y now, you’ve certainly heard about the hidden, painted rock craze making it’s way through Pensacola—perhaps you’ve even found or created a masterpiece yourself. The local trend started roughly nine months ago, when Susan Žampachová started a Facebook group called Pensacola Rocks. The name isn’t referring to rock music or how amazing the city of Pensacola is– but is a reference to actual small, palm-sized painted rocks, which are hidden, found and traded throughout town. “My daughter, Mary Burris, moved from Pensacola to Vancouver, Washington,” Žampachová said. “She discovered a group there called ‘Vancouver Rocks’ and told me all about it.” The popular Vancouver group has over 35,000 members who paint ordinary, pocket-sized rocks, only to hide them in specific locations around town and wait for someone to find the rock. Group members share pictures of the found and newly hidden rocks in the online Facebook group forum, and give clues to where their next painted rocks will be stashed. It’s sort of a scavenger hunt with online clues and friends to offer tips or hints. Žampachová’s daughter added her to the group, and she found herself enjoying the frequent pictures of the lost and found rocks, along with the sense of community, happiness and social exchange between members. “I told my daughter, ‘I wish we had something like that here,” Žampachová said. “’She said, Mom, you should

start a group of your own— and I did!” She got on Facebook and quickly created the public group, Pensacola Rocks. Žampachová went through her entire friends list, adding everyone local to the group, which amounted to about 250 people. The Facebook page explains the group as a way to spread joy and brighten people’s day throughout Escambia County. The group, billed as a communitybuilding effort, is meant to inspire creativity in all ages and energize people to explore beautiful Pensacola. Other rock groups have popped up all across the country, and stem from a similar project that began in England several years ago, called the Kindness Rock Project. Some friends didn’t understand the group, or asked why they’d been added, but Žampachová was quick to explain the concept and to ask everyone to add their friends. The concept originated in Cape Cod, Massachusetts as part of something called “The Kindness Rocks Project,” which was started by a woman named Megan Murphy. On thekindnessrocksproject.

com, Murphy shares a testimonial and said after losing her parents at a very young age, she would often walk along the shore in Cape Cod, looking for special signs of encouragement or inspiration- perhaps a heart shaped rock or a special piece of sea glass. She wondered if maybe she wasn’t the only one who was looking for little “signs,” along her walks. She began painting and hiding rocks, which included her email address on the back. She began receiving messages from people who were filled with joy upon finding her rock. Murphy decided to step up her mission and created a social media page for the project, and asked the public to join her. An overwhelming number of people showed interest in the project and have taken it upon themselves to spread the joy and inspiration to dozens of cities around the world—including the recent arrival in Pensacola. Meanwhile, as the local Facebook group slowly began to catch on, Žampachová was painting rocks to hide. Then, several weeks after the group was created, a woman named Cyndi Goforth came along and offered to help create some excitement around the group. “Goforth found our

group and was so excited,” Žampachová said. “She had already been involved in the Lakeland Rocks Group. We got together and she showed me how to really get it going. We painted more and more rocks, and then placed them downtown.” The group began to gain traction, and by April, WEAR featured a short clip on the new group. The group had 1,000 members at the time of the WEAR clip and is now nearing close to 26,000 members. Every day, hundreds of people continue to upload pictures of their colorful hidden or recently found rocks to the group—many painted like flowers, animals, cards, celebrities, famous pieces of artwork, sports teams, simply featuring a single word, like “love,” or “joy.” “It’s amazing how quickly it’s picked up!” Žampachová said. “I don’t have much time lately to paint, due to work and school, but I do host painting parties once a month or so.” She hasn’t found more than a few rocks, because she prefers the painting and hiding side of things. Sometimes she even paints a group of rocks, and gives them to other members to hide on their own. Many group members prefer to hunt down the

