Douglas County has under 100 people who are unhoused and hundreds more in precarious housing, but county leaders say community stigma has so far hindered efforts to provide year-round shelter locally.Concerns about safety and funding were reignited at the Aug. 11 meeting of the Douglas County Homelessness Initiative, where a plan to expand the existing winter shelter network hosted by a variety of churches to a year-round program faced resistance from public commenters.Onecommenter said she only supported helping the people who want help, but not with a shelter. “I don’t want to see this beautiful area that we live in and we choose for this reason to have homeless to have drugs, to be downtown infiltrated,” the woman said. “We do not want to invite homeless into our area. I am very, very opposed to this.”
The ballot language would ask voters to approve an extension — not an increase — to the 0.17% sales and use tax, which was first approved in 1994.The tax is currently scheduled to sunset in January 2024. If the proposed ballot language is approved in November, it would be extended until 2039, or 15 years. The recently passed climate change, tax and health care bill, gun reform, national security and the need for respect in politics were among the topics discussed during an Aug. 22 town hall with Rep. Jason Crow, a Democrat in Colorado’s 6th Congressional District. Crow spoke to about 165 people at Koelbel Library in Centennial. It provided an opportunity for him to hear resident feedback before he heads back to Washington D.C. for the final legislative push, he said. “I love these very much. I get as much out of these as I hope you’re gonna get out of it today,” Crow said. “But I’m really excited for this one in particular because

Reuters Fact Check looked into the issue and reported social media users raising these concerns “miss key context,” including that the bud get is for an array of positions, not just auditors, and representatives have repeatedly said “audit scrutiny would not increase relative to recent years for those making less than $400,000.”Whenasked about the concerns, Crow said the Inflation Reduction Act is a great bill and sometimes when people are up against a good bill, they resort to fear mongering.
Crow supports Assault Weapons Ban When asked about the status of an assault weapons ban, Crow said the House of Representatives recently passed the assault weapons ban again.“Ithas gone, like so many great ideas, to die in the Senate. That’s not for lack of support by our great senators here in Colorado, but that’s a simple function of the filibuster, where you need 60 senators to agree to any one measure,” he said. Crow, who voted to help pass the Bipartisan Safer Communities Act, which was the first major federal gun safety legislation passed in about 30 years, said he has had a life long relationship with firearms. He said he was given his first gun when he was 12 years old and has been a gun-owner for decades. While Crow was speaking, one at tendee interjected and asked, “Can we take them from you?”
Crow said the legislation will also reduce the cost of healthcare. For example, the bill will extend en hanced Affordable Care Act subsi dies for another three years and will allow Medicare to negotiate prices for some drugs, he said. It also caps Medicare Part D out-of-pocket drug costs at $2,000 a year for seniors and individuals with disabilities on Medicare, starting in 2025. The bill includes approximately $370 billion in investments address ing climate change, according to House Speaker Nancy Pelosi’s fact sheet.“It’s going to make investments in clean energy, so we can actually ad dress the climate crisis,” Crow said. He said the bill will help promote Colorado’s economy because clean energy is one of the fastest growing sectors of the state’s economy and employs thousands of Coloradans.
“There’s a lot of fear mongering about, you know, IRS agents beating down doors, and that’s just not what this is,” Crow said. “That’s just not what we’re looking to do. We’re look ing to enforce the law. We’re looking at making sure people pay their fair share in taxes.” Crow said in recent years, audits for millionaires have decreased more than 70% and basic services for residents trying to get their tax returns have gone down. Last year, four out of five customer service calls for the IRS went unanswered, heThesaid.bill will help increase enforce ment to find those who are not pay ing their taxes and increase services so people can get responses from the IRS, he said.
Bipartisanship and need for respect Being bipartisan is something Crow takes seriously, he said. He noted a report by the Lugar Center and the McCourt School of Public Policy at Georgetown University listed him as number 11 on the bi partisan index rankings for 2021 for the U.S. House of Representatives. According to Georgetown Univer sity’s website, the bipartisan index “measures how often a member of Congress introduces bills that attract co-sponsors from the other party, and how often they in turn co-sponsor a bill introduced from across the Bipartisanshipaisle.” is the way to get legislation done, Crow said, empha sizing the importance of respect in politics.“Theproblems facing our country are complicated. Governing is hard. Legislating is hard. There are unin tended consequences of legislation all the time,” he said. “But what that means is, we have to find ways to respect each other.”

In July, the bill, which expands health care and benefits for veterans exposed to burn pits and other toxic substances, gained national atten tion when 25 senators blocked it on the day it was expected to pass the Senate.Thebill had previously passed the Senate in June by an 84-14 vote, but a technical error in the bill required another vote, according to an NPR article. The July vote ended up being 55-42, with 25 Republican senators who previously supported the bill voting against it. However, on Aug. 2, the Senate voted again, and this time passed the bill in a 86-11“Wevote.cannot overstate how impor tant this is for my fellow veterans and brothers and sisters, of how big of a difference it’s gonna make,” Crow said.

“And the reason is because the weapon matters. They’re designed to do very, very different things, and they’re both very good at what they’re designed to do,” he said.
Crow said it’s important to be open and to engage with others, as well as recognize that words matter. The rhetoric of elected officials and leaders can incite violence, and he said he has been vocal against some of his colleagues and calls out when such rhetoric is used.
Crow on national security, Ukraine Crow, who assumed office in 2019 and is running for re-election in November against -Steve Monahan, said he currently serves on three committees in Congress — the House Small Business Committee, the House Armed Services Commit tee and the House Permanent Select Committee on Intelligence. “My committees are really a re flection of my priorities in Congress and the things that are important to this community,” Crow said. “My adult life has been dedicated to preserving the national security of our country. And I started my public service career in uniform and served three combat tours in Iraq andAfterAfghanistan.”beingasked about U.S. in volvement in Ukraine, Crow said the issue is something he spends a lot of time working on in the intelligence committee and the armed services committee.“Ibelieve in supporting Ukraine and making sure that they’re in a position to win and defend their homes and their democracy,” Crow said. “But we cannot allow this to disrupt the international economy.” Crow said he has visited Ukraine twice in the last year, and the things the Russian military is doing are horrific and has to stop. However, he said he believes firmly against perpetual war and does not think the U.S. should fight the war nor put a no fly zone in place.

“I used weapons of war at war, and I had them used against me. And I know what that looks like,” said Crow. He said when he went hunting, he did not take an AR-15, and when he went to Iraq and Afghanistan, he did not take his hunting rifle.
Crow calls Inflation Reduction Act ‘transformative’ One piece of legislation Crow highlighted during the town hall was the health care, tax and climate change bill, which Democrats have named the “Inflation Reduction Act.”Crow was among the supporters of the bill, which aims to lower health care costs, promote clean energy and increase the taxes on some corporations, according to the White House’s website. “This is really a transformative piece of legislation,” Crow said. He said the bill will reduce the fed eral budget deficit by an estimated $300 billion and taxes will not be raised on families earning less than $400,000 a year. “We are going to make our largest, most profitable corporations pay their fair share,” Crow said. The legislation sets a 15% mini mum tax rate for companies with profits of $1 billion dollars or more, Crow said, explaining this will apply to about 150 corporations. The legislation also includes giving $80 billion to the Internal Revenue Service, otherwise known as the IRS, which raised some con spiracy theories about a “shadow army” that could “shake down small businesses with assault rifles,” ac cording to The New York Times.

medical technician certificate, said without the program he would be “freaking out” about how to cover the cost of his education. “I, like so many of my peers, want to give back to my community as a healthcare worker,” Villalobos said. “I was beyond thrilled to learn that my training costs would be covered through the Care Forward Colorado program. It makes a high-quality training, like the one I’m receiving at ACC, accessible to everyone.”
The initiative stems from bipartisan legislation signed in May, cosponsored by state Senators Sonya Jaquez Lewis and Bob Rankin, along with State Rep. Kyle Mullica, in the form of Senate Bill 226. The bill was implemented to channel more funding to the development of healthcare education to guide Coloradans towards in-demand and well-paying healthcare careers.

