tion, or FAA, attending its community meetings to help address resident concerns, the federal agencey had no representation at the March community noise roundtable gathering.

For months, residents have been attending meetings to raise concerns about increased air tra c, noise and lead pollution impacting the community, speci cally those

living north of Arapahoe Road. Some even formed a group, Quiet Skies Over Arapahoe County, to advocate for changes to be made to address safety and noise concerns at Centennial Airport.

Should the city pursue getting its own ZIP code? Centennial council members discussed the issue during the March 7 meeting.

Councilmember Mike Sutherland brought up the matter and requested city sta try applying for a ZIP code, or ZIP codes, for the city.

“We’ve talked a lot about identity over all the years I’ve been on council. We’ve talked about how we don’t have a ZIP code,” Sutherland said. “I think a ZIP code or two would be appropriate.”

Richard Holt becomes Centennial mayor pro tem

Holt is a District 3 city council member

Centennial Councilmember Richard Holt, who represents District 3 in the city, was sworn in as the city’s mayor pro tem during the March 7 city council meeting.

e mayor pro tem position is elected annually and serves mayoral functions during any temporary absences of the mayor, the city said in a March 8 news release. Holt will serve as mayor pro tem until March 5, 2024.

“I am grateful to my fellow council members for allowing me this opportunity to serve as Mayor Pro Tem,” Holt said in the release. “I am very proud to be a part of this amazing community and to represent the citizens of Centennial.”

Before Holt, Councilmember Don Sheehan of District 4 served as mayor pro tem. When it came time to nominate someone for the position this year, Sheehan nominated Holt during a Feb. 7 council meeting.

“I think he is the person to do what needs to be done as mayor pro tem. We know his heart is in the city,” Sheehan said. “He puts heart and e ort into what he does for council and for the City of Centennial. And I think he’s more than able as a nominee for mayor pro tem.”

“I humbly and gratefully accept

“With no other nominations, we’ll go ahead and declare that, without a vote, that mayor pro tem for 2023 will be Mr. Rick Holt,” Mayor Stephanie Piko said, prompting applause in the room.

Holt is in his fourth year on city council and is one of three council members who have, as of March 9, declared that they will be running for re-election this November.

Case closed: Taco Bell

When discussing crime cases that happened in Centennial, Brown provided an update on the Taco Bell incident, in which the sheri ’s o ce investigated whether employees put rat poison in food given to a customer.

“Taco Bell was beyond cooperative,” Brown said.

He said the Taco Bell location had cameras inside its entire facility, so investigators gained access to all of that and saw “there was nothing foreign put into that patron’s food.”

“We’ve done a deep dive. We’ve done all the interviews necessary for that,” Brown said. “ at case is closed and there’s nothing further happening with that.”

In a statement the agency shared via Twitter, the sheri ’s o ce said investigators spoke with the victim to “try and ascertain who could have placed the poison in the tacos but were unable to nd a suspect.”

Motor vehicle thefts

Last year, there were just under 800 motor vehicle thefts, Brown said, saying that is a relatively good number given the size of Centennial.

“I would like to see that number lower,” he said.

Currently, the agency’s special response team is working diligently

in areas where there have been increased motor vehicle thefts to try to mitigate that, he said.

“And we’re working on legislation to have the ability to have more

Addressing Tyre Nichols’ death

Brown said the citizens advisory committee met Feb. 9 and the main talking point was the killing of Tyre Nichols in Memphis, Tennessee, and the Scorpion unit within the Memphis Police Department, as well as “how seriously we take those actions.”

“It may have been Memphis, but law enforcement gets categorized in a specific category when those incidents happen and we’re all responsible to make sure that we get out and we discuss these issues, and make sure that our citizens understand that that’s not who we are as an agency,” Brown said.

“We’re a community partnership. We work with our businesses. We work with our citizens to make sure that we have the ability to mitigate crime. And we don’t take punishment into our own hands. There’s a process for that,” he added. “We have very stringent policies. And that’s part of the reason that we have the agreement with the City of Centennial — to make sure that we are accredited at the highest level nationally.”

Centennial Councilmember Marlo Alston expressed gratitude for the report.

“It is very important to the citizens of Centennial and Arapahoe County to understand the culture of the sheriff’s department,” Alston said. “Thank you for that. I

appreciate that.”

