New Child Support Legislation In June 2016, the Texas Attorney General for Child Support announced the introduction of vehicle registration blocking as a result of unpaid child support. The law was said to be implemented in the fall and has been confirmed to start at the beginning of December 2016. Letters were said to have been sent out starting September 2016 to parents with outstanding child support amounts. The vehicle registration blocking law will affect parents who are behind on child support by 180 days or more. When asked about the practicality of the new law, a spokesperson from Busby & Associates stated that, “child support funds are tailor-made for the enrichment and benefit of the child and must be paid out consistently. Without consistency this has a direct effect on the child or children in question. The point of child support is just that to support the child”. The office of the Attorney General are not looking for parents to pay full amounts outstanding for the child support but to come up with a payment plan to enable the payment of what is outstanding. The office will be sending out electronic updates to the Texas Department of Motor Vehicles on payments made and advising them to allow registration for parents who are up to date on payments. An attorney from Busby & Associates was asked to comment on reasons for defaulting on child support by some parents, they responded, “if one were to speculate, there are many reasons; one of them is that parents may be resentful toward each other and child support is caught in the cross hairs, while others cannot afford the stipulated amount due to unemployment or changes in employment – where this is the case parents must get advice from an attorney who has the experience to give him/her the best advice. There are options such as child support modification that allow the review of the child support amount be it to increase or decrease the amount. For parents to know their options they must invest in a lawyer. The vehicle registration blocking law for parents with outstanding child support amounts will not apply to registering a new vehicle. It will not apply to the purchase of new or used vehicles and also does not apply to coowned vehicle registration.