Under the Care Forward Colorado program, students can pursue careers as a CNA, emergency room technician, phlebotomy technician, medical assistant and dental assistant.Students who enroll in these and related programs at community colleges under the CCCS umbrella — including ACC, Community College of Denver and Front Range Community College — will be reimbursed for their expenses through 2024. Non-traditional students, including those who are in their mid-careers or who are looking to change fields entirely to healthcare, are also eligible.
Gov. Jared Polis announced the Care Forward Colorado program Aug. 24, an initiative that makes community college and technical programs free for aspiring healthcare professionals across the state.

Care Forward Colorado is one of the 100 ways the Polis administration has said it has aimed to save Coloradans money, a target introduced during Polis’ 2022 State of the State Address in June.
“Last I checked, there were like 27,000 openings for certified nursing assistants (CNAs) in the state,” said Paccione, who was appointed to her position by Polis. “So we’re encouraging students to get started with these entry-level positions and to take advantage to earn a credential in their (chosen) healthcare profession for free.”

Residents can also vote in person beginning Oct. 24. The Douglas County elections for assessor, coroner, surveyor and treasurer are uncontested. The county’s next clerk and Republican, will be defending his current seat against Democrat Kari Solberg.There will also be retention votes for county court judges Kolony Fields and Lawrence Bowling. In Colorado, county judges are appointed by the governor and then come up for retention votes. The judges don’t compete with each other, instead, voters mark if they want the justice to remain in office handle things like civil cases of less than $15,000, misdemeanor crimes, restraining orders and search warrants.Dave Gill, the incumbent Treasurer, is running uncontested for his seat. Raeann Brown is also running uncontested in the election to replace Jill Romann as coroner. Toby Damish, another sole candidate, will be the next assessor. Darrell Roberts is the sole candidate running for surveyor.

“It’s the seven of you who are accountable for this ballot language and for the money being spent consistent with this ballot language,” Kane said. “Anything that goes outside of the district, (the Mill Bond Oversight Committee) can’t account for and you can’t account for.”

The board also unanimously approved a salary schedule, based on the MLO passing, to increase transparency about how the money would be Respondingspent.to public concerns about the money being used for any other purpose, such as vouchers, Superintendent Erin Kane emphasized that every dollar of the MLO is already dedicated under the proposed salary schedule.
“I’m going to try and spend every day in between now and Election Day making sure our teachers don’t come to work the Wednesday after and have to have a really hard conversation about why this community doesn’t believe in them as educators,” board member Elizabeth Hanson said. Ballots will be mailed to voters on Oct. 17.
An issue committee, called Invest in DCSD, has already formed and started collecting donations to support efforts to pass the funding. Additionally, all of the board members spoke of ramping up efforts to educate the community and gain supporters.
Additionally, public comment from staff and families of Ascent Classical Academy, which left the Douglas County School District in 2019, asked that the school be included in distribution of the bond and MLO funding.
With official approval of the ballot language, district staff will be prohibited from advocating for the bond or MLO under Colorado law, so the burden of gaining voter support will fall to the board and volunteers.Taxpayer impact for both the bond and MLO for residential property is $1 per week for $100,000 in assessed value. For a house valued at $500,000, the annual cost will be $255 and $1 million home would pay $410.
While Peterson and Kane said Ascent could always choose to return to Douglas County School District, the superintendent and all of the board members agreed that Ascent would not receive any of the bond or MLO funding because the district doesn’t have oversight of the charter.
Board member David Ray also noted the district’s current policy prohibits any staff from carrying weapons on campus except for exclusively employed security officers.Similar to the approved salary schedule, the district also released a plan for the $450 million bond, committing all of the funding to capital projects. A majority of the money, $216 million, is for constructing three new elementary schools and expanding two middle schools.
The Douglas County School District will officially go to voters in November for a $60 million mill levy override and a $450 million bond, with assurances that not a single dollar would be used for arming teachers or a voucher program.AttheAug. 23 school board meeting, the board unanimously approved ballot language for two funding questions, which would go toward staff compensation, building three new elementary schools and capital maintenance. The approved language for the MLO commits the district to using the money on salaries and benefits for all staff, including at charters.
“Once we move those (salary) schedules up, the money is spent,” Kane said. “Unless you plan to do a 9% decrease for everyone across the board, there is no using this for something else down the road. … I can’t see a universe, I’m happy to say out loud, at all where you could possibly spend it on anything except what’s in this ballot question.” Concerns about the $450 million bond centered around whether any of the $15.5 million dedicated to school safety would go to arming teachers. Kane answered those concerns with a detailed breakdown of what the money would be spent on, including window hardening, camera upgrades and alarmBeyondsystems.that,every board member said they did not support arming teachers and only member Mike Peterson said he would consider arming staff outside of school resource officers. “Do I want to arm teachers? Absolutely not, I can’t think of a case. But if we can’t get the SROs, which would be my first option for increasing our security, we should think out of the box,” Peterson said, suggesting school safety officers as an option.

A group of parents formed an issue committee called Invest in DCSD to help pass the $450 million bond and $60 million mill levy override, which would go to building maintenance and construction, as well as staff salaries. Invest in DCSD hosted a kickoff fundraising event on Aug. 28 at Heritage Park in Highlands Ranch with school board members Mike Peterson, Susan Meek, Becky Myers and ChristyChristaWilliams.Gilstrap, one of the founders of the Invest in DCSD committee, said education and outreach efforts have already started, but the event will be a formal introduction to the community. Gilstrap and four other members of DCSD’s Mill Bond Exploratory Committee, which looked into funding needs and the feasibility of ballot questions, created Invest in DCSD in June when the school board was indicating it would support putting bond and mill levy override questions on the NovemberSoballot.far,voters Gilstrap has spoken with are mostly amenable to the proposed funding questions, which is estimated to cost $1 per week for each $100,000 of assessed property values or about $255 annually for a house valued at $500,000.

