Building Excellence: Reflecting on a Year of Impact and Innovation at ABC Central Florida As we approach the end of another successful year, we look back and can see so many shining examples of ABC helping our members to develop people, win work, and deliver that work safely, ethically, and profitably for the benefit of our community. In this edition, we bring you information and insights on the dynamic world of construction and development that shapes our vibrant community. The Orange County Convention Center Upgrade takes center stage, offering a glimpse into the transformative upcoming projects that are in store to ensure that we keep OCCC world-class. In 2022–2023, the convention center hosted 159 events, creating 2.8 billion in economic impact.

requirement for employers in the construction industry to enter into a collective bargaining agreement with a labor organization as a condition of receiving an H-2B temporary labor certification. This new requirement would harm more than 88% of the construction industry that has chosen not to join a union and establish labor organizations as the gatekeepers of H-2B for construction.

We have so many members that leave their mark on our community, living the values that ABC stands for, many of whom are highlighted in our member news. We celebrate several of our members who have been showcased as the Top 150 Contractors in 2023. We recognize the craftsmanship and legacy of AMI, as they mark three decades of dedication to their craft and family heritage. We applaud Barton Malow for their strong commitment to philanthropy and community service throughout their 99-year history.

Lastly, contractors need to ensure that they are aware that the new joint employer final rule from the National Labor Relations Board will drastically alter the existing contractor and subcontractor relationship in the construction industry, implementing a harsh new standard that will require general contractors, in most cases, to be a joint employer of their subcontractors. This will undoubtedly cause chaos, muddying the waters and making many of these previously successful and effective business relationships unsustainable.

Our commitment to recognizing excellence is showcased in the recap of the 2023 Excellence in Construction Awards and ABC Construction Expo. These events not only highlight the outstanding achievements within our industry but also serve as a testament to the collective prowess of our members.

As an organization, we strive to address these challenges head-on and create an environment where every contractor, regardless of size, can thrive.

We dive into the intricacies of the 2023 General Contractor Project of the Year, the Brightline Station Project at Orlando International Airport. We praise Gomez Construction Company and the several members that are contributing to the growth and connectivity of Central Florida through these types of innovative construction projects. In this issue, we learn how JK2 Scenic worked their interior magic at the AdventHealth Training Center in Downtown Orlando, earning the 2023 Subcontractor Project of the Year. ABC Central Florida has always been at the forefront of advocating for our members, and in this issue, we delve into the challenges posed by DC. One is the NLRB rule impacting small contractors. ABC has issued an action alert and urges members to contact their U.S. Senators and Representatives to oppose this harmful legislation. On Nov. 13, ABC filed comments opposing the Occupational Safety and Health Administration’s Worker Walkaround Representative Designation Process proposed rule, which would allow employees to choose a third-party representative, such as an outside union representative or community organizer, to accompany an OSHA safety inspector into nonunion workplaces during site inspections. ABC and a coalition of construction organizations have been working to oppose a planned proposal by Sens. Lindsay Graham, R-S.C., and Alex Padilla, D-Calif., dubbed the Seasonal Employer Protection Act. This new legislation is a reiteration of previously shot-down proposals that would impose harmful and unjustified restrictions on the access of the construction industry to the H-2B seasonal guest worker program. Included in the legislation is a new

