A new celebration is born at the first annual Arvada Pumpkin Festival

Families, kids, couples, pets and more came out to the Arvada Community Gardens Oct. 14 for the first-ever Arvada Pumpkin Festival to enjoy cider, snacks, giant pumpkin and squash contests and more.

Arvada Community Gardens president Heather Fiedler created the first annual Arvada Pumpkin Festival. The community gardens survive on donations, produce sales and other fundraising activities. One of those is the Arvada Festival of Scarecrows.

“We’ve been part of the Festival of Scarecrows for many, many years,” Holland said. “Then, when it got canceled this year, we weren’t sure what we should do, because it was a big fundraiser for the community garden. So Heather, decided that maybe we could hold our own festival here, for the part that we used to do at Scarecrow. We went ahead and did that.”

The gardens needed a way to recoup the potential loss of funding from the festival. So, the group decided to move the fall festivities to their own space for an event on Oct. 14.

“We just brought them all up here,” Holland explained, gesturing to the space where the festival tents were located. “We did some advertising. We invited everybody we could think of. We’ve got some donations. We’re selling stuff. It’s really working out.”

Holland said the city of Arvada was very supportive as well. Several people in the community worked to get the word out. This operation was last minute due to a mix-up with the Festival of Scarecrows.

“Evidently, they applied too late for the date, and somebody else had already taken it,” Holland said.

He and the team at the gardens were fortunately more flexible. “We don’t need a permit to do anything in our own garden. We can just do it. We had about two months to organize it and boy, it worked out.”

Volunteers came to help out.

Some brought snacks and even hot cider, which were handed out free to the public.

However, Holland had his reservations about the first festival being a success. Those fears were soon put to rest. The gardens and the festival space were packed with attendees.

“It’s just beyond our expectations, the success,” Holland said.

“A lot of people were lined up at 9:45 this morning waiting to get in here. We’re really happy with the way it has turned out. And we’ll see how the receipts come out at the end of the day. The festival will help defer a lot of our expenses that we have to operate the garden.”

At the end of the festival, the winners of the squash and pumpkin contests were announced. The biggest pumpkins and squash grown in the gardens competed for prizes that included cash and gift certificates.

l Electronic Signatures Are Common Now in Real Estate — At Least Until Closing You have probably heard of eSignatures — signatures which are inserted by clicking on a link. The contracts from CTM eContracts used by most Denver agents include eSignatures. DocuSign is another such product. If you do a web search for “esignatures,” you’ll find many other companies competing to offer that service.

Electronic signatures were legalized by Congress in 2000 with the E-Sign Act. It was over a decade, however, before CTM adopted the process, and I was slow to adopt it, insisting that buyers and sellers at least use their finger or stylus to hand-draw their signature, something that is still allowed as an alternative to clicking on a font signature.

I relented when I realized that the

contracts being signed electronically only get buyers and sellers to the closing table, where every document must be signed on paper in front of a Notary, who verifies the identity of the signers. If there was any unauthorized signing of the contracts, it would come out then.

(It should be noted that, thanks to Covid restrictions, the ability to sign in front of a Notary remotely with video of the buyer and/or seller and photos of their IDs became somewhat common and is still used, for example, when the person is sick or can’t be reached by a mobile Notary.)

In over a decade of agents signing real estate contracts electronically, I still have not heard of any problem arising therefrom. It should be noted that each

Real Estate Market Saw Shifts and Opportunities in September As we stepped into the final quarter of 2023, the metro Denver real estate market showed an intriguing landscape, offering fresh opportunities for both buyers and sellers. This September, real estate professionals observed a market reminiscent of the ebb and flow during the 2013-2019 period, with a few noteworthy differences.

Despite high interest rates, the market presented a remarkable opportunity for buyers, especially those who could pay cash. The market is currently favoring those who were previously outbid in recent years, and move-up homebuyers may want to act, as the market shifts to their advantage.

One standout trend in recent transactions is the prevalence of concessions.

Nearly 60% of closed deals in September featured concessions averaging just over $9,000. Notably, 45% of these concessions were directed towards buying down the buyer’s mortgage interest rate, presenting a mutually beneficial situation for both parties.

In two of my recent closings on listings, the buyers submitted contracts with a 5-figure seller concession to fund such an interest-rate buydown. Here’s something to keep in mind: if there is a seller concession, get both agents in the transaction to agree that their commission is based on the net purchase price, not the contract purchase price.

Sellers in today's market aren't merely motivated by desire; many have to sell. This willingness to negotiate is affecting market dynamics, offering opportunities for savvy buyers to secure advantageous deals.

While key metrics like months of inventory, days on market and pricing trends remain stable, the market has shrunk, with fewer homes for sale. Approximately 25% of contracts are falling, and price reductions are both more frequent and larger than in previous cycles.

CTM contract comes with a certificate indicating the IP address of each signer and the precise time they signed. These are available on the software but are rarely printed out, because they are only needed in case of a dispute — which I haven’t seen.

With almost 22 years as a licensed real estate agent, I’m somewhat new. By the time I was licensed in March 2002, the MLS was already on the internet, although some agents accessed it by dial-up instead of broadbad connection.

Many “old-timers” were still using the big printed MLS books, which weren’t discontinued for another few years — to much objection by some.

In 2022 the various contracts and disclosure documents were prepared by hand or by typewriter on carbonless 4part NCR forms. We hand delivered these forms and any resulting offers to our buyers and sellers. A year or two later we got the first forms on a CD which was passed around so we could create the documents on a computer and email them to clients. But we still had to print them out for signing by hand.

A lot has changed, but online electronic contracts and e-signatures have to be the most important, although the advances in web-based MLS services comes in a close second.

Here’s something you need to know.

If you write an email agreeing to do something and it has your typed name

(or email signature) on it, the E-Sign Act says that you have in effect signed a contract that can be enforced by the recipient. Be careful what you write!

We real estate professionals still find ourselves doing a lot of our work inperson — especially with buyers, showing them homes — but the ability to write a contract for a buyer or seller on our laptop, often in their presence, has accelerated the pace of real estate in ways that benefit our clients as well as ourselves.

Remember that the iPhone was introduced in July 2007 — coincidentally, the same month that I founded Golden Real Estate — at a time when the Blackberry was state-of-the-art. The tech tools that followed that introduction, including “apps” — a word that didn’t exist before then — have revolutionized the practice of real estate, as it has every other industry.

