Celebrate American Angus Auxiliary 60th Anniversary in Louisville Join the Auxiliary for their annual breakfast, meeting and awards presentation.

Celebrate another successful year for the American Angus Auxiliary while attending the 129th American Angus Association® Annual Meeting. Events are held in conjunction with the 2012 North American International Livestock Exposition (NAILE) Nov. 10-13 in Louisville, Ky. All Auxiliary members are encouraged to attend their Annual Meeting, held at 3 p.m. on Nov. 10 in the Crowne Plaza. Agenda items include electing new officers and announcing the new team of regional directors. In addition, the Auxiliary silent auction and Gift Barn will be on display throughout the week in the Crowne Plaza. Begin the week with the Auxiliary breakfast at 8 a.m. on Nov. 11 in the Kentucky Fair and Exposition Center (KFEC) South Wing C, Room 101. The breakfast honors outgoing Auxiliary President Anne Lampe, Scott City, Kan., and the 2012 Miss American Angus Brooke Harward, Richfield, N.C. “This is one of our most popular events,” Lampe says. “We have great entertainment scheduled combined with an atmosphere for new and old friends to mingle — all within feet of the showring.” A limited amount of tickets are available, and reservations are strongly advised. To purchase a ticket, contact the Auxiliary program and hospitality chair Michelle Rieff at michellerieff@aol.com or 479-9361685. Tickets will also be available at the Crowne Plaza Angus registration desk. Auxiliary events continue Nov. 11 with a come-and-go reception, 3:30 p.m. to 4:30 p.m., hosted by Lampe. Members and potential members are invited to stop by and get to know one another. Following the reception, five young women vying for the title of Miss American Angus will give speeches in the Crowne Plaza. Presentations are open to the public, so join in and support these outstanding Angus representatives. The 2013 Miss American Angus will be crowned Monday, Nov. 12, prior to the selection of the SuperPoint Roll of Victory (ROV) Champion Angus Bull. “The Miss American Angus competition will select the outstanding young woman that will serve as an ambassador for our breed, as well as a role model for junior Angus members,” Lampe says. “The five contestants were chosen this summer from the top Auxiliary scholarship applicants and represent those that have excelled in junior Angus activities including leadership and service.” A tentative Angus NAILE schedule follows. 2012 North American/ Annual Meeting Schedule Rooms are TENTATIVE (10/8/12) SATURDAY, NOVEMBER 10 8 - 10 a.m. Angus Cattle Check in KFEC 9 a.m. - 5 p.m. Angus Registration Desk Open Crowne Plaza - Carroll Room 1 - 6 p.m. Holiday Room Open Crowne Plaza - Elliott 3 p.m. American Angus Auxiliary Annual Meeting Crowne Plaza - Coronet A 6 p.m. Angus Foundation Donor Recognition Event Crowne Plaza - Crowne B/C SUNDAY, NOVEMER 11 7 a.m. - 6 p.m. Angus Registration Desk Open Crowne Plaza - Carroll Room 10 a.m. - 6 p.m. Holiday Room Open Crowne Plaza - Elliott 8 a.m. Junior Heifer Show KFEC Freedom Hall (Breed order to be announced) 8 a.m. American Angus Auxiliary Breakfast KFEC South Wing C, Room 101 8 a.m. - 12 p.m. Angus Education Center Open KFEC South Wing C, Room 201 1:30 p.m. Board Candidates Forum KFEC South Wing C Room 202, 203, 204 3:30 - 4:30 p.m. American Angus Auxiliary 60th Anniversary Reception open to public Crowne Plaza - Coronet B 4:30 - 6 p.m. Miss American Angus Contestant Speeches open to public Crowne Plaza - Coronet A 64 illinoisnews@bingmanpub.com illinoisnews@bingmanpub.com ~ ~ NOVEMBER NOVEMBER 2012 2012

“Angus Talk” Podcast Available on iTunes

Download the bi-weekly radio program that discusses cattle industry topics. Audiences have grown accustomed to information, literally, at their fingertips. One tap of a smartphone can instantly access stock reports, breaking news headlines and weather forecasts. And that’s just the beginning. To help cattlemen stay up-to-date on the latest industry news and information, the American Angus Association® this week launched the Angus Talk podcast. The program is hosted by Doug Medlock, the voice of I Am Angus, and features timely discussion surrounding topics in the cattle business. “Talk radio programs are still a valuable source of information for many in agriculture,” says Eric Grant, Association director of communications and public relations. “Ten years ago it was on the radio in the tractor cab, now it’s on a smartphone.” A new Angus Talk show is released twice a month and can be accessed through iTunes on a computer, smartphone or tablet. The premiere episode features Larry Corah, vice president of supply development with Certified Angus Beef LLC. Corah shared with Medlock the economic advantages of reliable, predictable Angus cattle, and what that means for the cattlemen moving forward in the next 5-10 years. “Our goal with Angus Talk is to provide both informative and entertaining discussion as it relates to our industry,” Grant says. “Programs that people can take with them wherever they are – in the pasture, in the truck, or at a computer.” To subscribe to the free podcast, search Angus Talk in the iTunes Store. Episodes are also available on www.angus.org.

