Will it remain the primary source of data on residential properties or just one of many services available to real estate professionals and consumers?

Should an MLS offer a consumer­facing service? Officers And what is the value of MLS data to third­party services that repackage the listing information? One suggestion: Turn the MLS into a single point of entry for listing information and then upload that data to broker and agent sites as well as search engines and other third­party service providers. "Why should we have to enter the same data multiple times?" said one regional broker. Some MLSs are attempting to accomplish this through syndication agreements. Another opportunity for MLS organizations is to take advantage of their vast stores of market data and provide analytic services to key players in the real estate industry. "What if Fannie Mae or Freddie Mac (which manage the secondary market for residential mortgages) were to use MLS data to track the performance of their collateral?" asked one consultant. "That would help them to manage their investment risks and give confidence to their investors, improving liquidity in this difficult market."

New Appraisal Courses and Requirements Hondros Has New Courses and Requirements For Appraisal To improve the quality and consistency of appraisal data on loans delivered to government­­sponsored enterprises, the Federal Housing Finance Agency (FHFA) has developed the Uniform Appraisal Dataset (UAD). The UAD defines all fields required for an appraisal submission for specific appraisal forms and standardizes definitions and responses for a key subset of fields. Ethics 6 Easy Ethical Slip­Ups Bruce Aydt, REALTOR® Magazine columnist and real estate ethics instructor, receives hundreds of questions a year from REALTORS® who are confronting various ethical dilemmas. Here are some of the most prevalent problems that he's seen in the past year. 1. Not revealing your state of licensure On your Website, you need to include a note disclosing the state in which your hold your real estate license. The note could say something like "Licensed in Ohio", "Ohio Licensee" or "Ohio Broker" 2. Blogging or tweeting without making company affiliation evident In any real estate­related communications on Facebook, Twitter or other social media sites, you must include your company name in the posting or make it


accessible via a link back to your company name (like your username's link to a profile page). Your company name also must appear in all advertisements 3. Failing to disclose a short sale You have an obligation to know your MLS and state license laws rules on short sales and to disclose a potential short sale when it's required in those rules 4. Allowing false or misleading comments on your sites You should monitor your blogs, Facebook wall and pages and other electronic media regularly for any false or misleading comments about others and immediately remove any that you find 5. Giving unauthorized access to your listings You should make it clear to cooperating agents that they're expected to accompany buyers to the house. 6. Flipping, flopping or ignoring conflicts of interest Flipping and flopping are typically associated with short sales and involve clients buying a property from the lender at a discount and then selling it at a premium shortly afterward ­ often as soon as the next day. The inherent conflict is in the price differential, since there's no improvement to justify the difference in price. OAR News A closer look unveils home sales positives For the third consecutive month Ohio’s housing market posted gains over the monthly sales levels from 2009, an indication of progress for an industry that has felt the effects of the severe economic downturn that surfaced three years ago, according to statistics provided to the Ohio Association of REALTORS. http://www.ohiorealtors.org/news/stats/2011/may.pdf More homeowners staying current on mortgage The number of borrowers defaulting on their mortgages has dropped considerably compared to a year ago, according to Lender Processing Services' "First Look" report, which analyzed nearly 40 million mortgages. Nearly 8 percent of mortgages were 30 days past due­­but not in foreclosure­­in May, a significant difference compared to last year at that time. In May 2010, 18.3 percent of mortgages were 30 days past due. Overall, about 4.2 million mortgages were delinquent in May, 1.9 million of which are 90 days or more past due, considered the most severe, according to LPS. Source: NAR Mobile apps that help you save money You can use your smartphone to help you shop smarter and save money with a range of mobile apps. With several apps­­such as RedLaser, Android Barcode Scanner, and SnapTell, you can use your phone to scan bar codes of products at stores to check prices and comparison shop to find the best deal, or even find reviews on products to determine if that’s the smartest purchase.


