PRESIDENT’S REPORT

Let me begin this edition by taking a moment to acknowledge the incredible strength and solidarity shown by all of you. Week after week, we’ve shown up, together, in unity, as one, pushing for what you deserve as we continue to fight for a fairer deal in the current Enterprise Agreement (EA).

A special thank you to everyone who participated in the Protected Industrial Action (PIA). Every sticker stuck, every lanyard worn, and every recorded action counts. These acts, however small they may seem, are part of a much larger movement that sends a clear message: we will not back down. From hosting walk-offs to gathering on the lawns of Parliament, you’ve pushed PIA further than it’s gone before. And the wider community is watching - our collective efforts have garnered media coverage reaching over 9 million hits across multiple platforms.

But as we fight for fairness, it’s equally important to look out for one another.

This month is Mental Health Awareness Month, and we encourage you to have each other’s back. If you’re struggling, speak up. If you see someone who isn’t okay, reach out. Together, we’re stronger - not just in the demands of the job, but in our support for one another.

The fight continues, and so does our commitment to each other. Let’s keep showing up, keep speaking out, and keep standing together.

As we step into the vibrant season of spring, it feels like the perfect opportunity to reflect on the numerous occasions throughout the year when the membership team has ventured out of the office to engage with our members. Each event has afforded us the opportunity to continue to foster strong connections within our diverse membership base.

I’d love to take a moment to celebrate these memorable interactions and the bonds we’ve strengthened along the way.

We have had the pleasure of attending many events and gatherings where we can meet our members face to face. These occasions have varied in purpose, but each one leaves us feeling grateful and humbled. We always walk away having learned a little bit more about the members we represent. We often comment on how positive our members are, as they frequently share good stories and tend to downplay any challenges they face.

These conversations often reaffirm the work we do (not just in our small team, but more broadly across the organisation) and importantly guides the direction we take as an Association. After all, we are a member-led organisation, feedback is crucial in shaping our path forward.

We deeply appreciate the invaluable contributions of those who make our efforts possible. Our heartfelt thanks go to our National Executive, Convenors and Delegates, and we also extend our gratitude to the members who generously offer their time and assistance, stepping up whenever needed.

Their willingness to lend a hand and support us with the oftencomplex logistics of onsite visits, the delivery of posters, escorting staff, booking rooms, and numerous other tasks has not gone unnoticed. We would be unable to achieve even half of what we have accomplished over the year without their invaluable assistance. Their dedication and hard work have been instrumental in ensuring the smooth execution of our events and activities, and we are deeply grateful for their unwavering support.

We have conducted musters both online and in person, attended a community-based workshop facilitated by our members and Cuppacumbalong Foundation, participated in Wall-to-Wall,

and supported the organisation of trivia nights to raise funds for our members during some incredibly challenging times. Additionally, we have had the opportunity to participate in a golf day, delivered recruit presentations, attended graduations, and engaged in industrial action activities.

This diverse range of activities has fostered a strong sense of community and support among our members, and as we close out the year, we are keen to continue to stay connected and engaged throughout the rest of the year.

Our staff member Gerry O’Connor deserves a round of applause for his instrumental role in organising numerous BBQ events. His skills on the grill have made him a stalwart of the events, with all staff deferring to his instruction. However, after tirelessly manning the grill and serving up delicious food time and again, Gerry is undoubtedly looking forward to a well-earned respite from the tongs and a break from the endless stream of egg and bacon rolls!

Without Us, You Are On Your Own: Understanding the Importance of your Union.

Throughout history, unions have been at the forefront of advancing social justice causes and fighting against systemic inequalities. In today’s society, with its ever-increasing and complicated legislation surrounding employment law, the role of unions as a fundamental cornerstone is often overlooked. Without unions, employees find themselves at the mercy of unchecked employer power, potentially facing exploitative practices and unsafe environments alone.

The phrase "Without Us, You Are on Your Own" highlights the pivotal role unions play in safeguarding the rights and interests of workers across all industries and in shaping strong labour conditions and norms. Unions uphold and represent the collective strength of workers, advocating for their rights, safety, and fair treatment in workplaces across Australia. The collective bargaining power of unions helps to ensure that employees’ voices are heard, and that their interests are protected. It is well known that unionised workplaces are safer and healthier environments due to the rigorous standards and protocols fought for and negotiated by unions.