ABC explores ways in which our industry can contribute to combating this crisis and creating safer, healthier work environments. In this issue, we highlight a member who went above and beyond to help a member of our community by administering NARCAN. Matthew Livingston, a Modern Plumbing Industries employee, jumped into action when he saw a member of our community that needed his help. All members are encouraged to read this article and take proactive steps to train their employees and raise awareness about the opioid epidemic. The Orange County Convention Center (OCCC) is the third largest in the country, and second largest on the scale of having a more robust calendar. The original West Concourse building construction in 1983 housed an 11,300-seat arena until 1992 and hosted a plethora of popular artists such a Madonna and Aerosmith until its decline when the Orlando Arena opened in 1989. Today, the OCCC includes two buildings with a combined 2.1 million SF of exhibition space, 235 flexible meeting rooms, three full-service restaurants, eight food courts, and on-site parking for 6,227 cars. In 2022-2023 the convention center hosted 159 events with 1.5 million attendees equating to a $2.8 billion economic impact. The OCCC has a $50-60 million annual budget to cover renovations, mechanical and electrical improvements, roof replacements, life safety upgrades, technology upgrades, digital signage, and more. There is a dedicated project management team that is part of the procurement department involved in each project. Some of the most recent projects included renovations to the 48,600 SF Tangerine Ballroom that was expanded to include the Sunburst Room as a signature meeting room with dynamic finishes and an outdoor reception area. The food courts in the west building have been upgraded to dining lounges and hydroponic gardens, wellness spaces, and nursing rooms were added. Ongoing capital of a 2.5%-5% reinvestment of value has been put back into the OCCC since 2012 to keep the buildings at a world class level. The West Building now has 1.1 million SF of flexible meeting space that can be separated into up to 135 rooms and hosts 120 events in 2022. Originally, you could tell that this building was constructed in phases, the recent renovation projects have created the cohesiveness it needed to remain a modern and state-of-the-art space.

The newer North/South Building currently has 950,000 SF of exhibit space, but at 23 years old is ready to get the facelift it needs to continue attracting events. This will be part of the next expansion and renovation plan that the Orange County Commissioners recently approved the OCCC to receive TDT funding to move forward. Planned is upgraded flooring, new movable partitioning, a new 1.4 million SF roof with solar paneling, restroom renovations, food court upgrades, and a 60,000 SF meeting room expansion on the west side of the North/South Building. Currently an RFP is being put together for the expansion project that will be publicly solicited in March-April of 2024. The Gateway Arch in St. Louis is made of only 5,199 tons of steel. • The Operable Partition Panels in the North/South Building equal 1.65 miles, making them the largest operable partition system in the world. • The main span of the Brooklyn Bridge could fit inside the West Building’s contiguous exhibit space. • The Valencia Ballroom has more square feet than the White House and can hold events for up to 6,000 people. • There are 130,000 Cubic Yards of cast in place concrete that equals 410 miles of sidewalk. I believe The United States has the strongest economic structure in the world for two major reasons: Constant income and diversification.

Constant Income

The IRS is the institution responsible for overseeing income for the US government. They process tax returns and enforce tax policy, which translates into revenue for the government. These dollars come from several places: individual & corporate income tax, Social Security, Medicare, excise taxes, customs duties, remittances from the Federal Reserve, miscellaneous fees & fines and estate & gift taxes. All in, the US government budgeted for $3.4 trillion in revenues for 2020. These sources of revenue are perpetual in nature. Individuals and corporations always have income. This is not to imply that every individual has income every year, as we all know this is not true. As a group though, individuals will always generate revenue. The same is true of corporations and of estate taxes. When corporations have income, they pay tax on their retained earnings. When wealthy people pass away, their estates are subject to taxes as they pass to the next generation.

Diversification

This income comes from many sources and diverse business sectors of the US economy. Consider that, even in volatile times, revenue continues to the federal government. Hypothetically speaking, if one year the healthcare sector of the US economy is doing exceptionally well, the profits from those healthcare