painted pebbles instead of decorating one themselves, so the painting-and-hiding to finding ratio has aligned to find a happy middle ground. There are always enough rocks to go around, and more are being painted and hidden every day. “We all play a part in the whole scheme of things,” Žampachová said. “Anyone can join. They can paint, hide or hunt for them, however you choose.” Another fun element of the group is the social media side. After painting or finding a rock, many members upload a picture of the rock to the group, letting other members know if one was found and where they’re miniature masterpiece has ended up. Many members also offer hints to wear their latest pieces might be hiding. Žampachová often hosts painting parties for the group in local parks or cafes and encourages anyone who’s interested to come out, grab a rock and paintbrush, and join in on the fun. The musical comedy’s setting is 1922 when small-town Millie Dillmount comes to New York City to marry for money instead of love. She delights in the flapper lifestyle until problems arise and hilarious chaos takes over. The original production opened on Broadway in 2002 and subsequently won six Tony Awards, including Best Musical. Local Teens Selected to Play in Official PGA TOUR Champions Event The First Tee of Northwest Florida is sending Ty Aulger and Nicholas Dimitroff to compete in the 2017 PURE Insurance Championship, an official PGA TOUR Champions event to be contested at Pebble Beach Golf Links and Poppy Hills Golf Course in Pebble Beach, Calif., the week of September 19-24, 2017. The tournament, which is hosted by the Monterey Peninsula Foundation, will be televised internationally on Golf Channel. After the 2016 tournament, the PGA TOUR and Privilege Underwriters Reciprocal Exchange (PURE) Insurance announced an agreement making the policyholder-owned property & casualty insurer for high net worth families the title sponsor of the longstanding event, which dates back to 2004. “We have been anticipating this day since PURE was announced as title sponsor of this prestigious event,” said Ross Buchmueller, President & CEO of the PURE Group of Insurance Companies. “This tournament has the ability to impact the lives of youth throughout The First Tee, and we are thrilled to serve an integral part in the PGA TOUR’s mission of creating a strong community footprint while also helping to grow this great game.” Aulger & Dimitroff will join 80 other participants from The First Tee chapters, selected by a national panel of judges. Brownsville North Neighborhood Cleanup Scheduled for July 19 Residents in the Brownsville area will have the opportunity to dispose of yard debris and other items free of charge Wednesday, July 19 during the Brownsville North Neighborhood Cleanup in District 3. Only residents in the designated cleanup area are able to participate in the neighborhood cleanup. Items left at the curb outside of the cleanup area will not be collected. The general cleanup area is south of West Fairfield Drive and West Avery Street, north of Mobile Highway and West Cervantes Street, west of North Pace Boulevard and east of New Warrington Spur. Please see the cleanup map for details. The cleanup allows residents to leave items at the curb to be disposed of by Escambia County and partnering agencies, as part of the county’s ongoing effort to help keep local neighborhoods and communities clean and safe. All debris must be at the curb directly in front of your residence by 7 a.m. on the day of the cleanup. Please keep tires and paint cans separate from all other debris. Do not place piles

under low-hanging lines or near poles, fences or mailboxes. Items eligible for removal include: Household appliances and electronics Yard waste Household junk and debris Bicycles and toys Old furniture and mattresses Barbecue grills Household hazardous waste (old paint, motor oil, chemicals, batteries) Tires (limit 20 per household) Items NOT eligible for removal include: Building materials (concrete, bricks, blocks, roofing, drywall or more than one cubic yard of lumber) Explosives or ammunition Auto parts Dirt or sod Vehicles or vessels 55-gallon drums of fluids The neighborhood cleanup initiative involves an aggressive clean-up effort, targeting different neighborhoods throughout the county, with crew members and volunteers picking up a variety of debris and waste, including electronics, furniture and

household items. In the past two years, more than 1,200 tons (2,473,000 pounds) of debris were collected and disposed of through the Community Redevelopment Agency’s Safe Neighborhood Program. The county’s neighborhood cleanup program is hosted by the Escambia County Community Redevelopment Agency’s Safe Neighborhood Program and Escambia County Waste Services. Local partners include Escambia County Environmental Code Enforcement, the Escambia County Road Prison, the City of Pensacola Sanitation Department and Keep Pensacola Beautiful. Senior Chill Out breaks donation records for fans, AC units and monetary contributions Senior Chill Out, a one-day donation drive to acquire new air conditioners, fans or funds to assist seniors with heat-related issues, was held this past Friday, June 30, 2017, in partnership with WEAR ABC 3, Cat Country 98.7, NewsRadio 1620, Magic 106.1 FM, and Lowe’s Home Improvement. At day’s end, the Pensacola, Gulf Breeze and Pace communities helped Council on Aging shatter nearly 10 years of Senior Chill Out records by donating 320 fans, 218 AC units and approximately $9,200, beating last year’s numbers of 180 fans, 200 AC units and $8,000. From 6 am to 6 pm, Council on Aging staff, volunteers, board members and business leaders gave their time at five area Lowe’s locations to raise awareness of the challenges many elders face during Florida’s summer heat. According to the Centers for Disease Control and Prevention, more people die from heat waves each year than from hurricanes, lightning, tornadoes, floods and earthquakes combined. The elderly are particularly vulnerable to being adversely affected by excessive heat due to slower adjustment of the body to changes in temperature, increased risks associated with other medical conditions and prescription medicines that can impair the ability