The AFPA, as your representative, stands as a guard of fairness and equity in your workplace.

We provide legal assistance and representation in disciplinary matters, Comcare claims, payment disputes, and terminations, as well as advice in relation to entitlements under the Enterprise Agreement.

However, the AFPA is not merely concerned with your rights in the workplace, we negotiate on behalf of all members to secure better wages, improved working conditions, and we provide additional benefits such as trauma cover, bereavement assistances and

life insurance. Our advocacy goes beyond economic gain to encompass relevant broader social issues. This advocacy is vital to achieving progress and equity in the workplace.

Your union has assisted members with thousands of concerns in the last few years with a diverse array of issues ranging from minor, such as clarification of a clause in the EA or assistance with transfers, to serious such as adverse action or serious misconduct allegations.

EXAMPLES OF WHERE YOUR UNION HAS BENEFITTED THE MEMBERSHIP INCLUDE:

Member Recognition: A member applied for the National Police Service Medal for 15 years with the AFP, only to be told that due to an established PRS finding the member was not eligible on the basis of not meeting the standards of ‘ethical and diligent’. The AFPA appealed this decision on behalf of the member resulting in the member being awarded the NPSM.

Adverse Action: Upon a member returning from annual leave (followed by personal leave with a medical certificate), they were excluded from any overtime opportunities for three months, in part due to having taken sick leave. The AFPA represented the member in the Fair Work Commission in a successful adverse action claim for compensation for lost overtime opportunities. Astonishingly, the member was subjected to further adverse action a mere two weeks later resulting in the AFPA securing further compensation.

Historic Overpayment: Following the Superannuation Review, a member was informed they had been overpaid approximately

$91,000.00, which was required to be repaid. This also impacted the member’s pension by $400 per fortnight. Upon review the AFPA disputed the debt and, after 5 months of rigorous advocacy the AFP finally accepted that they had made a mistake and the decision was overturned.

Salary Increases and PDAs: The AFPA commenced proceedings in the Federal Circuit Court regarding the AFP’s interpretation of a member’s entitlement to salary increases under clause 7 of the EA, which provided annual percentage increases. The AFP’s view was that any salary increases would be delayed until a rating of ‘PDA fulfilled’ had been achieved. The AFPA were successful in that mater, and in the subsequent appeal lodged by the AFP. This resulted in almost 280 members receiving back payments and adjustments to their superannuation.

LEGAL ASSISTANCE

While the AFPA assists members in house wherever possible, there are times when external legal advice and representation may be required to address a member’s issue. The AFPA has a Legal Assistance Scheme that provides financial assistance for legal fees or associated legal expenses or costs that arise from their

employment relationship with the Australian Federal Police. This can cover Fair Work Commission matters, representation at any enquiry, costs in obtaining medical and other specialist reports, and to a limited extent criminal matters.

WELFARE ASSISTANCE

During times of hardship, the AFPA offers member support, which may include provisions for meals, housecleaning, general life administration, and assistance with finding counselling support. We also provide members with financial support during times of hardship and bereavement.

While the above examples are provided to demonstrate how the AFPA fights for you, they comprise only a tiny fraction of the work the AFPA does on behalf of members each and every day. In the last 12 months alone, we helped with over 1200 member and collective issues, in addition to bargaining for your new EA.

Therefore, supporting your union is a commitment to upholding fundamental rights and values in your workplace and community. After all, without your union, the promise of "You Are on Your Own" becomes a stark reality for those striving for a better future.

Australian Law Enforcement –

Bravery in the Line of Duty

On what seemed like a quiet morning in Morley, Western Australia, AFP Leading Senior Constable (LSC) Sean Boyd found himself facing a life-threatening situation. What started as a routine day off quickly escalated into a test of courage that would earn him the prestigious AFP Bravery Medal.

While off-duty, LSC Boyd noticed thick smoke rising from a nearby home. His instincts as a police officer immediately kicked in, and despite the absence of a uniform, he rushed to the scene. With children’s toys scattered in the driveway and a vehicle parked outside, there were clear signs that someone could be inside the burning house.