Community members connect at Hops and Cops Colorado Tap House hosts meet and greet for APD officers

Arvada community members and officers with the Arvada Police Department came together for an evening of light drinking and community building at Hops and Cops, hosted by the Colorado Tap House.

The event ran from 5 to 7 p.m. on Oct. 12 and featured members of APD answering questions about their role in the community and addressing residents’ concerns.

The department also brought a vehicle for kids to check out.

APD Public Relations Officer Dave Snelling said that although the department is currently down 40 officers, the employees still with the force understand the importance of building community ties.

“Even with staffing levels as low as they are now, we are still trying to connect with the Arvada community and appreciate the chance to meet,” Snelling said.

“The opportunity to get out from behind our cars and desks to talk to our community on a more social level is refreshing.”

Jeffco school board candidates address district’s critical needs

With ballots set to hit Jefferson County mailboxes soon, the five candidates running for two open school board seats are busy letting the public know where they stand on the district’s critical issues, like declining enrollment, teacher pay, student achievement and budget shortfalls.

Michelle Applegate and Thomas Wicke are vying for the District 3 seat, which covers portions of Wheat Ridge, Arvada and northern Lakewood and stretches northwest to the Gilpin County line. Incumbent Stephanie Schooley is not running for re-election.

Amara Hildebrand, Erin Kenworthy, and Joel Newton are running

for the open District 4 seat, which includes Edgewater and central and southern Lakewood. Incumbent Susan Miller also chose not to run for re-election.

The Jefferson County Education Association endorsed Applegate and Kenworthy as leaders who will “do what it takes to give our students, educators, and community members the best public school experience possible.”

Wicke and Hildebrand have the support of the Jefferson County Republican Party. which believes they “will stand up for your children and family in these difficult and confusing times.”

School board candidates are elected at large, meaning Jeffco voters can vote for both districts, regardless of where they live. Yet, the elect-

ed directors represent constituents in the district in which they reside.

School board races are non-partisan. Yet, after voters recalled a conservative board in 2015, they’ve consistently voted for members backed by the teacher’s union. This year’s race won’t change the majority but will add diverse, new perspectives.

About the District 3 candidates

Michelle Applegate is a mom to three children in Jeffco schools and the PTA president at Stober Elementary. She calls herself a lifelong public education supporter whose top three priorities are ensuring Jeffco has strong, thriving public schools, making safety a part of the student experience, and building trust through budget transparency.

Applegate said that if elected, she

would start with student achievement by replicating what’s working across the district and understanding what students, families, teachers and the community need. She also plans to use her work experience as an engineer to enhance collaboration among district stakeholders and that parent engagement, feedback and hearing from the community are essential to making informed decisions.

She said the board needs to consider more than salaries when recruiting, compensating, and retaining its teachers. Enhanced benefits, additional prep time, and mental health services could show how much the district values its educators.

Phone and Internet Discounts Available to CenturyLink Customers The Colorado Public Utilities Commission designated CenturyLink as an Eligible Telecommunications Carrier within its service area for universal service purposes.

CenturyLink’s basic local service rates for residential voice lines are $30.50 per month and business services are $43.50 per month.

Specific rates will be provided upon request.

CenturyLink participates in the Lifeline program, which makes residential telephone or qualifying broadband service more affordable to eligible low-income individuals and families. Eligible customers may qualify for Lifeline discounts of $5.25/month for voice or bundled voice service or $9.25/month for qualifying broadband or broadband bundles. Residents who live on federally recognized Tribal Lands may qualify for additional Tribal benefits if they participate in certain additional federal eligibility programs.

The Lifeline discount is available for only one telephone or qualifying broadband service per household, which can be either a wireline or wireless service. Broadband speeds must be at least 25 Mbps download and 3 Mbps upload to qualify.

CenturyLink also participates in the Affordable Connectivity Program (ACP), which provides eligible households with a discount on broadband service. The ACP provides a discount of up to $30 per month toward broadband service for eligible households and up to $75 per month for households on qualifying Tribal lands.

For both programs, a household is defined as any individual or group of individuals who live together at the same address and share income and expenses. Services are not transferable, and only eligible consumers may enroll in these programs. Consumers who willfully make false statements to obtain these discounts can be punished by fine or imprisonment and can be barred from these programs.

This week in Jefferson County, there’s new leadership at the Golden Civic Foundation and Denver Water has announced a rate hike for 2024. The Saluting Branches organization honors military vets through a large-scale forestry event, the county announces TABOR refunds and more.

Golden Civic Foundation welcomes new executive director

The Golden Civic Foundation announced its new executive director, Kim Mangle. The 53-year-old organization describes itself as a “community catalyst” for the city of Golden. Over the years, the foundation has invested over $18.2 million in the community. About $7.2 million in the form of community grants and $11 million in loans to local small businesses.

Mangle is eager to continue the foundation’s work “The sense of community in Golden is extraordinary,” Mangle said. “We are fortunate to havedozens of incredible nonprofit organizations and so many businesses that work every day to make our community stronger. It will be a tremendous honor to work alongside our Board of Directors, donors, community, and volunteers to support Golden’s nonprofits and businesses.”

Denver Water announces rate hikes for 2024

The Denver Board of Water Commissioners approved a rate hike during their Oct. 11 meeting. According to the announcement, the rate for a typical single-family residential customer, the monthly bill will increase from $1.60 to $2.30.

This increase assumes that water usage is the same for 2023 and 2024.

The board will use the proceeds from the rate increase to fund, “important upgrades, projects and ongoing maintenance and repair work to keep its system operating efficiently.”

“Denver Water is at a pivot point.

These are historic times and we’ll be affected, just as the communities we serve will be affected, by climate change, population growth, variability in the economy, inflation and supply chains,” said Denver Water CEO/Manager Alan Salazar.

According to the announcement, Denver Water hopes to raise $1.9 billion in the next 10 years to pay for maintenance, repairs, protection and system upgrades. The rate hike affects about 95 percent of all customers.

Lakewood employees, volunteers and military vets plant 42 trees at Fort Logan for Saluting Branches

Lakewood’s park employees and arborists joined military veterans and volunteers to plant trees in Fort Logan National Cemetery.

The event was the 9th annual Saluting Branches. According to the announcement, the event is “the largest single day of service in the forestry industry, and it is dedicated to honoring and recognizing the sacrifices and services of our military veterans.”

