The Longboat Key Garden Club handed out the seeds, along with various children’s books on gardening, for a “Making Vegetable Soup” event. Preschool-aged children who visited Stillpoint were allowed to pick out one book and three seed packets, all donated by the garden club, in hopes that the kids would learn a little bit about gardening and make their own vegetable soup at home.

Colony: Through the years How did the resort, once revered, get here?

1968 — The Klauber family moves to Longboat Key from Buffalo, N.Y. 1969 — Dr. Murray “Murf” Klauber and a business partner purchase the Colony for $3.5 million and turn it into the first “tenniscentric resort” in America.

1972 — Klauber forms the first condominium hotel rental partnership agreement in the state.

1985 — The Colony is inducted into the Nation’s Restaurant News Fine Dining Hall of Fame.

1988 — Katie Klauber Moulton becomes president and general manager of the Colony.

2004 — The Colony is recognized as the No. 1 tennis resort in the U.S. by Tennis magazine for an unprecedented eight consecutive years.

2007 — Murf Klauber files a lawsuit in Sarasota County, alleging the Colony Association unit owners owe $14.1 million in resort repair costs.

November 2008 — The Colony Association files for Chapter 11 bankruptcy in Tampa, forcing a federal bankruptcy judge to make the final decision on a 2-year-old disagreement between the unit owners and resort operators.

April 2009 — Bank of America files a foreclosure lawsuit against Klauber and seven of his corporations.

July 2009 — A federal bankruptcy judge rules the association

does not have to pay $14.1 million in repairs.

Sept. 22, 2009 — Klauber and Moulton announce hotel operations will be suspended until further notice.

October 2009 — The Colony’s hotel-operating entity files for Chapter 11 bankruptcy, putting the resort’s debts on hold.

December 2009 — U.S. Bankruptcy Court Middle District of Florida Judge K. Rodney May approves the reopening of 100 rooms at the Colony and a $175,000 loan to Murf Klauber.

January 2010 — The Colony’s hotel-operating entity submits a reorganization plan that would renovate the resort at a cost of $20 million.

Feb. 26, 2010 — Developerentrepreneur Randy Langley and businessman-lawyer David Siegal purchase loans for $10 million from Bank of America for Klauber-owned property and announce a plan to revitalize the resort.

LLC, through an agreement with Unicorp National Developments Inc., paid $15,200,001 for an 80% interest in the recreational property — bringing its ownership to 95% — plus 100% ownership of the restaurant complex and Klauber’s former penthouse in an auction.

September 2014 — Unicorp sent demand letters to unit owners warning them they could face liabilities of more than $42.3 million stemming from a longdisputed lease of the recreational property and offering $20,000 per unit and a waiver of liability.

Colony Lender then sued unit owners for $5.1 million for unpaid rent and real estate taxes.

Last year, Unicorp National Developments was chosen by board members of the Colony Association to redevelop the property. The Orlando-based company went on to propose a five-star hotel with 180 condo units in addition to the property’s existing 237 tourism units, requiring the referendum to increase density. Unicorp President Chuck Whittall has held more than a dozen informational meetings to present his plan, at which many Key residents have not been shy about questioning traffic, building height and the character of Longboat.

He’s been praised. He’s been yelled at.

Now, two weeks before the referendum, Whittall delivered a new plan with lower buildings and fewer condominiums. Whittall said he’s reduced the maximum height of planned buildings on his resort from 12 stories to nine. He said he believes buildings with a height of “eight to nine stories” will keep with the character of the Key. He also said he plans to reduce the condominium units to 108.

“We’ve heard the town’s concerns,” Whittall said. “And we’re addressing those concerns.”

The Key’s Planning and Zoning Board members approved language last week that allows additional height — up to 80 feet over elevation — for new buildings, as long as buildings are set back 2.5 times the height of the building from Gulf of Mexico Drive. The recommendation now heads to the Town Commission for discussion and final consideration.

Whittall hopes the board will consider language that regulates height by number of stories, not number of feet.

B.J. Bishop, vice chair of the Planning and Zoning Board, called Whittall’s idea for a storybased height ordinance “a potential can of worms.”

“A story-based ordinance has the potential to be abused,” Bishop said.

Whittall reaffirmed he will not sell the property if the referendum does not pass. Instead, he said his company will “go back to the drawing board.” If it does pass, Whittall still has to submit a detailed plan to the Town Commission for approval.

Last month, Frank Morneau started a political action committee called Preserve Longboat Key Inc. Through the PAC, which Morneau serves as president, he and like-minded Key residents have rallied against Whittall’s plan for the Colony property. In several weeks of operation, the PAC has sent frequent emails and raised more than $25,000 to buy signs and newspaper ads urging a no vote.

If the referendum is approved, Morneau said there will be nothing more he can do. “This is our single hurrah,” Morneau said.

The burden of that decision, Morneau added, would rest only with the Town Commission.

What’s next?

IF THE VOTE IS YES Developer Chuck Whittall says he will move forward and seek Town Commission approval of his new, lower height/lower density proposal, though he is not legally bound to submit that plan.

IF THE VOTE IS NO Whittall insists he will not sell the property. Unicorp will begin working on a new proposal for the property.

“Second, we must keep in mind that if the referendum vote is positive, it is in now binding on the P&Z Board or commission. It would simply be a gateway step to enable the evaluation of the applicant’s specific proposal. My guiding principle is to assure the continuing character of our community, while keeping Longboat as Longboat.

“Third, if the referendum vote is negative, I assume a plan B will be developed for the site, consistent with the applicable zoning regulations. My guess is that such a plan may be somewhat downsized.”

REFERENDUM QUESTION 1 May the Town allow the property located at 5630 Gulf of Mexico Drive and comprising approximately 1.82 acres, to increase density from C-1 commercial uses (which allows no density) to R-6MX residential use (which allows a maximum of six (6) residential units per acre), for a maximum total of 10 residential units on the property?