As he approached, LSC Boyd was confronted with an unexpected and alarming sight—a man wielding an axe. In a moment that could easily be lifted from an action-packed thriller, Boyd, unarmed and alone, found himself face-to-face with danger. He recalls that the last thing he expected was to face an armed man at that moment.

However, years of experience as a police officer had prepared him to handle the unexpected. Drawing on his police negotiation skills, he remained calm and engaged the man in conversation. As the fire continued to rage behind them, LSC Boyd de-escalated the situation, disarming the man and ensuring no further harm was done. With the help of a brave bystander, Boyd secured the man and handed him over to the Western Australia Police. Soon after, the Department of Fire and Emergency Services (DFES) arrived to tackle the blaze.

For his courage and swift action, LSC Boyd was awarded the AFP Bravery Medal, a recognition reserved for those who perform acts of exceptional bravery, often at significant personal risk.

Boyd’s journey in the job began with the WA Police Force on August 30, 1999. After six years in community policing, he sought new challenges, eventually applying to the Australian Federal Police. His career has taken him across diverse roles, including ACT Policing, the International Deployment Group, Aviation, Counter Terrorism, Joint Anti Child Exploitation Team (JACET), and Intelligence. Boyd had always been drawn to a profession that offered variety. “I was looking for a career that would give me a mix of indoor and outdoor work and keep me interested day to day,” Boyd shares. Policing offered that balance, providing him with a dynamic and rewarding career.

When asked if anything specific prepared him for the intense situation he faced in Morley, LSC Boyd humbly responds that it wasn’t one thing in particular, but rather "a wide level of experience across a broad range of weird and wonderful situations." The key, he says, is communication. "The biggest factor is being able to communicate with people, understanding their situation and making sure they know what is required of them."

That skill certainly came into play when he encountered the armed man, and his ability to de-escalate the situation without resorting to violence is a testament to his training and experience.

Receiving the AFP Bravery Medal is an honour that LSC Boyd doesn’t take lightly. "I am both honoured and humbled to receive this award. It means a lot to have my efforts recognised by my peers."

For LSC Sean Boyd, bravery isn’t just about extraordinary moments—it’s about the dedication and resolve that he brings to his work every day. His actions in Morley reflect not only his courage but also the values of the AFP and Australia’s frontline.

2024 Wall to Wall Ride

Each year, police officers from across the country - serving and retired - come together to ride side by side in memory of their fallen colleagues, to the Police Memorial in Canberra. The annual Wall to Wall Memorial Ride is more than just a journey; it’s a tribute, a powerful way of remembering and honouring police officers who have tragically lost their lives in the line of duty. This year’s event was imbued with even greater significance following the loss of one of our own who was tragically killed during the ride.

The Wall to Wall Ride not only brings together police forces, but also friends, families, and members of the community who wish to honour the bravery and sacrifice of these officers. In this time of reflection and remembrance, the camaraderie is clear and the shared understanding that the strength of the police community lies in its unity, a powerful message on display.

This year's ride, more poignant than ever, culminated in a moving ceremony at the National Police Memorial, where riders arrived to pay their respects. The rumble of the motorbikes could be heard across a silent Kings Park, coming together as a reminder that the service and sacrifice of police officers is never forgotten.

The Australian Federal Police Association (AFPA) team were honoured to have participated in the event, laying a wreath in memory of fallen officers.

While the ride itself is over for another year, the collective memory of our fallen officers lives on, and for those who continue to serve the thin blue line every day to keep us safe, a reminder that unity is strength.

Documentation of the history of AFP Uniform and Insignia Early History of the Australian Federal Police (AFP)

The Australian Federal Police (AFP) has endorsed a project to document the history of AFP Uniform and Insignia.

Eric Grimm (Retired AFP Superintendent and former APFA member) is managing the project with support provided by the AFP Museum.

The project aims to develop a comprehensive, researched and referenced publication with images, details and background of AFP Uniform and Insignia from AFP foundation (19 October 1979) to the present, with a commitment to publishing of future addendums.

The project will consult with various stakeholders including former members and AFP areas during research and validation of information.

The scope of the project includes uniforms, badges, patches, hats/caps and rank insignia. Social items will likely also be within scope of the project, along with PPE (Clothing including vests and jackets). Other items such as corporate branding items, challenge coins and non-official items may be developed as a separate addendum.