Approximately 285 volunteers, 18 Lakewood employees and others planted 42 trees at Fort Logan.

Jeffco teacher wins $100,000 teaching excellence award

Green Mountain High School manufacturing and construction teacher Alexander Adkisson got the surprise of a lifetime when he walked into school Tuesday, Oct. 3. Rounding the corner to erupting cheers, Adkisson learned he was the $100,000 grand prize winner of Harbor Freight’s Tools for Schools Prize for Teaching Excellence.

The school, located in Lakewood, got $70,000 to invest in the career tech program, and Adkisson walked away with $30,000.

“I feel so honored that I could be awarded this prize, seeing that there’s a lot of really good teachers out there that do a lot of really cool things,” Adkisson said. “It’s amazing to be part of such an elite teaching cohort and to be a Harbor Freight Tools for Schools prize winner not only for the money, which is super exciting but to be able to put it into our schools.”

According to a statement from the district, “Adkisson is driven by a love of teaching students about careerconnected learning that dissolves the traditional division between core academics and the skilled trades.”

He developed the school’s “AMPED on Algebra” curriculum, which combines core academics with trade and industrial education in the manufacturing career pathway, and he coleads the Geometry in Construction program.

Adkisson leads training sessions nationwide and has helped more than 275 schools start and sustain the AMPED on Algebra curriculum. In AMPED, students learn Algebra 1 and manage a real business that provides

Regarding student achievement, she said education and success amount to more than standardized test scores and wants to look at the impact of things like art and P.E. and understand the unique learning that happens in all the different schools.

“I believe engagement and honestly listening to people and letting that be a part of the data that’s coming in is truly important,” said Applegate in response to school closure decisions.

Thomas Wicke is the father of a Jeffco freshman and two graduates.

His wife teaches at Drake Middle School, and he serves as the Aurora campus president of Concorde Career College. He says he is also a champion of public education and believes the school board needs to clear the way for educators to do their jobs effectively.

Wicke’s priorities are to restore trust between parents and educators in the district through transparent, open and proactive communication, address budget challenges, and improve student achievement.

Wicke says he’ll use his experience managing the bottom line of a forprofit college to manage the district’s $1.4 billion budget and deal with monetary challenges to come.

“I’ve heard the reason we’re losing staff isn’t necessarily because of the bottom line of money, although that is an element that I’m very interested and concerned with. We need to keep our teachers because they enjoy what they’re doing and feel like they’re teaching. I’ve heard stories of teachers not having support for discipline in the classroom,” he said.

Wicke believes in listening to opposing views and understands there will be disagreements, especially when making hard decisions about school closures and budget choices. “Our parents need to understand the decisions being made so we can trust one another and move past the contention and division.”

About the District 4 candidates

Amara Hildebrand has two children, one in a public school and the other in a private school. She attributes her education as the factor that led her family out of poverty and believes in giving back to the community. She says she is running for a school board seat because education is the path to success, and every child deserves the opportunity to thrive.

Hildebrand believes in financially incentivizing teachers whose students show academic achievement and that some capital improvements are wants, not needs, meaning the district’s budget could

be better managed to support teachers.

While she has dealt with her own addiction issues in the past, she doesn’t believe schools need more counselors but that kids should get off their devices and devote time to community service projects.

“We all have perspectives based on our experiences, and no one is right or wrong,” she said. “We need to listen, respect each other, and keep our students in the middle.”

Erin Kenworthy is a former public school teacher who comes from a long line of teachers. She left her public school teaching role because she couldn’t afford to live and work in the community where she taught, but she continues to teach in other roles.

Kenworthy says schools are there to meet students where they are and support their needs and interests, from apprenticeships to career and college readiness. The district must attract and retain highly qualified educators with competitive pay to accomplish that goal.

“As a former educator, it’s imperative that we treat our educational professionals as professionals.

They deserve fair compensation and healthy, safe, supportive, and balanced work environments,” Kenworthy said.

It’s also important to her that educators learn culturally relevant, trauma-informed practices in approaching students who may be

responding to a situation or stimuli based on things they have not experienced in that school or are not immediately attached to that situation.

Joel Newton has lived in Jeffco for 18 years and believes he has a responsibility to make the community better. He started Edgewater Collective to support local Title I schools to build community partnerships so those students, families, and educators have what they need to succeed.

“We can’t sugarcoat tough decisions, and we need to educate the community about our priorities,” he said. “The budget priority process starts at the schools. These conversations have to start in December, and we need to keep what’s best for our students at the center.”

To solve some of the issues around the cost of living in Jeffco, Newton suggested looking for community partnerships for low-cost housing opportunities and other creative solutions for the district’s staff to live and work in the community.

“With education, there are a lot of things we can disagree on, neighborhood vs. charter schools or whatever it might be,” said Newton.

“But I am firmly committed to listening and seeking to understand where every stakeholder in Jeffco is coming from because as we do that as a board, we find the common good.”

Cities accelerate turf wars with construction bans, median rip-outs

Broomfield has joined a swelling wave of Colorado communities sharply limiting thirsty turf grass in new development, with more communities about to follow, while other cities and parks departments are starting to rip out useless grass in medians and rights of way for replacement with water-wise landscapes.

State water officials, meanwhile, have closed out the first year of $1.5 million in local turf removal grants with nearly 40 applications for the money, and water resource experts hope to use the momentum from the anti-turf evolution to create a bigger state-funded buyback next year.

“The momentum toward waterwise landscape transformation is unprecedented in the last year or two,” said Lindsay Rogers, a water specialist with Western Resource Advocates.

The nonprofit worked with WaterNow Alliance to advise Broomfield, and Rogers said cities from Fort Collins to Grand Junction to Edgewa-

ter are working on or have recently passed new landscaping ordinances deemphasizing turf. WaterNow Alliance’s grant work with Broomfield, population 78,000, provides up to 250 hours of pro bono water-wise consultation, Rogers said.

The Broomfield City Council unanimously passed what Rogers calls one of the strongest turf restrictions in the state in early October, with turfgrass allowed on only 30% of the front and side yards of new detached homes and commercial construction. New irrigation systems in Broomfield must have rain shutoff sensors to prevent overwatering, and turf is banned from parking lot landscapes. Broomfield’s new ordinance starts Jan. 1.