Upcoming election

South Metro Fire Rescue will hold an election this spring to select four members of its board of directors, said Communications Director Eckmann.

The agency serves roughly 550,000 people in the south Denver metro area. Last year, South Metro Fire Rescue got more than 50,000 calls throughout the district, Eckmann said. Out of those, there were 9,433 calls in Centennial.

South Metro Fire Rescue is governed by a seven-member board of directors who are publicly elected and oversee an annual budget of more than $127 million, according to the agency’s website.

Each board member represents a specific geographical portion of the overall fire district, known as a director district, the agency explained in a 2020 governing body document.

Four of the directors’ terms expire in 2023, including Sue Roche of District 1, Jim Albee of District 3, Cindy Hathaway of District 4 and Renee Anderson of District 5.

“There are two seats that were open for Centennial — District 1 and District 3,” Eckmann said.

“Jim Albee, he was the candidate for District 3, which is kind of the western part of Centennial. He is running unopposed.

“And then we have District 1, who Sue Roche, she is the one that is currently on our board — she is running opposed by one individual in that area.”

According to the agency’s

website, the candidate opposing Roche is Randy W. Perlis. A ballot will be mailed to voters between April 10 and April 17, per the website.

“The individuals just in that district will be receiving that ballot — it won’t be an at-large voting process,” Eckmann said.

For example, eligible voters in District 3 will get a ballot mailed to them that will only include Albee’s name.

“That is something that we’re required to do,” Eckmann said. “We’re hoping that doesn’t cause confusion, that it will just be one name on his ballot.”

Fire station rebuild

South Metro Fire Rescue is looking to close down Fire Station 15, located at 2702 E. Dry Creek Road, to rebuild it in May, Eckmann said.

“End of May, beginning of June is when you’ll start seeing construction on that, where we’ll start scraping that site and looking at rebuilding it,” she said. “We’re looking at probably an August 2024 timeline to actually get the station reopened.”

Before the old station is taken down, South Metro Fire Rescue plans to hold an open house for the public, she said.

The agency is also preparing itself so that there is no impact to service delivery when the station is going through construction, Eckmann noted.

From avian u to zoning permits, here’s what you need to know about raising backyard chickens

Baldwin, along with experts from Colorado Parks and Wildlife and Colorado State University, will host a webinar next week to share more information about the avian u and how to keep ocks safe this spring.

Avian u cases among humans are extremely rare, and they usually occur only when people are heavily exposed to infected poultry.

e federal government is discussing the possibility for a large-scale avian u vaccination program for poultry, and e New York Times reports a potential vaccine is already being tested.

“ e USDA is really the rst step in getting that approval process started because, if you vaccinate, there are potential trade implications,” Baldwin said.

In the meantime, agriculture ofcials and veterinarians are still searching for other solutions.

ere’s “no clear end in sight” for this avian u outbreak, Baldwin said. With no treatment available and the uncontrollable nature of bird migration coming back into play, it appears this strain of avian u is here to stay.

Man arrested on suspicion of sexual exploitation of a child

Englewood police have arrested a man suspected of sexual exploitation of a child for a second time this month, the police department announced in a March 8 news release.

According to the release, police arrested Homer Daniel Lewis, 73, on March 2. e police department said o cers responded to a welfare check at an Englewood residence, where

Roughly ve years ago, U.S. Rep. Jason Crow gave the city a roadmap on this matter and explained that the U.S. Postal Service is the agency to go to, Sutherland said.

“I think we need it for identity purposes. I think we need it for businesses to understand where to send their tax dollars,” Sutherland said. “I understand that it’s up to the U.S. Postal Service as to whether to grant ZIP codes or not, and it may be a futile process.

“And it’s been attempted before, but it’s been at least nine or 10 years since the attempt was made before,” he added. “I think we ought to at least make the attempt to do it.”

Councilmember Marlo Alston voiced support of the idea.

“We are working on our identity,” Alston said. “And we deserve to have someone pull up our ZIP code and say, ‘Oh, Centennial’ — not Aurora. And that happens quite often.”

Councilmember Don Sheehan said that he likes the idea, but he wondered what impact a ZIP code change may have on businesses.

