In Georgia, surrogacy is allowed for married and unmarried heterosexual couples with medical indication. The rights of the intended parents are protected by law and they are considered the legal parents of a child from the moment of conception. A surrogate has no right for the child and the agreement between the surrogate and the intended parents is legally enforceable. The official Birth Certificate issued by the Georgian Registry Office lists names of the Intended Parents.
If a couple is married, then it is necessary to present the original Marriage Certificate, apostilled or legalized (depending on the country of issue).
If a couple is not married, then it is necessary to submit documents that will allow the notary to certify the cohabitation period of at least one year.
All of the above must be dated at least one year before starting the program.
The intended parents also need to present a Medical Certificate showing previous infertility treatment. Although Georgia does not set forth exact medical indications for surrogacy, the clinics in Georgia enroll the intended parents for treatment based on the previous medical history.

Surrogate Support:
• surrogate transportation to / from the clinic for regular appointments
• accommodation for the surrogate in Tbilisi (from week 28 with a single pregnancy and week 26 with twins)
Delivery and Exit Process
Clinical Procedures:
• childbirth at a private maternity hospital
• paternal DNA test
Full Surrogate Compensation during pregnancy and after birth
Post-Birth Support:
• private room for the IPs at the maternity hospital
• consultation with a neonatologist at the maternity hospital
Legal Assistance:
• assistance with a birth certificate
• preparation of all documents necessary for the exit process, apostilization/legalization
• surrogate visits to the embassy/consulate (if required)