REFERENDUM QUESTION 2 May the Town allow The Colony property at 1620 Gulf of Mexico Drive (approximately 17.3 acres), zoned T-6 (allowing 6 units per acre) but having a non-conforming density for tourism uses of 13.6 units per acre and 237 tourism units, to increase density to add 180 residential units for a potential density of 24.11 units per acre (417 total units)?

MORE UP FOR VOTES ON LONGBOAT KEY DENSITY Voters will find a second density question on the ballot, though ultimately that’s not really what that referendum’s sponsors wanted.

Mote Scientific Foundation and Brista Homes asked the town in late 2016 to add to the ballot a density request for 1.8 acres on Gulf of Mexico Drive. Brista is under contract to buy the property at 5630 GMD from Mote for $1.35 million.

There’s currently no density set for the site, so the developer needs voter approval for up to six units per acre.

In January, though, attorney John Patterson wrote to Mayor Terry Gans seeking to have the measure removed from the ballot. He wrote the smaller request could “become entangled with issues of density, traffic and scale.’’ The letter went on to request the question be put to the voters on a “standalone basis.’’

Too late, the town responded.

t didn’t take long for four men vying for two positions on the Town Commission to address “the elephant in the room” at a candidate forum Monday at the Bayfront Park Recreation Center.

Longboat Observer Publisher Emily Walsh, who moderated the forum presented by the newspaper, wasted no time in asking how the candidates intend to vote on the looming density referendum.

In their answers, the dynamic between the two sets of candidates was similar: one was direct while the other proceeded with caution.

Gene Jaleski, running for the At-Large seat held by Vice Mayor Phill Younger, said he will vote no on the referendum, as well as any future density expansion on the Key regarding tourism.

“Tourism, which had an impor-

tant role 20 or 30 years ago, is less important to us now,” Jaleski said.

Jim Brown, Jaleski’s opponent, prefaced his answer with a caveat, which had been shared with every Town Commission candidate.

“The Town Attorney has advised us to be very careful in saying anything about this subject,” Brown said, noting the town has been threatened with lawsuits.

However, Brown, who serves as chairman of the Key’s Planning and Zoning Board, said he’s worked to maintain the residential character of the town through means like density restrictions, and he will “never vote for any-

Jack Daly, who is aiming to retain his District 4 seat, also followed the advice to tread lightly.

He remarked that, from what he’s gathered, the majority of Key residents do not support Unicorp National Developments President Chuck Whittall’s plan for the property.

Like Jaleski, Larry Grossman, Daly’s opponent, said he will vote no on the referendum, adding that he’s “not trying to bring Sarasota to Longboat Key.” He also criticized the town commis-

sion for not being proactive about what should become of the former Colony property after it was shuttered more than six years ago.

“Has the commission done anything to create a vision for what the town of Longboat Key would like to see on the site?”

Grossman asked.

While Grossman said he’s opposed to referendums being used as a means to approve or disapprove density expansion on the Key, Daly said he’s in favor of the process.

“It’s a way to get a sense of the

community on any change in density,” Daly said.

Regarding what the candidates think of Whittall’s lower density proposal, which the developer announced last week, Brown recalled Saturday’s Condo Federation meeting, where Brown laid out the town’s zoning codes, which led to a discussion with Whittall.

Brown said Whittall spoke of how lobbies should have 20to 25-foot high ceilings, so the developer believes height restrictions should be based on the

number of stories, rather than a measurement based on feet.

“Does that mean he thinks other stories should be more than the normal 10 or 12 feet?” Brown asked.

“You could end up with an eight story building that’s 120 feet tall,” he added. “It would be massive.”

Jaleski used the opportunity to tell the audience he has “serious questions” about how the town’s zoning codes are written, concerning aspects such as height, noting structures can be higher than 65 feet when parking garages and parapets are considered.

“When you’re talking about a 65-foot building, you’re really talking about an 85-foot building,” Jaleski said.

After formal questioning was completed, the 50-or-so residents on hand got their chance to address the candidates. The last question of the evening came from Key resident Lenny Landau.

He asked the candidates if they believe properties, like the Colony or anywhere else on the Key, need a residential aspect to be financially viable.

“My answer would be no,” Daly said, while acknowledging that high-end condominiums on the Key are particularly lucrative for developers.

Grossman agreed with his opponent about the idea that residential is not necessary, adding that he’s concerned Whittall’s plan will betray what made the original resort a special destination.

“I think we need to avoid that because I feel we’re a special place,” he said. “I don’t want something that looks like it could be anywhere else.”

Whitney Beach Plaza owner aims to sell Owner plans to convert individual storefronts to commercial condos after plans fall through.

Ryan Snyder tried to make it work on Longboat Key. He bought into Whitney Beach Plaza as part of an investor group in 2012, and the shopping center underwent $2 million in renovations. After becoming the sole owner in 2015, he pitched plans for a hotel to revitalize the site after struggling with leasing, but nixed the proposal after Floridays began pursuing a hotel just north of his property.

Last year, a mixed-use project with up to 18 homes failed after residents voted down a referendum to lay the groundwork for the project. This year, he hinted at a solely residential neighborhood.

In the end, he’ll file papers to turn the 5-acre property into a commercial condominium development so he can sell each unit in the plaza individually. It’ll likely remain in its current configuration for the next 50 years, he said.

“I expect it’s going to be hard to get anything done on the residential side, and something has got to get done with this center,” Snyder said. “I don’t want to do this, but I don’t see any other way.”

actually lowers traffic counts, it’s the perception that has mattered.

Nick DeVito II of Ian Black Real Estate will broker the coming sales, and the 11,000-squarefoot “market” building will likely be divided into smaller spaces.

The town doesn’t have a say about whether Snyder can pursue the conversion.

“All we have to do is file some paperwork,” Snyder said.

Although the move will help rid Snyder of the floundering real estate, it may hobble the town’s efforts to create a gateway to the north end and revitalize several properties skirting Longbeach Village.

The Town Commission four years ago amended the comprehensive plan to create the Whitney Beach overlay district, which encouraged redevelopment by allowing mixed-use projects, included flexibility with setbacks, awning overhangs, parking and open space requirements and even allowed for financial incentives, such as infrastructure or landscaping improvements.