Here are some other recently debuted mobile apps that are helping consumers save: Add to your piggy bank: NC Bank’s mobile app for its customers includes "Punch the Pig" features, so when you have some extra money, you tap the pig icon on your phone and it’ll transfer money from their checking account to their savings. Determine the best time to buy: E­commerce sites are constantly changing prices over a week timespan. A new app, Shopobot, helps shoppers track prices and decide when it’s the best time to buy such items as electronics. It can send you alerts when a price declines to a certain price. The app constantly crawls the Web sites of 12 retailers, such as Amazon.com, Walmart.com, and Newegg.com, to offer the latest prices. How will this impact retirement: Putnam Investments recently launched an iPhone app for its 401(k) plan participants that shows how their purchases can even influence their retirement income years to come. By scanning bar codes of products with the iPhone, the app then combines price checks with the participants’ retirement account information and calculates how their future retirement monthly income can be changed by shopping decisions. If this happens, many of your clients run the risk of being priced out of the American Dream of home ownership. Even worse, this could hold back the housing recovery. Preparing for Brokerage Audits Ensuring Compliance with Real Estate License Law: The Ohio Division of Real Estate is Here to Help As a means to help our licensees comply with Ohio real estate license law and to keep them working, the Division has decided to kick­start its brokerage audit process after putting it on hold for the past few years. This decision is in agreement with the directives set forth in Governor Kasich’s recent Common Sense Initiative. When asked about the role audits play in the overall compliance of brokers, Superintendent Petit responded, “We believe that working proactively with our licensees through positive instruction, when appropriate, instead of reactionary, punitive discipline will be beneficial to the Division, its licensees, and Ohioans in general.” 1) How will you know if the Division selects your brokerage for an audit? You will receive a telephone call from a Division investigator if you have been selected for an audit. Brokerages selected for a compliance audit are chosen at random from those companies in the Division’s database that have not had an audit in the past 36 months. During this initial conversation, the investigator will work with you to schedule a date and time to conduct the audit. The investigator will then send written confirmation of the scheduled audit along with a list of the items the Division will inspect during the audit. 2) How long will the audit last? Compliance audits can last anywhere from a few hours to several days, depending on the size of the brokerage. Most single office brokerage audits take just a few hours.


3) What can I expect after the audit? The Division will notify the brokerage in writing of any discrepancies found during a compliance audit and will allow the brokerage a reasonable amount of time to correct them. Once the Division receives documentation from the brokerage verifying that the discrepancies have been corrected, the investigator will send correspondence to the brokerage indicating that it has come into compliance 4) How can a brokerage prepare for a compliance audit? There are several preparatory measures you, as a broker of the company, can take to ensure that the audit is successful. First, take a deep breath and relax! Although the audit may reveal discrepancies between your business processes and Ohio real estate license law, the Division’s main goal is to work with you to help you comply with the law. The most important key to a successful audit is cooperation with the investigator conducting it. The links below are helpful tools for brokerages to utilize when preparing for an audit. Craigslist Rental Scams: What Do You Do? We continue to receive reports at YCAR that Craigslist rental scams are still ongoing. If you find that your listing has been falsely listed as a rental on Craigslist by someone else, please take the following steps: 1. Alert Craigslist to flag the posting as a scam 2. Contact the seller to alert them of the false Craigslist posting 3. Follow up on Craigslist and review the site to ensure the faulty posting is removed 4. Do periodic internet searches to ensure your rental properties are accurately listed on authorized sites

REALTOR® SAFETY Becoming a Road Warrior: Avoiding Dangerous Situations in Your Car by Andrew Wooten Last month we talked about the basics for your home; locks, lighting, and landscaping. Remember to keep all your locks (on doors and windows) locked and install motion detector lights all around your home. And don't forget the 3 Foot/10 Foot Rule for your bushes and trees. This month we want to discuss how to get you safely from your home to your destination. Leaving Your Home First, let's discuss how you leave your house. If you're like most people I know, you leave your house (especially in the morning) hurried and carrying a lot of stuff. You're most likely on the phone too. If you're parked in your garage, you open the garage door as you walk out, put your stuff in the passenger seat or the back seat, get in and go. But did you take a moment to look around for anything suspicious? Do you realize how easy it would have been for someone to walk up and grab you as you stood outside your car chatting on the phone or messing with some files in your briefcase? So how do we make leaving a garage safer? First, don't open the garage door until you are ready to pull out. Put your stuff in your car, get in, turn on the car, adjust your mirrors and buckle up before you open the garage door. Also, if at all possible, when you park in a garage, pull in backwards. This way once you open the door you can see straight out into your neighborhood. If you don't have a garage, take a moment and look outside before you leave your house. If you see anything suspicious, don't go outside, contact local law enforcement. If the neighborhood looks secure, walk quickly to your car, get in and get going. Do not spend a lot of time doing other things while you sit in the car in the driveway. Driving The best things you can do to prevent dangerous situations on the road is by staying aware and keeping your car well maintained. We all make phone calls while in our car, even though our main focus should always be on the road. But take a few moments when you stop at a red light or stop sign to look around and be aware of what's going on around you. If something seems suspicious or makes you feel uncomfortable, pay attention to it. Wait to make that phone call or send that text message. And remember that nothing, not even your car, is worth


your life. Accidents and breakdowns are going to happen. So let's be prepared for them. Always keep a Roadside Emergency Kit in your car. In addition, keep some comfortable shoes and clothes, a sweater and some water. You may have to walk a long distance to get help. You should also have a sign that reads, "Call Police," in case you find yourself in an area with no cell phone service. Stay inside your car with the windows up and the doors locked while you wait for help. Next month we will continue our conversation on safety basics. Affiliate Spotlight

