GOVT OFFICIALLY TAKES OVER HORIZON SCHOOLS

O V E R N MENT has officially taken over Horizon Schools and has since changed the name to Kabulonga Trust Schools.

The schools will however continue operating as private schools under a board of directors appointed by the Ministry of General Education.

According to a notice issued by school board chairman, James Chilufya, Government took

over the school on October 6th 2020.

Mr Chilufya said all members of staff at Kabulonga Trust Schools would continue in their respective positions under the new management except for the position of school principal.

He said the position of principal had been taken over by Sidney Chilanda, a former Juniour Secondary School headteacher and Upper Primary School headteacher in Horizon Schools.

HH parries land fraud allegations

By GRACE CHAILELESOETSA UNITED Party for National Development (UPND) president Hakainde Hichilema has denied claims by two Kalomo residents that he fraudulently obtained their land.

Mr Hichilema has asked the Lusaka High Court to dismiss the case, insisting that he legally acquired the land on Subdivision “A” of farm 1924, Kalomo in 2005.

Ms Pheluna Hatwimbo, an administrator of the estate of late Samson Siatembo and Mr Milton Hatembo have sued Mr Hichilema for allegedly obtaining their land fraudulently.

Mr Hichilema stated that the plaintiffs have not mentioned the date of the fraud or misrepresentation with regards to his acquisition and occupation of Subdivision A of farm 9124 in Kalomo.

This is according to an affidavit in support of summons to

dismiss action on point of law.

He stated that the land in question was created, surveyed, marked off and assigned to him some time in 2005.

Mr Hichilema contended that the parent certificate of title in possession of Ms Hatwimbo shows that his Subdivison A of farm 1924, Kalomo consisting of 222.6549 hectares was marked off by the Surveyor General from the parent title of farm 1924 of Kalomo on October 11, 2005, leaving a remainder of 192.9053 hectares.

He said at no time since 2005 did the two complainants or any beneficiary of the estate of the deceased (Mr Siatembo) ever complain to the police or him about the missing certificate of title to the parent property farm 1924 Kalomo.

He said Ms Hatwimbo and himself (Mr Hichilema) were the signatory of the deed of assignment relating to the land prepared by senior counsel Noah Kaponda Dindi of Messrs

Dindi and Company.

"I was registered as a proprietor of subdivision A of 1924 Kalomo measuring 222.6549hectares and a certificate of title was issued to me by the Registrar of Lands and Deeds on September 22, 2005,” he said.

Mr Hichilema said the marking off of subdivision A of farm 9124 (from the parent farm 1924 Kalomo) and the conveyance of the same to him by Ms Hatwimbo was a culmination of his purchase of the distributed portions from Mr Bernard Mazuba.

Mr Mazuba bought 2048 hectares from the estate and from other beneficiaries of the estate including but not limited to Mr Hatembo sometime between 2000 and 2005.

He said after he bought the same land from Mr Mazuba, other beneficiaries of the estate who had not sold him the land such as Mr Hatembo joined Mazuba, sold their portions to him (Hichilema).

...as L/stone Court sets Dec 14 for ruling in another HH land matter THE Livingstone High Court has set December 14, for ruling in a case in which Mr Hakainde Hichilema has asked the court to dismiss a matter in which he has been sued by a peasant farmer for trespassing and occupying three farms.

Mr. Hichilema wants the Livingstone court to dismiss on points of law a case in which Mr Misheck Hambwalula sued him for trespassing on his farms in Kalomo.

Justice Maka-Phiri set December 14 for ruling on whether the beneficiary can sue to protect the estate or properties of his late father.

such as writing a demand letter before one can sue someone.

According to the amended statement of claim, Mr. Hambwalula, who has sued as a beneficiary to the estate of his late father, George Nsemani Hambwalula, wants Mr. Hichilema to vacate farm number 3275, 803 and 801 situated in Kalomo.

Mr. Hambwalula claims that Mr. Hichilema is and was at all material times a trespasser and an illegal occupant of farm number 3275, 803 and part of farm 801 in Kalomo.

Malaria insecticide not banned, Chilufya clarifies

By NOEL IYOMBWA THE ban of Dichlorodiphenyltrichloroethane (DDT) only applies to the agriculture sector and is still allowed in public health, Minister of Health Chitalu Chilufya has told parliament.

The minister was responding to a question from Mazabuka Central Member of Parliament, Gary Nkombo, who wanted to know why Government has started using insecticide DDT a banned sub-stance in the malaria control programme.

Dr Chilufya told the house that Zambia started using DDT indoor spraying from 2002 to 2010 but stopped using the substance due to resistance to the anopheles mosquito vector which transmits malaria.

