Wild Western Slope Lush forest meets the vast desert west of the continental divide in Colorado. Understand the 1031 exchange Investment strategy can enhance benefits

An investment property in Durango is an investment in a city whose population is increasing. Durango is a town where real estate prices continue to rise and the supply of rental homes can barely keep up with demands. With its resort-like amenities, local culture and a strong sense of community, Durango is an attractive place for long-term investment. But say you want to diversify. Perhaps you want to sell your single-family property and buy a duplex or an apartment complex. Enter the 1031 exchange. This tax code is a powerful strategy that the savviest of investors rely on.

o what exactly is a 1031? To put it in layman’s terms, this procedure allows you to change the form of your investment without ‘cashing out’ in the eyes of the IRS. A 1031 allows your investment to continue growing, tax-deferred. There’s no limit to how many times you can do a 1031. You can rollover the gain from one investment property to another to another and so on. Although you may have a profit on each swap, you can avoid the taxes until you sell for cash at a later date. The “Like-Kind” Exchange, is a wide-reaching tax clause that may not mean what you think it means. For instance, you can exchange an apartment building for raw land, or a ranch for a strip mall. Properties are considered of like-kind if they’re of the same nature or character, even if they differ in quality. The rules are surprisingly liberal here.1031 exchanges come in several different types and you may need some help to determine which one is right for you.

An improvement exchange sometimes referred to as a Construction Exchange, allows an investor to use their tax-deferred dollars to make enhancements to the replacement property. To qualify for this exchange the entire exchange equity must be spent on improvements and the improvements must be completed within 180 days The property will need to be placed in the hands of a “Qualified Intermediary” until construction is complete. The 1031 provision is only for investment and business properties, so you can’t swap your primary residence for another home, but, this tax deferment is a wonderful opportunity for entrepreneurs or investors. Property transactions are complex and it’s not always obvious how or even if a transaction can qualify for a 1031 exchange. This is not a DIY task. Work closely with your tax professional and real estate agent to find the best scenario for your unique situation. n

This is the original type of 1031 exchange. With this type of exchange, the initial or relinquished, property is sold and replacement property is purchased at the exact same time in the same

The odds of finding the exact property you want with an owner who is looking for the exact property you have are slim. That’s why the Delayed Exchange is by far the most common exchange. Using this strategy, you’ll sell your property first. Then you’ll have 45 days to identify a replacement. When you close on the replacement property the net proceeds will need to be rolled into the new property on or before the 180th day following your relinquished property sale. You will need a “Qualified Intermediary” to complete this type of transaction.

Family integrates old techniques in modern design Homebuyers interested in older properties can find ways to incorporate modern conveniences, while retaining the home’s historic charm and character. Though the process can be both challenging and unpredictable, it is possible to marry modern amenities and historical design and be rewarded for the fruits of your labor.

ake Durango homeowners Krystie Karageorge and Karam Mishalani, for example. In 2015, they relocated from Nederland, Colorado in search of a small, healthy community to raise a family with opportunities to enjoy the outdoors. Mishalani is a commercial mason by trade, so when Karageorge landed a job at Mercy Regional Medical Center, the couple began searching for a home to raise a family. “Being out in Edgemont seemed like it would be constant driving,” Karageorge said. “So we wanted to be centrally-located.” To meet their needs, Keller Williams Broker Associate Joe Clair showed the couple a historic property with three bedrooms on a shady side-street near the old Animas City. The two-story brick home was about 1,200 square feet, and within walking distance of schools, shopping and the Durango Community Recreation Center.

“We wanted to respect the original aesthetics, so we opted for a similar look with the windows, arches and roof pitch complementing the original house.”

The home, built in 1883 by German immigrants August Robert Franz Gabbe and his wife Eva Louise Schutze, faces sideways on a solid, hand-laid stone foundation two feet wide by six feet deep on about .26 acre. “It was in excellent shape,” Mishalani said. “The brick was all pretty level. The settling, of course, had taken place many years ago. I couldn’t believe that no one else was taking on this project. As we got into it, we understood why.” After assessing the property, they began planning a renovation of the existing home and an addition with help from local architect Rachel Olson. They also consulted experts in historic preservation statewide to learn as much as possible about maintaining the integrity of the home. “We had the option of getting a historic preservation, but it was going to limit what we could do,” Karageorge said.

For example, though they were able to salvage doors and windows from the existing home, new windows would provide energy efficiency and sustainability. But preserving the look and feel was important, so they consulted expert stonemasons Benson Gladen and Tink Slade. They identified the best formula to match the existing mortar for their project. They also connected the couple with Brenda Hankins, who provided stone material adaptable to the freeze and thaw cycle from Hankins Stone Company. Karageorge said they began restoring the home in the summer of 2015 while living in a townhome nearby. Mishalani said they basically started from scratch. With the help of Wilson Structural Engineering, the family tore down the walls on the first level between the living room, kitchen and dining room to create an open concept. Because the house had been neglected for years, the ends of the existing joists were rotting; so the team also replaced and sistered them with a mix of new and salvaged lumber, added a structural beam to the living space and installed a new stairwell with clever storage. One of the three upstairs bedrooms was transformed into a bathroom, complete with the clawfoot tub from the original bathroom. “We wanted to respect the original aesthetics, so we opted for a similar look with the windows, arches and roof pitch complementing the original house,” Mishalani said. To speed up the process, they hired contractors to handle all the new plumbing and wiring for the existing home and the addition. The textured stone on the outside of the addition blends nicely with the brick used on the original home, and the addition provides nearly 800 square feet of space which includes two bedrooms and a spacious bathroom. “The work itself was hard work,” Mishalani said. “It was good work. We enjoyed it, and we enjoyed seeing the progress of it.” He added, “Having done many masonry jobs over the years, this project was a labor of love for my wife, daughter and two dogs.” The family says the property is still a work in progress, with additional details and landscaping to finish. But they have already accomplished their goal to build a family home that will remain sound and solid for future generations. n