“The most important thing we need our community to understand is being homeless is not a crime. We are not going to treat the homeless like they’re criminals,” Douglas County Sheriff’s Office Cpt. Kevin Duffy said. “If they commit a crime, we’ll take action, but they’re people, they need help and we’re going to help them. … We need to break down some of the prejudice against the homeless.”
“In the modern world, the availability of broadband has become a necessity for quality of life and desirability of a community, providing residents with access to things like online education, telemedicine, remote working, social connections and home-based business and rural businesses,” said Holly Carrell, special projects manager for the county. In 2005, the state legislature approved a bill that prohibited local government entities from dedicating public dollars to broadband without permission from voters. If approved, this ballot question would allow the county to opt out of that restriction. So far, about 140 municipalities and counties in the state have passed measures to override the law. While some areas in the county already have access to high-speed internet, many rural areas do not.
“We know that high-speed internet is the fourth utility,” Laydon said. “It’s also a signifi cant traffi c solution. If people don’t have to go to the Tech Center or another location along I-25 to get to their place of business, that alleviates our traffi c corridor.” If approved by voters, the county wouldn’t be required to dedicate funds to broadband but would have the option to do so.

Of the more than 150 interactions DCSO has had with unhoused people this year, Duffy estimated fewer than a dozen ended with arrests, most of which were for outstanding warrants, not active crimes.

Despite the perception, local officials who spoke to Colorado Community Media said there is little evidence of unhoused people committing crimes locally, while studies support providing housing as a way to reduce crime.
As part of the Douglas County Homelessness Initiative’s efforts, a partnership between law enforcement officers and social services navigators called the Homelessness Engagement, Assistance and Response Team or HEART has been handling calls about unhoused people or Douglaspanhandling.CountySheriff’s Office Deputy Tammy Bozarth, who is a law enforcement liaison with HEART, said she’s contacting one or two people who are unhoused on a daily basis, but rarely sees the same people more than once.

“We have very strong grassroots support,” said Micki Clark, president of the Douglas County Open Space Initiative. If approved in November, the ballot item will authorize intergovernmental agreements between the county and its municipalities for a 20% shareback from the funds. Lone Tree and Castle Pines would be new benefi ciaries of the shareback. How much each municipality receives will be based on a population formula.






The proposal would also address compassion, one of the homlessness initiative’s focus areas, by offering resources to anyone willing to take advantage, Laydon said, but also by allowing for code enforcement in Douglas County.
“If there are issues where crimes are being committed, substance abuse issues they don’t want to treat or mental health issues they aren’t interested in addressing, there has to be a community re sponse that is also compassionate towards the businesses and citizens that live and work here,” Laydon said. “Compassion is not merely for those experiencing homelessness, but compassion for our whole com munity.”Without an approved shelter plan, the homelessness initiative will con tinue to lean on HEART navigators and officers to provide the majority of the response to unhoused people.
“There’s a lot of perception out there that if we start providing too many resources or doing too many nice things, then we’re go ing to (exaggerate) the problem and the homeless will start com ing here to get our resources. But they’re already coming,” Duffy said.
“We found a lot more people living in their cars than I thought we would,” Duffy said of the July count.Many unhoused people say they are not from Douglas County, but were there because of a lack of transportation or sweeps pushing them out of other cities. Per DCSO data collected on 152 contacts from January to June, only 6% of them were from the Douglas County area, with the remaining either coming from the Denver metro area or out ofBozarthstate. said unhoused people will sleep in Douglas County to avoid being victims of crime.

A count done on July 25 by the county of its homeless population found 83 people unsheltered or living out of cars and 324 people liv ing in temporary housing, such as couch hopping or a hotel. With the introduction of HEART and potential for a faith-based shelter network, Douglas County Commissioner Abe Laydon is hopeful county efforts to incorpo rate community suggestions in its response will help chip away at the perceptions that have prevented action so far.
Duffy and Bozarth said address ing community prejudices and educating about the reality of the situation in Douglas County will continue to be important.
“Providing housing with support ive services is the most effective intervention for solving homeless ness and reducing crime because if people are in housing they have a place to store food and belongings, they don’t need to go out and steal things,” she said. “They’re not go ing to be victims of sex traffickers or drug dealers.”
A 2021 study of Denver’s Social Impact Bond, found that providing housing led to a 40% reduction in arrests and a 27% reduction in total days in jail. People in the supportive housing program were less likely to be arrested for trespassing, drug use, drunkenness or other low-level crimes.Still,Alderman recognizes there are gaps in the shelter system and barriers to shelters, such as rules about pets, curfews and a lack of privacy. Duffy said most unhoused people are willing to comply if they can. “Ninety-nine point nine percent of the time, people say ‘OK, we’re out of here’ and they walk on,” he said. “Or we can give them a cour tesyDuffyride.”said the department en forces trespassing if the property owner wants to press charges, but it rarely happens. From January to June, DCSO patrols responded to six calls of trespassing, four calls for disturbances and four calls for panhandling, which is not a crime.

Currently, Duffy said law enforce ment can’t enforce camping bans or force people to move on without offering people shelter due to the threat of litigation, which is why conversations about the county’s re sponse to homelessness have hinged on the need for a shelter in order to have proper code enforcement.
Douglas County doesn’t have shelter resources to offer unhoused people, except the winter shelter network.
Douglas County recently partnered with Arapahoe County to have a shelter option called the GOALS facility, but it’s only for a small number of families and hasn’t yet opened.
Cathy Alderman, communica tions and public policy director for the Colorado Coalition for the Homeless, said a recent study of the Denver Social Impact Bond, a hous ing subsidy and supportive services initiative started in 2016, shows that housing is a strong piece to reduc ingAldermancrime. said the visibility of people who are unhoused contrib utes to them being more likely to be contacted by police and get arrested compared to people who are housed. She also noted that housing helps keep people from being victims.
“We are in a resource desert down here when it comes to shelters,” Duffy said. “We can’t force people out (of an encampment) unless we have somewhere to take them and it has to be a shelter type environ ment and we don’t have any. So we can’t do any kind of a sweep.”
The top calls the sheriff’s office received from January to June were about welfare checks, suspicious persons and unwanted subjects. In the majority of her interactions with unhoused people, Bozarth said she tries to connect them with resources they may need and moves people along from private property largely without issue.
Outside of Douglas County, stud ies show places that provide shelter see a decrease in crime and inter actions between police and people who are unhoused.
The biggest resource DCSO and HEART have been advocating for is more transportation, but shelter resources are a key piece so the jail isn’t a default shelter and code enforcement can actually happen.
“I find a lot of people are com ing down from Denver at night and sleeping in Douglas County because they don’t have to worry about be ing assaulted while they’re sleeping or their property being stolen,” she said.According to the July count, 26% of people had a disability and/or chronic health concerns, 20% of the unhoused people in Douglas County had mental health concerns and 15% were fleeing domestic violence.
Laydon reiterated that the intent of the Douglas County Homeless ness Initiative is to reduce or eliminate homlessness, not to add to those“Thenumbers.citizens have already ac cepted and appreciated the winter shelter network for over a decade,” Laydon said. “I think with their encouragement to continue to work with the faith-based community, we can potentially address the shelter ing issue in a way that’s unique to Douglas County. No single commu nity wants to bear the burden of a singular homeless shelter in their community. That’s a big ask.”