He explained that now that the susceptibility had been restored the the substance was being used again.

Dr Chilufya stated that the ban on DDT applied only to the agriculture sector but for the purposes of public health, malaria control in particular, the insecticide was still permissible by the World Health Organization.

“Mr Speaker, the use of DDT in indoor spraying shall continue as long as it remains effective in kill-ing mosquitoes “The insecticide is sprayed only inside of a structure, the Ministry of Health continues to embrace and scale up malaria interventions that targets the anopheles mosquitoes," he said.

Dr Chilufya stated that all insecticide if not used appropriately could be harmful to living things and the environment.

The minister told the house that the harmful effects of DDT were now known and documented.

“The ban on DDT use was related to the way of use of the insecticide. The way we are going to use the insecticide is very different because there are other safeguards as a result of research.

“Government has put in place measures to safeguard communities where DDT is used in indoor spraying such as a strategic environment assessment was done through the Ministry of Health through the Malaria elimination program and Zambia Environmental Management Agency, “he said.

Dr Chilufya noted that to mitigate this, his Ministry was using other insecticides and that the rota-tion of spraying insecticide was done after two years.

“DDT is not the only insecticide being used but other insecticides are being used in fighting Malaria but it is among the best insecticide recommended by the World Health Organization in the elimi-nation of vectors,”

65 foreigners nabbed

By MICHAEL MIYOBA SIXTY-FIVE illegal immigrants have been apprehended by the Department of Immigration in a clean-up operation conducted in Lusaka.

Immigration public relations officer, Namati Nshinka, said illegal immigrants were apprehended on Tuesday for trading without permits, unlawful entry and unlawful stay.

Mr Nshinka said the 65 suspected illegal immigrants from Burundi, Rwanda, Congo, Tanzania and Uganda were currently detained pending further immigration processes.

The clean-up operation was conducted in Matero, Chunga, Kamwala, Chelson, Kamanga, Chilenje, and Chalala.

He said among those apprehended, were 24 Burundians,

21 Congolese while 11 were Tanzanians.

Mr Nshinka said four illegal immigrants were from Rwanda with one being a Ugandan while four others were claiming Zambian citizenship.

Meanwhile, immigration officers apprehended 37 persons of different nationalities for various of-fences countrywide during an operation conducted on Monday and Tuesday this week.

“During this period, the Department of Immigration also secured twenty-six (26) convictions, re-moved thirty-four (34) illegal immigrants from the country, and refused three (03) foreign nationals entry into Zambia for failing to meet entry requirements,” Mr Nshinka said.

He said in an interview that when a country was facing challenges it needed to approach debtors so that they could offer relief.

"When you are owing me and you don't have the money what can you do, you need to approach me so that we agree on payments.

“So what the government is doing is the best way to do, and this will be good for the country which is not doing well economically," Mr Magande said.

Mr Magande said that it was important that Government was firm so that the country could be saved from defaulting.

"I think Government has been talking to the bondholders and this is a good move which they have done. This is the only way a country can do when it is not doing well economically," he said.

Meanwhile, Mr Magande

has challenged Government to disclose how much has been raised from the Covid-19 bond which was recently introduced.

“Recently they said they have come up with a Covid-19 bond so how much has been realised from the bond? The Zambian people need to know how much Government has realised from this initiative,” Mr Magande said.

In June this year, Cabinet approved K8 billion economic stimulus package financed through a Covid-19 bond in an effort to ease the pandemic’s impact.

"Instead of cutting ministers' salaries there are other alternatives that can help rebuild the economy such as actualisation the growing of marijuana for medicinal and export purposes and commercialisation of the gold mining sector," Mr Simuwelu said.

ELIGIBILITY DEBATE THE renewed debate on whether President Edgar Lungu is eligible to stand in next year’s presidential elections is uncalled for.

This is because those arguing against his eligibility are using the same points that the Constitutional Court trashed.

They claim that President Lungu is serving his second term of office – something the ConCourt put to rest, but detractors do not want to accept.

Constitutional lawyer John Sangwa, who represented the petitioners in the eligibility case has continued to argue that President Lungu does not qualify to contest next year’s elections.

Mr Sangwa continues to base his arguments on what he presented or said in the ConCourt, which did not agree with him. On what basis has he continued his argument?

Patriotic Front Parliamentary Chief Whip Brian Mundubile has dismissed as mischievous, misleading and misplaced remarks by Mr Sangwa that President Lungu was not eligible to contest the 2021 presidential elections.

