PRESIDENT’S MESSAGE

As Salaamu Aaikum everyone and Ramadan Mubarak! I wanted to take this opportunity to say it has been my honor and privilege to serve as your President for the New Jersey Muslim Lawyers Association (NJMLA) July 1, 2016 to June 30, 2017 term. I want to thank, first and foremost, my wife Lubna, my mother Almas and my children Yaseen and Jannah for being patient and tolerant with me as I, with the best of intentions, strived to improve our standing and in doing so sacrificed much time, as the other Officers have as well. I also want to thank directly my Officers on the Board, my predecessors with the organization, our members, sponsors, attendees and all the lawyers that have helped us throughout this term. I also want to thank the great attorneys of SABA-NJ and APALA NJ who I serve with as a board member and are equally as dedicated to improving the system.

Our organization was formed in 2006 and it has been growing ever since. NJMLA is one (1) of eleven (11) diversity bar associations recognized by the New Jersey State Bar Association (NJSBA), the Administrative Office of Courts (AOC) and has designations from the New Jersey Supreme Court on various committees. We are also a part of and have designee opportunities since 2015 on New Jersey’s Commission on Professionalism in the Law. It has been a very busy year, especially given the political climate after November’s presidential election. Our organization has been serving its members and supporters in various ways. We have been invited by a gubernatorial candidate, along with other Muslim leaders in New Jersey, to discuss the executive orders regarding the travel ban. We have served on panels, including for TV Asia, to elaborate on immigration issues, hate crimes and multiple minority issues that cross religious lines. We have attended various bar events and co-sponsored numbers organizational events to ensure that our organization is recognized and involved in improving the legal system in New Jersey. NJMLA was a signatory as amici for the groundbreaking case of the Islamic Society of Basking Ridge for which all of us are ever grateful to the law firm of Patterson Belknap Webb & Tyler and their team. Relationships have developed, older ones have been further cemented and newer ones await. We have opened the lines of communication with the other diversity bar associations on core-common ground issues.

In my role to further enhance the visibility of the organization, I have been honored to be New Jersey’s representative on the National Association of Muslim Lawyers (NAML) which is now revitalizing itself and pulling in all the Muslim lawyers associations throughout the country. The awardees for tonight’s event speak volumes as to the progress that is gradually being made for Muslims and Muslim lawyers throughout New Jersey. To our knowledge, New Jersey now has five (5) Muslim Superior Court judges, including one (1) currently assigned to the Appellate Division. We also have six (6) known Muslim municipal court judges. This is the largest attendance in the organization’s history and I am humbled by the unprecedented generosity of the multiple donors who have supported tonight’s event. Please take advantage of this gathering to speak to one another, network and make yourself known.

That being said, much more needs to be done. The atmosphere is unfortunately marred with trepidation and uncertainty. As lawyers, we are at the forefront to combat bias, hate and nepotism through equality and seeking justice. Harvard law school has recognized the following Quranic verse as one of the greatest expressions of justice in history and has posted same at the entrance of its faculty library: “O ye who believe! Stand out firmly for justice, as witnesses to Allah (God), even as against yourselves, or your parents, or your kin, and whether it be (against) rich or poor: for Allah (God) can best protect both. Follow not the lusts (of your hearts), lest ye swerve, and if ye distort (justice) or decline to do justice, verily Allah (God) is well-acquainted with all that ye do.” Holy Quran - Chapter 4 Al Nisa (The Women), Verse 135.

I encourage all of you to become members and put aside any differences in a concerted effort to unify all of our voices as one for the common goals of all. I welcome the new Officers for the organization for a prosperous 2017. I will always be a part of the organization and as promised, anyone can reach out to me for assistance and if it is in my power I will help! With that I bid everyone an early Eid Mubarak!