President Joe Biden announced the adminplan to cancel $10,000 to $20,000 of student debt for millions of Americans last week, I listened to debates, watched the Facebook comments had some interesting conversations with my husband about what this all means. For me, it very well could lead to $10,000 off the student loans I still carry from getting my degree from Arizona State University. Sure, for a moment I thought that’s awesome. That is a huge amount that will make it possible for me to pay off the full loan way sooner than expected. However, that thought of instant gratification faded when I really started looking at the big picture and realizing this is not as great as those pushing for this big payoff think. Even economists are questioning what it will mean to an already struggling economy. Will it make inflation worse? Will middle-class families be the ones paying the bill? A lot of questions started coming to mind. As the days and discussions continue, I cannot see this as anything more than a political stunt to buy votes ahead of the midterms. Let’s face it, Democrats appear to be learning from past mistakes and taking advantage of American’s short attention spans by stringing several PR victories together leading up to Election Day. It is not a bad strategy. However, the long game strategy of student loans just shows an administration and Congress as a whole that refuses to truly address, discuss and work to fix a broken system.Iwillhappily forgo the instant gratification the $10,000 would bring in the name of fixing the system to make it possible for my three children to enter college without the problems our students are facing today. Take all those billions of dollars Biden is willing to shell out to pay people’s loans off or down and apply them to fixing the system. Fix the loan system itself, fix the loan forgiveness system, and for the love of God, do something about the incredibly ridiculous tuition rates our institutions are charging.

While $10,000 is going to be looked at as this wonderful gift from the government — my question is, what happens next?Think about it — a student who had a bunch of student loans they were paying off for the bachelor’s degree gets this gift applied to their loans. aving spent more than 25 years in the personal and professional development business, working with people in a variety of industries, I have been blessed to have worked alongside some of the most recognized iconic authors, speakers, trainers and motivators in the industry.Additionally, having spent so much time in the business, I have worked with some of the most phenomenal people, both inside the organizations where I have worked, and with the companies where we delivered training and performance development solutions. If you happen to read this column regularly, you will recognize the name Zig Ziglar, as I quote him often. I became a fan of Zig’s long before I partnered with him to launch a business and then becoming a part of his organization from 1998 through 2010 in some capacity, eventually becoming the president of the company. When people ask me what that run was like, I always respond the same way: It was a tremendous experience and I was blessed to have worked alongside some incredible people within the organization, including Zig’s son Tom Ziglar, who is still the CEO today as well as one of my partners. As Mr. Ziglar retired, I joined the Sandler Training organization led by David Mattson. I had known David for several years as he was a partner in one of our businesses with Zig, so making the decision to join Sandler was an easy one. Again, I worked alongside some tremendously talented people at Sandler, and continued to learn so much more about the corporate training environment. Sandler has a vast network filled with men and women who are at the top of the list of corporate training professionals, speakers and coaches. Sandler’s global presence provided me with an opportunity to build upon and expand my international experience, learning so much more about the cultural nuances of the many different countries we served. Why am I sharing this? Having spent 12 years with the Ziglar organization and nearly 10 years with Sandler, I never lost touch with the people that I worked alongside at either organization. As a matter of fact, it went deeper than just staying connected, I was able to partner with Sandler while at Ziglar, and then partner with Ziglar while at Sandler. Several weeks ago, I wrote a column about the importance of not burning bridges, and instead looking for ways to stay connected for the benefit of all parties. That lesson and the spirit of working cooperatively is demonstrated here.In2019 I branched out to launch my third start-up, a personal and professional development consulting organization. Ziglar and Sandler were both partners, as were several other of the leading training and development companies in the industry. And while some children are better at following the rules than others, that does not make them better or worse kids. It just makes them different.Ihavetwo kids who are professional rule followers and two who are professional rule breakers. Their genders and ages have nothing to do with it. The rule followers are 12 and 6 years old. One is a boy and one is a girl. The rule breakers are 11 and 9, both are boys. It’s just who they are. And there are pros and cons to each personality. The rule followers are excellent at trusting others’ instructions, they’re teachable and coachable. But they struggle trusting their own intuition and it’s hard to teach them whose rules to trust and when it is OK to not follow them at all. My rule breakers spend a lot of time learning and relearning the importance of the rules around them. But when given free rein, their creativity and leadership abilities astound me. The fact that I view one group as easier to parent than the other is my issue, not theirs. I am so wary of products or parents who claim that they know how to fix someone else’s kid. First of all, viewing kids as an object to be fixed is so damaging.

This woman’s famous parenting techniques that she promised would fix all of my problems didn’t apply to me. This experience was just the beginning of our journey down a road of getting my son the mental health care that he needed to succeed in the world.Butit taught me something else. There is no silver bullet to well-behaved children or to good parenting.
Second, I truly believe that there are little to no bad parents. Almost all parents love their kids and want what’s best for them. They may lack access to resources, not know how to love their kids in a healthy way or be misguided in what is truly best for them, but the desire and love is always there. Yes, let’s share parenting stories and lessons learned, but for the sole purpose of each parent deciding for themselves if that tool will fit in their parenting toolbox. Yes, let’s be free to be annoyed by other people’s kids. But remember that the annoyance is our issue, not theirs and it’s OK to set boundaries. When it comes to the parents I interact with, I will continue to believe that they are good people who don’t need me to tell them how to help their kids, they have that power in themselves. But what they could use is a listening ear and a vote of confidence in their ability to figure it out.

That was one of my first clues as to my lack of prowess in the parenting field. I eventually signed up for a parenting course. I picked one that promised you would get your kids to obey the first time, every time with zero yelling.Icould only hope. I studied those modules harder than I did for the ACT. I took diligent notes on the material I was learning and the experiences I was having at home. I called in every week to ask my questions according to what I’d learned. I was having problems with one child in particular. I was scared with how much I lost my temper with this little one and needed a way to fix it as fast as possible.Theparenting coach picked up the phone and I proceeded to explain my situation. The details are not important. The conversation went something like this: “Well, why don’t you try this?” “I’ve tried that. He then does this.” “Well, then do this.” “I did that, then he does this.” And so on and so forth until the author of this course got so exasperated with her advice not solving my problems that she exclaimed, “Well, then something’s wrong with him.”

“I think it was good for us during COVID,” she said. “Not necessarily a huge spike in sales but more of an interest.”Boxlerhopes to continue to see this interest in crafts, and looks forward to new customers.

“People just needed an outlet,” BoxlerBoxlersaid.saw many new faces at the shop (behind their masks), with people picking up new skills like knitting and sending handmade cards to relatives in nursing homes.
“Our goal was definitely to keep things from going into the landfill,” Boxler said. Not only does the store provide a second home for craft supplies, but it also provides a low-cost opportunity for those looking to start projects without breaking the bank. Supplies like fabric, yarn, stamps and more can get expensive when purchased new.The store also has a mission to sponsor charities and groups in the community. One ongoing project the store features is the “fidget quilt” for people with Alzheimer’s and sementia, where crafters can take a kit with supplies to create a quilt with tactile stimuli on it to bring back to the store to donate, or to give to someone they know who would benefit.Thestore also uses its unsellable fabric to make reusable tote bags for people to use at the local food bank. At the Craft Box, Boxler said, the No. 1 selling item is fabric, followed by yarn, though the store does see a great deal of paper crafters coming in for supplies. During the beginning of the pandemic, the shop saw an uptick in fabric sales for those sewing masks. As with many other craft stores, the Craft Box could not keep elastic on its shelves during this time. However, masks were not the only thing people were making during the lockdown.
“At least they know it’s going to be loved,” she said. The original Craft Box location was in Golden, and the store moved to Wheat Ridge five years ago. Items are donated to the store, and sometimes the store is able to purchase secondhand items from people. Employees want people to know these items are valued.
Thrift stores are more than just grandpa’s old shirts and the Goodwill store on the corner. Many shops around the metro area are bringing their own twist to secondhand stores.

