CHRG - Member Reward Program Terms & Conditions

T and C’s Member Rewards CHRG 1. Membership 1.1. Membership in the Members’ Rewards loyalty program comes with membership of CHRG. Membership of CHRG is an eligibility requirement of the Member Rewards loyalty program.

A member has the right to opt out of the Members’ Reward loyalty program at any time, by emailing chrslinfo@chrg.com.au or by attending reception at any of the CHRG venues.

Participation in the Members Rewards loyalty program is only open to members aged 18 years or over and is not open to junior members or corporate entities or any other entities.

Participation in the Members’ Rewards loyalty program, or claiming, receiving or spending Rewards Points earned, constitutes acceptance of these Terms and Conditions and an agreement to comply with them.

1.2. The Member Rewards loyalty program is currently structured into five (5) Tiers being Double Diamond, Diamond, Emerald, Ruby and the entry level Tier of Sapphire.

1.3. All eligible members are initially placed in the entry level Tier of Sapphire.

1.4. The Club may add or reduce the number of Tiers in the Member Rewards loyalty program at any time and for any reason and without notice.

1.5. A Member Rewards loyalty program member must promptly notify CHRG: 1.5.1. of any change in contact details (address, mobile phone, email address); and/or 1.5.2. if the Club membership card is lost, stolen, damaged or misused in any way.

1.6. Members of the Members Rewards loyalty program who are suspended by the Club or selfexcluded from any premises of CHRG shall have their Members Rewards loyalty program membership suspended. Members Rewards loyalty program points will be suspended until the earlier of the member suspension or self-exclusion ceasing, or the purging of points in accordance with these Terms and Conditions.

1.7. Members of the Members Rewards loyalty program who are expelled from membership of the Club will have their Members Rewards loyalty program membership and points terminated.

1.8 Members who partially self-exclude from CHRG Gaming Rooms only will have their membership card deactivated from Gaming Room promotions and activities for the duration of the self-exclusion.

Members Rewards loyalty program points will be suspended until the earlier of the member’s selfexclusion ceasing, or the purging of points in accordance with these Terms and Conditions.

1.9. CHRG reserves the right to make any changes to these Terms and Conditions, at any time, including to: 1.9.1. Create, amend or remove the Tiers of membership including but not limited to the benefits applicable to each Tier of membership of the Members’ Rewards loyalty program;

1.9.2. Set and change the number of Tiering Points required to be earned (and if specified from time to time, maintained) under the Members’ Rewards loyalty program within any period for eligibility to any Tier of membership within the Members’ Rewards loyalty program; 1.9.3. amend these Terms and Conditions; 1.9.4. amend the Members Rewards Loyalty Program Brochure; 1.9.5. amend the type and availability of Rewards offered to each Tier; 1.9.6. amend the date of expiry of points or the rate of accrual of Reward Points; 1.9.7. amend the duration of each Membership Tier Period; 1.9.8. amend the eligibility criteria to be a Member of Members’ Rewards loyalty program; and 1.10. CHRG will notify Members of any material change by making the updated Terms and Conditions available at reception of each CHRG venue. If such change relates to benefits provided by Third Party Offers, CHRG will, where possible, provide at least fourteen (14) days’ notice.

1.11. Promotional Offers can be varied at any time at the discretion of CHRG and will be subject to the specific terms and conditions of that Promotional Offer which are published separately to these Terms and Conditions from time to time.

1.12 Members are responsible for ensuring they keep up to date with the Terms and Conditions and the features and requirements of the Members’ Rewards loyalty program.

1.13. You will be entitled to receive a monthly Player Activity Statement if during the monthly period covered by the Player Activity Statement you have inserted your membership card into the membership card console of a gaming machine in a CHRG venue while playing that gaming machine.

2. Membership cards 2.1. Each member is issued one (1) membership number, and is permitted to hold one (1) valid membership card displaying that membership number (except where CHRG issues in its discretion an ancillary card linked back to the primary membership account in CHRG database).

2.2. Following each review at the end of a Membership Tier Period, where a member’s Tier changes the member will be issued a new membership card representing their new Tier level in the Members’ Rewards loyalty program.

2.3. It is the sole responsibility of the Member to safeguard their membership card and take precautions against the loss, or any unauthorised use, of their card.

2.4. In the event that the Member’s card is lost or stolen the Member must immediately report the loss or theft to CHRG. (and may be required to produce a police report if requested by CHRG).

2.5. CHRG may replace a lost, stolen or damaged membership card in its absolute discretion and subject to the member complying with CHRG’s appropriate Identification requirements. CHRG reserves the right to charge a fee for a replacement membership cards.

2.6. A membership card issued to the Member may only be used by that Member.

2.7. The Member must not give their membership card to another person or Member for any purpose whatsoever. A breach of this Rule shall be considered to constitute conduct unbecoming a member which may be dealt with under the disciplinary proceeding provisions in CHRG ’s Constitution.

