A Letter from the Executive Vice President – Dear First Coast Apartment Association Membership, It has been my honor to be the Association Executive for the First Coast Apartment Association for the last few years. The FCAA team is thrilled to see your association moving in new and exciting ways! Under the guidance of the Board of Directors and our incredible committee volunteers there are some big changes coming that we believe will take this association to new heights. The strength of our association comes from our members and volunteers. We are a strong association because of you! The Board of Directors met for an all-day planning session on Friday, February 8th at Hammock Beach in Palm Coast to discuss challenges facing the association. Under the leadership of our new Board President April Hudson of Milestone Management, the board generously donated a full day of their time to dive into discussions about the future of your association. The board has some great ideas to continue moving your association forward. The Board is made up of a fantastic group of people representing all different parts of our association. We are so lucky to have them as our Association leaders. At the end of the planning day the Board Members and staff participated in a team building activity that had them rushing around the Hammock Beach resort to complete tasks on a photo scavenger hunt. No one can ever doubt the dedication of Board Member Jason Frotten; he volunteered to go down a water slide completely clothed to push his team into the first-place spot! We are looking forward to a great year and we are so lucky to have each and every one of you as a part of our fantastic organization. Sincerely,

FAA Legislative Conference Members of the First Coast Apartment Association traveled to Tallahassee February 4th - 6th to meet with members of our Florida Legislature. Our members were able to successfully meet with Senator Aaron Bean, Senator Travis Hutson, and Senator Tracie Davis’ office. In the House of Representatives our members met with the Representatives and offices of; Cord Byrd, Clay Yarborough, Tracie Davies, Kimberly Daniels, Wyman Duggan, Jason Fischer, Cyndi Stevenson, Travis Cummings, and Paul Renner. FCAA supported four key issues during our meetings with our lawmakers. Our members worked hard to make sure that our voice was heard in Tallahassee!

Reduce Emotional Support Animal Fraud and Abuse

Prohibit Mandatory Inclusionary Zoning

Issue: The Legislature should pass legislation to reduce instances of emotional support animal fraud and abuse.

Issue: Mandatory inclusionary zoning practices do more harm than good.

The Florida Apartment Association urges the legislature to pass legislation to reduce fraud and provide clarity regarding reasonable accommodation practices for emotional support animals. The apartment industry strongly supports the rights of individuals with disabilities to request reasonable accommodations. However, the abuse in the current system places an undue burden on property owners and undermines the intent of the Fair Housing Act.

The Florida Apartment Association urges the Legislature to pass legislation that prevents local governments from mandating inclusionary zoning and encourages local governments to pursue marketbased incentives to address affordable housing. Mandatory inclusionary zoning policies stifle the development of new apartment communities and thereby exacerbate the rising demand for apartment homes. As a result of the rising demand and the reduction in supply caused by mandatory inclusionary zoning, the cost of housing for all Floridians will rise. In addition, these policies threaten the 47,000 jobs created by the Florida apartment industry and the $44.8 billion the industry contributes to the state’s economy annually.* *State data derived from www.WeAreApartments.org/data/state/Florida.

Protect the Sadowski Affordable Housing Trust Fund Issue: Use all Sadowski Affordable Housing funds for Florida housing programs. The Florida Apartment Association urges the Legislature to use all of the Housing Trust Fund monies exclusively for Florida’s housing programs and to pass Senate Bill 70, which will prevent the Legislature from diverting any cash balances in the Housing Trust Fund for other purposes within the state budget. Sadowski funds are highly leveraged with private sector loans and equity, which provide $4 to $6 for every dollar of state funding. As a result, Sadowski funds have a powerful economic impact in the State of Florida. In addition, the appropriation of the estimated $314.08 million* in the state and local housing trust funds in fiscal year 2019-2020 into Florida’s Housing programs would create 30,000 jobs and $5 billion in positive economic impact in Florida.

Members of the FCAA delegation met with Representative Sam Killebrew of District 41, and were able to help him understand how rampant Emotional Support Animal abuse is in the State of Florida. He is now sponsoring that bill in the House of Representatives.

Clarify the Impact Fee Process Issue: The Legislature should pass Senate Bill 144 to clarify the impact fee collection process. The Florida Apartment Association urges the Legislature to pass Senate Bill 144 to provide necessary clarity regarding the impact fee collection process. The inconsistency in the current impact fee system is problematic and burdensome for multifamily housing developers with projects across multiple jurisdictions. Similarly, the practice of using impact fee revenue to fund existing debt or noncapital projects raises costs for multifamily housing developers and thereby the cost of housing for all Floridians.

