Just like in the US, each individual Mexican state regulates surrogacy in its territory. In 2021 Mexico joined the short list of countries where compensated surrogacy is legal for married, single, gay, straight and foreign Intended Parents. The Supreme Court’s decision made surrogacy a protected medical procedure across all of Mexico. An agreement between the surrogate and the intended parents is legally enforceable.
The clinics require neither Marriage Certificate no Medical Certificate to start the process.
The Birth Certificate will list a surrogate mother and a genetic father as legal parents of the child.
If so required, it is possible to change the second parent in the birth certificate through the court procedure. Thus, a ge netic father’s partner can be named a second parent instead of a surrogate mother.
WCOB provides full legal support and assists in obtaining all the necessary documents to help the intended parents safely leave Mexico with the child/children.
