The Sovereign Yidindji Government, as the representative body of the Yidindji Nation, an indigenous nation of what the Commonwealth of Australia know as Cairns, Far North Queensland, Australia, find it necessary to write to the United Nations Human Rights Council regarding the apparent support by the United Nations for the Uluru Statement from the Heart, and comments made by members of the expert panel condemning the position adopted by the Commonwealth of Australia and Prime Minister Turnbull in rejecting the proposal as put forward by the expert panel on the recognition of indigenous peoples.

Whilst there are many truths contained in the Uluru statement, the expert panel are putting forward an idea, that is at its heart discriminatory, something that is undemocratic and wrong.

The expert panel of the Referendums Council on Constitutional Recognition of Aboriginal and Torres Strait Islander peoples consisted of experts in the fields of constitutional law and international law made the statement that the sovereignty of the Aboriginal and Torres Strait Islander peoples had neither been ceded nor extinguished, and co-exists with the sovereignty of the Commonwealth of Australia.

This statement is correct, and as in our case, the sovereignty of the Yidindji Nation has been verified by numerous Native Title Determinations handed down by the Federal Court of Australia as existing and separate to that of the Commonwealth of Australia.

Prime Minister Turnbull on behalf of the Commonwealth of Australia rejected the proposal as put forward by the expert panel as being unacceptable to the Australian citizenry and out of step with the Australian values. A position that the Sovereign Yidindji Government endorses.

The Sovereign Yidindji Government, though not yet allowed to participate in the life of the Commonwealth of Australia cannot and will not support undemocratic and discriminatory principles.

The Sovereign Yidindji Government in conveying this message to the Commonwealth of Australia has offered to settle the past and secure the future of the Commonwealth of Australia and the Yidindji Nation. This offer of treaty or formal agreement is the correct method to ensure that the principles of democracy and non-discrimination are not impinged upon.

To further explain the position taken by the Sovereign Yidindji Government in supporting the position taken by the Commonwealth of Australia, it needs to be comprehended the history and current position of the Aboriginal and Torres Strait Islander Nations.

The Yidindji Nation was excluded from the participation in the life of the Colony of Queensland and the Commonwealth of Australia, with the Commonwealth of Australia defining the people who took part in the conception of the Commonwealth of Australia as excluding the Aboriginal and Torres Strait Islander peoples, a position that stands today.

Should any man or woman who wants to participate in the life of the Commonwealth of Australia, they must adopt the use of an Australian identity, or one created by another UN member state, just like all other people when entering the Australian citizenry.

However, there is a conflicting position at law with this idea. The sovereignty of the Yidindji Nation has not yet been ceded to the Commonwealth of Australia, as identified in the Uluru Statement from the Heart meaning that the Commonwealth of Australia still does not possess the free, prior and informed consent from the Yidindji Nation to erect the Commonwealth of Australia upon the territory of the Yidindji Nation, and for that matter the territory of any other Aboriginal or Torres Strait Islander nation.

The Commonwealth of Australia is an occupational nation with a limited sovereignty, whilst the Yidindji Nation is the acknowledged true and correct authority still possessing the stronger continuing pre-1770 sovereignty, hence the co-existence of sovereignty.

The Commonwealth of Australia being within the territory of the Yidindji Nation is subject to the acknowledged authority of the Yidindji Nation, and it is in this forum of separation that the members of the Yidindji Nation can instruct its representative body, the Sovereign Yidindji Government, to consult with the Commonwealth of Australia regarding any issues that may be affecting them or their resources and lands.

In short, instead of creating a discriminatory representative body within the Commonwealth of Australia, the Aboriginal or Torres Strait Islander peoples must consider creating a representative body by the sovereignty of their Aboriginal or Torres Strait Islander Nation, and this is what the Yidindji Nation has done in creating the Sovereign Yidindji Government.

This is co-operation and consultation at a government to government level.

This method is not discriminatory, is not allowing any particular grouping of Australian citizens an advantage over another Australian citizen based on race, and allows the free, prior and informed consent to be granted to the Commonwealth of Australia to administer the territory of the Aboriginal or Torres Strait Islander Nation, whilst being the representative body for that particular Aboriginal or Torres Strait Islander Nation at the United Nations.

This method allows the Commonwealth of Australia to discharge its obligations in fully implementing the United Nations Declaration on the Rights of Indigenous Peoples as the true path to everlasting reconciliation between the Commonwealth of Australia and in our case the Yidindji Nation.

The Sovereign Yidindji Government has made numerous offers to the Commonwealth of Australia to enter into an everlasting method of formal agreement to settle the past and secure the future for all citizens within the Yidindji territory.

In the wake of the Uluru Statement and Native Title Determinations, the following points are now beyond dispute:  Sovereignty of the Yidindji Nation continues to exist from a time prior to that of the Commonwealth of Australia.  The sovereignty of the Yidindji Nation was neither extinguished nor ceded to the Commonwealth of Australia or any other nation.  The people of the Yidindji Nation were and still are excluded from the Commonwealth of Australia.  The members of the Yidindji Nation are not Australian citizens.  The Commonwealth of Australia does not possess consent from the Yidindji Nation to be present on the Yidindji territory through any formal agreement or treaty with the Yidindji Nation.  The Yidindji Nation is the true and correct authority of the area known by the Commonwealth of Australia as Cairns and Atherton Tablelands region.  The Sovereign Yidindji Government is the acknowledged representative body for the members of the Yidindji Nation.  The Commonwealth of Australia ratified the UNDRIP in 2009 with the intention of implementing it in full.  The Referendum Council consisted of Australian citizens of various races.  The Australian citizens have not had a vote to allow the members of the Aboriginal or Torres Strait Islander Nations to participate in the life of the Commonwealth of Australia.

All Australian citizens possess the necessary representation within the current structure of the Commonwealth of Australia, and this is demonstrated with the various members of both Houses of the Commonwealth of Australia having Aboriginal or Torres Strait Islander heritage.

Further, all Australian citizens including those of Aboriginal or Torres Strait Islander heritage, have the same civic rights and obligations, and it is this position that the Commonwealth of Australia is supporting with the rejection of the proposal contained within the Uluru Statement from the Heart.

The Sovereign Yidindji Government has released a Public Notice PN50 to inform the world of this position, to which you will find enclosed.

Joaquin, the Sovereign Yidindji Government would be forced to withdraw its support for the Commonwealth of Australia should the Commonwealth of Australia enter into racially discriminatory practices of allowing one group of Australian citizens from being able to influence or change the Australian Constitution or any other legal instruments based on race alone as outlined in the proposal put forward by the expert panel of the Referendum Council.

This would be a regressive step forward in reconciliation between the Commonwealth of Australia and the Yidindji Nation.
