WhentheGovernmentreformedpublicservicepension schemesin2014theyintroducedprotectionsforolder members.InDecember2018,theCourtofAppealruledthat youngermembershadbeendiscriminatedagainstbecause theprotectionsdidnotapplytothemandallpublicsector schemes,includingtheLocalGovernmentPensionScheme (LGPS),hadtoremovethisagediscrimination.Thisrulingis calledthe'McCloudJudgment'afteramemberofthescheme involvedinthecase.
From1October2023,theLGPSruleschangedtoremovethe agediscriminationasaresultoftheMcCloudjudgement.
Thereweremanychangesto theLGPSrulesfrom1October 2023becauseoftheMcCloud Judgement,whichmeans thereisahugeamountof worktodotogatherthe informationneededand recalculatethebenefitsdue. Thisworkisongoingandwe arecontactingthosedirectly whoareentitledtoanyuplift inpensionasaresultofthis exercise.
