Shaping Tomorrow, Remembering Yesterday In this edition of Building Central Florida, we are thrilled to celebrate the remarkable journey of ABC Central Florida as we mark our 50th anniversary. It's an honor to recognize our model members of the quarter, Blue Cord Design & Construction, LLC, and Burr Forman LLP, whose dedication and commitment are playing a pivotal role in shaping our association for tomorrow. As we gear up for our grand 50th Gala on October 14th, we've had the privilege of reconnecting with some of our past presidents, such as Tim Dwyer (1999 PP) and Walt Juergensen (1976 PP). Walt took us on a nostalgic trip to 1976 when our state approved our first apprenticeship program, a milestone that paved the way for ABC Central Florida's growth. Today, ABC and its members nationally invest a staggering 1.5 billion dollars annually in workforce training, empowering nearly 1.3 million individuals with essential skills in craft, leadership, and safety education. We're also excited to announce the groundbreaking of our Innovation and Training Lab in Orlando and our upcoming role as the host for the ABC National Project Management Institute in January - Make sure your team members secure their spot, as this program is bound to fill up quickly. Walt fondly recounted the early days of ABC, reminiscing about the vibrant breakfast meetings at Ronnie's restaurant. These gatherings united contractors, subcontractors, and material suppliers under a shared cause – the protection and growth of the merit shop philosophy. It was a time of camaraderie, mutual support, and the birth of enduring friendships. Tim, reflecting on his tenure, highlighted the evolution of our industry. He marveled at the sophistication in executing projects, emphasizing how ABC fosters fellowship among competitors and subcontractors, all working together for the advancement of our open shop industry. In this issue, we delve into essential partnerships that drive our mission to Build Central Florida. We express our gratitude to Diane O'Dell of the Universal Orlando Foundation and Sean Snaith, Ph.D., Director of the University of Central Florida's Institute for Economic Forecasting, for their insightful contributions at our Future Economy Builders' Luncheon. We firmly believe that promoting safety practices are key to creating impactful changes. “OSHA can have a bigger impact on jobsite safety by fostering positive partnerships with employers and promoting safety practices that produce results," said Ben Brubeck ABC Vice President of Regulatory, Labor and State Affairs. “For example, in ABC’s 2023 Safety Performance Report, topperforming STEP participants achieved a 688% improvement in safety performance compared to the U.S. Bureau of Labor Statistics construction industry average in 2022.” As you read through this issue, you'll discover the collective efforts of ABC Central Florida and its members, all working tirelessly to develop individuals, secure work, and ensure safety, ethics, and profitability in Central Florida and beyond. ABC LUNCHEON BUILDS COMMUNITY AND FORECASTS THE FUTURE ECONOMY BUILDERS’ LUNCHEON LOEWS PORTOFINO BAY AT UNIVERSAL ORLANDO RESORT | AUGUST 22, 2023

ABC and the Programs Committee recently hosted a luncheon at the Loews Portofino Bay at Universal Orlando Resort for members with speaker Diane O’Dell with the Universal Orlando Foundation and Sean Snaith, Ph.D, director of the University of Central Florida’s Institute for Economic Forecasting and a nationally recognized economist in the field of business and economic forecasting. Members had a chance to meet Universal guests and learn more about the foundation whose motto is “Culture Builds Community.” The Universal Orlando Foundation is committed to making a difference in Central Florida through the power of education and the magic of the arts. They are dedicated to supporting local organizations that strive to make our community a better place to live. The foundation recently completed a significant supply drive for all the students headed back to school. Sean Snaith kicked off his presentation by asking members “How did we get there?” Moving through issues beginning in 2020 and the COVID years to cover problems we’ve faced such as inflation, supply chain failures, labor market shortages, high oil/gas prices, Snaith showed how all of these were self-inflicted and rooted in pandemic policies. Repercussions of the set of problems we created are still being played out, and the next question asked is always “Whose fault, is it?”