3. Membership Tiers 3.1. A new Member will be assigned the Sapphire Tier based upon the criteria set out within the Program Brochure.

3.2. Membership of each Tier will be reviewed weekly and where a member has attained the required points for a higher Tier, CHRG reserves the right to move that member to the higher Tier at any time.

3.3. Members will only be moved down Tiers every six (6) months, at the expiry of each Membership Tier Period.

3.4. Members can check their Tier level and review their Tier Points at any membership kiosk or when they insert their membership card in a gaming machine.

3.5. If a member disputes their level of points or allocated Tier, they may raise the dispute by email to chrslinfo@chrg.com.au.

4. Earning Tiering Points and Reward Points 4.1. Tiering Points and Reward Points are awarded to Members for cash expenditure in participating facilities at CHRG venues on certain goods and services.

4.2. Tiering Points and Reward Points for spend on golf at Lynwood CC and Castle Hill Fitness are not automatic but are available by request via email to chrslinfo@chrg.com.au 4.3. The Member is not permitted to accrue Tiering Points and Reward Points as a result of play or spend by any person other than the Member named on the face of the membership card. A breach of this Rule shall be considered to be card misuse and to constitute conduct unbecoming a member which may be dealt with under the disciplinary proceeding provisions in CHRG ’s Constitution.

4.3. In order for Tiering Points and Reward Points to accrue to their membership card, it is the Member’s responsibility to ensure that their card has been registered for the transaction.

4.4. CHRG will not be liable in any way in relation to the unavailability of Tiering Points or Reward Points or the incorrect accumulation of Tiering Points or Reward Points as a result of a technical malfunction, operator fault, misrepresentation for which CHRG is not responsible or any other reason outside CHRG reasonable control.

4.5. CHRG reserves the right to adjust the Member’s Tiering Points and Reward Points balance and available Rewards where it is satisfied, in its absolute discretion, that there is good reason to do so or there has been an error in the accumulation or calculation of Tiering Points or Reward Points and/or any statement as to the availability of Rewards, including for the reasons set out in Rule 4.4.

4.6. Tiering Points will reset to zero for all members at the beginning of each Membership Tier Period.

5. Benefits 5.1. The participating facilities in the Members’ Rewards loyalty program is set out in the Program Brochure available at each CHRG venue Reception and on the website www.CHRG.com.au 5.2. CHRG shall not be liable in any way for Rewards which are unavailable for redemption as a result of a technical malfunction, operator fault, misrepresentation for which CHRG is not responsible or any other reason outside CHRG reasonable control. Rewards cannot be used in conjunction with other discount programs, offers or special events at CHRG, unless otherwise specified in the terms and conditions of a particular discount program, promotion offer or special event.

5.3. Some benefits like car parking and car washes are subject to availability (for example, services or goods may be in limited supply) and based on a first come, first serve basis.

5.4. The Birthday Gift is only available for all Castle Hill RSL members and any other members who reach Ruby Tier and above.

5.5. To claim the Birthday Gift, the member must swipe at the Member Rewards kiosk at any CHRG venue, on the month of their birthday.

5.6. Additional Monthly Reward Points are calculated on Tiering Points earnt in the prior month.

5.7. Weekly Reward Points are rewarded to eligible members every Monday providing there is Tiering Activity recorded the week prior.

5.8. Complimentary show tickets and discounts are limited to 8 tickets per show.

5.9. Free membership at Castle Hill Fitness and Aquatic Centre and Lynwood CC for Double Diamond members can be transferred to the member’s partner or Next of Kin by written request to chrslinfo@chrg.com.au.

5.10. Complimentary Rounds of golf at Lynwood can be redeemed by contacting the pro shop at Lynwood CC. 5.11. Invitations to Offsite Events may be available to Emerald, Diamond and Double Diamond level members during the year where members will be invited to attend an event by way of invitation in the mail or by an Executive Host. Should the Offsite Event be limited with the number of tickets made available, this would be considered a Promotional Offer and are subject to their own specific terms and conditions.

5.12. Invite list for the Double Diamond and Diamond Tier Annual Dinner are based on members who qualify for these Tiers based on the review conducted at the end of each Membership Tier Period . Each member is sent an invitation for themselves plus one guest.

5.13. Easter and Christmas Hampers qualification are based on Tier levels four (4) weeks out from Easter Day and Christmas Day. Any members who qualify leading up to the events will become eligible for a hamper 5.14. CHRG reserves the right to offer members who reach certain Tiers offers and invitations in line with the program.