Owner Liz Boxler had the idea for a secondhand craft store over 10 years ago when a friend passed away and left behind a mountain of craft supplies. She wanted to provide a place for the items to go where they would be appreciated.

The thrift store in Englewood is run by about 10 volunteers. Not only does the store support the mission of Soul Dog, it also strives to support the local people.

Soul Dog is a 501(c)(3) organization dedicated to the protection and spaying/neutering of animals. The group travels to rural areas on Native American reservations to spay and neuter pets at no cost to the public.
Not only does The Good Couch believe in helping the environment, but the business also works to help the community. The company partners with Colorado Coalition for the Homeless and helps to donate furniture to the coalition as needed. The founders always hoped they could pair up with a local nonprofit group, Reichert said. Working with the community and giving back is the ultimate goal, Reichert said. So far, the company has donated $17,930 to the Colorado Coalition for the Homeless, and also helped furnish an affordable housing During the early days of the pandemic, The Good Couch had to pause business, but overall the company saw growth. “During the pandemic, we grew by like 50%,” Reichert said. Reichert attributed the uptick in business to the number of people moving, downsizing and generally trying to save money on furniture.TheGood Couch is open from 9 a.m. to 5 p.m. Monday through Saturday and closed on Sundays. “Most of our clientele are regulars,” said Wendy Roth, who has been volunteering for two years. The store gets more than just the regular clothing and knickknacks, however. One of the most bizarre donations was a “dog zipline kit,” which apparently sold very quickly.
The volunteers at the store describe the place as “a little gem,” and say that people are consistently delighted to discover them. The store shut down for a few months during the pandemic, but now sees regular customers and a number of people buying clothing to send home to other countries or to bring to the Native American reservations.

All the local furniture stores now recommend the group’s services for people buying new furniture who need a way to dispose of the old items.
One of the owners and founders, Nick Reichert, explained that couches and furniture items are often curated for people’s personal aesthetics and end up getting thrown out when they redecorate.
“They’re such a large item and so personal to your decor,” he said. “A lot of trash ends up in the landfill, and furniture especially.”
“Our mission is to help our friends in the community,” said Kimberleigh Anders, who has been volunteering for two years. The store keeps prices low — $2 for most clothing items, many marked down to 50 cents. It has a good amount of pet supplies that are donated new from pet stores. The shop, which has been in the community for 10 years now, has become a landmark of the community, attracting a regular customer base.

The work’s location on one of the state’s major highways will not only provide plenty of eyes, but also an opportunity for those doing something as routine as driving to or from work the opportunity to be transported by the power of art. “It’s a gift to take something different and futuristic and put it where people can see it. It can be a shock visually, but over time it can define a place and give residents a sense of pride,” Leathers said. “These kinds of pieces start out as landmarks, but become what a place is known for.”

One of the great things about public art is that it serves so many purposes — just as easily as it adds beauty to a community, it can also become a landmark, a location for people to orient their lives around. And Thornton’s latest public art piece aims to become a waypoint for both residents and travelers alike due to both its size and Portland,location.Oregon, artist Volkan Alkanoglu has created a 34-foot-tall contemporary art sculpture for the city and when it is installed this fall, it will be the largest 3-D printed sculpture of its kind in the United States and the second largest in the world, according to provided information. Its home will be on the median at East 136th Avenue between I-25 and Lincoln Street.
“Thornton is really interested in becoming a beacon for more contemporary public art and a place that adds art that is a little less traditional,” said Hannah Leathers, Thornton public art coordinator. “This work has bright colors and a very futuristic look. It has a technological and scientific look, but is also beautiful in the way it mimics the Rocky Mountain sunset.”AsAlisa Zimmerman, Thornton’s Arts and Culture manager, explained, Alkanoglu’s work was approved by the city council and recommended by Thornton Arts, Sciences and Humanities Council (TASHCO) Public Art Subcommittee. The process began in 2020, but the COVID-19 pandemic delayed the project.“There were no size or dimension limitations to the call for artists,” she added. “This is our biggest budgeted piece and I think the fact that we supported thinking big about the work brought in a lot of submissions.”

Eric Ross, spokesperson for the 18th Judicial District — which is investigating the July 24 shooting — said the footage “will likely be part of the trial, so after it physically airs in a courtroom, there’s less of an argument to continue the ‘blocking’ of itsArelease.”trialdate has not been set, Ross said, but Blankenship is scheduled for a preliminary hearing Sept. 21. Ross said the judge’s ruling does not mean footage “won’t ever be released or available” but that it’s “temporarily blocked from release right now.”
Jeff Roberts, executive director for the Colorado Freedom of Information Coalition, said withholding the footage, at least until a trial, is “the closest thing to not releasing it.”
The Englewood Police Department and other city officials have since been blocked from speaking publically about the shooting after an Arapahoe County judge issued a gag order JulyAccording29. to a police affidavit of the incident, officers were sent to investigate a call at a home at 5007 S. Grove St. in southwest Englewood at about 7:39 p.m. July Blankenship’s24. mother, Kimberly Mitchell, called police because her son was intoxicated and causing a disturbance. She told officers her son was suicidal and shot a gun inside the home.After officers arrived, they made “loud commands” for Blankenship to exit the home, the affidavit says, before Blankenship began firing shots at officers from the home. According to the affidavit, police began firing back and Blankenship’s brother — who was barricaded inside a bedroom with Blakenship —suffered a fatal gunshot wound. Blankenship then exited the house and was arrested, the affidavit says. He later told investigators he was the only person shooting at officers and that his brother did not fire a single shot.

