QUESTIONS ASKED AT THIS MEETING Members of the public are invited to ask questions in accordance with the following resolution of Council (Min Ref 5824): 1.

Public participation shall take place at Council meetings in accordance with Regulation 31 of the Local Government (meeting Procedures) Regulations 2005.

2.

Public participation will be the first agenda item following the formal motions regarding Leave of Absence, Apologies, Minutes and Declarations of Interest.

3.

A maximum period of time of 30 minutes in total will be allowed for public participation.

4.

A maximum period of time of 3 minutes will be allowed for each individual.

5.

A member of the public may give written notice to the General Manager 7 days before an ordinary meeting of Council of a question to be asked at that meeting.

6.

A member of the public will be entitled to ask questions relating to the activities of Council, giving an explanation that is necessary to give background to the question and ask supplementary or follow up questions relating to that specific matter that may come to light as a result of the answer.

7.

Questions do not have to be lodged prior to the meeting, whether verbal or in writing. If a verbal response cannot be given or if specifically a written response is required, the question must be reduced to writing and be submitted to the Chairperson prior to the end of the public section of the meeting.

A question by any member of the public and an answer to that question are not to be debated.

A draft Policy be prepared to provide a framework for the application of the new powers was discussed.

LGAT Motion - A suggested motion for submission to LGAT for an Planning Advertising upcoming meeting was discussed.

Requirements Cradle Coast The agenda for the Cradle Coast Representatives Authority Agenda meeting on 27 February was listed to allow Aldermen an opportunity to raise any of the matters listed with its Representatives.

Enterprise Agreement An update was provided in relation to the closing - Update date for the Protected Action Ballot being undertaken by the Australian Electoral Office on behalf of the Australian Services Union.

MERSEY BLUFF CARAVAN PARK - EXPRESSIONS OF INTEREST ESTABLISHMENT OF QUALITY TOURIST STYLE CABIN PRECINCT NOTICE OF MOTION - ALD G B KENT File: 25329 D321301

In accordance with Regulation 16(5) of the Local Government (Meeting Procedures) Regulations 2005, a notice of motion has been received from Alderman G B Kent.

MOTION “That Council promote further upgrading of the Mersey Bluff Caravan Park by seeking expressions of interest from investors or interested parties in establishing a quality tourist style cabin precinct within the boundary of the Park and based upon the concept contained within the Park redevelopment plan (April 2011) and to operate under similar guidelines as Time Share Units or Holiday Apartment Body Corporates.”

SUPPORT It is apparent that Council does not have the resources to continue to upgrade the caravan park consistent with the recommendations made back in 2011 and that the current annual upgrade program is limited to maintaining standards and making relatively minor improvements to the visitor sites.

The sourcing of capital investment from other parties in a cabin development of superior quality could have the potential to increase patronage and other similar improvements to the park with the corresponding flow on effects to nearby enterprises.

Council’s contribution to the project would be limited to the provision of site infrastructure with revenue being received from an annual fee structure.

The style of cabin to be determined by Council but, generally they are of timber construction (Tasmanian) and range in price from $48K for a one bedroom unit up to say $73K for a three bedroom unit.

OFFICER’S COMMENTS The concept of holiday units within the Mersey Bluff Caravan Park was identified as part of the caravan park master plan prepared by Hanson, landscape architects. The Mersey Bluff Committee has discussed the idea previously, including the concept of raising the capital through a timeshare arrangement. The current Caravan Park operator has also indicated an interest in developing units to provide a more consistent revenue stream through the winter months.

Officers have undertaken some preliminary investigations into the concept. This has included some advice in December last year from a local real estate agent regarding the potential market for holiday units. Preliminary technical investigations regarding site configuration, proximity of services and construction costs have also commenced.

Before proceeding to an expression of interest or any other sale process it would be prudent for Council to finalise initial feasibility, complete design work, seek legal assistance on management arrangements and resolve any issues with key stakeholders such as the park operator and Crown Land Services.

With this work completed the risks to potential investors are minimised and Council have an attractive package which can then be appropriately marketed.

If Council were to proceed with the intent of the motion an allocation in the order of $25,000 would be required in next year’s operational budget to advance the feasibility work recommended above.

An alternative motion that Council may like to consider would be: “That Council in an effort to promote further upgrading of the Mersey Bluff Caravan Park include for consideration in the 2014/15 operational budget an amount up to $25,000 to finalise an initial feasibility study, complete design work, seek legal advice on the structure of management arrangements and to resolve any issues with key stakeholders prior to calling for expressions of interest from investors or interested parties in establishing a quality tourist style cabin precinct within the boundary of the park.�

RELEVANT PORTFOLIO General Manager RELEVANCE TO COUNCIL’S PLANS & POLICIES Council’s Strategic Plan 2009-2030: Strategy 2.1.2

Provide high quality, consistent and responsive development assessment and compliance processes

PURPOSE This report is provided to assist Council in its consideration of the adoption of a Dilapidated Buildings Policy and Show Cause Notice.

BACKGROUND A draft Dilapidated Buildings Policy and Show Cause Notice was presented to the Council at a Workshop on 24 February 2014. The Policy and Show Cause Notice are now presented for formal adoption so that the General Manager may consider the exercise of the new legislative powers to deal with buildings and structures which have become dilapidated to the extent that they are impacting on the general amenity of the City.

COMMENTARY The power to deal with a building that is classified as dilapidated is vested in the General Manager by virtue of amendments to the Building Act 2000 (the Act). From a practical perspective, however, it is essential that Council formally resolve to support any action that is proposed under the amendment before a Show Cause Notice is issued.

The attached Policy will conform to the principles of the amendments to the Act and will mirror the guidance set out in Building Regulation Advisory Note No. 01/2014 issued by the Department of Justice in January 2014.

Under the terms of this Policy the General Manager will present a report to Council that nominates the building or buildings that are of concern, contains supporting evidence from a suitably qualified person that the building or buildings meets the definition of “dilapidated”, sets out the works that the owners will be directed to carry out, and provides an estimate of the cost to Council of carrying out the prescribed works in the event that the property owner fails to do so.

There will be an initial cost to Council in obtaining a report from a suitably qualified person to establish that a building or buildings meets the definition of “dilapidated”. Should a property owner comply with a direction to carry out remedial building works this will not be recoverable. In most instances, however, it is not anticipated that this will be a substantial cost.

Where a property owner fails to carry out the remedial building works set out in a notice, Council may choose, by itself or by the use of qualified contractors, to carry out the required works. In such instances Council is entitled under various provisions of the Local Government Act 1993 to recover its costs as a charge against the property (similar to how rates are collected). This would then include the cost of the initial qualified person report.

The legislation is framed to ensure that procedural fairness is extended to an affected property owner. This is achieved through a process of serving a Notice to Show Cause on the property owner listing full details of the property and setting out what remedial building works are required to be carried out.

The owner is allowed a specified period of time, usually 20 days, to respond with reasons why they should not be required to carry out the works. This allows for the possibility of negotiation between Council and a property owner where, for example, an owner may agree to carry out the required works but request a certain period of time to achieve this.

The legislation also entitles an owner to appeal against any dilapidated building notice issued against them, and this is clearly stated in the Show Cause Notice.