The New Jersey Muslim Lawyers Association would like to congratulate Patterson Belknap, this year’s Landmark Award honoree, for their recent seminal victory in Islamic Society of Basking Ridge v. Township of Bernards in the United States District Court for the District of New Jersey. After more than a year of litigation, Bernards Township in Basking Ridge, New Jersey settled a lawsuit brought by the Islamic Society of Basking Ridge (ISBR) regarding its denial of a permit to build a mosque. Patterson Belknap’s team, led by Adeel Mangi and including Muhammad U. Faridi, Andrew L. Herz, Diana M. Conner, Alejandro H. Cruz, and Elizabeth C. Quirk, represented ISBR and its President, Mohammad Ali Chaudry, in this litigation to enforce ISBR’s constitutional rights in a suburban New Jersey town.

After a four-year public administrative approval process, the Township denied ISBR’s application to build the proposed mosque in January 2016. Shortly thereafter, Patterson Belknap attorneys filed the action in federal district court on ISBR’s behalf, alleging claims of religious discrimination under the federal Religious Land Use and Institutionalized Persons Act (RLUIPA), the U.S. Constitution, and state law. The U.S. Department of Justice also initiated a parallel civil rights investigation into the Township’s denial of ISBR’s application to build a mosque. In November 2016, the Department of Justice filed its own lawsuit accusing the Township of religious discrimination.

On December 31, 2016, Judge Michael Shipp in the District of New Jersey issued a landmark ruling in favor of ISBR on a motion for partial judgment on the pleadings on the central issue of parking, accepting that the Township’s admissions constituted discrimination under the RLUIPA and separately that their conduct was unconstitutional. That motion earned the support of an unprecedented coalition of 34 amici, including groups of all major religious faiths and the nation’s leading civil rights groups, including the New Jersey Muslim Lawyers Association.

On May 30, 2017, Bernards Township and ISBR signed a settlement agreement, in which the Township must pay $3.25 million to ISBR and must allow ISBR’s mosque application to proceed.

The settlement was covered widely in the media, including articles in The Wall Street Journal, The New York Times, CNN, The Atlantic, The Washington Post, Newsweek, and other local and national publications.

SHARIFA R. SALAAM, JSC Judge Salaam – who was born, raised, and educated in the City of Newark – earned her undergraduate degree in Marketing from Seton Hall University in 1983. Ten years later she achieved her Juris Doctorate degree from Seton Hall Law School, all while raising two adolescent children as a divorced single mother. For nearly twenty five years Judge Salaam has been a loyal devotee of the law, having served as Judge of the Municipal Court in Irvington, East Orange, Orange and Newark; the attorney for the Zoning Board of the Township of Irvington; ABC Board Attorney and Municipal Prosecutor for the Township of Orange; Legal Research Officer for the City of Newark and; Deputy Freeholder Counsel for the Essex County Board of Chosen Freeholders.

Over the years Judge Salaam has presided over legal matters ranging from Personal Injury cases and Real Estate matters, to Landlord Tenant disputes and Divorce resolutions.

Judge Salaam’s nomination to the Superior Court of New Jersey was sponsored by Senator Nia Gill, who upon confirming her vote of yes had this to say: “You will make a wonderful jurist. You will continue your level of excellence that you have portrayed on the courts that you now sit on.

And, you bring to the bench an understanding of not only the law, in both civil and criminal, but you also bring to the bench the understanding of justice and in that understanding how to dispense justice and mercy so that the community can move forward as a whole. And in that sense you are a very unique person to be in this most powerful position and you will be an excellent judge.”

In addition to her unbridled commitment to public servitude, Judge Salaam has remained a constant and active member of her communities, joining with like-minded civil and political activists to advocate on behalf of people, families, and neighborhoods throughout Greater Essex County, particularly in Irvington, East Orange,m Orange, West Orange and Newark. She attributes her success and sense of judicial and civic responsibility to the unyielding support of her family – especially her two children, Sharifa Rashida Salaam II and Abdul-Jaami Omar Salaam – friends, colleagues, and the community-at-large.