Aurora and Castle Rock have also recently passed sharp cutbacks in turf allowance for new construction, after years of drought in Colorado helped build momentum for water savings. While municipal water use overall makes up less than 10% of statewide water use, with the vast bulk going to agriculture, landscape

watering makes up half or more of municipal usage. Broomfield said 60% to 70% of its water use has been outdoors in recent years.

“We’ve seen a great appetite by our existing residents to participate in our water-wise planting and garden in a box programs,” Broomfield Mayor Guyleen Castriotta said. “So there’s definitely a growing desire to reduce water consumption and conserve, and we’re trying to walk the walk to do it with our own properties.”

Like Lafayette and other cities, Broomfield is beginning to rip watersucking turf out of public median spaces that are not used for sports fields or public enjoyment, and replace the grass with landscapes that use far less water.

Rogers and other state leaders mentioned a growing handful of other anti-turf efforts around Colorado: Lafayette has an ambitious public turf replacement series underway, with big demonstration projects replacing grass with low-water plantings, and educational signage so that

the gardens can be used as a “shopping” list for homeowners wanting to do the same. The city also has programs offering homeowners $1 a square foot in new landscaping subsidies if they rip out grass.

School absenteeism high, with 31% of students missing too much

Nearly a third of Colorado students were chronically absent last year, missing 10% or more of the days they were supposed to be in school, according to new state data.

That’s slightly better than the 2021-22 school year — when COVID’s omicron variant ripped through schools —but far worse than any year before the pandemic.

Colorado education leaders are sounding the alarm about the missed days, as student academic performance still hasn’t recovered to pre-pandemic levels.

“Every day a student is in school is an opportunity for them to learn, build relationships and access support,” Colorado Education Commissioner Susana Córdova said in a press release. “We know districts are working hard to ensure students attend school regularly.

But we need everyone, including educators, parents, students and community members, to make a renewed effort on this important matter.”

“The surest way to make improvements in our recovery from the disruptions of the pandemic is for kids to be in school,” Córdova added.

Colorado’s chronic absenteeism

rate was 31% last year, representing 269,582 students in kindergarten through 12th grade. Before COVID, rates ranged from 18% to 24%. Colorado is not alone, with most states reporting more students missing school.

Some groups had a greater share of students who were chronically absent. Kindergartners and 10th, 11th, and 12th graders all had chronic absenteeism rates above 35%. Roughly 40% of English learners missed too many days of school, as did 43% of low-income students and 60% of homeless students.

And the majority of absences — 62% — were excused.

Johann Liljengren, director of the dropout prevention and student re-engagement office in the Colorado Department of Education, said schools report a wide range of reasons students aren’t showing up to school. Expectations around health and wellness are different in the wake of COVID, and there’s more concern about not spreading illness to others. State education officials point to “how sick is too sick” guidance for when kids should stay home.

Some students report that they feel anxious or that they don’t feel safe at school. Others are disengaged or bored, and much of their schoolwork is now available online, even if instruction is supposed to happen in person.

School-based attendance workers and others who work with youth missing school describe teenagers sleeping in after working overnight shifts and elementary students who don’t make it to school because a parent is depressed or overwhelmed.

don’t feel like much to a parent can add up over time.

And missing school can be a warning sign for future problems.

Students who are chronically absent in middle school are more likely to drop out of high school, he said.

Liljengren said more schools are beginning to use attendance teams that go over data, reach out to families, and make home visits.

The state, meanwhile, has some grants available to support that work and also points schools to organizations like Attendance Works, which provides free resources. The state has also convened a cohort of school district leaders to share information and learn from each other.

Liljengren stressed that schools need to give students a reason to show up.

“What are we really valuing about in-person or live lessons?” he said.

“We are thinking about how we really draw students in.”

Denver Parks and Recreation is replacing turfgrass with low-water landscaping in medians and oddlot spaces it controls after decades of city growth and change. One of the initial projects was a highprofile median at Quebec Street and Martin Luther King Boulevard, said deputy parks director Scott Gilmore. The parks department has multiple medians and scattered block-size spaces it controls but which are not useful for public park or athletic field use, such as a block at West 48th Avenue and Julian Street cut off from the larger Rocky Mountain Lake Park by Interstate

70 construction.

Denver Water is helping to pay for the work, which replaces 10 acres of traditional Kentucky bluegrass in the broad median area.

Fort Collins is preparing to overhaul its landscape ordinances with a restriction similar to Broomfield’s of no more than 30% turf at new home construction, Rogers said.

Fort Collins and other cities are also studying bans on installation of artificial, plastic grass as a turf replacement, Rogers said. Artificial turf comes with increasing concerns about PFAS “forever chemicals” used in manufacturing and then shedding in water runoff, as well as creating urban heat islands and a lack of recycling options for old artificial grass.

Grand Junction is working on new landscaping codes that will include not only options for waterwise, low-use designs, but an additional option for ultra-low water

“high desert” landscaping, Rogers said.

Colorado is processing up to 39 applications from towns for the initial $1.5 million in state turf buyback programs. Legislators and water experts designed the grant program to fill in gaps among cities that haven’t launched their own buybacks, which until now have been concentrated in larger western cities like Aurora, Las Vegas and others. Rogers and others hope the high interest will push the legislature and state water board to find even more money for the program in 2024.

“We’d like to see an annual appropriation, given how popular it’s been,” she said.

Though many drought-savvy Colorado residents have moved beyond condemning all water-wise landscapes as “zero-scaping” in terms of aesthetics, turf replacement still requires constant pub-

lic education efforts, Szorad said.

Residents don’t want their lawns or public spaces simply given over to concrete or desolate gravel-scapes.

Nor do they want to add to worries about dry plants and weeds fueling future wildfires.

A Lafayette fire station is one of the first public spaces to rip out turf and demonstrate wiser alternatives, after firefighters were ready to give up mowing the unused lawns, Szorad said.

Attractive but defensible landscapes, Szorad said, have “been a very hot topic for our community ever since the Marshall fire.”

onesome Dove” is one of the rare stories that played well both in its original novel form and in film, in this case, a TV series. The success of the latter was due in large part to the brilliant acting by Robert Duvall and Tommy Lee Jones. They perfectly captured and portrayed the essential character of the protagonists, complementing and contrasting the other in the way author Larry McMurtry created them. Both men were noble, pure in spirit and serious about life, facing it head-on but with totally opposite natures. Augustus McCrae (Duvall) celebrated life and would not allow challenges, disappointments, and even tragedy to de-sway him from his live-lifeto-the-fullest attitude. Woodrow Call (Jones), on the other hand, was deadly serious, task-directed and taciturn to a fault. A smile would have cracked if not shattered his visage.