Light at the End

Survive nine months of bad news, better days follow for feeders by Miranda Reiman Don’t expect corn values to get dramatically lower…. this year. Feeding Quality Forum attendees were probably not surprised to hear Dan Basse, Ag Resource Company, say that pricing inputs would be their top challenge in the last quarter of 2012. But the fact that those costs could normalize in the latter part of next year surely piqued their interest. The market analyst addressed feeders, allied industry and educators at the seventh annual meetings held in Grand Island, Neb., and Amarillo, Texas, last month. “There aren’t too many years in my career that I’ve talked about surety of supply,” Basse said. “I want all of you to not only think of the cost of feed, but making sure you that you have it.” He expects the U.S. corn crop to drop substantially from USDA’s estimates, which have not reflected any reduction in harvested acres. Ag Resource puts the average corn yield at the lower range of industry estimates, but their numbers are based on actual field research. If the average falls to 113 bushels per acre, it would move corn prices to above $11 per bushel. That average is around 28% to 30% below trend, Basse said, also noting that ending stocks will be tight. “I can’t show deficit stocks,” he said. “Someone has to go without. What is that last residual bushel of corn worth? I don’t know. I don’t know how high is high.” Corn stocks will likely settle around 650 million to 700 million bushels. They’ve only been that low about 3% of the time since 1973. “Historically, this is unprecedented,” Basse said. That doesn’t necessarily mean the beef business will have to deal with back-to-back record corn-price years.

8 illinoisnews@bingmanpub.com ~ NOVEMBER 2012

Regardless of the status of the renewable fuels mandate, Basse says the “ethanol monster” is not the factor it has been the past five years. “He’s not dead, but he is at least in hibernation. Ethanol has reached its zenith,” Basse said. More efficient cars and driving fewer miles, along with the lower ethanol exports, make that a reality. “This will be the first year since 2005 in which the world per-capita grain use will decline,” he said. “That’s why this year was looking promising until Mother Nature dealt us this big blow in terms of heat and dryness.” Digging into historical data, there have never been two consecutive years of widespread drought in the central U.S. “Even in the 1930s, we had drought in 1934 and 1936, but in 1935 we had average rainfall,” Basse said. “So if I’m in the cattle feeding business, I’m very hopeful that next year’s weather will be normal.” If farmers ratchet up corn acres to 98.5 million and get an average yield of 160 bushels per acre next year, that puts corn in the $4.50 to $5.00 per-bushel range. “Won’t that be nice?” he asked. “But that’s three or four quarters away.” To add to the immediate stress, hay production is forecast at 120 million metric tons, or the lowest level since 1976. The poor corn crop may provide one saving grace: “The only good news for you is that this is really bad quality corn. There might be some nice discounts offered relative to poor quality.” Low test weights and aflatoxin issues are some of the widespread concerns.

Herd liquidation is another factor as feeders look to source calves, but Basse says crop insurance might help. Some Midwestern farmers are looking to chop poorquality corn and invest their payout in cows. “What does that mean for the cowherd in the United States? I’m not quite certain, but I do believe it will allow it be more withstanding than I’ve seen in other drought years,” he said. As the domestic population ages, beef demand is down slightly, but the worldwide trend contradicts that. “When I look at consumption, it is still moving up, so the story of being a livestock producer is still relatively bullish longer term,” Basse said. “We’re also finding from our overseas customers that importing beef is less costly than importing the grain itself.” That bodes well for trade. Individual balance sheets are based not only on costs and inputs, but on getting the highest possible revenue. Supporting a branded program is one option: “That’s good for the farmer, and everybody up and down the chain gets the most value,” Basse said. “It helps everyone, including the consumer because he knows he’s getting a high-quality product, so I’m big on branding, going forward.” Another thing he’s big on? Foresight. “I want every cattleman to think forward, at least for three quarters, and then we can plan for the good times which will probably happen nine months from now.” The forum was co-sponsored by Purina Land O’ Lakes, Certified Angus Beef LLC (CAB), Feedlot Magazine and Pfizer Animal Health. Watch for more information in the weeks ahead at www.CABpartners.com.