corporations and workers will be taxed and generate revenue to the government. The following year, perhaps the healthcare sector is not doing as well but the industrial sector is strong. In this case, the revenues from the industrial sector will go up and revenue from the healthcare sector will go down. Still speaking hypothetically, perhaps the third year finds both the healthcare and industrial sectors showing weakness, but the financial sector is having a good year…you get the idea. And if the whole economy is down, chances are that total revenue to the US government will be lower but not zero. Even during The Great Recession, government income was still a very big number at $2.52 trillion. https://www.thebalance.com/current-u-s-federal-government-taxrevenue-3305762 As our economy grows the total taxes paid to the U.S. government would theoretically increase. The faster it grows, the better. The subsequent challenges then become the amount of national debt we have incurred, the cost of servicing that debt and how to grow or tax our way into a budget surplus. The ongoing cost of servicing our existing debt and the seemingly perpetual budget imbalance is an ongoing political “hot potato.” Our two-party system seems to switch sides of the spending fence depending on who is in office. The challenge comes in determining what each party will spend their (our) money on, not if they will spend. (Hint: They both spend copious amounts of your money.) Gomez Construction Company was the general contractor overseeing the interior buildout of the new Brightline train station at the multi-modal center at Orlando International Airport. The 37,350 SF station next to Terminal C will help Brightline connect service between Central Florida and South Florida. The facility’s core and shell were built during the multi-modal center construction and connects directly to the airport’s parking garage C, with more than 350 parking spaces set aside for Brightline guests. The station is bright, airy, and full of amenities that are typically absent from passenger train outposts in the United States. The ornamental entry portal constructed contains over 70,000 LED lights and features the recognizable Brightline logo. Passengers can purchase tickets from guest services or one of the several self-service kiosks, and check luggage before proceeding through touchless turnstiles into the security screening tunnel. Once passengers make their way through the tunnel, they are met with the two-story station space featuring the Mary Mary Bar, the MRKT PLACE, and a BrightKids children’s play area. Passengers access their train by escalator or elevator to first level platforms that are 1,000 feet long and can accommodate a train with up to 10 coaches and two locomotives.

Throughout the station, all guests have access to free highspeed Wi-Fi, charging stations at every seat, and 87 big screen televisions. The Mary Mary Bar is positioned at the far end of the station with a panoramic view overlooking the train platforms. The custom bar installed at the Mary Mary Bar, installed by Advanced Millwork, Inc. includes LED systems, crafted to be both functional and visually appealing, with automation that changes between morning and night settings.

Working on a project in an active airport added complexity to their safety plan due to the increased security and work around the public. Brightline had their own safety guidelines that had to be adhered to, in addition to the rigorous safety protocols Gomez uses on all their projects. They had a dedicated, full-time safety supervisor on site throughout the project and successfully completed construction with no lost time. The Brightline station brings a whole new level of access to Orlando that will serve as a gateway to the most popular destinations in Florida, providing seamless connections to worldrenowned theme parks and tourist spots. The project is one that the entire Central Florida region can be proud of and why Gomez earned the Excellence in Construction Project of the Year Award for 2023!

During the preconstruction period, the Gomez team took time to do a deep-dive study of what had been done at previous Brightline stations, visit those stations, and speak with subcontractors to produce ways to get ahead of any challenges previous projects encountered. The high-profile nature made this an exciting project, but also challenging in a lot of respects. This very public project was being watched by all Central Florida, and the schedule, quality, and attention to detail were of the highest importance. The project was completed during a tumultuous time after the COVID-19 pandemic that created equipment lead time issues, supply shortages, and labor challenges that lingered during the course of construction. The Gomez team had the foresight to order some of the extremely long-lead items, such as fan coils, air handling units, light fixtures, custom carpeting, electrical switchgear, and other custom finishes during the preconstruction process to mitigate the delays. One of the biggest challenges on the project was modifications to the installed electrical and plumbing systems located in the totally enclosed, six-foot interstitial space between two levels. Modern Plumbing Industries, Inc. (MPI) was contracted by Gomez for the plumbing scope; this included a team working in that confined space and taking every safety precaution. Thick wood planking was secured within the deck to allow for a secure work platform and team members were always tied off at two points with their tools tethered to prevent breaks in the platform and potential falls. How ABC's Young Pros Are Shaping the Construction World By Julie Holmes, 2024 ABC Chair, JK2 Scenic Over the past few years, the Young Professional’s program has given many opportunities to young professionals in the construction community to build relationships and gain knowledge about the industry. Each year the committee produces different programs, ranging from networking events, site tours, volunteering opportunities, and educational programs. These programs offer a chance to connect with other young professionals and help create relationships and learn from other generations. By involving young professionals, it will help bridge the generational gap within our industry. Consider helping to get young professionals in your office engaged and designate a staff member be your office’s YP liaison, to get the word out for upcoming YP and other ABC events and encourage them to attend together. The main events scheduled for 2024 are the February Golf Tournament, May Bowling, July Trivia Night, and December Holiday Winter Olympics. Elected officials listen to their constituency – when a group of people from their district requests a meeting regarding issues, the official wants to hear their point of view. Most officials want to make sure they understand the consequences and benefits of any particular piece of legislation. This may be intimidating to some ABC members who may think they need to speak to legislators about bill language and in legalese. In reality, it is members speaking from their experience in construction and about their companies and communities that make the biggest impact.