This new provision of the Building Act 2000 is yet to be tested, and until such time as Council has issued a notice and worked through the whole procedure with an owner its effectiveness cannot be clearly stated. The outcomes of Council’s first action will therefore determine the extent to which the new provision might be used to clean up certain problem buildings in Devonport.

FINANCIAL IMPLICATIONS Operating Budget As a result of this matter, there will likely be an increase in Council’s operating expenses that cannot yet be accurately quantified. The General Manager will require a report from a qualified person to establish that a building meets the definition of “dilapidated” and clearly there will be a cost associated with this.

In an instance where the remedial building works required consist of such things as painting and general repairs the cost of the initial report is estimated to be less the $500.

Where a building is deemed to require demolition the initial report would be substantially higher.

It is not anticipated that the General Manager will exercise this power on a regular basis and it may perhaps be limited to three or four actions a year. The first action will probably be commenced within the existing financial year and this should be manageable in the budget. A specified allowance will be nominated in the 2014/15 budget.

There is also the possibility that Council may become involved in appeal proceedings which may accrue legal and expert consultant costs.

RISK IMPLICATIONS 

Political/Governance This is a new power given to the General Manager by virtue of amendments to the Building Act 2000. Council is not aware that it has as yet been exercised anywhere in Tasmania. The effectiveness of the new provisions will only be known over time.



Financial There will be costs involved in obtaining qualified person reports about dilapidated buildings and further costs where Council elects to carry out remedial building works itself.



Environmental/Public Health Objective use of the power to remediate dilapidated buildings is likely to positively impact on both the environment and public health.

Communication/Reputation This Policy will ensure that any proposed action by the General Manager is supported by the Council before a Show Cause notice is issued.

Given that the power is intended to deal only with dilapidated buildings it is likely that there will be widespread public support.

CONCLUSION An amendment to the Building Act 2000 has vested power in the General Manager to initiate an action requiring an owner to carry out remedial building works to a building or structure that meets the definition of a “dilapidated” building.

This Policy ensures that Council is provided with full details of the property involved, the scope of building works required and the likely cost if Council is itself required to carry out that work before any notice is issued.

The Policy also extends procedural fairness to any owner who is served with such a notice in that they are allowed a period of time to respond to or dispute the details set out in a notice.

RELEVANT PORTFOLIO General Manager RELEVANCE TO COUNCIL’S PLANS & POLICIES Council’s Strategic Plan 2009-2030: Strategy 5.3.1

Review and amend governance structure, policies and procedures to adapt to changing circumstances

PURPOSE To inform Council of recent Ministerial Orders issued by the Minister for Local Government and the actions to be undertaken by Council officers in order to achieve full compliance.

BACKGROUND On 7 February 2014, financial and asset management reforms were proclaimed that require councils to: 

maintain long-term financial and asset management plans, financial and asset management strategies and an asset management policy;



maintain an audit panel; and



report financial and asset management sustainability indicators in their financial statements.

Specifically, the Orders are titled the: 

COMMENTARY Council has an obligation to ensure compliance with the Orders and will make alterations as necessary.

Local Government (Audit Panels) Order 2014 The essence of this order is to ensure all councils have a functioning audit panel.

Devonport City Council has had an active Audit Committee for many years so meets the majority of its obligations already.

The Terms of Reference and Reporting Requirements of the Audit Committee will need to be altered to reflect: 

A change in name from “Audit Committee” to “Audit Panel”



Revision of the Roles and Responsibilities of the Audit Committee to reflect the functions of the Audit Panel in the Order. These will not differ greatly from current practice.



The General Manager or his or her delegate is to attend each meeting of the Audit Panel in addition to the Financial Manager and his or her delegate.

If at least one member who is an independent person is not present at the meeting of the Audit Panel, there is no quorum present.

The current Audit Committee rules surrounding membership, election of chairperson, charter, annual work plan all require very little adjustment from current practice.

It is proposed the Audit Committee will review the revised Terms of Reference and Reporting Requirements document at its next meeting scheduled for 28 April and it will be presented to Council with the minutes from that meeting at the May Council meeting.

Local Government (Content of Plans and Strategies) Order 2014 There are a number of improvements that will need to be made to ensure compliance with this Order with a number of them to be listed as actions as part of the 2014/15 Annual Plan.

In summary, some of these improvements include:    

Need to align our financial plan to our asset management plan and five year capital works plan.

Support tourism through the provision of appropriate Council owned infrastructure and facilities

PURPOSE This report is provided to Council to assist in further considering the leasing of the upstairs section of the Bluff Building to the Devonport Surf Life Saving Club (DSLC).

BACKGROUND The Devonport Surf Life Saving Club Inc. (“Surf Club”) has been in possession of the upstairs section of the new premises at the Mersey Bluff precinct since January, 2011.

The first report in relation to a lease for the DSLC was presented to Council at the January 2012 meeting and subsequently deferred to a Workshop. Aldermen agreed at the Workshop in February, 2012 to defer a decision regarding the rental payable by the DSLC until the 2011/12 DSLC financial reports were available. These were subsequently received and a further Workshop held in October, 2012.

Following examination of the financial reports, Council’s desire was to have a commencement rental of $2,500, CPI indexed for years 2 and 3 and Council to review the rental after the expiration of year 3. Council wished to review the DSLC’s financial statements on an annual basis to assist in the rental review after year 3. Prior to entering the new refurbished building, the DSLC did not pay rental for their old premises.

As evidenced by the DSLC’s Annual Report, the Club has settled into the facilities and operating the upstairs area, holding Club events, as well as many private functions. The new facilities provide an income revenue stream for the Club that they have not previously enjoyed.

Council at its meeting held on 18 March, 2013 resolved (Min. No. 57/13 refers): “That the General Manager be authorised to negotiate a lease between Council and Devonport Surf Life Saving Club with a commencement rental of $2,500 per annum, to be CPI indexed for years 2 and 3 and Council to review the rental after the expiration of the third year of the lease.”

Since this time, discussions have been ongoing with the Club regarding the lease. The DSLC remain concerned at the level of rent being requested by Council. The Club have met with local politicians raising their concerns about Council’s proposal.

Local parliamentary members Jeremy Rockliff and Adam Brooks have written to Council and copies of their correspondence have previously been provided to Aldermen for their information. Mr Rockliff also met with the Mayor and Acting General Manager to discuss the matter.

In December 2013, Council received a request from the DSLC for Council to enter into a Devonport Lifesaving Service Agreement. In response to the request, Council resolved at the December 2013 meeting (Min 346/13 refers): ITEM 10.3

“That Council thank the Devonport Surf Lifesaving Club for its proposal and advise that it will be considered as part of the 2014/15 budget process and that Council’s position regarding the lease has not altered and is required to be finalised.”

In a letter to Council dated 20 January 2014, from Doolan and Brothers, the DSLC indicated agreement with the remainder of the draft lease, subject to some minor alteration, with the exception of the rental, which it was indicated needed to be discussed further.

On 22 January 2014, the General Manager in a letter to Devonport Surf Life Saving Club President stated: “I write in reply to correspondence received from Doolan and Brothers on behalf of the Devonport Surf Life Saving Club dated 20 January 2014 and advise that its contents were relayed to Aldermen at their meeting on the same date.

The letter indicated that your Club would like to further meet with the Bluff Precinct Committee to discuss the flat rental payment previously determined by the Council.

I can advise that I was clearly instructed by Aldermen that Council do not wish to enter into any further discussions regarding this matter and that their decision is final.