“Any established business is going to have probably a website, they’re going to have letterhead, they’re going to have legal lings, and a lot of documentation that’s going to have whatever ZIP code they’re a part of right now,” Sheehan said. “And if they had to change that, that could be a pretty signi cant cost or burden on a signi cant number of businesses.”

Mayor Stephanie Piko said the city has raised this issue with Crow’s ofce in the past and with the o ce of U.S. Sen. John Hickenlooper.

“I think it does, pretty much, put

everybody in a stumped position, if you will, of not really knowing how to go forward or even get it passed, but it would be worth looking at, so I would support having us look at it again,” Piko said.

All members of the council gave a thumbs up for moving forward with the matter.

Centennial is not the only municipality interested in getting its own ZIP code. e City of Castle Pines has been trying to change its ZIP code since 2018.

In 2021, the Castle Pines Community Act was introduced in the U.S. House of Representatives with sponsorship from U.S. Rep. Ken Buck. e bill directs the U.S. Postal Service to designate a single Zip code for Castle Pines.

While inside the residence, the o cers allegedly observed evidence of child pornography “in plain view,” the police department said in the release.

Detectives responded to the address and Lewis was arrested on charges of sexual exploitation of a child, per the release.

“We met with the folks at Castle Pines and also with Representative Buck’s o ce, and potentially it’s an opportunity for us, as we consider, you know, building into 80134, whether it makes sense to have 80124 as a uniform zip code for the City of Lone Tree,” Holwell said.

Holwell explained there are a series of pieces of legislation written that relate to this issue, as well as a potential for Lone Tree to be added to the list of communities interested in a zip code.

It may take years before the legislation is introduced, but having it drafted and ready may not be a bad thing if the council agreed, he said.

Lone Tree Mayor Jackie Millet pointed out that the council does not make decisions during its study sessions, but noted a lot of the council members were nodding their heads.  “We might as well try to consider it if it’s happening, so we’ll be working on that and keep you updated,” Holwell said.

Small gestures are big

Irecently took my children to an event created by a mom and employee of a local school district. I only found out about the monthly gathering hosted in my community by chance at a birthday party.

After reading the agenda for the March invite, I opted to take my two elementary-school sons and check it out. I was impressed because the entire event taught us all, at di erent age levels, the importance of contributions and service to our local communities.

With this month’s focus on service we were all encouraged to bring supplies to build special kits for the homeless community. e kits consisted of warming gloves, toothpaste, toothbrushes, Kleenex, lip balm, socks and more. Our children worked to help build the bags to be donated to Aurora Warms the Night in the future. While the goal was to create about 50 bags, based on the amount of supplies donated, I’m sure the nonpro t organization received a lot more.

In talking to my sons after the gathering, they talked about how they learned that the simple gesture of opening a door for someone is considered good service in our community. My 6-year-old, while enamored by the laminating machine, did get some value from his breakout session. Along with an art project, he also learned the meaning of the Mother Teresa quote, “Give your hands to serve and your hearts to love.”

Parents were also required to participate in a breakout group where we interviewed each other and learned a bit more about virtues. As we listened to answers and got to know some of the community parents we did not know — we realized how good it felt to hear good things from others.

When we talked about what we gained from the exercise, one participating dad summed it up well — he said we often get caught up in judging others, having preconceived notions based on a look or attitude, when in reality hearing from someone else about our own good traits and values made him feel good.

is was one example of good happening quietly in our local communities. I truly saw the value in a day like this where it teaches our kids that the world is not just about how many material things we can take from it, but also how small, kind gestures can make it a better place.

In our own newspapers over recent weeks, I cannot say enough about the good deeds and treasured moments our reporters are capturing. I am like many newspaper readers, while I want to know the controversy and newsy stu , I also love to hear about and know about the good news.

From our local high schools in Douglas and Arapahoe counties raising funds to make children’s wishes come true to the Castle View High School project to raise funds to help save the rainforest — our young people are doing great things to help us today and in the future do better.

In Arapahoe County, we have a story of citizens and deputies at a courthouse coming together to save one woman’s life.

ere is always a place out there to lend a hand. Whether it be through a small gesture to help someone with a door or a handful of groceries or on a bigger scale of making sure 50 or more homeless people get some extra supplies or help — We can make a big di erence through small gestures every day.