to regulate temperature or inhibit perspiration. “Northwest Florida’s generosity simply cannot be matched,” said John Clark, President/CEO of Council on Aging. “Every year, there is a new challenge. Every year, there are more people who desperately need our help, and every year, Escambia and Santa Rosa county residents and businesses answer the call. We are humbled and grateful. I thank you and seniors who would otherwise have no respite from the heat thank you.” Council on Aging of West Florida would like to especially thank all of our media partners, as well as Barberi Heating & Air, Casey’s Hot Dogs, Krewe de Karnaval, Sue Hand, TLC Caregivers, Pete and Angela Moore, Home Instead Senior Care, Bob Solarski, Sue Straughn, Candy Cullerton, Linda Moorer and all the volunteers who made this day a success. Florida likely has a new richest lawmaker as the part-time Legislature prepares to return in September for committee meetings in advance of the 2018 session. With a 22.3 percent jump in his net worth to $32.8 million, Republican Rep. Ralph Massullo, a Lecanto dermatologist, has surpassed Sen. George Gainer in wealth, according to newly filed reports with the state Commission on Ethics. Gainer, a Panama City Republican who owns car dealerships across Northwest Florida, saw his net worth grow by 12.6 percent to $31.46 million. Annual financial disclosure reports were due July 3, though the state gives a grace period for filing. About one-fifth of lawmakers --- including House Education Chairman Michael Bileca, R-Miami, House Ways & Means Chairman Jim Boyd, R-Bradenton, and Senate Communications, Energy & Public Utilities Chairwoman Kelli Stargel, R-Lakeland --- had not submitted their paperwork as of Monday morning. The trend among the filed reports shows a majority

of the 158 House and Senate members have seen upticks in their wealth over the past year. Two seats are currently vacant. Of the reports that are in, 101 lawmakers posted increases in wealth, while 22 showed decreases, including House Speaker Richard Corcoran, R-Land O’ Lakes. Corcoran reported his net worth fell 27 percent --- it totaled $341,750, as of Dec. 31, 2016, down from $470,640 a year earlier. Corcoran, who became speaker in November, said last week he refinanced a home loan. Most of the newly filed reports reflect the net worths of lawmakers as of the end of 2016. Lawmakers do not face a penalty for missing the July 3 filing deadline. They can delay submitting the paperwork until Sept. 1 before fines of $25 a day kick in. The fines are capped at $1,500. Reports filed last year showed that lawmakers, who get paid just under $30,000 by the state, had an average net worth of $2.14 million. Paperwork submitted so far this year shows at least 45 members are millionaires. Another nine members --- among the 35 with outstanding reports --- were worth more than $1.5

million in last year’s filings, including Michael Bileca, the co-founder of Towncare Dental Partnership, who posted a net worth of $18.4 million. A year ago, 12 members from the two chambers reported being underwater in their finances, with Rep. Danny Burgess the deepest in the hole at a negative $253,100 due to heavy student loans. So far, eight lawmakers, including Burgess, have posted they’re in the red. Burgess, R-Zephyrhills is worth a negative $247,002 in his new filing. Rep. Kionne McGhee, D-Miami, improved from a negative $27,500 in last year’s filing to a positive $72,000. McGhee, like Burgess, is an attorney with student loan debt. Also, Wengay Newton, a St. Petersburg Democrat and professional photographer, reported his net worth has improved from a negative $17,473 to a positive $24,445. Meanwhile, Rep. Carlos Guillermo Smith, D-Orlando, is the only lawmaker who has reported going into the red. Smith posted a net worth of $8,432 when he ran for office last year, but it fell to a negative $2,346 in the latest report.