As a result, I request your advice by Friday 31 January 2014 as to whether the Surf Club intends to proceed with the lease of the upstairs facility.

If necessary I am happy to meet with you should you require further clarification regarding the Council's decision.”

There has been no further correspondence since this date. A meeting was held between the General Manager, Aldermen Leon Perry and the executive of DSLC on January 24, 2014 and it was agreed this matter be brought back to Council for consideration.

COMMENTARY Council have the option of choosing from a number of alternatives to resolve this matter.

Option 1 Inform the Devonport Surf Lifesaving Club that Council’s position regarding the lease has not altered and is required to be finalised by a determined date. If this payment does not occur, Council will immediately cease access to the upstairs component of the building for the DLSC and begin the process to source new tenants. The DSLC would maintain full access to, and use of, the ground floor component of the surf club building.

Option 2 The DSLC have previously requested Council consider entering into a service agreement with the Club. In return for surf lifesaving services the Council has been asked to provide annual funding of $2,300. As mentioned earlier in this report, Council previously decided to decline this proposal.

The DSLC’s proposal seeking $2,300 per annum from Council was to support its provision of surf lifesaving and emergency response services to the Devonport community. Council has not previously had a formal agreement with the DSLC but have supported them with grant funding on various occasions to assist with specific requests.

Given the delays in finalising a lease agreement between Council and the DSLC for the building, the agreement to an arrangement such as this is considered by some as an opportunity to resolve the matter. Indications from the Club President are that signing such an agreement would address the concerns the Club has in regard to the financial viability of paying the proposed rental.

Alternatively, it could be argued that the request for annual funding should be considered in isolation to the building lease as they are separate matters.

Council currently provide a significant contribution to the DSLC through the provision of a facility. The ground floor component of the new surf club building is effectively provided free of charge to the DSLC for life saving activities with the upstairs social facilities being offered for a rental of $2,500 p.a.

Should Council enter into a service agreement it would be reasonable to recognise the significant contribution Council makes in the provision of the surf club building.

It is unknown whether similar arrangements exist between other surf clubs and local Councils and what if any the risk implications there are for the organisation through agreeing to the proposed service agreement.

Council may wish to revisit its previous decision and reconsider the proposal from the DSLC. Option 3 Similarly to Option 2, Council may require the DLSC to pay a rent of $2,500 per annum and agree to enter into a partnership agreement less than the figure suggested by the DSLC, providing a contribution to surf lifesaving services.

The issues and points of discussion are similar to those identified for Option 2.

The Mersey Bluff Working Group have discussed this option and explored contributions ranging from $1,000 to $2,500. It would be up to Council to determine an amount they see as appropriate contribution towards the activities of the DSLC. This would occur as part of the 2014/15 budget deliberation process.

Option 4 Council may wish to offer the facility at a peppercorn rent. The ground floor component of the new surf club building is already provided free of charge to the DSLC for life saving activities and Council may wish to elect to provide the upstairs area for a peppercorn rent as well.

Prior to entering the new refurbished building, the DSLC did not pay rental for their old premises, however the new building has significantly improved their ability to raise revenue through increased bar and function room patronage.

If this approach was undertaken, it is recommended a review is scheduled in three years to revaluate the appropriateness of the peppercorn rent.

Option 5 A further alternative for consideration is to introduce a fixed rent component in addition to a variable rent component. The value of this model could alter, however Council may consider requesting the DSLC pay a rent of $1,500 per annum in line with the lease agreement prepared for the upstairs section of the building and agree to pay to Council an amount of $50 for each and every external rental of the facility that the DSLC attracts to the building.

This arrangement may have a cap at $2,500 as per the current offer.

The advantage of this model is that it may alleviate some of the concerns of the DSLC about their ability to generate sufficient revenue to afford a higher rent. Based on current usage of the facility, the club would certainly hold enough functions to meet the cap suggested above.

FINANCIAL IMPLICATIONS Operating Budget As a result of this matter, there may be an increase to Council income of up to $2,500.

Depending on the option chosen by Council, this increase to income may vary from $0 to $2,500. No allocation has been made in the 2013/14 operational budget.

RISK IMPLICATIONS 

Communication/Reputation The protracted nature of the lease negotiations has the potential to detrimentally impact the relationship between Council and the DSLC. It is possible media coverage of this matter may also impact the reputation of either of the organisations.



Financial Inconsistent application of rent charges increases the possibility that other clubs within the community will challenge or question the rent charged to them for their facility.

Since July 2012, Council has expended the sum of $3,726.00 in legal costs of having the lease document drawn up and altered to reflect changes in accordance with negotiations between both parties. Further changes to the lease document will incur additional costs.

CONCLUSION The issue of the appropriate level of rental to be charged to the DSLC has been an ongoing issue for Council since the building was redeveloped.

Despite Council determining its position the DSLC has continued to dispute that the rental proposed is appropriate and have argued that Council should provide recognition of their community service to Devonport and not charge them a rental for the building.

It is apparent that Council have a number of options open to it in finalising its position in relation to this matter. Five (5) options have been outlined in the recommendation section of this report to assist Council in determining its final position in relation to this matter.

RECOMMENDATION That Council in relation to the lease agreement with the Devonport Surf Life Saving Club determine to advise the Club: Option 1 (a)

that Council’s position in relation to the rental is unchanged and that the Club has until 14 April 2014 to sign the lease agreement and commit to paying to the Council an annual rental of $2,500 per year (adjusted by CPI in year 2 and year 3 of the lease period); and

(b)

failure by the Club to sign the lease will result in the Club being evicted from the upstairs section of the building.

Option 2 (a)

(b)

Council will enter into a partnership agreement providing $________ per annum as a contribution to Surf Club in recognition of the community service the Club provides to the Devonport community.

Option 3 (a)

it is to pay a rent of $2,500 per annum in line with the lease agreement prepared for the upstairs section of the building; and

(b)

Council agrees to enter into a partnership agreement for an amount to be determined by Council as part of the 2014/15 budget deliberations, in recognition of the community service the Club provides to the Devonport community.

Option 4 that it has determined that in recognition of the community service that the Surf Club provides to the Devonport community that a peppercorn rental of $1.00 (if demanded) will be applied for a period of three years, after which the matter will be further reviewed.

Option 5 (a)

it is to pay a rent of $1,500 per annum in line with the lease agreement prepared for the upstairs section of the building; and

(b)

agree to pay to Council an amount of $50 for each and every external rental of the facility that the Surf Club attracts to the building.

Ensure effective and transparent communication to meet the needs of customers

PURPOSE This report provides a summary of the activities undertaken by the General Manager 12 February – 12 March 2014. It also provides information on matters that may be of interest to Aldermen and the community.

BACKGROUND The report is provided on a regular monthly basis and addresses a number of management and strategic issues currently being undertaken by Council. The report also provides regular updates in relation to National, Regional and State based local government matters as well as State and Federal Government programs.

COMMENTARY 1.

COUNCIL MANAGEMENT 1.1.

Met with a representative of The Advocate Newspaper to discuss issues that Council has experienced with statutory advertising in recent times.

A commitment was provided that the issues would be addressed to ensure no future confusion was created.

1.2.

Attended and participated in a number of internal staff and management meetings.

1.3.

Attended Council Workshops and Meetings as required.