The gas station and former bank building on Gulf of Mexico Drive are components of the district, but Whitney Beach Plaza makes up the largest single portion.

“Once the individual spaces become independently owned,

it’s much more difficult to have a redevelopment of the site,” said Planning, Zoning and Building Director Alaina Ray. Although Longbeach Village resident and organizer Pete Rowan said he would have supported a low-density residential plan, he’s not disappointed the center could remain commercial.

“I would like to see the businesses make it in there,” he said.

Longbeach Cafe owner Colleen Collandra said she thinks if the property had more leasing promotion, the center could thrive — as her business is — as full commercial. Although it’s too soon for her to determine whether she’ll

buy her unit, she has one-and-ahalf years left on the lease.

“At least I have that time to figure it out,” Collandra said.

But Pat Neal, who built the plaza in 1970 and opened Food Way in October of that year, said the property in its current form will never be competitive with other options on the south end. And with an aging population, residents just don’t spend as much money as they used to on the island.

Robyne Richardson, owner of Beach Fitness 24/7, said she was excited about the prospect of some residential being on the property, but wasn’t too disappointed about the commercial condominium prospect. With individual owners, she said each tenant might get more attention, but has reservations about maintenance.

For example, the seawall behind the plaza needs to be replaced, and all the units owners would have to pitch in for that under the new arrangement.

Snyder said this is the only unsuccessful property in his portfolio.

“I never thought it would come to this,” he said. “Pat Neal said some 30 years ago when he owned this property that it would never succeed as commercial, and fast forward to 30 years later, what he said rings true.”

Longboat voters have seen these four candidates before. Two have proven records on the Town Commission.

I

t seems like a Yogi Berra moment — déjà vu all over again. Once again, Longboat Key voters have begun voting and will be going to the polls March 14. And when they open their ballots, they’ll see familiar names.

Hey, weren’t these guys on the ballot last year?

Well, it wasn’t last year, but they were in 2015 and 2013.

We’re referring, of course, to the status quo challengers of Gene Jaleski and Larry Grossman. They’re appearing on Longboat Key’s Town Commission ballots for the third consecutive election — Jaleski for an at-large seat, Grossman for the District 4 seat. Perhaps the third time will be a charm.

That would be a shocker.

Town Hall insiders, as well as regular readers of the Longboat Observer, know Daly Jaleski and Grossman well. They are almost fixtures at town government meetings, and frequently at those meetings you can count on them to offer opinions that always challenge the status quo.

Jaleski has been tryGrossman ing for two decades — to little avail — to persuade the town to change course on beach maintenance.

He can cite at great length research of what other beach communities around the world have done to address erosion. At times, we have endorsed his ideas — at least to give them a try.

In 2009, Jaleski won a seat on the commission in an upset over incumbent Randy Clair. But it wasn’t long before Jaleski himself — and town voters — recognized that he didn’t fit with the other town commissioners. Jaleski resigned.

But he continues to challenge commission incumbents, in part, and to his credit, because he chafes at the thought of anyone winning a seat on the commission by default. Give Jaleski credit for his devotion to wanting to make Longboat Key a better place.

You can say the same for Grossman. His heart and intentions are in the same place. GrossBrown man, a former planner from Alexandria, Va., always has been a long-time advocate for updating the town’s comprehensive plan and zoning codes. He was an early advocate for trying to persuade Publix to create a town Jaleski center when it developed the Shoppes at Bay Isles.

But if truth be told, Grossman can’t seem to overcome in voters’ eyes that he holds the permanent position as the town resident whose job is to question the Town Commission and planning and zoning board. Every municipality needs that watchdog; Grossman does it well.

Together, however, Jaleski and Grossman do not measure up to incumbent Jack Daly and former Mayor Jim Brown. They are competent candidates who have demonstrated the knowledge, thoughtfulness, judgment and temperament required of

Longboat Key commissioners.

In 2015, Longboat Key voters recognized Daly’s attributes as a four-year member of the Longboat Key Planning and Zoning Board and his 20 years on the board of the Club Longboat condominium. Add to that his professional career as a longtime senior executive with Columbia Gas and CEO of the Interstate Natural Gas Association.

In his two years on the commission, Daly has applied his wisdom well. In fact, asked the difference between himself and his challenger, Daly made an accurate self-assessment when he told the Longboat Observer he has demonstrated an ability “to work well through different issues and personalities while assimilating facts, listening to input from other commissioners and members of the community and then making decisions that are in the best interests” of Longboat Key residents.

While Daly still is learning nuances of being part of government, Jim Brown would bring back to the Town Commission a well-proven record of competence.

You would be hard pressed to find anyone more knowledgeable about Longboat Key zoning and town government in general than Brown. An architect by profession, Brown has been involved in Longboat government for two decades, volunteering as a member of the planning and zoning

board before being elected to the Town Commission in 2009.

In the six years on the commission, four of them as mayor, Brown found himself leading, navigating and mediating the commission through some of its most trying times in two decades.

And he did it competently. In fact, it’s worth reprinting our comments from March 2015, when Brown had reached his term limit and was leaving the Town Commission: “[W]e hope his successors will always keep him and his characteristics, in mind: an elected official who kept taxpayers first; who maintained his composure and patience; who became tough and curt when necessary; who had ample humor and humility; and who had a skill for bringing differing views and personalities to consensus.”

As the town continues its journey to install underground utility lines; redevelop the Colony; redevelop and expand the Longboat Key Club and Resort; create a town center; implement steps to improve traffic flow; and rework zoning codes that allow for development creativity while preserving the character of the Key, it’s clear who the best two candidates are this year.

We recommend: District 4 Town Commission — Jack Daly; at-large Town Commission — Jim Brown.

THE DENSITY QUESTIONS There are two requests on the town ballot for approval to add additional residential units to the Key. Unicorp Development is seeking a 180-unit increase at the Colony Beach & Tennis Resort site; Brista Homes is seeking 10 units at the vacant Mote Foundation property at 5630 Gulf of Mexico Drive.