Beyond the scope of that adventure, set in the Old West that is now fodder for lore and legend, the two primary characters serve as models — archetypes — for men to this day. For my part, men like Woodrow drive me nuts with their rigidly

uptight focus on moral strictures and life’s practical side. Guys like Augustus — Gus — are far more appealing to hang with due to their elan, their spirit of life. Their philosophy is that life is not only to be lived but to be enjoyed Columnist and celebrated.

I have aspired and tried to live my life the Gus way, albeit with serious lapses. Looking back on the periods during which I dawdled, even struggled, I realize I wasted a lot of time. That’s not to say time spent feeling down, blue, or melancholy isn’t justified or needed. But opting to stay in such times for prolonged stretches not only drains the spirit, it also wastes the most important human resources: Time and Attention. With the grains of sand in my hourglass of life now dwindled to a precious few, I’ve decided I’ve no time to waste. My intention hereon is to push pell-mell into Augustus territory. If my fate is to look down at my toes at my last breath, I hope

that I have the strength of character to echo Gus’s last sentiment with a smile: “It’s been a hell of a party.”

But what did Gus mean by that?

Was his life filled with partying or was his life a party? Of course, it’s the latter, which forces us to reconsider and eschew our general definition of party. For Gus, a party wasn’t a short-term, narrowly focused occasion for frivolity and celebration. Instead, it was living a life that held that every moment was one to celebrate. In “Lonesome Dove,” there were plenty of sad, sober, even tragic scenes that were hardly celebratory. But sadness and tragedy are part of life. Still, that reality doesn’t—shouldn’t— negate the idea that life ought to be celebrated. That includes times when that extra heaping of doodoo is piled upon your plate, so much so that it topples over.

When that happens, it ought to simply tell you that you have quite a mess to clean up. Of course, that’s easier said than done. There’s no “Mucking through the Dung for Dummies” guidebook to reference nor a magic wand to make the tough times go better. Rather, we need to find or devise ways to help

ourselves through the muddle. For me, that includes hiking, skiing, gardening, reading, writing, and getting with friends.

When reading about or listening to another’s personal tale, I am far more interested in the stories within a person’s story along with their whys and wherefores rather than a this-and-that litany of their deeds.

Imagine Woodrow and Augustus writing their memoirs. In all likelihood, Woodrow’s would read like a laundry list of things he did and accomplished, places he went to, and names of important people he met along the way. Augustus’s tale would be much different in style and content: It would be an engaging if not gripping tale of exploits and interesting characters who were his companions during those adventures. Think about which tale would put you to sleep and which keep your rapt attention. Then consider how you’d like your life story be told when you’re six feet under or ashes to the wind.

Visitors to the Denver Museum of Nature & Science, 2001 Colorado Blvd., can explore that far off time with the new exhibit, Mysteries of the Ice Ages, which opens on Friday, Oct. 20.

Regarding the Oct. 5 article about “Arvada settles with Johnny Hurley’s family” ... I felt well informed about the settlement, until I read the end of the article which published the manifesto of the murderer of Officer Beesley.

I think that was a poor and reckless decision, and only gives more light and exposure to a crazy person’s evil ideology. I don’t see how

publishing his words “I will be a hero in the eyes of millions for killing pigs ...” helps the community, the family of Officer Beesley, or the Arvada Police Department. ack Walters wasn’t planning to play college football.

Now, he plays for the

reigning NCAA Division II National Runner-Up, practically down the street from where he grew up.

A three-sport athlete for Golden High School, Walters hoped one of the Rocky Mountain Athletic Conference universities would recruit him during his senior year. Once Colorado School of Mines reached out and offered him a scholarship, he knew that’s where he belonged.

“Growing up in Golden, Mines is just in our backyard,” Walters said. “ …

I knew I wasn’t going to pass up on it. It’s a great academic school, and (has)

some of the best football in the country.”

Walters is one of about 30 players from the Denver metro area on the Mines football team, helping spur the Orediggers toward their firstever national title.

Because many of them played against each other in high school, the local Orediggers have a unique bond, Walters and Pomona High School graduate Billy Pospisil III described.

The players sometimes dish out good-hearted “smack talk,” they said, and share stories about

opponents or coaches they had in common.

Walters explained how those similar experiences can make things easier when meeting new players on recruiting visits or at camps.

That’s something Valor Christian High School graduates Jackson Zimmermann and Carter Forsythe can attest to.

The two played together at VCHS, and when Forsythe visited the Mines campus, Zimmermann — who was a freshman cornerback for the Orediggers — showed him around.

Forsythe, now a redshirt freshman linebacker, said seeing Zimmermann find success at Mines was one of the reasons he decided to join too. Another was the program’s culture, and how similar it was to Valor Christian’s, he continued, adding how there are now six VCHS alumni among the Orediggers.

“Mines’ culture is already so fantastic,” Forsythe said, “ … (and) Jackson made it an easy decision.”

they described, was how frequently they get to see their loved ones at the games. They said their family members, former teammates and coaches, family friends and others from the Valor Christian community show up to support them at the games.

Pospisil, who played wide receiver at Washington State University and grad-transferred to Mines in fall 2022, commented how grateful he was to be back home. He believed attending a local college was “underrated,” and that some high school students might overlook it as an option.

“But, coming back after being away, there’s really not much that beats it,” Pospisil continued. “ … It’s been a great ride ever since.”

Where nerds win

Despite attending different high schools, the four players said their experiences helped prepare them for everything they’d face at Mines.

Walters said Golden’s football team struggled his freshman and sophomore years, but a new head coach and a change in culture propelled the program to new heights.

“It taught us what it was like to be in a winning program,” he continued.

That was something Zimmermann found very early at Valor Christian.

The redshirt sophomore cornerback said he wasn’t planning to play high school football, clarifying that he went to Valor Christian for its academics. But he ended up “falling in love” with the game and the program’s culture.

Despite having six head coaches since starting high school, he said he’s been drawn to programs “where, no matter who the coach is … you’re going to have a great brotherhood around you.”