1.4.

Visited Tiagarra to view the facility.

1.5.

Council Website – an internal working group is currently reviewing the Council web site and Intranet. Council allocated $20,000 towards web development in the Communications budget this financial year. It is acknowledged that there has been minimal development over time, and an ongoing lack of internal coordination and updating of information has made the site outdated and less informative than it should be A plan is being prepared to have the current site reviewed and updated with current information in the interim until a new web platform is implemented.

Based on my understanding of the process there was a requirement for at least 50% of the ballots to be returned and of those votes returned at least 50% had to be in favour – the result is therefore that the Protected Action ballot was approved.

As previously advised there are a number of actions (as listed above) that the ASU can now pursue in support of their wage claim within 30 days of the ballot.

Once a particular action has been commenced it can then be ongoing while the matter of the EA remains outstanding. Any action not commenced within the 30 day period cannot be undertaken.

Negotiations are continuing and advice received from the ASU is that through their discussions with staff there are currently no immediate plans to commence any of the listed Protected Actions.

Council has placed its revised Strategic Plan on public exhibition. The Strategic Plan is on exhibition for a period of five weeks during which time the public are being asked to comment on the document. A report on the outcome of the consultations will be provided to Council at its 14 April 2014 meeting.

LIVING CITY 4.1.

Attended the media announcement relating to the purchase of the Harris Scarfe building by Council. The event included the Mayor, Bruce Gowans (Taskforce member) and Craig Badcock (representative of the building owners).

4.2.

Attended a briefing session with a number of business representatives in relation to the LIVING CITY project following the announcement that Council had acquired the Harris Scarfe building.

4.3.

Met with Consultant Grant Hirst in relation to the Living City project. Mr Hirst also provided a presentation to Aldermen at a Workshop.

4.4.

Attended a briefing to the Devonport Chamber of Commerce and Industry on recent developments associated with Living City.

COMMUNITY ENGAGEMENT (RESIDENTS & COMMUNITY GROUPS) 5.1.

Met with the General Manager of 7AD and SeaFM as an introduction. Agreed to participate in a radio interview as an introduction to the Devonport community in my role as General Manager.

5.2.

Attended a Devonport Chamber of Commerce and Industry Women’s Lunch as their guest speaker. Provided some of my background and my first impressions of Devonport and the challenges ahead for Council.

5.3.

Met with a local long-term resident of Devonport who provided a background history of the establishment of the Devonport Recreation Centre.

5.4.

Met with representatives of the Devonport Soccer Club regarding maintenance issues at the Valley Road complex. As a result of this meeting a review of the frequency of mowing of the second ground, which is generally used for training purposes, has occurred.

5.5.

Attended the Devonport Food and Wine Festival Launch at the Devonport Entertainment and Convention Centre. This year’s booklet was launched at the event.

5.6.

Attended the official launch of the Don River Railway Royal carriage.

Tasmanian Governor, Peter Underwood was the official guest at the event.

5.7.

Attended the Diamonds of Devonport dinner.

5.8.

Attended the Taste of the Harvest launch at Roundhouse Park on 7 March 2104.

5.9.

Met with representatives of the owners of Australian Weaving Mills relating to preliminary considerations for the future uses of this site.

NATIONAL, REGIONAL AND STATE BASED LOCAL GOVERNMENT 6.1.

Attended a meeting, as an appointed representative for Devonport City Council, of the Dulverton Regional Waste Management Authority.

Also attended a Special Meeting of the Authority. Items discussed at these ITEM 10.4

meetings were of a confidential nature and the minutes were referred to Council in Closed Session.

6.2.

Attended a meeting of the Cradle Coast General Managers Group. Items discussed at this meeting included day to day operational matters within the respective councils, project updates including the Visitor Services Review and NRM opportunities available to the region.

6.3.

The report of the Auditor-General on the financial results of Local Government Authorities for 2012-13 was tabled in Parliament in December 2013. A full version of the report can be found on the Tasmanian Audit Office website.

The measures of financial performance in the Auditor-General’s report are included to allow ease of comparison across councils. The underlying result excludes items that are considered to be non-operating such as capital grants and contributions.

Devonport’s net surplus of $4.584M for the 2012/13 year is well above the State average of $.862M however a large part of this is due to capital grants received in relation to the development of the Aquatic Centre. The more important figure is the underlying surplus / (deficit) which Devonport recorded ($0.047M) compared to the State average of ($0.260M).

STATE AND FEDERAL GOVERNMENT PROGRAMS 7.1.

Attended the official opening of the Splash Devonport Aquatic Centre. The new facility was jointly funded by the Australian Government, the State Government and the Devonport City Council. The official opening was performed by Brett Whiteley MP, Premier Lara Giddings and Mayor Martin.

7.2.

A review of Council’s current compliance with the content of the Ministerial Orders is currently being undertaken to ensure that any action/s that may be required are implemented.

7.3.

The State Grants Commission recently requested comments on their methodology discussion papers. A copy of the response provided is attached for the information of Aldermen. Anyone interested in accessing a copy of the discussion papers should contact the office and this will be arranged.

7.4.

The State Grants Commission will be conducting a visit to Devonport on Monday 31 March at which the Mayor, General Manager and Assistant General Manager – Technical & Finance will provide further comment on Devonport’s written response.

7.5.

Formal advice has been received from the Department of Infrastructure and Regional Development that the Australian Government has announced that the Roads to Recovery Programme will be extended for another five years from 1 July 2014 to 30 June 2019. The funding conditions and allocations for this new program will be determined in the next few months and communicated to councils.

7.6.

The State Government has recently amended the Fire Services Act 1979 requiring that Fire Area Management Committees be implemented across the State. Devonport is included in the Central North Fire Management Area Committee together with Latrobe, Kentish, Central Coast and part of Meander Valley. Membership of the Committee is made up of representatives from each of the nominated councils, Tas Fire, TasWater, Forestry Tasmania, Aurora Energy, Hydro Tasmania, Tasmanian Farmers & Graziers, Transend and the Conservation Partnerships area of the Department of Primary Industry, Water and the Environment. The objective of the Committee is to develop a fire protection plan for the central north to be completed by October 2014.

Presently Council’s representative on the Committee is the Emergency Municipal Co-ordinator.

FINANCIAL IMPLICATIONS Any financial or budgetary implications related to matters discussed in this report will be separately reported to Council.

Promote open communication and cooperation with Local and State governments in regional initiatives

PURPOSE This report is provided to assist Council in considering submitting a motion to the Local Government Association of Tasmania (LGAT) General Meeting in July 2014.

BACKGROUND Council has received advice from LGAT that the Annual General Meeting and General Meeting of the Association will be held at Wrest Point Casino on Wednesday 23 July 2014.

LGAT’s annual conference will be held on Thursday 24 and Friday 25 July at the same venue.

All member Councils have been invited to submit motions on matters connected with the objectives of the Association or of common concern to members for inclusion in the agenda of the General Meeting.

It is planned to distribute the agenda to Councils on Wednesday 25 June 2014 and motions have been requested to be received by the Association no later than close of business on 14 March 2014.

An extension of time for the submission of the proposed motion from Devonport City Council has been agreed with LGAT providing it is received no later than 18 March 2014.

COMMENTARY Ald Kent suggested that a motion be submitted to LGAT in relation to statutory notices required under local government legislation. The matter was the subject of a brief discussion at the Workshop on 24 February 2014.