Mr Mundubilie said the people who had petitioned over the eligibility matter, wanting to know whether President Lungu had served more than one term had gotten a ruling from the court over what constitutes a term of office, which dealt with the matter decisively, stating that the President was indeed eligible to stand in 2021 because he had served only one term.

The bone of contention has been how to interpret President Lungu’s tenure of office after the death of his predecessor, Michael Sata leading to the 2016 elections.

Said the ConCourt: “It therefore, follows that in the current case, the term served which sits astride the pre and post 2016 constitutional amendments and having looked at the intention of the Legislature as we have done, and the holistic approach we have taken in interpreting Article 106 of the Constitution in its entirety, our answer to the question that we have rephrased is that the Presidential term of office that ran from 25th January, 2015 to 13th September, 2016 and straddled two constitutional regimes cannot be considered as a full term.

“As regards the second question posed in the amended originating Summons, which is whether the incumbent President is eligible for election as president in the 2021 presidential election, our view is that, in light of the position that we have taken as regards the first question posed in the amended Originating Summons, the second question has become otiose and we shall not consider it.”

It is quite clear that President Lungu merely completed President Sata’s first term, and began his proper first term after the 2016 elections, making him eligible to stand for the 2021 elections.

But because of the polarised nature of the country’s politics people have taken partisan positions instead of interpreting what the ConCourt stated.

We however applaud that there is debate over President Lungu’s eligibility which is good for democracy. But let this not degenerate into physical confrontations for sanity must prevail at all times.

Even those threatening to go back to the courts must be given a hearing with a full realisation that theirs would be an exercise in futility.

‘TENDERS MUST NOT SIDELINE LOCALS’

ROCUREMENT of goods and services must be done in a transparent manner to avoid cancellation of tenders after a supplier involved fails to deliver, Private Sector Development Association (PSDA) chairperson, Yusuf Dodia has said.

Mr Dodia urged the state to seriously pursue the $9 million refund for undelivered

dredgers from MCD Civil and Mechanical Engineering.

In 2015, Government paid about US$9, 240, 370 to MCD leaving a balance of US$2, 635, 430 but to date the supplier has not delivered the dredgers, prompting Government to cancel the deal.

The money has however not been refunded.

Mr Dodia said Government should ensure that due diligence was done on suppliers engaged to ascertain the abili-

ty to deliver on the tender.

He said local contractors should be given preference for some tenders.

He however said the company’s track record and history to deliver on projects should be checked thoroughly.

‘Kafue Gorge Power Project a rare boost’

By PETER SICHALI THE completion of the Kafue Gorge Lower Hydro Power Project will revolutionise the electricity sub sector in the country, former National Energy Sector and Allied Workers Union General Secretary Yotam Mtayachalo has said.

He said once commissioned, the project would address acute shortage of elec-

tricity Mr Mtayachalo, a former Zesco employee, said the completion of the project would boost the power sector and ultimately upscale economic activities in the country.

"This is good news to the people of Zambia because load-shedding is expected to reduce as the landmark Kafue Gorge Lower Hydro Power Project comes on board.

"This is the largest investment in the power generation sub sector in more than 45 years after the 900MW Kafue Gorge Hydro Power Station was built in 1970's by the UNIP Government," he said.

Government, he said, should continue investing in the energy sector both in renewable and non-renewable sources to forestall current and future electricity challenges.

The minister said this yesterday when he officiated at the official opening of the stakeholders’ engagement workshop for ZCS Bill at Lusaka’s Ndozo Lodge.

Meanwhile, the programme for Legal Empowerment and Enhanced Justice Delivery (PLEED) manager, Christiane Roth said in line with the Seventh National Development Plan 2017-2021 and the National vision 2030, Zambia has made significant efforts to strengthen the dispensation of justice in the country.

And ZCS deputy Commissioner General Lloyd Chilundika said the repeal of the Prisons Act Cap 97 of 1965 needed support from all stakeholders because it would benefit Zambians as it shall bring about a constitution that respects the rights of inmates.

CONCOURT RULING: EDGAR LUNGU IS ELIGIBLE The ConCourt has ruled that it is otiose or useless to allege that President Lungu has served two terms when he has not.

The questions posed to the Constitutional Court 1. Whether His Excellency President Edgar Chagwa Lungu will have served two full terms for purposes of Article 106 (3) as read with Article 106 (6) of the Constitution of Zambia at the expiry of his current term; 2. Whether, as a matter of the Constitutional law of the Republic of Zambia, His Excellency Rresident Edgar Chagwa Lungu is eligible for election as President for another 5 year term following his current term of office which commenced on 13th September, 2016; 3. Further any other relief; 4. Costs.”