Most of us have seen an “I did that!” sticker picturing President Joe Biden pointing at the price of gasoline on fuel pumps in gas stations around the United States as a way to claim that he increased the gas prices. The problem stemmed from closing businesses and schools, resulting in a collapse of the demand for oil. Once the country reopened in full force, the demand explosion created a demand that couldn’t be met, and prices skyrocketed.

openings will lessen the need for layoffs and ease the sever labor market shortages over the next two years although not enough to fully relieve wage and salary pressures. Snaith ended his presentation with a discussion of the regional housing market and the difference between the surge in housing prices experienced in Florida from 2004-2006 compared to 20202022. Due to tightened mortgage standards during the pandemic as opposed to the easy lending that fueled the previous housing bubble, the wave of foreclosures and shorts sales that caused the plunge post 2006 will not repeat itself in the wake of this most recent surge. Snaith did not disappoint with his reputation to explain complex subject matter in a digestible manner, often earning praise from members for having “an uncanny knack of making economics not only understandable but interesting.” Once the self-inflicted recession ended and the economy roared back to life, the supply was not there to support it. Stimulus and unemployment money was going into unnecessary items instead of towards rent because of eviction halts and once that went away the money was not there for its intended purpose. This is part of the factor that is going to create a new recession. The data all shows similar behaviors consistent with the past three recessions this country has seen.

Despite a looming recession, Snaith added that “The recession, if it happens, will not be nearly as deep as the 2008-2009 and 2020 recessions but combined with tighter monetary policy it will help bring inflation down significantly from the peak levels in 2022.” Additionally, the large number of job openings as the economy enters a recession will cushion the impact on the labor market as cutting

BOND LADDERING A Strategy for Income

Bond Laddering is an income strategy by which an investor purchases multiple bonds with sequential maturities in order to mitigate interest rate and liquidity risk while attempting to maximize current income. This type of strategy has certain characteristics that help make it work. I frequently use the laddering strategy to help clients with their cash flow needs. Laddering bonds is simply buying bonds with sequential maturities. I have created a hypothetical illustration of a $1,000,000 bond ladder. I used round numbers to indicate sequentially higher rates as maturities went out into time. Please understand that the rates shown are not tied to any specific security and no offer is made or implied as to their availability. • • •

Bonds with shorter maturities generally pay less interest than bonds with longer maturities. Bond laddering reduces interest liquidity risk (the need for cash) by making cash available each year or two. Bond laddering can generate greater average interest by balancing long bonds with short maturity bonds.

The first day can be the worst day, when looking at total annual income. As time marches on, the shorter bonds are redeemed at maturity and then redemptions are reinvested out into the future. In a rising rate environment, those longer bonds might be offered at higher rates. However, if we find ourselves in a flat or even declining rate environment, the same strategy can still work well, since Short Term bonds with lower interest rates are sequentially being replaced with Long Term bonds at assumedly higher rates. This strategy can work for any type of Fixed Instrument; CD’s, Corporate Bonds, Fixed Annuities, Municipal Bonds, Government Bonds, orTreasuries. It is also possible to mix-n-match securities, depending on what is available at the time of investment or reinvestment. A client's tax situation might change over time and Tax-Free Municipal Bonds may no longer have the mathematical advantage they once did and Corporate Bonds might make more sense over time. Implementation of the best strategy is an important element to review frequently.

FUTURE IMPROVEMENTS FOR ORLANDO VENUES AND THE QUEST TO GET TAYLOR SWIFT NEXT TIME AROUND BUILDERS’ BREAKFAST | SEPTEMBER 26, 2023 PHOTO COURTESY OF ALLEN JOHNSON