Currently all statutory notices are required to be advertised in a newspaper circulating daily in the municipal area. This requirement includes notifications in relation to planning matters, convening of meetings, etc.

With the reduction in the number of people accessing newspapers in the traditional form, this requirement should be removed. In relation to planning notices these are attached to the property concerned and all adjoining land owners are notified in writing when a matter is considered to be of a discretionary nature.

In relation to meeting notices this is an added cost that provides little, if any benefit.

Councils usually meet on the same day and time each month. With the majority of residences now having access to a computer and connection to the internet (NBN or ADSL) the important place for advising of matters relating to activities (including formal notifications) is the front page of a Council’s website.

FINANCIAL IMPLICATIONS Operating Budget The cost to Council in statutory advertising is not insignificant and any changes would provide savings to future budgets.

RISK IMPLICATIONS There would be minimal risks associated with the proposed removal of statutory advertising from newspapers circulating daily in the municipal area. There may be a limited number of people who currently find out information under this medium.

CONCLUSION The proposed motion would at least start the conversation with the State Government and may result in a more appropriate notification format being agreed.

LGAT has a communication protocol which it uses to disseminate information and decisions as a result of General Meetings of the Association.

FINANCIAL IMPLICATIONS Operating Budget Council contributes to LGAT through payment of subscriptions. Any decisions reached at General Meetings may have an impact on Council’s finances.

The motion relating to a plebiscite to be held in conjunction with the 2014 local government elections would come at a significant cost which would have to be paid by the Tasmanian local government sector on a population/voter proportional basis.

A plebiscite held in Tasmania only is likely to have limited impact and it is hard to justify the costs that it would incur against any future benefits which might be achieved.

RISK IMPLICATIONS There are no risks which have been identified in relation to the contents of this report. Any risk is dependent on the outcome of decisions which are reached at the General Meeting.

CONCLUSION The LGAT General Meeting agenda items have been listed for the information of Aldermen and to allow comment and/or direction to be provided to the Council’s voting delegate in relation to any matter.

Operating Budget The Cradle Coast Authority has reimbursed $352.55 of the accommodation costs that relate to the Master Games meetings.

It should be noted that the total budget allocations for 2013/14 for accommodation and meals have been expended. The Aldermen Support cost centre overall is still tracking within budget.

Basketball Social roster commences next Monday, team numbers are down this year.

Senior roster will commence on Saturday and juniors are now in training.

Squash Pennant starts next week. Numbers are down this year. At a meeting held last night the possibility of a PSA tournament coming to Devonport was discussed.

Table Tennis There has been an increase in membership from 40 to 50. Now have full courts.

Junior numbers have increased. A questionnaire has been sent to all players (including Ulverstone players) to ask what other night they would like to play and what kind of roster. Rosters will commence in the last week of February.

Playhouse No report. The Playhouse was closed all of January 2014.

RECREATION OFFICERS REPORT The Committee was given a handout of statistics and budget.

GENERAL BUSINESS 7.1

Devonport Recreation Centre Units The units are now managed by the Basketball Club. All five units are now occupied with good tenants. It was previously discussed that an independent subcommittee be formed to receive reporting on the units from the Basketball Club on a quarterly basis and then for that subcommittee to report back to the Devonport Recreation Centre Committee at each meeting.

The Committee recommends to Council that a subcommittee be formed as a reporting mechanism for the operations of the Devonport Recreation Centre Units and that this subcommittee receives reports from the Devonport Basketball Club on a quarterly basis.

Swipe Cards Casual staff will continue to be at the Centre from 9am to 5pm, Monday to Friday. Swipe card access has now been installed on the majority of access doors. The cards will be $15 each plus a $15 bond. A FAQ document will be finalised soon and information will also be posted around the Centre explaining the new system. The Committee is asked to provide any feedback or questions to either Council’s Marketing, Tourism and Recreation Manager or Sport and Recreation Coordinator.

Table Tennis Centre Floors The floor in the south eastern corner is slippery. This will be monitored.

Budget Items The next meeting will be held at the Centre with a walk around to highlight recommendations for future budgetary discussion.

EAST DEVONPORT RECREATION AND FUNCTION CENTRE OFFICER’S REPORT Volleyball has commenced on Monday, Tuesday and Wednesday nights and badminton on Sunday nights. Community House classes have recommenced along with Thai Chi. Volleyball is undertaking maintenance on courts and removing garden beds. Both the holiday program and Lillium Show were a success with bookings made again for next year.

Devonport Touch Association Season finishes on 7 March 2014. David De Cani reported that so far the season has been very successful. Also conveyed the associations appreciation of the manner in which the grounds are presented. Council’s assistance is greatly appreciated. The DTA has formed a good relationship with Rugby with four games held at Meercroft this year, using DTA amenities.

A carriage was vandalized by graffiti taking volunteers up to 6 hours to remove.

Acknowledge, preserve and celebrate local art, culture and heritage, including indigenous art and culture

PURPOSE To present the minutes of the Public Art Advisory Committee meeting to Council and for Council to consider providing support towards a public art project.

BACKGROUND The Public Art Advisory Committee (PAAC) provides advice to Council on the development, management, coordination and preservation of Devonport’s public art resources. The Committee reviewed the Public Art Policy and Guidelines in 2012 and these were adopted by Council at its meeting held 18 March 2013 (Min Ref 69/13).

COMMENTARY At the PAAC meeting held 4 March 2014 committee members were presented a public art proposal by Devonport RSL member, Glenn Morse. The proposal involves marking the 100th anniversary of the Gallipoli evacuation (20 December 2015) with a contemporary memorial honouring Captain Charles Littler’s role.

It is believed that Captain Charles Littler was in the last steamboat to leave Anzac Beach on 20 December 2015 and is reputed to have been the last Australian to board the vessel.

Hence, he would represent the last physical contact that Australia had with Gallipoli.

Charles Littler was born in Launceston in 1868 and married Helen Cotgrave Thomas in Devonport in 1892. They had three sons and lived in Devonport when Charles enlisted as a lieutenant on 16 December 1914. Charles was killed on 3 September 1916 and is commemorated at the Australia National Memorial at Villers-Bretonneux in France as one of the 10,762 Australians who died in France.

The Committee discussed the historical accuracy of the information and requested further confirmation from the Australian War memorial or similar.

An allocation for public art is provided in the 2013/14 capital budget of $10,000. The PAAC recommend to Council that these funds be directed towards phase 1, 2 and part of phase 3 of the commissioning process, as outlined above. Funds are usually required to pay up to three artists, selecting through EOI process, for their time and materials to develop a model of their designs. Once preliminary concept designs are developed Council endorsement of these designs would be required to continue the project. It is expected that the Devonport RSL would seek external funding towards the project.

Development of concept designs would assist to strengthen funding submissions by the Devonport RSL.

FINANCIAL IMPLICATIONS Operating Budget Should the project come to fruition, there will be an increase to Council’s expense for maintenance. The exact amount would depend on materials used, however would likely to be less than $1,000 per annum.

Capital Expenditure The capital expenditure referred to in the Council Report is included in the current Capital Expenditure budget. Additional funds would be expected to be raised by the Devonport RSL through grants and sponsorship.

Long Term Financial Plan Should the project come to fruition there would be a minor financial impact on the Long Term Financial Plan.