ABC OPPOSES NLRB RULE AFFECTING CONTRACTORS | Revised Rule Could Disrupt Contractor Relationships and Increase Project Costs, ABC Warns In a recent press statement, Associated Builders and Contractors (ABC) voiced its concern over the National Labor Relations Board’s (NLRB) latest joint employer final rule. The rule, which replaces the 2020 standard endorsed by ABC, introduces a broader scope of joint employer liability under the National Labor Relations Act. The construction industry, known for its intricate network of contractors and subcontractors, stands at the cusp of facing significant operational upheaval due to this change. Ben Brubeck, ABC's Vice President of Regulatory, Labor, and State Affairs, expressed trepidation about the rule's implications. "The construction sector, pivotal in shaping America's infrastructure, could see a detrimental shift in its foundational contractor-subcontractor dynamics," said Brubeck. He emphasized that this expansion of joint-employer liability might saddle contractors with unwarranted risks and liabilities, potentially deterring them from engaging with subcontractors. Small businesses, which form the backbone of the construction industry, are likely to bear the brunt of these policy shifts. The confusion and lack of clear guidelines can result in a domino effect, culminating in project delays and inflated costs—effects that taxpayers could ultimately shoulder, especially in public infrastructure initiatives. ABC has strongly hinted at considering legal action to contest the NLRB's final rule.

Recent Developments

Small businesses are not just a segment but the majority in the construction domain, with 99% of companies employing fewer than 100 construction professionals, as highlighted by the U.S. Census Bureau. The new joint employer rule could have profound effects on these firms, challenging the stability of an industry that is a crucial player in the national economy. NLRB Extends Effective Date of the Joint Employer Final Rule to Feb. 26, 2024 On Nov. 16, the National Labor Relations Board extended the effective date of its final rule on Joint Employer Status Under the National Labor Relations Act from Dec. 26 to Feb. 26, 2024. The new standard will only be applied to cases filed after the rule becomes effective. On Nov. 9, ABC joined the U.S. Chamber of Commerce and a coalition of business groups in filing a lawsuit challenging the NLRB’s final rule for violating the National Labor Relations Act and for acting arbitrarily and capriciously in violation of the Administrative Procedure Act. The final rule takes an ax to the ABC-supported 2020 NLRB joint employer final rule, which provided clear criteria for companies to apply when determining status. ABC’S REGULATORY ROUNDUP

Learn About the Latest Developments Affecting the Construction Industry ABC has prepared a summary of Biden administration regulatory actions of interest to ABC members by agency. Here are some of the highlights. For a deeper dive scan the QR Code: U.S. Department of Labor

Improve Tracking of Workplace Injuries and Illnesses ABC submitted comments urging OSHA to withdraw the proposed rule. Establishments with 100 or more employees in certain high-hazard industries are required to electronically submit information from their OSHA Forms 300 and 301 to OSHA once a year. They are also required to include their legal company name when making electronic submissions to OSHA. Establishments with 20 to 249 employees in certain high-hazard industries will continue to be required to electronically submit information from their OSHA Form 300A annual summary to OSHA once a year. Establishments with 250 or more employees that must routinely keep records under OSHA’s injury and illness regulation will also continue to be required to electronically submit information from their Form 300A to OSHA once a year. The data must be electronically submitted through OSHA’s Injury Tracking Application. Heat Injury and Illness Prevention in Indoor and Outdoor Settings In September, OSHA held six Small Business Advocacy Review panel meetings to gather input on a possible Heat Injury and Illness Prevention in Outdoor and Indoor Work Settings rule. Any interested party may submit comments, and the agency will include those comments in the public docket. The deadline to comment is December 23, and all such comments can be submitted via regulations.gov at OSHA-2021-0009-1059. ABC strongly supports worker safety and protection from heat injury and illness, while maintaining flexibility for the fluid nature of the construction environment. Employers play a key role in providing training and awareness regarding heat protection, and ABC will continue to support members in ensuring preparedness for heatrelated issues through a wide range of resources. Worker Walkaround Representative Designation Process ABC and its members submitted comments in opposition to the rule. On Oct. 16, the U.S. Department of Labor’s Occupational Safety and Health Administration issued an extension of the comment period for the proposed rule, which would allow an employee to choose a third-party representative, such as an outside union representative, to accompany an OSHA inspector into nonunion facilities. ABC joined 40 other Coalition for Workplace Safety members in sending a letter to the U.S. House Education and the Workforce Committee’s Subcommittee on Workforce Protections calling out OSHA for its proposed rule and the politicization of the agency that the rulemaking exemplifies.