Courage, discretion and making a choice

Discretion is the better part of valor,” “Caution is preferrable to rash bravery,” and “ e better part of valor is discretion, in the which better part I have saved my life.” - All attributed to William Shakespeare e father and son were skiing together and had decided to head into a tight tree run. e son being in his late teens, and still somewhat made out of rubber, encouraged his dad, who had just turned 51 into joining him on the run. As they picked their way across the top of the run looking for the best entry point, the son without warning dropped into a powder stash and was quickly on his way down the mountain.

e dad stood there on his skis looking for his own entry point down. e longer he stood there, the more nervous he became, and the more nervous he became, the more his muscles tensed and froze. With no way back out, he remembered something he had heard in his life, “God hates a coward.” He wasn’t sure where he had heard it, but the timing was right as it was all the persuasion he needed as he pointed his tips over the ledge and took o down the mountain after his son.

I share that story as one recently shared with me because not too long ago I happened to be playing golf with a couple of customers. One of the guys in our group kept nding himself in trouble, meaning always hitting out of the woods or over water, playing a bit of rescue golf all day. I was standing next to him as he was trying to line up a shot around a tree. He kept walking around trying to decide to just punch the ball out or go for the risky shot that called for an intentional draw around the tree. He looked over at me and said, “God hates a coward,” and swung away. Happy to report that although his ball did not nd the green, it ended up just a few yards short. It was a magni cent shot.

We have all been faced with moments of decision on when we should choose discretion over rash bravery, and hopefully we have all decided in those most critical decision points of life that indeed discretion was the better part of valor. Making a bad decision could end up in serious injury. Making a bad decision in golf will just usually end up with several lost balls and a very bad score. But decisions when it comes to family, health, nances, careers and other key areas of life require us to use judgment and discernment before rushing into something that could cause us much greater harm than good.

Investors have been on the stock market and interest rate roller coaster so long they may feel as though they have gone mad. Planning around continued volatility is a challenge unless you are committed to updating goals at least annually.

Af ter more than 20 years of collecting pinball machines, Dan Nikolich’s basement had run out of space to store them all. So Nikolich opened the Colorado Pinball Pub in Littleton to share his collection.

“Pinball is a unique thing because it doesn’t matter what your background or walk of life is, pinball will draw you in,” he said. “It’s a great equalizer because it only takes one ball.”

While the concept of offering drinks and games at one location is nothing new, the Denver area is host to a number of unique takes on the Dave and Buster’s business model.

Colorado Pinball Pub is one of the newer additions to the barcade scene, having opened in 2020. The pub offers 22 pinball machines, plus a few classic arcade games like PacMan and Centipede, for unlimited play for $15 per hour.

Nikolich’s love for games started young, when he was growing up in Las Vegas and working for the MGM Arcade, so he was happy to see the recent rise in pinball’s popularity.

“Pinball is having a great resurgence right now. The last few years it’s been really hot,” he said. “We have parents who will bring their kids who have never played pinball and, at night, we get a lot of adults and date nights, stuff like that. All people seem to like pinball.”

Like the pub’s patrons, the pinball machines available range in age and theme, with Nikolich’s oldest machine being from 1981. The walls of the pub also pay homage to the history of the game, including its prohibition from 1940s to the 1970s, with pictures and news clippings.

In addition to pinball, the pub features over 150 kinds of whiskey, craft cocktails and Colorado brewed beer.

Nikolich said the goal is to have something for everyone and to make it approachable, whether that’s pinball or whiskey.

“We want you to come and learn about it and not be intimidated to ask if you don’t know something, we want to teach you, so that you can enjoy something new,” he said.

one-of-a-kind barcade is Akihabara, which, while located in Westminster, transports visitors to the Tokyo gaming district that gives the business its name.

Owner Brandon Osha said he was blown away when he had the chance to visit Akihabara and take in its blocks of multi-story arcades.

“The first time I went to Akihabara I knew I wanted to bring that here because it’s amazing,” Osha said.

He did just that by opening Akihabara in 2016.

Similar to Nikolich, Osha grew up with a love of gaming and worked at a local arcade and GameStop. Instead of pinball though, Osha’s games of choice came in arcade cabinets, which he began collecting at age 16.

Currently, Akihabara offers 52 arcade cabinets with around 65 games, but Osha has plans to expand his location with 25 new games and additional space, which he said will be complete this summer.

Osha said the game selection, which includes fighting games, rhythm games and nostalgic classics, definitely sets Akihabara apart.

