movement. It’s hard to put into words the energy created at each show and it seems as the venue continues to move and change and so does the vibration of the songs. It continues to take different forms and highlight different musical qualities and this becomes more apparent as the years continue onward and upward. Even as David Sias recently decided to move and be with his family in Florida, The Shift prepared the remaining band mates for the busiest summer in our history. Now we have incorporated new, extremely talented musicians to help the group as we continue to define our vision and mission as community leaders and advocates. In a time and age where we are constantly exposed to a digital divide in our government, religion, race & gender, we strive to work together with the community to bridge social and economical gaps, by singing about love, grace, and the struggle between the world created by those before us and our duty as productive members of our respective communities to make things right. No matter if we are performing at a fundraiser, bar, festival or hospital, it is amazing to see the people respond to the sound of absolute love and unity. E&B: What special talent does each member give to the band? What one thing made that person want to pursue that talent? The Shift: We have been fortunate to collaborate with some amazing musicians and have seen each of us come so far in our own musical discovery. Everyone knows David Sias aka “Didji Dave” as the boisterous, witty multi-instrumentalist who writes some of the catchiest folk influenced tunes while playing nearly every instrument on stage throughout the show. Bill Weigel is known for his impressive mix of jazzy drums & bluesy harmonica, playing both instruments simultaneously, with the occasional banjo showcased; not to mention his house on Barnwell St. is the reason we perform locally as Barnwell Shift. Josh Weigel is the voice of The Shift and started playing classical violin at the age of four. Known for his positive, soulful writings and classically driven solos, he plays primarily guitar & bass with the occasional cello. Shawnie Goldman joined the shift in 2012, adding a strong third part harmony and a silky smooth ukulele while adding the much needed female energy to the stage and image of The Shift. Steve Cochran was recorded on “Shifting States” in 2015 for his clean, upbeat trumpet solos making him a staple on stage with his intricate jazz style. Recently The Barnwell Shift features fellow brotherly musicians Kyre & Tyler Wilcox, two extremely talented brothers from Encinitas that can switch between drums, bass and guitar. When all of these elements of Barnwell Shift come together it creates one of the most creative & captivating musical performances. E&B: Can you go into your personal life choices about remaining positive, eating healthy, and living what society calls an “alternative” lifestyle? Does that lifestyle positively affect the band?

No matter what the future brings, The Shift will continue forward spreading its positive message and groovy tunes. Whether there are one, two, three, five, or eight musicians participating in The Shift, the audience is guaranteed a musical experience they will want to take home with them and hopefully incorporate in their daily lives. As we all twist and turn through the future, there is one certainty: fear slows our momentum and trajectory towards love. For us all, in some way, came from love and have been kept in some loving manner to make it to today. The shift desires to resonate that love with all willing to accept it and finds encouragement in life’s fearful lessons. E&B: Do you have anything exciting coming up you would like to share? The Shift: This coming fall Barnwell Shift will be cataloging its previous five years of material and start working on the next recordings to be released early 2017. “Didji” David Sias will be making a week long appearance in early October. Both Barnwell Shift and Living Tea have partnered with Feeding the Soul Foundation for the past two years to connect non-profits with popular artists through fundraising concerts for causes. The Shift: We have come to find that our lifestyle directly affects our entire being including those around us. Just like how skipping a meal or not getting enough rest can make you cranky and achy positivity can work in an equally opposite way. As we navigate this world, our minds and bodies are constantly exposed to toxins and it is our bodies designed duty to process through these toxins. By eliminating as many toxins from our daily lives and eating clean, local and organically grown foods, limiting our exposure to alcohol, sugar, and industrial chemicals like fluoride, pesticides and other petroleum products and byproducts. We are living a daily active lifestyle, “hiking it off ” or surfing, getting enough good sunlight, and setting aside time to meditate on life and the service of others. All of these implementations have positively shifted each of our lives, allowing us to share this knowledge with those who are eager to learn and transform their own lives. There is nothing alternative about living a healthy lifestyle as health should be the standard of living for all no matter the cause. If it wasn’t for the individual shift every member has taken to make their lives healthier and more productive, The Shift would still only be an idea instead of a movement. One thing that is evident from the past year and a half, the talent is amazing, the music is varied and the audiences are lucky to have this in their own backyards. Another thing that is evident is that there is lots of confusion about the terminology used to describe the music and the musicians who perform it. To help educate the reader about what various terms mean, Echo and Buzz has turned to the web’s authoritative site, UrbanDictionary.com.

Singer-Songwriter: Put on a pair of skinny jeans and a stupid hat and play some cheesy campfire songs on an acoustic guitar. Label yourself as a singer-songwriter, and you will instantly be mistaken for real talent.

Americana: A form of made-up, modern American music which borrows from traditional country, bluegrass, folk and blues which is conceived and played by people who haven’t explored those genres of music and really don’t care to. This music can often be found next to the Starbucks cash register.

Alternative Rock: Bands joining together all over America to make bland, passionless insincere rock music with lyrics about depression and breakups to cash in on teenage angst.

Rock Music: Something that was ruined by Nickelback. Pop Music: Any form of music (rock, country, rap, even metal) that hits the chart. But it has some requirements: Be good looking; If you are a boy, feature half naked girls in your video; If you are a girl, be half naked. Musician: A dude without a job, without money, and who somehow manages to get all the chicks. Band: A group of people who are almost constantly broke. Cover Band: A band of musicians usually in the 30’s to 60’s in age. The members play the most expensive gear available, believing they will achieve ultimate tone and resonance from their selected instruments. Their girlfriends and/or wives have permed hair. Sometimes females take part in cover bands, always as the singer. They wear extravagant costumes and have 80’s inspired hair-dos.