Jasi Martinez moved from Virginia to Ponderosa High School during the summer and she has been a welcomed addition to the Mustangs’ girls softball team. The junior shortshop had three hits, including a walkoff single, to lead Ponderosa to a 4-3, eight-inning victory over Discovery Canyon in a game played Aug. 23 at Ponderosa.Thewinwas the third straight for the Mustangs to open the season prior to the Mustang Stampede tournament.Martinez is hitting .429 with seven runs batted in after three games and has been a spark plug for Pondo. “Jasi is something else,” said Pondo coach Mark Roberts. “She’s a leader. She was a move in from Virginia this year. That was a nice surprise.“Hersister (senior first baseman Lexi) played for me her freshman year and they had military and went back to Virginia and then moved back here this summer. I didn’t know anything about the shortstop. She’s pretty good. Pollutant: Pollutants include, but are not limited to: dredged spoil; solid waste; incinerator residue; sewage; garbage; sewage sludge; filter backwash; munitions; chemical wastes; biological materi als; toxic materials; radioactive materials; heat; wrecked or discarded equipment; rock; sand; cellar dirt; and industrial, municipal, recreational, and agricultural waste discharged into waters of the State or into the MS4.
SECTION 1. TITLE This ordinance shall be titled Douglas County Stormwater Ordinance Regarding Grading, Erosion and Sediment Control; Operations and Maintenance of Stormwater Management Facili ties; and Illicit Discharge Detection and Elimination (“Ordinance”).
Municipal Separate Storm Sewer System (MS4): The system of conveyances, including, but not limited to, sidewalks, roads with drainage sys tems, streets, catch basins, curbs, gutters, inlets, pumping facilities, retention and detention basins, reservoirs, ditches, natural or human-made chan nels, or storm drains owned and/or operated by Douglas County and designed or used for collect ing or conveying stormwater and which is not used for collecting or conveying sewage.
The overall objectives of this Ordinance related to operations and maintenance of stormwater management facilities are: (1) To ensure the adequate long-term opera tion and maintenance of stormwater management facilities; and (2)To ensure County access to stormwater man agement facilities; and (3) To establish processes to carry out inspec tion, surveillance, monitoring, and enforcement necessary to ensure compliance with this Ordi nance; and (4)To ensure Douglas County is in compliance with its CDPS Permit No. COR-080000 and No. COR-090000, along with the Colorado Depart ment of Public Health and Environment, Water Quality Control Commission’s Regulations No. 61 (Colorado Discharge Permit System Regulations) 72 (Cherry Creek Reservoir Control Regulation), and 73 (Chatfield Reservoir Control Regulation), as amended, respectively.
5.2 Operations and Maintenance of Stormwater Management Facilities
Grading, Erosion and Sediment Control (GESC) Manual: The Douglas County grading, erosion and sediment control manual adopted by the Douglas County Board of County Commission ers on March 30, 2004, as amended. Grading, Erosion and Sediment Control (GESC) Permit: A permit obtained from Douglas County Engineering Services prior to commence ment of land disturbing activities as required by the Douglas County GESC manual.
Waters of the State: Any and all surface and subsurface waters which are contained in or flow in or through the State of Colorado, but does not include waters in sewage systems, waters in treatment works of disposal systems, waters in potable water distribution systems, and all water withdrawn for use and treatment until use and treatment have been completed.
This Ordinance shall apply to all land disturbance activities requiring a GESC and/or DESC permit, as outlined in the GESC manual, on any land within unincorporated Douglas County.
It shall be unlawful for any person to cause or allow any land disturbing activity to be conducted in a manner that violates the MS4 permit and/ or the GESC manual, which GESC manual is incorporated herein in its entirety by this reference.
Discharge: Any addition or introduction of any pol lutant, stormwater, or any other substance what soever into the MS4 or into waters of the State.
The overall objectives of this Ordinance related to illicit discharge detection and elimination are: (1) To regulate and prohibit and eliminate the illicit discharge of non-stormwater discharges on and into the MS4; (2)To prohibit illicit connections to the MS4; and (3) To establish processes to carry out inspec tion, surveillance, monitoring, and enforcement necessary to ensure compliance with this Ordi (4)Tnance.oensure
(b) If the person discharging non-stormwater fails to comply with such suspension order, the autho rized enforcement agent may take such actions as deemed necessary to prevent or minimize damage to the MS4 or waters of the State. The au thorized enforcement agent shall collect all costs incurred in taking such additional action pursuant to the procedures set out in Sections 8.3 and 8.4.
3.1 Construction Activities
Douglas County is in compliance with its CDPS Permit No. COR-080000 and No. COR-090000, along with the Colorado Depart ment of Public Health and Environment, Water Quality Control Commission’s Regulations No. 61 (Colorado Discharge Permit System Regulations), 72 (Cherry Creek Reservoir Control Regulation), and 73 (Chatfield Reservoir Control Regulation) as amended, respectively.
Unless a provision explicitly states otherwise, the following terms and phrases, as used in this Ordinance, shall have the meanings hereinafter designated:
(i) It shall be unlawful for any person to construct, use, maintain, or continue the e xis tence of illicit connections to the MS4. (ii) It shall be unlawful to connect a line conveying sewage or other non-stormwater d is charges to the MS4 or allow such a connection to (iii)continue.Thisprohibition expressly includes, without limitation, illicit connections made in the past, regardless of whether the connection was permissible under law or practices a ppli cable or prevailing at the time of connection.
(1) Any drain or convey ance, whether on the surface or subsurface, which allows or may allow an illicit discharge to enter the MS4, including, but not limited to, any conveyances which allow any non-stormwater discharge to enter the MS4 and any connections to the MS4 from indoor drains and sinks, regard less of whether said drain or connection had been previously allowed, permitted, or approved by an authorized enforcement agent; or, (2) any drain or conveyance connected from a commercial or industrial land use to the MS4 which has not been documented in plans, maps, or equivalent records or approved by the authorized enforcement agent.
(c) The notice of violation shall be served by hand-delivery or by first-class mail. Any such notice shall be deemed valid if it is mailed to the address of the owner of the premises on file with the Douglas County Assessor’s Office for the receipt of tax notices or mailed as otherwise set forth herein. If a person violates this Ordinance and such violation is not associated with a specific premise, then: if the violation is committed by a person that is a legal entity, notice to such entity shall be deemed valid if sent to the registered agent's address on file with the Secretary of State; or, if the violation is committed by a person other than a legal entity, notice shall be deemed valid if sent to such person at the person's residence, if known, or to any address of such person reported by such person in any political subdivision or State official records, kept for any purpose whatsoever.
The authorized enforcement agents, the Douglas County Sheriff’s Office, and/or Douglas County Zoning Compliance Officials shall administer, implement, and enforce the provisions of this Ordinance.
(d) If the violation has not been corrected pursu ant to the requirements set forth in the notice of violation, the authorized enforcement agent may pursue civil prosecution or abatement pursuant to Sections 8.3 or 8.4 of this Ordinance.
(c) Any modification to a specific, previously ap proved stormwater management facility, for opera tion and maintenance, shall require re-submittal of premises-specific plans to the County for approval prior to modification.
(ii) The authorized enforcement agent may require any person owning, occupying, or otherwise responsible for a premises, which is, or may be, the source of a non-stormwater discharge to implement, at said person’s expense, additional structural and non-structural BMPs to prevent the further release of non-stormwater discharges to the MS4, and it shall be unlawful to fail to provide such BMPs.
Person: Any individual, association, organization, partnership, firm, corporation, business, or other entity recognized by law, whether public or private, corporate or politic.
SECTION 2. PURPOSE/INTENT 2.1 Grading, Erosion and Sediment Control and Drainage, Erosion and Sediment Control
Notwithstanding other requirements of law, as soon as any person has information of any known or suspected release of a non-stormwater discharge into stormwater, or into or on the MS4, or into waters of the State, said person shall take all necessary steps to ensure the containment and cleanup of such release. In the event of a release of hazardous materials, said person shall immediately notify emergency response agencies of the occurrence via emer gency dispatch services. In the event of a release of non-stormwater discharges, said person shall notify the authorized enforcement agent in person or by phone or facsimile no later than the next business day. Notifications in person or by phone shall be confirmed by written notice addressed and mailed to the authorized enforcement agent within three (3) business days of the phone notice. If the discharge of hazardous materials or nonstormwater discharges emanates from a com mercial or industrial establishment, an on-site written record of the discharge and the actions taken to prevent its recurrence shall be retained for at least three (3) years. It shall be unlawful for any person not to provide the appropriate notice or recordkeeping as outlined herein.
Construction Sites: The premises on which land disturbance activities requiring a GESC permit and/or DESC permit, as outlined in the GESC manual, take place or are proposed to take place.
72.7.2(b)(1) of the Colorado Depart ment of Public Health and Environment, Water Quality Control Commission, Regulation 72, Cherry Creek Reservoi r Control Regulation requires Douglas County to develop, implement, and enforce a program to reduce pollutants in any stormwater runoff to the MS4 from construc tion activities that disturb land, including, but not limited to, the following: unless otherwise excluded in section 72.7.2(b)(2): (i) clearing, grading, or excavation of land; (ii) construction, including expansion or alteration, of a residential, com mercial, or industrial site or development; and (iii) construction of public improvements and facilities such as roads, transportation corridors, airports, andSectionschools.73.6(2) of the Colorado Department of Public Health and Environment, Water Quality Control Commission, Regulation 73, Chatfield Reservoir Control Regulation requires Douglas County to implement nonpoint source control programs for those areas within its jurisdiction with the goal of reducing nonpoint source phosphorus in the Chatfield Watershed.