HERE is a raging debate on whether President Edgar Lungu is eligible to stand in the 2021 presidential and general elections even though the Constitutional Court put the issue at rest by ruling in the affirmative.

With most debate based on partisan positions, we reproduce the ConCourt’s ruling to enable people make an informed decision.

Article 106 (6) thus presents a novel situation, providing that a person will be deemed not to have served a full term of office as President if at the time he or she assumes office, less than 3 years remain before the date of the next general elections. The intention of the Legislature as shown from the import of Article 106 is that a person can serve only two five year terms amounting to 10 years. However, with the enactment of Article 106 (6) two other scenarios now obtain. Under Article 106 (6) (a), it is possible that a person can serve for a period of less than 10 years, being one term of at least 3 years and another term of 5 years and these will count as two full terms.

The converse is also true under Article 106 (6) (b) where it is now possible for one to occupy the office of President for a period which is less than a full term in addition to two full terms of office. Meaning that a President can be in the office for a total of almost 13 years. We have decided to add this for clarity.

Therefore, it is clear from the above provisions that when the Constitution is read holistically, we believe, the intention of the Legislature was that when a person takes over the unexpired term of a previous president, that person should be able to serve a substantial part of the unexpired term in order for such a term to be considered as a full term.

In view of the above position, the question is: Did the framers of the Constitution in the transitional provisions under the 2016 Constitutional amendments, make provision for

what was to happen to, the incumbent President's term of office which straddled two constitutional regimes as to how it should be treated?

Perusal of both the Constitution of Zambia (Amendment) Act No. 1 of 2016 as well as the Constitution of Zambia (Amendment) Act No. 2 of 2016 has shown that these contain very limited provision(s) as to what or how the remaining term of office of the immediate predecessor's tenure should be treated. Section 7 (1) of the Constitution of Zambia (Amendment) Act No. 1 of 2016 provides as follows: "7. (1) The President shall continue to serve as President or the unexpired term of that office as specified by the constitution in accordance with the Constitution."

The above provision clearly shows that although the Constitution of Zambia (Amendment) Act No. 1 of 2016 provided for the continuation of the President in the office of President, it made no provisions for how the period served from January, 2015 to September, 2016 which straddled two constitutional regimes was to be treated in view of the change in the constitutional provisions from the limitation based on being 'twice elected' to 'holding office' for two terms. In this regard, we agree with Counsel for the Applicants that the Legislature did not address that aspect in the transitional provisions. The question, therefore, is: Was it the intention of the framers of the Constitution to not provide for transitional provisions relating to this term?

Counsel for the Applicants referred us to the learned authors of Bennion on Statutory Interpretation at section 96 where they state that:"Where an Act contains substantive, amending or repealing enactments, it commonly also includes transitional provisions which regulate the coming into operation of those enactments and modify their effect during the period of transition. Where the Act fails to include sue provisions expressly, the court is required to draw such inferences as to the intended transitional arrangements as, in the Iight of the interpretative criteria, it considers Parliament to have intended." (emphasis added) We were also referred to Craies on Legislation, paragraph 10.1.26 where it is stated that:"It is commonly necessary when one legislative system e ds and another begins to enact special rules in relation to factual cases that straddle the transition. Sometimes the old law is continued for transitional cases, and sometimes the new law is applied; in

Article 106 (6) of the Constitution 106. (1) The term of office for a president is five years which shall run cocurrently with the term of Parliament, except that the term of office shall expire when the President-elect assumes office in accordance with Article 105.

(2) A President shall hold office from the date of President-elect is sworn into office and ending on the date the next President-elect is sworn into office.

And at paragraph 10.1.27 of the same publication, where it is stated that:­ "ln the absence of express transitional provision the courts will have to attempt to discern what Parliament must have intended in respect of matters arising partly before and partly after the commencement of a (2304) provision, or which arose before commencement but fail to be addressed after commencement. This is not always easy." (emphasis added) The foregoing shows that where it is determined that an Act failed to include express transitional provisions, it is for the Court to draw an inference or to attempt to discern what the Legislature must have intended. The Supreme Court applied this approach in the cases of Lumina and Mwiinga v The Attorney-General27 and Attorney-general and the Movement for Multi-Party Democracy v Lewanika and 4 others22 where the respective transitional provisions did not expressly provide for the Members of Parliament who crossed the floor. In the Lewanika22 case, the Supreme Court put it as follows:"It follows, therefore, that whenever the strict interpretation of a statute gives rise to unreasonable and an unjust situation, it is our view that judges can and should use their good common sense to remedy it - that is by reading words in if necessary - so as to do what parliament would have done had they had the situation in mind."

