orthwest Florida is a haven for history buffs, especially those with a passion for maritime history. Hundreds of years ago, schooners, brigs and barques used to fill the harbors of Pensacola and Mobile Bays, but these ‘tall ships’ appeared less and less as our technology progressed. However, our harbors will be full of cloth sails once again as Tall Ships Challenge Gulf Coast lands at Pensacola in April of 2018. Taking place from April 12-16, 2018, Tall Ships Challenge Gulf Coast 2018 is part of the Tall Ships Challenge series—a series of races and port festivals held every year to honor America’s long maritime history. Normally taking place on the Great Lakes, Atlantic and Pacific, this will be the first time the event will take place along the Gulf Coast. “We are excited to expand the Tall Ships Challenge and its adjoining festivals and events to the Gulf Coast for the very first time,” Tall Ships Challenge Manager Erin Short said. “Pen-

sacola has a rich history and bringing the tall ships here makes sense. The fleet hasn’t been to Pensacola before, so this is a whole new festival for the city and ships to get excited about.” Tall ships generally refer to any large, traditionally rigged sailing vessel. These include sloops, ketches, yawls, schooners, barques, brigs and brigantines. The term itself dates back to the 19th century, first written by author and mariner Joseph Conrad. Tall Ships America, the organization behind the event, has roughly 120 different Tall Ships as registered vessels in their fleets. The event will kick off with the Parade of Sails on April 12. Visitors will have a chance to watch the ships parade around Pensacola Bay before docking for the weekend’s countless festivities. Pensacola has a long naval relationship, perhaps most famously with the wreckage of six of Tristan De Luna’s ships still present at the bottom of

Pensacola Bay. In the 1930s, the port saw famous ships like the USS Constitution, and in 2015 received a visit from the ship Juan Sebastian de Elcano, a training ship for the Spanish Royal Navy. For the Tall Ships Challenge, Pensacola will be receiving a small fleet of tall ships for a change. The flagship of this fleet will be the Elissa, which stands over 260’ feet tall and was first launched in 1877. The Elissa has actually been to Pensacola long ago, having made the voyage here from Galveston, Texas in 1886. Others include the Oosterschelde – built in 1917 in the Netherlands – the Picton Castle – built in 1928 in the Cook Islands – and the Oliver Hazard Perry – built in 2015 in the United States. There are also two other sail away ships: the When and If – built in 1939 in the United States and commissioned by the famous General Patton – and the Lynx – built in 2001 in the United States. The ships will initially launch from Galveston, Texas, and make their way to Pensacola, New Orleans and finally St. Petersburg. “There will be six to seven tall ships, which you’ll be able to take day tours of, and nighttime and VIP events will also be held on board the vessels,” said Curt Morse, executive director of the Downtown Improvement Board. There will also be Kids Crew Activities presented by the Margaritaville Beach Hotel and Holiday Inn Resort Pensacola Beach as an op-

portunity to get children interested in the history of these old vessels. Tall Ships America was originally founded in 1973 as a non-profit organization dedicated to enriching youth education through character building and leadership programs aboard their tall ships. Short said the Tall Ships events provide an opportunity for people to go on the ships, speak with their crews, and actually touch history. Visit Pensacola, the primary sponsors of the event, expects to attract 20,000 to 30,000 attendees from both Pensacola and the surrounding areas. Over the 15 years the Tall Ships Challenge series has taken place, it has been estimated to have brought a combined $1.9 billion in economic impact to its host areas. In addition to the ships activities, Plaza de Luna will be filled with entertainment, food and vending booths to make the three-day festival even more. “These festivals are a way to bring people downtown, showcase the waterfront to the visiting public and engage the community,” said Short. Tall Ships Challenge Gulf Coast 2018 will be held from April 12-15 at the Port of Pensacola. Daily general admission is $12, a weekend pass is $30, and various VIP packages are available. UWF 2018 Job Shadow Week provides students hands-on experience