The document will include items from ACT Policing, International Operations (including United Nations and other missions), Protection Operations, specialist areas, various Commands, ceremonial uniform, unsworn uniform and others. It will include descriptions and details of items and where possible a narrative or story of their use and media or journal articles (in part or referenced).

HOW CAN AFPA MEMBERS ASSIST?

◾ Email eric.grimm@afp.gov.au with images, descriptions and any background of the uniform or insignia item and stories which can be used in the narrative of the publication, in particular items which are not general duties standard issue.

◾ Loan items which may be more difficult to photograph, so they can be professionally photographed.

◾ Send links to media, articles or posts which would be of interest for use in the publication.

To maintain consistency of images, good quality (300 dpi+) colour scans of insignia (whether on or off uniform) and highresolution photographs of uniforms/hats/caps with a neutral (white preferred) background. Guidance can be provided prior to photography if required.

It is hoped that AFPA members with an interest in AFP items will assist with validation of the information collected to ensure items are accurately categorised and described (i.e. official, social, fantasy, era, areas used, etc.).

The AFP Executive have indicated the importance of collection, research and preservation of the AFP’s history and have acknowledged the valuable contribution current, former and retired members and other organisations can provide to ensuring this occurs, so your support with this project would be appreciated. Credit will be provided to members for their contribution where requested.

Early History of the Australian Federal Police (AFP)

The AFP ‘Mini’ Badge

The Australian Federal Police (AFP) ‘Mini’ badge, as it is sometimes referred to, draws its history and design from various aspects of Federal Policing in Australia.

This includes the use of collar badges (also known as collar dogs) on various historic uniforms and a design drawn from the Commonwealth Police cap badge and the Australian Capital Territory (ACT) Police mess kit badge (also worn on recruit berets).

It features a roundel with blue background, containing the words ‘AUSTRALIAN FEDERAL POLICE’. The roundel is topped with a St. Edward Crown and underneath is a laurel/oak sprig. The centre of the roundel contains the Australian Coat of Arms. The badge measures 3.2cm tall by 2.0cm wide. There are a number of variations of the badge, all being the same design but with slight variations over time (Various manufacturers including Stokes, J&J Cash and Lucas Productions).

Whilst the AFP Mini badge is well known for being worn on AFP Mess Kit (as a lapel badge), there have been a number of other uses of the badge throughout the history of the AFP;

◾ Used for recruit berets from 1979-1986

◾ Used as collar badges on motorcyclists on ceremonial uniform tunic

◾ Used as collar badges by Ceremonial Mounted Cadre members on ceremonial uniform tunic

◾ Used as collar badges by the AFP Pipes and Drums on their tunic

◾ Used as a lapel badges on AFP Mess Kit (Sergeants and Commissioned Officers)

◾ Used as a cap badge and pocket badge by Kenny Koala in the 1980s

◾ Attached to the cross guard of the AFP Foundation presentation sword (1983), made by Wilkinson Sword

A Journey of Healing in Timor Leste

In early November 2000, I touched down in Dili, Timor Leste, as part of the 5th Australian Contingent with UNTAET. The experience was as jarring as it was unforgettable—the oppressive heat, humidity, and the acrid smell were the first signals that the land I had arrived in was far different from anything I had known. The devastation was staggering; every building seemed to bear the scars of recent violence.

After two weeks of training and acclimatisation in Dili, my colleague Chris ZIINO (Zorba) and I were dispatched to Viqueque District, a six-hour drive from the capital. Our arrival late at night and subsequent assignment to Uato Lari, a village with no electricity or running water, marked the beginning of an intense and challenging chapter. Living among the locals, we adapted to their way of life, forming deep connections while grappling with the harsh realities of the post-conflict environment.

The six months that followed were a whirlwind of highs and lows. We faced the harshest of conditions, but also witnessed profound acts of resilience and community spirit. We became first responders, dealing with everything from violent crimes to medical emergencies. We navigated crocodile-infested swamps, facilitated crucial dialogues, and, amidst it all, forged lasting friendships. Meeting Xanana Gusmao and working alongside the Timorese police were some of the highlights of a deeply transformative experience.

However, my return to Australia was marred by the invisible wounds of war. Diagnosed with PTSD, I was advised by a psychologist that my experiences were “normal” and that I would eventually recover. Yet, the trauma was far from simple to overcome.