“The history and the foundation for my being in this position right now -- to humbly and proudly serve as Superior Court Judge for the State of New Jersey -- is the culmination of a collective effort and much dedication and sacrifice on the part of my family and the community over the course of many years,” says Judge Salaam. “I believe that my integrity and firm belief in our justice system, along with my reputation for being fair and balanced, open-minded, thoughtful, insightful and solution-oriented, will be an asset to the Court. It has been a lifelong aspiration to serve on the bench, and it is most certainly an honor to serve as a Superior Court Judge for the State of New Jersey. I am truly thankful and grateful for this opportunity.”

FREEHOLDER ASSAD R. AKHTER Freeholder Assad R. Akhter was appointed to fill a vacancy on the Passaic County Board of Chosen Freeholders in 2016. In this role he is one of seven Freeholders who have a vote in determining a wide range of issues concerning over 500,000 Passaic County residents and making decisions to help formulate an annual budget of over $450 million.

Apart from his role as a public official, Assad currently works as the Director of Community Outreach for the St. Joseph’s Healthcare System. Prior to this most recent position Assad worked for Congressman Bill Pascrell, Jr. (D-NJ) over the course of 11 years in both his Washington and New Jersey Congressional offices. In his capacity as Deputy Chief of Staff, he was directly responsible for managing the local district offices and staff for the 9th Congressional District of New Jersey.

Before that assignment, Assad served as the Legislative Director in the Washington, DC office where he oversaw the Congressman’s legislative agenda and staff as he was tasked with coordinating the Congressman’s position on the House Ways & Means Committee, as well as staffing his assignment on the House Homeland Security Committee. During his time as Legislative Director, Assad was able to work on a number of momentous pieces of legislation including the Affordable Care Act (ACA), the American Recovery and Reinvestment Act of 2009 (ARRA) and the Dodd–Frank Wall Street Reform and Consumer Protection Act; all of which were keystones to President Obama’s legislative agenda during his first term.

As Freeholder, Assad serves on the Human Services, Planning and Economic Development, Energy and Sustainability, and Budget Committees. He also is also assigned as a Freeholder liaison to the Passaic County Board of Social Services, the Board of School Estimate, the Open Space Advisory Committee and as an Alternate Delegate to the New Jersey Association of Counties.

Assad graduated from Seton Hall University in 2003 with a Bachelor’s of Science degree from the School of Diplomacy and International Relations. He graduated from the Honors program and also received the Undergraduate Leadership Award from the School of Diplomacy and International Relations at graduation.

Assad and his wife Saira are proud to be homeowners in the City of Paterson, residing in the Lakeview section of South Paterson.

Muslims are the adherents of Islam, the world’s second largest religion. By some accounts, there are upwards of seven million Muslims in America. Moreover, according to the Gallup Center on Muslim Studies, the American Muslim community is the most racially diverse religious group in the United States, with African Americans making up the largest contingent in the population (35%). Of those surveyed, 28% of Muslim Americans identified as white, 18% as Asian, and the remaining as “other.” There are an estimated 1 to 1.5 billion Muslims worldwide. On a global scale, Indonesia is the largest Muslim country with about 13% of the worldwide Muslim population.

From a regional perspective, 25% of the worldwide Muslim population resides in South Asia, 20% in the Middle East, 15% in Sub-Saharan Africa, and the remainder is spread out across the world. Russia and China also have sizable Muslim populations. An estimated 20 million to 60 million Muslims live in China alone. Muslims speak different languages, comes from different cultures, eat different types of food, and speak a variety of languages.

Muslims are widely influenced by their local customs, including those found in the United States.

Ramadan is the ninth month of the Islamic calendar. During this month, observing Muslims fast from dawn to sunset. Fasting involves, among other things, abstaining from food, liquids (including water), and smoking, during the daylight hours. Typically, Muslims have a pre-dawn meal before the fast begins and break the fast at sunset followed by the post-sunset prayer.

Ramadan is a special time for Muslims. In addition to fasting, Muslims engage in deeper self-reflection, charity, and consideration of those less fortunate. Muslims tend to be more conscious of their prayer requirements during Ramadan. Lastly, while certain practices are relatively uniform throughout the Muslim community, certain traditions regarding Ramadan differ from culture to culture.