Zimmermann and Forsythe described how Valor Christian and Mines have similar cultures centered on brotherhood and trust. And for both programs, that’s translated into winning records, Forsythe added.

“Winning isn’t everything,” he continued.

“But it’s definitely a byproduct of the hard work we put in here (at Mines) and the chemistry we have.” #HelluvaEngineer

The Orediggers aren’t just facing tough situations on the field, but in the classroom as well.

The players must learn to balance athletics with their classes in engineering, computer science and similar subjects.

Pospisil, who’s pursuing a master’s degree in environmental engineering science, said the Orediggers face a “truly unique situation” as far as college football goes.

“School is tough, but it’s going to be tough when you’re doing any one of these majors,” Pospisil continued. “But when you’re done, you’re set up for life. I think in the receiver’s

room, the average starting salary in the last five years is close to $100,000 now.”

While Pospisil was unsure if he’d return to Mines next year, Walters plans to use his final year of eligibility in fall 2024 and pursue a master’s degree in engineering & technology management.

Walters is currently studying mechanical engineering, which he said he didn’t know much about when he first started at Mines. But he’s enjoyed becoming a proverbial jack-of-alltrades, studying everything from construction to technology consulting.

“It’s really hard, but I like it,” he said. “ … If I was telling my high school self if I should come to Mines, I’d say do it 100%.”

When he graduated from Washington State with an engineering-related degree, he knew Mines would be the “perfect fit.” “‘Where can I go play some great football and get a great education?’” he continued. “There’s really no better place super close to home.”

Zimmermann and Forsythe both said they were grateful to be able to represent Valor Christian and the Highlands Ranch-Littleton area on the college football stage. The two hoped their families, hometown communities and the Denver area would continue to support them as the Orediggers hope to end 2023 holding a trophy.

“It’s really cool to just see the support,” Zimmermann said, “and see everyone come together in Golden.”

‘The perfect fit’

While there’s been plenty of adversity to overcome both on and off the field, Walters had no regrets about coming to Mines. He said the university and the football program have taught him “how to grow up.”

“You don’t really know how hard school and football can be,” he said, adding that because of that adversity he’s now forged bonds with his fellow Orediggers that’ll likely endure all their lives.

Those planning to attend college shouldn’t be afraid to stay local, Walters said. While he always wanted to go to an out-of-state college, he described how Mines “is such a special place you can’t get anywhere else in the country.”

Pospisil felt the university deserved more national recognition for its academic prowess.

Ban on hunting mountain lions and bobcats in Colorado could land on 2024 ballot

After Colorado lawmakers last year rejected a proposal to ban mountain lion hunting, animal rights advocates are planning to ask voters to end wildcat hunting.

A proposed ballot measure for the November 2024 ballot would prohibit hunting, trapping, using dogs or electronic devices to hunt mountain lions, bobcats or Canadian lynx.

The proposal asks voters to declare that hunting wildcats “serves no socially acceptable or ecologically beneficial purpose and fails to further public safety.”

Julie Marshall, the communications coordinator at the Center for a Humane Economy, said the ballot initiative proposal is “Colorado-centered” but has support from about 50 state and national animal advocacy groups.

trapping in Colorado and the West is for pelts that are sent to Russia and China. California has prevented mountain lion hunting since 1972 and since 1990 the state protects the wildcats as a nongame species. In 2015, California banned trapping of bobcats.

In 2020, the state banned bobcat hunting. (The ballot measure includes protections for Canadian lynx, which are endangered.

Colorado Parks and Wildlife reintroduced lynx in the late 1990s but advocates suspect they are occasionally injured or killed by hunters or trappers thinking they are bobcats, Marshall said.)

“The North American Model for Wildlife Conservation says you are not supposed to kill wildlife for commerce and that’s exactly what’s being done in Colorado. It’s giving all ethical and fair chase hunting a black eye,” Marshall said.

The coalition soon will begin training people to help gather more than 124,000 signatures from Colorado residents to get the proposed ban on the 2024 ballot.

Marshall said the signature gathering will include an educational campaign with information about wildcat hunting. Colorado Parks and Wildlife estimates there are between 3,000 and 7,000 mountain lions in Colorado.

In an email, Marshall forwarded links to online videos posted by hunters using dogs to tree large cats and then shooting them.

“We feel that a large majority of Coloradans have not been able to learn about what is happening to our wildcats and our woodlands,” she said.

Colorado Parks and Wildlife commissioners in January 2021 approved rules allowing hunters in about nine hunting units to use electronic calling devices to lure mountain lions with the sounds of dying critters. Since 2007, the agency requires that cat hunters take an education course and test to make sure they can identify a lion’s gender in an attempt to reduce the number of females killed.

In January 2022, animal rights groups worked with four Front Range lawmakers to propose a law — Senate Bill 31 — that banned hunting of wildcats. The bill riled hunters and opponents flooded lawmakers with emails. Three of the bill’s top sponsors pulled their support before the Senate Agriculture and Natural Resources rejected the legislation in February 2022.

In 2020, the Colorado Humane Society conducted two surveys of 3,300 state voters showing strong opposition to mountain lion hunting. The group’s July 2020 survey of 1,800 voters found 69% opposed hunting mountain lions and 23% supported. A December 2022 survey showed similar responses by voters who were asked about killing wildcats to prevent conflicts with people and livestock.

In 2005, Colorado Parks and Wildlife surveyed 1,300 residents and found 47% supporting legal and regulated hunting of mountain lions and 41% opposed. About 46% of respondents to that survey disagreed that hunting mountain lions should be banned while 34% supported a ban.

versity researchers for the mountain lion advocacy group The Summerlee Foundation showed 67% strongly agreeing with the idea that mountain lions should not be harmed by humans without cause. That survey also showed an even split — 40.6% — between residents who approve and disapprove of mountain lion hunting, with 19% saying they did not have any opinion. but a large majority said they did not like the idea of using dogs or electronic devices to hunt wildcats.

In 1980, Colorado hunters killed 81 mountain lions. In 2021-22, 2,493 hunters spent 1,826 days hunting mountain lions and killed 486 animals, down from a 10-year high of 515 in 2020-21. The agency adjusts caps for mountain lion harvests every year, with the 202324 hunting season capped at 674 animals.