RISK IMPLICATIONS 

Financial Loss of funds expended on conceptual designs, should the project not receive external funding.

CONCLUSION It is believed that a memorial commemorating the evacuation of Gallipoli is not existent in Australia at present. Given Captain Littler’s ties to Devonport a memorial would be relevant to the city’s history and sense of place. Should the Council provide in principle support and funds towards concept development an agreement with the Devonport RSL would be developed outlining both parties’ responsibilities up to this point. Further endorsement would then be sought by Council for project development and implementation.

Should Council resolve not to support the proposal, a letter to Devonport RSL will be prepared thanking them for their idea and interest.

Provide and maintain Council buildings, facilities and amenities

PURPOSE To provide information and options for Council to consider in relation to the repair, replacement or removal of the roof over the Arnold Richardson Grandstand located at Girdlestone Park, East Devonport.

BACKGROUND This report summarises information presented to Council related to the condition and options to address corrosion and maintenance issues associated with the Arnold Richardson Grandstand (depicted in Figure 1). The background issues and the options have been presented at a number of workshops and within Council reports over the past 3 years. At a recent workshop held on Monday 24 February, Alderman also considered a further repair option for the retention of the grandstand roof.

COMMENTARY Council has allocated $70,000 within the current 2013/14 Capital budget for the replacement of the Arnold Richardson grandstand roof. The issues associated with condition of the existing roof structure and options to replace, repair or remove have been considered by Council and workshopped on several occasions. Reports on the matter have previously been presented to Council meetings on 18 February 2013, 18 November 2013 and 17 February 2014.

The options previously outlined are: A.

Roof replacement/refurbishment including repair and grit blast and painting of existing steel trusses, replacement of purlins, roof cladding and trims.

B.

Remove the roof structure completely. This option will retain the existing concrete tiered seating and walls only. This option requires alternative arrangements for East Devonport Football Club (EDFC) training lights which are currently fixed to the grandstand roof.

C.

Remove the roof & trusses (some) completely and construct a shade structure over part of the existing tiered grandstand seating. As before, this option has implications for the training lights. (since deleted as not a viable option)

D.

Part replacement of the roof structure as described in option A. i.e. limit the roof renewal to half the existing area.

At the Council workshop held on 24 February 2014 a further option E was discussed. This option outlined low cost repairs as follows; E.

Modify and make good seven existing truss/wall connections, renew selected corroded purlins (end bays) and the purlin extending full length on the western side of the roof. The scope also includes grit blast & repainting of the two outside trusses only and reuse/refix the existing steel 0.42 BMT Trimdek roof cladding over the two end bays. It is recommended that the installation of new knee bracing would be included between the columns and the longitudinal transfer truss as part of option E. The cost for option E has been estimated to be approximately $30,000.

Previous Engineering Condition Reports An external engineering assessment of the grandstand structure was obtained in April 2011 and again in February 2013. Refer to the attachments 1 & 2. The reports detail recommendations for structural repair and replacement works to ensure that the structure is restored to a suitable aesthetic and functional performance level.

The recommendations also consider relevant current Australian Design Codes.

In summary the key engineering recommendations contained within the assessment reports are: 1.

Upgrade roof truss connections to the rear concrete wall (refer to figure 2)

2.

Grit blast clean and paint all primary steel framing members (refer to figure 3)

3.

Replace purlins , cladding, gutter and flashings (refer to figure 4)

4.

Add Circular Hollow Section (CHS) knee brace between columns and longitudinal transfer truss (to improve stability)

5.

Replace the existing 0.42 BMT Trimdek profile roof sheeting is with 0.48mm BMT (Base Metal Thickness) custom orb profile sheeting.

The extent of work associated with the various recommendations has been factored into the scope of work and also the estimated cost for each option.

The new Option E (described above) has also been reviewed against the engineering recommendations contained within the reports. The likely compliance is summarised below: Engineering recommendation 1 – Fully addressed Engineering recommendation 2 – Partly addressed Engineering recommendation 3 - Partly addressed Engineering recommendation 4 – Fully addressed Engineering recommendation 5 – Not addressed (Existing roof sheeting is not compliant with current design codes. Care will be needed in refixing of old sheets to reduce risk of failure in high winds) Notwithstanding the lower cost of Option E, this option has the benefit of deferring some of the costs associated with the recommended repairs and capital expenditure. This deferred work includes the remaining purlin replacement, truss painting and roof replacement. It is difficult to be definitive on timing, however it is likely the deferred works may be required within a 5-10 year period. The deferred work related to corrosion treatment (grit blast & painting) may result in an acceleration of the rate of corrosion and

deterioration. This may ultimately impact on the structural integrity of the supporting structures over time.

In summary, if Option E were adopted it is likely to provide a suitable level of service for the immediate future, however there is some additional risk to Council by way of future structural deterioration and repair cost. The risks would initially be low, however they may progressively increase over time. The monitoring of the roof structure condition and the timing of future maintenance would therefore be important.

Options eliminated from consideration Other shade and shelter options have been considered. These options included permanent and demountable shade structures and also tree planting. The alternative options have been determined as not being suitable due to higher life cycle cost, vandalism/risk issues, operational issues for user groups and because the option was unsuitable in offering protection from wind and rain. These options have therefore been excluded from further consideration.

This has left four final options for consideration, as listed in Table 1.

Additional Information: Consultation and User Group requirements There has previously been consultation with Girdlestone Park ground user groups. The East Devonport Football Club (EDFC) has raised its concern that without a functional roof over the grandstand the Club may miss out on a future allocation of football final games at the ground.

The Devonport Little Athletics Club (DLAC) has also responded and advocated that the Arnold Richardson Grandstand be maintained with a functional roof cover. The Club has identified that its Saturday and Monday evening competition has certain requirements and the grandstand is integral to their operations. The key points identified by the DLAC in support of a functional roof over the grandstand are;  

  

Proximity to assembly/congregation area. The stand is conveniently located close to event areas, toilets and away from the bitumen car park area (child safety).

The grandstand provides a functional viewing area which is suitable for participants and spectators The grandstand is conveniently located for marshalling of competitors and is central for the existing public address ( PA) system

It is noted that the existing DLAC administration activity is centred adjacent to the grandstand and the nearby scoreboard structure (refer to Figures 5&6). The storage and recovery of operational and sporting equipment is contained within the scoreboard structure. The PA system is clearly integral to the coordination of events and this has been developed around the existing layout of athletic activities both on the ground and also the areas adjacent to and behind the grandstand.

To assist in minimising the impact on the DLAC previous reports have recommended Council contribute $1500 to the Club for the purchase of portable shade structures should the full roof removal proceed.

FINANCIAL IMPLICATIONS Operating Budget While an allocation has been made in Council’s 2013/14 capital expenditure budget for this project, options B and E involve purely operational expenditure and would be expensed at year end, rather than capitalised.

Capital Expenditure Council have allocated $70,000 in the 2013/14 Capital Expenditure budget. The options outlined in this report allow for alternative lower capital costs.

Long Term Financial Plan The changes in this report will not have an impact on the Long Term Financial Plan.

RISK IMPLICATIONS 

Work Health and Safety Projects within the capital program include activities designated as High Risk under the model Work Health and Safety Regulations Part 6.1, R291. Hazard identification, risk assessment and development of safe systems of work are required to be carried out on all projects.