“You never see this many (arcade

cabinets) in one place,” he said. “We have such a different variety of games that you won’t find anywhere else in Colorado.”

One of the stranger and more rare games Akihabara offers is a Japanese table flipping game called Cho Chabudai, but more wellknown games include Third Strike, Monkeyball, Typing of the Dead and Pretty Soldier Sailor Moon. All of the games are $1 or less to play.

Osha said a lot of people come in seeking a specific game that’s hard to find anywhere else, but he encourages visitors to try whatever piques their interest, even if they can’t necessarily read the Japanese instructions.

“I think it’s a lot of games that

people have never seen, but they might find something that they like,” he said. “Plus, it’s usually only three buttons and a joystick, so they’re not too hard to learn.”

Akihabara’s focus on Japanese culture carries over into the bar offerings, which include Japanese beers and cocktails made with Japanese liquor, as well as a variety of packaged snacks and ramen options.

Overall, Osha said he tries to provide a space that’s both niche and for everyone, describing the Akihabara crowd as a welcoming hodgepodge.

“If you’re looking to find a friend, you’ll find one around here somewhere,” he said.

were trained in France, re ected. e market for those American artists was mainly on the East Coast and a number of them lived and painted in Taos, New Mexico, depicting the scenes in and around Taos and neighboring desert landscapes as well as scenes from an artist’s imagination.

“Our frustration continues along with the growing concerns for the health and safety of our … families and community,” said Lisa Mauvais, a nearby resident.

U.S. Rep. Jason Crow and U.S. Sens. Michael Bennet and John Hickenlooper signed a letter in December encouraging the FAA to attend the monthly meetings in person.

Michael Valencia, general manager of the FAA Denver District, attended the Feb. 1 meeting in person. He was joined virtually by three other FAA o cials.

During that meeting, representatives of the Centennial Airport and FAA disagreed on why more aircraft are ying over nearby neighborhoods.

e FAA explained its analysis found that the primary factor was increased aircraft volume in the trafc pattern, causing the tra c pattern to elongate. However, Centennial Airport Executive Director and CEO Mike Fronapfel said the airport disagrees with that initial analysis.

e airport thinks after a 2021 mid-air collision occurred, the FAA local control tower changed the way it managed the aircraft in the pattern, resulting in the pattern getting extended more frequently over the community, Fronapfel said. He also noted that any solution has to involve the FAA being at the table.

Leslie Lardie, senior advisor to the FAA’s regional administrator of the northwest mountain region, said in a Feb. 21 email that due to the “technical nature of the discussion, an FAA representative attended the February meeting in person.”

“For future meetings, any attendance from the FAA will be virtual, unless the FAA representative determines, upon reviewing the meeting agenda, it is necessary to attend in person,” Lardie wrote.

She noted that the FAA agreed to provide written responses to questions posed by the airport and community.

“ e formal written response is in review at this time,” Lardie wrote.

Fronapfel said that the following day, Feb. 22, the FAA sent another email that said the FAA would not be in attendance at the March meeting.

Brad Pierce, the chair of the roundtable, suggested that perhaps he and Fronapfel should “reach out to the FAA again and express our frustration that they’re not here.”

Lone Tree City Councilmember Mike Anderson, a member of the roundtable, said the community outreach committee has identi ed FAA engagement and participation as a priority.

“To solve problems, we need the FAA involved. Even if we don’t like what they say, we’ve got to have the conversations and try to nd solutions,” Anderson said.

Formation of two committees

During the meeting, Fronapfel proposed the formation of two committees to help address resident concerns — a community-focused committee and a technical working group that would involve the FAA.

At the last Arapahoe County Public Airport Authority Board of Commis-

sioners meeting, it was decided that a more community-focused committee that involved the Quiet Skies Over Arapahoe County group would be formed, Fronapfel said.

Fronapfel said he thinks it would make sense to make that committee an o cial subcommittee of the noise roundtable.

“ e FAA does recognize the roundtable as the community’s representation on noise issues and environmental issues at the airport, and so if we can make that a subcommittee of … the noise roundtable, that would be — that’d be ideal,” Fronapfel said. “We’ll kind of propose that in between this meeting and the next roundtable meeting, and come back to you guys on a request for that.”