Hello, I would like to introduce myself to those whom do not know me. My name is Linus Orr. I am the owner of K.E.L. Home Inspections Company. I have been performing home inspections in northeast Ohio for the past 17 years, which makes K.E.L. Home Inspections the third oldest continuously operated home inspection service in the Mahoning, Trumbull and Columbiana County areas. In the beginning, I earnestly attempted to perform my inspections to ASHI inspection standards. I never claimed to be certified when I was not, and never performed Radon testing without a license. Now, I strive to raise inspection standards. Like all competent Home Inspectors, I am trying to elevate the inspection business to the level of a profession, such as an electrician. I am a proud certified member of the AMERICAN SOCIETY of HOME INSPECTORS (ASHI). ASHI certified members will now use the acronym ACI, which stands for ASHI Certified Inspector, after their name. This will legitimately distinguish ASHI Inspectors from the others due to AHSI's recent recognition by NATIONAL COMMISSION for CERTIFYING AGENCIES as the only accredited Certified Home Inspection Program based on a true and verifiable third party accreditation. I do hold a State of Ohio license as a Radon Tester. Working as a Home Inspector, I do not manufacture anything. I cannot show anyone something and tell them “this is what I make, how do you like it?” I have always understood I only have my appearance and reputation to rely on. From my “uniform”, the familiar blue and white striped shirts and khaki pants, to my experience, education, integrity and eye for detail, I project an aura of professionalism and confidence that puts even the most nervous and discriminating buyers at ease. It is often said the length of time I spend on site with my clients causes undue alarm or is not necessary. Yes, on average, I do spend more time with my clients than most of my competitors spend with theirs. However, I do not feel it is a detriment. The extra time I take to answer my clients' questions and explain what they will read in my report, makes the rest of the transaction proceed easier and quicker for everyone else involved. I enjoy working with the members of this organization and participating in its many functions. I have established great working relationships with many of the REALTORS® and Affiliate members and have made some life long friendships as well. I am proud to have been part of the core group that started the Lunch and Learn Program, and I participate at every opportunity to provide information on the ever changing standards and updates pertaining to the home inspection industry. YCAR Offers Quarterly Dues Payment Service In order to relieve the financial strain of paying your annual REALTOR® dues on December 1st (during the holiday season), the Youngstown Columbiana Association of REALTORS® will continue to offer a voluntary quarterly dues payment service in 2011. The quarterly dues payment service is available for members who have already paid their 2011 dues and wish to begin paying ahead their 2012 dues. How to Pay Your 2012 Dues Ahead... By March 1, 2011, remit a payment of $120.50 By June 1, 2011, remit a payment of $120.50 By September 1, 2011, remit a payment of $120.50 By December 1, 2011, remit a payment of $120.50 Advance dues payments in amounts different than the quarterly payments outlined above will also be accepted (minimum $100.00). You will receive a 2012 dues invoice with any adjustments to your balance on November 1, 2011 with the remaining portion of your 2012 dues payment due by December 1, 2011. If you choose to take advantage of this quarterly dues payment service, however by December 1, 2011 you decide not to continue your REALTOR® membership for 2012, your entire 2012 advance dues payment will be refunded. Action The Directors of the Association took the following actions during the month of June 2011:

Approved the agenda without any additions. Approved the minutes of the May 5, 2011 Director’s meeting as written.


Filed the Association’s Financial Statement for April for review. Tabled the review of the Association's Financial Statement for May 2011 until the July Directors' meeting. Committee Reports were filed as follows:

Education Committee RPAC Committee Trade Fair Committee Golf Outing Committee REALTOR® Of The Year Selection Committee Reported that Debbie Parisi of RightPlaceRealty.com was selected as the Association’s 2011 REALTOR® Of The Year. Tabled the evaluation of the Chief Executive Officer until the July meeting of the Board of Directors. Reported on the actions taken by the NAR Directors at the recent NAR Legislative Conference in Washington, DC and on the meetings with Congressmen Bill Johnson and Tim Ryan. Approved the provisional REALTOR® Membership of four applicants; the reinstatement of REALTOR® Membership of one applicant and the approval of one Affiliate Member applicant. Informed the Directors of the new format of the Association’s on­line monthly publication, The Mahoning Valley REALTOR®. Informed the Directors that Steve Merkle from the Akron Area Board of REALTORS® is delaying his candidacy for the position of OAR Treasurer until 2013. Endorsed Nancy Eubanks of the Springfield Board of REALTORS® for the position of 2012 OAR Treasurer. Read thank you notes from Abigail Seguin, this year’s recipient of the Association’s $1,000 scholarship to YSU, and her mother REALTOR® Bobbi Seguin. [Back to Top]