Political/Governance Any decision to downgrade levels of service should be carefully considered and appropriate community engagement processes implemented.



Assets, Property and Infrastructure The key risk is public safety resulting from structural failure of the existing roof components. This risk must be considered and mitigated through proper asset management planning and maintenance decisions.



Financial Capital works and budgets must be considered and implemented in accordance with good asset management practice, policy and principles.



Environmental/Public Health The service function and performance of council assets must be planned and managed to maintain public safety.



Communication/Reputation Council must consider and carefully manage the risk of adverse public reaction to any decision to lower current levels of service. This issue has already attracted negative media coverage.

CONCLUSION Council has tentatively allocated $70,000 for the roof replacement in the 2013/14 capital budget. The roof structure components on the Arnold Richardson Grandstand are badly corroded and require replacement, repair or removal. The options, costs and risks have been considered and the service level impact on the community/user groups has been noted. Council has been briefed on the matter and provided with reports and information to assist in making a decision.

PURPOSE To award a contract for “Kelcey Tier Road Safety Improvements”.

BACKGROUND This report considers tenders received for “Kelcey Tier Road Safety Improvements” listed within the 2013/14 Capital Works Program. The project involves installing a gabion wall to support the embankment allowing shoulder widening and the installation of guard rail barrier. It is a continuation of similar works undertaken last year further up the road. A third and final section is included in Councils 5 year capital program for 2014/15. The project is partly funded by a Federal Government Black Spot grant.

COMMENTARY Tenders were publicly advertised and at the nominated closing time tenders were received from three companies. All tenders received are conforming tenders and are summarised in Table 1: Table 1 CONTRACTOR

From the Table 1 summary, Tamar Valley Construction Pty Ltd ($268,092.00) is the lowest priced tender. Tamar Valley Construction Pty Ltd consists of directors and management which previously traded as BPS Pty Ltd. The tender panel considered a number of other selection criteria other than price of which Tamar Valley Construction Pty Ltd scored poorly in comparison to the other 2 tenderers.

The Tamar Valley Construction submission indicates they will be unable to meet the Practical completion date of 12 May and will be unable to complete the work within the 2013-14 financial year. It should also be noted that Tamar Valley Construction P/L does not appear to have a fully audited or compliant IMS system and has not demonstrated

suitable experience related to this type of project. Some performance issues have occurred on previous projects undertaken for Council by BPS Pty Ltd. Both Kentish Construction and Engineering Company Pty Ltd and Gradco Pty Ltd have demonstrated that they have a fully accredited Integrated Management System (IMS).

Both companies have experience with this type of work.

Kentish Construction and Engineering Company Pty Ltd’s previous performance for Council has been of high standard and work has been completed in a timely manner.

Gradco Pty Ltd have not completed work for Council but have suitable references.

Taking into account the information provided in relation to the selection criteria and the tendered rates, Kentish Construction and Engineering Company Pty Ltd has achieved the highest total score and is therefore most likely to offer “best value” and performance in relation to Contract 1257.

Kentish Construction and Engineering Company Pty Ltd have provided an alternative construction method with a potential savings of between $20,000 and $30,000. Council officers are currently investigating this option in conjunction with the project’s consultant designers (Tasmanian Consulting Services). At the time of writing it appears that the suggested design changes will achieve the required outcome and Tasmanian Consulting will finalise the detail and quantify the saving prior to awarding the contract.

In addition to the works included in the tender there is project costs for design, project management, overhead and contingency (refer table 2). The total estimated cost for this component of the project is $50,000 (excluding GST).

FINANCIAL IMPLICATIONS Operating Budget There is not expected to be any impact on the Council’s operating budget as a result of this recommendation.

Develop and maintain a long term Capital Improvement Program

PURPOSE To inform Council of the progress and matters related to the 2013 /14 capital works program.

BACKGROUND The attachment to this report is a summary view of the current status of Council’s 2013/14 capital works program and reflects project priorities and progress. The program does not depict preconstruction tasks which occur before work starts on site (i.e. design, consultation, tendering etc). This representation allows a clearer picture of when physical site construction is planned to start and finish for a particular project and also provides an indication of actual progress against what was planned. Council has approved a $17,126,515 capital expenditure budget for 2013/14.

COMMENTARY Recently completed projects include the Bluff walking track (Aitkenhead Point) renewal and the cycleway reseal program. The car park technology upgrade ticket machine procurement is complete with software and operational trials now in progress, before site installation is undertaken.

The North Street pavement reconstruction, the Massey Place and Fergusson Drive reconstruction, Stony Rise pathway, the reseal program, DECC Lighting Control surround and the manhole lid replacement projects are now in an advanced stage of construction. Recent project commencements include, the Victoria Parade shared pathway upgrade, Ronald Street reconstruction, and the public open space furniture replacement.

There are a number of projects scheduled to commence soon. These include River Road widening, the Kelcey Tier Road Safety Improvements, Forbes Street Overpass Guardrail, Lovett Street footpath link, William Street Stormwater, and the Art storage facility solar power. The Energy Efficiency – Building CEEP project is expected to get final sign off from the Federal Government soon. This will then allow the rollout of a number of energy efficiency projects.

There have been several projects rescheduled/delayed for various programming reasons.

These changes will be reflected in the quarterly March review of the capital program.

The fleet, plant and equipment replacement programs and furniture and fittings purchases are progressing with planning and purchasing arrangements for a number of items completed. The IT is out of step with the program but procurement is expected to occur well before 30 June 2014.

PURPOSE To seek Councils determination on proceeding with the unbudgeted replacement of lights for the badminton courts in the Youth Centre at the Devonport Recreation Centre.

BACKGROUND The lighting in many parts of the Devonport Recreation Centre is nearing the end of its useful life and Council have been progressively replacing the existing fixtures as budget allocations allow.

The main stadium has recently been updated with new LED fittings.

Band-Aid measures have been applied to the lighting in the Youth Centre (badminton hall) with a view of deferring replacement until the 2014/15 financial year.

There are 62 light tubes within the hall, prior to repairs last year approximately half of these were not working. Currently 17 out of the 62 do not work and are not repairable.

COMMENTARY In recent times users of the badminton area have become particularly vocal in their concerns regarding the deteriorating condition of the lights.

Appendix 1 includes photographs indicating the current lighting levels in the badminton hall.

While the lighting does need upgrading and is far from optimum the photographs indicate that there still remains a base level of lighting within the building.

It is agreed that the upgrade is required, however considering the item is unbudgeted it would not be unreasonable to wait until the next financial year before proceeding.

Alternately with replacement imminent Council could determine to proceed immediately minimising the time during which users have to preserve with a lower standard of lighting.

The badminton season commences with a winter roster on 26 March and continues until the first week in September and the summer roster starts at the end of September finishing early December.

Delivery of the light fittings is estimated to be two weeks from the date of order. Installation will take approximately one week once fittings are received.

FINANCIAL IMPLICATIONS Operating Budget The cost to install new LED high bay lights and undertake necessary switchboard modifications is estimated to be $26,000 exc. GST. No allocation has been made for these works in the 2013/14 operational budget and proceeding would result in an over spend of the building maintenance budget by $26,000.

Current forecasting indicates Council is likely to end the year ahead of its budgeted operating result and therefore could accommodate these works this financial year if necessary.