Allen Johnson, chief venues officer at Orlando Venues joined ABC for breakfast to present the improvement project plans that Orlando Venues will bring in front of the Orange County Board of County Commissioners on October 3, 2023. The City of Orlando owns and operates multiple arts and cultural facilities under the Orlando Venues umbrella designed to enrich the lives of Central Florida residents and visitors. These unique gathering places include Camping World Stadium, the Amway Center, Harry P. Leu Gardens, and the Mennello Museum of American Art. Camping World Stadium has not only seen name changes since it was originally constructed in 1936 - many of us still can’t shake calling it the Citrus Bowl to this day – but massive construction changes since 2014 in what Johnson refers to as the modern era of the stadium. The upper precast concrete bowls are the only remaining feature of what the stadium was in the 1980s. The modern Camping World has hosted 4.6 million patrons over nine years including its highest attended event, Wrestlemania. In 2022 the stadium contributed $43 million to state and local taxes from its $632 million total output. To “complete the vision” of the modern stadium, Orlando Venues is asking to have the $400 million base scope approved that includes removing and replacing upper terrace decks, increasing vertical transportation, connecting all levels with a 360-degree concourse, and adding 100,000 SF of multipurpose fieldhouse. The upper decks currently still have concrete bench seating that is not up to code, once these are replaced the stadium will lose some of its seating with the replacements and need to make that up somehow to compete with the stadium in Tampa and perhaps have Taylor Swift in Orlando the next time around. Retractable seating similar to that at J. Raymond Stadium could add 8,000 more seats for concerts. Looking forward, an additional $400 million improvement scope to be approved would add a canopy-style covering over the new upper decks to protect against weather and maximize stadium usability. Johnson explained that he would like to see a flat roof put on the entire stadium, as the canopystyle would still not protect patrons against lightning in the area. This flat roof would cost an estimated $20 million more. Moving down the road to the Amway Center, Johnson described the $256.8 million project scope they are requesting. This would be an improvement project carried out over the next 10 years and includes updating and upgrading to keep up with state-of-the-art technology that improves guest, artist, and staff experience as well as maintaining and enhancing the quality of the space, and modernizing and innovating for security and safety operations, lighting controls, high-speed internet, next gen connectivity, and HVAC.

In 2022, the Amway Center had a $500 million economic impact from the 1.3 million visitors to the 478,000 hotel rooms they stayed in. These improvements are important to keeping the Amway Center a high-quality venue that continues to boost the local economy. Smaller in scope, but not in cultural impacts to the community are the improvement project scopes for the Harry P. Leu Gardens and the Mennello Museum. At Leu Gardens, plans include improving and upgrading existing guest areas and experiences as well as adding new amenities and interactive activities such as a children’s garden and butterfly house. The Mennello Museum is hoping to have a $29 million expansion project approved that would increase the existing 12,000 SF museum to include a 40,000 SF facility integrated around the current space increasing the number of quality exhibits, programs, and opportunities to serve the community. The project would also reimagine their green space creating a modern cultural destination on Lake Formosa. The expansion would allow the museum to attract a larger audience through new branded tourism efforts, earned income with multipurpose spaces for events and weddings, and create a greater economic impact in the area. The new facility design is both futuristic and timeless, something we know ABC members would be able to bring to life. The vision for the future of these venues is a bright one being led by Allen Johnson who is passionate about giving the Orlando community spaces they can be excited about, and we know ABC members will be passionate about building.

After months of doing due diligence to select the correct company for this project, to the standards and qualifications expected, NASA discovered Dreamcrete Custom Creations, who was currently completing a project at SpaceX next door. After inspecting the space with NASA Officials, and providing samples, uniquely designed by their artists, for this space, metallic epoxy was the flooring that would fulfill their design for this critical area. A meticulous, step by step plan was drawn up and approved, along with fulfilling the requirements NASA and the US Government have for their facilities. The previous floor was failing and had to be totally redone, so DreamCrete initiated and completed both the demolition and clean-up in preparation. Floor grinding, filling all cracks, control joints, along with meticulous cleaning between each step was completed. A moisture mitigator was applied, three layers of epoxy primer was applied followed by final prep, and 800+ gallons of XPS Epoxy. This completed the first ever metallic epoxy floor for NASA and met all ADA non-slip guidelines.