Last week, March 26-30, University of West Florida students participated in the 2018 Job Shadow Week. A record 53 students participated, with career interests spanning a variety of industries including hospitality, marketing, environmental science, finance and accounting, business, health care, government and more. The UWF Office of Career Development and Community Engagement, UWF Center for Entrepreneurship, UWF Student Government Association and Studer Community Institute partnered to host the week. Lauren Loeffler, executive director of career development and community engagement, said the increased interest and participation from both community partners and students in this year’s job shadow week helps solidify the University’s commitment to community engagement and allows students to see how their coursework translates to the workforce. “Job shadowing is an excellent way for students to observe a day in the life of their chosen career or industry,” Loeffler said. “Research also suggests that experiences like job shadowing help students crystallize career goals which in turn aids in academic progression and higher graduation rates.” Students were given the opportunity to choose a professional to shadow for a day from participating businesses in the region to experience a typical day in the industry, network with professionals and gain hands-on experience in a field of interest. Colton Currier, senior marketing major, shadowed Liz Pelt, senior account

manager and digital media lead at Appleyard Agency. Appleyard Agency is a full-service marketing and advertising agency, recognized as an industry leader in the Northwest Florida region. “I attended meetings with a few of Appleyard’s major clients, allowing me to gain an inside view of what a job in the marketing field entails and meet other professionals in the area,” Currier said. “I am very grateful for the experience I have gained from this opportunity and to Liz for being such a great mentor.” Pelt said she learned of the opportunity from Quint Studer, founder and CEO of Studer Community Institute, and wanted to give students an opportunity to see the inner workings of an advertising agency. “Colton was able to see how we work with clients and manage marketing plans and budgets,” Pelt said. “He discovered how to integrate what he has learned at UWF into real-world scenarios with local businesses and community organizations.” Job shadowing is designed to allow students to gain valuable exposure to a career of interest and apply knowledge acquired from their academic program. It is also a short-term, highimpact practice that can serve as preparation for other methods of experiential learning, such as internships and cooperative education, which typically take place in a student’s upper division academic experience. Comedian Brian Regan Returns to Saenger Stage One of the most respected comedians in the country, Brian Regan, will perform in Pensacola at the Saenger Theatre on Saturday, September 22, 2018 at 8:00 p.m. For this reserved seating show, all tickets are $49.50 plus applicable service charge. Tickets go on sale to the public on Friday, April 6 at 10 a.m. at the Ticketmaster.com and the Saenger Theatre Box Office. Vanity Fair calls Brian, “The funniest stand-up alive,” and Entertainment Weekly calling him, “Your favorite comedian’s favorite comedian.” Having built his 30-plus year career on the strength of his material alone, Brian’s non-stop theater tour continuously fills the most beautiful venues across North America, visiting close to 100 cities each year. Taking a leap into the acting world, director Peter Farrelly personally cast Brian in his new TV series, Loudermilk, on The Audience Network. Loudermilk premiered to rave reviews on October 17, 2017, with Brian earning accolades in the role of “Mugsy,” a recovering addict who is estranged from his family. Brian will shoot the second season of Loudermilk this summer. Brian appeared at Carnegie Hall on

November 11, 2017 following years of performances in New York City’s finest theaters including Lincoln Center’s Avery Fisher Hall, The Beacon Theater and Radio City Music Hall. A regular on The Tonight Show Starring Jimmy Fallon, Brian is the rare guest who the show invites on for two segments: a performance segment and a segment on the couch to chat with Jimmy. Previously, Brian was a regular guest on The Late Show with David Letterman, making 28 appearances on the CBS show. Brian made a scene-stealing cameo in Chris Rock’s film, Top Five, and he is a guest on Seinfeld’s Comedians in Cars Getting Coffee, which is now streaming on Netflix. Brian has seven hour-long comedy releases.

