TheLosAngelesfiresdestroyednearly10,000homes,causinglong-lastingandunequaledcrisesforthefamiliesand businessownersaffected.AccordingtoaJanuary20,2025,articlefromArtemis,17,027structuressustaineddamageor destruction.[1]Veriskestimatesinsuredlosses,includinglossestotheCaliforniaFairPlan,California’sinsureroflast resort,at$28billionto$35billion.[2]
TheFAIRPlanstruggleswithsolvency.Its$3millioncoveragecapoftenfallsshortofactualrebuildingexpenses,leaving policyholdersfacingdecisionsonwhethertorebuildorselltheirpropertyandrelocate.
AccordingtoInsuranceJournal,theFAIRPlan’sfinancialexposureincreasedby61%between2023and2024. Reinsurancedeductiblesandlimitedcashreservesadditionallystrainsitsabilitytohandlecatastrophicclaims,potentially leadingtosurchargesonpropertyownersstatewide.[3]
Additionally,newscoveragepointsouttheproblemsofunderinsurance.Laterinthispaper,we’llhearfromJohnPutnam, anexpertwhoassistedmanyhomeownersafterthe2021ColoradoMarshallfire.Inthatcatastrophe,approximately three-quartersofthosewithdamagedpropertywereunderinsured.[4]Forunderinsuredoruninsuredhomeownersand businessowners,theroadtorecoveryisparticularlyformidable.
ThismaybeespeciallyconcerninginAltadena,wheremanyhomesaregenerationallyownedandbungaloworhistoric style.Calleda“remarkablehavenforgenerationsofBlackfamilies….”Altadenamaybeforever“altered”as“recovery andrebuildingmaybeoutofreachformany,andpressuresofgentrificationcouldberenewed,”accordingtoanAP article.[5]

California’scriticalneedforhousing,withdevelopmentsoftenextendingintohigh-riskfirezones,increasing vulnerabilities.

Historicalandpolicyoversights,includingtherefusalbyCalifornia’sDepartmentofInsurancetoapproveproperty insurancerateincreasessoughtbyinsurers.

GeneralBackgroundonInsuranceRegulatoryIssues
AcrosstheU.S.,statedepartmentsofinsurance(DOIs)regulateratesandprotectpolicyholders.StateDOIsattemptto protectconsumersfromexcessiverateswhilebalancingtheneedforfiscalsolvency.

ExpansionofState-BackedInsuranceProgramsinCalifornia
Asprivateinsurersincreasinglywithdrewfromhigh-riskwildfirezones,state-backedprogramssteppedintofillthegap. ProgramslikeCalifornia’sFAIRPlanprovidebasicfirecoverageforpropertiesunabletoobtaintraditionalinsurance. However,theseplansoftenofferlimitedcoverageandhigherpremiums,leavingpolicyholdersvulnerableto underinsurance.
Manystate-backedprogramsexcludeadditionallivingexpenses(ALE)oronlyofferlimitedrebuildingcosts,creating significantfinancialstrainforimpactedhomeowners.
TherearelimitstothecoverageprovidedbytheFAIRPlan.Whileitremainsabackstopforhigh-riskproperties, solvencyconcernsarenowfrontandcenter.WhileCaliforniacreatedtheFAIRPlantoassureaccesstobasic insurance,policylimitsandcoveragegapswillleavepolicyholdersunderinsuredwhoseonlyoptionwasthis coverage.
Post-disaster,theCaliforniaDepartmentofInsuranceplaysanimportantroleinmanagingclaimsdisputesand ensuringfairnessinclaimshandlingandcoveragedisputes.
Asan“insureroflastresort,”demand“skyrocketed”fordwellingsinthelastfouryears.AsofSeptember2024, demandfordwellingcoveragerose61%fromthepreviousyearto$458billion,triplethedemandfromonlyfour yearsprior.Forcommercialproperties,demandnearlydoubledinoneyearto$26.6billionandrose464%inthose samefouryears.[9]
Afterthefire,California’sDOIannouncednewregulationsdesignedtoencourageprivateinsurerstoresumewritingnew policiesinfire-proneregions.Newrulesrequireinsurerstowrite85%oftheirmarketshareinfire-proneareas.Asabone throwntoinsurers,itappears,insurersarenowabletofactorinreinsurancecoststotheirratecalculations.[10] Reinsuranceratescontinuetoriseaslaborandrawmaterialsratesriseandclimateincreasinglyimpactsreinsurance losses.
TheFailureofRegulatoryActioninInsuranceRateManagement
SincevotersenactedProposition103in1988,theCaliforniaDepartmentofInsurancesetsinsuranceratesformostlines ofpropertyandcasualtyinsurance.Asearlyas2023,then-GovernorNewsomissuedanemergencyexecutiveorder attemptingtostabilizethepropertymarket,whichwas“rapidlydeteriorating,”accordingtotheInternationalCenterfor Law&Economics.[11]AccordingtotheCenter,“…theProp103ratingsystemisslow,impreciseandinflexiblerelativeto otherjurisdiction….”
Interestingly,thepaperallegesthat“ContrarytoclaimsthatProp103savedCaliforniansasmuchas$154billioninauto insurancepremiumsfrom1989to2015,wefindthatCalifornianswouldhavesavednearly$25billioniftheyhadnot passedProp103.
Evenbefore2023,basedonhistoricwildfirelossesinthestate,insurersbegantoretreatfromwritingpropertycoverage inresponsetotheirinabilitytochargeadequaterates,withsomecarriersleavingthestateentirely.In2023,accordingto Policy Genius,Safeco,Farmers,AllstateandStateFarmtookvariousstepstoshrinktheirbookofpropertybusiness. Californiainsurerspaid$15.4billionin2017lossesand$13.6billionin2018duetowildfires.[12]TheCaliforniaFAIRplan becametheobviousanswerforthemanyhomeownersunabletofindpropertycoverageastheCaliforniaDOIapproved lowerrateincreases thanincreasesrequestedbyinsurers.AddtothemixconsumergroupslikeUnitedPolicyholders, thepoliticalimplicationsofpropertycoveragehaveonlycontinuedtogrowtoitscurrentstalemate.
Asforsolvency,theFAIRPlanupdatedpolicyholdersinFebruary,assuringthepublicthatthePlan“…continuesto receive,manageandpayclaimsrelatedtotheSouthernCaliforniawildfires….ThelatestestimatesapproximatetheFAIR Planhasatotalpotentialexposureofover$4billionforthePalisadesFireand$775millionfortheEatenFire.”Itis currentlyaccessingreinsurancetohelppayclaims.[13]
However,onFebruary11,theFAIRPlannotifiedadmittedcarriersoftheirdutiesregardingassessments.Accordingto Insurance Journal,thestatewillassessthoseinsurers$1billion.[14]Upto50%oftheseassessmentscanflowto policyholders.[15]
ItseemsclearthatcurrentlythemunicipalitiesandtheStateofCaliforniamaybethe“emptychair”insomefire-related litigation.