Capital Expenditure Replacement of the light fittings is considered an operational expense.

Long Term Financial Plan The changes in this report will not have an impact on the Long Term Financial Plan.

RISK IMPLICATIONS 

Assets, Property and Infrastructure Lighting fittings have been repaired and patched as much as possible further modifications and patch ups would be considered unsafe.



Communication/Reputation Badminton fraternity have been vocal in expressing their concerns with the lighting.

Further delays could see this escalate.

CONCLUSION Lighting in the Youth Centre does need replacing for badminton users. Council is being asked to address the issue immediately rather than wait until the next financial year, as previously planned. Proceeding would result in an over spend of the building maintenance budget however current forecasts indicate that this would not result in Council exceeding its overall budgeted operating position.

Manage strategic urban development to support the “Go for Growth” initiatives that supports the primacy of the CBD and reduces fragmentation

PURPOSE To seek Council endorsement to proceed with an expression of interest process for the development of properties at 6-10 Steele Street, 21-23 King Street and 25 King Street Devonport.

BACKGROUND The Devonport CBD Investment and Development Strategy adopted by Council in December 2012 (Min Ref 320/12) aims to establish Devonport as the retail and service hub of the region. The strategy identified the opportunity to restructure the City into three key precincts: 

Business/Services Precinct in the southern CBD;



Retail Precinct linking the two existing CBD retail areas; and a



Waterfront Precinct linking the CBD and the Mersey River.

The concept of three precincts was presented to the public as part of the Principles Plan at the launch of LIVING CITY in March 2013. Based on the positive response during the community engagement process, Council formally adopted the Plan in May 2013 (Min Ref 127/13).

The future consolidation of business and services in the southern CBD aims to create a strong purpose and identity for that part of the City, building on the existing concentration of similar uses that already exist in the area.

Key strategic properties were identified in each of the three precincts and Council have taken the opportunity to purchase properties as they have arisen. The three Council owned properties in the Business/Services Precinct are: 

6-10 Steele Street;



21-23 King Street; and



25 King Street.

6-10 Steele Street is currently tenanted by the Goodstone Group and the two properties in King Street are vacant. Council officers have spoken with representatives from the Goodstone Group along with neighbouring land owners regarding a possible expression of interest process.

COMMENTARY Since the launch of LIVING CITY, Council have been approached by a number of parties enquiring about possible commercial development in City. In keeping with the principles of LIVING CITY, any future growth in business services is ideally consolidated in the southern CBD. This expression of interest process aims to identify potential developers who will progress Council’s objectives for the southern CBD and ensure final master plans align with the market needs.

Council have committed to releasing LIVING CITY master plans by December 2014. Work on the master plans is progressing well and the results of this expression of interest process will assist in the completion of the plans for public release.

The process seeks interest in either 6-10 Steele Street as Parcel A and/or 21-23 King Street and 25 King Street as Parcel B. There are currently several options for these properties and by testing if the level of interest is genuine, Council will be better positioned to maximise returns on the sites.

The property at 6-10 Steele Street is a prime CBD location and several of the concept plans drawn up in the past have highlighted an iconic building on this site. It marks the start of the CBD from the Southern entrance to the City and is a prime waterfront position.

It is proposed to release the expression of interest document prior to the end of March 2014 and allow an eight week period for responses to be provided.

FINANCIAL IMPLICATIONS Operating Budget There is not expected to be any impact on the Council’s operating budget as a result of this recommendation; however there will be an impact into the future if properties are sold.

Capital Expenditure There is not expected to be any impact on the Council’s capital budget as a result of this recommendation, however there will be an impact into the future if the properties are sold.

Long Term Financial Plan Any potential changes resulting from the expression of interest process in this report have not been factored into the Long Term Financial Plan at this stage. If Council agree to sell the site or enter into a ground lease, the various scenarios will be included in the Long Term Financial Plan.

RISK IMPLICATIONS 

Political/Governance Council have committed to releasing the LIVING CITY master plans by December 2014 and by calling for expressions of interest prior to the release of the plans may be perceived as acting prematurely. However, given the level of interest in the site it is considered appropriate to test that interest and use the information to inform the master plans.

CONCLUSION The LIVING CITY Principle Plan adopted by Council in May 2013 aims to consolidate future business/service activities in the southern CBD and the Council owned sites are considered prime locations in this precinct. Some interest has been shown in undertaking suitable ITEM 12.5

developments and it is appropriate for Council to commence an expression of interest process to progress possible opportunities. Council will be able to use the feedback from the process to help inform the master plans to be released to the public by December 2014.

The current forecast is updated on a monthly basis to reflect ant icipated changes t o revenue, expendit ure and net operat ing position. Note Commentary 1 Interest income is currently ahead of budget as a result of both higher than forecast interest rates being achieved and a higher opening investment balance than predicted during the budget process and a forecast adjustment has been made to reflect this.

2 Other revenue shows a favourable variation against budget and mainly relates to recoveries from MPES and workers compensation insurance claims. Both MPES recoveries and insurance claims are difficult to predict and the variation will be monitored. A forecast adjustment has been made. The MPES gain partially offsets the increase to the related bad debts expense as reported in other 3 Employee benefits show a favourable variation which is largely due to the number of full time equivalent employees being consistently below the budgeted number of 167 and a reduction in leave balances throughout the year.

4 Expenditure on materials and services is significantly less than budget. The favourable variation is due mainly to below budget expenditure on general materials, street lighting (expected to realign with budget in March), major maintenance, landfill services and consultants, partially offset by above budget expenditure on contractors.

5 Depreciation expenditure continues to lag behind budget largely in the following areas: urban roads, Bass Strait Maritime Centre and the Aquatic Centre and these gains are partially offset by losses in Property Management due to unbudgeted depreciation on the Living City buildings. Forecast adjustments have been made.

6 Other expenses are currently above budget and relate mainly to the write off of parking and animal infringements that have been referred to MPES for recovery and the unbudgeted additional rates remission provided to higher valued properties. It is expected that the infringement write off costs will be partially offset through future MPES recoveries reported in other income. Forecast adjustments have been made to reflect this.

7 Internal charges and recoveries are currently behind budget as a result of fewer labour hours being capitalised than planned. This trend is likely to continue and a forecast adjustment has been made.

8 The unfavourable variation in capital grants relates mainly to the timing of funding received for the indoor aquatic centre and the variation is expected to realign with budget as the year progresses.

9 Capital contributions are difficult to predict as they relate to timing of subdivisions being completed and Council taking over the related road and infrastructure assets from developers. Major subdivision contributions have occurred in July, with $380K relating to George Street and in December $1,274K relating to 180 Sheffield Road (Clayton Drive access). Capital contributions do not form part of Council's operating budget, therefore no forecast adjustment has been made in relation to this.

10 Gain/loss on disposal of assets is difficult to predict and avoided wherever possible. The majority of the loss relates to the November write-off of a number of sporting facility assets. This outcome follows the Tas Audit Office recommendation that Council should not recognise such assets that are not under Council control or do not provide economic benefit to Council. In addition the loss includes a number of road assets such as traffic lights and certain roundabouts that are placed in DIER's control on completion of the project and therefore expensed on the grounds that they are not under Council's control nor do they provide an economic benefit to Council. Gain / loss on disposal is not part of the operating budget and consequently no forecast adjustment has been made.