Therefore, the question is: What could have been the intention of the Legislature on this aspect in relation to the transitional arrangements for a presidential term straddling two constitutional regimes?

Our firm view is that it could not have been the intention of the Legislature to not provide for the period that was served and that straddled two constitutional regimes as to how it should be treated. This is so because, as stated above, a holistic consideration of the relevant provisions in this case will clearly show that the intention was/is to allow or enable a person who assumes the office of president to complete the unexpired period of the term of another president to serve a substantial part of the five year term of office in order for that term to count as a full term pursuant to Article 106 (6) of the Constitution as amended.

It follows that the sub-articles in Article 106 cannot be isolated from each other in interpreting the article. As we have already stat-

ed above, an interpretation of a constitutional provision that isolates the provisions touching on the same subject is faulty. Therefore, to state that Article 106 applies to the term that straddled two constitutional regimes but that Article 106 (6) does not, is to isolate Article 106 (3) from the rest of the provisions in Article 106 which is untenable at law, and is at variance with the tenets of constitutional interpretation, as all the provision on the tenure of office of the President must be read together.

We are of the considered view that the provision regarding the full term must be applied to defining what is meant by twice held office under Article 106 (3) in interpreting the provisions of that Article.

It therefore, follows that in the current case, the term served which sits astride the pre and post 2016 constitutional amendments and having looked at the intention of the Legislature as we have done, and the holistic approach we have taken in interpreting Article 106 of the Constitution in its entirety, our answer to the question that we have rephrased is that the Presidential term of office that ran from 25th January, 2015 to 13th September, 2016 and straddled two constitutional regimes c§annot be considered as a full term.

As regards the second question posed in the amended originating Summons, which is whether the incumbent President is eligible for election as president in the 2021 presidential election, our view is that, in light of the position that we have taken as regards the first question posed in the amended Originating Summons, the second question has become otiose and we shall not consider it.

Since this matter raised serious constitutional issues, it is only fair that each party shall bear its own costs.

FISP scam unearthed GOVERNMENT has unearthed a scam in which farming inputs under the Farmer Input Support Programme (FISP) were allegedly stolen by some staff from the Ministry of Agricultural together with some cooperatives using fake names in Rufunsa.

Lusaka Province Permanent Secretary Elias Kamanga visited Chinyunyu where more than 360 bags of fertiliser and seed have been stolen.

Mr Kamanga expressed disappointment at how the FISP has allegedly been abused by some agriculture staff and cooperative members.

Mr Kamanga noted that some officers have been arrested while the inputs have been impounded by security officers. He called on the Provincial Agriculture Coordinator (PACO) to deal with all the culprits involved as the FISP is aimed at uplifting the living standards of vulnerable households.

“It appears this is a wellplanned scheme because I don’t think it is an isolated case. There’s need to take administrative action while the criminal procedures are going on,” he said.

Mr Kamanga called for the perpetrators to face the law and so as to end the practice He noted that government was spending colossal sums of money to subsidise agriculture inputs for small scale farmers through the programme and described the scam as unfortunate that some people want to derail government efforts of empowering vulnerable households.

Meanwhile, newly installed Chief Shikabeta of the Soli people in Rufunsa has pledged to work with the government to foster development in his area.

Speaking when Mr Kamanga paid a courtesy call on him yesterday, Chief Chikabeta expressed satisfaction with the developmental projects in his area. He also highlighted some challenges faced in the area such as the replacement of Mwateshi Bridge which was washed away last rainy season, a critical shortage of water and a shortage of human resource at health centres and schools And in response Mr Kamanga promised to address some of the challenges faced in the chiefdom.

Dundumwezi for Lungu

RESIDENTS of Dundumwezi constituency in Kalomo are ready to support PF and President Edgar Lungu in the 2021 general elections.

Senior Headman Nsandeyi, who spoke on behalf of 53 headmen in Dundumwezi, said President Lungu has shown commitment to develop the area despite receiving less votes in the 2016 general elections.

He was speaking at a mobilisation meeting in Nabulangu area, held by PF national mobilisation committee member Bizwell Mutale.

The traditional leader said despite overwhelmingly voting for the UPND representatives, the opposition party had lamentably failed the people in the area.

He advised residents in the area to vote for leaders in the next years polls based on merit and not tribe.

And Mr Mutale said the PF Government was committed to improving the living standards of the people in Dundumwezi.

Government, he said, would provide better health facilities

and clean drinking water.

He said the PF Government would construct a new clinic and school in the area.

Mr Mutale said the construction of a school and clinic was the beginning of good things to come but the people in the area should also vote for the ruling party.