INNOVATION IN HARMONY: The AdventHealth Innovation Tower and the Collaboration Behind Its Creation PHOTOS COURTESY OF BATSON-COOK CONSTRUCTION

The Batson-Cook tradition of building a strong relationship with their clients is well expressed in their relationship with AdventHealth. Over the past few years, the two companies have completed nearly a dozen projects throughout the Central Florida region, including several offsite emergency rooms. One of the larger projects they’ve collaborated on is the AdventHealth Innovation Tower in Orlando, Florida. This new, 12-story, 330,000 SF medical office building on a fiveacre site next to I-4 in downtown Orlando will provide several health services to the community. The facility hosts a brain health institute, AdventHealth Innovation imaging center, ancillary specialists, Orlando specialties, research administration, rehab center, conference center, retail pharmacy, and shell space for future tenant development. The Innovation Tower exterior can be split into three sections, a concrete center in between two concrete shells. The concrete center has gray metal panels with vertical glass windows in a checkered pattern that runs up the middle of the building. If the concrete trucks used for the building were lined up end-to-end, they would stretch 11 miles. Approximately 95,000 SF of glass was installed in the building. The site is also in a tight space, surrounded by I-4, an occupied apartment complex, and an 11-story parking garage constructed at the same time as the tower. The team took precautions to minimize the impact on their neighbors during the construction phase of the project. Additionally, HuntonBrady designed the exterior façades to evoke the feeling of movement with the shift and flex of the building’s appearance, inspired by the orthopedic services inside the building. Those unique angles made installation of exterior finishes on the façade challenging. The east and west sides of the façade are angled two degrees in opposite directions, creating an approximately seven-foot difference between the bottom and top of the building’s precast. This required using a special counterweight sled to place the material during installation. As with most large-scale construction projects, there were several logistical challenges the team had to consider and overcome. One was the large parking deck. The Batson-Cook team provided the building pad for the parking garage, then turned that portion of the site over to the parking garage general

Any large-scale construction project can be disruptive, so BatsonCook’s approach is to consider themselves as a member of the surrounding community and neighborhoods they work in. The goal is to minimize the impact construction has on their daily life. Continuous coordination was required with the surrounding businesses and services, primarily medical and residential. Throughout the project, they constantly ensured they did everything possible to be good neighbors to the surrounding community. This project was a private and public partnership for AdventHealth’s Health Village and its community development district. A portion of the project site was located on historic Orlando brick streets. To assist the city’s future restoration efforts, the Batson-Cook team completed selective demolition of the original brick streets. They removed all pavers from the city streets by hand and then cleaned, stacked, and returned them to the city for future use. At the end of the day, Batson-Cook safely completed a $101 million quality project on schedule. The team found it rewarding to have worked on Innovation Tower and AdventHealth and contributed to the larger vision of their Health Village campus. The landmark tower project is a beautiful job that will serve the community well into the future. contractor. Trey Miller, assistant project manager, said, “A parking garage was being built by another general contractor directly adjacent to our site and they were sharing a common access road with them for deliveries. The field staff coordinated with the other contractor daily and held weekly project meetings to ensure we were fully utilizing the site.” Communication was key to having two independent companies working on two structures simultaneously on a small site. The Batson-Cook project staff had coordination meetings with the parking garage general contractor every few days to schedule deliveries and other logistics to help facilitate both projects. The team also found ways to innovate and enhance safety measures on the project. Some include multiple cameras on each tower crane for their operators to better see the objects they are pulling, full deployment of the EPS edge guard system for edge of slab and shaft protection, and cast-in-place tie-off anchors throughout the building. The project scope included a structural steel pedestrian bridge connecting the tower’s second floor to the parking garage. The pedestrian bridge provides visitors with safer and easier access to the Innovation Tower building. Batson-Cook created a thorough safety plan for the pedestrian bridge and held proactive safety meetings throughout the process, which included the foreman from the steel erection companies, safety heads, project managers, and relevant executives. The Batson-Cook team also ensured that the area around the building and under the bridge was blocked off to pedestrians. Any road shutdowns were coordinated with trade partners in advance so that they could move materials and adjust their workflow accordingly. The Batson-Cook safety philosophy discusses work methods, assesses risk, and agrees on controls and procedures. PREFAB IS SAVING TIME AND MONEY BUILDERS BREAKFAST | JUNE 27, 2023