(d) Notification of Spills
• Section I.E.2.a.ii of the CDPS General Permit, Permit No. COR-080000 and Section I.E.2.a.ii of the CDPS General Permit, Permit No. COR090000, Stormwater Discharges Associated with Municipal Separate Storm Sewer Systems require Douglas County to effectively prohibit, through ordinance or other regulatory mechanism, illicit discharges into the MS4 and implement appropri ate enforcement procedures and actions to the extent allowable under State or local law.
Authorized Enforcement Agent: The Douglas County Director of Public Works and/or his/her designated agents.
(b) If abatement of a violation and/or restoration of affected premises is/are required, the notice shall set forth a deadline within which such abatement, remediation, and/or restoration must be completed.
8.2 Emergency Suspension of Non-stormwater Discharges (a) The authorized enforcement agent may, without prior notice, order the suspension of con struction activities, discharge of non-stormwater into the MS4, and any other activity when such suspension is necessary to stop an actual or threatened discharge which presents or may present imminent and substantial danger to the environment, or to the health or welfare of per sons, or to the MS4, or to the waters of the State.
8.3 Abatement Action (a) The authorized enforcement agent may apply to the Douglas County Court or Douglas County District Court for an administrative entry
The overall objectives of this Ordinance related to grading, erosion and sediment control and drain age, erosion and sediment control are: (1) To ensure the adequate design, implemen tation, and maintenance of BMPs at applicable construction sites; and (2) To establish a process to require erosion and sediment controls, as well as sanctions and procedures, adequate to ensure compliance with this Ordinance; and (3) To ensure Douglas County is in compli ance with its CDPS Permit No. COR-080000 and No. COR-090000, along with the Colorado Department of Public Health and Environment, Water Quality Control Commissioner’s Regula tions No. 61 (Colorado Discharge Permit System Regulations), 72 (Cherry Creek Reservoir Control Regulation), and 73 (Chatfield Reservoir Control Regulation), as amended, respectively.
Hazardous Materials: Any material, including any substance, waste, or combination thereof, which, because of its quantity, concentration, or physical, chemical or infectious characteris tics, may cause, or significantly contribute to, a substantial present or potential hazard to human health, safety, property, or the environment when improperly treated, stored, transported, disposed of, or otherwise managed.
3.2 Operations and Maintenance of Stormwater Management Facilities
Non-Stormwater Discharge: Any discharge to the MS4 that is not composed entirely of storm water, except as specifically allowed in: Section I.E.2.a.v of the CDPS General Permit, Permit No. COR-080000, as amended; Section I.E.2.a.v of the CDPS General Permit, Permit No. COR090000, as amended; Section 61.8(11)(a)(i)(C) (II) of the Colorado Department of Public Health and Environment, Water Quality Control Commis sion, Regulation 61, Colorado Discharge Permit System, as amended; and the Colorado Depart ment of Public Health and Environment, Water Quality Control Division’s Low Risk Discharge Policy (WQP-27), and associated guidance docu ments, as amended.
SECTION 4. DEFINITIONS
Stormwater: Any surface flow, runoff, or drainage from any form of natural precipitation, including snowmelt.
• Section I.E.4.c.ii.(C) of the CDPS General Permit, Permit No. COR-080000, and Section I.E.4.c.ii.(D) of the CDPS General Permit, Permit No. COR-090000, Stormwater Discharges As sociated with Municipal Separate Storm Sewer Systems require Douglas County to develop, implement, and document procedures to ensure adequate long-term operation and maintenance of BMPs, including procedures to enforce the requirements for other parties to maintain BMPs when necessary.
It shall be unlawful for any person to cause or allow any stormwater management facilities to be oper ated and/or maintained in a manner that violates the MS4 permit and/or the Douglas County Storm Drainage Design and Technical Criteria Manual as amended, which is incorporated herein in its entirety by this reference.
SECTION 7. RESPONSIBILITY FOR ADMINISTRATION AND ENFORCEMENT
• Section 61.8(11)(a)(ii)(C) of the Colorado Department of Public Health and Environment, Water Quality Control Commission, Regulation 61, Colorado Discharge Permit System requires Douglas County to develop, implement, and enforce a program to detect and eliminate illicit discharges into the MS4.

Best Management Practices (BMPs) (Also known as Control Measures in the MS4 per mits): Schedules of activities, prohibitions of practices, general good housekeeping practices, pollution prevention and educational practices, maintenance procedures, and other management practices to prevent or reduce the discharge of non-stormwater directly or indirectly into storm water, the MS4, receiving waters, or any other stormwater conveyance systems. BMPs also include treatment practices, operating procedures, and practices to control site runoff, spillage or leaks, sludge or water disposal, or drainage from raw materials storage. The term BMP is used in terchangeably with the term control measure, and can include other methods such as the installation, operation, and maintenance of structural controls and treatment devices.
This Ordinance shall apply to all stormwater management facilities on any developed and undeveloped lands located within unincorporated Douglas County, unless explicitly exempted by the authorized enforcement agent.