Lead Singer: The front-man (or woman) of a band, usually in rock music. If the singer is male, it means he is the one who dates all the women!

Drummer: The first person to die in a band. Examples include Keith Moon and John Bonham. This fact is demonstrated in the film Spinal Tap.

Guitarist: The guy who your girlfriend left you for. Bassist: Someone who hangs around musicians.

E&B: So Chris, every kid these days has a smart phone and I hear a lot of parents say that

they have no idea what their kids are sending to each other. What are the laws regarding sexting?

Chris: Sexting refers to sending sexual pictures or videos via cell phone. California,

does not currently have laws tailored specifically to “teen sexting.” California legislative bills regulating teen sexting have failed to win passage but I expect that they will soon. So currently the District Attorneys only option is to prosecute a person under California’s general child pornography and exploitation laws, which provide for very harsh sentences, especially if we are dealing with a situation where one person is an older minor, say 17, and the defendant is a young adult, say 18 or 19. They have no idea what the legal consequences of send each other photos may be

California also makes it a crime for a person to send, distribute, exhibit or offer to send, distribute, or exhibit any harmful matter to a minor with the intent to both sexually gratify or appeal to the person or minor and seduce or arouse the minor. In order to be guilty of the offense, the person must know that the recipient of the material is a minor, or the person must fail to use reasonable care in determining the true age of a minor. Harmful matter is matter that depicts or describes sexual conduct in an offensive way, and the matter lacks serious literary, artistic, political, or scientific value for minors. For example, an adult who sexts a sexually explicit self-portrait to a minor may be charged with this crime even though sending the same image would not constitute a crime if the recipient is 18 or over. A person convicted of sending harmful matter with the intent to seduce a minor is guilty of a misdemeanor, unless the defendant has one or more prior convictions for sending harmful matter with the intent to seduce a minor, in which case the new conviction is a felony. If classified as a felony, the defendant may be sentenced up to three years in prison. Cal. Penal Code § 311.1 - Sending, Distributing, Printing, or Possessing Depicting Sexual Conduct by a Minor It is a crime to knowingly send or bring into the state (or cause to be sent or brought into the state) material showing a minor engaged in or simulating sexual conduct, when the intent is to distribute, exhibit, or exchange the material. The same statute also prohibits a person from possessing, preparing, publishing, producing, developing, duplicating, or printing any obscene matter showing a person under 18 engaging in sexual conduct. A person convicted of the offense may be sentenced up to a year confinement. If the person is sentenced to the county jail, the court may impose a fine up to $1,000; if the judge sentences the person to serve time in state prison, the judge may also impose a fine up to $10,000.

E&B: That’s unbelievable. Three years State Prison for sending a naked mirror picture, or

showing it to a friend?

Chris: Yep. And theoretically the Defendant can be prosecuted in Federal Court.

E&B: What happens then? Chris: Some harsh penal code sections come into play that were never intended to address teenage sexting, for example:

Cal. Penal Code §§ 311.4, 311.11 - Possession or Control of Matter Depicting a Minor Engaged in Sexual Conduct A person who possesses or otherwise controls material that depicts a person under 18 years of age engaging in or simulating sexual conduct commits a felony punishable by up to a year in prison, a $2,500 fine, or both. In order to be guilty of the offense, the person must know that the material shows a person under 18 engaging in or simulating sexual conduct. The prosecutor does not have to prove that the material meets the legal definition of obscene material. California’s definition of sexual conduct includes showing of the genitals, public, or rectal area. Therefore, a 19-year old person sexting with a 17-year old may be charged with the crime of possessing matter depicting a minor engaged in sexual conduct if the 19-year old receives a nude self-portrait of the 17-year old. If the defendant has a prior conviction for the offense or any other offense that requires registration under the state’s Sex Offender Registration Act (or an attempt to commit any of these offenses), a new conviction for possession or control of matter depicting a minor engaging in or simulating sexual conduct will result in a prison sentence of two, four, or six years. Cal. Penal Code § 311.3 - Sexual Exploitation of a Child A person who develops, duplicates, prints, or exchanges any material showing a person under 18 years of age engaging in or simulating sexual conduct commits the offense of sexual exploitation of a child. A conviction for sexual exploitation of a child carries a

The Prosecutorial Remedies and Other Tools to end the Exploitation of Children Today (PROTECT) Act of 2003 makes it illegal to produce, distribute, receive, or possess with intent to distribute any obscene visual depiction of a minor engaged in sexually explicit conduct. Knowing possession of such material—without intent to distribute—is also a crime under the PROTECT Act. (18 U.S.C. § 1466A(a)(1).) Federal law also criminalizes causing a minor to take part in sexually explicit conduct in order to visually depict that conduct. Parents who allow this behavior can also be prosecuted. (18 U.S.C. § 2251.) It’s also a federal crime to use a computer to ship, transport, receive, distribute, or reproduce for distribution a depiction of a minor actually engaging in sexually explicit conduct, or any material that otherwise constitutes child pornography. It’s another federal crime to promote or solicit sexually explicit material involving a minor. (18 U.S.C. §§ 2252, 2252A.) But federal prosecution of juveniles for sexting may be unlikely. The Federal Juvenile Delinquency Act (FJDA) generally provides that, where possible, juveniles should be prosecuted in state—not federal—courts. (18 U.S.C. § 5032.)

E&B: So what’s a parent to do when their kid has a new boyfriend or girlfriend and you think this is going on? Chris: I’d never give anyone else parenting advice but just like all other issues with the

internet, sit your kids down and explain all the consequences and possibilities of what they do and share on their cell phones and computer. I tell my kids, once you hit send, realize you are sending it to the world, including the police.