Another committee Fronapfel asked the noise roundtable to consider forming is a sub-roundtable technical working group to explore and recommend solutions to the issues caused by the extended training pattern tra c.

Based on the airport’s understanding, the purpose of the working group is to address an issue that’s been identi ed at the airport and assign technical people to that working group to try to identify solutions.

“From what we understand, it kind of triggers the FAA — because in their view, it’s an o cial subgroup of the roundtable — and it triggers the FAA to assign assets and assign technical expertise to this group,” Fronapfel said. “I understand, from talking to people in the noise industry, that this has been successful at other airports.”

e group would likely include FAA representatives, Centennial Airport o cials, noise roundtable members and subject matter experts.

“We’re obviously working really hard to nd any kind of path to a solution to this problem. And that’s one path that we’ve identi ed as a possibility, and so we want to leverage that as quickly as we can,” Fronapfel said.

Fronapfel said he and Pierce sent an email Feb. 14 requesting the FAA form and participate in the working group.

“We have not received a response o cially from the FAA. ey have acknowledged that they received that request, and so we’re hoping that they move forward with that,” Fronapfel said.

Members of the noise roundtable approved a motion to form the technical working group as a subcommittee of the noise roundtable.

Centennial Airport’s legal limitations

During the March meeting, aviation attorney Dan Reimer explained the legal limitations the airport faces when it comes to addressing resident

Reimer, who is the principal of Daniel S. Reimer LLC, provides legal services to several aviation clients including the Grand Junction Regional Airport and the Northern Colorado Regional Airport, Pierce said.

“I have litigated a number of cases concerning airport noise rules,” Reimer said. “What we are faced with is really a development in the law over the last 50 years, from about the

“And it is important to think about this as an evolution, because the law as it existed in the 1970s is not the same as the law as it exists today.”

What exists today is the “Swiss cheese” theory in which there are multiple, overlapping legal standards that limit the ability of a local airport to implement mandatory restrictions, Reimer explained.

“All the layers added together make it very, very hard for local communities and airport operators to restrict aircraft operations or aeronautical activities in the interest of noise or safety,” he said.

One of the legal issues that dominates this eld is the topic of preemption, he said, and that is the balance between federal government regulation and what local airports can do.

“ e federal government has assumed for itself exclusive jurisdiction over the regulation of airspace, the regulation of pilots, and the regulation of aircraft,” he said. “No entity — the airport operator, the local government, the state — can restrict the movement of aircraft in ight. at is within the exclusive jurisdiction of the federal government and shared with the pilot in command of the aircraft.”

Reimer said the airport proprietor, which in Centennial Airport’s case is the Arapahoe County Public Airport Authority, may or may not be able to put conditions on the use of an airport, such as a nighttime curfew.

Implementing such types of conditions, however, can be di cult given the passage of the Airport Noise and Capacity Act of 1990, also referred to as ANCA.

ANCA resulted in some louder types of aircraft being phased out, Reimer explained.

e FAA has a way of rating aircraft based on their noise emissions, labeling the aircraft as stage one, stage two and so on. e higher the stage number, the quieter the aircraft is, Reimer said.

“ANCA was responsible for the phase out of those loud stage two aircraft,” Reimer said. “But as part of the deal for phasing out those louder older stage two aircraft, ANCA made it harder for airport operators to restrict stage three aircraft.”

For airport operators to impose a noise or access restriction on stage three aircraft, certain criteria has to be met to the FAA’s satisfaction, as FAA approval is required, he said.

A noise or access restriction is broadly de ned “to be pretty much anything and everything that would restrict the operation of stage three

aircraft in an interest of reducing the noise,” Reimer said.

“ e FAA has approved zero stage three noise or access restrictions in the 30 plus years since ANCA was enacted,” Reimer said. “So that bar is so high and so intimidating that very few airports and very few communities have even tried.”

ere are a few airports around the U.S. that do have required noise standards and mandatory curfews, he noted. However, in each of those instances, those restrictions were in e ect before ANCA was enacted and were restrictions that were grandfathered in, he said.

Another layer in the swiss cheese theory is the strings associated with the federal grant funding the airport gets.

“Each and every grant agreement that the airport authority signs with the Federal Aviation Administration comes with — in addition to the normal terms and conditions of any contract — it comes with 39 di erent assurances on not just how that particular grant project will go, but how the airport will be run,” Reimer said.