Florida Bar Board of Governors March 2018 Meeting Highlights New Bar rules, a legislative session wrap-up, a report on the Constitution Revision Commission and two new Bar member benefits were on the agenda at the most recent meeting of The Florida Bar Board of Governors (BOG). At the March 23 meeting in Sarasota, we heard a report from the Board Review Committee on Professional Ethics on amendments to Rule 4-7.22, which include a change in terminology from “lawyer referral services” to “qualifying providers,” and broadening the definition of those services. An overview and Q&A on the changes, which have been adopted by the Florida Supreme Court and take effect April 30, are posted at floridabar.org/qualifyingproviderrule. At the direction of the court, additional changes to the rule will be considered by the BOG in May. Look for a summary of those changes and an opportunity to comment in the May 1 issue of The Florida Bar News. In response to a federal court ruling and an order by the Florida Supreme Court, the BOG also agreed to propose a rule amendment concerning when lawyers may advertise that they are “specialists” or “experts.” Law firms that want to use the terms would have to have a majority of lawyers who meet the minimum standards, and disclaimers could be required. This proposed amendment will be filed with the court on May 15; Bar members may file comments directly with the court after the filing. The Florida Legislature, in its recently completed session, restored some court funding lost to previous budget cuts. We also were told about an agreement to give state agencies the authority to pay Bar fees for government lawyers. The Special Committee on the 2017/18 Constitution Revision gave a report on the progress of the Constitution Revision Commission (CRC) in sorting through more than 1,000 proposals. The CRC committed 25 proposals to its Style and Drafting Committee, which is expected to merge those into several measures for the November ballot. The Florida Bar will be focused on the remaining proposals that could impact the judicial branch (many of the initial Article V proposals

were defeated or withdrawn), and will continue to monitor the CRC while educating Bar members and the public on this once-every-20-years process. The board approved aspirational guidelines for Florida Bar candidates, including those for board seats and for president-elect designate, encouraging professionalism and civility and discouraging campaign spending. As best practices, candidates are encouraged to limit expenditures, mass emails and the use of phone banks. The BOG also accepted the Program Evaluation Committee’s reports on its review of Florida Lawyers Assistance, Inc., the Practice Resource Institute (PRI) and the Committee on Diversity and Inclusion. Finally, the board approved two new member benefits through Amazon Business and Page Vault. These programs are expected to be available to Bar members by midApril and will be added to the more than 60 free or discounted products and services listed at floridabar.org/ memberbenefits. The Board of Governors (BOG) is an elected governing body of The Florida Bar, which has exclusive authority to formulate and adopt matters of policy concerning the activities of the 106,000-member Bar, subject to limitations by The Rules Regulating The Florida Bar. This meeting was the fifth of six meetings of the BOG in 2017-18. All board committees generally meet on the day prior to finalize actions, recommendations and reports to deliver to the board. This year I am serving on the following board committees: Investment Committee, Program Evaluation Committee and Disciplinary Review Committee. For the first time, a week before this meeting all Florida Bar members received a preview email providing information on the items coming up for action and asking members to contact their board representative(s) with any input or questions. Baptist Health Care to Offer Free Screening for Oral Cancer Awareness Month

Tuesday afternoon, Mayor of Pensacola, Ashton Hayward, Mayor of Century, Henry Hawkins, and District 4 Commissioner, Grover Robinson (on behalf of Escambia County Commissioners) proclaimed April 3 as National Service Recognition Day. United Way of Escambia County was joined in celebrating the dedication and selfless service of local Corporation for National and Community Service (CNCS) volunteers by BRACE, the City of Pensacola Government, Council on Aging of West Florida, representatives from CNCS, Gulf Coast Kid’s House, Pensacola State College, Sue Straughn, Publix, University of West Florida and more. “Volunteerism has been a vital part of our nation since its inception but it all starts locally,” said Commissioner Grover C. Robinson. “We could not have the quality of life we enjoy in

In recognition of Oral Cancer Awareness Month, the Baptist Cancer Institute will provide a free head and neck cancer screening for the public and team members of Baptist Health Care on Thursday, April 26, from 1:30 to 4:30 p.m., at 1717 North E St., Baptist Tower 3, suite 239. Physicians will check for cancers of the nasal cavity, lips, mouth, tongue, throat, thyroid and salivary glands. Baptist Cancer Institute and Baptist Medical Group – ENT will screen adults during this event. The screening will include a medical and family history review and painless physical exam. Tobacco and alcohol use, as well as human papillomavirus, are risk factors for cancers of the head and neck. Screenings also emphasize an awareness of signs and symptoms. Many types of head and neck cancer are treatable with early diagnosis.

