Elements of a Divorce vs. Texas Divorce Laws The high profile $100 million divorce case of Pakistani citizens and Texas residents; Hira Azhar and Mohammad Ali Choudhri, has sent shock waves throughout the Houston District Court. The divorce battle began in January 2016 and has been in newspapers around the country of the twists taken by each court hearing. The divorce has been playing out in the 312th District Court before Judge David Farr. In recent months the unanswered question was the issue of jurisdiction of the divorce as one party filed divorce in Pakistan while the other filed in Houston, Texas. While most attorneys reserve their comments on the issue, attorneys with years of experience have shared their views on Texas divorce laws and this case. When asked to comment on the issue of jurisdiction of the case, the spokesperson stated that; “the basic requirements regarding the filing of a divorce petition in Texas are that at least one spouse ought to live in the state. The requirements on residency are specific, for one to file a petition for divorce in any Texas court, either spouse must have been a resident of the state for at least 6 months before filing and must have lived in the county where the petition is filed for the prior 90 days. In the case of the court case in question, both spouses lived in Harris County since 2010 and were thus residents of the state and county”. The spokesperson was asked about the judge and court where the case was being heard, “our attorneys are familiar with the court room as we have a fully flourished family law practice in our firm. In fact our firm has had some 40 contested cases heard in the Harris County 312th District Court, some of these cases were heard by Judge Farr; whose associate is Judge Gaffney”. During witness testimony it was noted that Hira Azhar alleged that her husband was having an affair; we asked the Busby & Associates spokesperson to comment on the relevance of this information. “Texas has both a fault and no-fault grounds for divorce; therefore the divorce in question may be on the grounds of fault. In this case there is need to prove that there was fault and provide some supporting evidence of such. However, if no support is given for the fault, the grounds become no-fault divorce. Examples of fault grounds for divorce include; discord or conflict of personalities, cruelty by one’s spouse to another and adultery”. While divorce accounts for about 89% of all cases filed in District Courts, the rules on divorce affect each case and in the hands of the judge are applied according to each situation.