One of the grant assurances is that the airport sponsor must make the airport available for public use on reasonable terms and without unjust discrimination, he said.

Other grant assurances state that the airport sponsor may establish conditions to be met by all users of the airport, and may prohibit or limit any type of aeronautical use of the airport if such actions are necessary for safety reasons.

“What the FAA means by that is necessary in our view, in the FAA’s view. So they view themselves to be the nal arbiter of what is safe or unsafe to occur at and around airports,” he said. “And they take a pretty dim view about restrictions that are imposed by airport operators in the interest of safety.”

In many instances where airports attempt to implement a restriction, such as not operating jets at a small airport, the FAA will typically look at the case and determine the restriction is not necessary for the safe operation of the airport.

“ ere have been many instances where airports have said, ‘We’re concerned about this activity,’ — jet tra c, whatever it may be. And in a lot of … those instances, the FAA has said, ‘We look at it independently. We don’t think that that activity is inherently unsafe. And so we would view it as being unreasonable for the airport operator and therefore a violation of these grant assurances,’” Reimer said.

e overlapping legal standards — such as preemption issues, ANCA, and grant assurances — can limit what power local airports and communities have.

“It’s really that, kind of, overlapping set of standards and the interplay among these things that really add to the challenge for local communities who understandably want to reduce the noise exposure associated with an airport,” Reimer said.

“I would say it is fair to say that the FAA is generally viewed as being antagonistic towards mandatory noise rules. I’m not sure there’s a more polite way to say it than that,” he said.

One question raised was what would happen if the Centennial Airport did not accept grant funding or was to violate the grant assurances.

“ e grant funding from the federal government is the lifeblood of most airports. It represents millions and millions of dollars in contributions,” Reimer said. “ ere really is no way, as a practical matter, that an airport like this one could go without the grant funding.”

On top of that, there is an idea that the FAA could not only suspend an airport’s eligibility for future grant payments, but could potentially come against airports for the repayment of past grants that have been issued, he said.

“So that is also what is at stake, and again, another reason why airports typically don’t cross the FAA when it comes to these issues. Because your payment under existing grants, your eligibility for future grants, and potentially the repayment (of) past grants is what’s at stake,” Reimer said.

Reimer told attendees a key takeaway is that the regulation of aircraft and ight is preempted, and while there is some theoretical ability to restrict aircraft, the ability of airport operators to impose mandatory restrictions on aircraft in the interest of reducing and abating noise is “a nonzero sum that’s as close to zero as one can get, based on the track record at airports across country.”

“I’m not saying that airports (are) powerless. I’m not saying that the community is powerless,” he said. “ ere are a lot of tools that are available and so I am not doomy and gloomy about this particular topic. I think there is a lot of good work that is going on.”

measures, o ering education and outreach to the pilot community, giving recommendations to the FAA and land use compatibility planning, he said.

“It’s just when it comes to mandatory use restrictions, there is little that can be done,” Reimer said.

Centennial Airport’s legislative goals Fronapfel told attendees he would be traveling to Washington D.C. this month to communicate the airport’s legislative priorities.

One of the top priorities is emphasizing more local control to address aircraft noise issues.

“Obviously, based on Dan (Reimer)’s legal brie ng tonight, it doesn’t sound like we have any options under the current structure. However, we can pressure our legislative o cials to change the law to accommodate that — and we’ve done that in the past,” Fronapfel said. “It’d be a tall order and a long, kind of, process … but it’s worth pursuing.”

Another priority is replacing leaded fuel with alternative, unleaded fuels and having the federal government provide incentives to accelerate that transition, he said.

“Right now, the stated goal is 2030 from the FAA. We think it can and should happen much, much sooner than that. And so we’re going to carry that message to our representatives,” he said.

Other priorities include increasing penalties for pointing lasers at aircraft — which is something Fronapfel said the Centennial Airport has not been immune to — and requesting the increased airport improvement program funding.

“Everybody in the community and in this room are really looking for an immediate solution,” he said. “And we’re also looking for that as well.”

NOTICE IS HEREBY GIVEN that the general public and any interested parties are invited to provide comment and input regarding the County’s plan to utilize HOME Investment Partnerships Program-American Rescue Plan (HOME-ARP) funds to address community needs, reduce homelessness and increase housing stability.