CentralIssue:FireInsuranceCoverageLitigationChallenges
Insurancelitigationafterwildfirescreatesmanychallenges.Herearesomeprimaryareasofconflictpolicyholders, insurersandlegalprofessionalsencounter.
Manyinsuranceexpertswhetheragentsoradjustersagreethatthemostimportantfactorinpropertyinsurancecoverage, whetherpersonalorcommercial,iscorrectlydeterminingthebuilding’srepairorrebuildingcosts.Althoughthechoiceofa coveragelimitisultimatelytheinsured’s,manyE&Oclaimsariseoverthevaluationandadviceagentsoffered.
InadequatePolicyLimits
Onemajorissueinwildfire-relatedinsuranceclaimsisthefrequentunderestimationofreplacementcosts.Insurersuse proprietarysoftwarelike360ValuefromVeriskandRCTExpressfromCoreLogic,whichoftenfailtoaccountforreal-world complexitiessuchaslaborshortages,materialpricesurgesandupdatedbuildingcodes.Thesesoftwaretoolsrelyon outdateddataandmayusesimplifiedcalculationsinsteadofdetailedassessments.
Marketincentivesalsoplayarole.Insurersaimtokeeppremiumscompetitive,whichoftenleadstosettingreplacement costlimitslowerthanactualrebuildingexpenses.Policyholders,lookingtocontrolcosts,mayalsoselectlowercoverage limitswithoutfullyunderstandingtherisks.Further,insurers’legaldisclaimersshiftresponsibilityforselectingcoverage amountstopolicyholders,limitingrecoursewhenlimitsproveinsufficient.
Whileagentswarntheirclientsthattheseare estimates andthatitisultimatelytheclient’sresponsibilitytodevelopthe correctbuildingreplacementcost,limitsmaybeinsufficient.Evenwhenagentsverifywarninginwriting,theyoftenface errors&omissions(E&O)allegations.
AnExtendedReplacementCost(ERC)endorsementcanhelpmitigateunderinsurancebyincreasingthecoveragelimit beyondthedwelling’sstatedvalue.Typically,ERCstartsat10%to20%abovethebaseamount,butitcanbeincreased to50%oreven100%atarelativelylowadditionalpremium.Thisaddedprotectionhelpscoverinflation,buildingcode upgrades,andhigherconstructioncostsafteradisaster.
Despiteitsaffordability,manyhomeownersareunawareofthebenefitsofhigherERClimits.Reviewingpolicyoptions withanagentcanensureadequateprotectionandpreventfinancialhardshipafteraloss.
Evenifpolicylimitsappearadequate,post-disastercostspikes—includinglaborshortages,permittingdelays,and environmentalremediation—candrasticallyinflaterebuildingcosts.Theresultiswidespreadunderinsurance,leaving manypolicyholdersunabletorecoverfullyafterawildfire.
Inadequatelimitsoncommercialpackagepolicies,businessownerspoliciesandbusinessincomecoveragewillalso createlitigation.Inanywidespreaddisaster,cleanupdelays,lackoflaborandmaterialsandpermittingissuesslows recoverytoacrawl.Endorsementsareavailableoncommercialpropertypoliciesthatprovideextendedperiodsof restorationtohelppayforextendedbusinessinterruptiondelays.