Bryan Jones with the 1,800-member of the Colorado chapter of Backcountry Hunters and Anglers said his group is working with the Colorado Wildlife Conservation Project on a response to the proposed ballot initiative.

The 30,000-member Backcountry Hunters and Anglers does not support any wildlife management policy through legislation or voter initiatives. The North American Model of Wildlife Conservation that has guided the country’s wildlife management for more than a century with partnerships between states and the U.S. Fish and Wildlife Service is based on “the best science available.” The model considers wildlife as natural re-

sources that should be managed by scientists and prevents commercial hunting.

This is not the first time advocates have pushed wildlife management issues to voters. In 2020 Colorado voters narrowly approved a plan to require Colorado Parks and Wildlife to reintroduce wolves in Western Colorado by 2024. In 1996 voters approved a ban on lethal “leghold traps, instant-kill bodygripping design traps, poisons or snares” by animal trappers. In 1992, voters overwhelmingly approved a law that prevented hunting black bears with dogs or bait or between March 1 and September 1.

In early 2022, as Colorado lawmakers considered legislation that banned mountain lion and bobcat hunting and trapping, Backcountry Hunters and Anglers led a campaign that directed an estimated 20,000 emails to legislators blasting the proposed change in hunting regulations.

“We support hunting and fishing and trapping as efficient wildlife management models in Colorado,” Jones said. “We advance sound stewardship that is guided by science, not politics or emotion or any other conjecture.”

Colorado voters approved a ballot measure in 2020 increasing taxes on tobacco and nicotine products and letting the state use the revenue to fund a universal preschool program.

But the increased taxes generated more money than expected to the tune of about $24 million. So the legislature passed a bill asking voters this year through Proposition II to let the state keep that extra money — as well as all future revenue from the taxes — and use

The increased tobacco and nicotine taxes were approved in 2020 through Proposition EE, which was placed on the ballot by Democrats in the legislature. The measure, which got the support of 68% of voters, gradually increases tobacco and nicotine taxes through 2027.

When the initiative was drafted, nonpartisan legislative staff predicted the increased taxes would generate $186.5 million in new revenue a year. But the revenue has been much higher than that — at around $208 million — which is why Proposition II was placed on the November 2023 ballot.

A similar situation played out after Coloradans legalized the sale and possession of recreational marijuana in 2012. In 2015, voters approved Proposition BB, which let the state

keep recreational marijuana sales tax revenue collected above what was estimated and use the money predominantly for school construction.

How did Proposition II get on the ballot?

The legislature placed Proposition II on the ballot through the passage of House Bill 1290 this year. All 31 Republicans in the General Assembly, as well as three Democrats, voted against the legislation.

Where will the money go if Proposition II passes?

The tax rate will stay the same and the excess revenue would go toward Colorado’s existing preschool program, which this year began offering at least 10 hours a week of preschool in the year before they start kindergarten, as well as instruction for 3and 4-year-olds with disabilities.

That program has been popular, but it’s off to a rocky start, with some

school districts suing the state over funding issues and religious schools suing over nondiscrimination requirements.

The money collected through Proposition EE went to K-12 education, rural schools and housing assistance in the first three years.

What exactly will happen if Proposition II fails?

If voters reject the ballot measure, the state will have to return nearly $24 million to cigarette and nicotine wholesalers and distributors through direct refunds and temporary tax breaks.

The state would also cut nicotine and tobacco taxes by 11.53% to avoid collecting excess taxes in the future.

For context: The taxes on a pack of cigarettes under Proposition HH are currently $1.94 and set to increase to $2.64 on July 1, 2027. The tax on other tobacco and nicotine products is currently 50% and set to rise to 62% starting in July 2027.

What supporters say

Supporters contend that higher taxes on tobacco and nicotine products discourage their use. They also argue that increasing funding for Colorado’s universal preschool program will improve educational and health outcomes for the kids who benefit from the instructions.

Groups supporting the ballot measure include Healthier Colorado, the Colorado Children’s Campaign, Children’s Hospital Colorado and Great Education Colorado.

Preschool for All Coloradans, the issue committee supporting Proposition II, had raised more than $291,000 through late September and spent only about $34,000. The top donors to the group are Healthier Colorado at $90,000, Save the Children Action Network at $86,000 and Gary Advocacy at $50,000. Arvada West hoists girls flag football state trophy

ENGLEWOOD — Arvada West’s girls flag football was a picture of perfection this season.

In the second year of girls flag football as a pilot program with the hope to become a Colorado High School Activities Association sanctioned sport for the 2024-2025 school year, the Wildcats captured the state title Saturday at the Pat Bowlen Fieldhouse at the Denver Broncos’ Center Health Training Center.

A-West defeated Cherry Creek 3414 in the final of the 16-team state championship tournament. The Wildcats finished the season with a perfect 25-0 record.

“I’m so happy we got here. Last year we let it slip in the championship,” A-West junior Sara Walker said referring to A-West losing to Chatfield in the title game a year ago. “This year we made it all the way through undefeated. We got our revenge.”

The Wildcats cruised to victories over Chatfield V2, Mountain Vista and Pomona before facing Cherry Creek in the championship game.

The Bruins took a dramatic overtime win over Ralston Valley in the semifinals.

“It definitely helped,” A-West junior quarterback Saylor Swanson said of the Wildcats not having a tight game through the first three rounds. “We weren’t too exhausted and it helped having the experience of playing in the title game last year.”

A-West took an early 14-0 with touchdown passes from Swanson to Walker and junior Molly Schellpepper. The Wildcats pushed their lead to 21-0 at halftime.

“We were favorites this year, but we didn’t let that get to our heads.

The girls came out to play today,” A-West coach Mario Lopez said.

“They had ambition. They had drive. Everything was about discipline today. Mistake free flag football is what I kept preaching and that is what they did today.”

ner-up to Jeffco rival Chatfield at the state tournament. The defending state champions were knocked out of the tournament in the quarterfinals by another Jeffco team, Ralston Valley.

Three of the four semifinalists were Jeffco teams. A-West and Pomona were joined by Ralston Valley in the Final Four.

“We felt really confidence,” Walker said. “We knew we were going to win. I’m so happy we did.”

Walker, Schellpepper, along with sophomores Santana Pena and Aubri Cespedes gave Swanson plenty of offensive targets for the diverse offensive attack for the Wildcats.

“We have a very talented offense.