LEGAL OR NOT? by Brian Wolk, The Law Offices of Heist, Weisse & Wolk, PA

In January we filed an eviction, and the resident filed an answer requesting that our case be dismissed. Her only defense to the eviction is that she has a receipt from our assistant community manager which says, “January Rent”. The resident had not paid December rent and came in first thing in the morning on January 2 and gave the assistant community manager a check telling her it was for January rent. The following day, I posted the payment to December, and the computer then displayed a balance due for January rent plus some late fees. We then prepared a 3-day notice and served it to the resident, as her January rent was late on the 4th according to our lease. The 3-day notice referenced, “January rent $995.00”. This resident attached to her answer to the eviction complaint the receipt our assistant community manager provided her, and she has not deposited any money into the registry. She also is taking the position we cannot evict her for nonpayment of January rent because of the above mentioned rent payment receipt. We feel like we are being ripped off. Will this devious resident win in court?

There is a substantial risk that you may lose the eviction case based on the receipt which was given to the resident by the assistant community manager, particularly in conjunction with the way rent was demanded on the 3-day notice. An experienced eviction attorney will argue that a month’s rent was due and owing when the 3-day notice was served, but the inaccurate receipt will be a major problem for you, perhaps even a fatal one. You cannot evict a resident for not paying January rent, if the resident in fact paid January rent, and the receipt indicates this clearly in writing, even though both you and the resident know this is not in any way the whole story. Unfortunately, errors like this often lead to a judge denying an eviction. In the future, you should limit extra details like this on the receipt and your 3-day notices. Simply listing on the receipt that $995.00 was accepted would have been sufficient. By getting specific, it creates the opportunity for mistakes, which now your resident is trying to exploit. It is also important to write the receipt out clearly and spell out the amount received and the check or money order number, and the manner in which payment was received. Residents have been known to forge receipts, and occasionally the receipt in the resident’s possession is the only one in existence. Always use a receipt book for which a numbered carbon copy can be retained. I am the manager of a conventional apartment community. Our resident Judy walked into our management office and handed us a “Temporary Injunction for Protection against Repeat Violence”. It stated that Judy’s roommate, Ken, the other resident listed on the lease, is not to have any contact with Judy and is to stay at least 500 feet away from her, her car, and her home at all times, or be subject to arrest. Judy told us that Ken’s conduct has caused her to sustain significant physical injury, and he continues to threaten her, forcing her to attend court and obtain the injunction, as she was terrorized and in fear for her life. As a result, Judy requested that we change the locks on the apartment to deny Ken access. We are not sure if we should grant that request. Also, if we change the locks, and Ken enters the management office asking for a key to the apartment home, should we hand it to him?

I have been involved with FCAA for over 15 years and I feel it is very important to volunteer and get involved in the local association to make sure we know what is going on within our industry. This is always a changing industry.

What does your committee do? The Special Events committee is a huge part of FCAA. We organize Networking and Charity events through out the entire year. These events are great way to meet with your peers to discuss what is going on in the Market and network to help each other out.

Why should someone join your committee? The Special Events Committee is a great committee to join, you will be a part of something that is helping our industry, from networking, to raising money for all FCAA charities.

Why is your committee important for FCAA? The Special Events Committee is very important. This is the committee that runs all year long and raises the most money for our charities.

Chris Polk - Brookwood Club Apartments Chris Polk is the Maintenance Supervisor at Brookwood Club Apartments, part of the Milestone Management family. Chris is certainly deserving of recognition as he is a great leader, loyal, dependable, trustworthy and hardworking. Don’t let his impeccable appearance fool you as he works super hard down in the trenches with his team. Chris has been trusted with great responsibility to lead the due diligence maintenance inspection teams for acquisitions. Chris has always been willing to go assist other Milestone communities that were short staffed or struggling and maintains Brookwood all the while. Chris has mentored others including new hires. Chris has a great volunteer spirit and participates and frequents many FCAA events and community events. Chris is our pit master and pancake chef at resident functions and always does everything with a smile. Anyone that knows Chris will tell you he is always full of joy and smiling. As our team cheerleader, Chris always has encouraging words for everyone even while offering a correction. He is loved by his team, coworkers, corporate, vendors and residents. This year he was able to win a few awards at the Maintenance Mania event making us all so proud and helping to promote our Milestone reputation. Speaking of reputation, Chris has contributed to our ORA score by continuously offering excellent service to our residents and vendors alike.

Our ORA score is now well above the city and company average at 80%. Our Modern Message average is 4.4 stars out of 5 with review after review about our team exceeding expectations. Apartment Ratings has an 88% recommendation well above the 77% city average. All of our team has contributed to our high occupancy, ratings and the ability to make our budget each month but Chris has really led by example. Chris always does everything to the best of his ability and cheerfully. No problem is too big for him to take on and he has a gift of being able to turn negatives into positives. In the community, Chris is always helping others with storm clean up after the hurricane, tree removal etc. As a volunteer, Chris plays the bass guitar for the music ministry at his church. A husband and father of two beautiful children, Chris is always willing to help others with a smile on his face and gives of his time to others joyfully.