5.15. Benefit entitlements is only available to members while they remain at the required Tier level.

6. Reward Points 6.1. Reward Points may be redeemed at any participating Food and Beverage outlets in any CHRG venue.

6.2. Reward Points can be redeemed at Pitstop outlets located in the Gaming Room at Castle Hill RSL and Club Parramatta.

6.3 Reward Points can be redeemed at reception of any CHRG venue for show tickets and gift cards.

6.4 Reward Points can be redeemed at Lynwood Golf and Castle Hill Fitness and Aquatic Centre.

6.5. Reward Points can be used to pay utility bills by contacting an Executive Host or reception.

6.6. CHRG may offer Promotional Bonus point offers from time to time. Promotional Offers will vary and are subject to their own specific terms and conditions.

6.7. Double Diamond Reward Points will not expire as long as the member remains in that Tier of the Member Rewards loyalty program.

6.8 Diamond, Emerald, Ruby and Sapphire Tier’s Reward Points will expire and be purged from the Member’s Reward Account every year on close of business 30th June.

6.9. The security of Reward Points in your Member Rewards Account is the sole responsibility of the member. CHRG takes no responsibility for any losses which might occur from a member’s Rewards Account due to fraudulent activities.

6.10. Reward Points cannot be exchanged for cash.

7. Third party offers 7.1. CHRG may, from time to time, make Third Party Offers available to Members. Members acknowledge that Third Party Offers, including any goods and/or services provided in respect of such offers, are not provided by CHRG but by the third parties.

7.2. To the extent permitted by law, CHRG does not accept any liability in respect of Third Party Offers.

7.3. CHRG does not make any guarantee, promise or warranty in relation to Third Party Offers. To the extent permitted by law, the Terms and Conditions expressly exclude every warranty, condition, liability or representation concerning any goods or any services supplied by a third party as a ThirdParty Offer under or in connection with the Terms and Conditions.

7.4. To the extent permitted by law, the liability of CHRG and its officers, employees or agents in respect of any Third-Party Offer, including a claimed Reward not being awarded by the offer or of the Third Party Offer or a claim for breach of warranty or liability in respect of any Reward, including goods and/or services provided or offered as a Third-Party Offer, which by law cannot be excluded, restricted or modified, or under any express warranty, is limited, at CHRG ’s option, to: 7.4.1. re-crediting Reward Points; or 7.4.2. replacing or resupplying the Reward.

8. Privacy 8.1. The information we collect arising directly or indirectly out of or in connection with your membership shall become and remain our property.

8.2 You consent to us collecting and retaining your personal information (including information concerning your membership) for the purposes of: 8.2.1. Carrying out the functions and activities that are necessary for us to meet our obligations to you under the Terms and Conditions; 8.2.2. Disclosing your personal information to third parties who are engaged by us to assist in meeting our obligations to you under the Terms and Conditions; 8.2.3. Marketing our goods and services to you; 8.2.4. Disclosing your personal information to selected third parties to allow them to market their goods and services to you unless you inform us otherwise; and 8.2.5. Meeting legal requirements or fulfilling any purpose authorised by or under law.

8.3. CHRG will, at your request, provide you with access to your personal information held by CHRG in accordance with CHRG’s Privacy Policy and the requirements of the Privacy Act 1988. Player Activity Statements are available upon request.

8.4. It is your responsibility to ensure that your personal information held by CHRG is accurate, complete and up-to-date. In accordance with CHRG ’s Privacy Policy and the requirements of the Privacy Act 1988, you will be granted access to your personal information for the purposes of establishing that the information is accurate, complete and up-to-date.

8.5. If you opt out of promotional material from the club, you agree and acknowledge that CHRG will be unable to send you any relevant notice about such matters in connection with Members’ Rewards loyalty program.

9. Termination or suspension of the Members’ Rewards Loyalty program 9.1. CHRG may suspend the operation of the Members’ Rewards loyalty program or cease to operate the Members’ Rewards Loyalty program at any time.

9.2. Where possible, CHRG will provide two (2) months’ notice of such suspension or cessation.

9.3. To the extent permitted by law, CHRG (including its officers, employees, agents and contractors) is not and will not be liable for any damages or any loss whatsoever incurred by the Member (including consequential loss), either directly or indirectly in connection with the suspension or termination of Members’ Rewards loyalty program.

9.4. CHRG is not liable for any compensation to Members for unclaimed Reward or unredeemed Points if Members Rewards loyalty program is suspended or terminated.

9.5. CHRG may terminate or suspend a Member’s membership of Members’ Rewards loyalty program (at CHRG ’s absolute discretion) if CHRG believes (in its absolute discretion) that any of the following have occurred:

9.5.1. The Member has failed to strictly comply with the Terms and Conditions; 9.5.2. The Member’s Club membership has expired, has been cancelled or has been suspended; 9.5.3. The Member’s has engaged in conduct which is offensive, dishonest, disruptive, intimidating, unbecoming or prejudicial to CHRG ’s interests; 9.5.4. The Member has interfered with or misused any equipment or property; or 9.5.5. The Member dies or is bankrupt.