Each of them deserves separate consideration.

THE COLONY

The more you hear Orlando developer Chuck Whittall, the more you believe he has come around to understanding what Longboat Key is and what its residents want and don’t want.

To that end, it was encouraging to read late last week that Whittall announced he is downscaling his proposed five-star development for the Colony Beach & Tennis Resort property. He now says he wants to develop eight- and nine-story buildings, down from 11 and 12 stories; and reduce his request for additional residential density to 108 residential condominiums from 180.

He pledged — with earnest seriousness, we might add — at a Saturday forum of the Federation of Longboat Key Condominiums that he wants to develop a stunning, firstrate project that fits with Longboat Key’s character.

Questioned Saturday by an audience member why Longboat Key would even want a five-star resort, Whittall was puzzled: “Why wouldn’t you?” Whittall always looks at the portion of the glass that is half full. When he thinks of the difference between a four-star and five-star resort, he thinks of the enhanced values created — not just for his property but for all of Longboat Key. Instead of $1 million in landscaping to buffer the redeveloped Colony along Gulf of Mexico Drive, he said, you would have $2 million with a five-star property. “Why wouldn’t you want that?” he asked.

Whittall’s compromise is a major step, and one that rational, forwardthinking Longboaters can embrace.

We would support it.

Unfortunately, Whittall’s recalibration for the Colony property is not likely to sway Longboat voters to move in his favor on the Colony density referendum on the town ballot — at least not this time.

While Whittall is making the commitment before the election to downscale his project from its original size, the ballot question remains the same. It still will ask voters if they want to allow the Colony property to increase residential density to add 180 residential units.

But Longboaters are skeptical. A “yes” vote on this referendum would grant to the owner of the Colony property in perpetuity the ability to continue petitioning the town for up to 180 new units. As we know, Longboaters don’t want that.

Typically, we support wide development latitude for property owners. But knowing the history and character of Longboat, we’ve known from the start Whittall’s referendum wouldn’t fly. The reality is he’ll need to come back for another vote.

MOTE FOUNDATION PROPERTY

We made the case a month ago that Longboat voters should approve Brista Homes’ request to rezone the long-vacant Mote Foundation property at 5630 Gulf of Mexico Drive to residential use — allowing six units per acre, or in this case 10 units on the 1.82-acre property.

Believe it or not, converting this property from commercial to residential use would assure less intensive use and traffic. That’s always the case when you downzone.

But a “yes” vote also would have this beneficial effect: It would add value to the Key, not just in tax revenue that will generate more than a vacant property, but also because 10 residential units will enhance the neighborhood.

There’s one more benefit: The $1.35 million sale price would give the Mote Foundation additional funds to support its environmental causes.

We recommend: Yes on the 5630 Gulf of Mexico Density; no on the Colony density.

The recent editorial urging Longboat Key’s residents to vote “Yes” on the referendum for the Mote Scientific Foundation property is spot on. It’s time for the property to be put to a productive use consistent with the quality and low residential density that would be appropriate for this area of Longboat.

Your editorial did contain a statement that could possibly be misconstrued. You stated, “Who knows if Brista Homes wants to develop a maximum of 10 units.” This suggests that more than 10 units could possibly be constructed on the property if the referendum passes.

Any such suggestion would not be correct. The referendum question itself, if approved, specifically limits development to a maximum of 10 residential units. That is all; not one more. If approved, there will be homes for 10 families constructed with an island charm in a matter to maximize open space and with extensive landscaping. We realize that emotions run strong and opinions differ regarding the Colony referendum question. We submit that the referendum question on the Mote Scientific Foundation property, as your newspaper has noted, is a different issue for a different property for a vastly different use, and a “Yes” vote is in the best interest of the residents and taxpayers of Longboat Key. Collaborative process would work best My wife and I have been residents of Longboat Key for over 12 years and have been thankful for the natural beauty of the island. The Colony referendum to increase the density from the already nonconforming 13.6 units per acre to 24.1, a 77% increase, severely challenges this uniqueness and for this reason, we encourage a “No” vote.

The proposed site plan (as of mid-February) for the Colony redevelopment with the higher density shows four buildings of 12 or more stories and another building of five to seven stories.

To achieve the high number of 417 units (vs. 237 now), the plan appears to minimize any setback distance, particularly along the sides and oceanfront, and relies on building height considerably beyond LBK code. This is disturbing to us as residents of Aquarius since the tower-like structure nearby would shadow at least partly our pool and building.

Just this past week, though, the LBK Planning and Zoning Board has decided to recommend to the Town Commission certain restrictions to the Planned Unit Development (PUD) regulation, one stating a maximum structure height of

80 feet. And Unicorp has now proposed the building heights in its plans will be not more than “eight or nine stories” rather than the 12-plus stories.

So, Unicorp realizes high-rise buildings aren’t liked here — and besides the code will probably require this.

I must say the illustrative concept site plan presented by Unicorp last month caught us by surprise. During the past two months, Unicorp has been communicating their vision for the Colony, but unfortunately it doesn’t align with the town’s vision exemplified by the simple phrase “Keeping Longboat Longboat.” Others have expressed better than I what this vision means. I would like to focus on what happens after the referendum and Unicorp, or other developer, offers hopefully a better alternative.

Going forward, an effective approach to achieving buy-in, especially from the community, might be to use a collaborative, participative work process whereby major stakeholders (e.g. developer, community leaders, neighborhood groups, town zoning and planning and regulators) work together jointly and early on in a team effort. It sounds rather idealistic but it can work. Public hearings provide community members the opportunity to comment and are helpful but their input is usually reactive and not very interactive with other stakeholders. Rather than reacting to analyses, conclusions and recommendations already prepared, community members can be more participative and proactive if they are part of the planning process.

This Colony redevelopment team would ensure the vision proposed for the site is consistent with the town’s and would agree on key design concepts, plans and requirements, including compliance with code restrictions and evaluation of impacts to the neighboring residents, community and environment.