Injunctions and restraining orders are court orders prohibiting a party from a specific course of action. As a conventional apartment community property manager, you have nothing to do with this conflict, other than the fact that you are renting an apartment home to both parties. While we recommend that you call your attorney in each situation, we generally advise that your company not change the locks. By doing so, you are denying access to one of your residents, which could be considered a prohibited practice. If the person obtaining the injunction changes the locks on her own, and provides your office with a key, we do not believe you have an obligation to provide the co-resident with key access, and in fact recommend against doing so. Please keep in mind that the above mentioned advice only applies to conventional apartment communities. Federally regulated programs, including but not limited to landlords of low income housing tax credit communities and Section 8 recipients are required to follow the federal law as provided in the Violence against Woman Act, ‘VAWA”. This federal law often will require a different course of action in comparison to conventional apartment communities.

Four months ago our company processed an application, accepted the applicant, and our new resident moved into the apartment home. A few days ago, we received information that our resident had been evicted numerous times in the past. We verified this information by emailing the previous apartment community that was listed on the eviction complaint. That property manager confirmed that she had filed an eviction on the resident, but the resident had vacated the premises prior to the eviction being completed. We ask the question on our application, “Have you ever been evicted?”, and the resident answered, “No”. May we evict this resident for misrepresentation on the application?

You have neglected to ask the correct question on your application. Most eviction filings do not actually result in the resident being evicted. Most residents vacate prior to being forcibly evicted by the sheriff from the premises; the property manager notifies the attorney that the resident has in fact vacated, and the eviction does not continue. If this occurs, an applicant arguably can answer without being dishonest that he has not been evicted. The right question to ask is, “Have you ever had an eviction action filed against you?” This question is much more inclusive, and if the resident answered, “No” to this, it would have allowed you to evict based upon the resident giving false or misleading information, if this right was preserved on the application or lease. Our office views a large amount of applications where blanks are not filled in, information is illegible, phone numbers turn out to be disconnected, yet the applications are approved. An applicant who is desperate to move into your apartment community will intentionally misrepresent, omit or distort information. A property manager should meticulously review an application before accepting an applicant.

FCAA COMMITTEES FCAA Committees meet regularly to plan everything from networking events, education classes and topics, and legislative issues facing our industry. Our committee volunteers are what make our association successful!

Every year, the First Coast Apartment Association acknowledges the leaders of our industry through the Circle of Excellence Awards. Committee members establish criteria for the awards, encourage participation in each category, recruit individuals to judge entries, raise funds to cover the cost of the awards, and manage the event itself. COMMUNICATIONS:

FCAA’s primary lines of communication with its members are its semi-monthly newsletter, its e-newsletter, and its Website. Members of the Communications Committee report news that affects the multi-housing industry, identify articles of interest, create and edit articles, solicit advertisers for the Membership Directory and for CoastLINES, and ensure that Website content is current and contains useful industry links. FCAA provides comprehensive education programs with national certifications. HOSPITALITY:

The Hospitality Committee is responsible for ensuring that new members receive an orientation to FCAA activities. LEGISLATIVE:

The Legislative Committee provides Association members with up-to-date information on local, state, and national legislative issues affecting the multifamily housing industry. MAINTENANCE:

The Maintenance Committee develops and conducts workshops and seminars that provide maintenance technicians with skills required for the PMC license, prepare them for the PMC licensing test and provide them with the continuing education credits required to renew their PMC license. Membership dues and programs provide FCAA with its primary source of revenue, making the Membership Committee an important one. SPECIAL EVENTS:

How can people align their skill sets with their volunteer activities?

Members of the Special Events Committee oversee all details of special events (Summer Sizzler, Oktoberfest, Holiday Party, etc.), including site selection, decorations, food and beverages, and entertainment. FCAA reaches out to the community through its charitable activities. Members of the Special Events Committee also plan and conduct the annual Harbor House Softball Game, the Canned Food Drive to benefit the Clara White Mission, the Annual Poker Run, and other charitable activities approved by the Board of Directors. How can board service or other volunteer activities boost your career?

Regardless of where and why you volunteer, the experience undoubtedly helps build your resume and adds to your marketability. And volunteering can be an excellent way to learn more about a particular role or sector, especially if you’re coming from the for-profit sector.

There are two things to consider here. Are you looking to utilize existing skills or to build new skills and gain expertise in an area slightly outside of your existing professional circle? If you’re seeking the latter, explore areas where you’ll get valuable experience, potential contacts, and fodder for your resume.

How should your volunteer activities change as you advance in your career?

As our careers advance, different driver or motivators come into play. Very often what changes the most is our desire to give back to the profession or community that contributed to our success. We switch our focus from being mentored to mentoring-or from getting experience to giving experience.