Personal Protective Equipment in Construction On July 20, 2023, OSHA issued a proposed rule clarifying the requirements for the fit of personal protective equipment in construction. On Sept. 18, ABC, as a steering committee member of the Construction Industry Safety Coalition, submitted comments to OSHA in response to the PPE proposed rule and urged the agency to clarify what it means by the terms “properly fit” and “additional hazards” and that the clarification include specificity so that covered industries better understand their compliance obligations. In addition, the CISC urges OSHA to clarify how it will enforce this regulation and delineate objective measures regarding what constitutes “improper fit.” Infectious Diseases In March 2024, OSHA intends to issue a proposed rule on infectious diseases and examine regulatory alternatives for control measures to protect employees from infectious disease exposures to pathogens that can cause significant diseases. The agency listed several workplaces where these control measures might be necessary, including health care, emergency response, correctional facilities, homeless shelters, drug treatment programs, and other occupational settings where employees can be at increased risk of exposure.

Wage and Hour Division

Updating the Davis-Bacon and Related Acts Regulations The regulation’s drastic revisions to existing rules regarding government-determined prevailing wage rates that must be paid to construction workers on federal and federally assisted construction projects funded by taxpayers took effect on Oct. 23. ABC issued a statement opposing the new rule. Unfortunately, the DOL’s final rule disregards the feedback of ABC contractors, construction industry stakeholders, and thousands of small businesses urging the withdrawal of this unnecessary, costly, and burdensome regulation.


All contracts entered into after Oct. 23 are subject to the new rule’s provisions. Additionally, in certain situations, the rule may apply to existing contracts. This includes if a contract is changed to include substantial Davis-Bacon-covered work not within the scope of the original contract, if an option to extend a contract’s term is exercised, and for ongoing contracts not tied to the completion of a particular project. ABC continues to consider options for a potential legal challenge to the final rule. Overtime On Sept. 8, 2023, the DOL published a new proposed rule that would alter the “white collar” overtime exemption regulations. Specifically, the proposal would significantly raise the minimum salary level needed to qualify as exempt. The Partnership to Protect Workplace Opportunity, of which ABC is a steering committee member, created a grassroots toolkit for members to respond to the U.S. Department of Labor’s new overtime proposed rule. ABC is disappointed that the DOL is moving forward with a proposed overtime rule since multiple industries, like construction, are still grappling with the lingering economic consequences of inflation, global supply chain disruptions, rising material prices, and workforce shortages, all of which push operational costs ever higher,” said Ben Brubeck, ABC vice president of regulatory, labor, and state affairs, in a statement immediately following the DOL announcement.

Office of Labor-Management Standards

Form LM-10 Employer Report Employers must file the Form LM-10 report with the OLMS to disclose certain payments, expenditures, agreements, and arrangements, including the hiring of outside labor relations consultants to help inform their employees regarding union organizing or collective bargaining, known as “persuader activities.” ABC submitted a comment letter to the DOL opposing the revision.