Florida Supreme Court Denies Petition by Escambia County Property Appraiser to Overturn Victories by Pensacola Beach Taxpayers The Florida Supreme Court has denied a request by Escambia County Property Appraiser, Chris Jones, that the Court review two recent lower court decisions in favor of Pensacola Beach taxpayers. The ruling by the high court lets stand the decisions in Island Resorts v. Chris Jones, Beach Club v. Chris Jones and Portofino v. Chris Jones. All three of those decisions found that the plain language of the controlling Florida statutes makes leasehold interests in county-owned property subject, exclusively, to intangible personal property taxation – not ad valorem taxation. Following the decision in Island Resorts in 2016, Jones petitioned the Florida Supreme Court for review, and that petition was also was rejected. Jones claimed that Beach Club and Portofino raised different issues as they involved condominium improvements on county-owned land. That argument

was rejected by the First District Court of Appeals last year, and the Florida Supreme Court rejected that petition in its ruling released today. “This ruling effectively ends the issue of whether the land at Pensacola Beach, leased by Escambia County, is taxable to leaseholders,” said Ed Fleming, who together with Todd Harris, represented the leaseholders. “This issue has been definitively ruled on by the First District Court of Appeals three times, not including six requests for rehearing. The Property Appraiser’s attempts to overturn those rulings have now been rejected three times by the Florida Supreme Court.” “In January, the Property Appraiser told the News Journal’s Editorial Board that ‘no one will be happier than [me] when this is all over…,’” Harris said. “I hope that statement was true, and that he will recognize this is over.”

From April 2 through April 30, Gulf Coast residents can make a real difference in the lives of local families. Walmart and Feeding America are doubling their meal goal to help secure at least 200 million meals by increasing supplier participation to 14, and introducing the Walmart Credit Card as a new way for customers to get involved in the campaign. The ‘’Fight Hunger. Spark Change.’’ campaign launches at a critical time. Along the Gulf Coast, food insecurity affects one in six people, including one in four children. Nationally, one in eight Americans (41 million), including one in six children (nearly 13 million) struggle with hunger at some point during the year, according to the USDA. Food insecurity also affects certain populations more profoundly including children, seniors, minority and Latino communities. For Latino communities, one in five Latinos are food insecure compared to 1 in 10 white, non-Hispanics and 1 in 8 Americans overall. For Latino children, nearly a quarter (24 percent) are food insecure compared to 13 percent for white, non-Hispanic children, according to Feeding America’s Latino Hunger 2017 report. “In communities big and small across the country, there are families struggling with hunger,” said Kathleen McLaughlin, president of the Walmart Foundation and chief sustainability officer for Walmart. “By working together during this campaign with our suppliers, customers and friends at Feeding America, we can help secure 200 million meals that will help those who need it most.” Last year, Feeding the Gulf Coast benefited from $125,000 from Walmart’s campaign to fight hunger. Along the way, the executive director of the American Civil Liberties Union of Florida has plagued the Republicandominated Legislature and more than one GOP governor, emerging victorious in court battles involving abortion, gay adoption and drug testing of some of Florida’s neediest people, to name just a few issues. Simon, 74, will retire from the ACLU post he’s held for 21 years following the November elections, in which voters will have an opportunity to weigh in on a battle he views as significant as the one that ultimately secured the right to vote for black Americans. “I came in on voting rights. I’m going to retire after this monumental battle on voting rights,” Simon told The News Service of Florida in a lengthy interview Monday. Simon and the ACLU’s state and national organizations have been instrumental in garnering support for the “Voting Restoration Amendment,” which would automatically restore the right to vote for felons who have completed their sentences, fulfilled probation or parole and paid restitution. The proposal, which excludes felons convicted of murder or sexual offenses, will appear as Amendment 4 on the