This Ordinance shall apply to all non-stormwater discharges and/or connections entering Douglas County’s MS4 generated on any developed and undeveloped lands located within unincorporated Douglas County, unless explicitly exempted by an authorized enforcement agent.
(a) Stormwater management facilities shall be constructed in accordance with the Douglas County approved construction drawings. Storm water management facilities shall be operated and maintained at all times so that their water quantity control functions, water quality control functions, and maintenance access are not impaired, which shall include keeping all stormwater management facilities and access areas free of accumulated debris, trash, and sediment. Proper water quantity and water quality control functions are defined within the Douglas County accepted drainage report and associated construction drawings, which are required by the Douglas County Storm Drainage Design and Technical Criteria Manual, as amended. (b) Operation and maintenance of all stormwater management facilities shall at all times be con ducted in compliance with the Douglas County Storm Drainage Design and Technical Criteria Manual, as amended.
Drainage, Erosion and Sediment Control (DESC) Permit: A permit obtained from Douglas County Building Division prior to commencement of land disturbing activities as required by the Douglas County GESC manual.
SECTION 3. APPLICABILITY
(i) Persons shall provide, at their own expense, and it shall be unlawful to fail to provide, reason able protection from release of non-stormwater discharges on or into the MS4 or into watercourses through the use of Douglas County approved structural and non-structural BMPs.
Watercourse: A channel, natural depression, slough, artificial channel, gulch, arroyo, stream, creek, pond, reservoir, or lake, including major drainageways, in which stormwater and flood water flows either regularly or infrequently.
Premises: Any building, lot, parcel of land, or portion of land whether improved or unimproved, including adjacent sidewalks and parking strips.
In order to access the stormwater management facilities to ensure adequate operation and main tenance, appropriate easements shall be granted to Douglas County. For subdivision plats, the easements shall be recorded prior to the issuance of any construction permits. For site improvement plans, the easements shall be recorded prior to the release of a certificate of occupancy. For 35-acre developments and all other projects, the ease ments shall be recorded prior to the issuance of a GESC permit. All easements shall be granted by a person authorized to do so for the right to enter the premises, at the discretion of Douglas County, for the purpose of inspecting, maintaining, modifying, or replacing stormwater management facilities in accordance with the Douglas County Storm Drainage Design and Technical Criteria Manual, as amended. The easements shall be in a form approved by Douglas County. Existing stormwater management facilities that do not have the required width may be required to be increased by the authorized enforcement agent to the minimum extent necessary when the autho rized enforcement agent determines there are special circumstances applicable to the premises or the intended use, for which a wider easement is necessary to allow adequate maintenance of the proposed stormwater management facility; or The required width may be allowed to be reduced by the authorized enforcement agent, upon receipt of a written variance request, when the authorized enforcement agent determines there are special circumstances applicable to the premises or the intended use, including but not limited to, shape, topography, location, or surroundings, which do not generally occur on other sites and which render it infeasible to develop the premises for uses allowed under the Douglas County Zoning Resolution, or which impose undue hardship, provided that the authorized enforcement agent also determines the proposed stormwater man agement facility can be adequately maintained with the reduced easement width. Prior to accepting the easement, the authorized enforcement agent may require the removal of all encumbrances which are inconsistent with the purposes for which the easement is being granted. The easement shall be signed by an authorized person and recorded in the office of the Douglas County Clerk & Recorder.
(i) It shall be unlawful for any person to discharge or cause to be discharged non-stormwater into the MS4 or waters of the State. (ii) It shall be unlawful for any person to dump or deposit any non-stormwater onto public or private premises when such dumping or deposit may result in an illicit discharge to the MS4.
• Section 72.7.2(c)(5)(ii) of the Colorado Department of Public Health and Environment, Water Quality Control Commission, Regulation 72, Cherry Creek Reservoir Control Regulation requires Douglas County to develop a program that requires owners to be responsible for opera tion and maintenance of BMPs and requires that they provide easements or other legal means for access of the control measure sites for operation, maintenance, and inspection by the authorized enforcement agent.
(c) Implementation of BMPs
5.1 Grading, Erosion and Sediment Control and Drainage, Erosion and Sediment Control
(a) Except where emergency suspension is nec essary pursuant to Section 8.2 of this Ordinance, the authorized enforcement agent shall provide written notice to persons violating this Ordinance. Such notice shall describe the violation and the level of such violation if it is related to the GESC manual, and may require, without limitation: (i) Corrective actions necessary to remediate violations of the GESC manual; and/or (ii) Corrective actions necessary to ensure proper functioning of the stormwater management facility or easement; and/or (iii) For illicit discharges, that monitoring, analyses, and reporting be performed; that illicit connections and illicit discharges be eliminated; that nonstormwater pollution or contamination hazards be contained, abated, and/or remediated and any affected property be restored; and/or that source control or treatment BMPs be implemented.
2.3 Illicit Discharge Detection and Elimination Ordinance
Emergency Fire Fighting Discharge: A dis charge of non-stormwater to the MS4 or waters of the State resulting from the act of extinguishing destructive fires.
(b) Prohibition of Illicit Connections

Pollute/Pollution: Alteration of the physical, thermal, chemical, or biological quality of, or the contamination of, any water of the State that ren ders the water harmful, detrimental, or injurious to humans, animal life, vegetation, or property, or to the public health, safety, or welfare, or impairs the usefulness or the public enjoyment of the water for any lawful or reasonable purpose.
WHEREAS, Douglas County desires to adopt and implement this Ordinance to provide for the health, safety, and general welfare of the citizens and residents of Douglas County, hereby super seding and repealing all prior ordinances and resolutions inconsistent or overlapping herewith; now, therefore, BE IT ORDAINED BY THE BOARD OF COUNTY COMMISSIONERS OF THE COUNTY OF DOUG LAS, STATE OF COLORADO, as follows:

(b) Such application to the court shall include a copy of this Ordinance, a sworn or affirmed af fidavit stating the factual basis for such warrant, evidence that notice of violation has been provided or that reasonable efforts to serve the notice of violation have been made to no avail and such person has failed to abate the condition within the prescribed period, and a general description of the location of the premises that is the subject of the warrant and a list of corrective actions needed.

(b) The penalty assessment procedure set out in section 16-2-201, C.R.S., shall be followed in enforcing this Ordinance pursuant to this Section.
(e) The Douglas County Clerk and Recorder may certify the amount of the lien to the Douglas County Treasurer who shall collect the amount of the lien, together with a ten percent (10%) penalty for the cost of collection, in the same manner as other taxes are collected. The laws of Colorado for assessment and collection of general taxes, including the laws for the sale and redemption of property for taxes, shall apply to the collection of liens pursuant to this Ordinance.

(c) In addition to the penalties prescribed in these Sections 8.3 and 8.4, persons convicted of a violation of this Ordinance shall be subject to a surcharge of ten dollars ($10) that shall be paid to the clerk of the court by the defendant as provided by section 30-15-402(2)(a), C.R.S. and any other fines or surcharges deemed appropri ate by the court. (d) This Section 8.4 shall be enforced by the Douglas County Sheriff’s Office and/or Douglas County Zoning Compliance Officials.

Douglas County Government reserves the right to reject any and all responses, to waive formalities, informalities, or irregularities contained in a said response and furthermore, to award a contract for items herein, either in whole or in part, if it is deemed to be in the best interest of the County to do so. Section 8.4 Civil Prosecution (a) Any person who violates any provision of this Ordinance commits, pursuant to section 30-15402(1), C.R.S., commits a civil infraction, and upon conviction thereof, shall be punished by a fine of $250 for the first offense, $500 for the second repeat offense, and $1,000 for the third and subsequent repeat offenses. Each day during which such violation of this Ordinance continues shall be deemed a separate offense.
SECTION 9. VIOLATIONS DEEMED A PUBLIC NUISANCE

The provisions of this Ordinance are hereby de clared to be severable. If any provision, clause, sentence, or paragraph of this Ordinance or the application thereof to any person, establishment, or circumstances shall be held invalid, such invalidity shall not affect the other provisions or application of this Ordinance.