Payments to the matching funds stopped, something that the legal challenge doesn’t contest. But after the state again began running surpluses, lawyers for the alumni argue, the state should have resumed making the payments to the matching funds. Instead, the Legislature has continued to omit the funding. “The state of Florida made a promise --- a promise codified in Florida law and further reinforced in promises made to donors --- and, there is no other way to put this, but the state reneged on that promise,” said Grace

MORGAN CHALLENGES MEDICAL MARIJUANA SMOKING BAN By DARA KAM THE NEWS SERVICE OF FLORIDA

Saying Floridians knew what they were voting on in November, Orlando trial lawyer John Morgan on Thursday followed through on threats to sue the state over a smoking ban included in a new law carrying out a constitutional amendment that broadly legalized medical marijuana. Morgan, who largely bankrolled the medicalmarijuana ballot initiative, had repeatedly threatened to launch a legal challenge over smoking, which he maintains was permitted in the amendment supported by more than 71 percent of Florida voters last fall. Even so, lawmakers banned smoking of marijuana --- but allowed patients to vaporize, or “vape,” pot products --- in a bill approved during a special session last month. Gov. Rick Scott signed the bill, which went into effect last week. “The people of Florida knew exactly what they were voting on, when they voted. When they were voting on it, the vast majority, if not 100 percent, knew that smoke was included. The fact that we are here today is really unnecessary, but here we go,” Morgan told reporters Thursday morning outside the Leon County Courthouse. In the lawsuit filed in Leon County circuit court, Morgan accused a number of state officials, including Department of Health Secretary Celeste Philip, of “deprivation of rights and privileges” by prohibiting patients eligible for the treatment from smoking marijuana products. Morgan said he intends to add as plaintiffs to the lawsuit patients who smoke marijuana as a treatment for their illnesses. Some patients insist that smoking marijuana, rather than ingesting pot by other

methods, alone provides relief for their conditions. In defending the ban on smoking pot products, legislative leaders maintained that, as is the case of cigarettes, smoking marijuana is bad for patients’ health, and that medicinal dosages can’t be controlled when the product is smoked. But Morgan, in the lawsuit, argued there is no research indicating that smoking marijuana contributes to lung illnesses. “In fact, marijuana was shown to increase lung capacity,” Morgan argued. By banning smoking, Florida lawmakers put themselves in the place of doctors, who, under the amendment, are responsible for deciding patients’ course of treatment, Morgan maintained in the lawsuit. The constitutional amendment bans smoking of marijuana in public places --- language Morgan insists permits smoking on private property. The sharp-tongued Morgan, who regularly uses expletives when speaking with reporters, said the interpretation of the law “is as clear … as it would be to any first-grader.” He compared the language in the amendment to rules regarding the use of hotel swimming pools, where signs that prohibit pool use at certain times mean that swimming is permitted during the hours in which the activity isn’t banned. But House Majority Leader Ray Rodrigues, an Estero Republican who sponsored the legislation and insisted on the smoking ban, defended lawmakers’ actions, saying he was certain courts would uphold the law. Rodrigues said other states that permit smoking of medical marijuana made it clear in the proposals that went before voters.

“If you look at those other states, their constitutional amendments declared that it could be smoked and that it could be self-grown. If that’s what John Morgan wanted for Florida, he should have declared it in the amendment,” Rodrigues told The News Service of Florida on Thursday. Florida law-enforcement officials, including sheriffs and police chiefs, encouraged the ban on smoking, saying an outright ban on “whole flower,” or what is more commonly known as “bud,” would make it easier to identify people who are breaking the law. The issue is also rooted in a debate about whether smoking opens the door for recreational marijuana users, something Morgan rejected Thursday. He accused Florida lawmakers of laying the groundwork for a recreational marijuana initiative in the near future. He said such an initiative would be pushed by advocates unhappy with the way the medical marijuana amendment was implemented, as has happened in some other states. “They (the Legislature) have kicked the door wide open for recreational use of marijuana,” Morgan said. “They thought that this was their way of stopping people from backdooring the recreational use of marijuana. All they did, in the process, was to hurt the patients who need it the most.” But Rodrigues said he “absolutely” disagreed with Morgan’s assessment. States that have authorized recreational marijuana have three things in common, according to Rodrigues: smoking, self-growth and a large gray market for marijuana. “We have implemented a system that does none of those things,” he said.