The Powers of the IRS Commissioner By John Alan Cohan, Attorney at Law

The President has substantial power to implement policy within the IRS, and the IRS is the enforcer of tax laws. The IRS Commissioner is appointed by the President, with the consent of the Senate, for a five-year term. The Commissioner administers, manages, enforces, and supervises the application of IRS laws and related statutes. The term of the present IRS Commissioner, Douglas Schulman, expires in November, and a new appointee will be named by the President, subject to Senate confirmation. Section 183 of the IRS Code pertains to activities “not engaged in for profit.” This provision is used to disallow deductions for all farming-ranching activities as well as other ventures ranging from multi-level marketing to air charters. How this provision is applied and interpreted is something that the IRS Commissioner can and does influence. Many people do not make a profit in their farming ventures --and the IRS is well aware of this fact. For most farmers and ranchers, the activity is not the taxpayers’ primary occupation. One Tax Court case said that it would be “foolish” for a taxpayer to give up other employment until he was sure he could support himself with the proceeds from farming or livestock. The IRS is particularly interested in how you keep books and records of the activity. One case described the importance of proper books and records this way: “The purpose of maintaining books and records is more than to memorialize for tax purposes the existence of the subject transactions; it is to facilitate a means of

periodically determining profitability and analyzing expenses such that proper cost saving measures might be implemented in a timely and efficient manner.” It is important is to keep hard copies of all evidence that shows your manner of keeping records and that might reflect your business motives. For example, keep originals of magazine advertisement (including the entire magazines in which they appear). If you update written business plans, it is important to retain the earlier versions (all of which should be dated) rather than superseding them in a computer generated update. With respect to payment to vendors, you should always insist on obtaining invoices from vendors, and keep them as part of your permanent records. The IRS has a reputation for indifferent customer service, long wait times on calls, and abuse towards taxpayers who are supposed to be served. In situations where taxpayers have a history of losses, revenue agents tend to view business records of such taxpayers with heightened scrutiny. The recent trend in audits has been to regard livestock activities as hobbies. A document relied on by auditors, referred to as the Market Segment Specialization Audit Technique Program Guide (“MSSP”), encourages auditors to presume that taxpayers in the livestock and horse industries are motivated by personal pleasure and recreation. The document, which the IRS Commissioner could amend, directs auditors to inquire about business plans: “The taxpayer should have a formal written plan. This plan should demonstrate the

taxpayer’s financial and economic forecast for the activity. The plan should show a short range and long range forecast for the activity. The forecast should allow for changes due to potential unforeseen and fortuitous circumstances.” Auditors are asked to be on alert for “canned” business plan documents. Revenue agents are also advised to challenge the taxpayer’s “material participation” in the activity. Under this legal test, you are permitted to deduct losses relating to a ranching venture against your other income only if, among other things, you “materially participate” in the activity. This is often a difficult standard to meet if managers are hired to attend to important details of ranch management. Audits are the “lifeblood” of collecting additional revenue for the U.S. Treasury, but IRS philosophy has, for many years, made it difficult for taxpayers to defend themselves. In the event you are audited by the IRS you should seek legal advice at the earliest stage and work with legal counsel and your accountant to convince the IRS of your intentions. Audits are always a difficult experience for taxpayers. Changes in IRS policy depend on who the next IRS Commissioner will be, and that will depend who the next President will be. John Alan Cohan is a lawyer who has served the livestock, horse and farming industries since 1981. He serves clients in all 50 states, and can be reached by telephone at (310) 278-0203 or via e-mail at johnalancohan@aol.com. His website is: www. JohnAlanCohan.com.

Angus Foundation Launches New Website

The newly designed website includes more multimedia features while showcasing how the Angus Foundation uses funds to support youth, education and research. Donors who financially support the Angus Foundation make dreams a reality for many who have interest in the Angus breed. The Angus Foundation is excited to announce that many of these donors, along with those who have benefited from Angus Foundation support, are the focus of the Angus Foundation’s newly designed website officially launched on Sept. 24, 2012. The new website features a fresh look and more multimedia presence, which includes stories, photos and videos that show how the Angus Foundation is using funds to support youth in their ambitions to attend college, purebred Angus and commercial breeders with educational opportunities, and research for the betterment of Angus cattle. In addition to allowing for more stories about donors at all giving levels and the youth, education, and research programs they support, the new website’s home page also features current projects and different ways to contribute to the Angus Foundation. “Enhancement of the Angus Foundation’s website with additional visual features, ease of navigation and overall increased user-friendliness will further heighten the educational value and experience for our visitors to the website,” says Milford Jenkins, Angus Foundation president. “This communications platform enables us to inform our supporters of the impact their gifts are making in the lives of our Angus youth, adult members, and will provide up-to-date information on the many research initiatives funded by our organization for the benefit of the Angus breed.” Log on to www.angusfoundation.org to view the new website. Once on the home page, visitors who have used the former website will notice that the location of much of the content and navigation is very similar, so it is not hard to find information.
