company level, a trade union representative elected as a trustee on the industry benefit funds and/or a representative on the merSETA and/or MEIBC will be entitled to a minimum of ten days’ paid leave per annum for purposes of performing his/her duties as a trustee on the industry benefit funds and/or representative on the merSETA and/or MEIBC.

Employers and employees must observe the provisions of Annexure F on the SEIFSA Main Agreement Portal.

44 Attendance of worker representatives at national and regional council committees

Annexure G on the SEIFSA Main Agreement Portal details the arrangements and procedures governing the release of worker representatives appointed to serve on the bargaining council’s national and regional committees.

Employer organisations will, as far as possible, assist their members in releasing affected employees for duties as trustees of the industry benefit funds and trustee training and also for duties as Merseta metal and plastics chamber representatives.

Periods of absence whilst attending a MEIBC meeting count as shifts worked

Annexure H on the SEIFSA Main Agreement Portal details these special provisions.

Where a training committee identifies a specific training need and an employee is selected to undergo such training, then this training shall, wherever possible, be undertaken during ordinary working hours and the employee shall be paid at normal rates whilst undergoing this training.

46 Time off for the training of shop stewards and for trade union office bearers to attend union meetings

The time spent on ABET training will be shared equally between the employer and employee concerned on a 50/50 basis (for example, if the training lasts two hours, one hour will be paid by the employer and the other will be an unpaid contribution by the employee).

An employee who is an office bearer of a party trade union, is entitled to take reasonable leave during working hours to perform the functions of that office. The party trade union and the employer may agree to the number of days leave, the number of days paid leave and conditions attached to any such leave.

Subject to reasonable conditions to be agreed at company level, a trade union representative, appointed in terms of section 14 of the LRA, is entitled to take reasonable time off with pay during working hours to be trained in any subject relevant to the functions of a trade union representative. The following provisions constitute a minimum floor of rights and any rights at plant level currently exceeding these will remain in force:  Union general meetings will take place on a quarterly basis at plant level.  The time and duration of these meetings will be a matter for agreement at company level.  Recognised shop stewards will be entitled to a minimum of five days’ paid leave per year for purposes of shop steward training.  The appointment of shop stewards and health and safety representatives remains a matter for company level discussion.

Industry Policy Forum

The parties have agreed to establish an Industry Policy Forum under the auspices of the MEIBC as per the special provisions applicable in Annexure I (page 76).