With Democrats and some Republicans increasing calls this week to fully reject a federal commission’s request for voter information, Florida Secretary of State Ken Detzner announced Thursday that the state will only provide publicly available data. “Driver’s license information and Social Security numbers are not, and cannot be provided,” Detzner wrote to Kansas Secretary of State Kris Kobach, who is vice chairman of the Presidential Advisory Commission on Election Integrity. “We will also not release any information that is exempt or confidential under Florida law, including certain information regarding law enforcement officers, judges, prosecutors, and victims of stalking and domestic violence.” Information such as voters’ names,

already available under Florida’s public-records law and will be provided to the commission. Detzner added that a state voter database doesn’t include information about people’s felony convictions, another part of the request. Florida joined at least 44 other states and the District of Columbia in refusing to provide certain information to the commission, which was created to look into election fraud. State Senate Minority Leader Oscar Braynon, D-Miami Gardens, said he wasn’t surprised by Detzner’s decision, as “the law kind of stopped them.” But Braynon said he remains wary about the overall motive of the commission, which he believes may be directed toward future “voter suppression.” “What are they really trying to do here? What is the end game?” Braynon

asked. The request has become highly controversial in Florida and throughout the country. Most other states had quickly responded to the federal commission’s June 28 request, while officials in Florida, where Gov. Rick Scott has close ties with President Donald Trump, gave little indication about how they would respond. Given an opening, Democrats pounced through letters and comments on social media. The Florida Democratic Party, Democratic lawmakers and the three Democratic candidates for governor --- Tallahassee Mayor Andrew Gillum, former Congresswoman Gwen Graham and Winter Park businessman Chris King --- all voiced opposition to the commission and its perceived intent. The initial backlash from other state governments, including governments

run by Republicans and Democrats, drew a Twitter rebuke from Trump. “Numerous states are refusing to give information to the very distinguished VOTER FRAUD PANEL. What are they trying to hide?” Trump tweeted on Saturday. Detzner and county elections supervisors have had to respond to media questions for months about Trump’s claims of voter fraud in the 2016 general election. In his letter to Kobach, Detzner noted the importance of preserving the democratic process and the state’s responsibility in ensuring an accurate and fair election. “In fact, in 2016, we are proud that Florida had record turnout and a smooth, secure election which reflected the will of the people of Florida,” Detzner said.

SUPREME COURT UPHOLDS INDIGENT CARE LAW By JIM SAUNDERS THE NEWS SERVICE OF FLORIDA

In a case that could involve hundreds of millions of dollars, the Florida Supreme Court on Thursday upheld a state law that directed Sarasota County to reimburse private hospitals for providing care to indigent patients. Justices, in a 5-2 decision, overturned an appealscourt ruling that said part of the 2003 law was unconstitutional because it singled out private hospitals in Sarasota County. The 2003 measure was passed as what is known as a “special law,” dealing only with Sarasota County, rather than a general law that would apply to hospitals throughout the state. The Florida Constitution bars special laws that pertain to “private incorporation or grant of privilege to a private corporation.” But in Thursday’s majority opinion, Supreme Court Justice Ricky Polston agreed with arguments by private hospitals that the 2003 law did not violate the Constitution because it also applied to reimbursements to a Sarasota County public hospital district. “The private hospitals argue that the indigent care provision of the special law at issue here does not grant a privilege to a private corporation in violation of (the Constitution) because it applies equally to all hospitals in Sarasota County, whether public or private. We agree,” wrote Polston, who was joined in the majority by Chief Justice Jorge Labarga and

justices R. Fred Lewis, Peggy Quince and Charles Canady. But Justice Alan Lawson, in a dissent joined by Justice Barbara Pariente, described the majority opinion as a “judicial rewrite of this constitutional provision.” “(With) a local law like the one at issue here, legislators from other parts of the state could force the citizens of a single county to bear a significant financial burden flowing to a few private corporations in their county even if their local representatives voted against the measure and even if the electorate never had an opportunity to ratify the action by a local vote, as happened here,” Lawson wrote. “That, to me, seems like the most troublesome type of special law privilege because it could be enacted entirely by legislators not accountable to the local citizens on whom they placed the burden of financing the corporate privilege. Unfortunately, the (court) majority has now written the protection against granting a corporate privilege by local law out of our Constitution.” In a Supreme Court brief filed in April 2016, Sarasota County attorneys said private hospitals “demand hundreds of millions of dollars of payments” under the law. The brief said private hospitals began submitting reimbursement requests in November 2008 and that, at the time of a hearing in circuit court, the requests totaled about $200