Integrating this approach

into the town’s PUD process would ensure adequate input from all concerned parties prior to review of any proposed departures from code, or the conceptual site plan and final site plan. Since it can lead to enhanced trust, less contention, and ultimate buy-in, it should be considered for the Colony whether or not the referendum is passed.

To be clear, we are in full support of redeveloping the Colony and would like it to start earlier, rather than later.

But we do not support the higher density required to squeeze several buildings into a relatively small area. Along with this would come more traffic on already congested roadways. And finally, perhaps most importantly, is the cascading effect this referendum could have on the 47 other non-conforming properties.

If passed, these others could likewise expand their number of units — think of that! And also think of using a collaborative, more participative approach to achieving buy-in from all interested parties as the planning process unfolds.

We respectfully ask that LBK voters declare “No” on the March 14 Colony referendum ballot.

You can’t put a price on island’s character This letter is being written to urge LBK voters to vote “No” on the Colony referendum.

My wife, June, and I have been owners at Tencon Beach Association since 1997. I am a Florida resident. I have been the president at Tencon since 2003. Tencon is located directly south of the Colony.

From the late 1970s until the Colony closed in 2010, Tencon leased approximately 2.3 acres to the Colony. That land included nine tennis courts, a

basketball court and a parking lot. In addition to rental income from the lease of our land, Tencon owners enjoyed full membership privileges at the Colony. Those benefits included room service, beach towels, access to the concierge for golf and other reservations, free maintenance of our beach and grounds, the use of the pool and the spa, the use of the health club, and free tennis.

This didn’t include the benefits of just being next door to the Colony, which included three restaurants, the deli for morning coffee and a newspaper, and quality boutiques.

When the Colony closed, these amenities disappeared. If anyone would welcome a new hotel at the Colony, it would be Tencon.

For this reason, I was excited when Chuck Whittall contacted me in early 2016 to discuss his plans for a new five-star resort and his interest in striking a deal with Tencon.

Beginning in early 2016, we met with Chuck three times.

Our conversations centered on exchanging Tencon’s land for cash and 10 permanent memberships at the proposed hotel.

When we were unable to reach an agreement over the sale of the land, Chuck proposed that if Tencon’s owners would support the referendum, Tencon would be given the 10 permanent memberships without cost, and could keep its land. This appeared, at first blush, to be too good to be true.

I then looked at the referendum and the schematics of the proposed property, and began to understand what a density of 417 units means. Those who say that the schematics remind them of Fort Lauderdale are being kind. A more apt comparison of the fortress-like walls ringing the perimeter of the property, within feet of neighbors to the north and south, and extending twice the height of the adjacent properties, is to a Las Vegas casino.

Although Chuck has recently emphasized his flexibility, there is, in my opinion, no good way to cram 417 units onto 17 acres. A reduction in height would mean reduced side setbacks and aggressive seaward construction. Less aggressive seaward construction would require greater height and reduced side setbacks. Greater side setbacks would have to be offset in either aggressive seaward construction or greater height.

Tencon owners will not accept money, membership packages or consideration of any value to support the referendum. You can’t put a price on the character of this island.

Several points on why to vote ‘no’ I am hoping the March 14 referendum on a permit requesting increased density at The Colony Beach & Tennis Resort will not pass.

is a constant issue requiring planning just to manage where and when one goes anywhere off the Key. Adding substantially more traffic during and after the development is a huge negative. The developer may argue the percentage increase is nominal and propose potential solutions. Three points: 1) it is not nominal, it is excessive; 2) the town and taxpayers will be required to pay for and maintain such solutions, not the developer; 3) the increase in density and height for this property will lead to additional requests. The time to stop this potential density increase on Longboat is now. Also, can someone please explain to me how 180 incremental new units would reduce traffic on the island? We have traffic issues with no residents on the Colony property as it is.

Infrastructure: How can higher towers that will block the light and views of existing neighbors be a positive? More buildings and possibly having them closer to the beach are not positives. How can the latter even be considered?? It is incumbent on us to protect our environment (beach, dunes, wildlife ...) not hurt and possibly destroy it via this kind of excessive development. What about the impact on the roads and town resources caused by something of this nature being built? How about the impact on emergency fire and medical services? I am for the Colony being restored in a responsible way. If done correctly, this will benefit our community by providing jobs and tax revenues.

Sadly, the proposal at hand works against protecting the

island that we all love and sets the stage to completely ruin the existing environment that makes Longboat Key the paradise that it is. Everyone we know that has ever visited Longboat absolutely loves it.

Colony parcel can’t handle all that is proposed We all want to see the Colony redeveloped, but not with the proposals that Mr. Whittall has put forward.

It never ceases to amaze me that developers try so hard to put as much as they can on a parcel of land. It looks from the pictures as if we are in Miami.

This development would, and it will not sit well in the surroundings of Longboat Key. A two-story garage, highrises on this parcel of land is overkill.

The traffic that this development is going to generate beggars belief, as in the season now, it can take more than an hour to get to Sarasota.

Estimated movement to and from the new Colony on any given day is 1,000 guests and residents and all the deliveries etc. ... enough said. Can this beautiful parcel of land take all that Mr. Whittall is proposing?

Fruitville Road changes between U.S. 301 and Tamiami Trail “must be vigorously opposed,” Longboat Key Mayor Terry Gans told a meeting at Sarasota’s City Hall last week.

Addressing the presenters of a two-option proposal for the east-west thoroughfare in downtown Sarasota, Gans said he understands a desire to connect neighborhoods in Sarasota to the downtown district, but these motives do not address Fruitville Road’s role as an arterial roadway and have consequences.

“Fruitville Road is a critical element of the regional transportation network,” Gans said in his prepared statement. “Like it or not, it does not exist in a vacuum of Downtown Sarasota.”

Gans noted how Fruitville Road moves traffic to Interstate 75 from not only the Key he serves, but also places such as Bird Key and Lido Key. He argued that construction has already strained traffic flow.

The mayor implored planners to examine more options.