I put a lot of skilled players on offense,” Lopez said. “Last year our

quarterback (Swanson) didn’t really play defense. She is a gamechanger and she proved it today.”

Swanson did it on both sides of the ball in the title game throwing four touchdown passes.

“She (Swanson) did great. She is always amazing,” Walker said. “She always finds the right person and makes the right read. She gets the ball to the receiver. She is the best QB in the state.”

The point guard for A-West’s girls basketball team handled the pressure of playing in the state championship game for the second straight year.

“Being the favorite is always the hard part to be in,” Swanson said.

“We couldn’t get complacent. We stayed focused and got the job

done.”

A-West should be right back in the mix next season. The majority of Lopez’s players will return. He also believes girls flag football has a “bright future” and will clear all the hurdles to become a CHSAA sanctioned sport next year.

Only time will tell if Jeffco will be able to claim a third straight girls flag football state title next Fall.

For now, A-West is the home of the state champions.

“It was very important to stay in Jeffco, but it stays at Arvada West for this year,” Lopez said.

Columbine football gets it going in the 2nd half against A-West

LAKEWOOD — While the final score didn’t indicate it, but Columbine was in a battle late Friday afternoon at Jeffco Stadium.

Columbine — No. 3 in this week’s Class 5A Colorado Preps Select Media Football Poll — was tied 14-14 against Arvada West with 9:20 left in the third quarter. A successful on-side kick by the Wildcats led to a 3-yard touchdown pass from sophomore quarterback Logan Duhachek to sophomore Ayden Garcia.

A 2-point conversion by A-West (4-4, 1-2 in 5A Jeffco) tied the game up.

“I was a little frustrated,” Columbine senior Josh Snyder said. “I still had faith in our team that we would come out, fight and persevere.”

Columbine (8-0, 3-0) did just that scoring 28 unanswered points to take an eventual 42-14 victory to stay undefeated on the season.

The Rebels were coming off the big and emotional victory the pervious week against No. 4 Ralston Valley (6-2, 2-1).

“It was defintely a wake-up,” Columbine coach Andy Lowry said of the Rebels being tied 14-14 early in the third quarter. “I have to give Brad (A-West coach Brad Pyatt) and his kids a ton of credit. They played hard.”

The Rebels had two touchdowns runs by Snyder in the first half to give Columbine a 14-0 lead, but A-West responded just before halftime with a 1-yard touchdown run by sophomore Adrian Symalla in the final minute before halftime to cut the lead to 14-6.

“We started out slow. We didn’t have a great week of practice,” Snyder admitted. “We were sluggish in that first half. Our coaches figured it out at halftime.

Snyder started the 28-0 run with a long kickoff return and his third touchdown of the game on a 7-yard run with 5:54 left in the third quarter. Senior running back Mason Moreno got into the scoring action with a 1-yard run on the final play of the third quarter to push the lead to 28-14.

“It defintely wasn’t as clean as we

would like to be. Especially in that first half,” Moreno said. “It was great defense by Arvada West in that first half. At halftime we fixed it. Our hoggies (offensive line) were dominate in the second half.”

Moreno actually had the defensive play of the game with a stripsack and fumble recovery early in the fourth quarter on Duhachek.

“It was a corner blitz that we just installed this week in practice,” Moreno said. “It was just a great coaching scheme to give me an opportunity to make a play.”

nior quarterback Brennan Goodwin tossed his first touchdown pass of the season with a 21-yard strike to senior Spencer Houle. Goodwin is still filling in for senior quarterback Reeve Holliday, who missed his second game after having emergency appendectomy surgery last week.

The hope is to have Holliday back on the field this season.

Snyder finished off the scoring with his fourth touchdown run with 3:12 left in the game.

“All the backs ran hard,” said Lowry, who wasn’t happy with the firsthalf performance. “We just took turns making mistakes. Those are just drive killers.”

Columbine has two regular-season games remaining. The Rebels have home games at Jeffco Stadium against Lakewood (Thursday, Oct. 19) and Chatfield (Friday, Oct. 27).

The rivalry game during the final week of the regular season against the Chargers (5-3, 3-0) will determine the 5A Jeffco League championship.

“We just need to maintain the focus we had during the Ralston week for these next two weeks of practice,” Snyder said. “Then carry it on to playoffs.”

A-West was No. 22 in the 5A football CHSAA Selection & Seeding Index before the start of play Friday.

The Wildcats face their two rivals to close out the regular season. AWest has Pomona (0-8, 0-3) on Friday, Oct. 20, at the North Area Athletic Complex before getting a shot against No. 4 Ralston Valley (6-2, 2-1) on Oct. 26 at NAAC. There’s no organized opposition thus far to Proposition II. Several conservative leaders told The Colorado Sun they are more focused on defeating Proposition HH, the 10-year property tax relief plan also on the November statewide ballot.

The Centennial Institute, a policy think tank at Colorado Christian University, sent out a ballot guide opposing both II and HH. “Colorado has enough tax dollars,” the guide

said. “Any additional tax revenue collected should be returned back to the taxed individual or business.”

State Rep. Stephanie Vigil, of Colorado Springs, was one of the three Democrats who voted against House Bill 1290, the measure putting Proposition II on the November ballot. She said her “no” vote was more about the increased nicotine and tobacco taxes than letting the state keep the excess revenue generated by them.

“I had to signal my dislike for tax structures of these kinds,” Vigil said.

“I pledged this to my constituency, especially my libertarian constitu-

ents, that I’m not supportive of higher taxes on tobacco products — sin taxes. I find them rather regressive and not particularly helpful in encouraging people to quit smoking.”

Public Notice NOTICE OF FINAL SETTLEMENT Notice is hereby given that disbursements in final settlement will be issued by the Finance Director at 10:00 a.m., October 31, 2023 to Diamond Contracting Corp for work related to Project No. 2022 Water Main Replacement and Castlegate Project. Project # 22-WA-02 & 21-WA-03 and performed under that contract dated September 22, 2022 for the City of Arvada.

Any person, co-partnership, association of persons, company or corporation that furnished labor, material, drayage, sustenance, provisions or other supplies used or consumed by said contractor or his sub-contractors in or about the performance of the work contracted to be done by said Diamond Contracting Corp and its claim has not been paid, may at any time on or prior to the hour of the date above stated, file with the Finance Director of the City of Arvada at City Hall, a verified statement of the amount due and unpaid on account of such claim.