He pledged to provide iron sheets and other building materials for the two projects.

"The relationship between the people of Dundumwezi and President Edgar Lungu has grown stronger as people have resolved to vote for the ruling party in the coming general election," he said.

Mr Mutale also pledged K50, 000 to the youth in the area as part of the PF government robust programme to empower young people. He said President Edgar Lungu was aware of the many challenges women and youths were facing and has come up with programmes aimed at helping citizens to lead better lives.

Mr Mutale observed that since the UPND came into the political arena, it has done nothing for the people of Southern province despite receiving massive support in terms of votes.

Govt, WWF seal deal on clean energy

The Memorandum of Understanding (MoU) will provide a platform for uniting efforts, expertise, and resourcesth to harness opportunities that promote clean energy development.

Energy Permanent Secretary, Trevor Kaunda, said the MoU would not only promote clean energy development but also increase access to sustainable and affordable energy.

Mr Kaunda said the fiveyear MoU would foster collaboration on Zambia's pursuit for a clean energy development pathway.

He said this during the signing ceremony of the MoU between Ministry of Energy and WWF in Lusaka yesterday.

WWF country director, Nachilala Nkombo, said the signing of the MoU was about helping to deal with the crisis of energy poverty.

Ms Nkombo noted that every year, the country consumed four million tonnes of charcoal while hydropower installed capacity was at 50 percent.

Dear Editor, BILL 10 is done and dusted, however let us not allow frustrations reach alarming and threatening levels among our voters that will make them start looking at the opposition as an alternative.

If President Edgar Lungu was to ask for my personal and honest opinion after Bill 10 failed, I will courageously respond by saying it’s high time for massive changes and reshuffles both in the Patriotic Front and Government if we are to win back confidence, support and eventually restore hope in our voters.

We seem to have too many people in strategic positions both the PF and Government who are literally bringing next to nothing on the table, hence the more reason President Lungu must consider cleaning up the party.

The President may need to know that very few leaders in the PF are enjoying economic freedom at the expense of majority party officials and functionaries as a result of selfishness and greed, a very dangerous political manoeuvre that is weakening the party on the ground as most of our officials and functionaries are economically crippled, feel left out, sidelined, abandoned and neglected hence the need to conduct a clinical cleanup approach in our party as one way of strengthening it.

Voter apathy is another opposition knocking on our doorstep as a result of certain leadership traits exhibited by our leaders on party structures that have lamentably failed to win the love of the grassroots mainly the youth who vote in large numbers.

People both in the party and Government are more preoccupied with protecting their positions and portfolios not necessarily the party and President Lungu.

How many people are on the ground making more sections and branches which are very important ahead of 2021 as compared to people making endorsements which clearly have already been made in all the provinces as well as by Members of Central Committee the highest organ of the party.

I have observed that people are preoccupied with championing their agendas under the impression that they are loyal to the PF and President Lungu.

What was the rush of forming executives for new constituencies before Bill 10 going through and not seeing the need of starting with the formation of more sections and branches.

Don’t we think now that Bill 10 failed this will be the recipe of confusion and division as people will be fighting for positions.

It is clear our party did not necessarily depend on Bill 10 to retain power come 2021 for it has delivered on most of its campaign promises and it commands a huge following on the ground that makes it dominate the political arena.

However, the grassroots, mainly youths have lost confidence in some of our leaders both as a result of failing to address challenges affecting the grassroots.

Misplaced political ambitions by some of our leaders within PF over the running mate position is another l cancer eating up the party from inside with divisions and hatred as most of these leaders have opted to use investigative wings and toxic media tabloids to openly fight each other directly putting the name of the party and President Lungu in direct firing range from public ridicule.

IT was recently reported that 1, 800 teenagers fell pregnant in Eastern Province. The high teenage pregnancy prevalence rate is not only shocking but also detrimental to the future of the girl-child. This is because most of the victims are school going.

Some of the teenage pregnant girls are married by the men who made them pregnant while others are not married.

The Zambian Constitution as the supreme law of the land puts it abundantly clear that having carnal knowledge with a girl below the age of 16 with or without her consent is tantamount to committing defilement.

Defilement is a felony meaning that it is a serious criminal offence which attracts a jail sentence of 14 years or more.

However, President Edgar Lungu and some traditional rulers have been in the forefront fighting teenage pregnancies and child marriages. Fighting these vices is a noble cause and those campaigning against them must be lauded.

The culprits responsible for the teenage pregnancies in the region must be nabbed, prosecuted and jailed upon conviction to deter would-be offenders.