November ballot. If approved by 60 percent of voters, the measure could impact an estimated 600,000 Floridians who are now unable to cast ballots. Under Florida’s current system, felons must wait five to seven years before applying to vote. Just a fraction --- about 10 percent --- of those who have applied since Gov. Rick Scott and the Florida Cabinet toughened the process after taking office in 2011 have had their rights restored, according to the state’s Commission on Offender Review. U.S. District Judge Mark Walker recently ruled that the current process is unconstitutional and gave Scott and the Cabinet, who make up the Board of Executive Clemency, until April 26 to revamp the system. The state is appealing the decision. Simon praised Walker’s ruling but said it didn’t go far enough. Getting rid of what Simon called an unfair system by altering the Constitution “is going to change Florida,” the former philosophy professor said. “For me, what Amendment 4 is all about is a moral issue. When do people earn their way back into the community? There is no permanent second-class status. People break the law. They should be punished. But morally, there’s got to be a way in which people earn a right back into the community,” Simon said. With his thick New York accent and eminently quotable remarks, Simon has been the go-to guy for reporters covering the myriad lawsuits in which

his civil-rights organization racked up a series of victories over the years. Since Simon has been at the helm, the ACLU backed Michael Schiavo in a skirmish over then-Gov. Jeb Bush and the Legislature’s efforts to keep Schiavo’s wife, Terri, on life support. The ACLU also successfully challenged Gov. Rick Scott’s attempt to require people applying for temporary assistance --- whom a former state official called “the poorest of the poor” --- to undergo drug tests. Scott also lost a similar case involving mandatory drug testing of state employees. The ACLU also participated in or played a major role in numerous lawsuits focused on abortion rights and elections. Before becoming the ACLU’s chief in Florida, Simon spent more than two decades in the same role in Michigan. During his tenure there, the civilrights organization uncovered the FBI’s involvement in a 1961 attack on the Freedom Riders during the civil-rights movement. The Michigan organization’s work led to a federal judge’s finding that the FBI’s informants were responsible for the attack. Simon said that perhaps the most fulfilling triumphs he’s participated in have come in the arena of gay rights. The ACLU represented Martin Gill, a gay man raising two foster children with his partner, in a challenge against the state’s ban on gay adoption. In 2010, a judge ruled that the law violated Gill’s equal-protection rights. A state appeals court upheld the decision, and former

Gov. Charlie Crist’s administration did not appeal the ruling. More recently, the ACLU represented couples in a challenge against Florida’s same-sex marriage ban. The court sided with the gay couples, and the decision was later cemented by a U.S. Supreme Court decision striking down state prohibitions against same-sex marriages. “They weren’t just legal victories. What thrills me about this is, we helped create families,” Simon said. Others might be discouraged about opening and closing a nearly 50-year vocation on the same issue, but not Simon. “What sustains me personally is that, with progress and human rights and civil liberties in the U.S., it’s always two steps forward and one step back,” said Simon, whose 44 cumulative years as an ACLU state director is the longest in the national organization’s 98-year history. The country is in the midst of “a big step back” under President Donald Trump, Simon said. But, unlike when he first got into the civil-rights business, volunteers aren’t being killed as they register people to vote. And advances have been made for blacks, women and the LGBTQ community, Simon said. “There is progress. We don’t live in racial apartheid,” he said. “Race is a constant issue in America, but we’re not the same country. It’s two steps forward and one step back and we’re much better than we were.”

But for other Democrats, all they need is to see the strong connections between Scott and Trump.” The Nelson-Scott contest will be a marquee event in Florida on a ballot that also will feature a governor’s race, contests for the three statewide Cabinet positions and potentially more than a dozen proposed constitutional amendments. Scott’s history suggests he will attack Nelson aggressively as “a liberal and ineffective,” said Aubrey Jewett, a political-science professor at the University of Central Florida. “Scott will also emphasize his role in restoring the Florida economy in terms of jobs and growth and probably seek to portray himself as successfully dealing with the Parkland shooting and the nursing home deaths in South Florida,” Jewett said, referring to deaths after Hurricane Irma. “Nelson will attack Scott for his ties to President Trump over and over again and also on nursing home deaths after the hurricane and for not doing enough in the aftermath of the Parkland gun deaths. Nelson will point to his moderate-to-progressive record on a variety of issues that are frequently more in step with Florida public opinion.” Historic trends show the party that lost the White House in the previous election having a strong mid-term surge. Democrats playing up a “blue wave” in November will have to retain Nelson’s seat to have any hope of reclaiming a majority in the Senate. The Democratic group American Bridge 21st Century anticipates Scott will revert to digging into his own bank account to offset any backlash against the White House. Scott spent at least $73 million of his own money to win his first campaign and another $13 million four years later. His closely aligned state political committee Let’s Get to Work burned through $5.8 million after the 2016