ABC hosted a a group of panelists that discussed prefabrication, its risks and pay offs. While the West Coast has been integrating prefabrication into the construction process, Florida has tended to have tunnel vision on changing the way buildings are constructed. Michele Whiteside, Brasfield & Gorrie, LLC, stated that information needs to be centralized to be effective, and that the bad information surrounding prefab needs to be debunked to show the cost neutral solution and time saving abilities. Although prefab may have a longer up-front design time and is not the solution for architecturally unique designs, for repeat projects such as healthcare facilities, retail franchises, and multifamily housing, if you’re in it for the long haul and have the owners on board the project’s increased building speed creates a much quicker construction to revenue earning period and can even save on insurance premiums. Using prefab requires educating clients to make sure they are committed to the process. Onsite construction with the installation of prefab materials can reduce the schedule by up to 30% as the process is safer, quicker, and requires less people on a jobsite at a time. Prefabrication can attract skilled laborers that are tired of the heat and weather issues as well as driving to different sites for projects by allowing them a safer, climate-controlled jobsite environment.

Prefabrication can also decrease carbon emissions per project, requiring less heavy equipment for less time at a jobsite creating a more sustainable project. In addition, pieces in a factory can be reused that are not able to be recycled in the field creating less waste for projects and mitigating land fill over dumping and trash onsite. If the projects are prefabricated, what is the role of a general contractor? Construction management services are still needed, their job is just evolving along with the construction process. The planning and designing stage with prefabrication is more important than ever to make sure you don’t end up trying to fit a square peg in a round hole. GCs are still responsible for the critical path focus; prefab allows for several scopes to be combined but it does not speed up the time it takes to put on a roof for example. At the end of the day, communication between developer/owners, architects, and contractors are part of the key to making use of prefabrication a success. Done correctly, the predictability and quality of the construction can extend the life cycle of buildings using these models. WORKFORCE FUNDRAISER ORLANDO SCIENCE CENTER | AUGUST 18, 2023 Helping ABC members develop people by supporting construction industry workforce education is the goal of the Workforce Council. This event raises awareness and funds to assist Central Florida apprenticeship programs and promote careers in construction. The Annual Casino Night is the major fund contributor for ABC’s Workforce Fund Grant program, which raised over $25,000 this year. The event drew over 300 members and industry guests who believe in training people in our industry and building the future workforce. The Orlando Science Center’s atmosphere was dynamite in the Dino Digs section of the center. With casino games from blackjack and craps to Texas Hold ’em and roulette, guests gambled to win as many raffle tickets as possible for a chance to win one of the sponsored raffle prizes valued at over $18,000.

As “The Voice of Commercial Construction” representing more than 2,500 members in Florida, ABC of Florida takes their role seriously with legislative and political efforts to support and advance free enterprise and merit shop philosophies. Members from all five Florida chapters meet annually in the summer for the ABC of Florida State Convention and Legislative Planning Conference to set the legislative priorities for the upcoming year.

Topics included; owner-direct purchase reform, public construction bonds, building department/public owner reform, and apprenticeship/workforce education reform. Looking around the room once it was split into groups, it was remarkably clear what issue was at the forefront of everyone’s mind – Apprenticeship Reform. AN ATTACK ON THE MERITSHOP: NLRB's Decision Overrules Half-Century Precedent On Aug. 25, 2023, the National Labor Relations Board issued its decision in Cemex Construction Materials Pacific, LLC, which imposes a new framework that greatly expands the Board’s ability to impose unions on employees without a secret ballot election. The Board’s decision overrules precedent that has stood for over half a century. The ABC-led Coalition for a Democratic Workplace issued the following statement from ABC Vice President of Legislative & Political Affairs and CDW Chair Kristen Swearingen: “The Board’s decision to force unions on employees without an election is contrary to the law and the fundamentals of workplace democracy. Employees deserve the right to decide whether or not they want union representation through a secret ballot election. The Board should be protecting this right and doing everything in its power to promote employee participation in elections—not forcing unions on employees based on unreliable authorization cards. The Board decision overrules precedent that has stood for over half a century and been upheld by the U.S. Supreme Court. ABC Opposing OSHA's Recent Walkaround Proposal On Aug. 30, OSHA issued a proposed rule on Worker Walkaround Representative Designation Process, which would allow an employee to choose a third-party representative, such as an outside union representative, to accompany an OSHA inspector into nonunion facilities. ABC plans to submit comments opposing the proposal by the deadline of Oct. 30, unless an extension is granted. ABC members are also encouraged to submit comments on regulations.gov. In addition, see ABC general counsel’s, Littler Mendelson’s, analysis of the proposal. “ABC is deeply disappointed that the Biden administration is trying to revive a failed Obama-era initiative, which was bad policy then and is bad policy now,” said Ben Brubeck, ABC vice president of regulatory, labor and state affairs. “This proposal does nothing to promote workplace safety and it will have a substantial negative impact on the rights of employers and their employees.” “By allowing outside union representatives access to nonunion employers’ private property, OSHA is injecting itself into labormanagement disputes and casting doubt on its status as a neutral enforcer of the law,” said Brubeck. “Unfortunately, many outside union organizer representatives have a biased agenda that is not focused on safety or health, which could distract OSHA inspectors from their primary purpose of workplace safety. “OSHA can have a bigger impact on jobsite safety by fostering positive partnerships with employers and promoting safety practices that produce results," said Brubeck. "For example, in ABC’s 2023 Safety Performance Report, top-performing STEP participants achieved a 688% improvement in safety performance compared to the U.S. Bureau of Labor Statistics construction industry average in 2022.”

