That being said, it must be noted that in accordance with the Texas law requirements, all petitioners are to wait at least sixty days after filing the Original Petition of Divorce before the court grants the divorce. The basic theory behind the


sixty day wait is in the hope that the couple reconcile and do not proceed with divorce; the sixty day period is known as a ‘cooling off’ period. While the cooling off period works in theory this is not the case with most divorces as reconciliation does not happen�. Is it possible for a spouse to choose an uncontested divorce? The spokesperson responded that the question of having an uncontested divorce could easily be answered with a yes, however, the circumstances surrounding the yes would be the deciding factor. An uncontested divorce is said to be possible if the divorcing parties agree on all issues. The spokesperson further stated that an uncontested divorce required an amicable end to the marriage relationship where both parties could come to an agreement in writing, sign it and attend a hearing before a judge whereby their divorce is finalized. The spokesperson noted that in most cases uncontested divorce is common where couples had no children, where couples have not been married for long and had not accumulated many assets or debt in the marriage. To this the spokesperson responded that it was possible for an individual to go through a do-ityourself divorce but that this is not advisable; even in cases where both spouses are in agreement on most issues.