contest to mostly promote his agenda. Nelson’s re-election committee has just over $8 million on hand and minutes before Scott’s announcement on Monday sent out an email saying, “The only way we’re going to defeat Rick Scott and protect Florida’s Senate seat is if everyone --- and I mean everyone --- gives $5 or more right now.” Patton said even with “oodles and oodles” of money flowing into a Senate contest, which is considered a tossup by most political prognosticators, the Nelson-Scott match will “pale in comparison” to feelings about Trump. “Trump will drown everything else out,” Patton said. Calling the Trump-factor “huge,” Jewett said Democrats appear unified in their dislike of Trump. “Scott must walk a fine line when it comes to President Trump,” Jewett said. “Scott must not alienate the Trump voters --- without them he has little chance of victory --- but on the other hand probably will not appear personally with Trump and (will) seek to make the election about the incumbent Nelson rather than a referendum on Trump, which will be difficult to do.” The governor was an early endorser of Trump and chairs the New Republican PAC, which has raised money for the president. Scott has also embraced their friendship on issues such as securing funding to speed work to repair the Herbert Hoover Dike around Lake Okeechobee and getting the Trump administration to issue a statement that Florida would be removed from offshore drilling plans. Trump during public events repeatedly encouraged Scott to run for the Senate. However, the governor has on occasion tried to put some distance between himself and Trump, such as when the president used a vulgar slur to disparage Haiti and African nations or when Scott urged Congress to extend the Deferred Action for Child Arrivals program for children who are undocumented immigrants.

None of that means the opposing parties won’t zero in on the rival candidates. Democrats have already focused on low and stagnant wages to counter Scott’s job-growth narrative. Playing up companies that have handed out bonuses or pay increases, Republicans have gone after Nelson for voting against a federal tax overhaul approved by Congress last year. Nelson criticized the tax bill as being unfair in favor of corporations. The National Republican Senatorial Committee has long focused on Nelson, including portraying him as working for “Washington liberals.” The Democratic Senatorial Campaign Committee last week set up a website called “Self-serving Scott” that seeks to delegitimize Scott’s improved poll numbers. Nelson and Scott share one part of their political pasts: They both beat Republican Bill McCollum, a former congressman and state attorney general. Nelson, a Florida native, defeated McCollum in 2000 to move into the U.S. Senate and later defeated former U.S. Rep. Katherine Harris and former U.S. Rep. Connie Mack IV in his 2006 and 2012 re-election bids. Nelson has lost only one contest since first appearing on a ballot in 1972 when he ran for the state House. He fell to former Gov. Lawton Chiles in the 1990 Democratic gubernatorial primary. Scott, a former health care executive who settled in Naples, upset McCollum, the party establishment pick, in the GOP gubernatorial primary in 2010. More than $100 million will likely be spent during the next seven months as two of Florida’s top elected officials go head-to-head in the mid-term contest for a spot in the U.S. Senate. The long-anticipated contest in which Gov. Rick Scott will try to unseat U.S. Sen. Bill Nelson became official on Monday. Key issues that could shape the contest include the mass shootings at Pulse nightclub in Orlando and at Marjory Stoneman Douglas High School in Parkland and hurricanes Irma and Maria. But a third man not in the ring, President Donald Trump, is expected to play a pivotal role throughout the campaign. Alex Patton, a Republican political consultant from Gainesville, simply called the contest a “proxy battle” about Trump. “No issue will take as much importance other than, ‘Will you support Trump?’ ” Patton said. “Hell, I’m not sure it’s even about supporting Trump’s agenda --- it’s about do you support him.” Scott formally entered the race Monday with an announcement in Orlando, and the contest is considered one of the keys to control of the U.S. Senate. Neither Nelson nor Scott would be described as overly charismatic. Scott, 65, is in his eighth year as the state’s top executive.