million. In the brief, Sarasota County contended that the 2003 special law “constitutes a privilege” to the private hospitals. “The proper test for privilege is not to compare private hospitals in Sarasota County to the public hospital,” the county’s brief said. “Under Florida law, the correct test is to compare the private hospitals in Sarasota County to other private hospitals in the state. The private hospitals have cited no law mandating such payments statewide to private hospitals.” But attorneys for the private Sarasota Doctors Hospital, Inc., Englewood Community Hospital Inc., and the former Venice Regional Medical Center, now known as Venice Regional Bayfront Health, disputed such arguments as they asked the Supreme Court to overturn a 2015 ruling by the 2nd District Court of Appeal. “The reimbursement provision is a legislative decision to require payment to any hospital in Sarasota County to promote unfettered access to hospital services,” a Venice Regional brief said. “It is not the role of the court to question the wisdom of this policy. Further, this legislative policy serves a paramount public purpose that supersedes any incidental benefit received by private hospitals under this special law.”

Gov. Rick Scott and the Seminole Tribe have reached an agreement about the tribe’s “exclusive” rights to offer banked card games such as blackjack, in a move that took the Legislature by surprise. The settlement agreement, submitted to a federal judge on Wednesday, focuses on a portion of a 20year gambling deal, called a “compact,” that expired in 2015. That portion of the deal involves banked card games. Under the deal, approved in 2010, the tribe guaranteed $1 billion in payments to the state for the exclusive rights to offer the banked card games for five years. The tribe sued the state when the agreement expired, accusing state gambling officials of breaching the compact by allowing what are known as “designated player” card games at horse and dog tracks and jai alai frontons. A federal judge last fall sided with the Seminoles, saying the designated player games violated state law that prohibits pari-mutuels from conducting banked card games. But the Seminoles continued to make payments to the state, and continued to conduct banked card games, even after state lawmakers failed to strike a

new deal with the tribe during this year’s legislative session that ended in May. In the agreement released Wednesday, the state agreed to drop its appeal of the federal court decision and to take “aggressive enforcement action” against pari-mutuels operating banked card games that violate state law. The deal also frees up at least $200 million in payments to the state, something state leaders --including Scott --- are eager to tap into as Florida’s economic outlook worsens. Even so, Scott’s settlement with the Seminoles took legislative leaders by surprise, especially after they played key roles in negotiations with the tribe over the past two years. “At first blush, I’m not sure that the stipulated settlement agreement does anything more than make it more difficult for us going forward to negotiate gaming with the Seminole Tribe,” said Sen. Bill Galvano, a Bradenton Republican who’s been in charge of gambling negotiations and who is slated to take over as president of the Senate after next year’s elections. “It’s almost as if we’re guaranteeing for the tribe that the status quo will continue for the balance of the compact.” Miami Republican Jose Felix Diaz, who shepherded negotiations on behalf of the state House before leaving the chamber to run in a

special election for the Senate, was also unaware of the settlement agreement struck by Scott when contacted Wednesday evening by The News Service of Florida. “At all times during the past three years, the House and Senate have worked in concert with the governor’s office to come up with a plan that made sense for the state,” Diaz said. “To the best of my knowledge, no legislators were consulted on this specific agreement. I am still reviewing the details of the settlement.” Despite its seemingly harsh language, the settlement agreement likely won’t have any impact on the games currently being conducted by many of the state’s pari-mutuel facilities, according to lawyer John Lockwood, who represents numerous gambling facilities. “We are in compliance with state law,” Lockwood said in a telephone interview Wednesday. The Seminoles hailed the latest deal in a statement issued by spokesman Gary Bitner. “The settlement agreement ensures a stable future for the members and employees of the Seminole Tribe of Florida, and the Tribe appreciates the hard work of Gov. Scott and DBPR (the Department of Business and Professional Regulation) to get it done,” Bitner said.