Gans was one of about 100 people in attendance who

watched as Sarasota Chief City Planner Steven Stancel and design consultant Michael Wallwork laid out the two options of the city’s proposal.

One option includes reducing Fruitville to a twolane road between North Lemon Avenue and Cocoanut Avenue, with roundabouts at those two intersections as well as Central Avenue. Bicycle lanes would be removed, and sidewalks would be widened to 16 feet along the three-intersection stretch.

The alternative includes widening sidewalks to 10 feet and nixing bike lanes.

Key Commissioner George Spoll, who also attended the meeting, shares the mayor’s concerns. He said he was astonished that Fruitville Road’s role as an east-west artery that serves all of the barrier islands was not brought up.

“That is a major route,” Spoll said, adding the potential for delays during a hurricane evacuation is worrisome.

No matter what happens, Gans said one thing will remain certain about Fruitville Road.

“It’s going to remain a key artery,” Gans said. “You can’t just wish it away.”

The Ronald A. Johnson Memorial Fund will help support Mote’s biomedical research to advance studies on cancer-fighting compounds from sharks, a statement from Mote said. The funding has also been matched by several other gifts, including support from the Rick and Nancy Moskovitz Foundation.

Buchanan returns from Afghanistan U.S. Rep. Vern Buchanan, R-Longboat Key, on Feb. 27 returned from a nine-day trip to Afghanistan and other countries. During his trip, which focused on national security, he visited troops from Florida and was briefed on counterterrorism efforts by Army Gen. John Nicholson, the U.S. commander overseeing operations in Afghanistan. Buchanan said American leadership in the Middle East and Africa is critical in combating radical Islamic terrorism, according to a news release issued by his office.

Town commissioners considered an ordinance last week that, if approved, would alter the way Longboat Key’s town code is enforced.

The ordinance would allow the Code Enforcement Board to continue issuing liens for code violations, but it would also give code enforcement officers the option to issue citations with monetary fines, similar to parking tickets.

Commissioners also discussed the possibility of eliminating the Code Enforcement Board altogether, but that action would require a change to the city’s charter.

At a commission workshop, Town Attorney Maggie MooneyPortale spoke of a recent situation in which a licensed contractor, hired by a Key property owner, was improperly using a storm drain.

If the officer had the option to issue a citation on the spot, the contractor could have been held accountable instead of the property owner, Mooney-Portale said.

The ordinance would also add a special magistrate to hear coderelated cases. While the Code Enforcement Board is composed of Key residents, the special magistrate would be a member of the Florida Bar who does not live in the Longboat community.

Hein said one of the aims of the ordinance is to encourage code compliance during crucial times such as turtle-nesting season.

The citation option would allow the town the ability to take some measure against renters or visitors who are violating codes.

If issued a citation, the violator could either pay the fine, contest the citation or appear before the special magistrate.

Such a hearing could be scheduled faster than setting up a Code Enforcement Board meeting.

Hein stressed that citations would only be issued after code enforcement officers have made informal attempts to gain compliance, such as by telling people they are violating the town code.

“Our goal is not to gain revenue,” Hein said. “Our goal is to gain compliance.”

Commissioners expressed concerns about how code officers would use discretion, with no guidelines, to determine how to approach violations.

“We could have a situation where the exact same thing could happen, even on the same day, one person would get a citation, one person would get a lien,” Vice Mayor Phill Younger said. “I’m not comfortable with that.”

After discussing elimination of the Code Enforcement Board, the commissioners set aside further action until after the Charter Review Committee has been appointed.

Our referendum is for 5630 Gulf of Mexico Drive and we are requesting to change the zoning from commercial to residential R6, which is low density and only permits a maximum of 10 units. Traffic will be reduced substantially under the proposed residential development as opposed to commercial development. For example, a 150-seat restaurant or other commercial use would include additional traffic for employees, vendors and suppliers, as well as patrons. Additionally, most of the 10 future home owners will likely be part-time residents, further reducing traffic impact.

Our proposed high-end residential development would significantly increase the tax base. Currently, the property is unproductive for the tax base of the Town.

The $1.35 million proceeds from the sale of the property to Brista Homes, a local and respected residential builder, will go directly to the Mote Scientific Foundation.

The proceeds will be used to continue the Foundation’s charitable giving to Sarasota/Manatee community organizations and marine research and conservation, all honoring the legacy of William R. Mote, as described in more detail in the Foundation’s statement below.

The Cottages at Mote Cove will utilize a design consistent with the character and ambiance of Longboat Key. The proposed development will include beautiful landscaping, a community outdoor amenity center with a pool, cabana, fire pit, grilling station and boat docks. This is the number of other non-conforming properties on Longboat Key that could decide to increase their densities if the Colony referendum is passed, according to the LBK Revitalization Task Force. This would potentially add many more residential units than the 180 proposed by Unicorp and change the nature of our beautiful key forever. According to the Task Force, “Even a single “yes” vote in the March referendum sends the wrong signal to developers.” January 9, 2017 Further, according to a March 2015 comprehensive economic and market analysis prepared for the Town of LBK by Florida Economic Advisors, “...Longboat Key is already heavily developed and densely populated, leaving little room for future net expansion of the residential sector.”

This is based on forecasts developed in the study that supportable new development will range only from 70 to 150 residential units over the next 15 years -- compared with Unicorp’s 180 built within three years. And this does not include additional units which might come from the other 47 properties.

The early-bird preview for the St. Mary, Star of the Sea, Royal Rummage Sale isn’t until noon on Friday, March 3, but some people will be ready hours in advance.

Rummage sale co-chairwoman Ingrid Wisniewski is expecting shoppers to start lining up around 9:30 a.m as they have in years past. She said some people bring chairs, snacks and drinks to tide them over until the doors open.

The Royal Rummage Sale has been a staple of the church for the past 10 years. However, Wisniewski said St. Mary has hosted a rummage sale every year since its inception in 1973. But in the past decade, the sales have grown, earning it the royal moniker.

The church collects donated items from the end of July through February. From clothing and linen to shoes and luggage, the sale has something for everyone.