The U.S. Department of Labor has taken a significant step forward in promoting workplace safety and transparency with the announcement of a final rule that expands the submission requirements for injury and illness data from certain employers in designated high-hazard industries. The rule, which takes effect on January 1, 2024, aims to improve data collection and dissemination, empowering both employers and employees to make informed decisions about workplace safety and health. Under the final rule, establishments with 100 or more employees in specific high-hazard industries will be required to electronically submit injury and illness information to the Occupational Safety and Health Administration (OSHA) once a year. This data includes the Form 300-Log of WorkRelated Injuries and Illnesses and the Form 301-Injury and Illness Incident Report. These submissions are in addition to the existing requirement to submit the Form 300A-Summary of Work-Related Injuries and Illnesses. By expanding the reporting obligations, OSHA seeks to obtain more comprehensive data on workplace injuries and illnesses, allowing the agency to identify emerging hazards and target its enforcement and outreach efforts more effectively. To ensure data accuracy and clarity, the final rule mandates that establishments include their legal company name when making electronic submissions to OSHA. This requirement will facilitate accurate identification and tracking of workplace safety records, enabling OSHA to monitor trends, patterns, and recurring issues in high-hazard industries. One of the most notable aspects of the final rule is OSHA's commitment to enhancing transparency. The agency will publish some of the collected data on its website, providing access to employers, employees, potential employees, employee representatives, customers, researchers, and the general public. The availability of this information aims to encourage accountability and foster a culture of safety in workplaces. By allowing stakeholders to access a company's workplace safety and health record, informed decisions can be made, ultimately reducing the incidence of occupational injuries and illnesses. Assistant Secretary for Occupational Safety and Health, Doug Parker, highlights the importance of this rule in fulfilling Congress's original intent when enacting the Occupational Safety and Health Act. The rule provides OSHA and the public with a better understanding of the safety and health challenges faced by workers. OSHA will leverage the collected data to strategically intervene through outreach and enforcement measures to reduce injuries and illnesses in high-hazard industries. Additionally, the data will offer valuable insights at the industry level, benefiting the entire safety and health community.

The final rule does not change the current requirements for electronic submission of Form 300A information. Establishments with 20 to 249 employees in certain high-hazard industries and establishments with 250 or more employees in industries routinely maintaining OSHA injury and illness records will continue to electronically submit their Form 300A. This announcement follows the March 2022 proposal for amendments to regulations regarding electronic submission requirements for Log of Work-Related Injuries and Illnesses and Injury and Illness Incident Report data. The new final rule signifies the government's commitment to protecting workers and promoting a safer working environment across the nation. Employers, workers, safety advocates, and other stakeholders are encouraged to familiarize themselves with the new rule's requirements and prepare for its implementation. By embracing these changes, companies can proactively improve workplace safety, contribute to the reduction of workplace injuries and illnesses, and create an environment of trust and transparency that benefits all involved parties. As January 1, 2024 approaches, OSHA will continue to provide guidance and resources to help employers comply with the updated submission requirements and reinforce their commitment to the well-being of their workforce.