The County’s HOME-ARP Allocation plan establishes funding priorities and allocations for the $2,691,031 one-time entitlement program, and will be submitted for approval as part of a substantial amendment to the County’s 2021 Annual Action Plan.

Housing and Homeless Services staff will complete a Study Session and Business Meeting with the Board of County Commissioners (BOCC) to review the HOME-ARP Allocation Plan and provide an opportunity for public comment and feedback.

REQUEST FOR RELEASE OF FUNDS

On or about 4/3/2023 Arapahoe County will submit a request to the U.S. Department of Housing and Urban Development for the release of HOME funds, under title II of the CranstonGonzales National Affordable Housing Act, to undertake the following project:

Project Title: Eagle Street Homes

Project: This project will provide 93 new family units affordable for households with incomes ranging from 30% - 80% AMI. The Average Income mid-point is 48% of the Area Medium Income (AMI) with 23% of the units as 1 Bedroom (BDr), 51% at 2 BDR and 26 % 3 BDr Location: 14875 E 2nd Ave, Aurora, CO 80012.

Estimated Cost: Roughly up to $500,000 in Arapahoe County HOME funds. The total estimated Phase I project cost is $27.5 million.

SIGNIFICANT IMPACT

FINDING OF NO

Arapahoe County has determined that the project will have no significant impact on the human environment. Therefore, an Environmental Impact Statement under the National Environmental Policy Act of 1969 (NEPA) is not required. PUBLIC COMMENTS

Any individual, group, or agency may submit written comments on the ERR to Arapahoe County, Community resources. Comments should specify which Notice they are addressing.

ENVIRONMENTAL CERTIFICATION

Arapahoe County, Katherine Smith, Arapahoe County Director of Community Resources, in his/ her capacity as Official Title consents to accept the jurisdiction of the Federal Courts if an action is brought to enforce responsibilities in relation to the environmental review process and that these responsibilities have been satisfied. HUD’s State’s approval of the certification satisfies its responsibilities under NEPA and related laws and authorities and allows Arapahoe County to use Program funds.

OBJECTIONS TO RELEASE OF FUNDS

HUD/State will accept objections to its release of funds and Arapahoe County’s certification for a period of fifteen days following the anticipated submission date or its actual receipt of the request (whichever is later) only if they are on one of the following bases: (a) the certification was not executed by the Certifying Officer Arapahoe County; (b) Arapahoe County has omitted a step or failed to make a decision or finding required by HUD regulations at 24 CFR part 58; (c) the grant recipient or other participants in the development process have committed funds, incurred costs or

undertaken activities not authorized by 24 CFR Part 58 before approval of a release of funds by HUD/State; or (d) another Federal agency acting pursuant to 40 CFR Part 1504 has submitted a written finding that the project is unsatisfactory from the standpoint of environmental quality. CITY OF CENTENNIAL NOTICE OF PUBLIC HEARING

NOTICE IS HEREBY GIVEN that the City Council of the City of Centennial, Colorado will conduct a public hearing on Tuesday, March 21, 2023 at 7:00 p.m. regarding ORDINANCE 2023-O-03, AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF CENTENNIAL, COLORADO ESTABLISHING A TEMPORARY MORATORIUM ON THE ACCEPTANCE AND ON THE PROCESSING OF APPLICATIONS SEEKING THE APPROVAL OF A PERMIT OR LICENSE, INCLUDING APPLICATIONS FOR OR ISSUANCE OF BUILDING PERMITS AND BUSINESS LICENSES, FOR OUTDOOR PICKLEBALL COURTS LOCATED WITHIN 500 FEET OF RESIDENTIAL ZONED OR RESIDENTIALLY USED LAND AND DECLARING AN EMERGENCY. The public hearing will be held at the Centennial Civic Center, 13133 E. Arapahoe Road, Council Chambers, Centennial, Colorado 80112. Copies of Ordinance No. 2023-O-03 are available for inspection by the public on the City’s website: www.centennialco.gov. Interested parties may file written comments with the City Clerk, at: councilcomments@centennialco.gov or by mailing them to City Clerk, 13133 E. Arapahoe Rd, Centennial, CO 80112 any time prior to March 21, 2023. Any written comments received will be provided to City Council prior to the Public Hearing and made part of the record.