“It’s everything that you can use in a household, from picture frames to pots and pans to dishes and silverware,” she said.

The items come from people all across Longboat Key and beyond.

In return, the proceeds go to local charities.

The charities, Wisniewski said, “range from both faith-based and interdenominational charitable activities,” Wisniewski said.

The early-bird sale costs $5 and runs from noon to 4 p.m. on Friday, March 3. The sale is free and runs from 9 a.m. to 1 p.m. on Saturday, March 4. Both will take place at St. Mary, Star of the Sea, Catholic Church, 4280 Gulf of Mexico Drive. Don’t worry if you can’t make it to the early bird sale, Wisniewski said. She expects a big crowd Saturday because plenty of items are available.

Ospreys return to site of New Pass nest removal The nest was obscuring a traffic signal, according to the Florida Department of Transportation.

On Tuesday, Feb. 21, work crews removed the next on the New Pass Bridge, as transportation officials said it obscured the bridge signal.

At least one osprey on Longboat Key should get points for domestic persistence.

Built on a support bar for the drawbridge signal on the New Pass Bridge, an osprey nest was removed Feb. 21 by a work crew connected with Florida Department of Transportation. By Feb. 24, the bird was back at it, returning to its original homesite with a fresh batch of twigs and other nest necessities.

A spokeswoman for FDOT said the nest was abandoned and obscuring a portion of the drwbridge traffic signal.

Susan Gilmore-Clarke, a Longboat Key resident who wrote a letter to the Longboat Observer wondering why we can’t just coexist with local birds, had another take after seeing the bucket-truck crew at work that morning.

“Later in the afternoon, I was headed to (St. Armands) Circle, and I saw her off to the side, mournfully looking for her nest,”

ABOUT OSPREYS Size: About 2 feet tall. Wingspan is about 6 feet.

Markings: Head and undersides are white with an upper body of brown. A black stripe crosses the eyes and extends to the wings.

Nesting: Females lay two to four eggs that incubate for about a month. Both male and female ospreys tend to the eggs. Young ospreys fly about 55 days after hatching.

“It’s heartbreaking. There has to be a way.”

According to spokesman Robin Stublen, FDOT has a districtwide permit to remove osprey nests from department-owned poles at any time, but if ospreys are actively nesting, a wildlife biologist accompanies FDOT during the removal. This biologist advises FDOT on how to safely relocate active nests, Stublen explained.

Officials from Save our Seabirds Inc., just down the road from the bridge, say ospreys need to nest near water to hunt, and typically like to be higher than their surroundings to better see predators.

When possible, ospreys reuse nests.

It’s possible the same birds have been returning to the drawbridge site for four years, according to Save our Seabirds.

Gilmore-Clarke said she has seen a nest in the same drawbridge location previously. Last year for sure, possibly longer. And another nest is either under construction or occupied just a few hundred yards north of the bridge on a traffic signal pole.

According to Cornell University’s All About Birds publication, if left undisturbed, an osprey nest can be enlarged and expanded from year to year, growing from an original size of about 2.5 feet in diameter to something large enough for a human to sit in.

Ospreys are migratory but become less so in coastal areas of South Florida, according to the state FWC. So here, much like the human population, there are a mix of full-time residents and those from “up north.’’

Gilmore-Clarke wonders why we can’t all just get along.

“You build a nest, come back home after a while, and find it’s not there anymore,” said Gilmore-Clarke. “Just let it be.’”

Stuart James McEnerney, 87, of Hamden, Conn., died Feb. 9.

He was born in Derby, Conn., to the late Stuart and Mary McEnerney.

He received his bachelor’s degree in education from New Haven State Teachers College and later earned his master’s degree in audio-visual education

He was the department chair of math and science at Gateway Community College, where he taught mathematics for 30 years.

He was an adjunct professor at the University of New Haven, Southern Connecticut State University and Valencia Community College in Orlando.

He and his wife, Mary, owned and operated Mac’s Auto Driving School. He was active in politics and was the former Democratic chairman in North Branford, Conn. He was active in Hamden, serving as a member of the Democratic Town Committee, the Charter Commission, the Hamden Library Building Committee, and the Hamden Library Board. He was an active parishioner of St. Rita’s Church.

Before returning to Hamden, Stuart lived on Longboat Key and in Ponte Vedra.

He was preceded in death by his wife, Mary Gertrude Foley McEnerney, and his second wife, Margaret Shoulta.

He is survived by his children, Kathy Avery, Eileen O’Neill, Lynn Pfeiffer, Jean Stevens, James McEnerney, Edward McEnerney, Christopher McEnerney and Stuart McEnerney; 14 grandchildren; two stepchildren, Kathaleen and Ken Kuiper; three step grandchildren; and his sisters, Jeanne Davidson and Mary Jane Hohenshelt; and several nieces and nephews.

One of Florida’s largest hotel owners plans to redevelop the former Helmsley Sandcastle Resort in Sarasota and add 128 rooms to the beachfront property.

Ocean Properties Hotels Resorts & Affiliates seeks to raze the existing hotel, completed in 1953, and build a 304-room hotel and related space in a pair of towers slated to rise nine and 10 floors, according to a development documents submitted to Sarasota city officials.

“In order to be competitive, they need to update the hotel and make it a more contemporary beach resort,” says Bruce Franklin, president of Land Resource Strategies, the real estate consulting company working with Ocean Properties on the proposal.

The new hotel, on 6.1 acres on Lido Beach, could be completed in 2019, if required approvals from Sarasota are forthcoming.

Franklin says the new 1540 Benjamin Franklin Drive hotel would also offer roughly 20,000 square feet of meeting, ballroom and restaurant space.

The new hotel is being designed

by Nichols Brosch Wurst Wolfe & Associates Inc. Ocean Properties’ plans come as roughly 1,000 hotel rooms are being constructed or planned in downtown Sarasota.

Franklin says Ocean Properties’ proposal likely won’t be affected by the new rooms downtown, the majority of which are expected to open for use by 2018.