9.6. In the event your membership of CHRG is terminated: 9.6.1. All of your Tiering Points and Reward Points and associated Rewards (whether they be Tiering Points and Reward Points having accrued or not) will automatically be cancelled.

9.6.2. You must immediately return your Club membership card to us.

9.7 Nothing in the Terms and Conditions shall be interpreted as excluding or restricting and liability of CHRG that is non-excludable by law and shall be read subject to the provisions of the Australian Consumer Law and any other similar State or Territory Legislation which cannot be lawfully excluded. These Terms and Conditions shall otherwise have the maximum effect permitted by law.

10. RESPONSIBLE GAMING AND RESPONSIBLE SERVICE OF ALCOHOL 10.1 CHRG is committed to providing an environment in which gambling minimises harm and meets community expectations. Gaming facilities are provided in the CHRG venues for the enjoyment of members and their guests. Where problem gambling occurs, CHRG is happy to provide information regarding community organisations that will provide support and advice.

10.2 A Member can request a player activity statement at any time by contacting CHRG reception.

10.3 CHRG is committed to maintaining the Responsible Service of Alcohol in a safe environment for all members, guests and the local community. Service of alcohol will be denied to any person suspected of being under 18 years of age and to anyone who is considered to be in or approaching a state of intoxication.

11. Terms and Definitions 11.1. Members’ Rewards Terms and Conditions (“Terms and Conditions”) comprise these Terms and Conditions, the Program Brochure and any other terms and conditions that the CHRG may publish from time to time by which the Members’ Rewards loyalty program operates.

11.2. The Terms and Conditions apply to the rewards scheme known as Members’ Rewards. The Members’ Rewards Scheme has been established and is administered by the CHRG. 11.3. CHRG operates four (4) premises known as, CHRSL located at 77 Castle Street Castle Hill 2154, Club Parramatta located at 2 Macquarie Street Parramatta; Lynwood Country Club located at 4 Pitt Town Bottoms, Pitt Town 2756 and Castle Hill Fitness + Aquatic Centre located at 77 Castle Street Castle Hill 2154 (CHRG venues).

Definitions

“Benefits” includes those entitlements or benefits supplied by CHRG to members of the Member Rewards loyalty program, unless otherwise stated.

“CHRG”, “Club”, “we”, “our” and “us” are references to CHRG and all Third Party Offers, “member”, “you” and “your” means an eligible member of CHRG who participates in Members’ Rewards loyalty program under these Terms and Conditions as amended from time to time. “membership” means a member’s membership of CHRG. “Membership Tier Period” means: (a) the two six-month periods: (i) 8 April through to close of business 7th October; and (ii) 8 October through to close of business 7 April, in each Calendar year; or (b) such other period as CHRG may specify from time to time.

“Monthly Reward Points” are additional Reward Points calculated on Tiering Points earnt in the prior month by a member, that may be allocated by CHRG on a monthly basis to a member’s Bonus Point balance.

“Offsite Events” are events conducted for Member Rewards loyalty program participants that are not held in a CHRG venue.

“Program Brochure” means the Member Rewards Loyalty program brochure published by CHRG as amended from time to time, on display on CHRG ’s website and containing participating facilities or other information which are deemed to form part of these Terms and Conditions.

“Promotional Offers” are offers are those offers determined by CHRG to be promotional offers.

“Rewards” means a good, service, benefit or entitlement available through Member Rewards Loyalty program.

“Reward Points” are the points which a Member accrues when they purchase food or beverages in the CHRG venues or participates in gaming activities or uses other facilities as may be determined by the Club from time to time. These Points can be redeemed for Rewards.

“Third Party Offer” means any Rewards offer made as part of the Members’ Rewards loyalty program by any entity other than CHRG. “Tier” means Double Diamond, Diamond, Emerald, Ruby and Sapphire and any other tier created by CHRG for the purpose of the Members’ Rewards loyalty program.

“Tiering Activity” is the expenditure of cash in a CHRG venue by the member on activities that are part of the Member Rewards loyalty program.

“Tiering Points” are the points earned through Tiering Activity during each Membership Tier Period.

Tiering Points are used to determine a member’s Tier status and have no monetary value.

10.12. Subject to any applicable law which cannot be excluded, CHRG and its officers, employees, agents and contractors accept no liability for any loss, damage or injuries suffered or sustained

(including but not limited to direct or consequential loss or losses arising from negligence) by any Member arising directly or indirectly out of or in connection to Members’ Rewards and members release and discharge CHRG, officers, employees, agents and contractors from any liability for any such loss, damage or injury. If CHRG is liable to a Member in any way, then liability will be limited to: (a) crediting Points to the member’s Rewards Account; or (b) replacing or resupplying a Reward, which CHRG considers is appropriate in connection with the relevant claim.