U.S. Department of the Treasury

Inflation Reduction Act Prevailing Wage and Apprenticeship Regulations The U.S. Treasury Department’s Internal Revenue Service released a proposed rule and FAQs on provisions of the ABC-opposed Inflation Reduction Act, which will affect the developers, contractors, and workers that are building clean energy projects eligible for more than $270 billion in federal tax credits. ABC also led a coalition of 13 construction and business associations in comments urging the IRS to provide regulatory clarity and to abandon its illegal and coercive scheme to push clean energy project developers into requiring PLAs. In addition, ABC encourages ABC members and other contractors to connect with more than 400 government-registered apprenticeship programs offered by ABC chapters that can help contractors meet IRA apprenticeship requirements and win contracts for clean energy projects seeking the full IRA tax credits. UNITED AGAINST THE OPIOID CRISIS:

– The Amphibious Group & ABC Central Florida Lead the Charge for Workforce Wellness By Terence A. Curran Jr., ABC CF Safety Committee Chair, The Amphibious Group In a remarkable partnership aimed at addressing the opioid crisis within the construction industry, Terence Curran Jr., chief operating officer of The Amphibious Group, along with Michele Daugherty, president and CEO of ABC Central Florida Chapter, are spearheading an initiative that seeks to educate and protect the workforce of Central Florida. The reality of opioids, a class of drugs with potent pain-relieving properties, has a long and complicated history. Originally derived from the opium poppy plant, these substances have been used for centuries to manage pain. However, misuse and over-prescription of opioids have led to a modern-day health crisis that continues to affect countless individuals. The United States has faced an alarming epidemic of opioid misuse and overdose deaths for several decades. USA FACTS details California had the most total death from Fentanyl in 2022 with 6,453, Florida second with 5,083, and New York third with 4,950 total deaths. This data is tracked through the CDC drug overdose data. The construction industry is one of the sectors that have been impacted the hardest by the opioid crisis. The demanding and physically taxing nature of construction work, combined with a high risk of workplace injuries, makes construction workers particularly vulnerable to opioid addiction. This vulnerability is reflected in alarming statistics, with the Substance Abuse and Mental Health Services Administration (SAMHSA) reporting some of the highest rates of opioid misuse and overdose deaths within the construction industry.

The opioid crisis is a challenging battle, but it's stories like that of Matthew Livingston, a Modern Plumbing Industries employee, that remind us of the profound impact that education and preparedness can have. On October 10, 2023, while filling up his van at the Chevron Quick Mart in Orlando, Florida, Matthew Livingston made a discovery that would change a life. As he approached a vehicle at the adjacent gas pump, Matthew noticed an individual inside their car who appeared to be asleep with the car running. Concerned about their well-being, he knocked on the window repeatedly but received no response. When he opened the door, he found an adult male unresponsive with a drug pipe in his hand and recognized the signs and symptoms of a potential overdose. Acting quickly and confidently, Matthew called 911 and, thanks to the training and education Matthew received the week prior by Amphibious Medics and ABC, he used his Narcan kit to revive the individual.

The statistics surrounding drug abuse in the construction industry are often alarming, especially when compared to other sectors. Among other industries in the U.S., construction ranks: • Third in illicit drug use — 12.95% • Second in heavy drinking — 16.02% • Second in substance abuse disorder — 16.07% • First in marijuana use — 60.33% • First in heroin use — 4.42% • First in pain reliever/opioid abuse — 22.63% Amphibious Medics and ABC Central Florida are at the forefront of a movement to tackle this pressing issue head-on. The partnership represents a concerted effort to educate, empower, and protect the community’s workforce. As of October 2023, Amphibious Medics has educated 92 employees among nine companies, with more classes scheduled during the remainder of the year and throughout 2024. The approach is comprised of multiple elements: Awareness and Education: Terence and Michele recognize the importance of awareness. Together, they are organizing seminars and workshops in the field and at the ABC office, designed to inform workers about the dangers of opioids, signs of addiction, and harm reduction strategies. These educational classes are conducted by two of Amphibious Medics’ finest instructors David O’Keefe (English) and Carlos Corral (Spanish). Training: Recognizing the potential life-saving impact of Narcan,