“Downtown and Lido Beach are truly two different markets,” Franklin says. “The beach is much more tourist-oriented, whereas downtown tends to be more of a business market.”

Ocean Properties’ officials could not immediately be reached for comment on the proposal.

In all, Ocean Properties owns more than 100 hotels containing 17,000 rooms throughout North America, according to its website.

In Florida, the company owns the Lido Beach Resort; the Holiday Inn Lido Beach; The Resort at the Longboat Key Club; the Zota Beach Resort on Longboat Key; Sanibel Island Beach Resort; and the Edgewater Beach Hotel in Naples, among other hospitality properties.

ote Marine Laboratory and Aquarium has some new kids on the block, and they’re ready for their time in the spotlight.

Mote opened its “The Teeth Beneath: The Wild World of Gators, Crocs and Caimans” exhibit Feb. 25, allowing visitors two levels to view the three spectacled caimans and one American alligator from eye level and underwater. The 1,000-square-foot exhibit includes two aquatic areas and wetland space that the animals can access.

The three caimans — Dorothy, Blanche and Sophia — are almost 4 years old and came from the Everglades, where they are an invasive species. Rose, a nearly 6-year-old alligator, came from another Association of Zoos & Aquariums-accredited Florida organization. Inside Mote’s “Oh Baby! Life Cycles of the Seas” exhibit, is a juvenile crocodile named Ricky, who came from a

private owner.

Evan Barniskis, assistant vice president for Mote Aquarium, said the exhibit turned out better than he imagined. Brian Siegel, senior aquarium biologist, who will oversee the crocodilians’ care, said the exhibit has been a long endeavor. He said the gator and caimans are diversifying Mote’s already expansive collection of animals, including otters and sea turtles.

“We want to showcase a new dynamic animal at Mote,” he said.

“These animals do tell a fantastic conservation story. They are a top predator in our ecosystem here in Florida, so they are necessary to have in our environment.”

The “Teeth Beneath” exhibit is continuing Mote’s mission of explaining to visitors the importance of watersheds and conservation, something the aquarium did through the “Otters & their Waters” exhibit.

“We really wanted to continue with the watershed theme that we did with the otters,” Barniskis said. “We really want our visitors to understand the importance of

conserving our local waterways to rivers, lakes, streams and watersheds because everything that goes into those waters and affects those waters, eventually goes into our oceans,” he said.

Around the exhibit are various signs about the animals that will teach visitors fun facts about the two species. For example, crocodilians can produce 3,000 teeth during a lifetime, and during nesting season, females make nests using mud and plant material. The signs also explain how the crocodilians are taught certain behaviors that will help Mote staff provide the right care. They

are target-trained with positive reinforcement to ensure that each of them receives the right amount of food and correct nutrition. The training will also help prepare them for veterinary checks and procedures.

There is no end date on the exhibit, Barniskis said. They are just happy for it to be open to the public. He does, however, see the crocodilians sticking around for awhile.

“They’re young ladies now, but they’re going to grow with us,” he said. “They’ll be with us their entire lives. The really neat thing about alligators is they can live about 30 years in the wild, but in human care, they can live up to 50.

We’ll have these ladies into their old age.”

The exhibit is in the Ann and Alfred E. Goldstein Marine Mammal Research and Rehabilitation Center.

At 2 p.m. daily, Mote’s animal care specialists will work with the animals and narrate to guests more information about the biology and behavior of the crocodilians.

ith bright smiles and trendy clothing, the models were ready to take on the runway Feb. 13 for the sixth annual Christ Church of Longboat Key Fashion Show.

Before the fashion show, the ladies enjoyed lunch and dessert served by some of the members’ husbands, who all wore the same outfit — khakis and white button-down shirts.

The fashion show, which took place at the Presbyterian church, featured ensembles from Natural Discoveries, a women’s clothing store located on St. Armands Circle. The nine models, who were members of the church, and women of Learn to Fish Recovery Center walked the runway twice showing off outfits from the store.

Proceeds from the event benefited the church’s missions and Learn to Fish, a nonprofit organization that serves as a residential recovery center for women and children.

ird Key Yacht Club has a new group of leaders after its 56th Change of Watch.

As guests arrived for the big event Feb. 18, incoming and outgoing officers lined the entrance and greeted everyone.

The evening was a celebration of an end and a beginning. The 2016 officers’ terms ended as the 2017 officers were sworn in after a cocktail hour and dinner.

New officers include Commodore Charlie Wilson, Vice Commodore Bob Williams, Rear Commodore Curtiss Schantz and Fleet Captain Paul Bolton.

Wilson said he is looking forward to a good year building friendships and relationships with the club.

Prola, who died in July, often planned annual golf outings for the Men’s Club.

To honor him, the club held a Don Prola Memorial Golf Tournament at IMG Academy of Golf. About 50

people attended the event that included a buffet lunch before a round of golf.

As they signed in, each attendee got a card with “Lessons from Don” on the back. Some of his lessons include “stay positive and be confident” and “have fun and take the good with the bad.”

Longboat Key Fire Chief Paul Dezzi and Town Manager Dave Bullock spoke to the club about local issues including taxes, the Colony redevelopment, emergency medical services and traffic.

Library celebrates 60 years

T

he Longboat Library was anything but quiet on Feb. 24.

But, as co-president Mary Baker said, Longboat’s library isn’t one where people are sssshhhhh’ed, anyway.

This chatter was different, though. It was in honor of the library’s 60th anniversary. In 1957, a group of women opened a library in a local storefront, and the rest is history. Today, 55 volunteers run the library and its 6,000-book collection.

The little library was crowded for its anniversary event as guests visited near the bookshelves to celebrate the only place books are loaned on the Key. The friends and volunteers of the library in attendance enjoyed light refreshments, including appetizers from The Lazy Lobster and wine from Bob and Pat Gussin’s vineyards in New Zealand.

Co-president Hazel Steskal also presented the Gussins, owners of Oceanview Publishing, with a lifetime membership to the library as a thank you for their book donations.