DebrisRemovalIssues
Coveragefordebrisremoval,too,canbeproblematic.InarecentarticlebyJohnPutnam,“Debrisremovalisabig deal.”[16]AccordingtoPutnam,“Debrisiswhateversolidsremainafterafire.”However,heassertsthatpersonalproperty debrisleavesaresidueofashandmetalwithanunknownchemicalmakeup.Therefore,carcinogenssuchasasbestos requirespecialremediation.Debrismigrationmayimpactstructuresstillstandingaswellassurroundingwater Additionally,“Victims[want]anopportunitytobringclosuretomakesureanyrecoverableitemsarefound,”Putnampoints out.
Mostpersonalpoliciesallowadditionalcoverageof5%oftheexhausteddwellingcoveragefordebrisremovalifthe insuredpropertywastotallydestroyed,accordingtoPutnam.SomecompanieswillalsoincludeCoverageB–Other StructuresandCoverageC–PersonalPropertylimitswhenarrivingatadebrisremovallimit.Therewillbelowerlimitson treesandlandscapingmaterial.Personalpropertypoliciesdonotcoversoilremediation.
Undercommercialpolicies,debrisremovalhastimelimitsandexclusionstopropertytypescoveredbythepolicy.It usuallylimitscoverageto$25,000oranotherfixedamountifthe“totaldebrisremovalamountexceeds25%ofthe deductibleplusthedirectphysicallossamount.”[17]
Vehiclesrequireadifferentremovalprocess.Coverageforvehiclesthatblockedfirefighteraccessmayalsobelitigated.
Foundationsburninmanywildfires,andwhilehomeowner’spoliciestypicallycoverfoundationsinthedwellingcost, commercialpoliciesdonotcoverfoundationsunlessendorsed.Thecommonbeliefuntilwildfiresbecamemorefrequent intheUSisthatfoundationsdonotburn.However,inintensewildfireswhereheatmayexceed2,500degrees,rebarin thefoundationwillexpandandcontract,degradingthefoundation’sintegrity[18]
Remember,we’rediscussingstandardinsurancepolicies,writtenbystandardcarriers.Therealityisthatmanyofthese homes’coverageprobablynowliesinsurpluslines,wherecoveragewillvaryandusuallybelessrobustthancoverage offeredonstandardISO-typepolicieswrittenbyadmittedcarriers.Watchforlitigationarisingfromfailuretoexplainthose coveragevariationswhenagentsmovedtheirinsuredstosurpluslinescarriersafternon-renewalbystandardcarriers. AccordingtoPutnam,FAIRPlanpoliciesdonotofferadditionaldebrisremovalcoverage,“…soanydebrisremovalcosts willbedeductedfromthepolicyamountpurchased.”[19]
WhiletheFederalEmergencyManagementAgencymayofferpublicassistancefordebrisremoval[20],thenew administrationmaybereluctanttoexpendmuchhelptoadecidedlybluestate.
Theimpactsofincreasingconstructioncosts,supplychaindisruptionsandlaborshortageswillincreaserebuildingcosts andcreateconstructiondelays.Manyifnotmostpolicyholdersfaceunderinsurancechallengesduetooutdatedlimitsthat failtoreflectrisingrebuildingcosts,withoneestimateashighas75%.

Codeupgradesmayincludeinstallingsprinklersystems,upgradingtofire-resistantmaterials,Americanwith DisabilityAct(ADA)requirementsincommercialbuildingsanddefensiblespacemandates.Theseupgradeswill delayrebuildingandincreasecosts.
Delayswillsparkdisputesoverpolicytermsandadditionallivingexpenses(ALE)paymentsduetorisingrental costs.Thedisplacednowencounterlimitedavailabilityaswellasmorecostlyhousing. WhilecatastropheadjusterswillcontinuetoflowintoCalifornia,thelackofpropertyadjustingtalentwillcreate additionalhurdles.Thedemandforexperiencedadjustersoftenoutstripssupplyafterlarge-scaledisasters, compoundingdelays,increasingunfairoruninformedcoveragedecisionsandotherdisputes.
Simplybecauseahomesurvivedwhileitsneighboringhomesburned,wildfiresoftencausetoxicsmokeandsootto infiltratehomesleftstanding.ThissootcandamageHVACsystems,insulation,wiringandevenbuildingmaterials suchaswoodorbrick.[21]