Solwezi women MALARIA FIGHT ENHANCED IN LSTONE empowered

TWENTY-EIGHT women 28 from four community clubs in Sandang’ombe ward in Solwezi have been empowered with survival and entrepreneurship skills.

The 28 women have undergone training in bottle deco, knitting, doormat and jewellery making as well as entrepreneurship.

Solwezi Municipal Council has since awarded them with certificates of completion.

The local authority conducted skills training of community members in line with provisions of the Local Government Act number two of 2019 which mandates.

Sandang’ombe ward Councillor, Bernard Sokotela, expressed happiness at the zeal and eagerness to learn exhibited by the women during training.

Mr. Sokotela, who is also Deputy Mayor, said the move to train more women in various skills would enable them become selfreliant and eventually improve their livelihood.

Under the Local Government Act number two, councils are mandated to administer schemes for the encouragement of and participation in community development.

Mr Sokotela was happy that the council was living up to its mandate of providing services to the community aimed at eradicating poverty in the district.

Director Housing and Social Services, Andrew Kalemba, said despite the adverse effects of the coronavirus, his team has so far trained 50 women out of the 100 planned for this year.

Mr Kalemba said that among the 50 women trained so far, 22 were from Kimasala ward and were trained early this year.

He was optimistic that the 28 women would thrive and implement all skills acquired for the betterment of the community. And speaking on behalf of all the participants Maggie Chipolongo assured the municipality that the skills acquired would be put to good use.

THE Ministry of Health has commenced the Indoor Residue Spraying exercise in Livingstone, targeting about 25,800 households.

Livingstone District Environmental Health Officer, Zachariah Banda, said the exercise would run for 40 days in a bid to control the increase of mosquitoes in the city. Lately, Livingstone has recorded an influx of mosquitoes with a slight increase in the malaria prevalence.

Mr. Banda has therefore appealed to community members to allow the exercise to be implemented effectively without resistance from house owners.

He said that this is in order to realize the objective of leveraging the risk of malaria in the city.

Drones will capture data in land titling, says expert

By SANFROSSA MANYINDA A TEAM of drone pilots will be undertaking the capturing of data on properties for easy and quick issuance of certificates of titles in Kitwe, Ndola and Kalulushi.

The team of drone pilots from Medici Land Governance (MLG) would be conducting the exercise behalf of the Ministry of Lands and Natural Resources.

MLG Drone Manager, Martin Buchert, said initial activities of the programme involved the capturing of aerial images using drones which would be flown around the cities from now up the end of this month.

The drone images would be used to capture properties which would be used to issue certificates of titles.

Mr Buchert was speaking when he paid a courtesy call on Kitwe Town Clerk Mbulo Seke.

The Ministry of Lands and Natural Resources has signed a Memorandum of Understanding with MLG to test new methodologies of data collection and develop a National Land Titling System.

The National Land Titling Programme started in 2017 under the Seventh National Development Plan (7NDP) with an overall objective of ensuring security of tenure for the people and to minimise displacement of citizens who genuinely own land.

Government intends to deliver four million land titles countywide in the next seven years.

MLG would provide all the financing to roll out the programme and would be paid a fixed fee for each title produced.

The Town Clerk urged citizens to render all the support needed for the programme to be successful.

DECONGESTION PROJECT A GAME CHANGER

ECENTLY, a retiree from Eastern Province was forced to abandon his motor vehicle in the middle of the road in Lusaka on the busy Great East Road between the Munali round about and the University of Zambia (UNZA).

The mid-morning traffic was so heavy that the man felt hemmed in as he could not manage to wriggle and wiggle his way out, a feat “Lusakans” were however performing with ease.

The cacophony of honking and swearing from impatient fellow motorists was as intimidating as it was confusing.

Unable to bear the ordeal any longer, the man simply switched off the engine, removed the ignition key, locked the vehicle and started walking away, to the surprise and annoyance of other motorists and onlookers.

The vehicle was later “recovered” by a Lusaka-based relative he called on his mobile phone.

Such incidents are common in the capital city. The traffic congestions on busy roads across the capital can indeed flay your nerves, especially during peak hours.

But that will soon be history. Last Friday, President Edgar Lungu commissioned the Arcades flyover bridge at the Katima Mulilo-Great EastThabo Mbeki roads roundabout near UNZA. A throng witnessed the event, which the President announced on social media.

“Fellow country men and women, I am commissioning the Arcades flyover bridge on the Great East Road here in Lusaka,” President Lungu posted on his personal Facebook page.

This is the second flyover bridge he has commissioned in three months. In August the President commissioned the Makeni flyover bridge on the busy Lusaka-Kafue Road.