My journey through various treatments, including hospitalisations and therapiesI’ve tried them all EMDR, counselling, psychology of all types - was fraught with struggles, ultimately leading to my inability to work full-time.

In 2015, amidst a relentless cycle of emotional turmoil, I knew I had to confront my past. A glimmer of hope emerged when I learned about the Timor Awakening (TA) program. Designed as a holistic rehabilitation initiative for veterans, this program offered a path to revisit and reconcile with one’s past in a supportive environment.

When my husband Chris and I were accepted into TA27, which coincided with ANZAC Day in Dili, we were both eager and apprehensive. The program’s blend of personal reflection, historical immersion, and group support promised a meaningful journey.

Our adventure began with a poignant arrival in Dili, marked by a mix of nostalgia and nervousness. As we travelled through familiar yet transformed landscapes, each day of the program brought new insights and challenges. From witnessing sunrise over Balibo to exploring the haunting remnants of the past, every experience was a step towards healing.

The climb to Mt Ramelau was a profound metaphor for my personal journey. The ascent, fraught with difficulties and moments of doubt, mirrored my struggles with mental health. Reaching the summit, I found a renewed sense of strength and purpose. The clarity and beauty of the view symbolised a hopeful future, reminding me that even in the darkest times, the sun will rise.

Our journey included engaging with local communities, visiting historical sites, and connecting with fellow veterans. Each interaction and experience deepened my understanding and

empathy, reinforcing the program’s impact on my healing process. Returning to Australia, I felt a profound sense of closure and renewal. The Timor Awakening program had not only helped me confront and process my past but had also reignited my passion for supporting the Timorese community. Chris and I are already planning our next visit, eager to continue exploring and contributing to the NGOs we met during our trip.

Mental Health & Resilience in policing

Research shows that rank and length of time in policing impact mental wellbeing – with higher levels of anxiety, depression, and PTSD. One study shows constables accounted for the highest percentage of employees taking sick leave. These findings conclude that officers who are at the height of their career and closer to retirement are most in need.

ANXIETY, DEPRESSION & MENTAL UNREST IN POLICE

Anxiety & depression

It’s normal to experience anxiety from time to time, especially during stressful periods. However, there’s a difference between situational anxiety that’s brought on by a specific event versus generalised anxiety disorder (GAD) which is constant and chronic.

GAD is the excessive, uncontrollable worry about everyday situations, which can lead to depression. The two conditions are often connected.

While some people are inclined to worry more than others, stressful events are the main cause of anxiety. For police officers, the stress isn’t just about the work, it’s about life and death. Every day police are in harm’s way, and these emergency responses can’t be foreplaned.

Warning signs, risks & causes

You might experience:

◾ Overwhelm, avoidance and the inability to make decisions

◾ Feelings of hopelessness

◾ A lack of interest in activities you usually enjoy

◾ Worst-case-scenario thinking and rumination

◾ Like you’re in danger and something ‘bad’ is about to happen

◾ Physical symptoms such as panic attacks, racing heart, disassociation, insomnia, tingling, trembling etc.

Anxiety shows up differently for everyone. It can be caused by a multitude of factors, both external and internal, such as:

◾ Experiencing abuse of any kind

◾ Exposure to ongoing stressful situations

◾ Life-threatening events

◾ Physical issues such as chronic ailments

◾ A family history of mental health issues.

As a police officer, there’s greater exposure to stress, abuse, life-threatening events, injuries, and compounding effect of seeing people in their worst moments. It’s your job to deal with the negative, traumatic situations often caused by people who need the most help – and impacting those most innocent.

Prevention & management for police

In police work, there’s no way to prevent stress. But you can control how you perceive and process it. When you experience a symptom, use one of the tools that work for you.

Addressing Mental Health Challenges in Policing

Police are confronted with psychological stress on a daily basis that significantly affects their mental and emotional health.

In a 2023 international study, 44% of police indicated they suffer from stress, depression or anxiety that was measured at a moderate to severe level (Drew & Martin, 2023). Sadly, police also often report the likelihood of future attempts to take their own life at some point, and over 13% report being suicidal over the previous year.

Compared to the general population, police face a 54% higher risk of this type of death.