Since then motorists have reported faster and smoother movement.

The bridges are part of the multimillion dollar Lusaka Decongestion Project which involves 91.4 kilometres of road rehabilitation, widening and construction. Out of these, 29.3 kilometres of works are dedicated to bus lanes.

The two bridges are part

of the four to be constructed across the city to ease congestion, which has been a source of complaints from motorists, business people and commuters.

The other flyover bridges to be constructed under the project are Munali roundabout and Longacres roundabout.

Two years ago Government moved to respond to the plight and complaints of the motoring and travelling public.

On April 11, 2018 President Lungu and his Indian counterpart, Shri Ram Nath Kovind, launched the US$389 million Lusaka Decongestion Project, which has literally turned the capital city into a vast construction site.

The mega project is aimed at decongesting the city by building and expanding roads, fly-over bridges and overpasses to be done in three years

by AFCONS International, an Indian construction company.

An elated President Lungu said during the launch that the project was timely because traffic congestion had been slowing down the country’s economic development.

“Traffic congestion is slowing down the economy. People are spending more time driving to

President Lungu said the project marked the starting point for achieving sustainable mobility in the capital city.

And visiting President Kovind said the project symbolised strong Indo-Zambia friendship.

“This project will change the landscape of Lusaka and we are happy that India is part of

it,” he said.

In 2017 then minister of Housing and Infrastructure Development Ronald Chitotela had announced that besides Government implementing phase two of the Lusaka L400 road project, the Indian government had come up with the new project to include street lighting, by-passes, construction of roads and putting up drainage systems.

“This will add beauty to the capital city besides the jobs

that will be created during the project implementation phase,” Mr Chitotela said.

The capital city is beginning to look beautiful, with improved security thanks to the well-spaced lighting.

Government is committed to turning Zambia into a regional transport and business investment nerve-centre by improving road infrastructure in Lusaka and other cities.

The President is confident that once commissioned the flyover bridges and overpasses will enhance efficiency, reduce traffic congestion and save time for the travelling public, which will positively impact the economy.

The project is a game changer. The flow of traffic is improving exponentially, and since motor vehicles are beginning to move faster, they are exerting less weight on the roads, which will scale down maintenance costs.

There will also be fewer exchanges of insults and less swearing among frustrated motorists.

The transformative roads project resonates with “Strategy 3: Construction and Rehabilitation of Road Network” under the

‘Improved Transport System and Infrastructure’ cluster of the Seventh National Development Plan (7NDP).

In the 7NDP’s implementation plan, Government is targeting 87, 435 kilometres of road network from the current 11,992km by 2021.

The commissioning of the Makeni and Arcades flyover bridges foreruns the imminent completion of the US$298 million Kazungula Bridge linking Zambia and Botswana, which is expected to facilitate increased regional trade and reduce transit time for freight and passengers.

In the 2021 national budget, Minister of Finance Bwalya Ng’andu has proposed K6, 214, 145, 268 for road infrastructure as Zambia marches closer to attaining the Vision 2030 of becoming a prosperous middle income country.

Improving road infrastructure has been the Patriotic Front’s flagship development programme since it came into government in 2011. It includes the Link Zambia 8, 000, Lusaka 400, C200, Improved Rural Roads and Township Roads projects.

In Chapter 11 of its 20162021 Manifesto the PF pledges to increase and improve road infrastructure across the country as a priority.

“In order to improve the infrastructure backbone created the Patriotic Front government shall in the period 20162021 continue to rehabilitate and upgrade the road network to three star status including feeder roads in all districts to prescribed standards,” the manifesto says.

It says Government will also continue to construct additional inter district roads to open up the country to facilitate accelerated development and improve trade.

The commissioning of the Arcades flyover bridge is yet another step towards the fulfilment of this promise.

UMAMBA N u m b a’s search for his first M T N / FA Z Super Division title as Zesco United coach suffered another setback after the Ndola giants were stunned 1-0 by rivals Forest Rangers in yesterday’s local derby at Levy Mwanawasa Stadium.

Zikiru Adams 27th minute goal gave Rangers their second win of

the season after they beat Nkana 2-0 on match day one.

The win propelled the Tenant Chilumba-drilled to the summit of the 18team Super Division table with six points as they await Lusaka Dynamos’ visit at the weekend.

Meanwhile, Green Eagles punished Zanaco 1-0 at Independence Stadium in Choma thanks to a first half goal from Anos Tembo.

The win also propelled Eagles to six points on par with Rangers as the two

teams maintained a 100 percent winning run after the first two games.

Copper Queens feast over Lesotho