Given the increasing challenges in civilian life from relationship breakdown, drugs and the increase of criminal activities, the focus to improve health and wellbeing indicators requires new ways of thinking and uplifting to leadership capabilities through the use of evidence-informed tools and resources in the police force.

With this in mind, Alex and I recently presented on this important topic in Thessalonki in Greece. It was a great opportunity to showcase a new model developed by Amovita specifically for police leaders to demonstrate their range of capabilities engaging neurocare for police. The International Police Executive Symposium commenced in the 1990s and apart from the three years of covid, it has taken place across the globe every year. Police leaders, lawyers, researchers, and frontline law enforcement professionals attended from across the globe presenting on topics including enhancing police practices, retention issues, artificial intelligence, transnational criminal networks, cybercrime and human trafficking.

Alex focused on the context in which policing in Australia takes place, membership of the AFPA and challenges in the provision of policing services with limited resources and ongoing emotional injury. The long-term impacts of trauma and provided an overview of the Sanctuary model. Tracey then overviewed the important mechanisms that influence leadership capability and the importance of neurocare. Exploring leadership effectiveness, she discussed aspects of her recent research including the important of training leaders to understand key concepts of capability, the use of integrated leadership models and a framework for evaluating their effectiveness.

The key feature of the presentation included development of the new LAWS Leadership Model and its use to engage neurocare principles in conversations, meetings, and review processes. Captured in four domains, the model helps leaders to focus discussions with police on Law Enforcement/Professional,

Administration/Operational, Wisdom/Knowledge and Support/ Collaboration aspects of their role. The model helps leaders to set their agenda, evaluate the focus of discussions and ultimately evaluate their own effectiveness in their leadership role.

The presentation highlighted Daniel Sundahl’s artwork portraying police in the fullness of their complex work. DanSun is the President of the Recovery and Resiliency Foundation helping to support police living with symptoms of trauma.

Comments from delegates indicated our presentation was important and well regarded. As a result, we have been asked to support development of a formal certification in Police Leadership in the United States incorporating the LAWS model and relevant resources. We look forward to increasing awareness of the need for this model in Australia and progressing awareness through the AFPA.

Why should I seek a

legally binding property settlement?

Separation and divorce can unfortunately happen to anyone – police officers are not exempt!

There are always many things to consider when a relationship breaks down, but today I am going to share with you specifically about property settlements – and why you should seek a legally binding property settlement.

As a family lawyer, I am asked this question all the time, and there are four very compelling reasons why.

1. TO PREVENT YOUR EX FROM 'DOUBLE DIPPING'

If you and your spouse or de facto partner ("your ex") separate and you agree to divide your assets informally (without a legally binding property settlement), then there is nothing preventing your ex from making a claim against you to obtain further assets in the future.

There are no informal agreements or "handshake agreements" in family law. Informal property settlements are not binding.

2. TO PROTECT YOUR FUTURE WEALTH

If you do not formalise your property settlement so that it is legally binding, then the other party may have an interest in the assets you obtain in the future.

For example, you and your ex may have a house, two cars, nominal savings, and some superannuation at the time of separation. If your financial circumstances then improve post separation, because:

1. your income increases;

2. you receive inheritance from a deceased estate;

3. you combine your assets with the assets of a new partner; or

4. you win the lottery, then your ex may decide to resurface and make a claim on the assets you hold at the current time, rather than what you had at the time of separation.

This generally happens if you are (or are perceived to be) in a better financial position than your ex.

A legally binding property settlement provides you with the security you need to protect your future wealth.

3. TO OBTAIN STAMP DUTY

EXEMPTIONS

If you formalise your property settlement so that it is legally binding under the Family Law Act 1975 (Cth), then there are

stamp duty exemptions. This can save both parties a significant amount of money.

4. FOR YOUR PEACE OF MIND

Once you have a legally binding property settlement in place, you can move on from your past relationship with clarity about your financial circumstances.

This will allow you to plan your life, and to take steps to build your personal wealth without fear.

WHAT IS A LEGALLY BINDING PROPERTY SETTLEMENT?

A legally binding property settlement can only be achieved by an Application for Consent Orders and a Minute of Order, or a Binding Financial Agreement. These can both be attained by seeking advice from a family lawyer.

Statutory Declarations, handwritten agreements, or other agreements are not enforceable in the Federal Circuit and Family Court of Australia.
